FMCC GOLF COURSE RULES AND REGULATIONS

PRIVILEGE OF PLAY

Members are not permitted to play on the Golf Course unless and until approved by the Play Approval Committee (a subcommittee of the Green Committee), which shall consult with the Club Professional. Approval requires more than just an ability to hit balls from the practice tee, but some ability to play on the course and to move along at an acceptable pace. In addition, knowledge and use of proper Golf Course etiquette is mandatory.

Proper golf attire is required at all times when using the golf facilities (including the range and the practice putting green). Strollers are not permitted at the driving range.

Although twosomes will be permitted, they do not have the privilege of playing through. Foursomes are suggested whenever possible.

No member is allowed to use any golf facilities after the posted closing time.

GOLF LIABILITY INSURANCE

All members who intend to use the golf facilities are required to carry personal liability insurance and insurance covering damage to, or loss of, golf equipment and of other personal property or belongings. The Club assumes NO responsibility for such loss.

TIME OF PLAY

REGULAR MEMBERS; SPOUSES AND SIGNIFICANT OTHERS OF REGULAR MEMBERS; GOLF MEMBERS 25-36

MONDAY: Course is closed. No play permitted when Club is closed

TUESDAY: Women’s Day. Men or mixed foursomes may play after 11:00 AM, but preference is given to women until 1:00 PM.

WEDNESDAY: Men’s Day. Women may play before 10:00 AM or after 2:00 PM at the discretion of the Starter.

THURSDAY: Anyone may play at any time.

FRIDAY: Regular Members may play at any time. Spouses and Significant Others of Regular Members may play before Noon or after 2:00 PM, or with their Spouse or Significant Other at any time. Reserved tee off time procedures will

be in effect for May through September, and can be made through the Starter one week in advance.

SATURDAY: Regular Members may play at any time. Spouses and Significant Others of Regular Members may play after the last morning group has made the turn. Assigned morning tee times will be in effect from mid-April through October via the card system. Reserved afternoon tee times can be made one week in advance withthe Starter.

SUNDAY: Regular Members may play at any time. Spouses and Significant Others of Regular Members may play after the last morning group has made the turn. Assigned morning tee times will be in effect from mid-April through October via the card system. Reserved afternoon tee times can be made one week in advance withthe Starter.

TIME OF PLAY FOR ALL OTHER CLASSES

(April 15 to October 15)

ASSOCIATE MALE MEMBERS (23-24)

APPROVED JUNIORS (15-22)

Fridays, Saturdays, Sundays and Holidays at the Starter’s discretion.

Tuesdays, Wednesdays and Thursdays as per the rules for that day. May use the upper level of the range unless an adult member is waiting for a mat, then he/she must step aside, or hit on the lower level.

APPROVED JUNIORS (8-14)

Must play with an adult member. Must use the lower level of the driving range at all times under the supervision of an adult member.

Tuesdays, Wednesdays and Thursdays – after 3:00 PM at the Starter’s discretion.

Fridays, Saturdays, Sundays and Holidays – after 4:00 PM at the Starter’s discretion.

HOUSE /TENNIS MEMBERS

A House/Tennis Member who was a member prior to February 1, 2009 will be grandfathered and may play a maximum of nine (9) rounds of golf per year.

A House/Tennis Member joining the club after February 1, 2009 may play a maximum of six (6) rounds of golf per year.

Rounds played by a House/Tennis Member’s Spouse or Significant Other count towards the member’s maximum allowable rounds in each year (including rounds played by a Spouse or Significant Other with his/her member spouse or significant other)

House/Tennis members (including their Spouses and Significant Others) are subject to the following:

(a) May not play at any time that guests are not allowed to play.

(b) May not play as a guest of a Member.

(c) May not have guests to play golf.

(d) May play in the UJA tournament and must pay the required donation charged by the club. This will not count toward the maximum of nine or six rounds in a year.

(e) May not play in any ladies’ or men’s tournaments other than the ladies’ Babes Against Cancer tournament.

(f) May not play in the Member Guest tournament except as a guest of a member (that is, you may not be a host).

(g) Cannot play on weekends earlier than the last Regular Member’s starting time with permission from the Starter.

(h) Must pay a guest fee each time they are permitted to play golf.

(i) Frequency of play will be monitored by the Starter.

(j) Nine holes count as a full round towards a member’s permitted six (6) or nine (9) rounds.

JUNIOR

& ASSOCIATE TENNIS MEMBERS (8-24)

May play golf a maximum of six (6) times per year subject to the same rules as House and Tennis Members, except for (d).

GUESTS

GUEST POLICY

No guest shall be permitted to play more than twice a month or six times in any calendar year irrespective of the number of members who may invite such guest. This does not include Member Guest or 9, Wine & Dine tournaments.

Members must register their guests with the Starter before teeing off, and are required to accompany their guests at play. A guest list will be maintained to keep track of the guests’ names and assure compliance with the rules. In order to avoid any embarrassment, if there is a chance that a guest has played with another member during the year, it would be prudent to check at the time of inviting him or her.

Guests must adhere to the rules of play for members in their applicable category, i.e. male, female and shall not be considered to be in their host’s category unless they themselves fit into same.

Junior players (8-14) are not permitted as guests unless they are in the immediate family (within a three generation span) of a member and have obtained prior approval from the Green Committee Chairman.

GUEST FEES

Tuesday- Sunday and Holidays

GUESTS ON FRIDAY

Guests will be limited to one per member on the following Fridays only: The Friday of Memorial Day, July 4th and Labor Day weekends. All other Fridays, a member may have three guests

GUESTS ON SATURDAY, SUNDAY AND HOLIDAYS

Guests are limited to one per member and may not tee off before 11:45 AM unless prior permission is obtained from the Green Committee Chair.

RULES FOR JUNIORS

If children are members, the rules for their applicable group apply. Children who are not members cannot be on the course unless they are old enough to qualify as guests of their parents and are approved for play. Children may be allowed as spectators only during the Club Championship.

Children under the age of eight (8) are not permitted on any of the golf facilities, unless they are taking lessons from a Pro, and must leave the facilities at the conclusion of the lesson.

Children must adhere to the same dress code as adults.

GOLF COURSE - 4

CHILDREN OF MEMBERS WHO DO NOT ELECT A MEMBERSHIP CATEGORY

They are not permitted on any of the golf facilities, unless taking a lesson from a Pro, and are accompanied by a parent during the lesson. They must leave the facilities at the conclusion of the lesson. They may, however, but only as guests of members, use the swimming pool and tennis courts within the rules prescribed for those areas.

ATTIRE

Members and guests will not be permitted on the Golf Course improperly dressed. The practice tee, practice green, and chipping area are considered part of the golf course. The dress code is as follows:

MEN:

a) Shirts with collars, turtlenecks and mock turtlenecks tucked into their pants.

b) Full length pants, “plus fours” with knee socks or Bermuda shorts (to the knee) only.

c) Proper golf footwear. No metal spikes. No “street shoes”.

d) Caps and visors must be worn with bills facing forward

WOMEN:

a) Golf style shirts

b) Pants, skirts, or golf shorts

c) No metal spikes

Neither Tennis clothing nor “torn” clothing is proper attire and will preclude play on the golf course.

CADDIES

Every group must take a caddy when there is a caddy available until 2:00 PM. Caddies are mandatory until 3:00 PM on Fridays, Saturdays, Sundays and Holidays from Memorial Day weekend through Labor Day.

GOLF CARTS

You must be 15 years old to drive a golf cart. Carts must be in by the posted time every night, which will vary with the seasons. The time will be posted on the 1st Tee. Caddies have been instructed not to ride on the back of golf carts at any time.

TOURNAMENT PROCEDURES

A sign-up sheet will be posted in the Men’s Locker Room for all tournaments. If you wish to enter a tournament, PLEASE TAKE IT UPON YOURSELF TO DO SO PERSONALLY. If you wish to withdraw AFTER you have signed up, also DO SO PERSONALLY.

ALL CALLS OR EMAILS MUST BE DIRECTED TO THE SPORTS & HANDICAP CHAIRMAN OR THE STARTER/CADDIE MASTER.

WEEKEND STARTING TIMES

Time cards are available in the locker room. Time cards should be completed and put in the time card box prior to Sunday at 3 PM the week before. Starting time requests can also be made on our web site. If you forget to put in a time card, email or call the Starter or Sports & Handicap Chairman. The starting times are done on Sunday night or Monday morning and will be posted on the web site on Thursday prior to the weekend. If you do not get your request in prior to the completion of the weekend starting times, you will have to contact the Starter and he will assign you a tee time based on availability.

LIGHTNING DETECTION SYSTEM

We are equipped with the state-of-the-art detection system. When it goes off (long solid tones) you must leave the golf course, driving range, and putting green immediately and return to the Clubhouse. The golf staff is NOTrequired to inform you of this responsibility as this will only imperil more people in the face of impending violent weather conditions. Once in the Clubhouse you will be informed after the system has signaled that it is clear to continue play.

CLUB ENTRANCE

The club entrance road is not considered out-of-bounds. Please exercise caution when playing a shot near, or across the road, as well as when driving in or out of the Club.

1. MONDAYS: All facilities, including but not limited to, Grill rooms and Dining room, Locker rooms, Golf Course, Tennis Courts and Swimming Pool will be closed, excepting Mondays which fall on a Holiday, in which case such facilities will be closed on Tuesday. Any changes will be posted on the monthly calendar.

The Fitness Center will be open all year:

Monday: 5:00 AM - 5:00 PM

Tuesday-Sunday: 5:00 AM - 8:00 PM

2. DINING SERVICE:

Breakfast: served in the Grill rooms (when lunch is served) from 7:00 AM to 10:00 AM. (Or otherwise determined by General Manager)

Lunch: served TUESDAY TO SUNDAY (No Tuesdays in Off-Season)

11:00 AM to 2:30 PM Midweek

11:00 AM to 3:00 PM Saturday, Sunday & Holidays

Dinner: service will be posted in monthly written calendar and on FMCC website.

FOOD AND BEVERAGE SERVICE IS FOR ON PREMISES CONSUMPTION ONLY

There is to be no food or beverage brought into the Locker Rooms (except for water) at any time.

3. RESERVATIONS:

Members are "without standing" unless a dinner reservation has been made.

4. CANCELLATION POLICY:

Cancellation fees for any Club activity will be charged in accord with Club policy in effect from time to time.

5. ATTIRE: A. DRESS CODE:

For all Club functions, the required dress code will be posted on the monthly Club calendar. Special invitations and flyers mailed to the membership will also indicate proper dress code for special functions Members are responsible for advising their guests of proper dress for each event. Management has been instructed not to serve members, their children or their guests if they are inappropriately dressed.

CHILDREN (EXCEPT THOSE UNDER AGE 6) MUST ADHERE TO THE SAME DRESS CODE AS ADULTS

B. GENERAL DRESS CODE RULES:

1. No “cut-off” shorts or “short-shorts”.

2. No sports sweatshirts, sweatpants, athletic uniforms or “Hoodies”.

3. No “Bare Midriff” shirts or blouses.

4. No hats for men or boys anywhere in the Clubhouse.

5. No sweaty clothing to be worn in dining rooms. Please change before sitting down in dining facilities.

6. Femalesshould not have blouses, other tops, shorts, skirts or pants that expose their bras or other undergarments.

7. Men and boys must have their shirts (including Golf shirts) tucked in except as otherwise permitted (see below)

C. DEFINITIONS:

1. CASUAL (C) (i.e. Breakfast/Lunch/Regular Sunday Dinners):

Slacks and appropriate collared shirt or sweater. Appropriate jeans permitted as well as Bermuda length shorts.

Men and boys must have their shirts tucked in and not worn outside shorts or jeans (except Sunday Casual dinner where untucked collared shirts are permitted). T-shirts & Sports Sweatshirts are NOT permitted; shoes must be closed-toe, except at the Pool. Flip-flops, thongs and slippers are not permitted in the Clubhouse.

2. CASUAL ELEGANCE (CE): Slacks and an appropriate shirt or sweater required. Dark jeans are permitted for men & women. Men can wear their shirt untucked if wearing a collared, buttondown Oxford-style dress shirt

3. EXTREME CASUAL (XC): Collared shirts are not required. Shirts may be untucked.

4. SWIMMING & FITNESS CENTERATTIRE is never permitted in the Clubhouse, other than in locker room (street lengthcover-up is required through-out the Clubhouse).

Proper gym attire is permitted only in the Fitness Center or in the locker rooms and NO OTHER AREA IN THE CLUBHOUSE. Swimming attire is permitted only at the Pool area or in the locker rooms and NO OTHER AREA IN THE CLUBHOUSE.

CARD PLAYING:

The charges for playing cards or games of any kind (other than golf) in the Clubhouse or on the Club grounds shall be regulated by the House Committee. It shall be in its power to limit or prohibit the playing of any game, which may seem inappropriate or not inthe best interests of the Club. Card playing is permitted only in the Card Rooms, the part of the Pool area designated for that purpose, and any other pre-designated clubhouse area.

SEASONAL GUEST RULES

May 1st – September 30th

1) Any individual guest is limited in allCard Rooms to (one) time per week and a maximum of (twelve) times during this season; a $15 guest fee will apply.

a. The limit is irrespective of the number of members who invite such guest.

b. This limit is in addition to a Club Member Guest Tournament and Duplicate Bridge play.

c. If a member takes a guest golfing, that guest can play cards and no guest fee will be charged, nor does it count towards the guest’s limit per month.

October 1st – April 30st

1) During this season, there is no limit to how many times a guest may play; a $15 guest fee will apply.

CARD ROOM GUEST RULES

1) ALL MEMBERS MUST SIGN IN GUESTS UPON ARRIVAL.

2) All card guests must be accompanied by a member in good standing.

3) Members must play at the same table as their guests.

4) The hosting Member is responsible for the conduct and expenses of their guest(s).

5) Lessons are not permitted in the card rooms

7. CLASSES OF MEMBERSHIP, PRIVILEGES & RESPONSIBILITIES

A. MEMBERSHIPS FOR CHILDREN are available from the age of 8 to 36 age categories. Memberships for children from the age 25 to 36 are subject to approval by the Admissions Committee. Children over the age of 36 are required to go through the full admissions process. See 7H for Conversion features.

B. CHILDREN OF REGULAR MEMBERS are entitled to become Regular or Tennis members in any of the age categories as noted below. Children of House or Tennis members can only be Tennis members in any of the age categories.

C GRANDCHILDREN – Membership for grandchildren is available with the following conditions: The grandchild’s parents have been resigned from the club for at least two years or they have never been a member.

The Grandparent is a golf member. Grandchildren may play golf, use the pool, tennis courts, and fitness center accompanied by their grandparent. Grandchildren 15-18 may use the facilities unaccompanied. Children in this category may not bring guests.

D CHILDREN OF SIGNIFICANT OTHERS are not entitled to membership in any children’s category, nor are they entitled to any privileges of membership.

E. CHILDREN BETWEEN NEWBORN AND 7, are permitted in the Clubhouse only to eat and must be accompanied and appropriately supervised by a member, member’s spouse or significant other. They must eat in the Family Grill unless otherwise directed by management. The youngest age child will dictate where the family must dine. No carriages are permitted in the Clubhouse at any time. Strollers are permitted in the Clubhouse.

Members and guests are required to use the front pathway access to pool area with their infants. They may not pass through the men’s or women’s locker rooms.

Infants should have their diapers changed in the either the Handicapped Bathroom between the Golf Pro-shop

and the Grill room front entrance area or the pool men’s and ladies locker rooms.

In addition, children must dress in the dressing rooms at the pool. They are only permitted in the Locker Rooms on Sundays after 4:00 PM and must be accompanied and appropriately supervised by a member, member’s spouse or significant other.

F JUNIOR MEMBERS (8-14), may use sports facilities based on their membership category and are permitted in grill rooms and Locker Rooms ONLY and must be accompanied by a member, member’s spouse or significant other.

G JUNIOR MEMBERS (15-17), may use sport facilities based on their membership category, are permitted in the locker rooms and may dine in the Grill Rooms unescorted.

ASSOCIATE MEMBERS (18-35), may use sports facilities based on their membership category and have guests that are over the age of 18 during the week.

H. CONVERSION MEMBERS (36), the child of a member who is currently an active Regular or Tennis member and has attained the age of 36 on or prior to January 1 of a calendar year may convert to a full Regular or Tennis membership. The increase to full dues and assessments upon conversion will be phased in over 5 years with increments of 20% per year. In addition, a conversion fee which is based on the child’s years of membership will also be billed over 5 years in increments of 20%. Children of House and Tennis members, who wish to convert to Regular full membership, must go through the full admissions process, including paying the applicable initiation fee, to be determined by the Executive Committee.

I. HONORARY & OVER 80 MEMBERSHIPS

Any member who attains the age of 80 on or prior to January 1 of the calendar year and has been a Regular (i.e. golf) Member for 25 years will, for that year and thereafter, be entitled to a reduction in dues. Any

Member who attains the age of 90 on or prior to January 1 of the calendar year and has been a Regular (i.e. golf) Member for 25 years will, for that year and thereafter, be entitled to be an Honorary Member

8. GUESTS:

Guests may not use Club facilities unless accompanied by a member, member’s spouse or significant other. Guests are not permitted to sign for food, beverages or any other services. Members are responsible for their guests adhering to all Club rules. Children, who are not members of the Club, are considered guests and are subject to the same regulations as listed above.

MEMBERS SPONSORING A PROSPECTIVE MEMBER:

Any member sponsoring a prospective member:

1. Must familiarize themselves and abide by the Responsibilities of Sponsors, available from the club office or Admissions Chair

2. Must be a Regular Member in good standing

3. Have been a member for at least three full seasons.

The above rule applies to Sponsors and Co-Sponsors.

RESIGNED MEMBERS:

Resigned members who left the club in good standing after 20 years of membership and who are not statutory residents of the State of New York may visit the club as a guest during any two calendar weeks per year. The two calendar weeks do not have to be consecutive, but all such visits must take place only during the two calendar weeks selected. Such resigned members may utilize the facilities and will be charged all applicable guest and other fees. They may bring only immediate family as their guest.

11. SMOKING:

The entire Clubhouse and pool area are "smoke free" areas.

12. CELLULAR PHONES: Audible use of the telephone throughout the Clubhouse is NOT permitted.

13. NO TIPPING:

The club maintains a “No Tipping Policy”.

14. EMPLOYEES:

Members are not allowed to send employees on errands outside the grounds. This includes parking attendants. All complaints regarding employees, their services or behavior, must be handled through the General Manager. Members are not to engage in discussions of such matters with employees nor are they allowed to engage their services at any time.

15. SOLICITATIONS:

No solicitation, whether by telephone, electronic transmissions, placard posting on club property or in person, for philanthropic or other purposes, shall be permitted by a member or employee, except by express authority of the Board of Governors. This authority will be specifically indicated to the membership in each instance.

16. PETS: Are not permitted on the Club grounds.

17. AUTOS: Keys must be left in all cars for parking purposes. All cars must be turned over to a Valet Attendant at the Clubhouse entrance. Such parking is done for the convenience of our members and at their own risk. Chauffeurs will be told by the Valet staff where to take their cars. Autos cannot remain at the front entrance or in any part of the circular drive leading to or from the entrance porch for any reason. All "TRAFFIC" signs at our entrance and driveways MUST be observed.

18. MEMBERS & GUESTS:

Are expressly forbidden to use the paved road leading to and from the rear entrance on Community Drive.

19. CADDIES AND CHAUFFEURS: Are not permitted to enter the Clubhouse.

20. ALL CHARGES:

Must be paid on or before the 20th day of the month following the month in which said charges are incurred Interest and/or late fees will be accrued and assessed after the 30th day of the month, if charges remain unpaid.

CLAIM FOR ADJUSTMENTSMUST BEMADE WITHIN 30 DAYS. Members questioning charges should pay their bill (timely) and await credit on following statement.

21. COMPLAINTS:

All complaints shall be directed to the General Manager and not to employees. The General Manager and his executive staff are responsible for notifying a member of a breach of Club rules Board members in attendance should assist management if necessary The Rules & Welfare Committee will review all infractions and the committee will recommend a course of action. The Board of Governors will determine the final resolution of such infractions.

22.

MODIFICATIONS OF HOUSE RULES:

These rules may be changed or modified from time to time by the House Committee. In special circumstances the House Committee also has the power to suspend or amend them in the Club's best interests.

FMCC FITNESS CENTER RULES & REGULATIONS

Hours of Operation:

Monday: 5:00 AM - 5:00 PM

Tuesday-Sunday: 5:00 AM - 8:00 PM

No one will be permitted into the Fitness Center before or after scheduled hours of operation.

RULES AND REGULATIONS

1. Use of the Fitness Center is limited to Members of Fresh Meadow Country Club (“FMCC”), including Junior Members who are at least 15 years old, spouses and significant others. Persons under 15 years of age are not permitted at any time whether accompanied by an adult or not. A parent or legal guardian of a junior member otherwise qualified to use the Fitness Center acknowledges the contents of these rules and regulations and is bound to convey them to the junior member. This also serves to acknowledge that such parent or guardian is legally responsible for the conduct of the Junior Member and assumes the indemnity provisions of this agreement on behalf of the Junior Member.

2. Guests are not permitted to use the Fitness Center.

3. Fitness Center users must SIGN IN each time they use the facility.

4. Fitness Center users are exercising at their own risk and acknowledge that exercise and use of the Fitness Center carry certain health and bodily injury risks. Users of the Fitness Center expressly assume these risks by their use of the facility. FMCC is not responsible for any injuries resulting from performing any exercise in the Fitness Center, including use of the equipment. All persons agree, by use of the Fitness Center facilities, to pay or reimburse FMCC for any and all charges arising out of or resulting from breakages, shortages or damages to equipment caused by their use other than ordinary wear and tear. To the fullest extent permitted by law, all Fitness Center users also agree to indemnify and hold FMCC, its officers, board of governors, and employees harmless from any and all claims of injury, damage or claims of any other nature whatsoever, whether to person, property or both, that may arise or result from use of the Fitness Center and its equipment.

5. FITNESS CENTER USERS SHOULD CONSULT WITH THEIR PHYSICIANS BEFORE BEGINNING AN EXERCISE PROGRAM AT THE FITNESS CENTER. FURTHER, A PHYSICIAN SHOULD BE CONSULTED IN THE EVENT ANY DISCOMFORT OR PAIN IS EXPERIENCED OR IF THE USER OF THE FITNESS CENTER HAS HAD ANY CHANGE IN HIS OR HER HEALTH STATUS

6. All first-time users should have a fitness evaluation by their doctor and an orientation as to the proper use of equipment under the guidance of an approved Fitness Center trainer. FMCC does not warrant or imply that any employee or independent contractor hired by FMCC is qualified to provide medical advice or consultation to any user of the Fitness Center.

7. Personal Private Trainers may be used; however, the trainer must be approved by FMCC’s Fitness Committee prior to using the Fitness Center. Such approval is not an indication that the Committee endorses or makes any warranty as to the adequacy, professionalism or background of the trainer. In addition, the trainer must provide FMCC a certificate of insurance evidencing professional liability coverage and general liability coverage at a minimum of $1,000,000 each occurrence, $2,000,000 in the aggregate, and naming FMCC as an additional insured.

8. FMCC will provide a list of approved personal trainers. These trainers are independent contractors of the Member (his/her spouse, significant other or Junior Member) and shall be paid directly by said Member, spouse, significant other or Junior Member. FMCC’s approval process is limited to collecting documentation of certification and insurance requirements and avoiding any interference in the comfortable use of the Fitness Center by Members, spouses, significant others and Junior Members due to excessive personal trainer activity. FMCC does not supervise the conduct or activities of personal trainers and is not responsible for any injuries sustained while exercising under the direction of personal trainers or otherwise.

9. Members, spouses and significant others have priority over Junior Members when using the Fitness Center.

10. All free weights and other exercise equipment must be returned to their proper place after use.

11. Fitness Center users must be properly attired in fitness clothes and sneakers. Cut-offs, bathing suits, sandals, street clothes and jeans may not be worn in the Fitness Center. No clothing with stones or beading may be worn in the Fitness Center. Golf shoes are strictly prohibited

12. a) Towels are available for everyone exercising. Towels must be placed on equipment while in use to absorb perspiration. Machines must be wiped with disinfectant wipes after use. Towels must be place in towel bin prior to leaving.

b) Weights, machine attachments, fitness accessories, etc. MUST be returned to their proper place (weight rack, storage closet, etc.) after use.

13. Maximum time on any equipment is thirty (30) minutes when others are waiting.

14. Refrain from wearing colognes or perfumes, as these become stronger during workouts and can be offensive to other Members.

15. Smoking is not permitted in any part of the Fitness Center.

16. No food or beverages are permitted in the Fitness Center, except for water or sports drinks, which must be in a spill-proof container. Please properly dispose of all containers.

17. Pets, except for service animals, are not permitted in the Fitness Center.

18. Audible use of cellular telephones is prohibited in the Fitness Center.

19. All Fitness Center users are required to adhere to all the Rules and Regulations at all times. If Members fail to comply with these Rules and Regulations, they will be referred to the Rules & Welfare Committee. The action may result in loss of privileges of both Member and their Junior Members.

FMCC SWIMMING POOL RULES & REGULATIONS

GENERAL POLICY:

A. The swimming pool will be open from the Friday of Memorial Day Weekend until the Monday of Labor Day Weekend. Specific days and hours of operation will be announced

B. The Club is not responsible for any accident occurring in or around the pool area or elsewhere on the Club grounds or in the Clubhouse.

C. Food and beverage services will be available at Café 255 (see calendar for times).

D. Food may not be taken outside of the dining area of the pool.

D. Smoking is not permitted in the pool area, which includes ecigarettes (electronic cigarettes).

E. Audible cell phone conversation is not permitted in the swimming pool area. However, the use of cell phones is permissible outside of the pool complex entrance.

POLICY FOR CHILDREN:

1. Children under age 3 must wear swim-diapers and must be accompanied at the pool bya parent or grandparent. Theymay not use the main pool.

2. Children age 3 and older who are not yettoilet-trainedmaynot use the main pool but may use the kiddie pool if wearing swim diapers.

3 Children through age 13, under the constant supervision of one of their own member parents or grandparents, mayusethe pool on all days that the pool is open and a lifeguard is on duty.

4. Children of all ages must wear appropriateswimmingapparel.

5. Swim-diapers are prohibited in the main pool.

* NOTE: Mother's helpers, nurses, etc. or other members are not considered responsible for your children orgrandchildrenatthe Club; and as such, children may not be left in their sole care.

REGULATIONS:

1. All bathers must take a soap shower before entering the pool. No person with a fever, cold, inflamed eyes, skin disease, or wearing a bandage may use the pool.

2. Members must accompanytheir guestswhiletheirguestsareat the pool.

3. All members and guests visiting the pool area MUST SIGN THEIR NAMES IN THE REGISTER BOOK AT THE POOL ENTRANCE, as required by the New York State Board of Health.

4. Up to four guests (including children age 3 and older) may be brought to the pool bya hosting member and his or her spouse on any one day. Permission for additional guests, if requested in advance, may be given by the Club Manager or by the Pool Committee Chairman after consulting with the Club Manager (or his designee).

5 Children must dress in the dressing rooms at the pool. They are not permitted in the Locker Rooms, Golf or Tennis areas, except on Sundays after 4:00 PM.

6. Bathers may dine in the pool dining area in bathing attire but must wear suitable cover-ups and footwear at all times.

7. Persons in bathing attire are not permitted in front of the Clubhouse. They must remain in the immediate vicinity of the pool area. Suitable cover-ups must be worn when arriving at the Club and departing from the pool area, and on the outdoor path in front of the Clubhouse

Members and guests are required to use the front pathway access to pool area with their infants. They may not pass through the men’s or women’s locker rooms.

8 Running, jumping, playing games, pushing or horseplay, in or around the pool is prohibited.

9 All towels, debris, etc. must be placed in receptacles available throughout the pool area for this purpose.

10 Bathing suits and apparel left in the locker rooms and pool dressing rooms should be clearly marked with the owner’s name.

11. Diapering and changing children must be done onlyin the pool dressing rooms or at a designated changing station at the kiddie pool area, not at the main pool. Changing tables have been provided in dressing rooms, and a diaper receptacle (trash receptacle) must be used.

GENERAL RULES

1. The names of all players and their starting timesMUSTberegistered in the Pro Shop before starting play.

2. All players and spectators shall conduct themselves in such a manner so as not to interfere with the playing enjoyment of others.

3. All players MUST wear appropriate tennis attire. No bathing suits, oversized t-shirts, non-tennis shorts, jeans or basketball sneakers will be permitted Only proper tennis attire and sneakers are to be worn on the Courts.

4. No children under 6 years of age are permitted in Tennis area. Children from 6 to 10 years of age must be under parental supervision in the Tennis area.

5. Play will be limited to 1/2 hour for singles and 1 hour for doubles when others are waiting for Court time.

6. When necessary, all Courts will be closed formaintenancefrom1:00 P.M. to 2:00 P.M. When the Courts have been declared unplayable ABSOLUTELY NO PLAY shall be permitted.

7. A member of the Tennis committee will act as an officer of the dayin the absence of the Tennis Chairman.

TENNIS -1

FMCC TENNIS COURT RULES AND REGULATIONS

8. The official clock will be the clock on the outside of the Pro Shop.

9. In doubles sign up, only 2 members are necessary to be present. However, should the full foursomes not show up within10minutesof starting, Court shall revert to 1/2 hours singles play.

10. Players may not sign up or have their names entered for any Court time while actively playing on the Court.

11. Children of members who have not elected to be in a membership category are not considered to be a qualified member and are considered guests. They must abide by guest rules and pay applicable guest fees.

12. On Saturdays and Sundays between 9:00 A.M. and 12:00 noon, Courts will be reserved for "Category A". If no "Category A" players are waiting, then "Category B" will be next eligible. However, any players - other than "Category A" commencing play during these hours will be limited to 1/2 hour regardless of the number of players, if "Category A" players are waiting.

13. On days when Men's or Women's Interclub matches are played, all Courts are reserved during playing period for the exclusive use of such matches.

TOURNAMENTS

1. Players who sign up for tournaments aftertheposteddeadlinewillbe considered for play at the discretion of the Tournament Chairman, who will be appointed by the Committee.

2. Participants for all tournaments are to be 18 years or older, except for the Parent/Child tournament.

3. Only those members who have elected to be in a membership category are eligible to play in tournaments.

4 At the discretion of the Tennis Chairman, playersofbothgenderswill be eligible for participation in the annual Club Championship.

LESSONS

Court # 1 is reserved for the use of the teaching Professional unless otherwise determined by the Tennis Chairman.

JUNIOR RULES

1. Juniors under 8 may, at the discretion of the Pro, use only Court # 2, and then only with proper parental supervision.

2. Juniors 8 to 14 can sign up for a Court time provided no "CategoryA, B, C-1 or C-2" players are waiting for Court time.

3. Juniors 15 to 22 can sign up for a Court as long as "Category A, B or C-1" players are not waiting for Court time.

GUESTS

1 Members MUST play with their guests.

2. The host of any guest is responsible for the proper conduct of his guest, and MUST sign a guest chit in the Pro Shop, or at Clubhouse reception, in order for the guest to play Tennis. This chit will supersede the chit, if any, signed at the Pool upon entering.

3. A guest, regardless of host member, may not play more than twice in any month or 4 times per year.

4. Guests taking lessons must still be signed in as guests if they continue to play after their lesson is over.

5. Children of members who are themselves NOT Junior or Associate members are considered guests and MUSTabidebyguestrulesand pay applicable guest fees. We urge you to make your children Tennis members. Information concerning theyearlyfeesisavailable in the Club office.

6. Guests will be limited on Weekends and Holidays to the hours after 1:00 P.M. Special permission for Weekend or Holiday guests must be secured only from the Chairman of the Tennis Committee.
