EDITOR’S NOTE How are we doing? Seriously. Give it to me straight, are we covering the things that interest you and covering it well? One of the biggest challenges we face is choosing the content to include in our pages because without direct feedback from the readers, it’s a lot like shooting in the dark. The best that I can do to make sure we’re writing about relevant topics is to keep my ear to the ground on local current events, do a little ‘eenie-meenie-mynie-moe,’ and pick what I consider to be the top 2 or 3 conversations and run with it. And, to be honest, it always feels like a bit of a gamble. Luckily, you guys seem to like my taste – and I’m only assuming that because the occasional feedback we get is always positive. However, I wish I heard from you more often. The Flyer is a collaborative effort, and without your voices in the mix, we’re only going to write about the things we think are important for you to know. This magazine’s goal is to act as much a pure reflection of the Central Valley’s culture as is possible. But we can’t achieve that without you. And you don’t always have to talk to me, either. The writers all have their emails listed above their articles, let them know what you thought about their piece. Each of them comes to the table with something they’re passionate about – social issues, music,

Whether you’ve been reading the Flyer a while or just picked it up for the first time, your opinion is valuable – even if it’s just a “Hey, good stuff, keep it up,” it helps us keep things interest-
ing. Occasionally, I’ve had a pitch or two sent to my inbox to cover a subject that’s very specific. Sometimes, we can take that on ourselves, but not always – we’re a real small team, and most of our writers contribute out of their love for their chosen topic. In those instances, I always suggest to the reader to consider writing the article themselves, with some help from me, of course. That’s another thing I want to bring up. This magazine can’t just be made up of a few select voices, it needs perspectives that are as diverse as the whole Valley. In the Nov. election, the following measures passed. Look for these cities to start licensing cannabis businesses. KINGS COUNTY Hanford - Measure C would tax cannabis cultivation at $1/square foot for nurseries, $2 for natural lighting only, $4 for combination natural and artificial lighting, and $7 for artificial lighting only starting 1/1/19. The taxes would rise from $2-$10 per square foot starting on 7/1/21. Labs would be taxed at 1%-2.5% over the same time period, distribution at 2-3%, retail sales (not currently allowed) at 4-6%, and other types of cannabis businesses at 2.54%. PASSED WITH 72% OF THE VOTE. MERCED COUNTY Atwater Measure A - Would allow the city to establish 15% tax on marijuana businesses. Opposed by CA Cannabis Industry Assoc. PASSED (Also in June 2018):

short history: on November 8, 2016, Proposition 64 (The Control, Regulate and Tax Adult Use of Marijuana Act) was passed by a majority of California’s voters. It immediately became effective. However, what were its effects? Retail sales of recreational cannabis began in January 2018 – in theory. Although it allows for the recreational use, possession, and personal growth of marijuana, and the commercial growth, testing, manufacture, distribution, and retail sales – Prop 64 stipulates that all those commercial endeavors shall be under the control of local counties and municipalities. That distribution of power has led to a crazy quilt of permissions and prohibitions across the state, and the Central Valley is no exception. Let’s start right here in Fresno.
ational use. Several towns in Fresno County fell right in line with that paradigm, including Kingsburg, Sanger, Fowler, Orange Cove, Kerman and Huron. Reedley and Selma took that restrictiveness a step further, requiring permits for indoor personal grows. Only slightly less restrictive are the ordinances in Clovis, which additionally allows medical testing. Firebaugh, Parlier, and Mendota up the ante by allowing everything except outdoor personal grows and any form of retail sales (medical or recreational). At the top of the heap, among Fresno County municipalities, in terms of pot permissiveness, is Coalinga, which allows everything except outdoor home growing. It should also be noted that Fresno City just stepped away from the pack of Fresno County policy clones on December 13, 2018, when it voted, 5 to 2, to allow growing, manufacturing, testing, and retail sales of medical marijuana. Stipulations of the ordinance include limiting retail sale permits to one per council district for the first year and two per district in the second year, with consideration of rec-

reational sales at the end of the first year. Details have yet to be worked out. Walls do not have to be built of concrete and steel. They say the two things you can’t avoid are death and taxes – and death is not available as a legal sanction to a now legal process. So, taxes. For those cities listed above that do allow some form of commercial marijuana enterprise, the tax is uniformly $25 per square foot for the first 3,000 square feet and $10 per square foot for any additional space. For Coalinga, the only town allowing retail recreational sales, there is a 10% tax on gross sales. The official narrative, as provided within the text of Prop 64, is that these tax dollars will “cover the cost of administering the new law and will provide funds to: invest in public health programs that educate youth to prevent and treat serious substance abuse; train local law enforcement to enforce the new law with a focus on DUI enforcement; invest in communities to reduce the illicit market and create job opportunities; and provide for environmental cleanup and restoration of public lands damaged by illegal marijuana cultivation.” So, unless you live close to Coalinga, or have a feverish Fresno County allegiance, you might consider going across the border to a neighboring county. What additional opportunity might that provide you?

Merced County - Measure Y would authorize Merced to tax commercial marijuana businesses at $25 per square foot of cultivation space or 10 percent of gross receipts, whichever is greater, until the tax is ended by voters. PASSED (77%23%.) STANISLAUS COUNTY Ceres Measure W would authorize the levy of a tax on marijuana businesses at the rate of up to 15 percent of gross receipts. Opposed by CA Cannabis Industry Assoc. PASSED Oakdale Measure C would also authorize the levy of a tax on marijuana businesses at the rate of up to 15 percent of gross receipts. Opposed by CA Cannabis Industry Assoc. PASSED Patterson Measure Y would authorize a business license tax at a rate of up to fifteen percent (15%) of gross receipts on cannabis businesses and dispensaries, to help fund general municipal services. Opposed by CA Cannabis Industry Assoc. PASSED Riverbank Measure B would impose a business license tax at a rate of up to ten percent (10%) of gross receipts on cannabis businesses and dispensaries. Opposed by CA Cannabis Industry Assoc. PASSED TULARE COUNTY Lindsay “Shall an ordinance be adopted authorizing a commercial cannabis business tax in the City of Lindsay on commercial cannabis businesses up to $25 per square foot (annually adjusted by CPI) or up to 10% of gross receipts, as set by City Council, to

maintain essential public safety and general City services including, but not limited to, police, drug addiction and gang prevention, park maintenance, street maintenance for Lindsay residents, generating undetermined revenue, potentially up to $500,000 to $3.5 million until repealed? PASSED In Kern county, all measures failed except in the city of Arvin. KERN COUNTY Two measures are on the ballot in Kern; in addition, the cities of Arvin and Bakersfield have their own measures. Competing groups have divided support among local activists. Some are waiting for a third measure that is expected to be on the ballot in the next election. Measure J, sponsored by Jeff Jarvis and Heather Epps, would replace the county’s current ban on unincorporated area dispensaries with state regulations and guidelines on the industry. Commercial adult-use recreational sales and cultivation would still be banned, but medicinal sales and cultivation, testing, distribution and other activities would be allowed. Regulation would be done through ministerial land-use permits and levy a 7.5 percent business tax on operations. Opposed by CA Cannabis Industry Assoc. FAILED Measure K was brought forth by attorney Ben Eilenberg on behalf of the Committee for Safer Neighborhoods and Schools, with the goal to regulate both commercial adult use and medical. Commercial businesses (except retail and testing), such as manufacturing, cultivation and distribution would be required to operate in one of two zones adjacent to the I-5 corridor in western Kern County. It would also cap the number of retail dispensaries to 35, require regulation via ministerial approval of land-use permits, with exception of retail outlets, which would need a conditionaluse permit, and provides a mechanism for fees and taxes on cannabis activities, including a 5 percent tax on gross retail receipts. Endorsed by CCIA, but some locals oppose. FAILED Arvin Cannabis Tax Measure M would establish a tax of up to 6% of gross revenues on commercial cannabis business operations, excepting cultivation, and a tax of up to $6 per square foot of space used for commercial cannabis cultivation, as adjusted annually by CPI. PASSED Bakersfield Measure O After 32,790 signatures were submitted to the city by Kern Citizens for Patient Rights, the November ballot will read, “Shall the measure amending the Bakersfield Municipal Code to allow medical marijuana store front dispensaries, cultivation sites, manufacturers, distributors, and delivery operations with a valid permit, and which will impose a 7.5 percent excise tax that will last until terminated by voters, be adopted?” Endorsed by Ca NORML and CA Cannabis Industry Assoc. Well, don’t heed Horace Greeley. Going west will put you in Madera County, where every town in the county (Madera and Chowchilla) has passed the most restrictive rules allowed under Prop 64 (the same as Reedley and Selma). Unincorporated Madera County’s rules are the same as Fresno County’s (no requirement for permits for home grows). To the south/southwest you have Kings County, which is as intolerant as Selma, Reedley, Madera, and Chowchilla. Most of its towns (Avenal, Corcoran, Lemoore) are in line with the Fresno/Madera County paradigm: no commercial enterprise, no permit required for home grows. Hanford stands out as the most lenient municipality in Kings County, allowing everything except retail sales (medical or recreational). Turning to the southeast, you find Tulare County, where almost every municipality is an anomaly. Exeter and Dinuba follow the Fresno/Madera County protocol (nothing allowed except indoor home grows, but without a permit); Lindsay and Porterville allow outdoor as well as indoor home grows but nothing else; Tulare allows medical retail sales but no other commercial enterprise; unincorporated Tulare County allows commercial medical growing and distribution, but no sales, testing, or outdoor personal grows; and Farmersville requires a permit for indoor personal grows (no outdoor grows allowed) but also allows commercial growing, manufacturing, and testing of recreational and medical cannabis (no sales or distribution). Then there is Woodlake. By local referendum in 2017, Woodlake legalized all forms of marijuana activity permis-
sible under Prop 64. The tax structure is essentially the same as those areas where partial legalization has been enacted: $25 per square foot or 10% of gross revenue, whichever is greater. If you would rather travel northwest, to Merced County, you have a similar array of options. The unincorporated county is on the indoor-home-grow-with-no-permit plan (nothing else allowed), along with Gustine and Dos Palos. Los Banos requires a permit for indoor home grows (nothing else allowed). Atwater and Livingston allow everything except outdoor personal grows and sales of any kind. Here the king of commerce is Merced city itself, allowing all commercial endeavors but prohibiting outdoor personal grows. So there you have it. If you are hoping to buy recreational cannabis products from a legal retail outlet, without going over the mountains and through the woods (or over 100 miles), you have three options: Coalinga, Woodlake, Merced.
Manufacture, Distribution, and Retail Sales. Caveat Civis: If you find a grayed-out block on the grid above that represents something you would like to do, in the locale where you reside, advocate for a change in the regulations where you live. Hopefully you voted in the 2016 General Election that made Prop 64 law. It was and is a law intended to provide legal access to and use of cannabis for all citizens of California, over 21 years of age. If your town or county has thrown a roadblock in that access route by exercising their mandated right to control cannabis, contact your city council member and/or county supervisor to let your voice be heard on the matter. on skin side. Cook breasts 1-2 minutes skinside up. Turn breasts back to skin-side down 1-2 minutes to caramelize rub. Reserve approximately 2 tablespoons duck fat for sauce. Heat oven to 350 F. Place duck breasts skin-side up on rimmed baking sheet; bake 5-6 minutes, or until internal temperature reaches 155 F. Let breasts rest 4-5 minutes before slicing. Temperature will rise during resting period to reach 165 F. To make Cherry and Red Wine Pan Sauce: Place saute pan with reserved duck fat over medium heat. Add shallots and cook until softened. Add wine to pan to deglaze. Stir in balsamic vinegar, sugar, cherries and thyme sprigs; simmer until reduced. Remove thyme sprigs. Add salt and pepper, to taste. Serve sauce over cooked duck breasts. W
hen you think of hot-spots for comedic entertainment, certain cities come to mind - Los Angeles, Chicago, New York, places have long-standing reputations for springing consistent comedic talent for the stand-up stage, film or television. Those meccas, with their established venues, allow for these aspiring funny people to not only hone their talents but to stand in a wellknown spotlight that could launch them to the next level of their career. Venues that have become landmarks in the comedy landscape like The Comedy Store in LA, Second City in the Windy City, and the Caroline’s on Broadway in the Big Apple. Now it’s the Central Valley’s turn as two local comedians, Danny Minch and Dave Apkarian, have thrown Fresno onto the list of comedic destinations. And out of all places to set the stage, it’s not a theater or an auditorium, but the backroom of Di Cicco’s Italian Restaurant in Old Town Clovis. This past December they celebrated their first anniversary of calling the restaurant their home. “When I started doing stand-up comedy in the Central Valley I realized there wasn’t as deep of a scene as I wanted there to be. So, I started putting on my own shows and learned from there, and it has escalated in the last ten years leading to now,” mentions Minch. And then that’s when Apkarian, who’s got a year-and-a-half of comedy under his belt, got on board and started helping Minch with the hosting duties. “With our shows we book everything, we promote everything, they (Di Cicco’s) don’t have to pay the talent, that’s our thing,’’ Apkarian specifies. Di Cicco’s already had music in the area, and the establishment stayed open till 10 or 11 o’clock at night, so it was a good fit for the guys to slide right in. Minch and Apkarian took the Saturday slots to start, then evolved to hosting Tuesdays at another venue, Grogg’s Irish Pub, based on the success of their brainchild, ‘Just the Tips’ where visitors get free entrance but bring enough tip money to donate to the headlining comic to make a small profit. Adding to their growing schedule, they moved the Grogg’s show over to Sundays. And now, they’ve expanded, yet again, to Barmaggedon in Tulare on Wednesdays where local comics sign-up to do open mic by trying out new jokes and bits, using that audience as a test group to assess their material. Minch and Apkarian have grown their roster from two days to six-days-a-week, four of which are the

‘Open Mic’ nights. The weekends, what they call their ‘Slice Of Life Comedy’ nights, are the financial earners, offering paid premium packages like VIP tables, services, and tickets to attend the show. “If you’re a venue out there, and you think comedy will work for your venue, you better have a love for comedy, and you have to push it because if you don’t, it’s not going to happen,” Minch states. The promoting duo are a little unconventional, for example, during ‘Just the Tips’ they start off with a headliner, and then follow with the local comedians. Minch and
Apkarian come up with different themes, and they even include “clean shows” once a month where cussing isn’t allowed. They once held a roast once where Danny was the willing recipient of his fellow comedians’ insults. Whatever they can do to draw in a crowd, they’ll try it at least once. Usually, about 70-80% of their shows are people that are brand new, and they’ve adopted a business strategy to book shows so that every three months they get some of their past patrons back. And it has since grown into an established place for date nights among couples, and some even bring the family along. They’ve brought in some fairly wellknown names that have received good buzz in the comedic and entertainment landscape. Samuel J. Comroe, the comedian with Tourette’s who stole the country’s heart with his top 5 finish on America’s Got Talent this past season, was booked right here in the Valley months before his AGT debut. Insult comic, Alex Hopper, who brought his brand of humor to make fun of the AGT judges this year
has visited frequently. Jen Murphy, who’s been on Last Comic Standing has caused the room to erupt several times. British export, Eric Lampaert, who appeared in the blockbuster “Valerian and the City of a Thousand Planets,” has made this area one of his favorites amongst his American travels. And that’s just to name a few. For up-and-comers that are trying out their stand-up legs, Danny Minch and Dave Apkarian are giving them their first experiences of having the top slot that can help blossom them into a headliner in demand. Because of this kind of exposure among these national touring headliners the scene here has grown quite a reputation amongst the comedy community that the area is on people’s radar for comedy entertainment, and according to Danny and Dave it’s from the cities previously mentioned. “We started hanging out
with our buddies in LA, and they were talking about our shows, and I get people from there and in San Francisco hitting us up saying ‘what a scene you have down there,’ and it’s great” elaborates Minch. And that kind of buzz has generated a good word-of-mouth campaign for Minch and Apkarian to continuously book talent they don’t have to search for, it’s the talent coming to them. “A lot of times it’s not just the comics hitting us up, but the headliners love this room so much that they want their friends to see how much fun it is. Now, we have a Rolodex so full of people that we can’t even keep up with the talent we’re getting,” Minch says with pride. Being around those humorists have

inspired a crop of homegrown talent to show people what they’re made of. Minch and Apkarian have allowed a platform in which these locals are able to develop a name for themselves not just here but up and down the state as well. The number of people they recommend is pretty staggering, such as Heath Reedy, Tosh Donovan Martin, Trevor Richardson, Liam Womack, Ali O’Leary, Dana Turner, DeeDee Carbajal, Karmen Geffken, Greg ‘G’ Williams, Tanya Salzer, Jenn Felix, and the list goes on. Minch and Apkarian’s influence have rubbed off on some comics to pursue the promotional side of things. Andre Covington, AKA Dre, who serves as an on-air personality for The Greg and Dre Morning Show on Q97.1, hosts shows and comedy competitions at Chukchansi Resort & Casino and Frank’s Place as well as performing all around the area. Karmen Geffken has been hosting a slew of comedy showcases and open mics around Fresno at Full Circle Brewing Co., Fresno City Vapor, and at Bitwise Industries. Ali O’Leary has hosted some female comic inspired shows at Strummer’s throughout the year. All of which brought opportunities for local talent to open for some popular comedians that have achieved mainstream success, like when Jim Breuer came to Fulton 55 on December 8th where Ali and Dana Turner warmed up the crowd. Darren Carter, AKA “The Party Starter,” who is from the Central Valley, has been one of the few breakout stars from the area. He’s appeared on The Tonight Show with Jay Leno and in the film “Be Cool” with John Travolta. Known for his impressions, especially his most famous ‘Snoop Dogg’ impression, before the scene established itself here. Carter’s been to just about every big city for comedy across the country, and he still finds himself coming back to perform for his hometown audience thanks to his appreciation for what Minch and Apkarian have accomplished for local talent. Danny Minch and Dave Apkarian are not in this business for the money, but for providing laughs during a time when it’s really needed – and that is all the gratification they need. “Fifty years from now if I’m still living the life I have right now, doing exactly what I’m doing full-time, I can die a happy man,” declares Minch.
