s of now, some of the highest room rates in Jacksonville-area hotels are $373 to $564 per night, although one of the highest is listed at $5,000 per night for the club level, one-bedroom presidential suite at The Ritz-Carlton Amelia Island. Jacksonville Jaguars owner Shad Khan will challenge those rates if his deal works to develop a Four Seasons hotel on the Downtown riverfront. The Four Seasons Resort at Walt Disney World, the closest to Jacksonville, is listed at $1,015 per night.

“If we didn’t think it could be successful, Shad certainly wouldn’t be investing this amount of money and Four Seasons wouldn’t be interested in coming here,” Jaguars President Mark Lamping told the Meninak Club of Jacksonville on June 28. “If executed properly, it can be successful.” Lamping says he is confident his organization will have a licensing agreement with the Four Seasons hotel brand before the team’s development company breaks ground on the proposed Downtown luxury hotel in June 2022. CarParts.com Inc., based in Torrance, California, announced June 29 it will open a 180,000-squarefoot distribution center in Northwest Jacksonville and create 150 full-time positions. The center will open in the first quarter of 2022 at 6610 Pritchard Road, Building 300, in Crossroads Distribution Center. CarParts.com said the Jacksonville distribution center will stock and allow for expansion of auto parts categories, including mechanical, replacement and Certified Automotive Parts Association-certified collision parts. CarParts.com Chief Operating Officer David Meniane said Jacksonville is positioned to support the Southeastern U.S. market. “Our new warehouse will play a key role in helping us keep its drivers on the road with confidence,” Meniane said in a news release. “The Jacksonville distribution center will let us cover 55% of the country with 1-day shipping and over 98% of the country with a 2-day transit time including both the Miami and Atlanta metropolitan areas,” he said in the release. “Jacksonville has a talented workforce and its proximity to the port also increases efficiencies and decreases lead times. In the first quarter of this year, we grew revenues 65% and our continued investment in our supply chain will help us further disrupt the auto industry.”

Couple expanding Fresh-Mex & Co. to Town Center THE MATHIS REPORT

After battling cancer and pandemic delays, the restaurant plans to open in the fall next door to M Shack. Fresh-Mex & Co. Urban Grill & Cantina, a startup that opened its first location in August 2017 at Butler Boulevard and Interstate 95, is expanding to St. Johns Town Center. Amanda Andruzzi-Toussaint, who owns the restaurant with her husband, Michael, said the new location should open several months after build-out begins. It is a big step for several reasons, including her completion in January of six months of chemotherapy for Hodgkin’s lymphoma. “It’s been a rough year but we are still on board to open in the fall,” said Andruzzi-Toussaint, a health and nutrition expert. “We have been wanting to expand for a long time and had plans to go to other locations but when COVID hit it kind of changed our plans,” she said. “Then I was diagnosed with cancer and had been going through a very harsh chemo regimen which recently ended,” she said. “These two factors really pushed our expansion plans back.” The city is reviewing a building-permit application for an estimated $350,000 build-out for Fresh-Mex & Co. in 3,000 square feet at 10281 Midtown Parkway, No. 107. Prism Design & Construction Inc. is the contractor. They estimate a total investment in build-out of at least $650,000 “to get the doors open,” Toussaint said. Sleep Number and T-Mobile previously leased the space, which is next to M Shack. Andruzzi-Toussaint said the

space was presented, “and we really thought St. Johns Town Center would be a very good fit for Fresh-Mex.” She said the lease with landlord Simon is 10 years. Watson Realty Corp. Commercial Realtor John Mohr represented them in the negotiations. The first location, at 7111 Bentley (formerly Bonneval) Road, has eight employees and operates 11 a.m.-9 p.m. Monday-Friday. It comprises about 4,300 square feet of interior space and 900 square feet on the patio and seats 172. The Toussaints will hire at least 15-20 employees for the new location, which will be open 11 a.m.-10 p.m. seven days a week, and possibly later Friday-Saturday. It will seat 175, including a patio of 35-40 seats. Both have a bar. Andruzzi-Toussaint said the menu will be same with some new selections that Fresh-Mex introduced at the current location, including a seared tuna taco, a fried chicken taco and carnitas, to name a few. The current menu includes fajitas, quesadillas, burritos, tacos, salads and bowls. The Toussaints and their children moved to St. Augustine in 2015 from New York.

Toussaint retired from the New York City Fire Department in 2013 as a lieutenant after 22 years. He was off-duty 9/11. His company lost everyone at the World Trade Center. Those who were not on duty were called in and deployed to the site for search-and-rescue. This September is 20 years since that day. Toussaint prefers not to discuss it. “It was a tragic event and a difficult time for NYC,” he said previously. Andruzzi-Toussaint, who had not met her future husband yet, also worked in New York City and was riding her bike to work as a media and marketing professional when the planes struck and the World Trade Center fell. “I can remember being a few blocks from the site riding my bike around and looking up and seeing no sky,” she said. “Everything was covered in brown soot. It felt like it was raining heavy dust. It was surreal.” Upon moving to St. Augustine because of the landscape, the Toussaints designed FreshMex. They describe Fresh-Mex as fast-casual dining with a chefdriven menu that focuses on “good food, served fast.” The freshmexjax.com site says the concept is inspired by the New York restaurant scene. “Our ingredients are high quality, often local, usually healthy and minus the additives, preservatives and chemicals,”it says. “Our long-term goals are not simply profit driven; we focus on community development and an investment in suppliers and vendors who create sustainable, whole foods.” They designed the first restaurant, a closed Corner Bakery Cafe, with booths, butcher block community tables, white-washed reclaimed wood walls, and a garage door that opens into the full-service bar from the terrace. Toussaint designed the new location, which they describe as more high-end with clean lines, tile floors, a concrete bar top, an open kitchen, black pincushion seats and a garage door that can open the 25-foot bar to the patio. Toussaint said the Town Center restaurant would be the prototype for expansion.

Talking points say its merger with Genesis Park Acquisition Corp. is closing in the third quarter. Since announcing the deal in March, the blank check company acquiring Jacksonville-based Redwire LLC has provided few details about the pending transaction. Genesis Park Acquisition Corp. has posted numerous Securities and Exchange Commission filings with news stories about the space technology company. But it has not posted a proxy statement with details about the merger. However, last week Genesis Park posted a filing with “sell side analyst talking points” showing what the company is telling potential investors. Statements in the filing attributed to Redwire Chief Financial Officer Bill Read said the company expects to post its proxy “shortly” with the SEC. “We intend to have an ana-

Shoe Carnival stock hits record Shoe Carnival Inc.’s stock soared to record highs last week after the footwear chain controlled by former Jacksonville Jaguars owner Wayne Weaver announced a stock split and projected strong earnings for 2021. When the chain of 377 shoe stores announced first-quarter earnings in May, it said the business environment was too uncertain to forecast results for the second half of this year. However, Shoe Carnival said last week it expects fiscal 2021 sales to exceed $1.15 billion and earnings to exceed $6 a share (before its pending stock split). In the company’s best previous year in fiscal 2019, sales were $1.036 billion and earnings were $2.92 a share. “The fundamentals of our business remain robust. We have maintained strong momentum as we move through the second fiscal quarter, and as a result, we have provided an initial outlook for our full fiscal year 2021,” incoming CEO Mark Worden said in a news release. Weaver is chairman of Shoe Carnival and its largest shareholder. He and his wife, Delores, own 29% of the stock. Shoe Carnival also announced a two-for-one stock split, effective July 20. The stock already was trading at record high levels before last week’s announcement

but after the news, the stock jumped from $62.75 at the close on June 18 to as high as $79.81 a week later.

Vulcan rises on infrastructure bill Another company that jumped higher last week was Vulcan Materials Co., which rose on the potential of federal infrastructure spending legislation. Jefferies analyst Philip Ng raised his ratings June 25 on Vulcan and competitor Martin Marietta Materials Inc. from “hold” to “buy.” “With the market nervous about peak earnings for cyclicals, we believe Martin Marietta and Vulcan are positioned to outperform from a potential infrastructure bill and recovery in nonresidential,” Ng said in his report. “With a framework of a bipartisan infrastructure bill agreed upon, it increases our conviction and see the increased funding boosting aggregates demand by 5-8% annually,” he said. “We’re upgrading Martin Marietta and Vulcan to a Buy and raising our price target to $424 and $207, respectively.” Vulcan’s stock rose from

$165.84 June 18 to $181.38 a week later. Birmingham, Alabamabased Vulcan significantly increased its Florida business with its $4.2 billion acquisition of Jacksonville-based Florida Rock Industries Inc. in 2007.

Mall owner expects fast bankruptcy exit Mall operator Washington Prime Group Inc. expects to be out of Chapter 11 bankruptcy by late August or early September with a plan to convert debt to equity or sell off properties. The company’s portfolio of 102 properties includes the 952,725-square-foot Orange Park Mall and the 163,259-square-foot Westland Park Plaza on Jacksonville’s Westside. Washington Prime filed a prearranged Chapter 11 petition June 13 with the approval of a majority of its creditors. A disclosure statement filed last week with its reorganization plan in U.S. Bankruptcy Court for the Southern District of Texas said the company has two paths. The first path is an “Equitization Restructuring,” in which

new stock in a reorganized company will be issued not only to creditors but to existing shareholders. The alternative path is what the company calls a “toggle” feature to seek a transaction to pay off its debt. “Specifically, the Debtors will use the 60 days following the Petition Date to solicit proposals for such an alternative transaction, continuing the comprehensive marketing process that began prepetition,” the disclosure statement said. Before it filed for bankruptcy, Compass Point analyst Floris van Dijkum said Washington Prime was seeking to sell 47 smaller open-air malls, including Westland Park. If it gets an appropriate bid by Aug. 12, Washington Prime will take the transaction path and expects to be out of bankruptcy by Sept. 10, according to the disclosure statement. If not, it will go with the equitization plan, which would get the company out of bankruptcy by Aug. 27, it said.

Skylight Health Group Inc. announced last week that it acquired Doctors Center Inc., a primary care group with four locations in Jacksonville. Skylight is a publicly traded company headquartered in Toronto with a network of 23 primary care locations in five states after the acquisition of Doctors Center. ity board member Oliver Barakat during a June 25 committee meeting that Khan expects at least a 10-year commitment from the Four Seasons corporate arm for the proposed 176-room hotel and 25 for-sale luxury condominium project on the former Kids Kampus site along the St. Johns River south of TIAA Bank Field. “Four Seasons is a publicly held company, so they don’t comment on speculative projects like this,” Lamping said. “We would expect a long-term agreement with them. They would expect a long-term agreement from Shad.” Lamping said that Khan, as owner of the Four Seasons in Toronto, has insight into how the chain negotiates and has relationships “at the highest levels” of the company. Lamping also said he has had talks with representatives who handle Four Seasons licensing agreements. The team president has been fielding questions from DIA members and civic groups about the viability of Four Seasons in Downtown Jacksonville since Khan announced plans June 3 to build one. The DIA is considering a $114 million city incentives deal for the first phase of the Shipyards redevelopment. It comprises the proposed $321 million Four Seasons, a companion six-story office building and a city-owned marina. The deal must be approved by City Council. The proposed term sheet, scheduled for a vote July 7 by the full DIA board, says Khan and his

development company, Iguana Investments Florida LLC, have agreed to a minimum $301 million private investment. According to DIA documents, the hotel and condominium development itself will be a minimum of $241.4 million. The amount Khan plans to spend on a hotel and condo project is a bullet point Lamping is using to convince the DIA, attendees

Khan and Lamping’s view is supported by a Downtown hospitality market study by CBRE Hotels in Atlanta that Iguana commissioned and submitted to the DIA. It found that a Four Seasons

could be successful Downtown under the right conditions and with some caveats. The study was based on 2019 average daily room and occupancy rates before the COVID-19 pandemic. A summary in the DIA’s staff report says the six existing Downtown hotels don’t serve the luxury market targeted by Four Seasons. “(The hotel) will bring new

visitors and residents to the area not currently being served,” says a DIA summary of the CBRE report. The report says that market includes “non-price-sensitive corporate travelers who prefer luxury hotels and currently avoid staying in Downtown Jacksonville.” Asked at Meninak if Four Seasons would work Downtown, Lamping said: “We believe so. The market study suggests we can. “The reason for that is, if you break up all the people who come to Jacksonville and stay at hotel rooms, there’s a sliver, it’s actually about 10%, who are looking for hotel rooms in Downtown that are not price sensitive. “They just want to get the best place that’s close to where they want to be.” CBRE’s analysis puts average daily rates for a Downtown Four Seasons at $411 per night in 2025, rising to $462 by 2029. Three of Florida’s Four Seasons hotels had room rates as high as $1,335 per night and suite prices topping at $8,400 at the Four Seasons Resort at Walt Disney World Orlando, according to a June 29 survey of online booking and hotel websites. The closest comparable Four Seasons in Florida by rate is $459 to $995 per night on Brickell Avenue in Miami near the Miami South Channel waterfront. CBRE estimates the Jacksonville Four Seasons would have 57% occupancy when it opens and could reach 70% by 2029. According to the DIA summary, Downtown Jacksonville hotels had occupancy rates of 75.2% in 2018 and 73.5% in 2019. The report said area competition to the Four Seasons include The Ritz-Carlton Amelia Island,

the Cloister at Sea Island and the Ponte Vedra Inn & Club. Rooms at the Ponte Vedra Inn & Club ranged from $373 to $564 per night in June. CBRE also said Downtown Jacksonville could support as many as 79 Four Seasons residences and that Khan’s initial plans for 25 significantly lessens the project risk. “We’re not adding to other condominium projects in Downtown Jacksonville because these are going to be really, really highend,”Lamping told Meninak. “The market for that product is limited.” THE GAP

Without city assistance, the DIA summary of the study shows the hotel/condo project would be unable make enough money to cover its debt service or a positive cash on cash return within the first 10 years of operation after selling the condominium units. CBRE’s estimated $56.5 million funding gap likely would be filled by the proposed $47.68 million Recapture Enhanced Value Grant, $25.83 million completion grant and $12.45 million hotel land donation from the city. The CBRE report says the hotel and residences would otherwise have to reduce construction costs to reach that level of return, but that calculation does not include the $85.9 million in city cash, land and tax incentives for the hotel and office building. Khan’s 20-year property tax incentive in the city development agreement is tied to the quality of the hotel and brand. If Council approves the deal as written, the hotel will open as a Four Seasons. Lamping said June 25 the Jaguars do not anticipate a need to

change the hotel flag, but the agreement gives Khan that flexibility under certain conditions. If Khan or the owner of the hotel parcel at the time wants to change the flag from a Four Seasons, the term sheet states the DIA must approve it to “ensure that the hotel continues to be operated by a luxury brand” — a four- or five-star product determined by Forbes Travel Guide or “other respected source in the hospitality industry.” If the DIA does not approve the flag change, the hotel landowner can still change the brand but will lose remaining REV grant money. Lamping said this could be useful should Four Seasons change its corporate name. Barakat said knowing negotiations are active with Four Seasons and the city would receive “a certain quality hotel experience” for its investment made him feel better. “My concern is that we provide this incentive to build this building, the flag leaves, then we bring in a three-star flag that competes with our existing inventory which would not be best practice for us.” REAL-WORLD VIEW

and California and are used to such high rates and that’s what they expect to pay,” she said. “When they don’t, they almost get concerned about the quality of the hotel.” Massee said her guests at Azaleana and Club Continental are of all ages, but she has seen high traffic from those in their 30s house hunting in Northeast Florida and that “money doesn’t seem to be much of an object for them.” She also has booked Mayo Clinic patients, a customer category Khan wants to attract to the Four Seasons. Lamping says the hotel could cater to medical tourists coming to Jacksonville for treatment. The Jaguars want to expand that market with its partnership with Baptist Health to build a 42,000-square-foot orthopedic medical center adjacent to the Four Seasons in the second phase of Shipyards development. The term sheet gives the Jaguars until Dec. 31, 2024, to supersede any other offers the city receives for the 4.96-acre site. Despite the uncertainty and financial risk associated with bringing a speculative five-star hotel to market in Downtown Jacksonville, Lamping said the language in the deal with the city shows Khan’s commitment to it. “The fact that we stipulated it would be a Four Seasons hotel in our term sheet should give you an indication of how confident we are,” Lamping said. I

was on a text string recently planning my next girls’ trip. While discussing the current state of affairs and whether it seems prudent to travel, one of my friends responded “YOLO.” I tried to figure out what she meant by before finally succumbing to Google and learning that YOLO is shorthand for “you only live once.”

It seems so obvious now. I blame my lack of teenage children for my lag in knowledge of pop culture, but will catch up soon. This is my final article as president of the Jacksonville Bar Association. I have been reflecting a lot on the end of this era in my life. I must admit I have a bit of FOMO (fear of missing out) in addition to JOMO (joy of missing out). This is ironic to me because I remember suffering from FOJI (fear of joining in) when I first got involved in the JBA. This organization has provided me so many opportunities to not only meet, but get to know, my colleagues, our local judiciary and court officials. The JBA has allowed me to engage in community outreach to the elderly, the hungry, to our youth, to the battered, and to the unemployed. I have greeted new American citizens and watched law students’ first oral arguments and mock trials. Each one of these experiences has changed me in

ways both big and small. Just when I was thinking I had reached the pinnacle of local Bar involvement and could take a break, local attorney and former JBA President (1998-99) Tom Edwards posted a quote on Facebook that said, “If you’re over 45 and don’t have an under-30 mentor, not mentee, then you are going to miss fundamental shifts in thinking that are happening.” That post hit me like a ton of bricks. Since I am not quite 45, I am going to catch my breath, but I certainly do not want to miss fundamental shifts in thinking. I look forward to my next phase in Bar involvement and to finding my new mentors. I clearly have a lot to learn and need someone to show me the way. After all, YOLO. I need to get it right. Thoughts on the law: From awe to hilarity After 40 years in the profession, I have some stories to tell.

For each lawyer and each judge, a life in the law produces a constant and remarkably diverse array of unforgettable moments. Some moments are tragic, some deeply satisfying, some awe-inspiring and some riotously and unexpectedly funny. As I contemplate retirement

from the law after 40 years, I recall vividly some of each type. Let me begin with the humorous moments. At a dissolution of marriage hearing years ago, the attorneys advised me that their clients had resolved all property distribution issues with one exception: They were unable to agree on who should get a valuable zebra rug. No appraiser was going to testify. I mused aloud, “So what is the value of a used zebra rug?”

Attorney Denise Watson asked, deadpan: “To the parties or to the zebra?” When they were 4 years old, Denise’s son and one of my sons were in day care together. Her son was accustomed to women in positions of authority. His pediatrician was a woman. His mother was a lawyer. He knew I was a judge. One day, Denise was running late to a short, early-morning hearing before my suite-mate,

Judge Henry Davis. After giving her son strict instructions on the rules of good behavior, Denise took him to the hearing with her. Afterward, I asked her why she was chortling with laughter. Annual event boosts students, helps legal aid organizations

Volunteer attorneys and future lawyers helped more than 300 clients. For the third year, the Florida Law School Challenge connected law students with alumni of their law schools to work together to help people who can’t afford representation. The annual project was created and is run by The Florida Bar Foundation with the goal of increasing access to justice and promoting volunteer work by allowing mentor attorneys and law students to assist on a pro bono case from a legal aid organization. From Feb. 1 through March 26, students were able to search and select a pro bono case on FloridaProBonoMatters.org, where legal aid organizations post available cases year-round. As soon as a lawyer/mentor selected the same case, a match was made and the legal aid organization supported the partnership to assist the client. Students were able to complete their pro bono require-

ments as well as participate in mentorship and networking opportunities with attorneys. Attorneys were able to share their knowledge and experience with students and complete their annual pro bono obligation. The challenge also provides a chance for law students and attorneys to become involved with the legal aid organizations working in their community and throughout the state. The group that benefits the most from the challenge are the clients that receive assistance from the law students and attorneys. Jacksonville Area Legal Aid and Three Rivers Legal Services were involved in the challenge this year. The COVID-19 pandemic put a different spin on the program this year, but it actually allowed attorneys from areas outside of Jacksonville to assist with cases remotely and expanded our pro bono attorney panel. Students and attorneys who were not located within JALA and Three Rivers’ service areas were able to take on cases so long as the case was one that could be completed remotely, or the attorney was able to travel. Throughout the state, 309 cases were placed during the 2021 Law School Challenge. For JALA and Three Rivers, nearly 20 cases were placed with law student/attorney teams. JBA members recognized at The Florida Bar annual meeting

ASHLEA EDWARDS YOUNG LAWYERS SECTION IMMEDIATE PAST PRESIDENT

Attorneys received awards for their accomplishments and assumed leadership roles. After a year of mostly virtual Bar events, The Florida Bar had a hybrid virtual and in-person annual convention June 9-12 in Orlando. Members of the Jacksonville Bar Association were well represented and recognized again this year. At the Young Lawyers Division board of governors meeting, YLD President Adam White ended his 2020-21 term in office by presenting the annual awards. The recipients were chosen after review of many nominations in support of attorneys from all over the state. Among the recipients are two outstanding members of the Jacksonville legal community. Duval County Judge Rhonda PeoplesWaters, recently elected to the bench, received the YLD Woman Lawyer of Distinction Award. LaTesha Campbell, an assistant state attorney, received the YLD Outstanding Government Lawyer Award. Earlier this year, the YLD selected the JBA Young Lawyers Section as its Large Affiliate of the Year, a distinction that the JBA’s young lawyers have not received in more than a decade. At the general assembly, YLD governors Valeen Arena, Sara Morris and I were sworn in to serve another year on the YLD board. JBA 2021-22 President Michael Fox Orr and Braxton Gillam were sworn in for another term on The Florida Bar board of governors. JBA members Mike Tanner and Gary Lesser were administered the oath of office as 2021-22 Florida Bar president and president-elect, respectively, by state Supreme Court Chief Justice Charles Canady. As we begin the new Bar year, I look forward to seeing the accomplishments of our members shine locally and statewide.

Amid clouds, find your silver lining

Light continues to shine even in darkness. There is no doubt that this past year has been a challenging year for most of us. On a large scale, we faced a global pandemic compounded

with social unrest. On a personal level, many of us dealt with increased anxiety, depression and grief from the lives lost and uncertainty of what the future holds. Although we are more than halfway through this year, the challenges presented in 2020 linger. However, much like the tropical storms we witness this time of year, there always is a silver lining. When the sun or moon shines behind a dark cloud, a silver lining is created. Metaphorically, it signifies that light will continue to shine even as darkness exists. I was challenged to find my silver lining in the darkness of 2020 and I challenge you to find yours. For me, one of the first signs of hope in the midst of 2020 came from nature. While in quarantine, I began gardening

outdoors and growing house plants indoors. Because I worked from home for most of the year, I watched my plants grow and blossom. That was a daily reminder that life will move forward and be beautiful despite tragedy. With the availability of coronavirus vaccines and eased restrictions, my newest silver lining is the upcoming Young Lawyers Section Bar year. I soon will be sworn in as president of the section and I’m looking forward to serving alongside our board of governors. I am looking forward to more in-person social events and being able to hug my friends and colleagues. In the 2021-22 Bar year, YLS will continue with our three annual charity events: The golf tournament, poker tournament and Chili Cook-Off.

While we had to postpone the 2021 Chili Cook-Off scheduled in February, we were fortunate to move the poker tournament into a virtual format and continue with the golf tournament to raise money for local organizations. For the upcoming year, the board selected the MaliVai Washington Youth Foundation as the recipient of proceeds from the poker tournament and Girls of Virtue as the recipient for the golf tournament. Big Brothers Big Sisters of Northeast Florida will remain the recipient for the 2022 Chili Cook-Off. All three organizations work to serve local youth to equip them with the tools to face challenges and find the silver lining during life’s storms. Each nonprofit has its own needs, so we are pleased to be able to contribute monetarily to help meet some of those needs.

Take time today to think about something you’re looking forward to this year. Perhaps it’s starting a new hobby, beginning a new job or taking up a new form of exercise. Maybe it’s reconnecting with family and friends or volunteering in the community. For me, joining the Peloton community has allowed me to connect with friends, challenge myself and manage stress. I’ve also continued to nurture my house plants, which has taught me to be more patient. We all have a silver lining, whatever it may be. I encourage you all to find yours. An in-person jury selection alternative

The 4th Circuit’s tested hybrid remote model offers advantages. The viewpoints and opinions reflected in this article are my own and do not represent any official policy or position of the Florida Supreme Court, the Office of the State Courts Administrator, the Judicial Conference of Florida Judges,or the Chief Judge of the 4th Judicial Circuit. After selection by the state Supreme Court’s COVID-19 Workgroup in 2020 to participate in the remote civil jury trial pilot project, the 4th Circuit conducted two fully remote civil jury trials using Zoom with the participants’ consent. Both trials resulted in binding verdicts. The pilot project ended in October 2020 and then the workgroup submitted its written report with its findings and recommendations to Chief Justice Charles Canady. Those findings and recommendations included my opinion, as outlined in Chapter 15 of the report, that scaling fully remote jury trials for implemen-

tation on a weekly basis is not feasible, but that a hybrid system consisting of a remote jury selection with an in-person trial presentation would be a realistic and feasible option for the civil justice system. The workgroup also completed two hybrid jury trials in April and May 2021 with the parties’ consent that resulted in binding verdicts. The first was a complex, two-week wrongful death trial including two days of remote jury selection. The second was a damages-only trial arising from a claim of professional negligence with one day devoted to

the remote jury selection. Simultaneously, the COVID-19 restrictions gradually were eased in the Duval County Courthouse and in-person jury selections have increased. Considering these recent positive jury trial developments, should the 4th Circuit’s remote jury selection option be eliminated? It is my opinion that our remote jury selection model is a practical alternative to in-person jury selection and, in some circumstances, offers advantages over the in-person selection for the following reasons: ■ The guarantee of a special

set trial with a remote jury selection that will not be bumped off the trial docket. ■ After jury selection, the trial is conducted in person at the courthouse. ■ The response rate for remote jury summons is comparable to, or higher than, the response rate for in-person jury summons. ■ All prospective remote jurors are required to answer an electronic juror questionnaire in advance of remote jury selection which are then forwarded to the attorneys several days before jury selection. ■ Surveys of the jurors in our remote jury selections indicate

that they prefer remote jury selection over in-person jury selection. ■ Remote jury selections have more flexibility as to the number of jurors and the duration of jury selection because the venire is not physically present in the courthouse. We typically have panels of 15 potential jurors or less each separated into morning and afternoon panels allowing up to 30 jurors to be questioned each day. However, we can accommodate practically any reasonable combination of jury pool numbers and jury selection duration. Remote jury selection is conducted the week before the trial begins. After selection, the jurors are instructed to report to the courthouse on the following Monday morning to hear opening statements. This process adds more certainty to the parties’ trial scheduling and logistics planning. We are committed to continuing this hybrid, remote civil jury selection process, but we need the continued help and support of the 4th Circuit’s attorneys. Mahon once presented me with a Consent Final Judgment of Dissolution of Marriage and, in support of it, offered the testimony of two young women. One was his client, the wife, and the other was her residency witness. The wife was appropriately attired. The residency witness was, shall we say, not. I advised Mahon that I could receive the wife’s testimony but not that of the residency witness. Mahon explained that there were considerations outside the record which made it essential that the divorce occur that day. I offered alternate hearing time for later that day but the witnesses were not available at those times. Mahon ruminated aloud, “So, judge, what we need is for the witness who is testifying to be appropriately attired.” I agreed with that unremarkable proposition. He thought a moment and then his face lit up. “Judge,” he said, happily. “My client and her residency witness are best friends. They are the same size.” I immediately understood the solution he was offering. The future chief judge conferred briefly with both women and they left the room. When the residency witness re-entered, she was alone and attired in the wife’s demure garments. She left after her testimony and, a few minutes later, the wife

re-entered the room, having resumed wearing her own clothes. She testified and was divorced that morning. Circuit Judge Virginia Norton had completed the step-parent adoption of an adorable 4-yearold boy. He had been carefully dressed by his parents, was exquisitely well-mannered, and clearly was the veteran of many preschool birthday parties. Thus it was that, as he and his family were leaving chambers, he paused and returned to Norton. “Thank you for having us over,” he politely said. The final moment of hilarity requires me to embarrass myself. My order speaks for itself: “On the Court’s own motion, it is further ORDERED that the Court from the referenced order strikes a phrase in line 3 of the first paragraph, a phrase that resulted from an unfortunate but unobserved auto-correction. “The phrase ‘signed by the Fathead his counsel’ is stricken and replaced by the intended phrase ‘signed by the Father’s counsel.’ “The Court regrets, and apologizes to counsel for its failure to previously note the erroneous auto-correction.” Shall I point out that “Father” and “Fathead” both start with F-A-T-H-E? You are right: it’s a weak excuse. I for years to come will be apologizing to the lawyer involved, who remarkably did

not point out the error to me. I only found it when a new motion required me to review past orders. When the unintended insult jumped out at me, I didn’t know whether to be horrified or convulsed in laughter. I also will share three moments of the awe-inspiring variety. There was the American Inns of Court formal dinner in the magnificent Great Hall of the U.S. Supreme Court, where I, a young lawyer, was randomly assigned to sit at the same table as Justice Ruth Bader Ginsburg, scholar and hero to so many of us. At the time, I could not foresee the future global pandemic nor that in response to that pandemic I would one day wear a black mask adorned with Justice Ginsburg’s iconic white jabot and the words famously associated with her: “I dissent.” What I did learn in the Great Hall that evening was that justices deal with the same everyday challenges that we lawyers and ordinary judges face. How, someone asked, did the justice manage to be appropriately attired for a black-tie event when she lived in Maryland and could not go home to change after a long day at the office? Her eminently sensible solution, which she readily shared: “I wear a black dress to court and then bring evening pumps, an evening bag, a change of earrings and an evening shawl.” Lightweight,

easily packed, and capable of being discreetly carried. This brilliant jurist whose opinions changed the legal landscape still remembered how to be practical. U.S. District Judge Brian Davis inspires awe. You cannot find a more principled person or one more committed to working for justice. A gentle man, he nevertheless has a backbone of steel. When he was an assistant state attorney assigned to after-hours homicide duty, he received an emergency call asking for his help at the scene of a shooting. The location was the original Hubbard House battered women’s shelter. A violent man had broken in and was rampaging through the house, looking for those who were trying to escape him. A quick-thinking receptionist called 911 and left the phone on the counter where the dispatcher could hear what was happening. Police responded just as the armed man discovered his wife and children cowering in a closet. Having no choice, the officers shot and killed the intruder. When Davis arrived on the scene, the man’s body had been removed, but the wife and children and other victims in the shelter were still terrified and traumatized by what they had witnessed. Sensitive to their distress, Davis quietly requested towels

and grimly mopped up the blood on the floor so that the deceased man’s children and wife would not have to continue to see it. Compassion personified. A proud Jacksonville law firm once realized that it had committed malpractice. It did not rush to settle the case and bury the evidence of its mistakes. Instead, uncertain if the client understood the issue, the firm’s partners asked to meet with him. They advised him that he had a legal malpractice claim against the firm and then they provided him the names of several lawyers who handled such cases. The actions of the firm epitomized professionalism and unswerving ethical principles. Doing the right thing is easy when your action does not produce adverse consequences, much more difficult when it does. One cannot retire from the law without recalling countless moments experienced or observed: Some courageous and noble, some wise, some tragic, some frustrating, and some simply affording needed comic relief. Each lawyer’s or judge’s moments are unique. Treasure yours. Cole was appointed to this position in 1994 to replace Dorothy Pate. Cole won election in 2018 and her current term ends Jan. 7, 2025.

The proposed O&M Assessments as stated include collection costs and/or early payment discounts, which Duval County (“County”) may impose on assessments that are collected on the County tax bill. Moreover, pursuant to Section 197.3632(4), Florida Statutes, the lien amount shall serve as the “maximum rate” authorized by law for O&M Assessments, such that no assessment hearing shall be held or notice provided in future years unless the assessments are proposed to be increased or another criterion within Section 197.3632(4), Florida Statutes, is met.
