June start for $26M HarborChase

Vestcor Communities expects to break ground in June on the $26 million HarborChase of Mandarin, designed as a 114-unit independent, assisted living and memory care community. Holly Hepler, marketing manager of The Vestcor Companies, said Jacksonville-based Vestcor will partner with Harbor Retirement Associates for the development. Vero Beach-based Harbor Retirement Associates is a regional senior living development and management company that focuses primarily on assisted living and memory care communities,

including HarborChase of Jacksonville along San Pablo Road. HarborChase of Mandarin is planned on 4.1 acres at 12276 San Jose Blvd. It will comprise 116 beds among 94 independent and assisted-living apartments and 20 memorycare units. Rents will be market rate, but have not been finalized. Hepler said the three-story,

126,000-square-foot project, to be built by Summit Contracting Group, should be completed in August 2017. She said the one- and twobedroom apartments will include utilities, Internet service, housekeeping, laundry service and routine maintenance. Services also include full-service dining by an executive chef and 24-hour access to a licensed nurse and health monitoring by a professional staff. Tent over Metro Park stage may come down

A different kind of B&B There’s a new B&B under construction Downtown along Forsyth Street. It’s not a bed-and-breakfast, it’s a bakery and barbecue restaurant. Work is underway at 331 W. Forsyth St., a two-story structure that opened in 1941 as the offices of the Tucker Bros. mortgage and real estate company. The building later housed Café 331 and most recently, Sweet Lady Blue nightclub. It was purchased in a foreclosure auction in July 2014 by Tom Thornton Jr., who is replacing virtually everything from the roof to the basement. He plans to open a combination bakery and barbecue restaurant. There’s a reason for the uncommon combination. “Barbecue is one of my favorite foods and there’s no barbecue Downtown,” said Thornton. “And I like doughnuts.” The $350,000 build-out of “The Bank BBQ and Bakery” will include new heating and air-conditioning, restrooms and a 50-seat dining room. Work is scheduled to be complete for a grand opening in June. The location — near Downtown office towers, the Duval County Courthouse and Bryan Simpson U.S. Courthouse — also should draw customers from Brooklyn, Riverside and San Marco, said Thornton. The Bank will serve breakfast, lunch and dinner and he plans to hire two local barbecue experts with more than 40 years’ experience combined. That gives Thornton confidence he’ll have at least one satisfied customer. “One of the pitmasters is coming out of my favorite barbecue joint, so at least I know I’ll like it,” he said.

After more than three decades along the St. Johns River, the well-known— and well-worn — tent of Metropolitan Park could be coming down. Mayor Lenny Curry’s administration will make that recommendation to City Council in the coming weeks. Inspections showed the tent could no long be used or repaired, according to Curry spokeswoman Marsha Oliver. There are no immediate plans for replacement, she said. Metropolitan Park’s canopied stage has been shut down since November after an initial report from an outside firm said the structure was “not safe to occupy and must be brought down.” Additional city tests concurred. The decision to shutter that part of the park caused promoters of The Big Ticket concert event in December to build a temporary stage. Legislation is being introduced today to City Council to reimburse the group about $96,000. Mike Yokan, one of the concert’s promoters, said Monday he thought the reimbursements were fair but conservative. Probably 20 percent more was incurred to move the concert from the originally planned staging area to the fire museum field in the park, he said. Yokan said he wasn’t in favor of the tent coming down with no commitment for a replacement. “I think Metropolitan Park is an incredibly valuable and unique asset to the city that continues to be so,” he said, later adding, “I would be disappointed if it goes the way of the dodo birds.” For concerts like The Big Ticket and upcoming Welcome to Rockville, Yokan said roughly 20-30 acres plus parking for 7,000 vehicles is needed. Army exercise is early practice run for JaxPort’s $30 million transfer facility Before the newly completed Intermodal Container Transfer Facility at Dames Point officially opens this year, it is the site this month of a military training exercise. The U.S. Army is practicing moving nearly 800 pieces of cargo, including vehicles, containers and equipment,

from the facility to a military ship. The exercise involves several Army units, including the 832nd Transportation Battalion based at JaxPort. The $30 million facility allows cargo to move directly between ships and trains, which speeds up the shipment process.

The stage at Metropolitan Park was shut down in November after the tent was deemed unsafe. The tent is expected to be taken down. December. Yokan doesn’t get the sense the Curry administration envisions Metropolitan Park housing such concerts and festivals anymore. Instead, he thinks such events will be pushed toward the amphitheater and outdoor flexfield across the street at EverBank Field. Those facilities, part of $90 million in improvements at the stadium, have not yet broken ground. Yokan isn’t sure where the concerts would go, but if no appropriate venue is found, the concerts could move to another city. Removing the tent will take City Council approval, but the district representative wants some assurances before signing off.

Council member Reggie Gaffney said he met with the Curry administration about the issue in the past couple of weeks and expressed a desire for the community to still use the park. They can — the only part shuttered is the staging area. However, he believes the

newer venues across the street will be too expensive for nonprofits, community and social groups to rent. Building owners sue state over leases By Brandon Larrabee The News Service of Florida The owners of a controversial office building in Tallahassee that leases to several state agencies went to court Monday to try to block legislation requiring state workers to leave the facility. Northwood Associates filed suit in Leon County circuit court, arguing that budget language ordering state agencies to leave the Northwood Centre is unconstitutional and a breach of the departments’ contracts with the company. Northwood Centre has faced allegations in recent weeks that poor conditions have led to health problems for workers. “This is an unfortunate situation for all involved. No one benefits from the actions taken by the agencies and the state,” said Stuart Silberberg, a principal with the parent company of Northwood Associates, in a statement issued late Monday. “We hate having to take this action after so many years of a good partnership with

the state and it’s a bad day for everyone,” he said. “However, we believe this situation involves serious infringement of constitutional and contract law that can only be addressed through a court of law.” The lawsuit specifically names the Department of State and four state agencies that are parties to leases at the facility — the Department of Management Services, the Department of Business and Professional Regulation, the Department of Children and Families and the Agency for State Technology. It also names the heads of those agencies and the leaders of the Department of Education and the Department of Economic Opportunity. In the lawsuit, Northwood Associates said it was working in good faith to try to address the issues at Northwood Centre, but received a letter on March 3, dated a day earlier, “demanding that certain work and work plans be accomplished” under the lease. Three days later — on a Sunday — Sen-

ate Appropriations Chairman Tom Lee, R-Brandon, and House Appropriations Chairman Richard Corcoran, R-Land O’ Lakes, agreed to place new language in the budget barring state money from being used to cover the leases. The company’s lawsuit suggests some of the agencies were planning before then to move elsewhere. “Simultaneously with its legislative maneuvers to circumvent the lease, in February and March 2016 DMS (the Department of Management Services) and DBPR (the Department of Business and Professional Regulation) were already making arrangements with other private lessors to move state employees and operations from the Northwood Centre to other facilities in Tallahassee,” it says. The language calling for the agencies to move out of Northwood Centre was folded into the fine print of a budget the Legislature approved last month. That fine print, known as “proviso,” often spells out exactly how money pro-

vided in the annual spending plan is supposed to be used. While the budget language takes effect July 1, one of the leases referenced in the lawsuit runs until 2020. Generally, state contracts are contingent on the Legislature providing money to pay for them. But the lawsuit says the money to pay for the leases is still in the state budget, despite the proviso, and the agencies undermined the contract by asking lawmakers to approve the language on the leases. The lawsuit calls for a court to find the language unconstitutional and to bar the agencies from “from relying upon the subject proviso for any purpose whatsoever.” It also asks for damages from breach of contract. The offices of Senate President Andy Gardiner, R-Orlando, and House Speaker Steve Crisafulli, R-Merritt Island, said they hadn’t received the lawsuit when contacted about it Monday afternoon.

Scott poised to act on health, education bills

In a final flurry of activity from the legislative session, Gov. Rick Scott this week will take action on heavily debated health, education and tax bills. Scott faces deadlines to act this week on 25 bills, including 22 of them on Thursday. After that, one deadline will remain next week for a controversial bill about overhauling the state’s alimony laws. As of early Monday afternoon, Scott had signed 245 of the 272 bills approved by the House and Senate during the session that ended March 11. He has vetoed only one — a local bill dealing with Gainesville Regional Utilities, according to a Senate tally. After each legislative session, House and Senate leaders gradually send bills to Scott, who then has 15 days to take action. The batch with a Thursday deadline includes ones that were closely watched during the session by health-care and education interest groups and lobbyists. As an example, Scott will take action on a proposal (HB 423) that

would allow advanced registered nurse practitioners and physician assistants to prescribe controlled substances. Advanced registered nurse practitioners have lobbied for years for the prescribing authority but have faced opposition from doctor groups. The bill would place some limits on the authority, including restricting the prescribing of what are known as “Schedule II” controlled substances, such as codeine and oxycodone, to sevenday supplies. Among other health-care measures, Scott will take action on a proposal (HB 221) that addresses an insurance issue known as “balance billing.” The issue, which drew lobbying from health insurers, doctors and hospitals, primarily deals with patients who have preferred provider organization, or PPO, coverage and go to hospitals for emergency care. Patients have sometimes gotten unexpected bills because doctors at the hospitals are not part of the insurance plans’ networks. The legislation, at least in part,

would set up a dispute-resolution process that supporters say would help shield patients from unexpected bills and leave it to health-care Scott providers and insurers to work out payment issues. Also facing a Thursday deadline is an omnibus education bill (HB 7029) that includes a plan to allow parents to transfer their children to any public school in the state that is not at capacity. The bill ties together a variety of other education issues, ranging from performance-funding formulas for colleges and universities to changes in high-school athletics. Among the other proposals set for action is a $129.1 million tax cut package (HB 7099). Perhaps the most-notable parts of the package are a permanent sales-tax exemption on manufacturing equipment and a three-day sales-tax “holiday” for back-toschool shoppers this summer.
