Buyer’s Premium
A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. The Buyer’s Premium shall be: 25% on the first $50,000 of the hammer price of each lot, 20% on the portion from $50,001 through $1,000,000, and 12% thereafter.
Sales Tax
All items in the catalogue are subject to the 8% Pennsylvania and Philadelphia sales tax. Dealers purchasing for resale must register their tax numbers on current PA forms. Forms should be submitted to our Client Services office on the second floor.
Catalogue Descriptions
All item descriptions, dimensions and estimates are provided for guidance only. It is the buyer’s responsibility to inspect all lots prior to bidding to ensure that the condition is to their satisfaction. If potential buyers are unable to inspect lots in person, our specialists will be happy to prepare detailed Condition Reports on individual lots as quickly as possible. These are for guidance only, and all lots will be sold “as is” as per our Terms and Conditions of Sale.
Bidding
At the sale Registered bidders will be assigned a bidder number and given a paddle for use at the sale. Once the first bid has been placed, the auctioneer asks for higher bids in increments determined by the auctioneer. To place your bid, simply raise your paddle until the auctioneer acknowledges you. The auctioneer will not mistake a random gesture for a bid. By phone A limited number of telephone lines are available for bidding by phone through a Freeman’s representative. Phone lines must be reserved in advance. Requests must be submitted no later than 24 hours prior to the scheduled start of the sale. In writing Bid forms are available in the sale room and at the back of the catalogue. These should be submitted in person, by mail or by fax no later than one hour prior to the scheduled start of the sale. The auctioneer will bid on your behalf up to the limit. On the internet A fully-illustrated catalogue is available on-line at www.freemansauction.com. Registered bidders may leave absentee bids through the web site and will receive email confirmation of their bid. Freeman’s is not responsible for errors or failure to execute bids.
Payment
Payment is due within ten (10) working days of the sale. Lots purchased will not be released until we have received full payment. Payment may be made in cash, by check, money order, or debit card. Payments by check must clear the bank before goods will be released.
Removal of Purchases
Deliveries will not be made during the time of the sale unless otherwise indicated by the auctioneer. All items must be paid for and removed within ten (10) working days of the sale. Purchases not so removed may be turned over to a licensed warehouse at the expense and risk of the purchaser.
Shipping and Packing
Responsibility for packing, shipping and insurance shall be exclusively that of the purchaser. Upon request, Freeman’s will provide the purchaser with names of professional packers and shippers known to us.

March 31, 1888, pp. 4-5. “National Academy of Design 63rd Annual Exhibition.” Sun. April 3, 1888, pg. 16. “The Academy Exhibition.” Nation. April 19, 1888. pp. 33031. “Spring Exhibition of the Academy and the Society.” Art Review 3 no.1 [July - August 1888] pg. 31. note: This painting depicts Cornelia Rogers Huntington Greer (b. 1836) and was likely commissioned given that Chase also completed a portrait of Greer’s son Colbert (OP. 145). This painting was originally dated circa 1912 based on information provided by descendants of the sitter. However, several reviews of a work entitled Portrait of Mrs. G. that was exhibited once during the artist’s lifetime - at the Spring Exhibition at the National Academy of Design in 1888 suggest an earlier date, as they seem to be describing the present portrait of Mrs. Greer. A critic for the New York Daily Tribue writes “Mr. Chase’s portrait of an elderly lady seated in a fur-trimmed blue robe, seen against a hanging of a very pale blue, is a picture which has earned its honorable place not only by the cleverness of coloring, but also by the firmness and strength of the modeling.” (New York Daily Tribune[March 31, 1888];4-5). A writer for the New York Sun comments, “More should be said for the portrait of an elderly lady in a dark blue gown against a curtain of lighter blue” ([New York]Sun, April 3, 1888, 16). A rave review and further description of the work is given in the Nation, which describes it as “dignified, of excellent style, and showing the artist’s appreciation of quiet tones and his ability to harmonize the figure and costume, with the accessories, in a complete ensemble at its best” (Nation, April 19, 1888, 331). Finally, another critic discussing the exhibition writes that the Portrait of Mrs. G has been “treated with an eye to color likewise, but in a much quieter and more wholesome manner. There is more of the character of the sitter about it, and a reasonable concession to the needs of good portrait
painting” (Art Review, July-August 1888, 31). Further supporting the date circa 1888 is that Chase painted the portrait of Greer’s son Colbert circa 1886: it seems likely that he would have executed both portraits at around the same time. A further consideration is the age of the sitter, who would have been seventy-six years old in 1912 (the original dating), though in the portrait she appears to be much closer to the fifty-two years of age she would have been in 1888. The lot will be accompanied by ephemera relating to the sitter. $25,000-40,000

(61 x 44.5cm) provenance: The Sitter. By descent in the family. The Estate of Rubert Forbes Adam. Sold under instruction from the executors of his estate. note: The sitter was the daughter of George Nathaniel Curzon, who would later be named Marquess Curzon of Kedleston and Viceroy of India. His wife was Mary Leiter, of the Leiter family of Chicago, known for their vast real estate holdings. Mary Leiter’s father, Levi Leiter, cofounded Marshall Field & Company. The year prior to sitting for Sargent, Lady Cynthia married Oswald Mosley, M.P., later the 6th Baronet. A favorite subject of the press due to her looks and glamorous dress, Lady Mosley first campaigned with her husband but later struck out on her own winning a seat in Parliament by a vast majority in 1929. While in Parliament, she was a great champion of women’s rights. The Lady Mosley followed her husband as he left the Labour Party in 1930 and formed a new party that would later become the British Union of Fascists. Though Oswald’s views were becoming increasingly extreme, Cynthia stood by him through it all, including joining he and Mussolini at a Fascist Party parade in Rome. The Lady Mosley developed peritonitis following an appendix operation in 1933 and passed away that year at the young age of 34. A number of family members also sat for Sargent, including Cynthia’s aunt Daisy Leiter and Lord Curzon. $40,000-60,000

A Midwesterner by birth, Joe Jones’ paintings brought regionalist imagery to New York, evidenced by familiar elements of the harvest seen in Winter in Dutchess, a depiction of farm life in Dutchess County, just north of New York City. Alternately referred to as a “regionalist,” “anti-regionalist,” “modernist,” “social realist” and a painter of the “American Scene,” Jones’ oeuvre defies distinct categorization. A card-carrying Communist as a youth, he would later enlist in the United States Department of War Combat Artist Program. Not surprisingly, any discussion of Jones’ work includes reference to Thomas Hart Benton. The two artists’ careers were more perpendicular than parallel. While Benton made a name for himself in New York City before retreating to the Midwest to further perpetuate regionalism and the region itself as an artistically fertile area, Jones would outgrow St. Louis, believing the criticism and infrastructure to be insufficient. Jones would move to New York City in 1935, committing to live there in 1937. Unlike Benton’s romanticized visions of farm life, Jones painted scenes of unrest in his early career, perhaps best illustrated by American Justice in the Columbus Museum of Art. Emerging from the proletariat, labor unrest was another topic that Jones captured with his deft brush. Jones’ original style was noted by New York Times critic Howard Devree in a 1936 exhibition at the ACA gallery “Paintings by Midwestern Artists” where he stated there were “no imitations of Benton, Curry and Wood.” In Winter in Dutchess, Jones spares the viewer the politics of his earlier work instead focusing on the camaraderie of the harvest. The four farmers work in unison to fill their silo before the fields are fully blanketed in snow. Jones’ wheat paintings, might appear simple, but they reflect the necessary community of the farmstead, whether in the Midwest or here in Dutchess County. Additionally, the expanse of farmland, rolling hills that recede into the distance, provides a potent example of Jones’ interest in celebrating the
landscape, a celebration even more evident in a work such as Our American Farms found in the collection of the Whitney Museum of American Art. The painting dates to the early 1940s, when Jones moved to Wappingers Falls, near Poughkeepsie. He was finding much success in New York City, with a work purchased by the Metropolitan Museum of Art and exhibiting two paintings in the 1942-1943 exhibition, “Artists for Victory: An Exhibition of Contemporary American Art” at the Met. Additionally he had a solo exhibition at the Associated American Artists Gallery, in March of 1943, that included Winter in Dutchess.

The American artist Fairfield Porter reached artistic maturity with the Abstract Expressionist generation. He worked closely with the Abstract Expressionists in the Hamptons, regularly acknowledging his artistic debt to his friend Willem De Kooning. Porter however would maintain his figurative realist style despite being surrounded by the immense success of those who emphasized gesture and materiality. Though Porter recognized that medium was the hallmark of modern sensibility, he did not lose interest in the classics, particularly the Old Masters he studied while at Harvard and illustrated by his excitement in meeting Bernard Berenson in 1931. As such, Porter is celebrated for circumventing the artist’s need to assert the primacy of either medium or reality – Porter chose both. In the words of the inimitable Hilton Kramer, “Porter restored the presence of the world to a place of high pictorial importance.” We see this in “Morning After A Storm” where the viewer sits on the recognizable Southampton shoreline. At the same time, Porter’s paint application and generally neat division of sand, waves and sky convey a modern sentiment. In 1982, The Museum of Fine Arts Boston held a retrospective of Porter’s work. With the Abstract Expressionists firmly entrenched in the art historical canon by this time, contemporaneous artists were identified, and rightly celebrated for their success in the face of abstraction, perhaps none more so than Fairfield Porter. Porter’s genius was thus revealed; an artist that had the means to produce artwork that was simultaneously modern and traditional.

Primarily remembered for her illustrations that graced magazine covers nationwide, the Philadelphian, Jessie Willcox Smith, remains one of the most celebrated American women artists of the late 19th and early 20th century. A pupil of Thomas Eakins and Howard Pyle, Smith matriculated through the higher education system of Philadelphia, first at the School of Design for Women (now Moore College of Art & Design), the Pennsylvania Academy of the Fine Arts, Drexel University and then the Brandywine School. While studying with Howard Pyle, Smith was surrounded by exceptional classmates including Violet Oakley and Maxfield Parrish. Smith would befriend Oakley and Elizabeth Shippen Green, choosing to live with them at the Red Rose Inn in Villanova. It may come as a surprise to those familiar with her work that Smith never married nor raised children. Often compared to another Philadelphian, Mary Cassatt, Smith’s mothers and children tended more toward the ideal than those of the famed American Impressionist. Smith’s success as an illustrator landed her numerous portrait commissions, particularly in the 1920s. As seen here in The Tea Party, clients hired Smith to render children in a manner similar to her more popular magazine illustrations. As noted by the artist on the painting verso, this is an initial study for individual portraits of the children of prominent Philadelphia businessman Howard Butcher Jr.

Therefore, all property is sold “ASIS”. Freeman’s is acting solely as an auction broker, and unless otherwise stated, does not own the Property offered for sale and has made no independent investigation of the Property. If any dispute arises after sale, the Freeman’s sale record shall be conclusive in all respects. 7 If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, he may reject the same and withdraw the Property from sale.
8 Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the buyer with these Conditions of Sale. Buyer thereupon assumes full risk and responsibility of the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full price, plus Buyer’s Premium, therefore or such part, upon such terms as Freeman’s may require. 9 No lot may be removed from Freeman’s premises until the buyer has paid in full the purchase price therefor including Buyer’s Premium or has satisfied such terms that Freeman’s, in its sole discretion, shall require. Subject to the foregoing, all Property shall be paid for and removed by the buyer at his/her expense within ten (10) days of sale and, if not so removed, may be sold by Freeman’s, or sent by Freeman’s to a public warehouse, at the sole risk and charge of the buyer(s), and Freeman’s may prohibit the buyer from participating, directly or indirectly, as a bidder or buyer in any future sale or sales. In addition to other remedies available to Freeman’s by law, Freeman’s reserves the right to impose a late charge of 1.5% per month of the total purchase price on any balance remaining ten (10) days after the day of sale. If Property is not removed by the buyer within ten (10) days, a handling charge of 1% of the total purchase price per month from the tenth day after the sale until removal by the buyer shall be payable to Freeman’s by the buyer; Freeman’s shall charge 1.5% of the total purchase price per month for any property not so removed within 60 days after the sale. Freeman’s will not be responsible for any loss, damage, theft, or otherwise responsible for any goods left in Freeman’s possession after ten (10) days. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to Freeman’s and the Consignor (including without limitation the right to hold the buyer(s) liable for the bid price) Freeman’s, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the buyer(s), or resell the property. In such event, the buyer(s) shall remain liable for any deficiency in the original purchase price and
will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and Freeman’s commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment shall be by cash, certified check or similar bank draft, or any other method approved by Freeman’s. Checks will not be deemed to constitute payment until cleared. Any exceptions must be made upon Freeman’s written approval of credit prior to sale. In addition, a defaulting buyer will be deemed to have granted and assigned to Freeman’s, a continuing security interest of first priority in any property or money of, or owing to such buyer in Freeman’s possession, and Freeman’s may retain and apply such property or money as collateral security for the obligations due to due to Freeman’s. Freeman’s shall have all of the rights accorded a secured party under the Pennsylvania Uniform Commercial Code.

10 Unless the sale is advertised and announced as “without reserve”, each lot is offered subject to a reserve and Freeman’s may implement such reserves by bidding through its representatives on behalf of the Consignors. In certain instances, the Consignor may pay less than the standard commission rate where Freeman’s or its representative is a successful bidder on behalf of the Consignor. Where the Consignor is indebted to Freeman’s, Freeman’s may have an interest in the offered lots and the proceeds therefrom, other than the broker’s Commissions, and all sales are subject to any such interest.
16 In no event shall any liability of Freeman’s to the buyer exceed the purchase price actually paid.
11 No “buy” bids shall be accepted at any time for any purpose. 12 Any pre-sale bids must be submitted in writing to Freeman’s prior to commencement of the offer of the first lot of any sale. Freeman’s copy of any such bid shall conclusively be deemed to be the sole evidence of same, and while Freeman’s accepts these bids for the convenience of bidders not present at the auction, Freeman’s shall not be responsible for the failure to execute, or, to execute properly, any pre-sale bid. 13 A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. 14 Unless exempted by law from the payment thereof, the buyer will be required to pay any and all federal excise tax and any state and/or local sales taxes, including where deliveries are to be made outside the state where a sale is conducted, which may be subject to a corresponding or compensating tax in another state. 15 Freeman’s may, as a service to buyer arrange to have purchased property posted and shipped at the buyer’s expense. Freeman’s is not responsible for any acts or omissions in packing or shipping of purchased lots whether or not such carrier recommended by Freeman’s. Packing and handling of purchased lots is at the responsibility of the buyer and is at the entire risk of the buyer.
17 No claimed modification or amendment of this Agreement on the part of any party shall be deemed extant, enforceable or provable unless it is in writing that has been signed by the parties to this Agreement. No course of dealing and no delay or omission on the part of Freeman’s in exercising any right under this Agreement shall operate as a waiver of such right or any other right and waiver on any one or more occasions shall not be construed as a bar to or waiver of any right or remedy of Freeman’s on any future occasion. 18 These Conditions of Sale and the buyer’s, the Consignor’s and Freeman’s rights under these Conditions of Sale shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania and Consignor and Buyer agree to the exclusive jurisdiction of the Philadelphia, Pennsylvania Court of Common Pleas and the United States District Court for the Eastern District of Pennsylvania.
