merica’s voice was heard loud and clear in its most recent election, as seven states joined the growing ranks legalizing marijuana. Over the course of 4 years, the movement to legalize marijuana has become bigger than ever, gaining more supporters daily. California is undoubtedly the biggest triumph in the fight for marijuana legalization, in fact, the states Proposition 64, which makes it legal for adults 21 and over to possess and carry up to an ounce of marijuana, makes the entire West Coast a legal playground for recreational weed – Maine, Massachusetts, and Nevada also joined the recreational club this go ‘round. “This is the most momentous Election Day in history for the movement to end marijuana prohibition,” Rob Kampia of the Marijuana Policy Project, a group that supported a number of the legalization initiatives, said in a statement. The west coast has been the forerunner in the fight for legalization, but the recent win in Massachusetts speaks volumes of the progress being made nationwide. The poles show that Americans are seemingly becoming more accepting of marijuana related medications as well – Florida, Arkansas, and North Dakota voted yes for medical use. Though many of the newly joined states will most likely have to wait for the green light via their governors, the promise of profit is an undeniable factor. According to the Tax Foundation , tax collections from marijuana in both Colorado and Washington both exceeded initial estimates – the industry brought in more than $270 million within the first quarter in Colorado alone according to the Associated Press. The Tax Foundation goes on to explain that an efficient and developed marijuana industry could generate up to $28 billion in tax revenues for federal, state, and local governments, including $7 billion in federal revenue. However, even with the blatant progress being made in the campaign for legalization, supporters will potentially be facing a new obstacle. President Trump, who has flip-flopped on the issue, will have large decisions to make in the near future.

WINTER 2017 • FOX & NUG 34

Trump recently expressed his support for medical marijuana in an interview with the Washington Post – “In terms of marijuana and legalization, I think that should be a state issue, state-by-state,” Trump told The Washington Post. “… Marijuana is such a big thing. I think medical should happen — right? Don’t we agree? I think so. And then I really believe we should leave it up to the states.”

“It reverses 20 years almost of hostility to drugs that began really when Nancy Reagan started ‘Just Say No.’ ” Sessions said during the hearing.

But, while Trump supports a states’ right to choose how to legislate medical marijuana, he deemed Colorado’s legal marijuana industry a “real problem” in an interview with Bill O’Reilly in February of 2016. It seems Trump is on the fence and will likely be pushed to either side. Vice President, Mike Pence, has expressed his distaste on legalization and governs a state with one of the strictest marijuanasentencing laws.

The DCMJ, the group formerly known as the D.C. Cannabis Campaign, fear that Sessions could trigger set backs nationwide and cripple D.C.’s local laws. According to the Washington Post.

But, while Trump supports a states’ right to choose how to legislate medical marijuana, he deemed Colorado’s legal marijuana industry a “real problem” With 65 million people living in states that have given the green light to marijuana legalization, any federal crackdown “could have significant political costs associated with it,” Beau Kilmer, a drug policy expert at the nonprofit Rand Corp., said in an interview with the Washington Post. Hardening the blow to the legalization campaign is Trumps nominee for Attorney General, Sen. Jeff Sessions (R-Ala.), who is an overtly vocal opponent of marijuana legalization. “We need grown-ups in charge in Washington to say marijuana is not the kind of thing that ought to be legalized, it ought not to be minimized, that it’s in fact a very real danger.” Sessions said at a Senate hearing in April of 2016. Sessions called attention to statistics showing that more drivers have been found with THC in their system since the legalization began – chocking it up to the Obama administrations “lax treatment on marijuana.”

35 FOX & NUG • WINTER 2017

Sessions went on to state, “good people do not smoke marijuana,” that’s right, good people don’t smoke pot you guys.

These activists have protested outside of Sessions’s Capitol Hill office with pot in tow since his nomination and showed up to demonstrate on Inauguration day with 4,200 prerolled joints free to the public. “The marijuana giveaway would not happen if Jeff Sessions wasn’t nominated as the attorney general,” said Adam Eidinger, the head of DCMJ, said in an interview with the Washington Post. “It is not a smoke-in; it is a giveaway, and people can smoke them when they want.” Even though Sessions may be appointed Attorney General, it is still unclear whether progression could be reversed. A recent Gallup poll from October shows that nearly 60 percent of Americans are now in favor of legalization and supporters should keep in mind that Trump expressed support for medical usage. A newer development in medical marijuana usage is cannabidiol hemp oil or CBD oil. Unlike traditional medical cannabis products made from plants with high THC concentrations, the oil is made from high CBD and low levels of THC. In fact, the THC levels are so low in these products that they are considered non-psychoactive. CBD is only one if nearly 85 cannabinoids currently identified in cannabis plants and is the second most abundant found. Because levels of THC are so minimal in the oils, it causes no high – giving patients a less controversial and safer alternative to traditional medical marijuana usage, whole still offering the overwhelming benefits of the treatment. However, the US Drug Enforcement Administration (DEA), recently put a damper on legalization, making CBD oil more federally illegal – Item 21 CFR Part 1308 established a new code for “marihuana extract.” “This code,” wrote DEA Acting Administrator Chuck Rosenberg, “will allow DEA and DEA-registered entities to track quantities of this material separately from quantities of marihuana.” This motion is meant to bring the US into compliance with international drug treaties.

Medical Recreational

Some may ask, “what if my CBD oil is derived from hemp?” – The DEA does not care.

In an interview with Leafly, Hoban stated that the action is “beyond the DEA’s authority.”

The agency is positive that it will be able to find a large enough amount cannabinoids in CBD oil to arrest and prosecute you, and if they cannot, they may still arrest you for possessing the oil itself.

“The DEA can only carry out the law, they cannot create it. Here they’re purporting to create an entirely new category called ‘marijuana extracts,’ and by doing so wrest control over all cannabinoids. They want to call all cannabinoids illegal. But they don’t have the authority to do that.” Hoban said,

Although considered to be an illegal Schedule I drug, temporary safeguards are in place to protect patients who posses the oils – one of the most important being the Rohrabacher-Farr amendment, which defers the Justice Department from spending funds to interfere with the implementation of state medical cannabis laws. This amendment is the fence stopping federal law enforcement from prosecuting CBD product users in the legal medical marijuana states and the District of Columbia. Robert Hoban, a Colorado cannabis attorney and adjunct professor of law at the University of Denver, raised the notion that the rule itself may not be lawful.

Though it is still unclear whether marijuana legalization will continue to flourish nationwide under Trumps regime, it is blatantly obvious what the American people support, and what they support is legalized pot.

SALLY HEWETT Sally Hewlett, a UK based artist with both a law and fine art degree, uses her creations to investigate beauty, but also disgust. Her raw depictions of the human form are made by stretching lyrca, angel skin, or velour around padding that is all held together by embroidery hoops. She stitches in shaping, hair, embroidery, and decoration. “I suppose what I would like people to take from the work is the idea that perhaps all sorts of bodies can be seen as beautiful, not just those that are conventionally beautiful,” says Sally.

Since childhood, Sally has been inspired by bodies. “I’ve always found bodies intriguing, both men’s and women’s bodies: by the fat, the thin, the spotty, the freckled, the old, the hairy. AMY PAYNE In the male-dominant video game industry, Environment Artist, Amy Payne, has made a name for herself by working on big-name titles such as Uncharted 4: At Thief’s End and The Last of Us. Working with a huge team to create interactive masterpieces, Amy draws inspiration from the environment around her as well as other artists. “The first thing I always do is just spend a day or so reference and inspiration hunting. I’ll either run outside to gather material reference or take a deep dive into Pinterest to get as much reference for a scene as possible. After that it’s just getting into the zone to make the art, but I’ll be jumping in and out of content authoring to try and reference check my work or get more inspiration for a section that I’m stuck on. It’s just that game of trying not to get too sucked into what you’re doing that you lost sight of the big picture.” See More of Amy’s Work: payneless3d.com artstation.com/artist/luthyn

I want to keep learning and developing,” says Brittany, inspired by the dedicated and hard working growers. This Seattle-based artist and pastry chef, enjoys time with her feline companion and making art with her significant other. “I only hope all women know how strong, intelligent and capable well all are and shouldn’t let anyone, or thing, get in the way.
