uby Beach Brewing Co. opened its new location Aug. 5 at 228 E. Forsyth St. because of the owner’s belief in Downtown Jacksonville’s potential and the continued popularity of craft brewing. While sitting in his new taproom, watching pedestrians walk by, Ruby Beach owner Mark Vandeloo spoke of how the day was a long time coming.

“Nobody lost more sleep than I did trying to get this place open,” he said. The pandemic shutdown in March 2020 affected his plans. Vandeloo and building owner Petra knew it would take time to create a brewery, taproom, event space and patio in the two-story, 3,100-square-foot building that was developed in 1904. It was not easy, but he considers it worth it. In December 2019, Vandeloo signed a 10-year SEE RUBY BEACH, PAGE 6

The unfinished Berkman Plaza II high-rise in Downtown Jacksonville has a tentative date with demolition — 7:30 a.m. Oct. 17. That’s when project contractor Pece of Mind Environmental Inc. wants to implode the 18-story riverfront shell structure, according to documents sent Aug. 27 to the city. Pece of Mind President Steve Pece said it filed an amended demolition permit application with the city the same day. Structural concerns found Aug. 19 halted demolition on the 14-year-old building at 500 E. Bay St. The contractor was using a high-reach excavator to take down the building. After an independent inspection, Pece said Aug. 23 implosion is “the safest way” to complete the demolition. Pece of Mind plans to subcontract Phoenix, Maryland-based Controlled Demolition Inc. to design and install explosive charges for the implosion. Controlled Demolition also imploded the old City Hall Annex in 2019. Pece said crews will need three to four weeks to prepare the Berkman II for implosion after the city approves the amended permit. It will take about two weeks to remove rubble from the site, he said. The contractor plans to complete the job by the end of the year. Jacksonville Riverfront Revitalization paid $5.503 million for the property April 21 and intends to redevelop the site as apartments and retail space.

Minneapolis-based Target announced in February that the “new shopping experience” debuted online. Target began to roll out in select locations that month. It announced at least 17 locations to start, including four in Florida in Clearwater, Gainesville, Miami and Orlando. Target’s news release said there would be “additional locations rolling out in 2021 and beyond.” “The retail collaboration builds on Target and Apple’s more than 15-year relationship by combining Apple’s latest products with the convenient shopping experience and fulfillment services Target’s guests love,” it said. THE BASCH REPORT

Triple S deal continues GuideWell expansion

MARK BASCH CONTRIBUTING WRITER

Florida Blue’s parent is buying the Puerto Rican licensee of the Blue Cross brand. As the Puerto Rican licensee of the Blue Cross Blue Shield insurance brand, Triple S Management Corp. seems like a natural merger fit for GuideWell Mutual Holding Corp., parent of Florida Blue. However, Triple S said the shared branding was not the impetus for the $900 million merger agreement announced last week. “Blue system consolidation was not the driver for this transaction. The transaction was driven by what we believe we can accomplish together through collaboration,” publicly traded Triple S said in an FAQ (frequently asked questions) posted in a Securities and Exchange Commission filing. Jacksonville-based GuideWell is a not-for-profit mutual holding company. Its main business is operation of Florida

Triple S Management

Triple S Management Corp. is becoming part of GuideWell Mutual Holding Corp., the parent company of Florida Blue.

Blue, one of 35 independent Blue Cross Blue Shield health insurance companies. However, the company has been expanding in the past decade beyond its primary mission of insuring Floridians. “To reimagine health care, increase access and create healthier communities for our members, we have taken steps to diversify and grow our business, both vertically as a Florida-focused insurer and horizontally as a health solutions enterprise with an increasingly national footprint,” GuideWell said in an FAQ sent to employees last week. “That diversification has taken us from an $8 billion company in 2011 to a $20 billion company in 2020,” it said. Triple S reported $3.7 billion

in 2020 revenue. “Florida Blue and Triple S have complementary capabilities, cultures and expertise,” GuideWell CEO Pat Geraghty said in a video message as the merger was announced. “Joining forces will strengthen Florida Blue’s ability to grow in the Medicare Advantage segment and in the rapidly growing Puerto Rican and Hispanic segments across commercial markets given Triple S’s strengths in both areas,” he said. Although they are independent companies under the Blue Cross Blue Shield brand, Geraghty and Triple S Chief Executive Bobby Garcia-Rodriguez have worked together in the past, Triple S said in its FAQ. “Our organizations and lead-

ership teams have long known and respected each other. Pat and Bobby have served on the BCBSA Board together for a number of years,” it said. “The idea for the combination is rooted in that relationship and shared values. In addition, the number of Puerto Ricans who have come to Florida since Hurricane Maria has advanced the natural synergy between the Puerto Rican market and the Puerto Rican and Hispanic markets in Florida.” Upon completion of the merger, expected in the first half of 2022, Triple S will continue operating as a subsidiary of GuideWell with its current management. “We do not expect that employees will be asked to relocate as a result of this announcement,” GuideWell said in its FAQ. “Following the closing, we expect little to no impact for our teams as a result of this transaction,” it said.

Medtronic touts ENT strength Medtronic plc’s Jacksonville-based division, which makes surgical instruments for ear, nose and throat physicians, produces a fraction of the global medical device company’s revenue. However, as Medtronic reported earnings last week, it touted the performance of that business. “ENT is one of our stronger businesses,” CEO Geoff Martha

said in the company’s quarterly conference call with analysts. Medtronic highlighted the ENT business because the earnings report came three weeks after the company announced a $1.1 billion acquisition of Intersect ENT, which will add new products to the division. Martha California-based Intersect will bring drugeluting sinus implants to the ENT business. Such an implant slowly releases medication. “Our ENT business has quietly been a strong performer for us, led by a great team with a track record of consistently outperforming the market,” Chief Financial Officer Karen Parkhill said, according to a transcript of the conference call posted by the company. “With the addition of Intersect’s complementary products, we can accelerate the growth profile of this business for years to come,” she said. Martha said the Intersect deal is an example of a “tuckin” acquisition strategy to grow existing businesses. “This segment within ENT is growing in the mid-teens and the returns are strong, well above our weighted average cost of capital,” he said. “So these are the kinds of deals that we like to see.” Medtronic does not report sales figures for the ENT busi-

ness, but it said ENT sales rose by a mid-30s percentage in its first quarter ended July 30, as it recovered from a COVID-19 pandemic-related slump last year. The pandemic caused delays in elective surgical procedures last year, reducing demand for ENT instruments. The ENT business is part of Medtronic’s specialty therapies group, which had total first-quarter revenue of $641 million. Medtronic’s global firstquarter revenue was $7.99 billion. Worden said comparablestore sales were almost 60% higher than last year in the three-week period and 23% higher than the first three weeks of August 2019. Shoe Carnival Inc., the footwear chain controlled by former Jacksonville Jaguars owner Wayne Weaver, reported a big jump in second-quarter earnings last week. Sales rose 10.5% to $332.2 million in the second quarter ended July 31 and earnings rose to $1.54 a share, compared with 35 cents in the second quarter of 2020. Shoe Carnival said comparable-store sales (sales at stores open for more than one year) were 25.5% higher than the second quarter of 2019, a more normal pre-pandemic quarter. “Footwear customers have resoundingly returned to shopping at Shoe Carnival stores all across the country. Cadre Holdings Inc. requested last week that the SEC withdraw its registration statement for an initial public offering, after the stock sale was postponed Aug. 5. The New York Stock Exchange approved Cadre’s application to certify its listing Aug. 4. However, last week’s filing said Cadre is withdrawing its registration because it does not expect its registration statement to become effective within 30 days of the NYSE’s approval. The filing does not say if Cadre will try again to bring its IPO to the market. Cadre had filed plans to sell 7.1 million shares of stock at $16 to $19 each. Cadre, which does business mainly under the name Safariland, makes safety and survivability products for the law enforcement, first responder and military markets. The business formerly was part of Jacksonville-based Armor Holdings Inc., which was sold to BAE Systems Inc. for $4.5 billion in 2007. Former Armor CEO Warren Kanders led an investor group that bought the law enforcement products business back from BAE for $124 million in 2012. Cadre was the third Jacksonville-based company to call

off an IPO this year. Specialty insurance company Fortegra Group Inc. pulled its stock sale in April and withdrew its registration, telling the SEC it had no plans to pursue the IPO. Southeastern Grocers Inc., parent of Winn-Dixie and three other supermarket chains, called off its IPO in January. The company did not file a withdrawal statement but hasn’t made any new filings with the SEC since January.

Grebe-chaired firm files for IPO A company chaired by former Interline Brands Inc. CEO Michael Grebe filed plans last week for an initial public offering. New York-based Sterling Check Corp., which provides technologyenabled background and identity verification services, filed Grebe a registration statement to sell an unspecified amount of shares. Sterling reported revenue of $454 million in 2020 and $299 million in the first half of 2021. Affiliates of The Goldman Sachs Group Inc. and Caisse de dépôt et placement du Québec own a majority of Sterling’s stock and will continue to have a controlling interest after the IPO, according to the filing. Grebe has served on Sterling’s board of directors since 2015 and is expected to become nonexecutive chairman when the IPO is completed. Grebe was chairman and

Rayonier AM completes lumber and newsprint sale

Rayonier Advanced Materials Inc. completed the sale Aug. 30 of its lumber and newsprint assets to GreenFirst Forest Products Inc. for $235 million. Jacksonville-based Rayonier AM said 85% of the purchase price was paid in cash and the rest in stock. Rayonier AM now owns 16.2% of Vancouver, British Columbia-based GreenFirst, which is publicly traded in Canada on the TSX Venture Exchange. lease on the Downtown building. Plans to move were in the works before the brewery’s former Jacksonville Beach location was set to be demolished earlier this year to make way for the Jax Beach Town Center. At Jacksonville Beach, Ruby Beach Brewing occupied a restaurant at 131 First Ave. N. that had been known as Zeta and later Zeta Brewing. The full-service restaurant and brewery was better known for its popular Sunday brunch instead of its beer, much to Vandeloo’s frustration. Zeta Brewing Co. became Ruby Beach Brewing Co. as an attempt to remarket the beer. The name came from history. Jacksonville Beach was called Ruby Beach in the late 1800s, named after the daughter of one

of the early railroad surveyors, Vandeloo said. “It needed to identify as a brewery. Beer first. That is a big deal,” Vandeloo said. Construction on the new brewery was planned to start in July 2020, but because of the pandemic shutdown, it was moved up to the spring. Vandeloo’s beer strategy is diversified. In addition to Ruby Beach, it is on tap at area restaurants and sold in cans at WinnDixie and Total Wine & More. “We were open to several areas, not necessarily intentionally leaving the beach. But the more we looked Downtown, the more intriguing it became,” he said. “The location really lends itself to our business model.” THE DOWNTOWN RENOVATION

music store that sold vinyl and compact discs. Vandeloo removed plaster that was 2 inches thick in places to expose the original brick walls. A sprinkler system was installed as well as a support beam that runs the length of the taproom. Vertical floor supports were installed in the cellar. Vandeloo wants to use the cellar to age stouts in whiskey barrels, a challenge because the ceiling has less than 6 feet of clearance. On the first floor, the taproom has a small garage door that opens to Forsyth Street. The taproom has the capacity for 50 people while the patio can accommodate another 75 customers. The patio is a product of COVID. Many customers feel comfortable outside relaxing on patio furniture or at several high-top tables. The beer garden will expand to have artificial grass and places to play Cornhole and Ladder Golf. COVID also has changed the way people work. Confident that he’ll see more than a couple of laptops on the bar, he installed electrical outlets underneath for easy customer access. Upstairs, the wood floors are vintage. A drop-down ceiling was removed to add height and show off the original plank wood. He estimates the second floor can hold 125 to 150 guests for events. Vandeloo’s experience at his other job makes hosting events at Ruby Beach a natural brand extension. Vandeloo is the general manager of Casa Marina Hotel and Restaurant in Jacksonville Beach. craft breweries, line Bay Street a block south. Intuition Ale Works is farther east down Bay Street near the Maxwell House coffee plant. Vandeloo considers the other craft brewers as an asset rather than competition. “It is great what (Intuition and Bold City) have done. They brought the craft beer scene to Jacksonville,” Vandeloo said. “I feel we are a destination. No one is going to come to my place every day. No one is going to sit here for eight hours. I think we compete with other sections of town.” Customers fancying a pub crawl will find the three breweries within walking distance, allowing them to park once and sample a variety of beers. Ruby Beach Brewing opens at 2 p.m. Monday- Friday and 11 a.m. on weekends. Although there is no kitchen, food trucks are on-site regularly even for Sunday brunch. While not marketing itself as a sports bar, four TVs will be showing football. Besides serving its own craft beer, the bar has a full liquor license. With 24 taps, Ruby Beach Brewing can serve a wide array of flavors and styles. “Craft beer isn’t just a lager or a bitter IPA anymore. We have 21-,22-, 23-year-olds who come in willing to pay $8 a pint. They know their beer,” he said. The timing was right to make the Downtown move, Vandeloo said. He welcomes the news of riverfront development, more hotels and more Downtown living opportunities. He foresees a time when Downtown residents will consider his bar their “local.”

THE MARBUT REPORT

When judges break the rules, there are consequences REVIEWING THE BENCH The Florida Judicial Qualifications Commission receives more than 500 complaints each year about judges.

MAX MARBUT ASSOCIATE EDITOR

The Judicial Qualifications Commission reviews complaints and can recommend sanctions. Judges are human. That means they can make a mistake. Judges also are those chosen to make decisions that can change people’s lives or even revoke their right to liberty. That means they must be held to the highest standards. The Florida Judicial Qualifications Commission and The Florida Bar presented a webinar Aug. 26 that outlined those standards and explained what happens when they are violated. The commission processes, reviews and investigates complaints lodged against circuit, county and appellate judges and state Supreme Court justices. Its 15 members comprise two circuit court judges, two county judges and two district judges appointed by the state’s judicial conferences; four

attorneys appointed by The Florida Bar; and five nonlawyers appointed by the governor. In other states, the judicial review commissions comprise only judges and lawyers, said Blan Teagle, the commission’s executive director. “All stakeholders have a seat at the table in Florida,” Teagle said. Having an independent and diverse commission to review complaints ensures that disciplinTeagle ary actions related to judges is not driven by public outcry or politics, he said. Judges are bound by the Florida Code of Judicial Conduct. It governs how they conduct themselves in the courthouse and extracurricular activities, their personal lives and campaigns for election. “A judge is a judge 24/7. Judges have a life apart from the bench, but must avoid conflict of interest with judicial

responsibilities. Each judge’s conduct reflects on the judiciary as a whole,” Teagle said. Despite its name, the commission does not evaluate whether someone is qualified to be a judge or judicial policies. It has no jurisdiction over decisions made by judges. “That’s for the appellate courts, unless it’s willful or persistent to not follow the law,” said Alex Williams, the commission’s general counsel. A complaint may be filed by anyone, including litigants, lawyers and fellow judges. The commission also may monitor news reports, the internet and social media, Williams said. If a complaint is found to have possible merit, it is turned over to an investigative panel comprising commission members, similar to a grand jury. If the investigative panel determines there is probable cause that a judge has violated the code of conduct, the judge may agree to a sanction that is subject to approval by the state Supreme Court, which has authority over attorneys and

judges in Florida. If the accused judge declines sanction at that point, the complaint is turned over to a hearing panel comprising other commission members that has the power to subpoena documents and witnesses. After examining the evidence, the hearing panel may submit formal charges and a recommendation to the state Supreme Court. Sanctions may be in the form of public reprimand, when a judge found to have violated the code of conduct appears before the justices in a proceeding that is televised and recorded. “It’s not a slap on the wrist. It’s pretty humbling,” Williams said. A fine may be levied and a judge may be suspended or even removed from office, depending on the infraction and circumstances. The commission receives more than 500 complaints each year, but few are submitted to the highest court after the investigation. In the past 15 months, seven judges that were the subjects of three complaints have been reprimanded by the court, according to floridajqc.com, the commission’s website: ■ A judge in the 11th Judicial Circuit in Miami-Dade County was reprimanded for improper conduct while trying to quiet a crowded and noisy hallway outside his courtroom, during which he inappropriately threatened a court employee with contempt for shaking her head at him.

■ Five judges from the 11th Judicial Circuit were reprimanded for improperly interfering in a contract procurement process being run by the Florida Department of Children and Families. They each signed a letter advocating on behalf of a private company that was one of only two companies bidding to become the primary services provider in South Florida for DCF, worth about $500 million over five years. In a stipulation with the commission, the judges acknowledged that while they intended for the letter to be informational, it crossed the line into lending the prestige of judicial office to advance the interest of a private entity and created the appearance of impropriety. ■ A judge in the 17th Judicial Circuit in Broward County was publicly reprimanded, appearing before the state Supreme Court after the court accepted the findings and recommendation of the commission’s investigative panel, filed as part of a stipulation. The judge admitted to violating the code of conduct by using the endorsement of a political organization in his judicial campaign. The judge also disclosed his personal political party affiliation during an endorsement interview with a newspaper editorial board. MMARBUT@ JAXDAILYRECORD.COM (904) 356-2466

Opportunities are available for professional development and engagement.

n Aug.11 we had our annual committee leaders orientation at the Jacksonville Bar Association offices. During the program committee leaders heard from 2021-22 JBA President Michael Fox Orr about his vision for our committees this year. I was able to explain the process involved in operating a committee. There are options for conducting a committee meeting in person, virtual or hybrid, meeting location choices including the JBA offices at Wells Fargo Center and meeting times as well as for the different types of events we would like each committee to host. We also went over the communication options available at jaxbar.org that allow committee leaders to email directly to their

committee members. Committees comprise specific practice areas and other specialized committees, including Judicial Relations, Professionalism, Pro Bono, Solo and Small Firm Practitioners, Holiday Party, Law Day and others. I encourage our members to sign up for as many committees as interest them. If you are curious about a new practice area, attend committee meetings to learn about that area. Attending a CLE also can expand your knowledge in that area. Participation is included in your JBA membership. Signing up for a committee will ensure that you receive specific committee communications about upcoming events. Visit jaxbar.org to learn about and join our committees or call me at (904) 3994486 to get started. We hope you will soon join us for one of our committee meetings.

PRO BONO YOUNG LAWYERS

The essential tool: The power of working your network In every stage of your career in the law, it pays to build personal connections.

KATHRYN STANFILL YOUNG LAWYERS SECTION BOARD OF GOVERNORS

As Porter Gale said: “Your network is your net worth.” Networking is essential at every level of an attorney’s career. Whether you are in your first year of law school or have been practicing for 50 years or longer, it is never too late to

start or continue building your network. It is not just about going to events to collect business cards to put in your rolodex or computer. It is about making connections on every level to enrich you and your network’s professional and personal life. The people you meet can become friends or partners in business. Networking supports us with almost every aspect of our careers from building a book of business to new employment

to reminding us of legal concepts we may have forgotten. August is the first month of the 2021-22 Bar year for many associations, including the Jacksonville Bar Association, and a great time to get involved with committees and events. Joining a voluntary Bar association is the first step. Then you have to go to events and meet people. Associations offer lots of activities from golf tournaments to happy hours to CLEs. If there is something that

interests you that you do not find, reach out to the Bar leaders. If you are interested in something, most likely others are too. Bar associations always are looking for new ideas for networking. Maybe you can start a new event or series. It is important now more than ever to network. For the past 18 months, we have not been able to interact in person with other attorneys or judges the way we SEE NETWORKING, PAGE 15

UPCOMING EVENTS

PRO BONO

A recipe for pro bono during the pandemic

SARAH SULLIVAN JBA PRO BONO COMMITTEE CO-CHAIR

More volunteers are needed to help people who cannot afford an attorney. While the surge of the Covid-19 delta variant dampens our hope for the end of the pandemic, it is more than lost hope that affects low-income people in our community. The sheer length of the health safety restrictions have particularly exacerbated issues affecting the poor. Luckily, with the experience in using technology to reach people over the past 18 months, pro bono outreach has adapted. The Jacksonville Beaches Bar Association stepped forward Aug. 21 to provide free legal services virtually to people in our community. Thanks for the justice clinic goes to attorneys Courtney Walters, Kathryn Hancock, Heath Brockwell, Mary Scott, Justin Drach, Joseph Nepowada, Rebekah Hope, Gregory Redmon, Lisa Ruiz, Vilerka Bilbao and law student volunteer Bailey Sassatelli.

The association partnered with Jericho Road Legal Service Ministry Inc. and Three Rivers Legal Services Inc. to provide more than 20 hours of volunteer legal service to people in need. Planning a virtual legal clinic starts weeks before the day it is presented. News of the clinic is sent to community agencies that serve low-income residents. Connecting with community agencies is essential to serving vulnerable people with legal issues that may not find their way to a legal service organization. With the assistance of case managers, social workers and other good Samaritans, clients with legal issues are encouraged to reach out to the service providers. When the clients are identified as appropriate for the clinic, they are screened by volunteers who gather information that assists the volunteer attorney on the day of the event. Justice clinics are similar to other pro bono events in that clients can receive only legal advice. However, if a client is eligible for further services, they may be referred to a civil legal aid organization. To meet the clients’ needs and to make the volunteer attorney as comfortable as possible, the client’s legal issue is matched with the lawyer’s areas of practice. The pro bono director then creates the schedule for the virtual event. Because the goal of a virtual clinic is to break down the barriers keeping people from receiving vital legal advice, clients are given the choice of participating by telephone or by Zoom. The attorneys use Zoom as the “center” of the justice clinic and can come in and out of the main meeting to ask questions and receive instructions for their next client.

Attorneys take virtual notes via a form link which is sent electronically to the pro bono director at the end of the justice clinic. While remote meetings have become a common communication tool during the pandemic, utilizing them to reach underserved people is essential to meeting their legal needs. The JBBA, with the assistance of Courtney Walters, its president, offered their members the opportunity to sponsor a justice clinic that traditionally would have taken place in person in the beaches community. The JBBA several years ago identified the need and desire for a regular service project to help the community. The justice clinics at the beach were a great fit, and we were able to continue virtually this year, despite the most recent surge of the coronavirus. Having the support of Jericho Road Legal Service Ministry and Three Rivers Legal Services ensures an event is meaningful for the volunteer attorneys and the clients. Without virtual clinics, many people with the greatest needs would have no access to legal advice. Utilizing technology and encouraging collaboration between voluntary Bar associations, legal service organizations, community providers and the private practice Bar are essential ingredients to a successful virtual clinic.

PRO BONO FROM THE BENCH

All in the details: Considerations for pretrial motion practice Motion practice is a vital part of litigation. The decision to file or defend can be critical to your case. The ultimate question must always be: How does the prosecution or defense of this motion advance the interests of my client?

Think strategically JUDGE GARY WILKINSON 4TH CIRCUIT

Careful, thoughtful and detailed planning and execution are the keys to success.

Consider the strategy of filing or defending with the overall strategy of the case. Just because you can file or defend does not mean you should. Always consider your opponent’s possible reactions. Are you comfortable with the other side seeking the same relief you are requesting? If you decide to go forward, there are two primary components of successful motion practice – education and persuasion.

Educate Start with an outline, even a simple one if the argument is not complex. Headline with key points and then go smaller with supporting facts and citations. If the outline is thoughtful, well organized and

strategic, the motion or defense likely will be as well. It also will serve you well as an outline for oral argument. What are the statutes and rules of procedure that are applicable to the motion or defense and the relief you seek? It is critical to effective motion practice to consider them, review them and address them as needed in the motion and at hearing. The precise provisions of rules and statutes are easily forgotten or confused. Moreover, rules and statutes frequently change. You do not want to find out at hearing that your assumption is inaccurate, or worse, the rule or statute has changed. It also is fundamental to good practice, yet often neglected, to cite the rules and statutes upon which your motion or defense is based. Attach copies of the rule or statute to your motion or response and highlight the pertinent components. It is easier for the court if the key cases you intend to rely upon are found near the beginning rather than in the middle or toward the end. If your motion or response is going to be more than a couple of pages, consider a

“summary of argument” in the beginning, particularly if there is a key quote from a case on point that speaks directly to the issue. It is important to consider the judge hearing your case. What is his or her background? What is his or her familiarity with this topic? Has he or she ruled on the same issue in other cases?

Persuade Lead with strength and tell the court the precise relief you are seeking and why your client is entitled to it. Be concise, using short, simple declarative sentences. Address your weaknesses and explain why they do not control the outcome. When addressing your opponent’s weaknesses, always avoid personal attacks and hyperbole. In addition to being unprofessional, such attacks frequently signal to the court a lack of confidence in your client’s position. Motion practice can be enormously consequential for your client. As with all legal practice, careful, thoughtful and detailed planning and execution are the keys to success.

PRO BONO COMMENTARY

ALAN PICKERT JBA PAST PRESIDENT

Resolutions approved by ABA House of Delegates Recommendations made related to private prisons, hate crimes and transgender studentathletes. Forty-three topics and resolutions were considered and debated at the American Bar Association House of Delegates summer meeting Aug. 9-10 in Chicago. Here are some of the few that were approved: ■ Resolution 507 opposes the continued use of private prisons for detention or corrections purposes and urges all governmental units to terminate their contracts with private prisons. ■ Resolution 509 urges the highest court or Bar admission authority of each jurisdiction to adopt rules that would allow attorneys in their jurisdiction to earn continuing education credit for service as a poll or election worker. This means that for elections, attorneys would be able to generate much needed CLEs to cover their required three-year commitment. ■ Resolution 514 seeks adoption of federal and local hate crime legislation and specifies civil remedies and First Amendment protections to be built into the legislation. The policy specifically states that Asian Americans and Pacific Islanders are covered by the resolution. ■ Resolution 604, entitled “Law Enforcement Body-Worn Camera Policies,” seeks appropriate government entities to develop comprehensive policies regarding the use of cameras, as well as the use and storage of their footage. One sponsor of the resolution noted that “this resolution is one step” to improve police-community relations and serves as a “roadmap for developing policies that will make bodyworn cameras to be a more effective tool…that we hope will improve trust in the justice system.” ■ Resolution 609 opposes any federal, state, local, territorial or tribal legislation, regulation or policy that prohibits transgender students from participating in athletics in accordance with their gender identity. ■ Resolution 11-2 postpones until after the 2023 annual meeting determination whether representation of ABA sections and state and local Bar associations should be reduced based on membership numbers. Alan Pickert, a partner at Terrell Hogan, is the Jacksonville Bar Association’s representative in the ABA House of Delegates.

YOUNG LAWYERS PRO BONO

Preserving your work-life balance amid the pressures of COVID-19

ALEXANDRIA MEDEROS JBA YOUNG LAWYERS SECTION

Set personal boundaries and commit to following through with them.

In March 2020, our world as legal professionals shifted. Much to our client’s benefits, we transformed our practices into virtual offices and courtrooms and learned to practice from almost any location. Working from home became less challenging for most legal professionals, but at what cost? Work-life balance is a construct I have discussed in almost every legal job interview. The idea is that employees split their time between their professional and personal responsibilities and the two obligations do not overlap or compete. Prior to the COVID-19 pandemic, I had the ability to work from home on days I did not have court appearances or client meetings. But in most cases, I would work in the office for the

majority of the week. By the beginning of April 2020, like most attorneys, I found myself working primarily from home. With the uncertainty of the pandemic, I made every effort to ensure my client’s needs were met virtually, being available for them during most times throughout the day and into the evening. I justified the later working hours as not only assisting my clients in the world we were living in, but also making the most of my work-from-home life, where I did not have hours of commuting. Overall, I increased my billable hours. However, since April 2020 and the shift to virtual offices and courtrooms, I cannot recall the last true “sick day” I’ve taken and, full disclosure, I contracted

COVID-19 in August 2020. Even while dealing with illness, I still answered my client’s calls and emails and made one court appearance, remotely. Recently, as I’ve begun to feel burnt out, I’ve come to a realization: Just because I can work anywhere and at any time, doesn’t mean I should. We cannot provide the best representation to our clients without first ensuring we are at the top of our game, mentally and physically. So where does this leave me? I’ve taken a personal inventory of my pre-pandemic and post-pandemic professional and personal balance and have made every effort to find a way to have them mirror each other. I’ve set boundaries for myself when working from home which

stay true to not only my field of practice, but my personal needs. When I feel sick, I take the sick days and allow my body time to heal. I’ve committed to taking my paid time off this year. I’ve made a choice not to schedule virtual hearings during my PTO when I should be spending time with my family. When I begin to feel mentally drained, I close my laptop and take the evening or weekend to be revitalized. I encourage my fellow members of the Bar to take a personal inventory of your work-life balance. Set your own personal boundaries and commit to following through with them. Alexandria Mederos is a litigation attorney at Cordell Law LLP.

Networking: You never know who can be that connection CONTINUED FROM PAGE 11

did before the pandemic. With the spike of the COVID-19 delta variant, we are back to the question of what events might look like this fall. While we are being safe, we need to continue networking to make and build our connections.

Bar associations are creative with networking events such as online trivia, online wine tastings and outdoor or hybrid events. When I started practicing, I knew few attorneys in and around Jacksonville, and none in my area of law. I needed a push out the door to start going to networking events. Thank you

Circuit Judge Katie Dearing. You were right. Before I knew it, I was part of the “club,” and I had colleagues everywhere. It starts by going to that first event and making that first connection. If you already network, there is room to add more contacts. You never know who can be that connection you need or

wish you had when you started. After meeting new people, you need to build your relationships with them. Ask them to go to coffee, happy hour or whatever you both are comfortable with. Before you know it, your connections will become more substantial. Reach out to your local Bar

association and start growing your network today. Kathryn Stanfill is an attorney at The Hinson Law Firm where she practices estate planning, guardianship and probate, including probate matters involving personal injury and wrongful death.

You may view the TSR by going to the Permitting section of the District’s website at www.sjrwmd.com/permitting/ index.html. To obtain information on how to find and view a TSR, visit https://permitting.sjrwmd. com/epermitting/html/EP_FAQs. html, and then follow the directions provided under “How to find a Technical Staff Report (TSR) or other application file documents.” A person whose substantial interests are or may be affected has the right to request an administrative hearing by filing a written petition with the District. Pursuant to Chapter 28-106 and Rule 40C-1.1007, Florida Administrative Code (F.A.C.), the petition must be filed (received) either by delivery at the office of the District Clerk at District Headquarters, P. O. Box 1429, Palatka Florida 32178-1429 (4049 Reid St., Palatka, FL 32177) or by e-mail with the District Clerk at Clerk@sjrwmd.com, within twenty-one (21) days of newspaper publication of the notice of District decision (for those persons to whom the District does not mail or email actual notice). A petition for an

administrative hearing is deemed filed upon receipt of the complete petition by the District Clerk at the District Headquarters in Palatka, Florida during the District’s regular business hours. The District’s regular business hours are 8 a.m. – 5 p.m., excluding weekends and District holidays. Petitions received by the District Clerk after the District’s regular business hours shall be deemed filed as of 8 a.m. on the next regular District business day. The District’s acceptance of petitions filed by e-mail is subject to certain conditions set forth in the District’s Statement of Agency Organization and Operation (issued pursuant to Rule 28-101.001, F.A.C.), which is available for viewing at www. sjrwmd.com. The District will not accept a petition sent by facsimile (fax). Mediation may be available if you meet the conditions stated in the full Notice of Rights (see last paragraph). The right to an administrative hearing and the relevant procedures to be followed are governed by Chapter 120, F.S., Chapter 28-106, F.A.C., and Rule 40C-1.1007, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District’s final action may be different from the position taken by it in this notice. Failure to file a petition for an administrative hearing within the requisite time frame shall constitute a waiver of the right to an administrative hearing. (Rule 28-106.111, F.A.C.). If you wish to do so, please visit http://www.sjrwmd.com/ nor_dec/ to read the complete Notice of Rights to determine any legal rights you may have concerning the District’s decision(s) on the Consumptive Use Permit Application(s) described above. SECOND INSERTION Are internet-only legal notices sufficient?

No. While the internet is clearly a useful resource, websites should not be used as the sole source of a legal notice. Websites, whether controlled by a government body or a private firm, are not independent, archived, readily available or independently verified.
