Welcome to November! Michael Sudhalter Editor

t’s time to make some extra room on your plate for that turkey, cranberry and stuffing. Make your plans for the shopping rush for the Friday after Thanksgiving! The holidays are a great time to spend time with family and friends, and reflect upon what we’re thankful for. Fort Bend residents have a great deal to be proud of and thankful for as 2015 winds down. Home values have increased in Fort Bend, and there are a variety of homes and styles throughout the county. There is something for nearly every prospective buyer in Fort Bend. We were fortunate to profile two Sugar Land attorneys with the Texas-wide firm Roberts Markel Weinberg Butler Hailey (RMWBH), which has an office in Sugar Land Town Square. Aaron Dobbs and Kelley Bentley know it’s not easy for people to think about or discuss end-of-life issues, but they understand the importance of it – having seen individuals who have neglected Estate Planning. Estate Planning isn’t just for the folks with the big house on the hill – it’s for every one of us. Enjoy the turkey and be kind to your fellow holiday shoppers! Sincerely, Michael Sudhalter

Child Advocates of Fort Bend receives Community Leadership Award alongside Children’s Advocacy Centers of Texas
™
I
n an evening ceremony Monday night, the Children’s Advocacy Centers of Texas, Inc. (CACTX) was recognized for its efforts on behalf of child victims of physical and sexual abuse across Texas. Recognized by First Lady Cecilia Abbott, Honorary Chair of the 32nd Annual Governor’s Volunteer Awards, and the OneStar Foundation, CACTX joins a select group of individuals, groups and organizations honored for a significant and measurable contribution to their communities. “The power of the public-private partnerships our membership has established at 69 different Children’s Advocacy Centers (CACs) across the state cannot be overstated. Through these intricate collaborations, our network is able to provide much needed assistance to nearly 40,000 Texas children every year who have been subjected to heartbreaking abuse,” said Joy Hughes Rauls, Executive Director of CACTX. “We are grateful to our partners across the state, law enforcement, CPS, prosecution, medical and mental health providers and volunteers, who have joined this collective vision of justice and healing for the smallest of victims.” Children’s Advocacy Centers are a nationally renowned solution to the challenges facing the child victims of sexual and physical abuse. At their core, the centers provide a place for representatives of law enforcement, legal, medical and Child Protective Service organizations to coordinate the pursuit of justice for perpetrators and therapeutic healing for victims and their families. Forging partnerships with community volunteers,

child welfare advocates and Government Agencies, local centers also provide the much needed support these families need while seeking justice. “In Fort Bend County Child Advocates of Fort Bend provides crucial services to 1,498 children and families a year. Without the support of our local partnerships with law enforcement, CPS, the District Attorney’s Office and others, the positive impact we are making on our community would not be possible, said Ruthanne Mefford, CEO of Child Advocates of Fort Bend. We are proud to accept this award alongside CACTX.” “Texas is so fortunate to have a First Lady like Cecilia Abbott and an organization like the OneStar Foundation who understand the value of partnerships within communities,” concluded Rauls. “We dream that, someday, child abuse will be eradicated, but until then, we’ll keep working together in the service of a tragic, but vital cause. I’m proud to accept this award on their behalf.” About CACTX: Children’s Advocacy Centers™ of Texas, Inc. (CACTX) is the statewide membership association representing all

Are you afraid of running out of money in retirement?
L
ast week, new clients of mine, Jim and Susan, came in for their periodic review. They had recently retired because Susan wanted them to travel and see their grandkids more often, but Jim was very apprehensive about this new phase of his life. Jim was the type of person who always asked a lot of questions and wanted to know every detail. I usually never saw a smile on his face until I’d answered all of his questions. Last week was different. Jim came into my office, shook my hand vigorously and sat down with a smile. He launched right in saying, “April, Sue and I can’t thank you enough for setting up our mailbox money.” I looked at both of them a bit confused, and asked what he meant. “Well, April, as you know, I wasn’t too sure about retiring and no longer being a provider for my family. My dad always advised me to get a good job with a strong company that has a pension so that when I retired, checks
would keep arriving in the mailbox. I followed his advice, but after my company was bought out, our pension stopped. Since then, I’ve been scared to retire because I was worried that we didn’t have enough money. I’m glad that Sue insisted we come in to see you. After we sat down with you and worked out a plan for retirement, I felt a little better. Now, being retired and seeing money being deposited into our account every month, I can enjoy retirement because I know that no matter what happens to me, Sue will always get that money every month for the rest of her life. So, thank you for setting up our ‘mailbox money’.” Do you have this kind of peace of mind in retirement? Have you set up your “mailbox money”? If you don’t have a pension, or if your pension and your social security are not enough money to cover monthly expenses, you may need to look into a lifetime income stream.
Only life insurance companies can offer this peace of mind. I believe in hybrid annuities to help my clients spend with confidence in retirement. But, be careful, as all annuities April R. Roberts, J.D. are not created equally and should be just one tool in your retirement toolbox. Be sure that you are working with a fiduciary who will help you set up a retirement income plan, instead of selling.
At Roberts Wealth Management, we realize that you have worked hard for your money. We will work just as hard to help you protect and grow it. for our patients right from the emergency department to the stroke floor,” says Dr. M. Faisal Khan, M.D., D, ABSM, director, Neuroscience Program, Memorial Hermann Sugar Land. “Stroke patients coming to Memorial Hermann Sugar Land can rest assured that they will get the very best care.” These quality measures are designed to help hospital teams provide the most up-todate, evidence-based guidelines with the goal of speeding recovery and reducing death and disability for stroke patients. They focus on appropriate use of guideline-based care for stroke patients, including aggressive use of medications such as clot-busting and anti-clotting drugs, blood thinners and cholesterol-reducing drugs, preventive action for deep vein thrombosis and smoking cessation counseling. “We are pleased to recognize Memorial Hermann Sugar Land for their commitment to stroke care,” said Deepak L. Bhatt, M.D., M.P.H., national chairman of the Get With The Guidelines steering committee and Executive Director of Interventional Cardiovascular Programs at Brigham and Women’s Hospital and Professor of Medicine at Harvard Medical School. “Studies have shown that hospitals that

consistently follow Get With The Guidelines quality improvement measures can reduce length of stay and 30-day readmission rates and reduce disparities in care.” For providers, Get With The GuidelinesStroke offers quality-improvement measures, discharge protocols, standing orders and other measurement tools. Providing hospitals with resources and information that make it easier to follow treatment guidelines can help save lives and ultimately reduce overall healthcare costs by lowering readmission rates for stroke patients. For patients, Get With The Guidelines– Stroke uses the “teachable moment,” the time soon after a patient has had a stroke, when they learn how to manage their risk factors while still in the hospital and recognize the F.A.S.T. warning signs of a stroke. According to the American Heart Association/American Stroke Association, stroke is the number five cause of death and a leading cause of adult disability in the United States. On average, someone suffers a stroke every 40 seconds; someone dies of a stroke every four minutes; and 795,000 people suffer a new or recurrent stroke each year.

First annual Aga Khan Foundation Run at the Sugar Land Memorial Park held
H
undreds raced in Sugar Land to improve the lives of communities across the world. It was at Sugar Land’s first annual Aga Khan Foundation Run at the Sugar Land Memorial Park on Sept. 27, 2015. The event is an initiative of the Aga Khan Foundation (AKF) to raise awareness and funds for programs that work with communities around the world to build longterm solutions for better futures. Sugar Land’s race attracted a range of runners wanting to help communities in some of the poorest areas of Africa and Asia improve their quality of life. Runners and sponsors across the metro area, including the national sponsor The Coca Cola Company, were enthusiastic to support a global cause. Hundred percent of net proceeds from AKF events go directly to projects supported by the Foundation. The Foundation’s projects make a tremendous impact in creating locally driven opportunities – such as opening up doors for girls in Afghanistan to attend school, farmers in Mali to feed their families, and mothers in India
to lead healthy lives. Run and Walk events for Aga Khan Foundation are being held in at least 11 major US cities this year, including a Walk/Run in Houston on Nov. 14, 2015. Since 1995, the Foundation’s activities including the annual Walk and Golf events have attracted nearly a half million participants and raised $75 million for poverty alleviation projects supported by the Foundation. With 200 projects in 30 countries, Aga Khan Foundation cultivates deep partnerships with local businesses, nonprofits, governments and community leaders to harness the best from people of all walks of life. Working with our partners, we make long-term commitments to
innovative programs that improve the quality of life, from early childhood education to green space preservation. The Aga Khan Foundation is a private, nondenominational, not-for-profit international development organization committed to alleviating poverty, hunger, illiteracy and poor health. The Foundation helps communities around the world to build better futures by creating institutions like hospitals, making longterm investments to the most innovative programs, and cultivating strong local leadership. AKF is a non-profit, tax-exempt organization under section 501(c)(3) of the Internal Revenue Service code. AKF is a member of the Aga Khan Development Network, one of the world’s leading poverty solutions networks, established by His Highness the Aga Khan. The Network empowers communities and individuals, often in disadvantaged circumstances, improve living conditions and grow opportunities. The Network’s agencies work for the common good of all citizens, regardless of their gender, origin or religion. Its underlying impulse is the ethic of compassion for the vulnerable in society.

Drees custom homes marks 1 year with expansion despite oil slump Drawn by expanding its existing Texas presence into the nation’s largest housing market and buoyed by a robust economy, Drees Custom Homes began planning its Houston entry in 2014. Little did executives know that oil prices would begin a nearly yearlong decline right about the time Drees was breaking ground in the Bayou City. “The price of oil was rather high when the regional office started buying land positions in Houston,” said Jay McManus, Houston division president for Drees Custom Homes who started work for the company in September 2014. “No one was thinking about an oil slump.” The builder, active since 1928 and ranked as the nation’s seventh largest privately-owned homebuilder, persevered, not only continuing with planned openings in three communities, but quickly expanding to five Houston-area developments within its first year. “Oil prices made it easier for us to enter so many communities so quickly,” McManus
said. “Other builders were pulling back a little, so we were able to write contracts on good lot positions.” Drees opened in January in Woodtrace, a Tomball development where it offers designs priced from the Jay McManus $520,000s. Plus, a model home opened this summer in the Retreat at Augusta Pines, where Drees’ homes are priced from the $700,000s. Model homes will open this year in Harpers Preserve, Long Meadow Farms and Summer Lakes. Base pricing on homes in those developments ranges from the $250,000s to $480,000s. “Because some builders were a little hesitant to move forward, we were able to secure properties that could underscore our breadth of product,” McManus said. “We want to showcase our diversity both from a product standpoint and geographically.”
McManus says his sales offices aren’t seeing as many people relocating to Houston as when they initially opened, but buyers associated with the oil industry are still shopping for homes. “They just seem to be in the planning stages rather than ready to buy now,” McManus said. And despite uncertainty regarding oil prices, Drees Custom Homes will continue its growth strategy in Houston, adding to a 30year presence in Texas that includes successful building programs in Dallas and Austin. “We see no reason to slam on the breaks, and everyone I talk to feels the same way,” McManus said. “There are still a lot of people working in health care and other industries, plus we have seen a lot of empty nesters looking at our homes. “We still see Houston as a viable market and are looking at new communities, particularly in the Katy and Cy-Fair areas.” For more information on Drees Custom Homes, visit www.dreeshomes.com.
Katy’s newest Master-Planned Community, Cane Island, welcomes first residents Katy’s Newest Master-Planned Community, Cane Island, Welcomes First Residents KATY, TX (September 22, 2015) – About a year after plans for Cane Island were first unveiled, the Katy master-planned community has welcomed its first residents, a Katy family drawn to the new community for its location, amenities and builders. Ashley Warren, son Brayden and Ashley’s fiancé Justin Wagner may not have many neighbors now, but that’s expected to change soon with the completion of new luxury homes in Cane Island’s first phase. The owners of a new home by Perry Homes, Ashley and Justin moved to Cane Island from the Katy subdivision of Mason Lakes. While Cane Island’s first family enjoyed their previous home, the opportunity to own a new home in Katy’s newest masterplanned community was too good to pass up. “We’re really proud to be the ‘first family’ of Cane Island,” Ashley added. “We loved working with Perry Homes. The plan we selected is perfect for our family.”
Besides moving into Cane Island’s first new home, Justin and Brayden joked they’ll also try to be the first to jump into Cane Island’s new family pool, part of the masterplaned community’s Amenity Village where families also will enjoy a Recreation Center, poolside cafe, glass-walled conservatory and yoga studio.
Fort Bend / Katy Business Journal H November 2015
In addition to Perry Homes, Cane Island offers new luxury homes by Coventry Homes, David Weekley Homes, Ryland Homes, Shea Homes, Toll Brothers and Trendmaker Homes. Several model homes are now open daily, Monday thru Saturday, 10 a.m. - 7 p.m. and Sunday, noon - 7 p.m., with others opening soon. Developed by Rise Communities, Cane Island is minutes from the Energy Corridor, Katy Mills and Memorial Katy Hospital. It also is minutes west of the extended Grand Parkway, Houston’s third ring road currently open from Sugar Land to U.S. 290. Families currently can reach Cane Island from First Street in Katy. Logos Preparatory Academy expands to K-9 in Katy
For the second year in a row, Logos Preparatory Academy is expanding the educational options of families in the Katy community. Having opened in fall 2015 with a strong offering of grades 3-8, Logos Prep is excited to announce that grades K-2 and grade 9 will be available in the fall of 2016. This week, the Logos Prep Board of Directors solidified a new partnership with Cinco Ranch Church of Christ, enabling this expansion of service. “Opening our doors to Katy families this year has been quite a joy, and many parents expressed an interest in the primary (K-2) grades,” says Logos Prep Head of School Ron Clyde. “We are thrilled with the opportunity to meet the need.“ Logos Prep, the nation’s second largest University Model® School (UMS), began in Sugar Land in 2006, and expanded to the Katy community in 2015. UMS students attend classes on alternating days, much like a university, and the opposite school days are spent at home in the “satellite classroom” with the parent acting as a co-teacher. Research indicates that parental involvement is the number one indicator of a child’s success in school, and the University-Model is perfectly designed to incorporate the parents as a necessary instrument in their child’s education. Cinco Ranch Church of Christ will host grades K-2, and is located at 6655 South Mason Rd, a short drive from Logos Prep’s main Katy campus at Westland Baptist Church. Kenny Elder, President of the Board for Cinco Ranch commented, “Since the early days of Little Ranch Preschool, Cinco Ranch
Church of Christ has been committed to Christian education. We are pleased to partner with Logos Prep in providing additional Christian education opportunities to the Katy/Fort Bend community.” Parent Information Meetings for families interested in learning more about this opportunity are scheduled for 7 PM on October 13th at Westland Baptist Church, 1407 W Grand Parkway South. Additional information meetings are
scheduled for Feb. 4th, Mar. 3rd, Apr. 7th, May 5th, and June 2nd. More information can be found on the school’s website, www. logosprep.org/katy. About Logos Preparatory Academy: Logos Prep is a K-12 University Model® school founded in 2006 in Sugar Land, TX. With the mission of creating Kingdom Families, Kingdom Communities, and World Changers, Logos Prep was named the Best Private School in Sugar Land by the Sugar Land Sun readers in 2014 & 2015.

What is Estate Planning and Why Do You Need It?
E
state Planning is necessary for the orderly and efficient administration and transfer of your property upon your incapacity or death. An estate plan can be designed to discourage litigation about the distribution of your estate, to protect an inheritance from falling into the wrong hands, such as a beneficiary’s creditors or during divorce, and to preserve a beneficiary’s government benefits. Having a last Will and Testament isn’t enough. Your estate plan needs to be a comprehensive plan which takes into consideration the particular types of property that you own, including business interests, your family dynamics, and whether your beneficiaries have special needs. An estate plan should coordinate assets that may not pass through your will, such as life insurance or other assets naming a beneficiary. Otherwise, the estate could be used for purposes that the individual did not desire.

any people avoid planning for their potential incapacity and eventual death. But there are two paths that people can take –develop an estate plan that dictates how you want your financial and personal decisions handled, or leave it up in the air. The latter could very well end in a result that you did not desire, including your family members suing one another over the division of your assets. T. Aaron Dobbs and Kelley Bentley of the Fort Bend office of Roberts Markel Weinberg Butler Hailey PC (RMWBH) specialize in estate planning, probate, trust, guardianship and elder law. Together, they serve clients from Fort Bend and surrounding counties
and view estate planning as an empowering process. “By taking the step to engage in the thoughtful development of your estate plan, you can rest easier knowing that your affairs will be handled in the manner which you dictate – not state law, not a judge or jury, not anyone else,” Dobbs said. Dobbs and Bentley are both proud Sugar Land residents. Bentley grew up in the area and graduated from Austin High. Both Dobbs and Bentley began focusing on estate, trust and guardianship cases right out of law school – Dobbs at a trust and estate litigation boutique and Bentley at a firm specializing in estate planning and elder law. A decade later, they have joined RMWBH to grow the firm’s Estate Planning, Probate, and Trust practice in Fort Bend County.

“We assist individuals, corporate entities and non-profit clients in all aspects of estate and trust administration, probate, will contests, trust and fiduciary litigation, creditor claims and guardianship disputes before trial and appellate courts, as well as estate planning, Medicaid eligibility and long-term benefits planning, and planning for individuals with special needs,” Bentley said. Dobbs adds, “What makes our practice unique is that Kelley and I focus exclusively on estate planning, probate, trust, guardianship and elder law cases, but we have the backing and resources of a firm that has other highly specialized practices, such as litigation, real estate, employment and corporate law. We have had trust and estate matters which involved complicated real estate components, and it was very efficient to interface with our in-house real estate attorneys to make sure those needs were met. When we are in court on an estate litigation matter, we work with our litigation and appellate attorneys to coordinate our substantive and tactical approaches.”
PRESERVING THE PAST “Most people assume estate planning is for the very wealthy, but the reality is that everyone needs some level of planning. If you plan ahead, you are more likely to avoid complications and tremendous expense for your family down the road,” Dobbs said. “Our clients don’t want to see their hard-earned assets fall into the wrong hands or be consumed by attorneys’ fees over an inheritance dispute.” “Our approach to estate planning is comprehensive. We don’t just offer our clients a will and a power of attorney. We go further by educating our clients about how they can maximize the benefits employed through their will or trust. It is important to Aaron and me that we help our clients understand that their estate plan is designed to preserve their assets and wealth for future generations,” Bentley said. RMWBH also works with business owners and executives on business succession planning. “Fort Bend County is home to so many entrepreneurs. It’s not surprising that Fort Bend / Katy Business Journal H November 2015
those business owners want to make sure the businesses they have built from the ground up have a continuity and succession plan in place when they decide to no longer be involved in daily operations,” Dobbs said. SECURING THE PRESENT Sometimes planning can be even more involved, especially if there is a need to plan for long-term care. “Many people rely on governmental benefits to pay for long-term care services, as well as therapies and other essential medical services,” Bentley said. “If an individual on governmental benefits receives an inheritance or other sum of money without proper planning, he or she could potentially lose eligibility for such benefits.” “As individuals live longer, the need to plan for potential incapacity has increased. With proper planning, the individual and family can preserve assets, as well as ensure their loved one receives proper long-term care. continued on pageCONTINUES... 34
23
This is especially important if a spouse is in need of long-term care, because we want to secure their assets so that the healthy spouse living at home provide for his or her needs, while also ensuring that the ill spouse receives adequate medical care,” Bentley said. Bentley works with seniors and their families to secure their long-term care needs, as well as with families who are planning for a child with special needs. “I like to help families. My area of law is very specialized. I work with multiple generations to ensure that the specific needs of the family are met. From developing a plan to achieve Medicaid eligibility to pay for long-term care in a nursing home, to drafting a special needs trust for a child with disabilities, I focus on planning that helps families,” Bentley said. PROTECTING THE FUTURE Not all estates and trusts end in the peaceful transfer of property. RMWBH is available to its clients when litigation becomes necessary – from will contests to litigation involving the misdeeds of a trustee to disputes over the care and custody of elderly family members. “We have been in the trenches of estate and trust litigation, and I think this has helped us become better estate planners. We have seen estate plans that have worked how they were intended, and we have seen estate plans that have failed. We share those experiences with our clients,” Dobbs said.

Litigation over an estate, trust or guardianship can be emotionally and financially taxing. “Kelley and I work with beneficiaries to protect their inheritances from misappropriation, and we also work with executors and trustees to help them fulfill their fiduciary duties in order to avoid litigation,” Dobbs said. “But we approach all of our litigation matters with the financial and emotional costs in mind. We understand you are already facing a disap-

pointing situation – having to pay an attorney to right a wrong is a tough pill to swallow.” BOARD CERTIFIED IN ESTATE PLANNING AND PROBATE LAW Both Dobbs and Bentley are board certified in estate planning and probate law by the Texas Board of Legal Specialization. Bentley is also a Certified Elder Law Attorney (“CELA”) by the National Elder Law Foundation. Bentley is one of six attorneys in Texas who has achieved both distinctions. Board Certification is a mark of excellence and a distinguishing accomplishment that signifies substantial, relevant experience in a select field of law as well as demonstrated, and tested, special competence in that area of law. Achieving board certification is a rigorous process which includes evaluations by judges and fellow attorneys, passing a written exam, and recertification every five years. According to the Texas Board of Legal Specialization, there are over 70,000 attorneys licensed to practice in Texas, but less than 700 are board certified in estate planning and probate law. Of those 700 attorneys, fewer than 10 list their principal office to be in Fort Bend County. RMWBH has five offices in Texas – Fort Bend, Austin, Houston, Dallas, and San Antonio. In addition to Dobbs and Bentley, the all-star firm of attorneys include retired judge Pedro Ruiz and Sugar Land city council member Himesh Gandhi.

Deanna Dawson This year’s award, reflecting production from September 2014 - 2015, was presented at the broker’s recent mid-year meeting. “I expected to be successful, but my first year certainly exceeded my expectations,” says Dawson, a former stay-athome-mother whose son urged her to pursue a career in residential real estate. “Better Homes and Gardens Real Estate Gary Greene has been extremely supportive – and that’s been the difference.” Dawson closed $6.1 million in sales in her first full year in the firm’s Fort Bend office. “Closing over $6 million in residential transactions is a good year for any agent, but to do that in the first year is exceptional,” stated Marilyn Eiland, partner of Better Homes and Gardens Real Estate Gary Greene. Now in its 52nd year, Better Homes and Gardens Real Estate Gary Greene is staffed by more than 1,000 Realtors in 21 sales offices throughout the greater Houston area. For more information, visit www. HWY 36A which would allow for more truck freight to transport cargo to Fort Bend County and throughout the US. County Judge Bob Hebert said, “The dynamic growth of the Port of Freeport, since my last visit, reinforces the need to expand HWY 36 and to pursue the 36A and Fort Bend-Brazoria Rail option in an effort to handle the ever-increasing truck traffic; and through the construction of a short line railroad, take many of those trucks off the road sometime in the future.”
