Buyer’s Premium
A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. The Buyer’s Premium shall be: 25% on the first $50,000 of the hammer price of each lot, 20% on the portion from $50,001 through $1,000,000, and 12% thereafter.

Bidding
At the sale Registered bidders will be assigned a bidder number and given a paddle for use at the sale. Once the first bid has been placed, the auctioneer asks for higher bids in increments determined by the auctioneer. To place your bid, simply raise your paddle until the auctioneer acknowledges you. The auctioneer will not mistake a random gesture for a bid. By phone A limited number of telephone lines are available for bidding by phone through a Freeman’s representative. Payment

Removal of Purchases
Deliveries will not be made during the time of the sale unless otherwise indicated by the auctioneer. All items must be paid for and removed within ten (10) working days of the sale. Purchases not so removed may be turned over to a licensed warehouse at the expense and risk of the purchaser.
Shipping and Packing

The Patton Family Not until its owner retired did he suspect he could have a treasure in his possession. It was something that was passed on to him in the early 1960's when time and interest where in short supply. As the great-grandson of Michael Patrick Patton (1870-1943), a draper and decorator of patriotic flag displays, he inherited a trunk kept in the family and forgotten for decades. An unusual flag was found among its contents. Patton, born to John and Catherine Patton of Upper Darby, Pennsylvania, worked at the Cardington Mills, a cotton cloth factory at nearby Cobb's Creek with most of his seven siblings. Their jobs included weaving, dying, piecing and picking, but at the time of his marriage to Julia Elizabeth Ruth in 1892, he is listed as a weaver. In the early part of the last century, he became involved in decorating buildings and large interiors such as those at Philadelphia’s Frankford Arsenal. In time, Patton’s great-grandson recognized one of the trunk’s items as an American flag, though not realizing its potential as an important piece of our history. He then began in earnest to verify that it was, indeed, from the 18thcentury. He first had it examined by S. Rabbit Goody, a nationally known textile historian. She concluded it was consistent both with 18th century sewing practices and construction of that era. It was then examined by the the major forensic lab McCrone Associates, Inc. whose 50 page report stated that the materials are consistent with the late 18th century. The present owner recently had it conserved and framed by a highly regarded textile conservator.
Nathaniel Ames This flag's unusual hand-written inscription is thought to have been made by Nathaniel Ames (1761-1863), born in Killingly, Connecticut. He joined the New London County Militia at the outbreak of the Revolutionary War and, as a 17-year-old, helped in the building of Fort Griswold in Groton, Connecticut. He later joined the Connecticut Continental Army and served under Washington at Morristown during the harsh winter of 1780. Ames went on to join the crew of a 16-gun brig and privateer, Marquise de Lafayette, and traveled to Holland and the West Indies, returning home in mid 1783. At the end of that year, Ames signed onto another merchant ship sailing to Bermuda—this time under an English captain. On the voyage home, the ship was captured and taken to Bermuda where the crew was thrown in prison for three months. It is during this captivity that Ames most likely signed and dated the flag. It is also possible that he was impressed (forced to serve) onto a British ship for three more years at sea. The flag itself is a wonderful revelation of science, history and geography. The red dye has been identified as cochineal, and the blue dye as “Prussian” blue—both in common use in England and North America by the end of the 18th-century. The inscription ink was identified as thin Oriental smoke-black ink in a gelatin binder, probably mixed with sea water—also appropriate for the late 18th-century. An analysis of the fiber and dye content of the flag’s materials and ink inscription on the hoist has been completed and accompanies this lot.
Ames eventually became a farmer and Methodist minister in Oneida County, New York until the age of 75 when he then moved to a farm in Wisconsin. This flag is accompanied by photocopies of Ames’s pension records from the National Archives; correspondence relating to his years of military service; a number of accounts of his life, along with photographs and transcribed interviews with Ames from December 11, 1832 and June 28, 1833, recounting his Revolutionary War service. Also included is a photocopy of "A Sketch of the Life of Nathaniel Ames as Dictated by him, the R.P. Main , Oregon , Wis," and an article from The Saturday Globe, March 5, 1898. Nathaniel Ames died in Oregon, Wisconsin at the age of 102, making him the last serving revolutionary war soldier. From the hands of a Revolutionary War patriot and naval adventurer, to the possession of a Delaware County weaver and draper, to its years of “imprisonment” in a family’s trunk, this unique emblem of the United States is now poised to begin a new chapter in its long and rather circuitous route through Freeman’s to a new home.

Confederate 2nd National Flag of the Louisiana Guard Battery

The Richmond Whig of August 18, 1864 reports that this “handsome battle flag” was presented to the Louisiana Guard Battery on August 17th, 1864, through Professor Alex Dimitry “by New Orleans ladies now residing in our city.” It was carried until the end of the war. This is the third flag of the Louisiana Guard Battery; the first was retired, and the second, captured in the battle of Rappahannock Ford, November 7, 1863. According to tradition, the night before General Robert E. Lee’s surrender at Appomattox Courthouse, as artillery and accoutrements were surrendered to
Federal troops, the color bearer, Private William C. Ahern of New Orleans tore the flag from its staff and wrapped it around himself under his shirt. He successfully hid the flag during the surrender proceedings at Appomattox and during troop transport to New Orleans. Ahern continued to hide the flag fearing confiscation during the Reconstruction years. He eventually presented the flag to the Confederate Memorial Literary Society of Richmond, forerunner of the Museum of the Confederacy, in 1916. The flag remained on display there until 1956.

Silver from the Macalester Family of Philadelphia Born in Scotland, Charles Macalester, Sr. (1765-1832) emigrated to the United States in 1786 and thereafter settled in Philadelphia. One of the leading merchant traders of his day, Macalester later retired and entered into the world of finance, acting as President of the Insurance Company of the State of Pennsylvania, director of the Bank of North America, founder of the Mariners Church of Philadelphia, and Vice President of the St. Andrew’s Society. Macalester’s son, Charles A. Macalester, Jr. (1798-1873) was born in Philadelphia and graduated from the University of Pennsylvania. He was a well-known businessman, broker, and leader in Philadelphia, having been appointed Government Director of the Second Bank of the United States and serving as President of the St. Andrew’s Society from 1864 until his death in 1873. An avid philanthropist, he founded many local organizations including Philadelphia Presbyterian Hospital, Macalester Presbyterian Church, and Macalester College in Minnesota. He acted as an advisor to eight U.S. presidents from Andrew Jackson through Ulysses S. Grant. In 1850, Macalester purchased land and property along the Delaware River upon which to build his summer home, a riverfront mansion he named, “Glengarry.” An example of Victorian elegance and tradition, Glengarry served as the sight of several events and gala affairs. Many important heads of state and dignitaries traveled to Glengarry to be guests of Mr. Macalester and his daughter, Mrs. Lily Macalester Laughton, a renowned Washington hostess married to a Belgium diplomat. Today, Glengarry (now called Glen Foerd) is a historic mansion listed on the National Register of Historic Places. Glen Foerd Mansion, Philadelphia.

The Bonaparte Family Silver Wine Coaster The likely mate to the Bonaparte Family wine coaster exhibited in Uncorked! Wine, Objects & Tradition (2012-2013), Winterthur Museum, Wilmington, Delaware. See fig. 1. Rejected by Emperor Napoleon I after marrying his youngest brother Jerome in 1803, Elizabeth “Betsy” Patterson Bonaparte (1785-1879) returned from Europe to her hometown of Baltimore, Maryland in 1805 with only her newborn son, Jerome Napoleon Bonaparte (18051870). Though abandoned by her husband, Betsy refused to let American society forget her Imperial alliance, emblazoning the Bonaparte Family coat-of-arms on her carriage and other items. Samuel Kirk & Son, who advertised in New York Magazine as having provided the service used at the wedding of Jerome and Elizabeth, fashioned silver for Betsy bearing the Bonaparte Crest. Such pieces include this wine coaster; the wine coaster at Winterthur; a tea service;
and a repousse sugar dish and covered tureen currently in the collection of the Maryland Historical Society (MdHS). Though it remains unclear as to who commissioned this wine coaster, it bears the same coat-of-arms seen on other pieces commissioned by Betsy. Given the hallmark, it could have been ordered by any member of the Bonaparte family living in Baltimore from 1868-1896, including Betsy who, in 1834 after sojourns in Europe, returned to Baltimore and lived there until her death in 1879. Betsy’s tradition of heraldic display was adopted by her son, Jerome, who, like his mother, was reported to ride around in a coach decorated with the Crest. Furthermore, Jerome amassed quite a collection of Napoleona, which he passed along to his son, Charles Joseph Bonaparte (1851-1921). Although Charles Joseph took much greater pride in promoting his American, rather than European,

He presumably acquired additional items directly from Betsy (the soup tureen at MdHS is listed as having been made for Betsy but bears his

monogram) and may have received the two wine coasters in honor of his marriage to Ellen Channing Day of Newport, RI, in 1875. Upon Betsy’s death in 1879, her estate of 1.5 million dollars was bequeathed to Charles Joseph and his brother, Jerome Napoleon Bonaparte II (1830-1893).

Born in Pennsylvania on October 1, 1746 to Henry Melchior Muhlenberg, patriarch of the Lutheran Church in America, and Anna Maria Weiser, daughter of Indian treaty negotiator Conrad Weiser, John Peter Gabriel Muhlenberg (1746-1807) was a Lutheran minister who became a celebrated major general in the American Revolutionary War. Known as the “Fighting Parson,” General Muhlenberg commanded the 8th Virginia Regiment and was involved in many important battles, including the Battle of Brandywine and the Battle of Stony Point. provenance: The powder horn descended in a Philadelphia family to the present owners. note: Hugh Maclain, or “Maclean” as often spelled in the 18th century, was probably a member of the three companies of Maclean clansman raised by clan leader Allan Maclean to support the British effort against the French in North America, and arrived in May of 1758 as part of the 77th Regiment of Foot or Montgomeries Highlanders. Over 4,000 Scots served in the three Highland regiments during the French and Indian Wars (1755-1763): The 77th Regiment of Foot, the 42nd Regiment of Foot or the Black Watch, and the 78th Regiment of Foot or Fraser’s Highlanders. While
some muster roles for officers and surgeons exist, few remain for the rank and file soldier of this conflict. At the conclusion of the war, many Highlander veterans from all the regiments took land grants in America in lieu of returning to Scotland. It is interesting to note that a Hugh Maclean was living in Cumberland County, North Carolina in April of 1762. Furthermore, in the early years of the American Revolutionary War, the British raised the 84th Regiment of Foot or Royal Highland Emigrants from Highlander French and Indian War veterans living both in Scotland and in America. The muster rolls of the 84th list a Col. Hugh Mclean who served in the 77th Regiment and a Lieut. Hugh McLean. $10,000-15,000

Promoted to Colonel and Chief Engineer in 1818, Armistead became commander of the 3rd Artillery Regiment in 1821
and was brevetted to the senior rank of brigadier general in 1828. Succeeding Zachary Taylor, Armistead served as commander during the Second Seminole War in Florida in 1840 and 1841. Armistead’s illustrious military career was paralleled by that of his relatives. Walker Keith’s brother, George Armistead (1780-1818) fought in the War of 1812, commanding Forth Mchenry during the Battle of Baltimore-the battle that ultimately inspired Francis Scott Key’s writing of The Star Spangled Banner. Keith Walker’s son, Lewis Addison Armistead (1817-1863) was a Confederate brigadier general in the Civil War, who died shortly after his capture during Pickett’s Charge at the Battle of Gettysburg. In 1829, Thomas Sully (1783-1872) completed a portrait of Walker Keith Armistead for West Point Academy. The portrait remains part of the Academy’s collection. Walker Keith Armistead married Elizabeth Stanley Armistead (1791-
1861) in 1814. The initials on the case may have belonged to their daughter, Mary Walker Armistead (1821-1857) who married J. Travis Rosser, a Major of the 10th Regiment Virginia Calvary, in 1843. $6,000-9,000

(sight) note: The Gilpin paper mill shown in this work, was established by Philadelphia Quaker brothers, Joshua and Thomas Gilpin in 1787. The Gilpin’s were renowned for instituting the most recent Europeon advances in paper manufacturing. The mill was sold in 1837. An exile following the unsuccessful polish November Uprising against Russia in 1830 and a former professor at Poland’s Lyceum of Krezmieniec, Martin Rosienkiewicz arrived in Philadelphia in 1834. At the time, Philadelphia showed great support for these exiles and publisher Matthew Carey established a committee to care for them and supported Rosienkiewicz in writing the first American book printed in Polish, Dialogues to Facilitate the Acquisition of the English Language by the Polish Emigrants. He also ran a Polish school and taught drawing and painting at the Philadelphia High School for Young Ladies. The Library Company of Philadelphia holds a lithograph published by Lehman & Duval (1837) showing this school on Spruce Street. Dr. Hugh Lenox Hodge (1796-1873) was a legendary Philadelphia physician, lecturer and Professor of Obstetrics at the University of Pennsylvania. $8,000-12,000

Ravenscroft published a book in 1826 outlining his beliefs. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to Freeman’s and the Consignor (including without limitation the right to hold the buyer(s) liable for the bid price) Freeman’s, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the buyer(s), or resell the property. In such event, the buyer(s) shall remain liable for any deficiency in the original purchase price and
will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and Freeman’s commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment shall be by cash, certified check or similar bank draft, or any other method approved by Freeman’s. Checks will not be deemed to constitute payment until cleared. Any exceptions must be made upon Freeman’s written approval of credit prior to sale. In addition, a defaulting buyer will be deemed to have granted and assigned to Freeman’s, a continuing security interest of first priority in any property or money of, or owing to such buyer in Freeman’s possession, and Freeman’s may retain and apply such property or money as collateral security for the obligations due to due to Freeman’s. Freeman’s shall have all of the rights accorded a secured party under the Pennsylvania Uniform Commercial Code.
Premium shall be: 25% on the first $50,000 of the hammer price of each lot, 20% on the portion from $50,001 through $1,000,000, and 12% thereafter.
10 Unless the sale is advertised and announced as “without reserve”, each lot is offered subject to a reserve and Freeman’s may implement such reserves by bidding through its representatives on behalf of the Consignors. In certain instances, the Consignor may pay less than the standard commission rate where Freeman’s or its representative is a successful bidder on behalf of the Consignor. Where the Consignor is indebted to Freeman’s, Freeman’s may have an interest in the offered lots and the proceeds therefrom, other than the broker’s Commissions, and all sales are subject to any such interest.
16 In no event shall any liability of Freeman’s to the buyer exceed the purchase price actually paid.
11 No “buy” bids shall be accepted at any time for any purpose. 12 Any pre-sale bids must be submitted in writing to Freeman’s prior to commencement of the offer of the first lot of any sale. Freeman’s copy of any such bid shall conclusively be deemed to be the sole evidence of same, and while Freeman’s accepts these bids for the convenience of bidders not present at the auction, Freeman’s shall not be responsible for the failure to execute, or, to execute properly, any pre-sale bid. 13 A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. 14 Unless exempted by law from the payment thereof, the buyer will be required to pay any and all federal excise tax and any state and/or local sales taxes, including where deliveries are to be made outside the state where a sale is conducted, which may be subject to a corresponding or compensating tax in another state. 15 Freeman’s may, as a service to buyer arrange to have purchased property posted and shipped at the buyer’s expense. Freeman’s is not responsible for any acts or omissions in packing or shipping of purchased lots whether or not such carrier recommended by Freeman’s. Packing and handling of purchased lots is at the responsibility of the buyer and is at the entire risk of the buyer.
17 No claimed modification or amendment of this Agreement on the part of any party shall be deemed extant, enforceable or provable unless it is in writing that has been signed by the parties to this Agreement. No course of dealing and no delay or omission on the part of Freeman’s in exercising any right under this Agreement shall operate as a waiver of such right or any other right and waiver on any one or more occasions shall not be construed as a bar to or waiver of any right or remedy of Freeman’s on any future occasion. 18 These Conditions of Sale and the buyer’s, the Consignor’s and Freeman’s rights under these Conditions of Sale shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania and Consignor and Buyer agree to the exclusive jurisdiction of the Philadelphia, Pennsylvania Court of Common Pleas and the United States District Court for the Eastern District of Pennsylvania.
