This represents William Harding (My grandfather) as town crier of Great Marlboro who was appointed in 1826 and held the office until 1835 when a change of crier was declared soon after the election of Sir William Creston as M.P. for the Borrow of Marlboro. The representation is the work of his own hands. The only crier that ever wore a uniform in Marlboro. He was succeeded by William Crosswell commonly called White Will. The little dog did not belong to him but followed him everywhere when in uniform. This was given to me by my grandfather in the latter part of 1852.

He lived in and around Marysville, Pennsylvania and his compelling facsimiles of the work of Wilhelm Schimmel and 19th century Pennsylvania redware could fool the unwary.

H: 62 in. provenance: Property of a Texas collector note: Although this figure no longer retains his costume accessories or most of his carved pendants and bosses, it shares numerous characteristics with two iconic Folk Art figures: American Indian Man (1986.65.303) and American Indian Woman (1986.65.384), in the collection of the Smithsonian American Art Museum, formerly in the collection of Herbert Waide Hemphill, Jr. (1929-1998). A January 19, 1987, New York Times article, announcing the Smithsonian’s acquisition of the Hemphill Folk Art collection notes that the figures were used as shop signs in a New Jersey store.

This figure’s proportions, large bellied posture, treatment of hands and the pattern of pendants is almost identical to both of the Hemphill figures, while his facial features are more closely related to those of the Indian Woman. This figure retains a quiver similar to that on the Indian male figure, and is carved with similar arms, suspenders, protruding ankle bones, shoes, and naturalistically carved circular base.

The similarities strongly suggest that this Trapper figure was carved by the same maker as the two Hemphill figures. $15,000-25,000

The Historic Portrait and Sculpture Collection of the Philadelphia Bar Association lots 410 - 478

200 years of philadelphia legal history The Philadelphia Bar Association is the oldest association of lawyers in the United States. A group of 71 lawyers met in 1802 and established the Law Library Company of the City of Philadelphia to share law books. The first location of the Law Library Company was a room in Independence Hall. Over the next two centuries, the Library grew in size and moved six times. The locations included the Athenæum and Philadelphia City Hall. The name of the organization evolved to the Law Association of Philadelphia and ultimately, to the Philadelphia Bar Association. The Library of the Philadelphia Bar Association was renamed The Theodore F. Jenkins Memorial Law Library in 1967.

Along with the purchase of legal books and manuscripts for the Law Library, portraits and sculptures were purchased and presented to honor and celebrate current and past figures of importance to the local and national legal community. The first portrait to hang on the Law Library walls arrived in 1825. By the 1830s, the Library of the Law Association of Philadelphia had some of the city’s finest portraits, painted by Thomas Sully, John Neagle, Henry Inman and others. The lawyers depicted in these portraits were often among Philadelphia’s most famous citizens — renowned orators, educators, community and legislative leaders, as well as highly successful litigators. Through the years, the Philadelphia Bar Association has treasured and conserved the collection.

As the Jenkins Memorial Law Library prepares to move to smaller quarters, the Philadelphia Bar Association has decided that it is time that the collection’s paintings and sculptures find new, respectful and responsible owners.

william lewis (1750-1819) Lewis was a member of the Pennsylvania Legislature from 1787 to 1789, U.S. Attorney for the District of Pennsylvania from 1789 to 1791 and Judge of the Federal District Court for the East District of Pennsylvania, 1791 to 1792. Considered one of the best defense attorneys of his day, Lewis was especially well-known for his skill in defending people accused of treason. A Quaker, Lewis was active in efforts to abolish slavery.

edward shippen (1729-1806) Shippen held official postitions in both pre- and postRevolution era Philadelphia. In 1755, he was appointed Judge of the Admiralty; in 1758, was appointed to Philadelphia Common Council; and in 1770, became a member of Pennsylvania’s Provincial Council, and Prothonotary of the Supreme Court of Pennsylvania, 1762-1776. He attempted to remain neutral during the American Revolution but lost his multiple offices during the conflict. After the War, Shippen secured the position of President of the Court of Common Pleas of Philadelphia, 1784-1791; Judge of the High Court of Errors and Appeals, 1784-1791; Justice of the Supreme Court of Pennsylvania, 1791-1799; and Chief Justice of the Supreme Court of Pennsylvania in 1799.

william tilghman (1756-1827) A politician and jurist in Maryland and Pennsylvania, Tilghman was a member of the Maryland Assembly from 1788 to 1790, and of the Maryland Senate from 1791 to 1793. He was Chief Judge of the U.S. Circuit Court for Pennsylvania, 1801-1802; President Judge of Court of Common Pleas for Philadelphia District, 1805; and Chief Justice of the Pennsylvania Supreme Court, 1806 to 1827.

Tilghman ran unsuccessfully for Governor of Pennsylvania as a Federalist in 1811.

john meredith read (1797-1874) “A great jurist and a great statesman,” Read was elected to the Pennsylvania House of Representatives in 1822 and 1823, and served as City Solicitor of Philadelphia from 1830 to 1833. He was appointed District Attorney of the Eastern District of Pennsylvania in 1837 and held the office until 1845. Read became Justice of the Supreme Court of Pennsyvlania in 1858, and Chief Justice of the Supreme Court of Pennsylvania in 1872. Read gained an international reputation for the depth of his knowledge, eloquence, and masterly arguments in the courtroom. Active in politics, Read was an early supporter and organizer of the Republican party.

peter stephen duponceau (1760-1844) At age 17, DuPonceau arrived in America as secretary to Baron Von Steuben and served in the Revolutionary War effort. With an understanding of eight languages, he later assisted the U.S. Secretary for Foreign Affairs, Robert Livingston. While active as a lawyer, he studied and published on the grammatical system of American Indian languages. He served as the President of the American Philosophical Society, Athenæum and the Pennsylvania Historical Society. His papers are in the Collection of the American Philosophical Society.

horace binney (1780-1875) Horace Binney graduated from Harvard in 1797 and was admitted to the bar in 1800. Binney represented several major insurance companies and became an expert on marine insurance and land-title law. Between 1809 and 1814, he published six volumes of court reports of cases heard by The Pennsylvania Supreme Court. He represented the First and Second Banks of the United States and served in the U.S. House of Representatives, defending the renewel of the charter for the Second Bank of the United States. In Lyle v. Richards (1823), Binney’s arguments established the common-law basis of real property in the United States. Binney later successfully opposed Daniel Webster in Vidal v. Philadelphia et al. (1844), affirming the City of Philadelphia’s handling of Stephen Girard’s estate and its charitable bequest that established Girard College. Binney made many public addresses and published historical sketches on Chief Justice John Marshall. He was twice offered nomination to the Supreme Court, refusing both. Binney served as a charter member to the Philadelphia Bar Association.

david paul brown (1795-1872) Considered to be one of the most brilliant orators and lawyers of his time, Brown was also a poet and playwright. An ardent abolitionist, Brown was a member of The Pennsylvania Abolition Society and The Philadelphia Antislavery Society. At his death, The Albany Law Journal, Vol. 6, (1872) pp. 49-50 published, “Mr. Brown was the steadfast friend, counselor, spokesman and orator for the anti-slavery party. He was their chivalrous champion upon nearly all occasions, important and unimportant, in the court, on the rostrum and in the newspapers. It may be said with safety that he never failed to answer their call.”

When Brown’s portrait was added to the Library’s collection, The Philadelphia Inquirer wrote, “one of the most perfect specimens of the power attainable in portraiture we have ever seen ... In design and execution, we pronounce it Neagle’s happiest effort - its finish is exquisite - the subject evinces a beauty of drawing combined with such clearness and brilliancy, that it ranks Mr. N. on an equality with the best artists in our country.”

john sergeant (1779-1852) Sergeant spent much of his life as a politician in the Federalist and Whig parties. He served as Deputy Attorney General for Chester County and Philadelphia in 1800 and was elected to the Pennsylvania House of Representatives in 1805 and 1807. Sergeant served in the U.S. House of Representatives from 1815 to 1823, 1827 to 1829 and 1837 to 1841. A supporter of Henry Clay and the Second Bank and opposed to the extension of slavery, Sergeant ran as Vice President on a ticket with Clay unsuccessfully in 1832. Sergeant was a counsel for the Second Bank. He was Chancellor of the Philadelphia Law Association from 1845 to 1852.

george mcdowell stroud (1795-1875) Stroud held the position of Court of Philadelphia Judge for many years. He is best remembered for his 1827 groundbreaking book documenting the laws of slave states, A Sketch of the Laws Relating to Slavery in Several States of the United States of America. The book was a key reference for Harriet Beecher Stowe while writing Uncle Tom’s Cabin.

eli kirk price (1797-1884) Price was a noted lawyer in the field of property and real estate law. He was elected to the Pennsylvania State Senate in 1854 to shepherd a bill consolidating separate political and geographical entities into the city of Philadelphia. The Consolidation Act of 1854 transformed the city from 1,200 acres to 122 square miles.

Price was instrumental in the passage of many legislations reforming real property law and domestic relations law. Price helped found the Fairmount Park Commission and served as its Chairman until 1884. He also authored publications on law, history and memoirs. His papers are found in the collection of the University of Delaware.

roger brook taney (1777-1864) Taney held many political and legal positions: Maryland State Legislator, 1799-1800; Maryland Senator, 1816-1821; Attorney General of Maryland, 1827; Attorney General of the United States, 1831-1833; Secretary of the Treasury, 18331834; and Chief Justice of the United States Supreme Court, 1836- 1864. He is infamously associated with the 1857 Dred Scott decision, in which the U.S. Supreme Court ruled (7–2) that a slave who had resided in a free state or territory was not entitled to his freedom; that African Americans were not and could never be citizens of the United States; and that the Missouri Compromise of 1820, which had declared free all territories west of Missouri and north of latitude 36°30’, was unconstitutional.

theodore cuyler (1819-1876) Cuyler argued seventy-three cases before the Pennsylvania State Supreme Court. He successfully represented the defendants in the landmark Christiana Riot Trial for Treason (1851) in which a group of Pennsylvania Quakers refused to surrender fugitive slaves, fired on a federal marshal and the slaves’ owner, killing him. This was the first case brought under the Fugitive Slave Act and the defendants were charged with treason and levying war against the United States. This court victory made Cuyler a national figure. From 1857 to his death, Cuyler was the Chief Philadelphia lawyer for the Pennsylvania Railroad.

john innis clark hare (1816-1905) An acknowledged leader of the Philadelphia and Pennsylvania Bar, Hare served as a Judge in the District Court of Philadelphia County from 1852 to 1874, and as President Judge of that court from 1867 to 1874. He served as President Judge of Common Pleas Court No. 2 from 1875 to 1896. Hare also held the position of Professor of Constitutional Law in the Law Department of the University of Pennsylvania.

john christian bullitt (1824-1902) In 1849, Bullitt and his partner Fairthorne, established one of the most successful and lucrative law offices in Philadelphia, with the Bank of Kentucky as one of their earliest clients. The partnership of Bullitt and Fairthorne would evolve into the law firm of Drinker, Biddle & Reath. He famously represented the financier Jay Cooke in the aftermath of The Panic of 1873. Bullitt served as a delegate to the Pennsylvania Constitutional Convention of 1873. In 1885, he drafted the so called “Bullitt Bill,” which became the Philadelphia City Charter. A statue of Bullitt stands on the north plaza of Philadelphia City Hall.

john graver johnson (1841-1917) Johnson was a noted Corporate lawyer and art collector.

He represented Standard Oil Corporation, The Sugar Trust, The American Tobacco Company, The Northern Securities Company and was counsel to numerous railroad, mining, metal and distillery companies. He argued before the U.S. Supreme Court 168 times. The firm he established in 1863 continues as Saul Ewing. william a. schnader (1886-1968) Co-founder of the firm of Schnader, Harrison, Segal & Lewis, Schnader was a practicing attorney and had a remarkable career of teaching and legislative drafting. A brilliant student, he became a brilliant teacher at the University of Pennsylvania Law School and Wharton, 1914 to 1922, while drafting the Workmen’s Compensation Code of 1915 and The Philadelphia City Charter of 1919. He became Special Deputy Attorney General in 1923 to prepare legislation to modernize exisiting state codes in The State Administration Code of 1923 and 1929. In 1930, he was appointed Attorney General of the State of Pennsylvania and under his preparation and guidance, the Banking Code, The Building and Loan Code, The Business Corporation Law, The Department of Banking Code, The Liquor Control Act and The Milk Control Board Law and the Nonprofit Corporation Law were passed.

In the 1940s, Schnader worked tirelessly on the creation of the Uniform Commercial Code. He is frequently referred to as its “Father.”

12 Any pre-sale bids must be submitted in writing to Freeman’s prior to commencement of the offer of the first lot of any sale. Payment Payment is due within ten (10) working days of the sale. Lots purchased will not be released until we have received full payment. Payment may be made in cash, by check, money order, or debit card. Payments by check must clear the bank before goods will be released.

Buyer’s Premium A Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price. The Buyer’s Premium shall be: 25% on the first $200,000 of the hammer price of each lot, 20% on the portion from $200,001 through $3,000,000, and 12% therew.

Removal of Purchases Deliveries will not be made during the time of the sale unless otherwise indicated by the auctioneer. All items must be paid for and removed within ten (10) working days of the sale. Purchases not so removed may be turned over to a licensed warehouse at the expense and risk of the purchaser.

Sales Tax All items in the catalogue are subject to the 8% Pennsylvania and Philadelphia sales tax. Dealers purchasing for resale must register their tax numbers on current PA forms. Forms should be submitted to our Client Services office on the second floor.

Shipping and Packing Responsibility for packing, shipping and insurance shall be exclusively that of the purchaser. Upon request, Freeman’s will provide the purchaser with names of professional packers and shippers known to us.

Catalogue Descriptions All item descriptions, dimensions and estimates are provided for guidance only. It is the buyer’s responsibility to inspect all lots prior to bidding to ensure that the condition is to their satisfaction. If potential buyers are unable to inspect lots in person, our specialists will be happy to prepare detailed Condition Reports on individual lots as quickly as possible. These are for guidance only, and all lots will be sold “as is” as per our Terms and Conditions of Sale.

Endangered Species Lots marked * are manufactured in whole or in part of restricted materials that may include tortoiseshell, ivory, mother-of-pearl, coral, rhinoceros horn, whalebone or marine ivory. Such materials may require specific licenses, certificates, or CITES documentation for import, export, moving between states in the U.S., or resale. Obtaining these documents may require scientific, laboratory or other expert analysis, in order to establish which species or genus the material came from. Freeman’s is unable to provide this information, and the obligation is on the purchaser of a lot containing any of these materials to ensure that they are able to obtain all the necessary or required documents should they need to, prior to bidding on the lot. If proper documentation or licenses etc. cannot be obtained for a purchased lot, the purchaser will still be required to make an on time payment for the lot as per our standard terms and conditions. Freeman’s cataloguing of the lots marked with this symbol * represents the best of our opinion, and the absence of this symbol from any lot description does not form a warranty that the lot will be free from any licensing or certification restrictions.

Bidding At the sale Registered bidders will be assigned a bidder number and given a paddle for use at the sale. Once the first bid has been placed, the auctioneer asks for higher bids in increments determined by the auctioneer. To place your bid, simply raise your paddle until the auctioneer acknowledges you. The auctioneer will not mistake a random gesture for a bid.

By phone A limited number of telephone lines are available for bidding by phone through a Freeman’s representative. Phone lines must be reserved in advance. Requests must be submitted no later than 24 hours prior to the scheduled start of the sale.

In writing Bid forms are available in the sale room and at the back of the catalogue. These should be submitted in person, by mail or by fax no later than one hour prior to the scheduled start of the sale. The auctioneer will bid on your behalf up to the limit.
