1. General

1.1. These general terms and conditions of sale and delivery apply to all purchases made via Fredericia Furniture A/S's webshop on www.fredericia.com and can only be found here. If the customer's purchase of goods takes place through a dealer or other third party, their terms and conditions apply. These conditions apply to all markets and not just limited to the Danish market. If the customer's purchase of goods from Fredericia Furniture A/S (hereinafter referred to as "Fredericia Furniture") takes place outside the webshop on www.fredericia.com other terms of sale and delivery apply, in which case reference is made to the order confirmation.

1.2. The Danish Sale of Goods Act and the Consumer Contracts Act also apply to the customer's purchase of goods from Fredericia Furniture.

1.3. All agreements on purchases made on the Website are concluded with:

2. Conclusion of agreement

2.1. The agreement between the customer and Fredericia Furniture is deemed to have been concluded when the customer receives an order confirmation from Fredericia Furniture.

2.2. When Fredericia Furniture has received the customer's order, an order confirmation will be sent as soon as possible by e-mail with information about the customer's order number, name and address, method of payment, delivery address and an overview of the ordered item(s). The customer's order confirmation will not be available on the webshop, and the customer is therefore encouraged to print and save the submitted order confirmation.

2.3. The customer is obliged to review the information in the order confirmation, and in case of discrepancy with the order placed, the customer must contact Fredericia Furniture immediately and no later than within 2 working days. Orders are not finally accepted until you receive a written order confirmation. The customer can normally expect to receive the confirmation within 48 hours of placing the order. Always check the order confirmation as soon as possible after receipt and contact us immediately if you find any discrepancies.

3. Prices and payment

3.1. All prices quoted include VAT. The applicable price is that stated on the website next to the product in question at the time of placing the order and which will appear on the order confirmation.

3.2. Fredericia Furniture reserves the right to change prices on the website that may be incorrectly stated. Fredericia Furniture also reserves the right to price changes as well as changes to fees and/or other costs stated on the website at any time.

3.3. Fredericia Furniture is not bound by errors, including price errors, if it should be clear to the customer that there was an error.

3.5. If you pay with an international payment card, the amount will be reserved immediately. The funds are reserved in your card or account until we withdraw the amount when we ship the item or until the funds are released in agreement with your card issuer. You can read more about the rules for your specific card with your card issuer.

3.6. When using payment cards for payment, the amount will only be withdrawn at the same time as the goods are dispatched.

3.7. All information provided in connection with the payment transaction shall be protected by encryption.

4. Delivery time and location

4.1. Goods ordered on the webshop are delivered to the countries that can be selected in the ordering process. If you want delivery to a country that is not stated during the ordering process, please contact us for a possible solution. Depending on the current order, delivery takes place by courier or freight forwarder, which is stated on the delivery notice that you receive when the order is shipped from our warehouse.

We aim to deliver your order as quickly as possible, and the delivery time is estimated on the product page, shopping cart, and order receipt sent immediately after your purchase.

Fredericia Furniture strives in all cases to ensure that delivery takes place without undue delay. Information about delivery time is only indicative and Fredericia Furniture cannot be held responsible for delay of deliveries. If production delays or other delays occur in relation to delivery, this may affect the delivery time. We strive to contact you as soon as possible in case of delays.

4.2. Details of delivery time and place will appear in the order confirmation.

5. Freight and delivery services

5.1. Delivery to customers

5.1.2. Furniture and/or packages weighing 10 kg. or more is delivered by LGT. The price for delivery is included in the sales price and free delivery is thereby achieved on standard delivery. If the customer chooses other form of delivery than standard delivery, Fredericia Furniture reserves the right to charge shipping surcharges.

5.2. General information on delivery

5.2.1. Goods are delivered in unassembled condition, unless otherwise agreed.

5.2.2. Delivery is carried inside the house, unless otherwise agreed

5.2.3. The Customer is responsible for ensuring that proper delivery can take place. If the driver assesses that proper delivery cannot take place, or if the customer is not at home to receive the order at a preagreed delivery time, the order will be returned to Fredericia Furniture. The customer shall bear all costs associated with this.

5.2.4. Questions or wishes regarding delivery and possible assembly of furniture must be made to Fredericia Furniture customer service by phone +45 7592 3344 or by mail customerservice@fredericia.com.

6. Right of withdrawal

6.1. The Customer has the right to withdraw from purchases made on the Website (right of withdrawal) and return the item(s). The right of withdrawal does not apply to goods that are manufactured according to the customer's specifications and/or have been given a clear personal touch.

6.2. If the customer wishes to make use of his right of withdrawal, the customer must notify Fredericia Furniture, cf. clause 6.3, within 14 days of receipt of the goods. If the customer has ordered several different items in the same purchase, where the goods are delivered individually, the deadline runs from the day on which the customer has possession of the last item. If the purchase consists of several lots or parts, the deadline shall begin on the day on which the last lot or part is in the customer's possession. If the last day for exercising the right of withdrawal falls on a Danish public holiday, a Saturday, Constitution Day, 24 December or 31 December, the deadline expires on the following working day.

6.3. The Customer may exercise his right of withdrawal by sending an email to customerservice@fredericia.com or by using the standard withdrawal form, cf. clause 14.

6.4. Fredericia Furniture encourages the customer to save documentation and receipt that the customer has exercised the right of withdrawal.

6.5. When the customer has informed Fredericia Furniture that the customer wishes to exercise his right of withdrawal, the customer must deliver or ship the goods to the address mentioned in clause 1.3 within 14 days.

6.6. When the customer has notified Fredericia Furniture that the customer wishes to exercise his right of withdrawal, Fredericia Furniture will refund without undue delay after Fredericia Furniture's receipt of the goods, and in any case no later than 14 days from the date on which Fredericia Furniture has received notification of the customer's decision to withdraw from the agreement, all amounts received from the customer, including delivery costs. The refund presupposes that the item has been received by Fredericia Furniture or that the customer documents that the item has been returned. However, Fredericia Furniture does not refund additional costs if the customer has chosen a form of delivery other than the cheapest form of standard delivery offered by Fredericia Furniture.

6.7. The Customer bears the direct costs for returning the goods upon dispatch of the goods, after which reasonable delivery costs will be refunded, cf. clause 6.6.

6.8. Fredericia Furniture will carry out the refund on the same means of payment as the customer used for the original transaction, unless the customer has expressly accepted that Fredericia Furniture may carry out the refund in another way.

6.9. If the customer chooses to cancel in part so that only part of the purchased item is returned, Fredericia Furniture will refund without undue delay and in any event no later than 14 days from the date on which Fredericia Furniture has received notification of the customer's decision to withdraw from the agreement in part, an amount equal to the returned. The refund presupposes that the item has been received by Fredericia Furniture or that the customer documents that the item has been returned. Fredericia Furniture does not refund delivery costs in case of partial cancellation.

6.10. To the extent that the value of the goods has deteriorated as a result of handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods, e.g. if the goods have been used, an amount corresponding to the decrease in value will be deducted from the refund from Fredericia Furniture.

7. Claims and defects

7.1. The customer has a 2-year warranty on all goods if they may suffer from a defect. Thus, the customer cannot claim defects that become apparent later than 2 years after delivery of the goods.

7.2. If the product within the 2-year warranty period turns out to be defective or faulted, Fredericia Furniture undertakes to rectify such errors and defects. If it turns out not to be possible – or it is not deemed appropriate by Fredericia Furniture – to repair the item, Fredericia Furniture undertakes instead to deliver a new faultless item upon receipt of the defective item. If neither repair nor replacement is possible or deemed appropriate by Fredericia Furniture, Fredericia Furniture will instead refund the purchase price or part thereof (proportional reduction) depending on the nature of the defect. If the complaint is justified, Fredericia Furniture will also help the customer with the return of the item. If the item turns out not to be defective or defective, the item will be returned to the customer. Fredericia Furniture will then be entitled to charge shipping costs.

7.3. In addition to the right of complaint, Fredericia Furniture provides extended warranty on selected products. The warranty covers defects that were present at the time of purchase or that have occurred due to defects that were present at the time of purchase. The warranty period is calculated from the date of the original invoice. During the applicable warranty period, Fredericia will, at its sole discretion, either repair, replace or issue a credit note regarding the defective product, part or components. Extended Product Warranty applies to products purchased after January 1, 2023.

25 year warranty

A 25-year warranty is provided on selected models:

1. Spanish Chair (2226)

2. OX and Queen Chair (1000/1010)

3. Corona Chair (5000)

4. BM 22 series by Børge Mogensen

10 year warranty

A 10-year warranty is provided on sofas.

7 year warranty

A 7-year warranty is provided on armchairs, chairs, tables, coffee tables and smaller furniture under our Complements series (e.g. side tables).

2 year warranty

A 2-year warranty is provided on lamps and accessories, including vases and loose spare parts.

7.4. Warranties do not apply in the following situations (the list is not exhaustive):

1. The customer's own textile or leather and materials ordered separately.

2. In case of consequential or incidental damages.

3. If the product is stored, assembled or maintained incorrectly.

4. In case of attempted unsuccessful repair or modification of the product without Fredericia's consent.

5. If the product has been misused or cleaned using incorrect cleaning methods.

6. Damage due to normal wear and tear.

7. If the product has been standing outdoors or in a humid environment.

8. If the product has been exposed to prolonged bright sunlight or heat.

9. If the product differs from a wood or textile sample. Since the material changes naturally over time, the samples can only be considered indicative.

10. Sinew braid where a 2-year warranty is provided.

11. If the product changes naturally over time, normal patina will occur and not an expression of a product defect.

Products manufactured according to customer specification are not covered by Fredericia's test certificates regarding strength, durability and stability and Fredericia therefore gives no guarantees for this.

Original purchase invoice is mandatory when making claims under warranty.

Replaced products or replaced product parts become Fredericia's property. The delivery of a replacement product or repair of a product does not imply a renewal or extension of the applicable warranty period.

All inquiries and questions related to extended warranty should be directed to our customer service.

7.5. If the customer finds that there are defects in the delivered, the customer must notify Fredericia Furniture of this within a reasonable time after these defects were discovered. If the customer fails to give notice within a reasonable time, the customer forfeits the right to invoke the defect. However, a notification given within two months after the defect was found is always timely.

7.6. The Customer may exercise its right of complaint by sending an email to customerservice@fredericia.com.

7.7. In connection with the complaint, the customer must inform Fredericia Furniture of what the defect or defect consists of, just as the customer must provide the relevant invoice number. The customer is encouraged to provide a detailed explanation of the error or defect to ensure an effective remediation process.

7.8. Returns and complaints must be made to the address mentioned in clause 1.3. The customer is responsible for proper packaging upon return.

8. Possibility of appeals

8.1. For disputes arising between Fredericia Furniture and the customer, the customer may submit a complaint to:

8.2. For customers residing in another EU country, complaints about disputes arising between Fredericia Furniture and the customer regarding the customer's purchase may be submitted to the European Platform for Online Dispute Resolution, http://ec.europa.eu/odr. When submitting a complaint, the customer can provide Fredericia Furniture's email address customerservice@fredericia.com.

9. Liability

9.1. Product liability

9.1.1. Fredericia Furniture is liable if a delivered product causes personal injury or damage to property, if the item in question by its nature is usually intended for commercial use and is mainly used by the injured party accordingly. Fredericia Furniture is not liable for commercial property damage, unless it is documented that the damage is due to errors on Fredericia's part that should not have been averted by the customer's examination of the delivered products.

If a third party makes a claim for compensation for product liability to the customer, the customer must immediately notify Fredericia Furniture in writing.

9.2. Limitation of liability

9.2.1. Fredericia Furniture is not responsible for delays or non-performance of agreements due to force majeure. As long as a force majeure situation exists, Fredericia Furniture is exempt from fulfilling its obligations

9.2.2. Fredericia assumes no liability for loss caused by delay, defects or other breach, unless the loss is caused by gross negligence on Fredericia's part. Fredericia assumes no liability for indirect losses, including loss of goodwill, lost profits (e.g. loss of profit), operating losses or ongoing costs.

9.3. Liability

9.3.1. Fredericia Furniture's liability for damages is limited to an amount corresponding to the price of the product purchased by the customer.

10. Personal data

10.1. The information provided by the customer in connection with his order will be registered with Fredericia Furniture, which is the data controller for the information. Read more about our processing of personal data and the customer's rights in this regard in our privacy policy.

11. Governing Law and Venue

The purchase of goods on www.fredericia.com is subject to Danish law. Any dispute shall be settled by the ordinary Danish courts.

12. VAT refunds

Please note that we cannot refund VAT for customers abroad (including the Faroe Islands and Greenland).

13. Commercial customers and resale

Apart from this point (§13), these terms of sale and delivery do not apply to traders' purchases on Fredericia Furniture's online platforms. Traders’ purchases are subject to the Terms and Conditions of Sale and Delivery for Fredericia Furniture A/S in force at any given time.

These terms can be requested through our B2B portal or by contacting our customer service. The same applies to purchases by private individuals if this is for the purpose of resale.

Regardless of the fact that the trader or a private individual with the intention of resale receives an order confirmation generated automatically on the trading platform, Fredericia Furniture is entitled to cancel the order in question afterwards if the order concerns goods sold at a discount.
