Restaurant planned for San Marco gallery site

Stellers Gallery in Jacksonville’s San Marco Square is in review for conversion into a Flying Iguana restaurant. Restaurateur Al Mansur, also owner of the seven area Al’s Pizza Inc. restaurants, said Monday he has a contract to buy the building and convert it into a second Flying Iguana. The first Flying Iguana Taqueria and Tequila Bar is in Neptune Beach, where Mansur and a partner converted the former Sun Dog Diner in a more than $2.1 million project. Mansur said he will move forward on his own in the San Marco deal. He expects to invest more than $2 million to buy and renovate the 4,030-square-foot building. “I think it’s a great part of town for the demographics I am looking for,” Mansur said. Scott Riley, president of Stellers Inc., said Monday he hasn’t decided the next step if the building is sold, although he is looking at options to relocate the art gallery. He said Stellers has been in business since 1985 and in that building for 23 years. Riley said he is considering leasing a smaller location, but hasn’t decided where. Mansur said Stellers is on a month-tomonth lease. “They will have plenty of time to relocate,” Mansur said. He had no timeframe for the San Marco Flying Iguana because it awaits zoning approvals. Property owner Zambetti Properties Inc. has applied for a zoning exception, waiver and administrative deviation to create a 150-seat restaurant at the location, listed as 1407 Atlantic Blvd. Property records show the structure was built in 1940. According to applications made May 25, the zoning exception is for the retail sale of alcohol for on-premises consumption. Mathis continued on Page A-2

Rising expenses, headlined by close to $280 million in pension payments are eating away at any boosts. “We can’t promise anything this moment,” Sam Mousa, Curry’s chief administrative officer, told Sheriff Mike Williams and

his staff at the end of the committee meeting. Yes, Curry’s priorities lie in public safety. And yes, Mousa said extras doled out could end up within the sheriff’s office. However, the city has a lot of needs and the budget team hasn’t sifted through every department’s proposal. Even then, Mousa acknowledged the end will have a “negative nut.” No promises. The agreement is to be renewed annually, provided the money is available in the state attorney’s budget. Barnard said the job has an annual salary of $50,000, plus benefits. According to

The interior of The Flying Iguana Taqueria and Tequila Bar in Neptune Beach. Partner Al Mansur wants to open a second Flying Iguana on his own in San Marco. The waiver is to reduce the required minimum distance between a liquor-license location and a church from 500 to 111 feet. The administrative deviation is to reduce the minimum number of off-street parking spaces from 43 to zero. Mansur said he was seeking a solution to provide off-site parking by working with nearby businesses that would have available spaces during the day as well as at night and on weekends. He said he also was talking with a church for access to parking spaces. The Flying Iguana operates in the Beaches Town Center at 207 Atlantic Blvd. It specializes in a fusion of Latin American cuisine and offers local craft beers and more than 100 tequilas. Mansur said the Neptune Beach Flying Iguana employs 125 people and he expects the San Marco restaurant would need 100 workers. It would operate for lunch and dinner, staying open during the week until 11 p.m. and until midnight or so on weekends.

Aspen Dental applies for build-out

There’s no building on-site yet at the Town Center Promenade under development, but Aspen Dental already has applied to

build-out its space planned there. Aspen Dental is one of the tenants in buildings to be constructed for Core Property Capital at the new shopping center, which is across Town Center Parkway from St. Johns Town Center. Land is being cleared for construction. Aspen Dental has applied to build-out 3,500 square feet of space at 4520 Town Center Parkway at a construction cost of $250,000. It will share the building with Newk’s Eatery. The city is reviewing the permit application for the structure and several others at the Promenade. Eight tenants, including the area’s first Red Robin Gourmet Burgers & Brews, Texas de Brazil Churrascaria Brazilian Steakhouse and Piada Italian Street Food restaurants, are planned to open there by spring 2017.

By Jim Saunders The News Service of Florida In a case that raised questions about tribal sovereignty, the U.S. Supreme Court on Monday turned down an appeal from the Seminole Tribe of Florida in a dispute about paying state utility taxes. The decision effectively let stand a ruling by the 11th U.S. Circuit Court of Appeals that upheld collection of a state tax for electricity used on tribal lands. The Seminoles argued the tax violated tribal sovereignty, but the appeals court last year ruled the tax is imposed on utility companies, which pass it along to customers. The Supreme Court, as is common, did not explain its reasons for turning down the Seminoles’ request to hear the case. In a petition filed in February

with the Supreme Court, attorneys for the tribe argued the issue in the case “is important to Indian tribes, states, and the federal government.” The petition also contended allowing the tax to be collected would violate the tribe’s sovereignty, which helps shield it from state taxes. “The court of appeals’ decision permits Florida to tax activities on a federally recognized Indian tribe’s reservations,” the petition, posted on scotusblog.com, said. “That represents a grave encroachment on tribal sovereignty.” But attorneys for the Florida Department of Revenue, in a brief filed last month, disputed the case had such broad implications and asked the Supreme Court to turn down the Seminoles’ appeal. The case stemmed from what is known as a “gross receipts”

tax the state imposes on utility services. While the state collects the tax from utility companies, the tribe argued the tax is itemized on bills sent to customers, who are required to pay it. “Virtually every utility provider in Florida exercises its right to expressly pass the tax along to customers,” the tribe’s attorneys wrote in the February petition. “Indeed, a state tax official testified that he knows of no utility provider that does not separately charge the utility tax on its customers’ bills. The tribe’s utility providers are no different; they have always passed the utility tax on to the tribe, making the tribe legally obligated to pay it,” the brief said. But in siding with the state in August, the 11th U.S. Circuit Court of Appeals agreed with the Department of Revenue the tax is imposed on utility companies and not directly on customers.

Walking through a Chicago airport on Sunday, it wasn’t merely the horrific massacre of 49 clubgoers at a gay bar in Orlando earlier that morning that reduced Christian Ulvert to tears. It was how he heard a couple of fellow travelers characterizing the event. “They said it was such a tragic event, but at least it wasn’t a school where children were, it was a club where gays hung out,” Ulvert, a gay Democratic political consultant said Monday. “That was a very painful moment. It was very hard to hold back the tears.” The shooting deaths at Pulse, a popular gay nightclub in downtown Orlando, has sparked outrage, grief and a global outpouring of support for the LGBT community. Federal authorities say Omar Mateen, 29, acted alone, but, in the words of President Barack Obama, was “radicalized” by Islamic terrorists via the internet. In the short time since the event, much of the analysis has focused on Mateen’s links with terrorists. But while reeling from the worst mass shooting in the nation’s history, many LGBT people throughout Florida and the nation feel they’re being ignored. “I think it’s pretty much gone viral that our political leaders not only in Florida but throughout the country need to say the words that this was an attack on our gay community,” said Ulvert, a Miami resident who has been married to his husband, Carlos

But he has made no references to the gay or LGBT component of the attack. “This is clearly an attack on the LGBTQ community. It was clearly an attack on Latinos as well. A supermajority of the victims that have been named so far are young Latino men, most of them LGBTQ,” said Carlos Guillermo Smith, governmental affairs director for Equality Florida, a gay-rights advocacy group. “We have to remember that it is an attack on our community, which we have to call out for what it is — an anti-gay, anti-Latino, disgusting act of terror and hate,” Smith, a Democrat running for the state House in Orlando, said. But we’re not backing down.” Gage is a longtime member of Mickey Faust, a community theater group she said has been a “haven” for LGBT locals in the Tallahassee area. The troupe’s Friday show will go on, Gage said. On Friday, the Jacksonville Fire and Rescue Department outlined its $19.4 million in enhancements to the budget committee. That includes an additional 47 firefighters ($5.4 million), 44 engineers ($6.5 million) and a host of other employee and capital improvements. Like the sheriff’s office, no promises were made.
