Agency Relationship There are two primary agency relationships in the state of Florida. Berkshire Hathaway HomeServices Florida Network Realty believes that Single Agency provides the highest level of client service and representation afforded by Florida law. Here’s the difference and why it should matter to you. 1. SINGLE AGENCY

The highest degree of accountability comes with Single Agency. As a Single Agent, the REALTOR® or Broker enters a fiduciary relationship and owes complete allegiance to the seller or buyer. By law, the agent must work to achieve the best terms for their principal. There are four key benefits a buyer or seller receives with Single Agency that don’t apply to Transaction Brokerage: Loyalty, Confidentiality, Obedience and Full Disclosure. Simply put, REALTORS® who are Single Agents work to serve the best interests of their principal.

2. TRANSACTION BROKERAGE

A Transaction Broker is the default role of a Broker or REALTOR® in Florida and does not represent the buyer or seller, but instead acts as a neutral go-between to help both parties complete a home sale, operating with limited confidentiality. While a Single Agent acting as a buyer’s or seller’s agent has a duty to act in the best interest of the party they represent, a Transaction Broker is required only to act in a way that is honest and fair to both parties while disclosing all known material facts, but is not permitted to negotiate or offer opinions to buyers or sellers.

TRANSITION TO TRANSACTION BROKERAGE Florida law requires that when a single brokerage firm is involved with both the listing side and the selling side of a transaction, the professionals involved must work in a Transaction Agency relationship. WHAT ALL OF THIS MEANS TO YOU You are a seller working with a REALTOR® and your home is listed for $290,000. Your REALTOR® calls a brokerage firm that is working with a buyer who is interested in your home to find out when the buyer plans to make an offer. During discussion, the buyer’s broker mentions that the buyer is already pre-qualified up to $300,000 and has lost out on two homes already so they are very eager to submit their offer and are hoping it works out.

The Home Selling Process


You: The Most Important Piece You have the most important role in the home selling process. Here are some ways your participation contributes to a successful sale:

• Maintain the property in ready-to-show condition. • Be flexible in scheduling showings and make sure a lockbox is used for ease of showing. • If approached directly by a buyer who is not represented by a real estate professional, please contact me. Do not allow them into the property unescorted. This is for your safety and to ensure buyers are qualified. • Remove or lock up valuables, jewelry, cash and prescription medications. • If possible, leave the home when your property is shown. • Securely contain pets or take them with you for showings.

• Be cautious about saying anything to buyers or their REALTORS® that could weaken your negotiation position, especially regarding price or your urgency to sell.

• Let me know of any suggestions you have - no one knows your home better than you!

• Collect the business cards of REALTORS® who preview and show your home and provide them to me for follow-up. • Let me know of any change in the property’s condition that would need to be disclosed to potential buyers. • Be available to review the list price and condition of your property if it has not sold in a reasonable period of time.

Dress Your Property To Impress You only have one chance to make a first impression. This is especially true from a buyer’s perspective. Be sure your home’s first impression is the best one by following a few simple guidelines. EXTERIOR • Remove clutter including toys. • Spruce up lawn, shrubs, and plants. Fresh mulch is a nice touch.

INTERIOR • Replace worn carpets and drapes. Add cheerful pillows to sofas and beds. • Clean overstuffed closets and cabinets. Minimalism is key.

• Pick up after pets. • Remove grease or oil spots on the driveway. • Repair any peeling paint or rotten wood.

• Open blinds and curtains to let in natural light.

• Bathrooms should look open and airy. Add a basket filled with spa treatment products and fresh towels.

• Remedy pet, food and cigarette smoke odors.

• Play soft background music during showings.

• Remove or replace anything that looks old or worn. Pay close attention to door hardware and lighting.

• Replace or remove peeling paint, smudges, or marks on walls and doors.

• Park cars in the garage or on the street, leaving the driveway clear.

• Keep visible personal photographs and family heirlooms to a minimum.

CURB APPEAL • What is your first impression of the home and yard area?

HOME STAGING • Define the space.

• What are the best exterior features of the home? How can they be enhanced? • What are the least attractive exterior features of the home? How can they be minimized or improved?

• Dress the kitchen with large bowls of fruit like apples, bright oranges, and luscious grapes. Arrange a few colorful cookbooks on the counters and put away appliances and countertop clutter.
