Plans were in place for Sax Seafood & Grill, a restaurant at the edge of a Downtown neighborhood that had not received much investment. The city in 2003 partnered with an Orlando developer and spent nearly $2 million in hopes of seeing the jazz-themed establishment come into place. It never made it. Five years later, the city took over the partially constructed building. It’s sat idle since then. A step into the vacant 816 W.

Site plans were filed Wednesday for an expansion to United Parcel Service Inc.’s Northwest package distribution center, indicating the Atlanta-based global logistics company is serious about growth in Jacksonville. The plans show an almost 264,000-squarefoot expansion and nearly 730 additional parking spaces, signaling an increase in employment and delivery vehicles. When completed, the UPS center will be almost 800,000 square feet and offer about 1,680 parking spaces. The center is at 4420 Imeson Road in Westside Industrial Park. It was developed in 1989. Information submitted with the site plan says the total property boundary is about 130 acres. The documents were dated Oct. 26, a day after legislation was filed with City Council for Project Mountain, a fast-track deal for a $4.3 million Recapture Enhanced Value grant for an unidentified global logistics solutions company. Project Mountain, as it is code-named, would invest $196 million into expansion of its Northwest Jacksonville logistics center and create 10 jobs by year-end 2020 that pay an average $50,675 plus benefits. A city project summary said the company is considering four other cities across the U.S. for the expansion. The summary said the company already employs 965 people, wants to start construction by the end of this year and complete the expansion within three years. While the description of Project Mountain matches UPS, the company has said only that it is considering Jacksonville among various locations “where communities are supportive of our projects as we further assess the viability of an opportunity.” The company also has asked the city for an administrative deviation to the zoning code to increase parking and reduce the landscape requirements.

We’ll use it to give us guidance in the final product,” said Jim Klement, authority development coordinator. The District will comprise numerous structures and amenities on the 28.6-acre parcel including apartments, condominium towers, a hotel, retail and restaurant space, as well as public parks and parking lots. “It’s a unique public and destinationoriented product,” Klement said. As each component is designed, architects will use the master plan as their

design standard. Any deviation will have to come before the board for its review and decision. Elements partner Michael Munz said the master plan will be used as the basis for all aspects of each project as agreements are negotiated with developers who become part of The District. “We’ll make the design guidebook a condition of closing,” he said. “This (document) will live with the project.” Elements is required to submit a progress report to the board five years after the project begins. Construction should start in a few weeks and be completed by year-end 2018 on the Ravella Town Center Apartment Homes. Stanmore Partners of Houston recently paid $7 million for about 6 acres at 4674 Town Center Parkway for the 306-unit project. Jason Schlanger, managing director of multifamily, said the project is a four-story wrap project — apartment homes wrapping a structured concrete parking garage. He said the contractor is Hoar Construction LLC of Birmingham, Ala. The architect is Stein-

berg Design Collaborative of Houston and the civil engineer is England, Thims & Miller of Jacksonville. Schlanger said the Class A apartments will average 891 square feet and rents will be finalized closer to the end of construction. Ravella is being developed in The Strand at Town Center near St. Johns Town Center. Stanmore Partners bought the property from PGP Jacksonville TC II LLC. Stanmore made the purchases through Stanmore/ADEF JAX Owner LLC and Stanmore JAX Land LP. Stanmore ADEF JAX Owner LLC took out a $35.75 million mortgage from First Tennessee Bank. Permits for the apartment buildings and a seven-level parking garage total almost $32 million. Space Florida asks for $5M for launch pad improvements By Jim Turner The News Service of Florida Space Florida, the state’s aerospace arm, wants another $5 million to help the private SpaceX improve a former shuttle launch pad at the Kennedy Space Center for manned missions. The pad is separate from a launch facility where a SpaceX Falcon 9 rocket caught fire and exploded last month. The Space Florida Board of Directors, with little discussion, voted Wednesday to negotiate with the Florida Department of Transportation for the money, which would be used in a match with billionaire entrepreneur Elon Musk’s SpaceX on further upgrades to Spaceport Launch Complex 39A. “Obviously, an important project,” Space Florida Board

Chairman William Dymond said during a conference call. “Moving to commercial crew is both exciting and an important part of the future of the spaceport, so it’s something that is very important to Space Florida.” With the aid of a prior $5 million match from the state, SpaceX has been working on the pad since 2015. Howard Haug, Space Florida’s chief investment officer, said the additional money would be used by SpaceX for a second phase of the effort to prepare the pad for launching manned vehicles to the International Space Station as part of NASA’s Commercial Crew Program. The work on a new crew arm tower is expected to create 130 jobs, with SpaceX expected to spend $25 million, Haug said. Dymond said SpaceX would be required to spend $10 million

to achieve the match and the new positions are in addition to 90 the company brought in for the first phase of work. A SpaceX representative on the conference call wouldn’t say when manned flights may begin. The launch pad was originally built for the Apollo program and was later used by the shuttle program. The next Falcon 9 launch at Cape Canaveral isn’t expected until 2017. However, there have been reports the launch pad may also be used by SpaceX to launch a Falcon 9 rocket to supply the space station by the end of this year, as Launch Complex 40 at the north end of Cape Canaveral is repaired. The Sept. 1 fire and explosion, which occurred while a Falcon 9 was being fueled at pad 40, remains under investigation.

Construction should start in mid-December on the 98-room Tru by Hilton hotel, which is moving through the regulatory process for its first Northeast Florida hotel at Town Center Promenade. Designed to attract millennials, the four-story property is planned on 1.5 acres at 4640 Tropea Way, off Town Center Parkway. Town Center Hotel Partners LLC of Lebanon, Tenn., bought the property Sept. 30 from Core Property Capital, through CPC Jacksonville SJTC Hospitality LLC. It will sit on lakefront property at the Promenade, which is across from St. Johns Town Center. The city is reviewing the proposed project’s concurrency and site plans. Prosser Inc. is the civil engineer. Hotel partner Roshan Patel previously said construction would take about nine months. The estimated $9.7 million project comprises the $1.45 million property purchase and an estimated $8.25 million construction cost. Patel said the group also is building a Tru by Hilton in Tallahassee, home to Florida State University. The new midscale brand is designed to attract leisure and corporate travelers, particularly millennials. Hilton Worldwide designed the brand to attract generations united by a “millennial mindset.” It says it focuses on hotel basics — bed, shower, technology — along with a public space to foster connections at a value price. USA Today reported in January rates at Tru vary by location, but will be in the $90 to $100 range. The first Tru by Hilton property is expected to open in summer 2017 in Oklahoma City. Appeals court says damage caps are unconstitutional As the Florida Supreme Court considers the issue in another case, an appellate court Wednesday ruled that limits on “noneconomic” damages in medical malpractice lawsuits are unconstitutional. The ruling by a panel of the 2nd District Court of Appeal in a Charlotte County case cited a 2015 decision by another appeals court in a Broward County case. The Supreme Court in June heard arguments in the Broward County case but has not ruled. Non-economic damages, which are awarded for issues such as pain and suffering, have long been controversial. The Legislature and then-Gov. Jeb Bush in 2003 approved caps on non-economic damages, pointing to skyrocketing malpractice insurance costs for doctors. But the Supreme Court in 2014 ruled the caps were unconstitutional in a wrongful-death case

The 2nd District Court of Appeal ruled against Peace River Regional Medical Center in a lawsuit filed against the hospital and doctors by Iala Suarez, who alleged negligent care when she was pregnant led to her daughter being born with severe neurological injuries. A jury awarded $5.25 million in non-economic damages to Suarez and her daughter, with the hospital responsible for a portion of that amount. In Wednesday’s ruling, written by Judge Robert Morris and joined by judges Patricia Kelly and Nelly Khouzam, the panel said it agreed with the 4th District Court of Appeal in the Broward County case that the limits were unconstitutional.

Construction debris and products left behind by crews nearly a decade ago remain in the Sax Seafood & Grill building. The Sax Seafood site has its perks, said Parola. Namely, its accessibility. Cars hum along Downtown thoroughfares of Beaver, Davis and Union streets. The building has neighbors like the Ritz Theatre and Museum, the LaVilla School of the Arts and several businesses. Yet, a decade of neglect shows. Several doors and windows have been boarded up. Glass is strewn about after vagrants busted their way in to have a place to sleep with a roof over their heads. Some of them left their sparse belongings and garbage behind. Others used the bathrooms that are plumbed out but haven’t had running water for ages. As for the open house, Daniel Jordan and his Outlaw Sports group were among the half-dozen or so who made the visit Friday to see the possibilities through the clutter and debris. “It has a lot of potential,” he said. Jordan said his group was looking for investments and he saw the potential for a family-friendly restaurant. He and his group also saw the potential costs — Jordan wasn’t sure just yet if they would place a bid for the project. By Lloyd Dunkelberger The News Service of Florida While state debt has declined 9.5 percent over the past five years, debt for Florida’s state universities has risen by 41 percent, according to a report reviewed by Gov. Rick Scott and the Cabinet. State debt has fallen by $2.7 billion in that period, for a total debt of $25.5 billion at the end of 2015. In the same time, university debt has risen by $1.1 billion, for a total of $3.8 billion, the state Division of Bond Finance report showed. The bulk of university debt is tied to borrowing by “direct support organizations,” universitybased entities that have borrowed money for health-care facilities, student housing, parking garages, fitness-wellness centers and athletic facilities. One major factor is health-care debt, which has doubled over the past five years to $1.23 billion. The University of Florida has the most debt at $1.35 billion, led by borrowing related to UF Health Shands Hospital and related facilities. Borrowing by the direct support organizations began in 1994. Over the subsequent two decades, the Legislature, the university system’s Board of Governors and the executive branch have taken steps to regulate the process, including passage of a 2006 law that created two methods for allowing universities to borrow money. One was the traditional process where the borrowing was arranged by the Division of Bond Finance with approval by the governor and Cabinet. The second allowed borrowing more directly by state universities using the direct support organizations, subject to approval by the Board of Governors. Debt control has been a fundamental issue for Scott, who took office in 2011. Under his direction, more debt-control policies were initiated in 2013, including requiring an analysis of the return on investment and cost assessment of issuing debt. “The whole reason for the change in policy and the justification of debt is to enhance accountability and transparency whenever debt is being used,” said Ben Watkins, director of the Division of Bond Finance. The $1.1 billion increase in university debt during the fiveyear period included $423 million under Scott’s watch, with the bulk of that coming from borrowing by the direct support organizations, which were not subject to approval by Scott and the Cabinet. But the report showed even with that rise, university borrow-

ing has slowed under Scott compared to longer-term borrowing trends. The direct-support organization borrowing sparked some controversy last spring when state officials learned that $15.6 million in bonds issued by the University of North Florida in 2010 for a sports-wellness center had been downgraded by financial analysts. It led to a new round of borrowing reforms, including a requirement that the Board of Governors and the Division of Bond Finance receive notice of rating changes on bonds issued by the direct support organizations. Watkins said the revised debt policies, which also include the use of public-private partnerships by the universities, now provide a “framework for adequate oversight” of university borrowing. However, one exception is borrowing related to UF Health Shands Hospital, which as an older institution borrows money under a framework established prior to the use of direct support organizations. “From a debt management perspective, that’s a bit of a blind spot because there is no review process in place,” Watkins said. “Either the Board of Governors or the governor and Cabinet should be responsible for evaluating the Shands health-care debt and applying the policies that are applicable to all state agencies including universities.” In a second recommendation, Watkins called for more scrutiny by the boards of trustees at each university when they are reviewing borrowing proposals by the direct support organizations. Watkins said the local boards should apply the same standards that will later be used by the Board of Governors when reviewing the borrowing. University system Chancellor Marshall Criser said the Board of Governors has already amended its debt policies with the requirement that the local boards of trustees as well as the boards of the direct support organizations use the same debt standards as the Board of Governors and the governor and Cabinet. Criser said in his preliminary discussions with University of Florida officials, they are open to changes in the borrowing policies related to Shands. But Criser said the Board of Governors would look at a borrowing policy that would not only impact Shands but could be applied to other institutions, including the University of Central Florida, which is working on a proposal for a new teaching hospital.

He said the project and its master plan validate creation of the authority. Staff, Elements and its design team spent 17 months working out the details of the master plan to protect the city and the developer as the project moves closer to its construction phase, estimated at $400 million to $500 million. “We know they are taking a risk. They have to have predictability,” Wallace said. Working together will continue as the two sides “make and bake the cake.” Negotiations will now begin on the development agreement that lays out the city’s responsibilities for the project, such as providing utilities, drainage, roads, sidewalks and other infrastructure. Economic incentives such as property tax credits and other concessions on the city’s part also will likely be part of the negotia-

tions and the budget source for each phase of the city’s contribution will have to be identified and approved. “We need to understand the nature of the request (from Elements) and the timing of vertical development,” Wallace said. The authority granted Elements the development rights for the project in September 2015.

By The News Service of Florida In the fall of 2014, more than a quarter of the students who had transferred to state universities after earning associate in arts degrees in the Florida State College System were enrolled at the University of Central Florida. The Orlando university’s ability to enroll 27.2 percent of the state college graduates contrasts sharply with Florida A&M University’s enrollment of less than 1 percent of those students, a new report given to the state Board of Education showed. “I was struck by the spread,” said Tom Grady, a member of the education panel that oversees Florida’s 28 state colleges as well as the K-12 system. The ability to attract state college graduates with associate degrees is one reason the University of Central Florida is the largest state university, with more than 63,000 students, and one of the largest in the nation, while Florida A&M has

struggled with enrollment. FAMU, one of the most prominent historically black universities in the nation, has seen its enrollment decline about 25 percent between the fall of 2010, when it reached a peak headcount of 13,277 students, to 9,920 students last fall. Madeline Pumariega, chancellor of the Florida State College System, said she is working with FAMU on ways to help the school attract more state-college transfer students. The so-called “2 plus 2” system guarantees students who graduate with associate degrees from state colleges a place in the university system, although not necessarily at the universities they want to attend. The new articulation report showed that in the 2013-14 academic year, nearly 66 percent of the high school graduates who decided to continue their higher education in Florida opted to attend state colleges. Slightly less

than 30 percent went directly to state universities. Many of those students go on to earn associate degrees, with the system producing more than 55,000 associate-degree graduates annually in recent years. In 2013-14, about 30,000 of those graduates were admitted to state universities, with 25,000 deciding to attend. Pumariega said some students do not move on to state universities because they are “place bound,” not having the means to enroll because of other responsibilities like jobs or caring for children or elders. Other students are satisfied with associate degrees. Behind UCF, the University of South Florida had 16.5 percent of the transfers in 2014, followed by Florida International University with 13.9 percent, Florida State University with 11.3 percent, Florida Atlantic University with 10.2 percent and the University of Florida with 9.9 percent.
