Katy homebuilder firm looks back on 40 years

A

l Mayer, in 1971, decided to leave St. Louis, where he wasn’t building many homes, and move to West Houston where he hoped to be more successful. Almost immediately, he was successful with his company, Trendmaker Homes.

“Mayer set up an office just east of Dairy Ashford and concentrated on town homes,” recalled Joel Marshall, who has been with Trendmaker for the past 25 years, now as vice president of land development. In 1972, there wasn’t much building activity west of Dairy Ashford, he said.

“Mayer was a visionary, “ Marshall said.

“He saw this area as a place of opportunity.”

Trendmaker soon shared in developing subdivisions and in constructing a majority of the homes in Green Trails, Grand Lakes and Cinco Ranch. Now, Trendmaker is kneedeep in the dynamic new community of Cross Creek Ranch which will have some 4,500 homes in Fulshear.

Mayer saw hundreds of acres of rice fields turned into attractive master-planned communities which have been the signature of the rapid growth in Katy .

Now, Trendmaker has been saluted by the Katy Area Economic Development Council for its 40th anniversary. Marshall, representing Trendmaker, gave a brief power point presentation at the November KAEDC breakfast, showing various high end model homes which it is selling throughout Fort Bend County, and a new line of casual homes in Wimberly, Round Top, and other Central Texas areas.

“Trendmaker is an outstanding company that has helped build the Katy area with outstanding neighborhoods,” said Lance LaCour, president and CEO of KAEDC. “They have been an outstanding supporter of economic development, and of the Katy Area EDC.” Trendmaker, through the years, has been successful in anticipating the desires and tastes of home buyers, going from town homes, to custom homes to high end production homes, and now homes in more rural settings.

In 2010 Trendmaker was cited by J.D. Power and Associates as the winner for “Best Customer Satisfaction” in the Greater Houston area.

“We’re seeing the need for nice patio homes again,” Marshall said, as ‘baby boomers’ now are leaving the large ‘empty nests’ for nice single-story, small-yard living areas.”

As Trendmaker’s land development executive, it’s part of Marshalls’ job to keep a pulse on the needs of potential home customers.

From a few employees in 1972, “Trendmaker now has 115 employees, going strong,” Marshall said.

Lake Pointe Town Center adds two new tenants

wo new tenants are coming to Lake Pointe Town Center, the Whole Foods-anchored shopping center at the intersection of Highway 59 and State Highway 6. Busy Body is now open for business and Great Greek Grill is scheduled to open by the end of the year, announces Planned Community Developers, Ltd. (PCD), the developer of the 9,700-acre First Colony master-planned community and two other major projects: River’s Edge, a 370-acre community in Richmond and the 32-acre Sugar Land Town Square.

Methodist Sugar Land Hospital’s free flu shot clinic and community toy drive a success

ethodist Sugar Land Hospital, in collaboration with the Sugar Land and Fort Bend Exchange Clubs and the Sugar Land Rotary, provided free flu shots to community members who participated in Santa’s Gift Exchange. Fort Bend and surrounding county residents graciously brought new, unwrapped toys or clothing items to Methodist Sugar Land Hospital in exchange for a flu shot. The toys and clothing will benefit local children in the Fort Bend area during this holiday season.

Big biz for vendors & local economy

About $1 million projected in annual sales from Farmers Market at Imperial

C

ha-ching! Cash registers of some 50 local farmers, dairy operators and vendors are melodiously making that money making sound each Saturday at the Farmers Market at Imperial in Sugar Land.

Organizers are projecting the market will generate over $1 million in annual sales.

“We certainly had high expectations during the planning stage and by all indications, we’ve met or exceeded them,” said Keri Schmidt, president of the Fort Bend Chamber, which presents the official GO TEXAN Farmers Market.

Just about 60 vendors regularly participate each Saturday at what started in October and it is now going on three months with quite an impressive

attendance. Schmidt said they offer shoppers fresh-from-the-field fruits and vegetables, pasture raised meats, free range eggs, local cheeses, fresh baked goods, jams and honeys, spices, olive oils and so much more. Even the Lakeview Elementary School students raised over $700 from the sale of their market items—popcorn, lemonade and other merchandise –for a fundraiser at a pumpkin patch they set up.

Here’s the business success part in brief.

After she lost her job in 2009, Julie Hammond of Hammond Farm started producing and selling goat cheese, soaps and lotions to supplement her family’s income. “With the addition of the Farmers Market at Imperial, we now participate in three Houston-area markets to support the sale of our products,” she said. “Our sales

at Imperial have been strong and steady.”

There’s also Jaime and Theresa Crespo, owners of Teresita’s restaurant nearby on Eldridge Road. They say exposure at the Farmers Market has impacted their business and they’ve seen an 18 percent increase in traffic. Crespo said that the Farmers Market is “our most effective marketing tool yet.”

They’ve even booked more off-site catered events, she said.

There’s more. Nearby merchants are reported to have witnessed an increase in sales since the opening of the Farmers Market. The event is held at U.S. 90A and Ulrich Street by the Imperial Sugar silos and the historic Char House. Rain or shine, it’s held on Saturdays, 9 am – 1 pm.

Risk Assessment

n our current age of financial crises, corporate bailouts, sovereign debt crises, high unemployment, and gridlock in federal governments, it is difficult to assess what the future brings in investment markets. W

ith a total land area of 181 square miles, the Katy Area is located where three counties converge – Harris, Fort Bend, and Waller. It is an important part of the Greater Houston area and includes the entire boundary of the City of Katy and parts of the City of Houston and City of Fulshear. The City of Katy has a rich history as a major rail center, and the early oil and gas industry provided a unique character and tradition to the small city. Fields surrounding the City have been some of the largest producers of rice in Texas, which has made agriculture an important part of Katy’s economy.

Thanks to the top rated Katy Independent School District, the Katy Area is booming and growing rapidly. With a current population (2010) of 259,000 people, Katy is growing at an average rate of over 5% each year. In 2010, the Katy Area was rated as the No. 1 place in the United States for growth by the Gadberry Group, a site selection firm that composes growth articles for Business Week magazine. By the year 2015, the Katy Area is expected to grow to 327,000 in population and to over 550,000 by the year 2035. The demographics of the area are strong and improving every year, with the school district area having an average household income of $104,000.

headquarters and manufacturing sectors. Katy is home to over 150 headquarters companies.

In fact many of the world’s largest energy companies have offices in the “Energy Corridor,” such as BP North America, Conoco Phillips, Shell Exploration and Production, Foster Wheeler, and Mustang Engineering. Over half of Katy’s workforce has a bachelor’s degree, and a graduate or professional degree is held by 15 percent or more of area residents than other Texans as a whole. The unemployment rate of the Katy Area is below five percent and the civilian labor force is expected to grow 31.7% from 135,000 (2010) to 177,000 by the year 2015.

In terms of available facilities for companies, the Katy Area has over 13 million sq. ft. of inventory in office space in buildings over 20,000 sq. ft.. Much of the available office space is being occupied, with BP North America and KBR recently leasing large portions of office space in the Energy Corridor. Office space developers are preparing to build new office space to accommodate the expansion of the Energy Industry.

Industrial space is growing in Katy, as well, as over 2,000,000 square feet of industrial space has been added in recent years through the efforts of the Katy Area Economic Development Council.

Companies such as Rooms to Go have constructed 1,000,000 sq. ft., with the Pathfinder Energy Services project constructing 200,000 sq. ft., and Pointsmith building 140,000 sq. ft.. Since its inception in 2003, Katy Area EDC has helped create over 8,900 jobs and over 1 billion in capital investment.

Fort Bend Family Health Center expands provider services

F

ort Bend Family Health Center (FBFHC) is growing and expanding. In addition to the renovation of its Richmond center, the addition of a Rosenberg-WIC Specialty site and a new Missouri City center, FBFHC has recently hired two new providers, Dr. Silpa Roa and Dr. Gildardo Ceballos.

Dr. Rao received her medical degree in Family and Community Medicine from Kasturba Medical College. She completed her Family Medicine residency at the University of Texas Medical School at Houston. Dr. Rao is a member of the American Academy of Family Physicians.

In her spare time, Dr. Rao likes to spend time with her husband and dog, Snooze.

When asked why she chose to work at Fort Bend Family Health Center, Dr. Rao responded: “I love Fort Bend county and I

wanted to make a difference in the underserved community.”

Dr. Gildardo Ceballos specializes in Internal Medicine and received his medical degree from Gildardo Ceballos Rosario University in Bogotá, Columbia. He completed his residency at the University of Texas Medical School in Houston. Dr. Ceballos is a member of the American Medical Association and Silpa Roa the American College of Physicians. “I enjoy helping people,” said Ceballos. “I want to help in underserved communities where doctors are most needed.” Dr. Ceballos also loves spending time with his wife and playing soccer, tennis, and running.

Carol Edwards, CEO of Fort Bend Family Health Center, states, “We are excited about having these two great providers who will help expand the number of patients we can help as we expand the range of services we can provide.”

Transform taxable IRA minimum distributions into tax free donations Are you frustrated over taking minimum IRA distributions that inflate your taxable income needlessly or at inopportune times?

At the same time, in this economy wouldn’t it be nice if you could fund your charitable obligations for 2011 without impacting current cash on hand? Many are unaware that a soon expiring tax saving provision is still available for 2011 that allows you to do just that, and satisfy your IRA distribution requirements at the same time. You can still use IRA distributions up to $100,000 to fund charity directly in 2011. This allows you to satisfy all or part of your Required Minimum Distributions, channel the funds to your charitable targets, and do so without putting taxable ordinary income on the face of your Form 1040. In the meantime, you can use current cash on hand to fund your living expenses and other things.

A “qualified charitable distribution” is any otherwise taxable distribution from a traditional IRA or a Roth IRA that is: (1) made directly by the IRA trustee to a Code Sec. 170(b)(1)(A) charitable organization (other than a Code Sec. 509(a)(3) private foundation or a Code Sec. 4966(d)(2) donor advised fund); and (2) made on or after the date on which the individual for whose benefit the IRA is maintained (i.e., the IRA owner) has attained age 70½.

For RMD rules as they apply to individual retirement accounts and individual retirement annuities, qualified charitable distributions may be taken into account to the same extent that the distribution would have been taken into account under the RMD rules had the distribution not been directly distributed under

the IRA qualified charitable distribution rules.

Thus, when you make an IRA qualified charitable distribution in an amount equal to your 2011 RMD you are treated as having satisfied you minimum distribution requirement for the year, even though a charitable entity (and not you the IRA owner) is the actual recipient of the distribution. If you turned 70½ in 2011 you may have some interesting potential options.

This is an expiring provision and there are other special rules that can be retroactively applied as well. Careful planning will help you fit this to your individual scenario.

But my contract said no oral modifications In today’s business world, the contracts that we sign are essentially the rulebook that we play by. However, sometimes those “rules” that businesses place in their contracts don’t carry a lot of weight. For example, many business agreements contain a provision toward the end of the contract that specifically prohibits oral modifications and further requires that any modification to a contract to be in writing.

This “no oral modification” clause sounds great. Their intended purpose is to prevent confusion about the terms, and would seem to help avoid future litigation about disputes of changes to a contract. However, these clauses are generally unenforceable and often provide parties to a contract with a false sense of security.

Unless the contract is one that is already required by law to be in writing, “no oral modification”” clauses do not prevent that

agreement from being changed by a subsequent oral agreement. This principle is firmly rooted in Texas law. In fact, Texas courts have recognized the ineffectiveness of no oral modification” clauses since 1887 when the Supreme Court of Texas decided Morrison v. Insurance Company of America.

In Morrison, the Court stated that, “A written bargain is of no higher legal degree than a parol (oral) one and, therefore, either may vary or discharge the other.”

Despite this long standing and clear position in the law, commercial agreements continue to include “no oral modification” clauses despite their general legal irrelevance.

The law is fairly clear: unless the law requires an agreement to be in writing, any “no oral modification” clause included in a contract will not be honored if that agreement is subsequently orally modified.

The false sense of security caused by these

clauses can have significant effects on a business. For example, business owners could assume that a “no oral modification” clause protects them and allows them to talk freely and informally about the terms of an agreement with no fear that those discussions could lead to a modification until they are reduced to writing. Under the law, that assumption is probably a false one.

It is important for businesses to know that a “no oral modification” clause offers very little, if any, protection and should generally not be relied upon.

Depression loses its grip

Local psychiatrist brings cutting-edge technology to Greater Houston

F

or more than two years, Sugar Land psychiatrist Kimberly Cress, M.D. has been treating patients in the Greater Houston area with a new, cutting-edge technology for depression: TMS or Transcranial Magnetic Stimulation.

“Based on my experience, I believe that TMS is the future for treating individuals with depression,” said Dr. Cress. “Not only can it be very effective at treating the symptoms of depression, TMS gives patients an important alternative that does not contain the traditional systemic side effects of depression treatment.”

A Salute To Fort Bend Growth This month’s journal salutes Fort Bend County growth, economic development and our chambers of commerce. In other words, if you have been involved in business in Fort Bend….take a bow. You are part of one of the more impressive community success stories not only in Texas, but the entire country. Over the past decade, both the velocity and the quality of growth in Fort Bend has consistently ranked among the very highest in the US. This success has been the result of a lot of hard work and dedication by a lot of individuals and organizations throughout the county. Our chambers of commerce and our economic development organizations have done a great job of communicating our successes and our opportunities to the rest of the world.

Earlier this year, Ted Jones, chief economist for Stewart Title, reported that while the

United States lost 1.79 million jobs (-1.35%) between 2000 and 2010, Fort Bend County added 74,500 additional jobs (+ 41.6%) over the same period. Over that same period of time the county’s population grew 63% to 577,444 people. Over the next ten to fifteen years, our population will double to over 1.1 million.* This number is considered conservative by many as the county has historically outpaced almost all previous projections by demographers.

From a real estate perspective, this forecast, while impressive, is foreboding. One way to put that level of growth into perspective is to consider the current inventory of houses and commercial properties in Fort Bend. For every house, shopping center, office building, warehouse, restaurant, school, hospital, etc., in the county, there will be twice as many within fifteen years. It took the county fifty years to

grow from 40,000 people in 1960 to the current 585,000. We will add the next half a million residents (and the corresponding doubling of residential and commercial buildings), in about 1/5 of that time.

Although, like the rest of the world, our recent growth slowed as we attempted to navigate through the economic uncertainty following the recession a couple of years ago.

I am confident we will soon be back on track.

Most of our real estate activity in 2009 and early 2010 was primarily due to companies downsizing or repositioning to take advantage of pricing opportunities. I am seeing encouraging signs this year. We have signed a number of leases for expansions and new locations.

Fort Bend Library System opens University branch in Sugar Land

T

he grand-opening ceremony of Fort Bend County Libraries’ University Branch Library was held November 10 at the new library, located at 14010 University Blvd. in Sugar Land. The library is a joint project between Fort Bend County, the University of Houston System at Sugar Land, and Wharton County Junior College.

The grand opening was officiated by Fort Bend County Judge Bob Hebert, who was joined by other county, university, and local officials. All area residents were invited to take part in the grand-opening reception.

The library sits on the University of Houston-System Sugar Land campus.

The new library, designed by Baily Architects, Inc. of Houston, is a twostory building of 40,193 square feet, making it the third largest library in the system.

A bond referendum approved by voters in May 2006 included funds for three county library construction projects: the University Branch Library in partnership with the University of Houston campus in Sugar Land and Wharton County Junior College; the Sienna Branch Library in partnership with Houston Community College; and renovations at George Memorial Library in Richmond. The University Branch is the second joint-use facility in the Fort Bend County library system.

The library includes community meeting rooms, study rooms, a puppet theater, and a computer lab for technology classes and general public use.

Additional computers will be available for public use outside of the computer lab.

The library has free WiFi access for individuals wishing to bring their own laptop computers to the library.

the Youth Services department hosted a full range of children’s programs, including Mother Goose Time for infants, Toddler Time for babies from 12 to 36 months of age, Story Time for 3 to 6-year-old children, school-aged programs for children in grades 1 through 5, and programs for tweens.

The library offers introductory computer classes for adults. Patrons may learn computer basics such as how to use a computer, how to search the Internet, and how to use Microsoft Office programs such as Microsoft Word, Excel, and PowerPoint.

A wide variety of books for children and adults are available for recreational reading and research. Magazines, newspapers, and audio-visual materials are also on hand. The library offers audio books that can be downloaded from home, as well as a generous assortment of databases that patrons may access in the library or from home. The University Branch Library will utilize Radio Frequency Identification (RFID)

technology in its check-out system.

“The University Branch Library is the second county library/college partnership in the Fort Bend County library system,” says Library Director Clara Russell. “Part of our library mission is to provide an environment of lifelong learning and enrichment for the entire, diverse community, and this new venture just reinforces our commitment to providing a continuum of service for people of all ages. We hope the residents in the area will find the new library a pleasant and enjoyable place where they can study or just relax with a good book.”

The hours of operation for the new branch library will be as follows: Monday, 12:00 noon - 9:00 pm; Tuesday and Thursday, 10:00 am – 9:00 pm, Wednesday, 10:00 am – 6:00 pm; Friday, 12:00 noon - 5:00 pm; and Saturday, 10:00 am - 5:00 pm. The library will be closed on Sundays.

Her agency also operates a facility in Philadelphia that is managed by a friend and located in a historic hospital built in 1892.

“My clients are like my family,” she says, admitting she feels the same about her 79 employees who daily take on tasks throughout Fort Bend County, and the Texas cities of Nacogdoches and

Livingston. “Our mission is to exceed your care expectations.”

“I love my job, my employees and my people,” she says, and strongly adding the services are provided without discrimination based on religion, race, sex, orientation, color, gender, origin or disability. “We believe that when it comes to recovering from illness or adjusting to a chronic condition, home is the best place to be. Patients respond better to healthcare in their homes rather than in the hospital or a long term nursing facility.” All care plans are approved or prescribed by their physicians.

She knows. The Nigerian native lost her grandfather when he was 124 years old. Her father is 95 and an uncle is 105 years old. “In Nigeria there are no nursing homes and we take care of each other as family,”she says, adding that includes the extended family members and neighbors.

Nigeria is the most populous country in Africa, the seventh most populous in the world. It was declared a republic in

1963 and is a member of the Commonwealth of Nations. Like America it’s sport is football and its emblem is an eagle. Corrupt leaders have kept the people below poverty. It is estimated that over a million Nigerians have emigrated to the United States and are considered the Nigerian American population.

The monitoring of glucose levels and giving insulin, wound care dressing, colostomy care, drawing blood samples and catheter change, the monitoring of medication response, evaluation of nutrition, bowel and bladder response and hydration, physical therapy, IV therapy, occupational therapy, speech therapy, medical social services, respiratory therapy, home oxygen, home health aides, wound care management, and bilingual services of most languages through a language line.

The company provides supportive medical social workers to assist clients and families to identify and coordinate resources like financial assistance and community services available and essential to the patient. Aides are also available to assist clients with simple treatment exercises, bathing, dressing, grooming and light housekeeping. They are supervised by registered nurses. The office when called can also assist with shopping, meal preparation, laundry and other household duties until independence can be regained.

Planting cabbages at Froberg’s Family Farm in Alvin or seeing the way one of those logging skidders could fell a tree before I’d even started my chainsaw really brings home how important these vehicles are to the families we feature.”

Known for his roles on “Dukes of Hazard,” “Smallville,” and “Nip/Tuck,” among others this award-winning actor and proud father of three has spent his fair share of time in Texas. From “Eddie Macon’s Run” filmed in Laredo back in ’83 to Doonby filmed this year at Spiderwood Studios near Austin, John Schneider’s worked all over the Lone Star State. Finance Department earns State, National honors for excellence In recognition of the City’s excellent fiscal practices and policies, the Missouri City Finance Department has earned two new honors.

The gold Leadership Circle Award from the Texas Comptroller of Public Accounts salutes the City’s “transparency in financial, audit and budget reporting to residents,” said Finance Director Wes Vela. “We value financial accountability and an important service we provide to citizens is the online posting of the annual budget, annual financial report and check register.” The City Budget features key services and programs; the Comprehensive Annual Financial Report highlights details on the City’s financial condition and the Check Register shows how City funds are spent.

In November, 95 Texas cities have received a 2011 Leadership Award; 60 earned gold status. The program was started in 2009 to acknowledge local governments statewide that excel in setting and meeting high standards for financial transparency online. It commends cities that “open their books to the public; provide clear, consistent pictures of spending and share information in user-friendly formats that allow taxpayers to easily find more

information.”

This was the “Show Me” City’s first year applying for the program and due to “our strong economic management standards we achieved the highest level award,” which is reserved for municipalities that are setting the bar for transparency actions, Vela said.

In October, the Finance Department received the Certificate of Achievement for Excellence in Financial Reporting from the Government Finance Officers Association of the United States and Canada for the 27th consecutive year. The distinction is for the fiscal year ending July 2011 and represents the highest form of recognition in accounting for the comprehensive annual financial report.

“What the auditors are looking for is not only financial accuracy but also compliance with procedures that are in place because they have to rely on those procedures being done,” Vela said, explaining the auditor review process.

Contract Land Staff’s Laurie F. Markoe named Foundation chairwoman Laurie F. Markoe, president and chief executive officer of Contract Land Staff, LLC, a land management and right of way consulting firm, was elected chairwoman of The INGAA Foundation Inc. at the Foundation’s annual meeting in San Diego November 12.

“Laurie is passionate about the future of the natural gas pipeline industry, and we are delighted to have her lead us this coming year,” said INGAA Foundation President and CEO Don Santa. “Laurie will be at the forefront of explaining to the public how the natural gas pipeline industry—from pipeline operators to contractors and material manufacturers—provides jobs and benefits our economy more broadly in its role as the critical link in moving much-needed energy supplies to market.”

Southwest Electronic Energy Southwest Electronic Energy recently purchased a 5.15 acre site at 823 Buffalo Run in Lakeview Business Park in Missouri City. The company, which is a designer and manufacturer of high tech lithium and lithium-ion battery pack solutions, is planning on constructing a new 52,000 sf industrial facility to serve as its corporate headquarters and manufacturing plant. Construction will start in the fourth quarter of 2012 and they plan to occupy the facility by late third quarter of 2012.

Port of Houston Authority adopts 2012 tariffs, reflecting no general rate increase

C

hief Executive Officer Alec Dreyer of the Port Commission of the Port of Houston Authority said steel continues to be the “bright spot.” Steel tonnage for October was up 49 percent over last year and is up 60 percent in the first 10 months of this year. Dreyer said 4 to 4.1 million tons were projected for the end of 2011.

Dreyer said October container activity was flat, unlike the normal increase in activity that we experience during the holiday season.

He said grain also showed a deep decline as an effect of the drought.

“All of the growth at the Turning Basin was related to steel movement,” he said.

“We’ve seen a nearly 30-percent increase there, which correlates with the higher steel volumes.”

Port Commission Chairman Jim Edmonds provided an update of the Oct. 19 Pension Task Force meeting and discussed its review of a proposal to fund the newly established Port Authority’s other post employment benefits (OPEB) trust for up to $8 million for current calendar year. He noted that the Port Authority’s actuary, Milliman, calculated the annual OPEB contribution to be about $7.9 million for this year. The recommendation that the Port Commission approve this funding will now be considered at the next Port Commission meeting on Dec. 13.

Port Commissioner Steve Phelps recapped the Oct. 28 Governance Task Force public meeting, pointing out that the task force-approved charter was on the agenda for Port Commission consideration.

The Port Commission approved reissuing and amending Port of Houston Authority Tariff Nos. 8, 14 and 15, generally covering the Turning Basin Terminals, and Barbours Cut and Bayport Terminals. The approved tariffs reflect no general rate increase in 2012, with increases only in security fees, harbor fees and water charges, and various other non-fee clarifications, updates, additions and corrections, all effective Jan. 1, 2012.

Stuart family receives Texas Family Land Heritage Award from State of Texas Department of Agriculture

O

n November 3, Richmond residents Jess Stuart, Julius Stuart Jr., and Clark Stuart traveled to Austin to receive the Family Land Heritage Award from the State of Texas Department of Agriculture on behalf of the Stuart Ranch located along FM 359 near FM 723. There were 119 ranches honored at the ceremony. Six of these ranches were presented the 150 year award.

The Family Heritage Program recognizes farms and ranches that have been in continuous agricultural operation by the same family for 100 years or more and the Stuart Ranch is being honored for being in operation for more than 150 years.

“To be exact the Stuart Ranch has been operating by the same family for 187 years,” said Jess Stuart, a eighth generation resident.

“Very few ranches remain under the same family ownership for this many years, due to inheritance taxes and the financial drain to maintain the land properly. Family ranches and farms are the embodiment of the Texas legend. For many, working the land is a family tradition and these ranches and farms are living Texas treasures.”

Agricultural Commissioner Todd Staples heads the Family Land Heritage Program, and to qualify the owner must be a Texas resident who can trace the ranch’s line of ownership from the first landowner to the present. The program began in 1974 honoring families with 100 years of farming heritage. The Stuart Ranch received the 100 year award in 1976 at the State Fair in Fort Worth. In 2000 the State of Texas began honoring families with 150 and 200 years or more of farming and ranching heritage.

Award winners receive a Texas Century Farm or Ranch sign for display on the property and documentation of the family history in the Family Land Heritage Registry.

The Stuart clan is passionate about history and the heritage of the Stuart Ranch began on July 9, 1824, when John and Randolph Foster arrived in Texas with

“This was back prior to Texas becoming a Republic,” explains Jess, whose great, great, great, great, great grandfather was John Foster and his great, great, great, great uncle was Randolph Foster. Randolph Foster arrived as early as 1817 and was a scout in Austin’s Colony. He was instrumental in the Runaway Scrape and the Texas Revolution as he supplied wild game to Sam Houston’s Army as they retreated to the Battle of San Jacinto.

To this day a portrait of Randolph Foster hangs in the Texas State Capitol just behind the Speakers stand in the State House of Representatives Chamber. The Lamar Consolidated Independent School District board named Foster High School after the two gentleman and it so happens the school site is located near where the active, small community of Foster, Texas was once located.

“The lineage continued through John Foster’s daughter, Hettie Foster, who married Francis Mayes,” explains Stuart.

“Their daughter Martha Mayes married

Benjamin Stuart and as a result of their union the land has been able to stay in the same family all these 187 years.”

Stuart’s great, great grandfather Burienne F. Stuart was Fort Bend county commissioner in the 1890’s and served as Fort Bend County’s first tax collector in 1900. Today, Stuart says the family is proud of its heritage on the land and the lineage that along with many other early Fort Bend county residents formed a great foundation to build the Lone Star State of Texas.

The Stuart’s claim they look forward to 2024 when they will be make a third trip to Austin to receive the 200 years of continuous ownership by the same family award.

Jess Stuart says, “I look forward to encouraging the State to recognize and present the 225 or 250 year awards. We are carrying on the tradition and legacy for the long haul.”

The Stuart’s plan to continue with the family history of operating the ranch as a cow-calf operation for many years to come.

Stuart quips, “to the dedication and perseverance of the founders and heirs of these lands, we owe the basic wealth of Texas.”

NAMES IN THE NEWS Schaefer joins Texana board Nina Schaefer is a newly elected Texana board of trustees member and will represent Fort Bend County.

She is the proud sister of a Texana client who has intellectual disabilities. She Nina Schaefer has served on the board of Richmond State Supported Living Center Volunteer Services Council for a number of years. Additionally, she has served on boards for many non-profit organizations, her church, and has been active in community service organizations for many years. Schaefer graduated from Houston Baptist University with honors in two majors, English and Political Science. She is a graduate from South Texas College of Law and has been practicing law in Fort Bend county for more than 25 years.

International sulphur conference enjoys Fort Bend symphony

T

he sulphur industry is no stranger to Fort Bend County.

During the 1950’s several large removal fields were in operation and actively shipped the yellow resource. The Sulphur 2011 Conference and Exhibition was held in November at the InterContinental Houston and several Fort Bend businesses attended and participated in the international program.

As usual, delegates from international industries producing, buying and supplying for manufacturing, handling and transporting sulphur and sulphuric acid met at the annual forum to hear from the industry drivers and learn more about the global product supply.

Among the numerous corporations participating in the five-day event were Fluor and TKK Company of Sugar Land. Tofik Khanmamedov, president and CEO of

TKK, presented a paper on sulphur and sulphides, “New Strategies for Acid Gas Enrichment.”

The next conference will be held in Shanghai in June 2012 to forge new relationships in China.

As part of the conference’s welcome reception members of the string section of the Fort Bend Symphony performed for an active and appreciative crowd.

Of even more significance, we are seeing a loosening of capital in the commercial RE financing markets. In Sugar Land (my “back yard”), we are working on a number of deals that involve land acquisitions and new construction. Last year at this time, I don’t believe we had more than one or two “new construction” deals in our pipeline at any time.

Until confidence is fully restored in our national political and financial arenas, it will be difficult to return to the levels of growth that we saw in Fort Bend in the middle of the decade. That notwithstanding, this year is proof

Cruise operations at the Port of Galveston bring fresh revenue and jobs to the Gulf Coast

F

ort Bend county residents do their share of travel. Whether it’s by car, jet, or train, now many are taking to water.

Cruise operations at the Port of Galveston are making that even more possible and probable. Cruise destinations also bring economic impact and receiptants are now businesses in the Greater Houston area; including Fort Bend county.

On September 30, 2000, Carnival Cruise Lines (CCL) began cruise ship service from the Port’s Cruise Terminal No. 1 with one of its oldest ships, the Celebration. That first year produced 33,900 passengers embarking on 20 cruises. Over the 11 years since that first year CCL has substantially expanded its operations and has developed a “PublicPrivate Partnership” relationship with the Port of Galveston.

The strength and quality of that relationship and of the cruise market at the Port in general is highlighted by CCL’s decision to deploy its newest and largest ship, and the flagship of its cruise line fleet, Carnival Magic to the Port as a Home Port vessel which began November 13. Carnival Magic was built and launched from an Italian shipyard in May 2011. Royal Caribbean Cruise Lines’ brand Royal Caribbean International (RCI) followed CCL to the Port of Galveston for several “test” cruises between October 28, 2001 and December 23, 2001. RCI started yearround cruise line home port service from the Port on April 14, 2002 with the Rhapsody of the Seas. Rhapsody and RCI moved from Cruise Terminal No. 1 to a new cruise terminal, Cruise Terminal No. 2, located immediately to the west of Cruise Terminal No. 1 in 2003.

The number of cruises increased to 203 in 2003, with 231,965 passengers embarking. With the advent of the

second cruise terminal, the terminal complex was branded as “The Texas Cruise Ship Terminals on Galveston Island”. A second Carnival Cruise Line ship, Jubilee, which was another of CCL’s older “Holiday Class” ships, joined Celebration on August 19, 2002.

Jubilee was later replaced by a much newer “Fantasy Class” ship, Elation, on September 28, 2003. RCI positioned another of that company’s ships, Splendour of the Seas, to the Port of Galveston for winter season cruises to the Western Caribbean on November 11, 2002. On October 22, 2004 Celebration was replaced by another “Fantasy Class” ship, the Ecstacy. Celebrity Cruises, one of the Royal Caribbean Cruise Lines (RCCL) brands, deployed one its ships, Galaxy, to the Port of Galveston on November 1, 2004. The arrival of the Galaxy raised the bar for cruises from Galveston, as Celebrity cruises is considered one of the cruise industry’s “premium” cruise line brands. Princess Cruises began home service from the Port of Galveston with the arrival of the

Grand Princess on November 4, 2004.

Carnival Conquest replaced the Elation in the fall of 2005. On December 3, 2007 RCI replaced the Rhapsody of the Seas with Voyager of the Seas, which when built in 1999, was at that time the largest cruise ship in the world.

The Port of Galveston saw the Carnival Ecstasy replaced by the larger and newer Carnival Triumph on October 6, 2011. On November 14, CCL replaced the Carnival Conquest with CCL’s Flagship, Carnival Magic. RCI replaced the Voyager of the Seas with a newer and larger sister ship, Mariner of the Seas on November 20. In 2012, the Port of Galveston will see the arrival of a Disney Cruise Lines Ship, Disney Magic, due to arrive on September 22, 2012 and a Princess Cruises vessel, Crown Princess, due to arrive on December 22, 2012.

Since the inception of the cruise industry business at the Port of Galveston in September 2000 and through the end of September 2011, cruising from the Port of Galveston has produced 1,886 cruises and 4,456,842 revenue passengers.

More than half of global professionals feel like if they work hard and demonstrate results, they have a good opportunity to advance in their company

Despite global economic challenges, LinkedIn research finds most professionals happy in current job job.

L

inkedIn (NYSE:LNKD), the world’s largest professional network with more than 135 million members worldwide, has released data about global professionals’ career ambitions and satisfaction with their current jobs. The survey results were unveiled during the Texas Conference for Women, the largest women’s conference in Houston with more than 6,000 attendees. LinkedIn is the conference’s exclusive connection sponsor and LinkedIn’s Connection Director Nicole Williams, was a speaker at the event.

LinkedIn surveyed more than 12,000 professionals and found that 63 percent of professionals globally said they are “happy” or “very happy” with their current job.

• Professionals in the Netherlands ranked as being the happiest. Eighty percent of professionals in the Netherlands said they were “happy” or “very happy” with their current job.

• Japanese professionals ranked as being the least happy with only 31 percent of professionals in that country stating they were “happy” or “very happy” with their current

• Sixty-six percent of professionals in the U.S. said they were “happy” or “very happy” with their current job, putting the U.S. in sixth place.

“A tough economy can make professionals appreciate facets of their job they might otherwise overlook when business is booming,” said Williams. “Perhaps you didn’t get the raise you wanted this year, but you are appreciative of an amazing supportive manager who keeps an eye out for opportunities that will help you grow in your career.”

The study also revealed that most professionals have a hopeful outlook about their future with their current employer.

Fifty-two percent of global respondents agreed that if they work hard and demonstrate results, they have a good opportunity to advance in their company.

• Professionals in Brazil ranked as being the most optimistic. Sixty-three percent of professionals in Brazil said that if they work hard and demonstrate results, they have a good opportunity to advance in their company.

• Spanish professionals ranked as being the least optimistic with only 44 percent of professionals in that country agreeing that if they work hard and demonstrate results, they have a good opportunity to advance in their company.

• The U.S. came in seventh place. Fiftytwo percent of professionals in the U.S. said they believe that if they work hard and demonstrate results, they have a good opportunity to advance in their company.

The survey also listed out seven different career ambitions and asked professionals to select which ones applied to them.

(Respondents could select more than one option.) The No. 1 career ambition for professionals globally is getting promoted. In the U.S. the top three career ambitions professionals selected were: 1. UH Sugar Land campus elevated, expanded

eginning in January, it will be the University of Houston Sugar Land Campus, renamed from UH System Sugar Land, offering more higher education opportunities, and designed to accommodate the rapid growth, workforce needs and interest from Fort Bend area residents and students.

Now, the University of Houston will manage the Sugar Land campus, in close partnership with UH Victoria (UHV). UH will be the primary provider of academic programs at UH Sugar Land Campus and will oversee its operations. All programs currently offered in Sugar land by UH Clear Lake (UHCL) and UHV will continue. This will facilitate a net increase in programs from UH, UHCL and UHV, UH System officials said.

The action taken last November 16 by the UH System Board of Regents is subject to the approval from the Texas Higher Education Coordinating Board.

Regent Jarvis Hollingsworth said, “ As a UH System regent and a resident of Sugar Land, I am proud of the board’s decision. I think the Sugar Land community and UH

will benefit from this partnership. This would not have been possible without support from the city of Sugar Land and the community.

This is what it is all about. Universities and communities working together to serve students.”

John Antel, UH provost and senior vice president for academic affairs, said, “We have a plan in place with people in Sugar Land to build a larger presence in that area. We’re working with the community...offering a range of new programs focused on technology, business and education.”

UH will add a minimum of nine programs at UH Sugar Land Campus over the next three years, doubling the number of programs at this site, Antel said.

UH recently added Master of Science degrees in human resource development and project management; a Doctor of Education degree in professional leadership, and a Post Baccalaureate Certificate in speech pathology assistant.

“This is a tremendous opportunity for the City of Sugar Land, “ said Sugar Land Mayor James A. Thompson, who attended the meeting and addressed the board. To have strengthened access to UH programs is a

great thing, he added. “We have a very strong economic development group in Fort Bend County that was very involved in getting these programs here, and we look forward to these academic offerings complementing our local economy.”

The UH Sugar Land Campus, located at U.S. Highway 59 and University Boulevard, is a 200-acre campus, hosting 15 UH degree programs and four certificates as well as programs by UHV, UHCL, and Wharton County Junior College. Students now have access on this campus to the new University Branch Library, a part of the Fort Bend County Libraries System, which opened in mid-November.

Fort Bend County’s population increased by 65 percent in the past decade. In the past five years, Fort Bend residents attending a Texas public university has increased by 35 percent. There are about 18,000 students in Fort Bend County attending Texas public universities, and 26 percent of them are enrolled at UH, a nationally recognized Tier One public research university.

Unemployment rate drops to 8.4 percent

Texas private employers add 13,500 jobs in October, 286,200 jobs over the year

tate of Texas’ private sector continued to grow in October, adding 13,500 jobs. Texas’ total non farm employment has expanded by 231,600 jobs over the year to reach an estimated 10,616,500 positions in October. Overall, Texas added 2,500 jobs over the month. Texas has experienced positive annual job growth in the past 18 months with annual growth rates above 2.0 percent for the last five consecutive months.

Texas’ seasonally adjusted unemployment rate was 8.4 percent in October, down slightly from 8.5 percent in September, and remains below the national unemployment rate of 9.0 percent.

“Private employers continue to invest their capital in the growing Texas workforce,” said Texas Workforce Commission (TWC) Chairman Tom Pauken. “The pri-

vate sector has added an impressive 286,200 jobs since October 2010, for a growth rate of 3.4 percent.”

Over the year, nine of the 11 major industries have added jobs. Mining and Logging employment climbed for the 11th time in the past 12 months with an estimated increase of 4,500 jobs in October.

Over the past year, Mining and Logging has grown by 20.5 percent. This major industry has grown by 33,900 jobs since January 2011.

“Several of our major industries are continuing to grow, including the Education and Health Services industry,” said TWC Commissioner Representing Labor Ronny Congleton. “That industry has expanded by more than 6,000 jobs for the third consecutive month.”

ing by 53,900 jobs over the year. Leisure and Hospitality added 14,900 jobs over the month, for a total of 35,600 jobs since October 2010. Government employment declined by 11,000 jobs in October, bringing the number of Government jobs lost over the year to 54,600 jobs.

“Texas’ unemployment rate is going down even as its civilian labor force has grown to more than 12.3 million,” said TWC Commissioner Representing the Public Andres Alcantar. “We encourage those looking for work to utilize Workforce Solutions services to connect with job opportunities in our growing industries.”

The Midland Metropolitan Statistical Area (MSA) had the lowest October unemployment rate in the state at 4.5 percent.

The Amarillo MSA came in second at 5.6 percent, and the Odessa MSA third at 5.7 percent (not seasonally adjusted).
