“I

hate journalists.”

That was the opening statement by one of my college professors when a bunch of my fellow journalism majors and I attended our first class in economics at Adams State College (now University).

With that gauntlet being thrown, I did what any self-respecting collegiate cub reporter would do: I dropped the class and took it again at another time.

It was required, so I couldn’t get around it.

For years I thought that particular professor had it out for journalism majors. I have since come to understand that what he really meant was that he hated the way economic issues were reported – often misunderstood – by reporters. He didn’t hate the reporters themselves.

Over the last three decades, I have learned that reporting on business and the economy is very complicated. Business people often do as bad a job articulating their point as many reporters do reiterating it. On the flip side, there are very good reporters and very good business communicators.

The bottom line is that both sides are trying to do their best. At least, I try to do my best. I have been on both sides. As an independent businessman,

my track record is less than stellar. As a reporter and editor, I’ve been much more successful. Moving into my new position as editor of the Fort Bend-Katy Business Journal, I want you to know that I will be doing everything in my power to make sure that the information you are receiving is accurate, timely and informative.

If the information you are given in our pages doesn’t meet those criteria, then I have failed at my job and, more importantly, will have lost the trust of our readers. I won’t stand for that. Fort Bend County and Katy have very savvy and intelligent business leaders who deserve the best we can deliver.

We have within our coverage area world-class medical communities, a powerful energy sector, top educational institutions, stellar arts, entertainment and museum communities, and some of the best dining options in the country. My goal is to make sure this magazine reflects that quality. I don’t want to give anyone who reads the Fort Bend-Katy Business Journal any reason to say that they hate journalists.

Would You Like to Legally, Morally & Ethically Disinherit the IRS?

T

here are numerous ways to avoid running out of money during retirement. Chief among them is not paying the government more than you need to.

Now, I am talking about tax efficiency, not tax evasion. The difference between the two is about twenty years, and we want to be on the right side of those twenty years, so let’s look at how we can legally be tax smart.

While no one likes paying taxes, when the income faucet is on, they are less painful. But, what about when you retire, your income sources (social security, pension, etc.) aren’t sufficient to cover your lifestyle and you have a set amount of retirement savings to cover the difference?

Imagine that those retirement savings are in a big bucket and your bucket has holes — namely investment risk, fees and taxes. You want to keep your bucket full (maintain principal). Now, doesn’t

it become even more paramount to minimize the size of that tax hole? In fact, if any money leaks out, wouldn’t you prefer that it lands in your hands? Thus, tax planning is April R. Roberts, J.D. an important aspect of retirement income planning for two reasons: 1) we want to sustain your retirement income savings and income for you and your spouse’s lifetime; and 2) we want as much of it to stay in your family’s hands (instead of the IRS) as possible when you pass away. One way that I ask my clients to do tax planning is by imagining four tax buckets:

The goal of good tax planning, and a part of good retirement income planning is to move assets as far to the bottom of this list as possible. Let’s briefly discuss each of these buckets. The first bucket is the taxable bucket, I also call this your income bucket. If you are still working, and your boss knocked on your door tomorrow and said, “Hey, Sally, I’m going to give you a 20 percent raise” would you be excited or would you worry about paying taxes? Would you tell your boss, “Thank you, but I don’t want to pay the additional taxes so please don’t give me a raise?” You would take the money! My dad, who was a CPA for 20 years used to tell his clients “go make all the money you can and let me worry about the taxes.” Most people would agree with this sentiment. So, what we want to do is take the income that someone

is willing to give us and also take the income that we need. But, in retirement, it becomes very important that we don’t take more than that. Why? Because if we do, we are paying unnecessary taxes and depleting our retirement income savings.

Now, let’s visit what may be falling into this taxable bucket that we don’t want to fall here.

If you are receiving dividends, interest and capital gains on taxable investment accounts and not using them for retirement income, guess what? You are still paying taxes on them — even if they are being “reinvested”.

Remember that we want to separate your retirement income from your retirement savings for good retirement planning. If you are not taking these sources as income, they should fall into the savings bucket. If you are paying unnecessary taxes on them (because you don’t use them as retirement income) then they are falling into the income bucket for tax purposes and depleting your retirement savings bucket. Also, any distributions from a qualified retirement plan (401K, IRA, 403(B), TSP, etc.) would fall into this taxable/income bucket. These are two areas to consider closely for tax efficiency in retirement.

Oh, and you do know that your social security is taxed, right? Most people pay taxes on somewhere from 50 percent to 85 percent of their social security. The amount you pay in taxes is determined by the other income that you receive. So, managing this first bucket could allow you to pay less in taxes on your social security. Not a bad idea, is it?

If you think that you are having sources of retirement savings fall into this bucket that you don’t need as income, wouldn’t it make sense to move those to the next bucket, the tax-deferred bucket?

The second bucket, the tax deferred bucket simply allows you to defer taxes until you take distributions from it. Your qualified retirement plans, as well as any annuities and cash value life insurance would fall here.

When you are younger and earning good income, your CPA likely recommended that you save some money for retirement in your 401(K) or another type of qualified retirement plan so that you could avoid paying taxes on that income at that time.

The thinking behind this is that you will be in a lower tax bracket in retirement so when you distributed the assets, you’d pay less in taxes. One misnomer of this idea is that the assets should have grown larger, so you may have a larger pot of money to pay taxes on in retirement. Also, sometimes, people don’t

need income from these plans or they have saved too much in them, but at age 70 1/2, the government kind of forces you to start taking income. This is called your Required Minimum Distribution (RMD), which is a calculation based on your age and the amount you have in your qualified retirement plan. As you age, the calculation increases.

If you happen to be one of the individuals who won’t need your RMD in retirement, we can start doing some tax planning early and formulate a plan to move it to the next bucket, the tax free bucket. This is where a good retirement income planner and a good CPA come in handy.

The third bucket is for assets that are income tax free — this means that once set up, you won’t have to pay income taxes on them during your lifetime. The most commonly known vehicle for accomplishing this is a Roth IRA. Other options for this bucket include municipal bonds, appreciation of capital assets held until death and life insurance (if properly structured).

Now, while income tax free is wonderful, income and estate tax free is even better.

Some retirees receive enough money in their pension and social security that they will never touch their retirement income savings.

I call this their “never” money. If you have never money, you probably should investigate a plan to move it into the income tax free bucket, even better, you may want to consider moving it to the fourth bucket, the income and estate tax free bucket.

This fourth bucket is the holy grail — income and estate tax free, but it’s also a little more complicated as it combines life insurance and a trust. It’s called an irrevocable life insurance trust, commonly called an ILIT. It’s worth mentioning that good retirement income planning and good tax planning should involve conversations between your financial professional, your CPA and your Estate attorney. If these three individuals aren’t talking, then likely either issues or money may be slipping through your fingers. I like to tease my clients that I’m the quarterback of their finances. While I can’t be your financial planner, your CPA and your attorney, I can make sure that we’re all talking and trying to sure up any cracks.

Club SciKidz, Tech Scientific ready to launch in Sugar Land

I

n the land of NASA, Omah and Herbert Duncan are hoping they can help youngsters rocket to the head of the class in the fields of science, technology, engineering and math (STEM) with their new Club SciKidz and Tech Scientific programs that are starting up this year in Sugar Land.

The couple purchased a franchise of the Atlanta-based summer camp and after school program and is the first to launch it in the Houston area. The inaugural programs will open soon in Sugar Land and will be expanded to other communities.

“This is unlike anything we had seen in the city of Houston,” Omah Duncan said.

Duncan, a former classroom teacher who has her doctorate from Texas A&M University, and her husband are entrepreneurs where were looking for business opportunities in the area. They are also parents of a 5-year-old and were frustrated with the time and expense of taking him to different enrichment programs. That’s when they discovered Camp SciKidz in Atlanta and decided to give it a try.

“We enrolled our son and we to the Atlanta camp for a week … and fell in love with the camp,” Duncan said.

She said the program brought everything they were looking for into one package. The company is committed to demonstrating how science works in the real world by providing activities in veterinary medicine, robotics, forensics, video game creation, food science, paleontology, engineering, chemistry and biology.

“Being able to allow little Houstonians the opportunity to experience multiple

science, technology, engineering and mathematics experiences in one location has been a long time dream and now it is a reality,” Duncan said.

The age-appropriate summer camp programs are for children ages 4-5, 6-8, 9-11 and then the advanced Tech Scientific program for youngsters 12-15. There is a half-day option for children ages 4-5. The first summer camp begins June 13 and enrollment is under way at Houston. clubscikidz.com.

In order to bring the program to multiple communities, the Duncans are partnering with local churches for space. So far they will be at Fishers of Men Lutheran Church at 2011 Austin Parkway and Faith Lutheran Church at 800 Brooks St. “We will be adding locations in Houston and Katy in the coming year,” she said. “We are interested in recruiting churches in the Katy area. We have lots of families interested there.”

In addition to enrolling children for the summer camps, parents can also enroll them in the before and after school programs that will start in the 2016-2017 school year.

With a slogan “Where Science and Technology Connect,” Club SciKidz takes children’s enrichment opportunities to a whole new level by offering 42 different science themed day camps, after-school science clubs, Lego Robotics, in-school field trips, science birthday parties, pre-school workshops and scouting badge projects.

Duncan said the classes will be set up like a lab to enable more hands-on learning.

There will be different classes throughout the day with breaks for lunch and some unstructured play time.

“We want to help keep kids healthy,” she said.

Why Document Preparation Websites Can Cost You

he phrase “do-it-yourself” is often used in the context of home improvement, cooking or craft projects and is usually associated with saving money. However, unlike a failed attempt at baking the perfect bread, using a document preparation website to draft your legal documents can cost you more than just your dough. Before you use a document preparation website to do things like form a company or draft a will, consider these two points.

First, document preparation websites are not a substitute for consulting with an attorney. Chances are that if you are seeking to draft a legal document, you are also seeking re¬lated legal advice – advice which you will not find on a docu¬ment preparation website. In fact, one of the top document

preparation websites states in its Terms of Use that it does not review a user’s answers for legal sufficiency, draw legal conclusions, or provide legal advice, opinions or recommenda¬tions..

Second, these websites treat your legal issue in isolation. Yet, one document can create a ripple effect in your legal issue pond.

Document preparation websites can give you a false sense of security because they do not alert you to po¬tential future issues.

In short, while you might save money in the short term, a document that does not provide an adequate or appropriate legal solution for your needs can end up costing you more in the long run.

celebrate FM 1093/Westpark Extension groundbreaking celebration

F

ort Bend County officials along with Fort Bend Toll Road Authority and TXDOT representatives, gathered recently for the groundbreaking celebration of the long awaited FM 1093/ Westpark Extension.

Phase One of the project includes 4.12 miles of FM 1093 and approximately 2.5 miles of the Westpark Tollway extending from State Highway 99 to FM 1463. The phase is set to be complete by February of 2018.

Phase 2 of the project includes 4.15 miles of FM 1093 extending from FM 1463 to James Lane and is scheduled be bid by the end of the year with a completion date of July 2018.

“This vitally needed project is finally underway. Completion will provide greatly improved traffic flow to this fast growing area of North Fort Bend County,” Fort Bend County Judge Bob Hebert said.

Houston Methodist Sugar Land Hospital opens new patient pavilion

H

ouston Methodist Sugar Land Hospital employees recently celebrated the opening of the hospital’s new six-story patient

tower.

A ribbon-cutting and blessing ceremony were held on Feb. 26 to mark the launch of the new Brazos Pavilion, which will house 104 patient care beds, bringing the hospital’s total bed count to 347.

Brazos Pavilion’s 20-bed intensive care unit opened on Feb. 29 and build-out for an additional 56 medical/surgical beds will be completed in May. An additional 28 beds will be added based on demand from our community.

“The opening of the new Brazos Pavilion is the culmination of our $131 million expansion program that began in 2013,” said Houston Methodist Sugar Land Hospital CEO Chris Siebenaler. “We are proud of this significant investment in the Fort Bend community and thrilled with our expanded ability to serve our patients.”

Harvest Green holds huge open house

fter spending a couple hours Saturday at the neighborhood grand opening festival, friends and neighbors Anita HuntNelson and Holli Walker made a return trip Sunday to bask in their decision to buy homes in Harvest Green, Houston’s first farm and garden focused community in Fort Bend County’s master-planned community.

Hailing from Chicago and Ohio, the two friends relaxed on the promenade near the stage as their family sought out treats from nearby food trucks and the Spasmatics band expertly played Led Zeppelin’s “Kashmir.”

“This is so exciting. We had to come back today earlier, we didn’t want to miss anything,” said Hunt-Nelson who said she and her family built a home three years ago

and downsized and built a 1.5-story home in Harvest Green.

“It’s a Johnson Development and we know what they do,” said Hunt-Nelson.

“This will be healthy living for our children,” piped in Walker, who closes in April on her family’s Harvest Green home.

Parents echoed that theme of safety and healthy living throughout the different sections of the 300-acre park Sunday as they visited the 11 model homes, watched their young ones interact with baby animals in the petting zoo or sampled healthy treats in the food tent from area chefs and food entrepreneurs.

“This is our audience. This is why we’re here,” said food entrepreneur Courtney Spiwak who was selling signature grapeseed oils under the tent. She said Johnson Development paid them to be present to get residents and future residents comfortable to the idea and ease of healthy cooking.

With an on-site farmers market, a planned farm-to-table restaurant and acres of greenbelts and open space, the homes priced from the $260s to the millions and the two-day open house attracted plenty of attention.

Jennifer Bausch of Meadows Place was excited about the “family atmosphere” provided, the emphasis on fresh and local grown food and the chance to see new model homes. Her youngsters were happy about the animals and the bouncing tents.

“I got to touch bunnies and chickens,” said her young daughter.

“We had 2,000 people on Saturday and it’s even bigger today, “ said event planner Lynda Winne.

She said they used overhead drones to determine the number of visitors. By Sunday afternoon, she was declaring the event a success since she knew of at least two builders who signed contracts for a new home. Cars and trucks continuously poured into the new Richmond neighborhood off Grand Parkway 99 and West Airport Boulevard. Golf carts and trolley cars shuttled visitors who parked beyond the Oyster Creek bridge and didn’t want to make the trek.

The 1,300-acre community, which is Houston’s first “agrihood,” will eventually feature up to 2,000 homes, more than 300 acres of farmland and several amenities including a farm-to-table restaurant, greenhouse, a grove of fruit trees, a nursery, farm stand and community gardens.

The community is anchored by a fouracre village farm and education center allowing residents to attend classes and events and lease plots to grow their own food. Home builders include D.R. Horton, Darling, David Weekley, Highland, Lennar, Meritage, Newmark,Plantation, Perry, Trendmaker and Westin Homes.

Travis High School, James Bowie Middle School and Harvest Green’s future on-site elementary school will be connected by walking paths to the Village Farm where classroom space will be available for courses in agriculture.

The Village Farm will also host weekly farmers’ markets open to residents and the public, according to their website.

in the military more frequently, which meant I had to step away from my duties as a school teacher. Thankfully, Principal Kammerman found creative ways for me to implement my lessons and make sure my students were taken care of during my time away. Having her in my corner has made it possible for me to serve my nation, as well as my students.”

he Central Fort Bend Chamber celebrated the grand opening of Hair Salon Maciel’s new location with a ribbon cutting ceremony March 7 and welcomed the owner, Elizabeth Cervantes, to the chamber family.

Hair Salon Maciel is located at 5255 B Reading Road in Rosenberg, in the Reading Road Professional Office Park. More than 60 business owners, elected officials and chamber members delightedly welcomed Cervantes and her nine staff members at the ceremony.

Elizabeth Cervantes has been serving Fort Bend County as a professional business owner and hair dresser for 20 years.

“It has been my passion to change lives, transforming each individual’s natural beauty,” Cervantes said.

s a lawyer, Stephen Fernelius has always done things in a big way.

He still does big things but now he wants to do it on a smaller scale. and that experience, including a successful trial, has convinced me that we are ideally positioned to assist folks who have to endure such an ordeal.”

Not only has he developed, prepared and tried several process-plant disasters, Fernelius also participated in a trial involving a terrorist attack on U.S. oil workers stationed abroad, defending against claims of inadequate company security. That trial, which resulted in a complete defense victory, was followed closely by the international insurance industry.

He also defended at trial a U.S. auto manufacturer against the claim that the deployment of an air bag caused the death of a driver. The case ended in a successful jury verdict and was followed closely by the automotive industry, as it was the first case of its kind.

Among Fernelius’s high profile catastrophic industrial-accident-defense experience is a case where he successfully defended a multinational energy company last year in a five-week trial in federal court in which the plaintiffs sought a quarter of a billion dollars in damages, but were only awarded a few thousand.

“Since our inception, in addition to representing the world’s largest corporations, we have been privileged to represent a number of individuals and closely-held/family-owned companies in a wide-range of disputes,” he said.

Those have included: • Representing a family-owned business against its insurance carrier for failing to abide by its contractual obligations. The litigation resulted in one of the most important insurance-coverage opinions issued by the Texas Supreme Court in the last several years.

• Securing a confidential settlement for parents for the wrongful death of their son following a three-week jury trial.

• Negotiating a substantial, confidential settlement for an individual and small-business owner who suffered major injuries due to the negligent conduct of another corporation’s employee.

• Successfully pursuing slander-of-title claims for a private landowner, which enabled our client to close an important real estate transaction.

• Winning negligence and gross-negligence findings on behalf of the estate of a young woman who was wrongly killed.

• Obtaining a confidential settlement on behalf of an individual who suffered significant injuries as the result of a homeowner’s negligence. The settlement was reached almost immediately after FAS filed suit.

Fernelius came to Texas from Ohio in 1980 at the age of 14. He graduated from Dulles High School in 1984 and went to college at Georgetown University. He earned his Juris Doctor with honors from the Uni-

He has coached several teams at First Colony Little League and has served for years on the board of the Fort Bend Education Foundation.

TEXAS DIRECT AUTO’S DOWNTOWN LOCATION IS

OUT OF THIS WORLD! They’re calling it #DowntownMars and it is Space City’s first dealership on Mars. Located in the Central Business District at 1301 Leeland St., it’s currently the largest mural in downtown Houston, wholly inspired by humanity’s distinct curiosity with The Red Planet. Houston-based Eyeful Art Murals and Designs teamed up with Texas Direct Auto™, the largest independently owned dealership in the nation, to design and paint an out-of-this-world work of art covering a 7,000 square-foot canvas on the outside of a downtown building. The building started its life as a hotel in the 1930’s and has since been converted to an office building. Inside, Texas Direct Auto™ will operate a satellite Sell Us Your Car™ Center, one of nine area locations.

Jessica DeMarr, Director of Marketing and New Business Development, said, “Texas Direct Auto is technology-driven to make the process of buying and selling a car most efficient for our customers. Just as NASA has laid the foundation for success in space, Texas Direct Auto has laid the foundation for successful car buying. Started by two native Houstonians with zero experience in the automotive industry, Texas Direct Auto™ is bringing their ninth location to “MARS” but with an edgy twist. The team at the company wanted to create a new public art destination while beautifying an entire building. The goal of the project, rather than erecting their typical billboard style signage, was to turn this onceoverlooked three-story building into a “must see” public art destination.

The mural is intended to pay homage to Houston, also known as Space City, with a colorful and whimsical angle. Furthermore, exterior lighting and red-colored boulders will be added to the entrance of the building to give the mural a 3D effect, producing interactivity with the work.

And one side of the building features an interpretation of the Texas flag and an astronaut doggie floating in space. Yes, you read that correctly, an astronaut doggie. Which is guaranteed to put a smile on people’s faces during their daily commutes for years to come.
