32 A FLEMISH BAROQUE SILVER-GILT REPOUSSÉ CHARGER unknown maker, possibly middleburg, 17th century The oval platter with a banded scrolling foliate repousse border decorated with masques, and centering a depction of the Triumph of Amphitrite, queen of the Sea and consort of Poseidon. With indistinct marks for Middleburg and other marks, as well as Soviet export marks from the early 20th century. L: 17 1/2, W: 12 in. Weight: 43.34 oz. t. note: The offered lot belongs to the relatively rare group of objects of this type which survive from the mid-seventeenth century. Silver production in this period centered around Antwerp, but the offered lot appears to bear the stamps for Middelburg, another well-known area of production of baroque silver. (For more information, see the article “Zilver Op Tafel - Vlaams Tafelsilver Van De 16e Tot de 18e Eeuw” published by the Openbaar Kunstbezit Vlaanderen.) The late 19th century in Russia was a time of immense interest in Dutch Old Master paintings and Works of Art from this period. The interesting Soviet export marks dating from the early part of the 20th century indicate that the piece was in a Russian collection at the time of the revolution, and may have been amongst the large group of foreign works of art in the Soviet Union designated for sale in the west in the 1930’s.

85 A LARGE AND VERY FINE RUSSIAN SILVER NIELLO AND PARCEL-GILT TANKARD moscow, first quarter 18th century Of typical form, the lid with fruited finial and the handle with knobform thumb piece, the whole decorated with scrolling foliate motifs in niello work, the sides engraved with three Old Testament scenes of David and Bathsheba, Daniel in the Lion’s Den, and Joseph relaying his dream to Pharaoh, within cartouches and with related slavonic inscriptions, separated by classical trophies on a conforming shaped and stepped niello and parcel gilt base. Weight: 49.6 oz. t. provenance: Lewis Cass (1782-1866) Mathilda Frances Cass Ledyard (1818-1898), his daughter Lewis Cass Ledyard (1851-1932), her son Thence by descent note: Niello (or “chern’” in Russian) was already known in Russia in the 10th century, and nielloed objects from Kiev, Ryazan, Chernigov, and Moscow were produced at a high level of quality. Byzantine jewelers that arrived in Moscow after the fall of Constantinople contributed to technical variations, and by the late 17th and early 18th century, Moscow was the undisputed center of niello production.

In the late 17th and early 18th century, Western silver forms began to influence Russian work, and the charka, bratina, and shaped beakers of the earlier periods were replaced in popularity by the tankard (as in the offered lot), the snuffbox, and the patchbox. Western engravings began to filter into Russia in this period from the Netherlands, and it is from these that the creator of the offered lot no doubt drew inspiration for the baroque-style scenes which decorate the sides of the tankard.

The three Old Testament scenes depicted on this tankard each feature inscriptions that complement the individual scenes of David, Beersheba and the Prophet Nafan, Daniel in the Lion’s Den, and Joseph telling his dream to Pharaoh. In the first scene, the inscription reads: “Had Beersheba not revealed [exposed] herself, then David would not have fallen into adultery and not sinned, however through the prophecy of Nathan, he was warned.” In the second, it reads: “On Daniel [who was] cast to the lions for eating / The counselors of King Darius became enraged at him because he was better than they were.” And in the last, it reads: “Joseph, though sold by his brothers and thrown into a pit, but as God Almighty seeing [his] good initiatives, rewarded him in time ...[illeg.]”

Each of these scenes and inscriptions points to the role of the prophetic and faithful servant. It may be inferred that the offered lot was a presentation gift to a prescient and faithful supporter of a member of the highest aristocracy of Moscow. It is possible because of its impressive size and quality that the tankard was created in the Moscow Armoury workshops. The offered lot left Russia long before the revolution, through France whence it was acquired by Lewis Cass, governor of the Michigan Territory (1813–1831), Secretary of War under President Andrew Jackson, and Secretary of State under President James Buchanan. During his public life, Cass also served as the American Ambassador to France at the Court of the Tuileries, and acquired this piece during his time there. The tankard bears, in addition to mid-19th century import marks for France on the lip and flange, partial Cyrillic scratched inventory numbers “TF,” “IF 16,” and “74,” as well as other indistinct marks, including the faint outline of the mark for Moscow. The full hallmarking of this piece was deliberately effaced by the 20th century engraver who added the inscription “L.C.L. and G.P.L., April Eleventh, 18781903, from L.C.” which was an inscription commemorating the 25th wedding anniversary of Cass’ grandchildren Lewis Cass and Gertrude Prince Ledyard, noting that the tankard was from the statesman, “LC.” $10,000-15,000

Freeman & Co, (“Freeman’s”) shall be offered and sold on the terms and conditions set forth below which constitutes the complete statement of the terms and conditions on which all property is offered for sale. the expense of the ultimate sale, and Freeman’s commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment shall be by cash, certified check or similar bank draft, or any other method approved by Freeman’s. Checks will not be deemed to constitute payment until cleared. Any exceptions must be made upon Freeman’s written approval of credit prior to sale. In addition, a defaulting buyer will be deemed to have granted and assigned to Freeman’s, a continuing security interest of first priority in any property or money of, or owing to such buyer in Freeman’s possession, and Freeman’s may retain and apply such property or money as collateral security for the obligations due to Freeman’s. Freeman’s shall have all of the rights accorded a secured party under the Pennsylvania Uniform Commercial Code. 10 Unless the sale is advertised and announced as “without reserve”, each lot is offered subject to a reserve and Freeman’s may implement such reserves by bidding through its representatives on behalf of the Consignors. In certain instances, the Consignor may pay less than the standard commission rate where Freeman’s or its representative is a successful bidder on behalf of the Consignor. Where the Consignor is indebted to Freeman’s, Freeman’s may have an interest in the offered lots and the proceeds therefrom, other than the broker’s Commissions, and all sales are subject to any such interest. 11 No “buy” bids shall be accepted at any time for any purpose. 12 Any pre-sale bids must be submitted in writing to Freeman’s prior to commencement of the offer of the first lot of any sale. Freeman’s copy of any such bid shall conclusively be deemed to be the sole evidence of same, and while Freeman’s accepts these bids for the convenience of bidders not present at the auction, Freeman’s shall not be responsible for the failure to execute, or, to execute properly, any pre-sale bid.

6 The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re- offer and resell the article in dispute. If any dispute arises after sale, the Freeman’s sale record shall be conclusive in all respects. 7 If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, he may reject the same and withdraw the Property from sale. 8 Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the buyer with these Conditions of Sale. Buyer thereupon assumes full risk and responsibility of the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full price, plus Buyer’s Premium, therefore or such part, upon such terms as Freeman’s may require. 9 No lot may be removed from Freeman’s premises until the buyer has paid in full the purchase price therefor including Buyer’s Premium or has satisfied such terms that Freeman’s, in its sole discretion, shall require. Subject to the foregoing, all Property shall be paid for and removed by the buyer at his/her expense within ten (10) days of sale and, if not so removed, may be sold by Freeman’s, or sent by Freeman’s to a public warehouse, at the sole risk and charge of the buyer(s), and Freeman’s may prohibit the buyer from participating, directly or indirectly, as a bidder or buyer in any future sale or sales. In addition to other remedies available to Freeman’s by law, Freeman’s reserves the right to impose a late charge of 1.5% per month of the total purchase price on any balance remaining ten (10) days after the day of sale. If Property is not removed by the buyer within ten (10) days, a handling charge of 1% of the total purchase price per month from the tenth day after the sale until removal by the buyer shall be payable to Freeman’s by the buyer; Freeman’s shall charge 1.5% of the total purchase price per month for any property not so removed within 60 days after the sale. Freeman’s will not be responsible for any loss, damage, theft, or otherwise responsible for any goods left in Freeman’s possession after ten (10) days. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to Freeman’s and the Consignor (including without limitation the right to hold the buyer(s) liable for the bid price) Freeman’s, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the buyer(s), or resell the property. In such event, the buyer(s) shall remain liable for any deficiency in the original purchase price and will also be responsible for all costs, including warehousing,

13 A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. The Buyer’s Premium shall be: 25% on the first $200,000 of the hammer price of each lot, 20% on the portion from $200,001 through $3,000,000, and 12% thereafter. 14 Unless exempted by law from the payment thereof, the buyer will be required to pay any and all federal excise tax and any state and/or local sales taxes, including where deliveries are to be made outside the state where a sale is conducted, which may be subject to a corresponding or compensating tax in another state. 15 Freeman’s may, as a service to buyer, arrange to have purchased property posted and shipped at the buyer’s expense. Freeman’s is not responsible for any acts or omissions in packing or shipping of purchased lots whether or not such carrier is recommended by Freeman’s. Packing and handling of purchased lots is at the responsibility of the buyer and is at the entire risk of the buyer. 16 In no event shall any liability of Freeman’s to the buyer exceed the purchase price actually paid. 17 No claimed modification or amendment of this Agreement on the part of any party shall be deemed extant, enforceable or provable unless it is in writing that has been signed by the parties to this Agreement. No course of dealing and no delay or omission on the part of Freeman’s in exercising any right under this Agreement shall operate as a waiver of such right or any other right and waiver on any one or more occasions shall not be construed as a bar to or waiver of any right or remedy of Freeman’s on any future occasion. 18 These Conditions of Sale and the buyer’s, the Consignor’s and Freeman’s rights under these Conditions of Sale shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania and Consignor and Buyer agree to the exclusive jurisdiction of the Philadelphia, Pennsylvania Court of Common Pleas and the United States District Court for the Eastern District of Pennsylvania.
