05/15/11 44 11-1266/2 MAX ERNST (german 1891-1976) “DEUX OISEAUX” Signed bottom right, oil on slate Executed in 1926 9 x 6 in. (22.7 x 15.1cm) provenance: Sidney Janis Gallery, New York, New York. Sotheby Parke-Bernet, New York, Sale #4304, lot 957, November 9, 1979, lot 957. Private Collection, Pennsylvania. literature: Spies, Werner and G. Metken, Max Ernst: Werke 1925-1929, Cologne, Germany, 1976, p. 135, no. 1053 (illustrated). note: While confined to bedrest during an illness in 1925, Max Ernst is said to have noticed and studied the patterns emerging from wood grains and other natural surfaces in his home. This prompted experimentation in a new technique, “frottage” in which he rubbed surfaces with graphite or crayon and explored what images would suggest themselves. In 1926 he took this a step further by applying paint and scraping it away when it was nearly dry, leaving a textured surface which he termed “grattage.” The present work, executed that same year and depicting a quintessential Ernst subject, is a fascinating look into the artist’s evolving technique that was so influential to the surrealist movement as a whole. $80,000-120,000

05/15/11 The following five lots come from the personal collection of Charles Lisanby, three time Emmy Award-winning art director and production designer who was most recently inducted into the Television Academy Hall of Fame. Lisanby and Andy Warhol first met at a party in 1955, and traveled around the world together in 1956. During this trip, while visiting Kyoto, Japan, the artist developed his interest in gold leaf which appears in his art soon afterward including Gold Book of 1957. The friendship between the artist and producer extended to the artist’s mother, whose holiday card addressed to Lisanby (lot 107) exhibits the same flourishing script recognizable in the lettering she did for her son’s prints throughout his career including his own holiday card (lot 105) as well as “A La Recherche du Shoe” (lot 106), Gold Book, and many other books. Proceeds of the sale of these works will directly benefit the James Madison University, Harrisonburg, Virginia, Madison Art Collection in support of the research and use of the Charles Lisanby Collection in their extensive curriculum in the visual and performing arts.

05/15/11 “Bo Bartlett is an American realist with a modernist vision. His paintings are well within the tradition of American realism as defined by artists such as Thomas Eakins and Andrew Wyeth. Like these artists, Bartlett looks at America ’s heart – its land and its people – and describes the beauty he finds in everyday life. His paintings celebrate the underlying epic nature of the commonplace and the personal significance of the extraordinary. And like Wyeth, Bartlett sees the importance of the smallest details in the overall picture and imbues his work with surreal ambiguity.” (Bo Bartlett, Charles T. Butler et. al, The Columbus Museum, Columbus, Georgia, 2002, cover introduction) Freeman’s is privileged to offer 47 working sketches, drawings, and paintings by Bo Bartlett, one of the most prominent alumni of The Pennsylvania Academy of the Fine Arts. The majority come from a single, private collection and offer a unique glimpse into the artist’s career, spanning from before his student years of the 1980s through to the early 21st century. Represented here are intimate portraits evocative of 18th Century Italian portraiture studied while the artist was in Italy in the early 1970s (lots 186 and 200) along with several paintings and pencil drawings from the 1980s and 1990s when Bartlett was a well sought after Philadelphia portraiture artist (see lots 183-4, and 191-5). Working studies for large scale, epic works of the mid-1990s are also offered such as “Hiroshima ” (lot 196), “Unity” (lots 190 and 207) and the arresting “Lifeboat” (lot 201) from the much celebrated “Water Series” of the late 1990s.

Therefore, all property is sold “ASIS”. Freeman’s is acting solely as an auction broker, and unless otherwise stated, does not own the Property offered for sale and has made no independent investigation of the Property. Freeman’s makes no warranty of title, merchantability or fitness for a particular purpose, or any other warranty or representation regarding the description, genuineness, attribution, provenance or condition to the Property of any kind or nature with respect to the Property. 4 Freeman’s in its sole and exclusive discretion, reserves the right to withdraw any property, at any time, before the fall of the hammer. 5 Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the printed catalogue. Freeman’s reserves the right to determine any and all matters regarding the order, precedence or appropriate increment of bids or the constitution of lots. 6 The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re- offer and resell the article in dispute. If any dispute arises after sale, the Freeman’s sale record shall be conclusive in all respects. 7 If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, he may reject the same and withdraw the Property from sale.
8 Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the buyer with these Conditions of Sale. Buyer thereupon assumes full risk and responsibility of the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full price, plus Buyer’s Premium, therefore or such part, upon such terms as Freeman’s may require. 9 No lot may be removed from Freeman’s premises until the buyer has paid in full the purchase price therefor including Buyer’s Premium or has satisfied such terms that Freeman’s, in its sole discretion, shall require. Subject to the foregoing, all Property shall be paid for and removed by the buyer at his/her expense within ten (10) days of sale and, if not so removed, may be sold by Freeman’s, or sent by Freeman’s to a public warehouse, at the sole risk and charge of the buyer(s), and Freeman’s may prohibit the buyer from participating, directly or indirectly, as a bidder or buyer in any future sale or sales. In addition to other remedies available to Freeman’s by law, Freeman’s reserves the right to impose a late charge of 1.5% per month of the total purchase price on any balance remaining ten (10) days after the day of sale. If Property is not removed by the buyer within ten (10) days, a handling charge of .1% of the total purchase price per month from the tenth day after the sale until removal by the buyer shall be payable to Freeman’s by the buyer; Freeman’s shall charge 1.5% of the total purchase price per month for any property not so removed within 60 days after the sale. Freeman’s will not be responsible for any loss, damage, theft, or otherwise responsible for any goods left in Freeman’s possession after ten (10) days. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to Freeman’s and the Consignor (including without limitation the right to hold the buyer(s) liable for the bid price) Freeman’s, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the buyer(s), or resell the property. In such event, the buyer(s) shall remain liable for any deficiency in the original purchase price and
will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and Freeman’s commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment shall be by cash, certified check or similar bank draft, or any other method approved by Freeman’s. Checks will not be deemed to constitute payment until cleared. Any exceptions must be made upon Freeman’s written approval of credit prior to sale. In addition, a defaulting buyer will be deemed to have granted and assigned to Freeman’s, a continuing security interest of first priority in any property or money of, or owing to such buyer in Freeman’s possession, and Freeman’s may retain and apply such property or money as collateral security for the obligations due to due to Freeman’s.
