All potential buyers must register for the sale prior to placing a bid.

Registration information may be submitted in person at our reception desk, by fax or through our website at www.freemansauction.com. We will require proof of identification and residence and may require a credit card and/or a bank reference. By registering for the sale, the buyer acknowledges that he or she has read, understood and accepted Freeman’s Terms and Conditions of Sale.

Buyer’s Premium

A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. The Buyer’s Premium shall be: 25% on the first $50,000 of the hammer price of each lot, 20% on the portion from $50,001 through $1,000,000, and 12% thereafter.

Sales Tax

All items in the catalogue are subject to the 8% Pennsylvania and Philadelphia sales tax. Dealers purchasing for resale must register their tax numbers on current PA forms. Forms should be submitted to our Client Services office on the second floor.

Catalogue Descriptions

All item descriptions, dimensions and estimates are provided for guidance only. It is the buyer’s responsibility to inspect all lots prior to bidding to ensure that the condition is to their satisfaction. If potential buyers are unable to inspect lots in person, our specialists will be happy to prepare detailed Condition Reports on individual lots as quickly as possible. These are for guidance only, and all lots will be sold “as is” as per our Terms and Conditions of Sale.

Bidding

At the sale Registered bidders will be assigned a bidder number and given a paddle for use at the sale. Once the first bid has been placed, the auctioneer asks for higher bids in increments determined by the auctioneer.

To place your bid, simply raise your paddle until the auctioneer acknowledges you. The auctioneer will not mistake a random gesture for a bid.

By phone A limited number of telephone lines are available for bidding by phone through a Freeman’s representative. Phone lines must be reserved in advance. Requests must be submitted no later than 24 hours prior to the scheduled start of the sale.

In writing Bid forms are available in the sale room and at the back of the catalogue. These should be submitted in person, by mail or by fax no later than one hour prior to the scheduled start of the sale. The auctioneer will bid on your behalf up to the limit.

On the internet A fully-illustrated catalogue is available on-line at www.freemansauction.com. Registered bidders may leave absentee bids through the web site and will receive email confirmation of their bid.

Payment

Payment is due within ten (10) working days of the sale. Lots purchased will not be released until we have received full payment. Payment may be made in cash, by check, money order, or debit card. Payments by check must clear the bank before goods will be released.

Removal of Purchases

Deliveries will not be made during the time of the sale unless otherwise indicated by the auctioneer. All items must be paid for and removed within ten (10) working days of the sale. Purchases not so removed may be turned over to a licensed warehouse at the expense and risk of the purchaser.

Shipping and Packing

Responsibility for packing, shipping and insurance shall be exclusively that of the purchaser. Upon request, Freeman’s will provide the purchaser with names of professional packers and shippers known to us.

note: Mary Way—born in New London, Connecticut to Mary Taber and shopkeeper Ebenezer Way—and her sister Elizabeth, or Eliza, (1771-1825) were artists and created dressed miniatures, as well as traditional miniature portraits on ivory. In 1809, Mary Way advertised a school for girls offering “painting, tambour, embroidery, lace work on muslin, reading, writing, plain sewing, etc.” in the Connecticut Gazette. In 1811, Mary and Eliza moved to New York. Mary advertised herself at 95 Greenwich Street, as “a portrait and miniature painter” who could also paint “landscapes or views of country seats,” and as a teacher of drawing. She remained in New York until 1820.

She returned to New London, gradually going blind. $8,000-12,000

27 141188/1 Pair of Chippendale mahogany Marlborough leg side chairs philadelphia, pa, circa 1780 Each with serpentine crest above Gothic splat on molded trapezoidal seat and Marlborough legs joined by brackets.

H: 38 in. provenance: According to family tradition, this pair of chairs belonged to Miriam Pyle Williams (1846-1913) at the time of her marriage to George Brooke Roberts (1833-1897) in 1868, after the death of his first wife, Sara L. Brinton. Roberts was the sixth proprietor of the family ancestral home, Pencoyd, a large stone farmhouse that stood near City Line Avenue. Roberts was the fifth President of the Pennsylvania Railroad. The chairs were among the possessions of Pencoyd inherited by their daughter, Miriam Williams Roberts (1888-1989), who married Spencer Ervin (1886-1967), and they stood in the front hall of Minfford, a home built for Miriam in 1917 at the corner of Belmont Ave and Llanberris Road, Bala Cynwyd, thence to her daughter and the present owner. The chairs have been on loan to the Philadelphia Museum of Art since 1990. $5,000-8,000

Hailed as “the most eminent iron-smith of his time in the United States,” Samuel Wheeler was commissioned by General George Washington during the Revolutionary War to make a chain that would stretch across the North River in New Jersey and serve to thwart the British ships.

Often compared to the Roman Aristocrat Cincinnatus (519430 BC), George Washington befittingly served as the Society’s first president, and he was the

original owner of the 302-piece service to which this plate belongs.

This service was commissioned during the first American mercantile voyage to Canton in 1784 by Samuel Shaw (1754-1794), a Revolutionary War hero and an original member of the Society. Its decoration incorporates Pierre L’Enfant’s (17541825) design for the Society’s eagle insignia. In 1786, Washington purchased the service with the help of fellow Society member Henry “Light-Horse Harry” Lee (17561818).

Washington is known to have used the service in Mount Vernon as well as in his presidential mansions in New York and Pennsylvania. The service later passed to Washington’s step grandson, George Washington Parke Custis (1781-1857), and thence to his daughter, Mary Anna Randolph Custis (1808-1873), who married Robert E. Lee (1807-1870) in 1831. In 1928, Henry Francis duPont purchased those pieces that remained with the descendants of Mary Custis Lee (1835-1918). $6,000-8,000

A United States Senator, Mayor of New York City, and the sixth Governor of New York, DeWitt Clinton (1769-1828) was a strong advocate for the construction of the Erie Canal and is consequently often called the “Father of the Erie Canal.”

note: On June 1st, 1813, aboard the USS Chesapeake, which was engaged in battle with the British HMS Shannon, the dying Captain James Lawrence (1781-1813) issued his infamous, final command: “Don’t Give Up the Ship.” The phrase appeared soon after in a Baltimore Newspaper, and just two months later was inscribed on a banner flown aboard the USS Lawrence, commanded by Commodore Oliver Hazard Perry (1785-1819), who emerged victorious in the Battle of Lake Erie.

The absence of any piece of Chinese Export porcelain bearing this particular Eagle with the “Don’t Give

Up the Ship” banner in any of the standard resources for American Market Export, suggests that this piece could be especially rare.

A precedent for the inclusion of the now iconic American wartime slogan on a piece of Export does exist in the form of a flagon depicting naval battles from the War of 1812 on either side and a sailor holding a banner emblazoned, “Don’t Give Up the Ship” under the spout. According to John Hill Morgan and Mantle Fielding, “In November, 1927, Messrs. Kennedy & Company, of New York City, had a Washington, evidently by Pine, which had been found in France. This was sold to an American collector...” (88).

note: Believed to be the fourth portrait of George Washington by Robert Edge Pine, painted during Pine’s stay at Mount Vernon, April 28th to May 16th 1785. Could possibly be the “Fine portrait of His Excellency General Washington” as listed in “Scheme of a Lottery Authorised by Act of Assembly for the Sale of a Real Estate, and a large and valuable Collection of Paintings, Engravings & c. Late the Property of Robert Edge Pine, deceased,” Philadelphia, August 1, 1789.

The son of renowned British engraver, John Pine (1690-1756), Robert Pine began working in London but suffered from a lack of recognition in his native country.

Pine befriended Washington’s neighbor, associate and intimate, George William Fairfax (1729-1787) and expressed to him his American sympathies. Consequently, Pine was introduced to Washington via letters from Fairfax in spring 1784 as a “worthy Artist” and a “true ‘Son of Liberty’.” Pine emigrated to America shortly thereafter, arriving at Mount Vernon in April 1785 with intentions of painting a non-commissioned portrait of Washington and with letters from notable Philadelphians, including one from Francis Hopkinson (1737-1791) in which Pine is described as “the most eminent Artist, in his Way, we have ever had in this Country.”

During his stay at Mount Vernon, Pine is known to have painted portraits of Washington, as well as of Mrs. Washington, Frances Bassett (now Frances Washington), and the

four Custis grandchildren. In a letter from R.E. Pine to George Washington, dated 16 December 1785, Pine expresses his desire, “That the Pictures may meet with an endulgent reception has been my hope, and my ambittion, that they may be honour’d with some degree of approbation, by your Excelly and Mrs Washington.”

On May 16, 1785, Washington, in reference to his sittings for Pine, writes, “In for a penny, in for a pound is an old adage. I am so hackneyed to the touches of the Painter’s pencil, that I am not altogether at their beck, and sit like patience on a Monument, whilst they are delineating the lines of my face.” The three additional known portraits of Washington by Pine bear a very strong resemblance to this example in so far as they present a 3/4 view of the President, facing left, dressed in his Uniform of the Continental Army with his right hand clutching a gold-tipped cane; a tent and the edge of a spear are visible in the upper right corner. The first is the Property of the National Portrait Gallery, Smithsonian, Washington, DC; the second, is situated in the Second Bank National Portrait Gallery, Philadelphia, Pennsylvania; and the third is Property of Jack Warner and Westervelt Company, now on display at the Tuscalonsa Museum, Alabama. He returned to New York and was promoted to Captain in the 69th Regiment New York State National Guard on September 17, 1865. 24 in. x 36 in. (sight) note: As Union forces approached Richmond on April 2, 1865, General Robert E. Lee notified Jefferson Davis that the capitol of the Confederacy had to be evacuated. The events that followed remain controversial. Warehouses of tobacco and cotton, and piles of official papers were set on fire and strong winds caused the fires to spread. The ironclad warships were set on fire and their arsenals exploded. As foodstuffs and clothing were brought from storage to be destroyed, the starved citizens took the goods and rioting and looting commenced, enhanced by the whiskey being dumped in the streets.

When the Union forces arrived on April 3, 1865, fifty-four blocks of Richmond had been destroyed and Union troops put out the two remaining fires. $2,500-3,500

The model matches a sketch of Hunt’s dated, “August 7, 1884,” at the American Institute of Architects in Washington, D.C., across which Hunt has written: “Make a Model of this!”

In 1881, the Committee, organized to raise funding for the installation of Auguste Bartholdi’s Statue of Liberty in New York Harbor, commissioned renowned American architect Richard Morris Hunt to design the pedestal.

Incorporating suggestions from Bartholdi, Hunt’s initial design was for a pyramidal pedestal that was a staggering 114 feet in height and an amalgam of a fortress and the ancient Lighthouse at newworldencyclopedia.org Alexandria; due to monetary constraints, though, the final version of the pedestal was simplified and ultimately reduced to 89 feet. After much delay, the final pedestal was completed in April 1886.

Correspondence dating from 1881 to 1901 between August Bartholdi and Richard Butler, secretary of the Committee, concerning the design and construction of the pedestal are currently in the Manuscripts and Archives division of the New York Public Library. $8,000-12,000

These “Turkey”oyster plates are dubbed as such because the wells and shells are uniquely positioned to form the outline of a turkey. Due to the popularity of the service and to its signficant production cost, Davis patented his design in 1880 so that the plates might be mass produced to meet the public’s demand. The building seen through the window is thought to be the Bibb County Courthouse designed and built by architect, contractor and philanthropist Elam Alexander (1796-1863) in Macon, Georgia in 1829. note: Isaac Winship (1802-1885) was born in Massachusetts and moved with his older brother Jacob in 1820 to Monticello, Georgia where they established a shoe factory. When Isaac married Martha in 1827 he was an established merchant in Macon. In 1848, the brothers built a cotton gin manufactory, first near Macon and then in Atlanta, and eventually established and operated Winship Iron Foundry and Machine Works in Atlanta. The Winships maintained homes in Macon and Atlanta. The Iron Foundry and their Atlanta home were destroyed by General Sherman’s troops in 1864.

Martha Pearson Cook (1813-1882) had the distinction of being the first white child born in Indian territory before the founding of Macon. Her father, Major Phillip Cook, of South Carolina, commanded Fort Hawkins, then the frontier from 1812-1815. During the Civil War, Martha served as President of the Atlanta Hospital Association from 1862 until the end of the conflict. She was renowned for tireless efforts organizing and tending to wounded soldiers, raising money, and for gathering the dead from the battleground and securing decent burials. When their Atlanta home was destroyed, she organized hospital work in Macon. She served as the president of the Ladies Memorial Association providing headstones for Confederate dead and building a monument in their honor. Martha gave birth to twelve children. Papers of the Winship-Flournoy family are in the collection of the Atlanta History Center. $15,000-25,000

In 1889, he acted as President of the Tennessee Coal, Iron and Railroad Company. He died in 1889 and is buried in Pulaski, Tennessee. The papers of John Calvin Brown, 1871-1875 remain in the collection of the Tennessee State Library and Archives in Nashville, Tennessee.

John Calvin Brown (1827-1899) married his second wife, Elizabeth Childress Brown (1842-1919) on February 23, 1864. Based on the engraving to the tureens’ undersides, this suite was likely ordered or gifted to the couple in honor of their 25th wedding anniversary in 1889. John C. Polk (President, 1845-1849) and her aunt, Former First Lady Sarah Childress Polk (1803-1891). Though never shy of suitors, Elizabeth married Confederate Major General John Calvin Brown in 1864, and their marriage day is chronicled in Annie Somers Gilchrist, Some Representative Women of Tennessee, Nashville, TN: McQuiddy Printing Company, 1902, pp. 12-16. Following the Civil War, the couple moved to Pulaski, Tennessee, where they had four children: Marie, Daisy, Elizabeth, and John C. Brown, Jr. With the rising political career of her husband, Elizabeth “filled her high position with graceful dignity. Her entertainments were frequent and elaborate…”(15). Active in the community, Elizabeth was a member of the Daughters of the American Revolution and Episcopal Church, and served as president of the United Daughters of the Confederacy and of the Vanderbilt Aid Society. Subsequent to Brown’s retirement from politics, the couple moved around before later returning to Nashville, Tennessee. According to Gilchrist, their “mansion on Spruce Street abounds in beautiful works of art statuary, paintings, copies from the old masters, plate and sets of gold-chased Venetian glass brought from abroad” (16). It is very possible that these silver pieces on offer formed part of the impressive collection of “plate” to which Gilchrist refers. $1,000-2,000

Adamant that the trumpets should instead be exhibited at the fire house, the members of the fire house hired Mr. William Fickus to retrieve and return the trumpets. Outraged at this decision, Woelkers insisted that Fickus be arrested for theft. The fire house members, “retaliated...[and] had the audacity to become indignant, and holding a special meeting they decided to prefer charges against Joseph Woelkers” in the hopes of securing his expulsion from the company. $800-1,200

note: Under the instructional support of his uncle, Elijah Pierce began whittling and carving at a young age while growing up on a cotton plantation near Baldwyn, Mississippi. Disinclined to follow in the footsteps of his father, a former slave turned farmer, Pierce trained and worked as a barber, received his preacher’s license, and eventually relocated to Columbus, Ohio. When he opened his own barber shop in 1951, Pierce converted a room in his shop into a woodworking studio where he continually honed his carving skills.

Pierce began receiving national and international acclaim for his folk art late in life: In the 1970s, he exhibited his work at galleries such as the National Museum of American Art, the Renwick Gallery, and the

Museum of Modern Art; in ‘73, he won first prize in the International Meeting of Naive Art in Zagreb, Yugoslavia; in ‘82, his carvings were included in the Corcoran Gallery of Art’s pivotal and large-scale exhibition Black Folk Art in America 1930-1980 and in that same year, the National Endowment for the Arts awarded him a National Heritage Fellowship.

Though many of Pierce’s carvings are often religious in theme and spiritual in nature, his secular carvings bespeak a keen interest in his everyday community, contemporary culture, and American politics and history. He seemed particularly inclined to celebrate individuals who promoted and advocated for freedom, equality and liberty, whether it be those who fought for the rights of African

Americans (e.g. Abraham Lincoln, Martin Luther King, Jr., Joe Louis) or notable American heroes, such as the Kennedys and Paul Revere.

According to the entry for this figure in the Columbus Museum of Art’s exhibition catalog (pg. 176), this carving has been identified as Paul Revere based upon the horse’s seemingly frantic stride and the figure’s style of dress, especially his hat, which bears a strong resemblance to the Colonial tricorn hat. Though the race of the rider has been called into question, Pierce was known to seldomly distinguish the race of his subjects, as evidenced by his similarly racially ambivalent depictions of Joe Louis and Abraham Lincoln. $10,000-15,000

Terms & Conditions All property offered and sold (“property”) through samuel t. freeman & co, (“freeman’s”) shall be offered and sold on the terms and conditions set forth below which constitutes the complete statement of the terms and conditions on which all property is offered for sale. by bidding at the auction, whether present in person or by agent, by written bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions.

1 Unless otherwise indicated, all Property will be offered by Freeman’s as agent for the Consignor.

2 Freeman’s reserves the right to vary the terms of sale and any such variance shall become part of these Conditions of Sale.

3 Buyer acknowledges that it had the right to make a full inspection of all Property prior to sale to determine the condition, size, repair or restoration of any Property.

Therefore, all property is sold “ASIS”. Freeman’s is acting solely as an auction broker, and unless otherwise stated, does not own the Property offered for sale and has made no independent investigation of the Property. Freeman’s makes no warranty of title, merchantability or fitness for a particular purpose, or any other warranty or representation regarding the description, genuineness, attribution, provenance or condition to the Property of any kind or nature with respect to the Property.

4 Freeman’s in its sole and exclusive discretion, reserves the right to withdraw any property, at any time, before the fall of the hammer.

5 Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the printed catalogue. Freeman’s reserves the right to determine any and all matters regarding the order, precedence or appropriate increment of bids or the constitution of lots.

6 The highest bidder acknowledged by the auctioneer shall be the buyer.

The auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re- offer and resell the article in dispute. If any dispute arises after sale, the Freeman’s sale record shall be conclusive in all respects.

7 If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, he may reject the same and withdraw the Property from sale.

8 Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the buyer with these Conditions of Sale. Buyer thereupon assumes full risk and responsibility of the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full price, plus Buyer’s Premium, therefore or such part, upon such terms as Freeman’s may require.

9 No lot may be removed from Freeman’s premises until the buyer has paid in full the purchase price therefor including Buyer’s Premium or has satisfied such terms that Freeman’s, in its sole discretion, shall require. Subject to the foregoing, all Property shall be paid for and removed by the buyer at his/her expense within ten (10) days of sale and, if not so removed, may be sold by Freeman’s, or sent

by Freeman’s to a public warehouse, at the sole risk and charge of the buyer(s), and Freeman’s may prohibit the buyer from participating, directly or indirectly, as a bidder or buyer in any future sale or sales. In addition to other remedies available to Freeman’s by law, Freeman’s reserves the right to impose a late charge of 1.5% per month of the total purchase price on any balance remaining ten (10) days after the day of sale. If Property is not removed by the buyer within ten (10) days, a handling charge of 1% of the total purchase price per month from the tenth day after the sale until removal by the buyer shall be payable to Freeman’s by the buyer; Freeman’s shall charge 1.5% of the total purchase price per month for any property not so removed within 60 days after the sale. Freeman’s will not be responsible for any loss, damage, theft, or otherwise responsible for any goods left in Freeman’s possession after ten (10) days. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to Freeman’s and the Consignor (including without limitation the right to hold the buyer(s) liable for the bid price) Freeman’s, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the buyer(s), or resell the property. In such event, the buyer(s) shall remain liable for any deficiency in the original purchase price and

will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and Freeman’s commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment shall be by cash, certified check or similar bank draft, or any other method approved by Freeman’s. Checks will not be deemed to constitute payment until cleared. Any exceptions must be made upon Freeman’s written approval of credit prior to sale. In addition, a defaulting buyer will be deemed to have granted and assigned to Freeman’s, a continuing security interest of first priority in any property or money of, or owing to such buyer in Freeman’s possession, and Freeman’s may retain and apply such property or money as collateral security for the obligations due to due to Freeman’s.

Freeman’s shall have all of the rights accorded a secured party under the Pennsylvania Uniform Commercial Code.

10 Unless the sale is advertised and announced as “without reserve”, each lot is offered subject to a reserve and Freeman’s may implement such reserves by bidding through its representatives on behalf of the Consignors. In certain instances, the Consignor may pay less than the standard commission rate where Freeman’s or its representative is a successful bidder on behalf of the Consignor. Where the Consignor is indebted to Freeman’s, Freeman’s may have an interest in the offered lots and the proceeds therefrom, other than the broker’s Commissions, and all sales are subject to any such interest.

11 No “buy” bids shall be accepted at any time for any purpose.

12 Any pre-sale bids must be submitted in writing to Freeman’s prior to commencement of the offer of the first lot of any sale. Freeman’s copy of any such bid shall conclusively be deemed to be the sole evidence of same, and while Freeman’s accepts these bids for the convenience of bidders not present at the auction, Freeman’s shall not be responsible for the failure to execute, or, to execute properly, any pre-sale bid.

13 A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the

total purchase price. The Buyer’s Premium shall be: 25% on the first $50,000 of the hammer price of each lot, 20% on the portion from $50,001 through $1,000,000, and 12% thereafter.

14 Unless exempted by law from the payment thereof, the buyer will be required to pay any and all federal excise tax and any state and/or local sales taxes, including where deliveries are to be made outside the state where a sale is conducted, which may be subject to a corresponding or compensating tax in another state.

15 Freeman’s may, as a service to buyer arrange to have purchased property posted and shipped at the buyer’s expense. Freeman’s is not responsible for any acts or omissions in packing or shipping of purchased lots whether or not such carrier recommended by Freeman’s. Packing and handling of purchased lots is at the responsibility of the buyer and is at the entire risk of the buyer.

16 In no event shall any liability of Freeman’s to the buyer exceed the purchase price actually paid.

17 No claimed modification or amendment of this Agreement on the part of any party shall be deemed extant, enforceable or provable unless it is in writing that has been signed by the parties to this Agreement. No course of dealing and no delay or omission on the part of Freeman’s in exercising any right under this Agreement shall operate as a waiver of such right or any other right and waiver on any one or more occasions shall not be construed as a bar to or waiver of any right or remedy of Freeman’s on any future occasion.

18 These Conditions of Sale and the buyer’s, the Consignor’s and Freeman’s rights under these Conditions of Sale shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania and Consignor and Buyer agree to the exclusive jurisdiction of the Philadelphia, Pennsylvania Court of Common Pleas and the United States District Court for the Eastern District of Pennsylvania.
