Shake Shack approved for renovation at Town Center

Shake Shack is converting the closed M Shack at St. Johns Town Center now that the city issued a permit April 15 for the $1.3 million project. RCC Associates Inc. of Deerfield Beach is the contractor for the conversion at 10281 Midtown Parkway, No. 101, at the Southside shopping center. BAI Architecture Inc. of Boston is the architect.

M Shack closed March 17 after its lease expired. It opened in St. Johns Town Center in late 2013.

Shake Shack Jacksonville No. 1492, as it is called on the permit, will be 4,258 square feet comprising 3,136 square feet of inside space and 1,122 square feet of patio space.

Shake Shack Brand Communications Specialist Kate DeMarco said April 16 she did not have details about when the location will open.

New York City-based Shake Shack Inc. calls itself a “modern day ‘roadside’ burger stand.”

Grocery-anchored center planned for Clay County

The Clay County Development Review Committee reviewed site plans April 11 for a proposed groceryanchored shopping center called the Henley Grocery Center in Lake Asbury.

The 12.16-acre project would include retail, office space and a public park. Plans call for 243 parking spaces. Newberry-Based AY Ventures Inc. owns the land. Jacksonville-based England-Thims & Miller Inc. is the civil engineer.

Thomas Yonge of AY Ventures said no grocery store is identified for the shopping center and it was early in the process of “marketing to tenants.”

The proposed 51,390-square-foot grocery store is similar in size to Publix locations.

The Henley Grocery Center would border Henley Road and Verbena Parkway south of State Road 23, also known as the First Coast Expressway.

SE Toyota Distributors wins $60 million permit

Buildings are on the way up at the Southeast Toyota Distributors auto processing center at the Jacksonville Port Authority’s Blount Island Marine Terminal with approval for the $60 million processing and operations support buildings.

The city issued a permit April 9 for J.E. Dunn Construction Co. to build the 337,000-square-foot concrete tilt-wall and structural steel structure at 8975

Dave Rawls Blvd. at the North Jacksonville terminal. That structure is the industrial processing and accessories facility.

The operations support building is described as two stories and 24,000 square feet.

Southeast Toyota said in April 2022 it would move its auto processing operations from JaxPort’s Talleyrand Marine Terminal to the Blount Island terminal.

More changes ahead for Lofts at Southbank

Developers of the Lofts at Southbank are returning to the drawing board after the Downtown Development Review Board raised concerns about the conceptual design of the mixed-use project, which has drawn opposition from neighbors for including a self-storage operation.

Two days after a special meeting in which the DDRB voted in favor of

recommending rezoning for the project, the board deferred a request for conceptual approval from the developers during a regular meeting April 11.

The deferral was granted to give designers time to revise the plans based on input from DDRB members, several of whom criticized aesthetic elements of the design.

Proficient Auto Logistics plans to merge 5 firms

The Jacksonville-based company filed April 11 for an initial public offering.

Proficient Auto Logistics Inc., a Jacksonville-based auto transportation and logistics company, is looking to profit from a postcoronavirus rebound in automobile production as it launches an initial public offering.

The company’s primary business is shipping new cars from manufacturers to dealers. It was formed to merge five automobile transport companies that together produced $415 million in 2023 revenue.

The mergers will be completed when the IPO closes, according to Proficient’s registration statement filed April 11 with the Securities and Exchange Commission.

The largest of the five companies is Jacksonville-based Proficient Auto Transport Inc., which was founded in 1993.

That company had revenue of $135.8 million and net income of $7.2 million last year, according to the SEC filing.

CEO Randy Beggs will become president and chief operating officer of the merged Proficient Auto Logistics.

company Saia Inc., will be chief executive of the merged company. He is currently nonexecutive chairman of Saia.

The other four auto transport firms are two New Jersey-based companies, Delta Automotive Services Inc. and Tribeca Automotive Inc., and two Californiabased companies, Deluxe Auto Carriers Inc. and Sierra Mountain Group Inc.

“We will operate one of the largest auto transportation fleets in North America based upon information obtained from leadership of the Auto Haulers Association of America, utilizing roughly 1,130 auto transport vehicles and trailers on a daily basis, including 615 Company-owned transport vehicles and trailers, and employing 649 dedicated employees,” the SEC filing said.

“From our 49 strategically located facilities across the United States, we offer a broad range of auto transportation and logistics services, primarily focused on transporting finished vehicles from automotive production facilities, marine ports of entry, or regional rail yards to auto dealerships around the country,” it said.

The five companies combined produced annual revenue of about $260 million from 2019 to 2021, as automobile manu-

facturing slowed because of supply chain disruptions and component shortages during the pandemic, the filing said.

However, the companies grew revenue in 2022 and 2023 from market share gains and price increases.

“Industry production volumes are beginning to rebound, and are expected to be a continuing tailwind for the auto transportation and logistics industry throughout the next three to five years,” it said.

“We believe the combination of our executive management team, the management of the Founding Companies, and the fragmented nature of the auto transportation and logistics market will provide us with the capability and opportunity to continue to expand both organically and via effective tuck-in acquisitions.”

Proficient’s headquarters office is at 12276 San Jose Blvd. on Jacksonville’s Southside. The filing does not say how many people it will employ at the corporate headquarters.

The 30-year-old Proficient Auto Transport business, headquartered at 10047 103rd St. on Jacksonville’s Westside, has about 140 employees, it said.

The registration statement does not say how much stock

would be sold in the IPO and does not give a timetable.

CSX rated at ‘hold’ ahead of Q1 earnings report

Before CSX Corp.’s first quarter earnings report late April 17, Jefferies analyst Stephanie Moore initiated coverage of the Jacksonville-based railroad company with a “hold” rating.

“With shares above its longterm average and fully discounting an almost 10% EPS compound annual growth rate over the next two years, we think shares are close to fully valued,” Moore said in an April 8 initiation report on major railroad companies.

“We view the rail industry as well within the maturity phase,” she said.

“With just six competitors, the industry is at the end of a multidecade consolidation story which was capped off with the merger of Canadian Pacific and Kansas City Southern.”

Moore thinks investors need to take a different approach to evaluating rail stocks in this phase.

“With a fresh look at the industry and the competitors, unburdened by investment theses of the past, we think the Street continues to put too much

emphasis on structural margin expansion, and we see growing disconnect between the investment community investing in these assets and the management teams running them,” she said.

“Said another way, investors and analysts still want structural margin expansion, while the rails themselves are focused on service and volume growth.”

Soler & Palau acquires air control firm in Chattanooga

Jacksonville-based Soler & Palau USA acquired certain operating companies of United Enertech Holdings, according to an April 15 news release by S&P USA’s financial adviser Heritage Capital Group.

S&P USA specializes in designing and manufacturing ventilation products for commercial, industrial and residential applications.

Chattanooga, Tennesseebased United Enertech manufactures products for the HVAC industry including high-quality dampers, louvers and diffusers.

S&P USA said the addition of United Enertech provides customers with a single-source ventilation system solution. Terms of the deal were not announced.

The Benteler Automotive Group spinoff could be the code-named Jacksonville prospect for a $100 million parts and assembly plant.

A spinoff of a German automotive group appears to be the leading candidate as Project Link, the electric autonomous vehicle and parts manufacturer considering Jacksonville for a $100 million plant to establish its North American presence.

Holon, an almost 3-year-old automotive brand spun off from Germanybased Benteler Automotive Group, is an autonomous, fully electric and inclusive mover that was presented in early 2023 at the Consumer Electronics Show in Las Vegas.

Benteler said in a news release in 2023 that production is scheduled to start in the U.S. at the end of 2025, with additional production capacity to be built in Europe and the Middle East/Asia in the following years.

It later changed that date to 2026.

Holon matches the description, needs and timetable for Project Link, the code name for a company Jacksonville is trying to recruit.

Benteler has not announced where in the U.S. it would start production, but when asked about prospects that it could be Jacksonville, a company spokesperson responded April 10:

“HOLON is planning to set up three production sites to market our autonomous mover worldwide in the next couple of years: in the USA, in Saudi Arabia and in Europe. We are currently conducting corresponding evaluations of potential locations,” it said.

“As always, we will take the needs of our customers and other framework conditions (availability of skilled workers, funding opportunities, etc.) into account when choosing a specific location. It’s therefore too early to discuss specific locations. We ask for your understanding,” it said.

Benteler Group’s overall headquarters are in Austria, with the automotive division in Germany.

Ed Randolph, executive director of the city Office of Economic Development, said April 10 he had signed a nondisclosure document regarding the identity of

Project Link. He did offer a few more insights April 8 when he told members of the Mayor’s Budget Review Committee that he believes Jacksonville has at least a 50-50 chance of landing Project Link. He said he hoped an announcement on the plant would be coming in 60 to 90 days.

SEEKING INCENTIVES

The Office of Economic Development is introducing legislation to Jacksonville City Council to support incentives for Project Link with property and training grants totaling $7.7 million. The state would provide an $8 million incentive award and a tax credit.

A Jacksonville project summary says Link is a company that proposes to manufacture parts and assemble an electric autonomous vehicle in Northwest Jacksonville at an investment of $100 million.

The company plans to use a new 450,000-square-foot space on about 40 acres. Randolph said there are multiple prospective sites in Northwest and North Jacksonville.

A March 24 memo from the Mayor’s Budget Review Committee, which authorized legislation to be introduced,

says the company is a subsidiary of a global industry leader in the automotive industry and currently does not have a presence in the U.S.

The memo says the company wants to develop a footprint in the U.S. automotive landscape and is considering Florida and other Southeast U.S. states for the facility. The facility would support the company’s clients throughout the U.S.

It would be the first autonomous electric vehicle assembled in Florida.

The $100 million capital investment represents the cost to build and furnish a facility by year-end 2026.

The company would start with about 145 employees by Dec. 31, 2027, and

increase to more than 200 as demand increases.

Payroll would top $9 million exclusive of benefits.

The city incentives would comprise a $7.5 million Recapture Enhanced Value Grant paid over 10 years and a training grant up to $200,000, based on $1,000 per job.

The state incentives would be a HighImpact Performance Incentive Award of $8 million in two installments as the project progresses and a Capital Investment Tax Credit of 100% of the state Corporate Tax Liability, which was not specified as an amount.

The project summary said the project is within a targeted industry and adds to the skilled labor base in Jacksonville.

JAXUSA Partnership President Aundra Wallace had no comment April 10. The partnership is the economic development division of JAX Chamber.

POINTING TO HOLON

The descriptions parallel Holon. Benteler.com says that at the end of 2021, Benteler spun off the Benteler EV Systems business unit and then changed the name in late 2022 to Holon to focus on the business with fully electric, autonomous moves.

Benteler Group CEO Ralf Göttel said that mobility around the world is undergoing rapid change.

“BENTELER is optimally prepared for this – 85% of our products are technology and propulsion-method agnostic. In parallel with the traditional automotive business, innovative, digitally connected, and autonomous mobility services promise high growth in the coming years,” he said.

“By founding HOLON, an independent legal entity, we can react flexibly to changing customer requirements in this dynamic market. In this way, we will make the best possible use of growth opportunities.”

There also appears to be financial support for the expansion.

On Feb. 8, 2024, Benteler announced that an external investor wanted to buy “a significant amount of shares to help the company’s business with its autonomous vehicle grow.”

It said Saudi Arabian company Tasaru

Mobility Investments was considering the acquisition of a 33% stake in Holon “for a nine-digit sum,” the company writes. However, Tasaru will not buy the shares at once but in tranches, or portions.

Following regulatory approval, the first transaction is expected in April.

Benteler said it will use the money to expand its autonomous mover business.

THE HOLON MOVER

Benteler said the Holon Mover is an all-electric self-driving vehicle for public roads and, according to the company, “one of the world’s first movers built to automotive standards.”

It can hold 15 passengers, “making it an ideal vehicle for ridesharing and ondemand services.”

The first pilot project was announced in Germany with Hamburg’s Hochbahn, the country’s second-largest mass transit company.

It said that in the U.S., the mobility provider Beep will be responsible for implementing the first vehicles. Other areas of application and customers include private institutions such as campuses, airports and national parks.

Florida State College at Jacksonville is working with Beep Inc., which provides software and service to operate autonomous vehicles.

Representatives of FSCJ, the Jacksonville Transportation Authority and Beep celebrated the launch Feb. 20 of the campus shuttle service, becoming the first campus in Florida to have autonomous shuttles in use.

The vehicles move people along a milelong route on the FSCJ Downtown campus.

The term “holon,” pronounced hollen, is a Greek word for “something that is both a whole and a part of a whole.”

The brand’s slogan is “HOLON –Established Tomorrow.”

Benteler.com says Benteler Automotive develops and produces components and modules in the areas of chassis, body and engine and exhaust systems.

“We support our customers along the entire value chain – from the product idea through development to production and assembly. We also offer system solutions for electric vehicles,” it says.

Work is underway to convert them from oneway traffic back to how they were decades ago.

Work is underway to restore two-way traffic on stretches of two Downtown streets.

Downtown Investment Authority CEO Lori Boyer recently told the Downtown Vision Inc. board that construction has begun to reconfigure Forsyth and Adams streets for two-way traffic from Jefferson to Liberty streets.

The work is being done under a $4.6 million revised contract approved in October 2023 with Jacksonville-based EltonAlan Inc., an engineering and construction firm.

Boyer, a member of the DVI board, said crews have started prep work to install new signal devices at intersections. That work is part of the first phase of the two-phase project.

As part of Phase I, Boyer said, the streets would be restriped and traffic would be converted to two-way. The second phase involves work such as moving curbs and widening portions of sidewalks, she said.

Phil Perry, chief communications officer for the city and Mayor Donna Deegan’s admin-

istration, said in an April 4 email that EltonAlan is running underground traffic signal conduit and completing orders for construction materials.

Perry said the city expects road construction to begin this summer, including lane shifting and repaving asphalt. Between now and then, traffic signal infrastructure will be installed and construction materials will start to arrive, he said.

ORIGINALLY TWO-WAY

The streets originally were designed to be two-way but were changed decades ago during a car-first time in traffic engineering.

At that time, engineers prioritized quick movement for commuters to and from Downtown workplaces over walkability and commerce.

Boyer and the DIA uses the term two-way restoration versus conversion to emphasize that the streets will be a modernized version of their original design.

One aim is to slow traffic and make the streets safer for walking, cycling and other modes of transportation like scooters.

The restoration also is designed to make more efficient use of on-street parking and ride-sharing.

The overall goal is to encourage pedestrian activity, increase

mobility and foster development of street-level dining and retail.

The idea is that those businesses will benefit from increased foot traffic and patronage by motorists who are more likely to notice storefronts along the streets while traveling at lower speeds.

The project is part of the DIA’s strategy for revitalizing Downtown, which includes a focus on attracting residents and new businesses to the area, improving quality of life, creating a cyclical effect of redevelopment and driving up property values.

Boyer told the DVI board that the first phase of the restoration is expected to be completed in less than a year. The second phase is in design.

SIMILAR CONVERSIONS

Several cities across the U.S. have made similar conversions, and projects in other cities are underway. They include a $46 million-plus conversion of eight streets in Indianapolis.

A 2015 study of conversions in Louisville, Kentucky, showed that accidents decreased as much as 60% after two-way traffic was restored on two city streets in 2011.

The study, which compared the data from the two years after the conversions with the four years before, also showed an

increase in property values along the converted streets, although the study’s authors noted that factors other than the new traffic patterns were likely involved.

In a November 2023 editorial about the two-way conversion of Main Street in Vancouver, Washington, The Columbian newspaper said the project had rejuvenated the central business district since it was completed about 10 years ago.

The editorial stated that a street that used to provide “a one-way trip leading out of town” had become the center point of “a revival that enhances life for residents and attracts visitors from near and far.”

TRAFFIC CONCERNS

Detractors of street conversions say they’re not as efficient at moving traffic as one-way streets and increase the possibility of head-on collisions. Another concern is that two-way streets create congestion for fire trucks and other emergency vehicles, increasing response times.

Proponents counter that twoway streets provide a more direct route to destinations and reduce the possibility of high-speed vehicle-pedestrian accidents.

The U.S. Department of Transportation reports that traffic tends to move faster on one-way streets than two-way

streets. Although one-way streets require pedestrians to look for oncoming cars in only one direction, the transportation department says several studies have shown that conversion to two-way traffic reduces pedestrian accidents.

The department also says twoway configurations slow traffic through “friction,” with drivers slowing to contend with oncoming traffic and pedestrian traffic.

On College and Post streets in Riverside and Avondale, which were converted to two-way traffic in 2006, it is common to see cars slowing and pulling to the curb to allow oncoming cars to pass by.

In 2021, the city approved a $1.33 million contract with Jacksonville-based Prosser Inc. for two-way mobility and safety engineering services.

Prosser produced a design for Forsyth and Adams streets that included 10-foot travel lanes and seven-foot parallel parking spaces, plus new features such as protected “parklets” with seating areas, steel planters and wood flooring.

The contract with EltonAlan includes all facets of the conversion, including milling and resurfacing, signal and sign installation, pavement marking installation, utility alterations and maintenance of traffic.

Council member Lahnen seeks Purple Heart City designation for Jacksonville

To undergird support of military veterans and active service members, including those who stay and work in Jacksonville after their active service has ended, City Council member Will Lahnen has introduced legislation that would make Jacksonville a Purple Heart City. Resolution 2024-0261 would add Jacksonville to the list of more than 900 U.S. cities that participate in the Purple Heart City program. The program honors both active service and veteran military personnel who have received the Purple Heart

medal for wounds suffered during their service.

In its economic development efforts, Jacksonville promotes the community as having a pipeline of skilled, experienced workers through the presence of Naval Air Station Jacksonville and Naval Station Mayport.

Space and defense companies operating in the area include Northrop Grumman, Boeing, Redwire Space, Carlisle Interconnect Technologies, Kaman Aerospace and Collins Aerospace, according to the JAXUSA

Partnership website.

Lahnen served as a U.S. Navy submarine commander and is currently the director of finance and procurement at the Wounded Warrior Project.

His community service activities include being a member of the JAX Chamber’s Military Affairs Committee.

“We have approximately 30,000 service members in the greater Jacksonville area with roughly 3,000 ending their careers or enlistments each year, and I want to help ensure we are positioning ourselves to the best of

our ability,” Lahnen said. “And while not measurable, this is another small step we can take.”

Fifteen Council members have cosponsored the resolution, including Navy veterans Nick Howland, Jimmy Peluso and Raul Arias, Florida National Guard Judge Advocate General Rory Diamond and Army veteran Chris Miller.

The legislation is in committee review on its way to a vote by the full Council. If it passes, the city’s costs will consist of paying for signs to put up at major entryways to the city.

JEA CEO Jay Stowe resigns; Vickie Cavey named interim leader

Board Chair Joe DiSalvo said philosophical differences were behind Stowe’s departure.

The top executive at JEA is out, replaced on an interim basis by a former high-ranking JEA employee who had been hired less than three weeks earlier to serve as a liaison for the board.

Jay Stowe, the utility’s CEO and managing director since 2020, stepped down during a special board meeting April 15. During the same meeting, the board voted to name Vickie Cavey as interim CEO.

The moves came after board members brought Cavey aboard as a liaison between them and Stowe’s administration March 26 to review JEA’s organizational structure and to help choose an independent consultant that the board would pay to examine JEA’s capital improvement plan.

Those moves prompted questions about whether the board had lost confidence in Stowe by bringing on an independent consultant as opposed to relying on his guidance.

‘DIFFERENT PHILOSOPHIES’

JEA board Chair Joe DiSalvo said Stowe’s departure had nothing to do with malfeasance or misconduct but rather stemmed from a philosophical disagreement with board members over how to move the utility forward.

The board is seeking another consultant to evaluate a plan by the administration to spend $4 billion over the next several years on capital improvements, including a $2.3 billion to upgrade and expand the water and sewer system and a new high-tech natural gas electric-generation plant that will cost about $1 billion.

“It’s a sports analogy: Belichick and Kraft decided to part company,” DiSalvo said, referring to the break between New England Patriots owner Robert Kraft and coach Bill Belichick after the 2023-24 NFL season. “Same thing. Nothing derogatory against Jay. He did a great job. We just had different philosophies, so we needed to go a different way.”

Several participants in the meeting said there was no plan to sell JEA.

Stowe’s resignation is effective Aug. 15.

In a separation agreement, he will be paid a lump sum of $257,504 and a monthly business allowance of $2,083. The allowance will be prorated during August.

The agreement further stipulates that Stowe will serve through his separation date as an executive consultant and will continue to receive his regular pay and benefits during that time. He will continue to accrue annual leave and will be paid for his unused time off.

DiSalvo said it had not been determined how much Cavey would be paid in the interim role.

He said the succession plan would involve a consultant analysis of JEA’s structure, which could take until the end of the year to complete.

“From that, I hope to get an idea of what exactly is the right organizational structure, and then from there we’ll get a good idea of what are the characteristics that we are looking forward to seeing (from CEO prospects),” he said.

When DiSalvo asked whether any board members were opposed to accepting Stowe’s decision, a message flashed up reading, “Any opposed? Yes, like 2/3 of the work force.”

During public comments before the vote, JEA employees commended Stowe in person.

Randy Hilton, a longtime JEA employee and union leader, said staff members would miss Stowe and were confused

about the reasons behind his departure.

“What’s the why? Who triggered this? And what’s the background of all this?” he asked.

When Stowe left the board room, several attendees stood and applauded him.

Former JEA board member and lobbyist Mike Hightower endorsed Cavey for the role. He cited her experience with the utility and community, saying she was former CEO Paul McElroy’s first hire when McElroy was brought back to serve as interim CEO after Zahn’s firing.

In remarks during the board meeting, she emphasized her longtime connection to the utility. She said was wearing the same business suit she wore to her first day on the job at JEA 40 years ago – a gift her mother bought for her at the former 5-7-9 clothing store in Jacksonville.

“I have vivid childhood memories of my widowed mother of five crying in our poorly insulated rental home because of our high electric bills in the 1970s. She was a waitress,” Cavey said.

“That was a time when JEA had among the highest electric rates in the country due to our reliance on oil and the oil embargo of 1973. Thanks to strong leadership and cultural diversity, JEA eventually had the lowest rates in the state,” she said.

Cavey addressed the issue of JEA employees being allowed to work remotely out of the county and out of state, which prompted speculation the policy had become a pain point between Stowe, the board and City Council members.

“When you work remotely, it’s hard to mentor people,” she said. “It’s hard to identify people with talent. It’s hard to have synergy with your coworkers. So I think going to a different model or an integration of a hybrid model or something to that effect could help us.”

The board accepted Stowe’s resignation without a vote. Its decision to hire Cavey as the interim came with one no vote, from member Kawanza Humphrey, who said her stance on the hiring was not related to Cavey or her qualifications for the role.

“In the absence of a formalized succession plan, I’m a little more accustomed to seeing a COO take on the role,” she said.

Stowe’s resignation came less than four years after he was brought in during November 2020 amid turbulence surrounding former CEO Aaron Zahn.

Along with former JEA CFO Ryan Wannemacher, Zahn would be accused of scheming to steal tens of millions of dollars in bonuses from the utility by deceiving the board into exploring a sale and approving an incentive plan that would have triggered the bonuses.

Stowe referenced the controversy while reading from prepared remarks during the April 15 board meeting.

A public hearing will be held on the above mentioned day and time at the City of Jacksonville Council Chambers, City Hall - St. James Building, 117 West Duval Street, 1st Floor, Jacksonville, Florida 32202, before the full City Council of the City of Jacksonville, Florida, (“City Council”) to consider the elements of a petition (“Petition”) filed by EPG JAX, LLC (“Petitioner”), to consider the adoption of Ordinance 2024-246, establishing a community development district to be known as the Kings Creek I Community Development District (“District”), as authorized and provided for in Chapter 190, Florida Statutes. A copy of the Petition is available for public inspection in the Office of Legislative Services, located on the 4th Floor of City Hall, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Interested parties may appear at the meetings and be heard at the public hearing with respect to the proposed ordinance.

The information presented at the meetings and hearing will be used to afford the Petitioner, landowners, any affected units of local government, and the general public, a fair and adequate opportunity to appear and present oral and written comments regarding the establishment of the District. If adopted, the ordinance will establish the District, name its initial Board of Supervisors, grant the District the right to exercise the additional power described in Section 190.012(2)(a) and (d) related to parks and facilities for recreational uses, and educational uses and security, and designate the land to be serviced by the District.

The land area proposed to be served by the District is generally located southwest of Lem Turner Road and bisected by Braddock Road. The District will comprise approximately 1,198.18 acres of land. The boundaries of the lands proposed to be served by the District are outlined in the map depicted in this notice. The Petitioner has proposed that the District will construct or acquire certain infrastructure improvements in order to serve the land within the District. By way of information, a community development district is a local unit of special purpose government authorized by statute to ensure the provision of infrastructure to serve community developments subject to state and local regulatory requirements governing the lawful use and development of the property. Establishment of a district pursuant to Chapter 190, Florida Statutes, is not a development order under Chapter 380, Florida Statutes. All planning, permitting and other regulatory requirements pertaining to development within the land area will be in accordance with general and special law.

The City Council will conduct the public hearing in accordance with Section 190.005, Florida Statutes, and determine whether to establish the District by ordinance. The purpose of the public hearing is to consider whether the petition meets the six factors listed in Section 190.005(1)(e), Florida Statutes

A statement of estimated regulatory costs (“SERC”) was prepared by Inframark, LLC, in compliance with Section 120.541, Florida Statutes, as required by Section 190.005, Florida Statutes. The complete text of the SERC is contained as Exhibit H to the Petition. By way of summary, the SERC indicates the type of individuals and entities most likely to be affected by the ordinance are the landowners within the District. The SERC estimates that establishment and enforcement costs to the above-described entities will be modest; and, that there will be little to no negative impact on state and local revenues from the establishment of the District. Further, the SERC provides that future property owners within the District will be affected by the proposed ordinance to the extent that the District issues debt for the construction of infrastructure and undertakes operation and maintenance responsibility of that infrastructure. Finally, the SERC concludes that the establishment would have no negative impact on small business and that the City of Jacksonville is not a “small city” as defined by Section 120.52, Florida Statutes Interested persons are advised that, if a person decides to appeal any decision made by the City Council with respect to any matter considered at a hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

Using new technology and being prepared for the cost roller coaster are some of the factors.

In litigation, an attorney’s success is often tied to his or her ability to “think like the other side.”

Contractors, too, have an opportunity to secure a winning edge by placing themselves in the customer’s shoes, whether that is a government agency, commercial owner or homebuyer.

In 2024, the Northeast Florida contractor’s customer is frustrated; the dollar is not going as far as it has in recent history and certainly not as far as the customers would like it to go.

Construction costs are high. Money is more expensive to borrow. Projects that made great sense four or five years ago are not as easy to pencil without

incentives.

So how can contractors leverage the shifting market and gain an advantage over competitors?

Take care of your employees, subcontractors and suppliers

The demand for construction labor and skilled trades are at an all-time high, while the available supply is at an all-time low.

Contractors with talented employees and dependable subcontractors/suppliers should focus on retention and relationship-building.

On the internal side, offering a client your “A Team” will lead to higher trust, better performance and an increased likelihood that a partnering approach will proceed successfully.

On the external side, reliable lower-tier partners will allow contractors to remain confident in their sequencing, scheduling and budgeting — again garnering trust with the owner.

On both fronts, contractors who can reduce turnover will be in the best position to balance risk and avoid disputes in every direction.

Stay current on technology

In a high-cost market, a contractor’s ability to maximize and persuasively present value is crucial.

When there is no “give” in material pricing, implementing

digital construction technology presents major opportunities.

For example, rather than charging an hourly fee for a field employee to methodically capture, log and report daily progress photos from a limited vantage point, deploying drones allows contractors to present high-definition photo and video progress updates in real time and from angles and heights previously not possible or efficient to provide.

Particularly in the context of commercial projects and residential developments for future end-user sale, owners may also find value in drone footage for marketing and advertising purposes, presenting another layer to this approach.

From quality assurance to sales content, low-cost technology is a value-add that should not be overlooked.

Offer sustainable products

When immediate savings are not on the table, contractors who can offer future savings will stand out.

Renewable energy, ecofriendly materials and greenscapes are opportunities to reduce long-term costs and, in some instances, qualify the project for incentives, both of which can help lighten an owner’s financial pressure in the overall package.

Be prepared for the material cost roller coaster

After a period of calm, upward price pressures are reemerging. As the Associated Builders and Contractors published in its March news release, overall construction input prices are 1.5% higher than a year ago, nonresidential construction input prices are 1.8% higher and inflation data is coming in hotter than anticipated.

Brick, tile, gypsum and steel are categories with apparent jumps.

Contractors who can think ahead, prepurchase materials and lock in prices at key points in the fluctuation will stand out to owners as industry experts and good stewards of project funds.

Know where the Northeast Florida markets are going By all accounts, the region continues to display strong economic health.

Contractors who stay focused on growth areas can expect strong business opportunities as the year rolls on.

Residential, multifamily and condominium markets will continue to expand given low vacancy in comparison with population growth. Industrial projects will surge as reliance on e-commerce drives demand for logistics and distribution centers.

High volumes of migrating

professionals with higher disposable income and a desire for community integration will lead to a retail sector revival.

Contractors who can present themselves as the industry experts that owners want will ultimately prevail as the partners owners need in 2024.

Construction boom times bring challenges

Be prepared for potential labor disputes and contract issues.

Northeast Florida is on the brink of a construction boom. Once a steady-growth town, economically driven by the insurance industry and a strong military presence, Jacksonville is now growing in multiple areas that will soon result in the largest construction expenditures our community has ever seen.

Construction demand in the region has remained strong since 2017 and will continue to be focused on the commercial market – although office buildings, along with single-family residential, will remain soft until interest rates tick downward.

Warehouse facilities and

multifamily housing have led the way since 2020, but other sectors are now gaining strength.

Construction of the Four Seasons Hotel and related buildings is underway, marking the start of extensive and long-planned development near Metropolitan Park.

Significant work has begun in the health care sector and the upcoming stadium renovation, and the Museum of Science & History project also will infuse significant dollars into the local economy at a record pace.

This is good news on many fronts, but the expansion will come with some growing pains that owners and industry professionals should be prepared to face.

LABOR CHALLENGES

One major challenge will be finding enough workers to staff large new projects without siphoning skilled labor from previously planned smaller projects. Atlanta, Austin, Texas, and and Nashville, Tennessee, all have experienced construction booms that exceeded their local workforce capacity.

That led to significant delays on some projects and sparked a bidding war for replacement workers as experienced project managers, superintendents

and crews were lured to larger projects by eye-popping signing bonuses.

That type of situation may benefit some employees, but it can leave legal claims of delay, mismanagement and poor workmanship in its wake.

Because labor-related project disruptions impact every party to a construction contract, a valuable strategy for minimizing the practical and legal consequences is to address the possibility in the contract negotiation phase.

On a broader level, trades and subcontractors can attract and retain vital personnel by investing in properly trained workers and compensating them fairly.

In the long term, our community can support a healthy construction industry with training and apprenticeship programs.

SUPPLEMENTAL WORK

Whether the money from a construction boom stays in the local economy depends on how many local trade contractors are ultimately paid to perform the work.

Project funding flows from the owner/developer down to the contractor and then to subcontractors and subcontractors.

If there is a dispute, that flow stops, leading to a bad situation for everyone.

The owner or general con-

tractor withholds money from the subcontractor and the sub withholds money from subsubcontractors, typically both the smallest companies on a project and the least equipped to weather a financial shortfall.

To inoculate against labor issues, general contractors would be well-advised to have a relationship with a sub that can mobilize quickly to supplement defective or delayed subcontractor work.

At the same time, they should be aware that an overly aggressive supplementation process with a related entity can lead to a lack of trust by the subcontractors and the owner.

BE PREPARED

Owners, general contractors and subs can protect themselves from financial and legal problems by having enough money in the budget to ensure that the work can be performed for the contract price under less-thanideal conditions.

While it’s nice to believe that every sub will complete work on time, materials will arrive when needed and substrates will be in perfect condition, owners and

savings end up in the pockets of the lawyers following a dispute that arose because the sub was more focused on immediate cash flow than planning for contingencies.

If missteps occur, owners need to be prepared to allocate the risks to the party most capable of managing or minimizing that risk.

Daily documentation of external impacts is essential, as the company that communicates clearly and effectively will typically win the day in court, if it comes to that.

As construction in Jacksonville begins to boom, preparing for possible risks will help the construction industry and our local economy make the best of a good thing.

The annual event raises money for Jacksonville Area Legal Aid.

With pledges still coming in, the 10th annual Pajcic & Pajcic Yard Golf Tournament raised more than $174,000 as of April 17, a record single-year donation making a total over the history of the event of more than $1 million for Jacksonville Area Legal Aid.

In addition to law firm and corporate sponsorships, more than 250 people paid the entry fee for the afternoon of miniature golf and fellowship along the St. Johns River in Avondale.

The Pajcics match sponsorships and entry fees to double the support for civil legal aid in Northeast Florida.

“Yard golf keeps getting better every year.
