Job Creation in Orange County Since taking office in 2011, I have made it a priority to strengthen and diversify our local economy. Our unemployment rate has dropped 3.3%and over the past year, we have assisted in 11 economic development projects that promise to bring more than 1,200 new high-wage, high-value jobs to Orange County.

Tax Incentives for New Jobs Orange County voters passed a referendum that allows the Board to provide limited, temporary property tax breaks for new or expanding businesses that create high-value permanent new jobs in various targeted industries. Each proposal will have to undergo the scrutiny of Orange County staff, the Board and the citizens via public hearings and must be enacted by a separate ordinance.

I say that time and time again as I have the honor of welcoming visitors like you to our Central Florida community. As a matter of fact, Orlando welcomed 55.2 million visitors in 2012. We are the first destination in the United States to surpass 50 million visitors in one year. In 2012 the BCC approved a major five-year, $185 million renovation program at the Orange County Convention Center to keep the center in modern condition and enhance its marketability. In April, SPI, the Plastics Industry Trade Association hosted NPE2012 at the Center and will be returning in 2015. NPE, the International Plastics Showcase, is the largest plastics technology and manufacturing exposition in the world and one of the biggest trade shows in the United States. With 1,900 companies represented and over 55,000 registered attendees, the estimated economic impact of the four-day global conference was pegged at approximately $114 million. Other events included the International Builders’ Show, with its more than 51,000 attendees and economic impact of $97 million and Star Wars Celebration VI, which provided an estimated $28 million impact. orlando green and yellow 

NBA All-Star Game at the Amway Center NBA fans and players from across the country and around the world descended upon Orange County in February for the 2012 NBA All-Star Weekend at the Amway Center and the Orange County Convention Center. The economic impact was approximately $95 million.

Economic Development Outreach to South America I lead two trade delegations to Colombia last year and made two major economic development announcements after the missions. The Bio-Energy Conference of the Americas (BECA) committed to bringing their trade show to Orange County in 2014. The conference brings international experts, companies and higher education institutions together to showcase the latest technologies and advancements in renewable energy. Additionally, Avianca now provides a daily nonstop flight from Bogota to Orlando International Airport. This new flight will have an annual estimated economic impact of $16 million.

Global Trade Series, which focuses on engaging local businesses in the promotion of global trade in Central Florida. Meetings included Doing Business with Columbia; Doing Business with Puerto Rico; the European Union Showcase; and Brazil: A World of Opportunities. The latter focused on the opportunities we learned from my trip to Sao Paulo with Florida Governor Rick Scott and the potential market Brazil represents to our local business owners.

Passenger Rail Advances in Central Florida SunRail, Central Florida’s commuter rail project, is moving ahead toward commencement of service on Phase 1 in 2014. Progress also

continues on All Aboard Florida, a proposed privately-owned 240mile passenger service route which would run North-South on existing right of way from Miami to Cocoa, with new tracks planned to connect to Orlando International Airport and SunRail. Future plans also envision extending the service to Tampa and Jacksonville. This is only a snapshot of what is going on in Orange County. for brazilian investments in the U.S.

T

he U.S. continues to be the most attractive country for investment of foreign capital, in this case, brazilian. In the real estate area prices have fallen so much because of the crisis that it can be said that real estate today is cheaper than in Brazil and still much cheaper than in Europe. The U.S. is considered a safe place to invest because of its stable government and strong economy, as well as strict regulations which protect investors from fraud. The opportunities also in the industrial and commercial area are fantastic. At any rate, the country really is the “Mecca” for foreign investment. This is proven by the fact that Brazil is the largest foreign investor in productive investments in Florida. Thus, investors as Embraer and others chose Florida for their investments. However, the U.S. also has an extremely complicated regulatory system. The legality in the country is taken very seriously and violations are severely punished. Thus, brazilian investors should be very careful not to violate the law, because the consequences can be onerous, both financially as well as in jail sentences if there is a criminal violation. Tax rates on foreign investment in the US have historically been lower than those of other developed countries. However, investment in a US business or real estate will result in liability for US income tax on the income received from that

investment, and a portion of that income may have to be withheld and remitted to the US Internal Revenue Service. It is critical to make sure that the investor does not have to pay tax on the same income to both the US and Brazil. Thus, it is essential to consult with a tax advisor who knows and understands the tax rules of both the US and Brazil for taxation of international investments. Contracts are enforced to their letter and the terms are not always very clear to brazilian investors. In addition, the U.S. legal system is different from what brazilians are familiar with. There are planning

techniques available that can be very useful for asset protection and also in the organization of the family and hereditary succession. Hence, for example, a properly formed and documented trust can provide the possibility that legal ownership of an investor’s property and assets in the name of a trustee, which will protect them against potential creditors and minimize liability for US inheritance tax. In view of these facts, it is imperative that brazilian investors always seek the assistance of competent lawyers who have knowledge of both laws in american and brazilian jurisdictions.

The demand for investments on the real estate business from Brazilians here in Central Florida is getting bigger. The notable increase from Brazilian investors came to the attention of Brazilian realtors as well, and now they are trying to understand the local businesses and learn on how to help their resident clients on generating relationships and lucrative deals.

W

ith that goal, a delegation of realtors from Brazil was created with connections from the 1st CIMI - Conference of Real State that took place in August of 2012 in Brasília. After the event, the professionals from Orlando and Brazil started to develop a plan of educational visits to inform Brazilian realtors on how we operate, the opportunities of investments and lucrative tools with this new partnership. The delegation was possible thanks

to important agencies that are allowed to work in Brazil, Cofeci and Creci, and planned by a Brazilian event planning company, Taurus Marketing, of president Daniel Rosenthal; Moneycorp, a company of international transactions; Colwell Banker, real estate business with its headquarters in Brazil; and ORIC, the Association of International Realtor Agents of Orlando. The event took place in November of 2012 along with the NAR (National Association of Realtors) fair that takes place annually in the United States; this year it took place in Orlando-Florida. Among the speakers we had representatives of the Orlando government exposing developmental economic facts from the city, as well as local specialists explaining each step of the real estate purchase process, including how to finance for foreigners, how to transfer funds from Brazil to the United States, local taxes and other information. The delegation was a huge success, with the beginning of a lot of partnerships; one positive fact that shows how professionals from Orlando are embracing business relationships between the Americas.

An UPDATE on

Deferred Action for Childhood Arrivals As previously reported, the Department of Homeland Security announced on June 15, 2012, that they will not prosecute certain individuals who were brought to this country as children and are now without any status in the United States. These children are often referred to as “Dreamers” because they dream of a future where they can obtain driver’s 16  orlando

licenses, attend college and work legally without a daily fear of being caught by the immigration authorities and deported back to their home country. In most cases, these are innocent children who were brought to the United States when they were young and had no choice in deciding whether to stay unlawfully or return to their home countries; in most

cases, they had no idea that they were unlawful until they became older and were restricted to do things other lawful children were allowed to. As such, effective August 15, 2012, these “Dreamers” will not be placed into removal (i.e. deportation) proceedings, if they meet and prove certain requirements. If approved, they will be able to obtain a


relief called Deferred Action in two-year increments (which prevents them from being deported), and obtain work authorization (allowing them to work legally and obtain a valid social security number, a valid driver’s license, and/or identification) that enable them to live in the United States with Citizenship and Immigration Services (“CIS”) authority. Unfortunately, based on recently published statistics, many eligible individuals are not taking advantage of this relief. Whether they are uncertain as to what the law requires or provide, whether they were worried about what would happen in the recent elections, or whether they are afraid of what will happen in 2 years, many eligible individuals are simply not applying. In fact, as of December 13, 2012, CIS has only received about 356,000 cases. Yet, in accordance with the American Immigration Council, it is estimated that approximately 1.4 Million individuals are eligible, from which approximately 110,000 individuals (including more than 30,000 in Florida alone) are of South American descent. Further, the statistics published by CIS confirms only about 4,800 applications received were from Brazilians. Thus, this article shall clarify the requirements for eligibility and explain why hiring an Immigration Lawyer is necessary. First, to be eligible for deferred action, applicants must:  be age 30 or below on June 15, 2012;  have come to the U.S. before the age of 16;  have continuously resided in the U.S. since June 15, 2007 up to the present time;  have been physically present in the U.S. on June 15, 2012;  be in unlawful status as of June 15, 2012 or have entered the U.S. without inspection;  be currently in school, have graduated from high school, have obtained a GED, or is an honorably discharged veteran of the Coast Guard or Armed forces of the U.S.; and  have not been convicted of a felony offense, a significant misdemeanor offense, multiple misdemeanor offenses, or otherwise pose a threat to national

security or public safety. Second, although the requirements mentioned above may appear to be straightforward or simple, it is clear that looks can be deceiving and with no right to appeal the decision made by CIS, it is in the applicant’s best interest to retain an experienced Immigration Lawyer. There are many factors of concern but below is a list of a few concerns that only an Immigration Lawyer can evaluate:  if the individual has been in any contact with law enforcement. It is important to understand that matters that may be minor in Criminal Law may be major in Immigration Law, even if the matter was dismissed  if the individual has had any previous filings or cases with CIS, it is important to determine whether the information previously provided may now hurt his/ her chances  if the individual has ever left the U.S., it is important to determine whether this exit resulted in terminating his/her “continuous residency”  if the individual ever used falsified documents, whether a fraudulent passport upon U.S. entry, a made up social security card, a falsified greencard, falsified information/documents on an I-9 form when applying for a job, false claim to U.S. citizenship, or even if the individual used a family member’s identification to obtain a driver’s license. All of these questions are vital in

determining whether the individual should apply for deferred action. With the elections behind us and both the President and both sides of Congress willing to discuss Immigration Reform, deferred action is likely to stay and be extended for many years to come. As such, meet with an experienced Immigration Lawyer to see if you or a loved one is eligible for the relief.

SunRail, Central Florida’s first commuter rail line, will run along a 61-mile stretch of existing rail freight tracks in Orange, Seminole, Volusia and Osceola counties. SunRail will create 250,000 construction related jobs with an income of $8.8 billion impact over the next 30 years. Also, the initial stage construction of The Dr. Phillips Center for the Performing Arts will create approximately 3,000 new jobs, and by the time stage two is done, there will be more than 4,000 new jobs with an estimated economic impact of $315 million.This modern center will provide a unique, world-class destination to showcase and support the performing arts. The renovations of the Citrus Bowl expected to start in early 2014, will 20  orlando

create up to 1,750 construction jobs. These renovations will help us to continue hosting college bowl games that have generated a $320 million local economic impact during the past four years, boosting business at area hotels, bars, restaurants, theme parks and more. This is an important milestone for our community as it ensures we don’t lose our Bowl Games and the tens of millions of dollars they bring. Additionally, this will allow for more neutral site football games, international soccer games, Wrestle Mania, Monster Truck and Motocross events and more to return to the Florida Citrus Bowl. The Creative Village will be another economic engine for our city and it’s going to be built in a 50-acre site where the Amway Arena was located. This innovated community builds on the success of Orlando’s digital media industry by transforming the former site of the Amway

Arena in Downtown Orlando into a 68-acre mixed-use, transit-oriented, urban infill neighborhood that will be home to leading higher education providers; high-tech, digital media and creative companies; and a diverse mix of students, employees and residents. Creative Village fosters a “live, work, learn and play” lifestyle in the heart of Downtown Orlando while bringing exciting opportunities to the Parramore area. The job creation study for the Creative Village estimates there will be 6,500 jobs created in the local economy over the construction period. At build out, there will be close to 5,000 permanent jobs, with more than 8,000 total jobs in the local economy related to the Creative Village. Orlando has a bright economic future ahead. From Lake Nona’s Medical City to our Downtown resurgence and the Creative Village with UCF’s Center for Emerging Media, the Florida Interactive Entertainment Academy and House of Moves, Orlando will continue to diversify its economy by attracting these highvalue and high-wage jobs that will drive the future of Central Florida and grow the next generation economy.

ately, the opportunities in the real estate market in Florida are vast. From land to condos, vacation homes, luxury houses and warehouses, even condos under construction; it will all depend on your goal and your investment capital. A lot of investors start slowly, buying at first one property, to learn the steps of the process and then invest on more properties. The so called Vacation Homes are those with short term rent agreements. They are normally located on the Kissimmee area and these houses can be managed by management companies. That’s the most popular alternative for brazilian investors since Florida is such a touristic reference, who comes to visit once normally comes back, so investing in properties is an attractive alternative to save money with hotels and to have more freedom and privacy

at the same time. With the money collected from renting the owner normally can pay the expenses with taxes, insurance, management and still have a little left. If the plan is to move to Florida or have your own property with no intentions to rent, condos or homes in residential areas are an attractive alternative. The most popular cities besides Orlando, are the ones surrounding it, like the charming Winter Garden, Windermere and Winter Park, among others. You can find homes or condos in different price ranges, but normally they are cheaper than in Brazil and capital appreciation is probable. If you are looking just for an investment, investors try to diversify with different properties, residential and commercial. The financial return can vary on 5 to 12% annually, depending on location, taxes, expenses with the property, among other factors.

Orlando sports four major shopping centers that all add their unique style and blend of stores to fill any palate. The Florida Mall (Located at 8001 S. Orange Blossom Trail) houses several stores indoors anchored by some of the largest name brands like Macys’, Sears, Dillard’s, JcPenneys, and Saks. The Premium Outlets (Located on both ends

of International Drive) boasts two outdoor malls that cater to the outlet shoppers. The Millenia Mall (Located 4200 Conway Road) features a more upscale approach and boutique style shopping. Every mall in Orlando caters to the international and domestic traveler with their concierge services, maps and coupon booklets, language services, and money exchange centers. Several employees in many of the stores you will find now speak Portuguese, Spanish,


and other languages to better facilitate the needs of the consumers. Even individual stores are finding ways to bring in international customers by working directly with tourism companies and operators as well as FITs. (Foreign Individual Travelers). The Sports Authority (881 Sandlake Road) offers coupons, incentives, and transportation packages for groups and individuals. CompUSA (7802 South OBT) offers incentives and coupons and programs tailor made in Portuguese to help those set up computers back home as well as tablets, cameras, and all other electronic needs. Macy’s (FLORIDA MALL, MILLENIA MALL) offers special discounts and programs as well for operators. The point is, American companies are beginning to search outside-of-thebox to develop sales. Harnessing the power of the tourism industry is one way to not only help stimulate our economy, but also build bridges overseas. Possibly one day, we might see a Sports Authority open in Sao Paulo, Brasil as an example. It is imperative that measures are taken to broaden the landscape and understand we all need each other. Right now, Brasil is the flavor of the year. The 2014 World Cup is coming, the Olympics, new trade agreements, etc….Brasil is riding a tidal wave of good fortune, and America could use a little good fortune right now. Argentina is showing up in huge numbers in the Orlando area too.

It’s not always going to be like this. All demographics overseas are important. The cycles just changes every five or six years. Not too long ago, England was the top producer in Orlando along with Canada. Japan used to be more powerful in these areas too but a Tsunami and economic changes have altered their production. It is always cyclical. Orlando is no longer known as just the destination for going to theme parks. Tour operators and travel agencies are searching for ways to include shopping days on their itineraries. It is a requirement now. Shopping has become a part of every trip, and will continue to grow in importance.
