LEGAL VIEAWSMOTORCYCLE RIGHT-OF-WAY VIOLATION WIDOW AND SURVIVOR ADDRESSES THE KILLER OF HER HUSBAND AN OPEN LETTER FROM AMY PICKHOLTZ TO BRENDA MELANCON
Bruce on Bikers’ Rights (November 2009)
I hope on this day, 14 October 2009, that you will spend some time reading my letter, and that the message I am conveying will make a difference, because on this day I will spend some time at the cemetery mourning my husband Jim, and spend some time honoring him by reflecting on all the reasons that I fell in love with him. “It’s not the life that you live, it’s the courage that you bring to it.” --Yogi Bhajan This is the quote I adopted in 2004 when I started to teach yoga. I really never understood why I adopted this particular quote as my own credo, and even put it on my yoga business cards. Now, I truly understand why. It’s been 2 years since your grossly negligent behavior as the driver of the car who violated our right-of-way, and as the Mayor, who although with prior knowledge did nothing about the existing problems at the intersection. We know the result of your negligence. The death of my husband Jim, the permanent disabling injuries to me, and the devastation to our entire family. I will remind you of your immediate response after the crash when asked if you had been in touch with the Pickholtz family, was “No. I don’t wanna know. This is all so devastating to me. The accident was just horrible.” Horrible, yes, but this was not an accident, Ms. Melancon. This was an incident, caused by you, but not solely about you. You reiterated how devastating all this was to you when you took it upon yourself to call The Advocate newspaper in Baton Rouge to use them as your own personal platform in response to the Sorrento Town Council meeting reporter including in her article my showing up at your public town hall meeting on Tuesday June 16, 2009. The headline on Friday June 19 read, “Mayor: Crash ‘devastated’ her”: http://tinyurl.com/yk6e98a You literally slid out of the back door of your own town hall meeting (without having opened up the floor to any further business), when faced by me and the other 16 motorcycle riders, family and friends who sat or stood quietly without disrupting any of the business of your town council meeting. The Advocate reporter was irresponsible to even write an article for you and furthermore to intertwine my previous quotes into your dictated agenda. My message to you of “It can never be over” written on a poster board was in response to you saying “It was a terrible accident, and I’m very sorry. I’m glad that it’s over...” after the Grand Jury hearing concluded they would not indict you on Criminal Negligent Homicide, Criminal Negligent Injury and Failure to Yield from a Private Driveway. The Grand Jury’s failure to indict does not mean you were found innocent. It means that the law in Louisiana does not support Justice. You should have been found guilty by proximate cause for killing my husband Jim, and for seriously injuring me, and you should have been charged with the ROW Violations ACT 195. How can you think this will ever be over? You need to know that I still need to go weekly to grief therapy, still need physical therapy, have to rely on pain medication daily, still live with PTSD, survivor’s guilt, chronic pain, disabling injuries and depression. I am still paying exorbitant medical bills, and health insurance premiums as a result of you crashing into us. I have had continued tests, treatments, surgeries and therapies. I am scheduled for my fifth surgery. I must maintain myself physically in order to function at a reasonable level to care for children and maintain my household. The simplest tasks have become physically challenging and my everyday functioning is completely at the mercy of my pain levels throughout the day. I am still unable to provide an income for my household. You took away took away my financial stability, and my physical ability to do the work I used to do. Yes, the insurance companies paid. It is a pittance after all the medical and legal expenses, and with the ongoing medical expenses and no income, how long do you think it will last? And what are your financial ramifications? You had the audacity to question if I think you felt nothing, for learning a “person was killed”, as you put it, while propped up on your platform in the Advocate newspaper. This is not about what I think you feel, Ms. Melancon. This is about how you have taken no responsibility, morally or

ethically as a human being, or any action to make any positive impact as a political figure. A person was killed, Ms. Melancon. His name was Jim Pickholtz and he was a son, a father, a husband, a friend and the absolute, unequivocal love of my life, with whom I was supposed to grow old. Since you took it unto yourself to refer to your letter of May 22, 2008, in the newspaper, I am taking it unto myself to refer to your letter, also, in which you expressed “sympathy and condolences for the loss of my husband.” I need to remind you that I did not “lose” my husband and your wording was entirely insensitive to the fact that you killed him. Your timing couldn’t have been any worse, either. It was very damaging for me to have received your letter on Saturday of Memorial Day weekend, and even more damaging to read what I consider an empty jumble of contrived clichés and self justification defending your previously perfect driving record. Nowhere in your letter or to the media did you ever ask, “Is there something I can do to help?”, or ask how I am, or how the children are. Nowhere did you reach out a hand or reach beyond your own self, or into your political position as a public official to DO anything to help me, my family or the community. Why? Courage. Well... it takes courage to do so. I think you’ve buried your head in the sand as a coward. I am writing proposed legislation and will be on the floor with two Bills next June, even though I have never been politically minded before. I am talking with the new administration in Sorrento in order to make the necessary changes to the entrances and exits of the property at the Ascension Civic Center. I have volunteered as the Director of the Baton Rouge Chapter of MAC [Motorcycle Awareness Campaign], and have applied for MAC to be present at the largest festivals in the area that are non-motorcycle events so that our message and mission goes out to the motoring public. I am speaking on behalf of MAC and independently on television shows, radio shows and at events held by Motorcyclists’ Rights Organizations that invite me. I am actively involved in my community and do whatever I can to help by guiding and talking with other crash victims, and comforting other widows of motorcycle riders killed by motorists like you. I am trying to make a difference, so that no one else has to go through what I am living. All of this takes courage. In two years I have come from being totally incapacitated, months spent in a wheelchair, and having to re-learn the simplest of physical functions that we all take for granted--like walking, from begging God to take me to Jim, to waking up daily in grief and depression and loneliness, in anger and pain, to enduring the emotional and physical rollercoaster of loss--of Jim, of health, of my blended family, of my entire life as it was, what I describe as “blissfully happy.” It takes courage to stand up for my rights and advocate for motorcycle awareness. It took courage to sit before you in your meeting. It takes courage to write you this letter, which I can only represent as my truth. It takes courage to accept that I am a victim, but that I will not be victimized. It takes courage each day to live without Jim, yet honor Jim all the ways that I choose. So I ask, who are you speaking with about being a driver who killed a motorcyclist? How are you educating motorists to look for motorcycles? How are you spreading the message to other motorists, so that they don’t kill a motorcyclist, too? You had over a year in office to correct the problems that exist at that intersection, and you have the rest of your life now as a civilian to do something, and yet to this date, you still have done nothing. I maintain that no matter what the Attorney General says about the crash site, the tree line, the guardrails, or the stop sign placement at that intersection didn’t kill Jim: You did. You were behind the wheel of the car, and you violated our right-of-way. You are the proximate cause of this incident. You also knew about the obstructions and yet, you didn’t take the care to insure that the right-of-way was clear.
Perhaps you shouldn’t have listened to your lawyers, and been in touch with us personally from the beginning of this tragic incident. Perhaps you should have considered the timing of your letter, the affect of the content and your comments to the media with greater stringency. Perhaps, you should look at the forgiveness that you hope I will be able to offer you with some more reflection and merit. I invite you muster up the courage to take your head out of the sand and do something. In memory of my husband Jim I remain, Amy Pickholtz . brmac@eatel.net FTY-ROWV Widow/Survivor/Bikers’ Rights Activist Director, Baton Rouge Chapter, Motorcycle Awareness Campaign P.O. Box 4762 . Baton Rouge, LA 70821 . http://www.macorg.com FOOTNOTE FROM BRUCE ARNOLD It’s a shame that Transportation Secretary Ray LaHood apparently never reads the many FTY-ROWV messages like this that are regularly sent to him. Perhaps if he did, motorcyclists would not have been slighted at the USDOT’s Distracted Driving Summit a few weeks ago: Perhaps if he did, he’d acknowledge that every year right-of-way violations by distracted, inattentive and negligent cagers contribute to the loss and suffering of over 100,000 families like Amy’s who are impacted by motorcycle accident injuries and fatalities. Perhaps if he did, he’d address
more of the distracted driving problem than teens texting. And perhaps, the (preordained?) outcomes of his staged summit would’ve included more than plugging the new website of Cooper Munroe and Emily McKhann, two “moms” (who just happen to be long-time political activists) that Lahood claims he “first met ... at our Distracted Driving Summit where they were blogging about the conference to their community.”
ST.LOUIS SECTION
The law in Louisiana is not yet in place, but it will be after next session, that would have convicted you, which is Ordinary Negligent Homicide. I maintain there is no justice, there is just law. If there was justice, you’d be off the road, without a license to drive. You’d be at the very least doing community service and advocacy work for motorcycle awareness, and you would have been found guilty on all counts of negligent homicide, negligent injury and failure to yield, and you would have been charged under the current ROW Violations Act 195 and convicted of that, too. Louisiana should be ashamed as a State to not have the proper law in place to convict those responsible for negligent homicide. And you should be ashamed, Brenda Melancon, that you’re doing nothing to make amends for killing my husband Jim, permanently injuring me, and devastating an entire family, not for months, but for the rest of our lives.
I cannot find any reference to either of LaHood’s designated distracted driving divas ever having any involvement with the cause prior to the Summit. So I can only wonder how they happened to be in attendance, and what good fortune it was for all involved that “fate” brought them together with the Secretary. And isn’t it just amazing that these two “concerned mothers”, traffic safety neophytes such as they were, managed to bring “their” new distracted driving website online less than 24 hours after the Summit concluded: http://www.momsmsg.com/
Oh well... Most of you still believe that Pearl Harbor was a surprise attack ... that JFK was killed by a lone gunman ... and that on 9/11 a small band of Muslims with bad flying records and box cutters outwitted the world’s most sophisticated and powerful air defense systems to hijack four airliners, using two to topple three WTC towers, flying one low enough to punch a hole in the first floor of the Pentagon without damaging the lawn, and crashing one into a field in Pennsylvania without leaving any significant debris. So I doubt Le DOT will have any trouble pulling LaHood over your eyes. Besides, very soon we’ll all have bigger fish to fry: READ “BRUCE ON BIKERS’ RIGHTS” ONLINE HERE: http://bikersrights.ldrlongdistancerider.com “If you willingly trade liberty for security, expect to be sheared in good times and slaughtered in bad. Such is the fate of the Sheeple. If on the contrary, you’d rather die on your feet than live on your knees, rise up now and join us in the struggle: The battle for bikers’ rights is not about patches, parties or poker runs. We fight to protect the freedom and promote the interests of American motorcyclists ... to defend our right to choose our own modes of transportation, attire and lifestyle ... to deter and defy discrimination against us ... and to vanquish those who violate our rights or right-of-way.” --Bruce Arnold

MY MISSOURI MULES By Anita Kasper
Long before I heard of Santa Claus and the Easter Bunny... I knew about the Missouri Mules Motorcycle Club. Legend has it that sometime in 1939 on the streets of North St. Louis, 8 men started the Missouri Mules. The first President was Ken Kloessner and I’ve been told that my dad was one of the original 8. Many of them went to school at Beaumount High and hung out at Shrek Bros, Macnamee’s, Lucky Landing Tavern, Colletti’s Tavern - just to name a few, BUT their official Headquarters were Kloessner’s Food Shop. In the winter of 1945, my parents (Fred and Gladys Kasper) met and it wasn’t long before my mother was in the Women’s Auxiliary Club. Women could help plan events and work them, but were not allowed to be members of the Club. In fact, at that time there were many restrictions in the bi-laws. Such as: all motorcycles had to be painted white. My dad worked as a referee and a flag man at the Jerseyville races while my mom kept score cards and Frances Smith (AKA: Smitty) was the announcer. He worked for Babe Osborn and drove a side car so he could haul his speaker equipment. He was also a neighbor and one of my dad’s best friends. To name a few of the events they participated in or sponsored: Annual AMA Gypsy tours, Shriner’s Parades, Ups & Downs Charitable Association, Riverdale Speedway & East Side Speedway Races, Hare & Hound Chase, field meets and of course the legendary Jerseyville Races. Clubs such as the Shamrocks, Missouri Flyers, East Side Motorcycle Club, Alton Piasa Flyers, Mattese Riders, Shooting Star Motor Club, Night Owls, Broadway Riders, Ozark Ridge Runners, Blue Eagles, Illinois-Missouri Motor Club were always invited to share in the fun. In 1947, my father picked up his beloved Harley from Charlie Domyan Bros. in East St. Louis. My parents rode to Pocahontas, AR in the fall of 1948 to get married. The Club was their extended family and our basement had a ratskellar where my parents held BBQ’s & parties for the Mules. I can remember there were trophies and photos all throughout our house! In 1957, after nearly 20 years as a Mule, my dad sent a letter of resignation to the club but still remained somewhat active until the mid 1960’s with their last run in 1964 – a year after I was born. I cannot remember a time when there wasn’t a motorcycle in our garage or basement being worked on by my dad, brothers, brotherin-law, uncles, and cousins as they all had the love for motorcycles and all rode. I loved riding but never trusted anyone but family. Growing up in the house as a teenager if the phone rang and it was Kenny Kloessner, Al Sandau, Smitty or Babe, I just knew that would be a 3 hour conversation with my dad. They’d reminisce about the past in which at the time I thought it was very boring. My mother had a Hope Chest and every now and then she’d pull out a box of “treasures” that contained their old uniforms, photos, AMA pins, programs, Mules membership cards, etc. When I was 12, I got to “model” her entire outfit and thought it was cool, but again was too young to really appreciate what it meant to her. In 1971, my father entombed his Harley in our basement and never rode again. The motorcycle room was a shrine in our house. Only on special occasions was anyone able to look at it. Sometimes, my friends & I would sneak a peek at this family jewel. As years passed, only on occasion would the Mules come up in conversation with my parents, but when they did the gleam in my mom and dad’s eyes bore the happiness in which they shared those wonderful days. These were memories my parents treasured most. My dad loved the Museum of Transportation and I always envisioned his bike and their stuff on display there. When he passed
away in 2005, I decided to try to make this happen so I contacted the curator who told me they didn’t have much on the history of motorcycles, especially not in St. Louis. He was interested in what I had to show him. I started to do some research and quickly life got in the way and my agenda was placed on the back burner temporarily. Needing money to pay for his funeral expenses, I took on a bartending job near my home. After working there a short time, I found out that the owner was Ken Kloessner’s niece (Sue Shepherd) and she told me that her Uncles Bob and Kenny started the Mules and they were still an active club. Her mom and dad (Ruth & Fred Hafer) were also Mules riders and I felt this was a sign to continue my mission. In April of this year, I was given a number to one of the Mules and we talked for nearly an hour. He invited me to come to the next Mules meeting which was to be held on April 30th, 2009. He asked if I knew where Jennings Station Bar & Grill was and I had to laugh as I’d been bartending there on Saturday nights for the past 2 years. I knew the bar had been open 70 years under different names –Shrek’s Bros/ Tharpe’s Tavern, and that the club used to hold meetings there but never knew the Mules still did. I showed up with my box of memorabilia and met several of the current members and they invited me out on their spring run the following Sunday, May 3rd, 2009. I rode with one of the former Presidents and had the time of my life. In my back pocket, I had 2 photos of my parents and I told the club that never in a million years would I have thought I’d be riding with them in their club - post-humus. That day, I fell in love and I totally understood what my parents loved so much about riding and being a part of something great! The wind in my hair and the sun on my face not only warmed my heart but melted it. I couldn’t quit smiling and thought all day long how happy my parents would be if they could see me now AND I GOT IT! I completely understood why those days as Mules were the best days of their lives. That day is on my top 10 list of best days of my life and I knew I had to continue my mission of putting our family heirloom Mules memorabilia into a museum. I also knew they were still an active Club and by no means did I want to do anything to upset the current members. They embraced me with open arms and invited me to a couple of meetings to share my museum idea and get their input and permission. They couldn’t have been nicer and I learned what a great group of men they are! I attended their annual picnic and on another ride was taken to the Jerseyville Race track and was totally overcome with emotion as the photos of the past events came to life. I could feel the energy as I pictured the excitement of those legendary races. The Mules suggested the Dave Mungenast Classic Motorcycle Museum and I had never heard of it but thought I’d contact them to see if they would be interested. I handed over my precious box of memorabilia and gave them permission to use what they thought would be of interest. I envisioned a small display but when I arrived for the first time to see what they had done with my box of treasures, I was in awe as it covered an entire wall. On October 10th, 2009, 11 years after my mother passed away, we held a small dedication ceremony at the museum. As the Mules arrived to share in the day, I got goose bumps - I saw the 1st bike, then 2 more, then came 5 and 10 and 20 more bikes. As they pulled up I had tears in my eyes knowing how happy my parent’s would be to see such a turnout of Mules. The sun was shining and the weather was perfect and I could not have asked for a better day. I kept the speech short and mainly wanted to thank them for coming and for the new Mules memories that I had collected over the past few months. Before leaving the museum, I had one last request. I asked that they ride by Calvary Cemetery where my parents are buried. As my family gathered at the grave site and listened to the roar of nearly 40 Harley’s driving by, it was music to our ears. I knew in my heart that the long lost melody that I used to take for granted, that my parents loved so much, would never be heard by them again but at least their legacy lives on… in a museum, NOT in a box. I WOULD LIKE TO THANK THE MULES AND EVERYONE ELSE WHO MADE THIS ONE OF THE BEST DAYS OF MY LIFE AND ALSO THANKS TO THE MUSEUM FOR HELPING MY DREAM COME TRUE. MAY YOUR HEARTS AND SOULS RIDE FOREVER IN THE WIND!!!!! Anita Kasper NOVEMBER 2009

Rich Phillips Cycles
Rich started doing upholstery at a young age working for his uncle’s shop. After that he worked at car dealerships installing sunroofs, which started his interests in working with metal. Rich went back to doing upholstery for his uncle, after doing this he realized if he was going to make the seat for his chopper he would need to build his own seat from the pan up. Rich started his business out of necessity, realizing there was a high demand for one off seats. So he did what he needed to and bought the proper equipment to make his own pans and upholster his seats himself. As for his tooling, he started his tool work with old leather tools at his mom and dad had and went from there. Rich can do anything you can think of with a custom seat. He uses many different patterns, fasteners, colors, tooling, etc. Pretty much if u can think it, up he can do it. Rich’s talents go way outside of leather working. In fact Rich offers custom Indian style leaf spring front ends, custom Springer handle bars, and taillight license plate combos. Rich also builds one off custom bikes. He builds his own frames, tins, and even paints his own bikes. Rich has also recently released a biker documentary entitled, “Free To Wander” which I highly recommend to anyone. To check rich’s seats out go to www.bikersaddles.com. Also to get yourself a copy of Free To Wonder go to www.freetowonder.net

PRODUCT REVIEW
By Garrett Bahr
Cycle Hill Wheel Balancer Last month’s product review was the Cycle Hill Tire Changer. IT worked great for in home tire changes for all makes and models of cruisers and sport bikes. There is still one crucial step in changing a tire, is the balancing of the wheel that will help avoid a nasty speed wobble. Just so happens Cycle Hill offers a very accurate and affordable static balancer. It is small in size and can be placed on an uneven surface such as a tool box and still be accurate. The Cycle Hill Wheel Balancer is a simple invention but very effective. The balancer can get as accurate as a 1/16 of an ounce making it one of the most accurate balancers available. The balancer consists of a powder-coated base with bearing mounted on the top for the machined axle to sit on and let the heaviest/out of balance spot on the wheel fall to the bottom. When balancing a wheel, take the correct polyethylene cones then set them against the bearings of the wheel. The heavy portion will then be pulled to the bottom. Next mark the top that will be the light spot of the wheel and the objective is to get the light spot balanced and equal to the heavy spot of the wheel with weights. Once the light spot is matched to the heaving portion of the wheel it will stet completely still at any position on the balancer once the wheel is truly balanced.

Biker Etiquette By Chris “Rowdi” Yates
HERE ARE A FEW THOUGHTS ON BEING A MORE CONSIDERATE BIKER. Passing lamps are possible in the day so cars can see you, but at night your fellow biker in front of you feels like your bright lighting him in his mirrors. Loud pips help you be heard, but too loud and your friends might not want to ride with you. Try to be considerate of your neighbors when you come home drunk at night, and their kids are sleeping. A loud rumble is soothing; revving your engine can give everyone nightmares and turn them against you. Burnouts are cool, throwing loose gravel on your bro’s parked bikes isn’t. Wheelies are cool. Weaving in and out of traffic at 70mph on one wheel, isn’t. Make sure cars can see you in their mirror when flying by them on the highway. Watch the side streets in the city and neighborhoods for cars pulling out. When talking to motorcycle club members try not touch their colors unless your brave, tough or stupid.

Try not to cuss in front of children! If we’re ever going to get the helmet law repealed we have to set a good example and change the public opinion about us! Be careful of wet leaves on the road this fall and watch for deer, I almost hit one already!

NOUGIER
500cc 4-Cylinder Grand Prix-1953
The Nougier engine was remarkably narrow, thanks to a primary drive by gears cut directly into the crankshaft, a shaft-driven magneto behind the cylinders and just three float chambers for the quadruple carburetors. Except in the early years of this century, French motorcycle manufacturers have made little impression on the international racing scene. Nevertheless, that hasn’t prevented the country’s many small workshops from continuing to build grand prix racers. Hand-Built Superbike Among the most outstanding were the bikes produced by the Nougier brothers at St. Andiol, near Avignon in Provence. Nougiers were built from stem to stern by brother Jean, but this old-fashioned approach gave away nothing in terms of sophistication to the machines built by the great makers from other countries. Already well-known for his twin-cam singles and twins based on Terrot and Magnat-Debon machines, Jean decided to challenge the all-powerful Gilera and MV Agusta bikes on their home ground. In 1953, he built a four-cylinder. With the aid of the metal founder Pierre Collington, he made all the components for this remarkable machine, the sole French four-cylinder built in the postwar era, apart from Citroen-engine BFGs of the Eighties. In the Forefront of Technology Superbly finished and technologically formidable, the Nougier seemed to have everything going for it. But the Nougier brothers lacked the financial muscle to develop it or to employ a top-drawer rider capable of putting it in the winner’s circle. The results this amazing bike achieved were sadly disappointing. Specifications Engine: air-cooled 500cc 4-cylinder four stroke Power Rating: 50+hp @11,000rpm Valves: chain-driven twin overhead camshafts Fuel System: carburetors Transmission: 5 or 6-speed gearbox Suspension: (front/rear) Collingnon twin leading shoe magnesium drum Wheels: wire Weight: 320lb Max Speed: 122 mph 20

NOVEMBER: well hope everything is ok with everybody. I understand we had a fatality at the bikefest, a rider hit a deer. It’s not going to be the last time this happens unfortunately, but we all know it’s part of riding it’s easy to do. Those F%&^ers just come out of nowhere. SO BE CAREFUL!!!! I talked last month about new riders in STURGIS well I got e-mails telling me it’s not just there that these things occur. Well of course it isn’t what the F%$# , you expect me to name every event or rally by name . Hell I can’t remember my passwords on the computer much less the names of every event or rally. But I understand what he meant so it was a kind e-mail I sent back for the most part anyway. LET’S RIDE! In the past year I’ve been asked this question more than a few times mostly from new riders but not always. When do you or will you know after an accident if you should or shouldn’t ride again? I know sounds like a dumb question I thought so to, but recently I was asked it again and I started really giving it some thought. My first thought was as soon as you can get back on one. But after reviewing this more intensely in my mind and naturally a couple of Budweiser’s there are definitely several different responses. First as I’ve said I have been in several accidents but the last one which was by far the worst in which I lost a good friend and his wife. This was the first time I said that’s it I’m never riding again , but that was an immediate response when I woke up in the hospital and finding out I lost two friends. After a few days I wanted another bike. I think you have to weigh the differences , in my case I miss them both, but not riding again will never bring them back and there isn’t a day goes by I don’t think of them so that’s my only time even thinking about never riding again. Each person has to make his or her own choice the only advice I will give you is to make it yourself because if someone else forces you into something you don’t want to do you will eventually over time despise them. If you really want to ride again by all means get back on, well wait a minute on second thought first take a good hard look at what caused the accident. If you come up with I was scared or I was nervous or I froze then do yourself and those of us that love to ride a favor. SELL THE F$#%ER and quit while your ahead because if any of the three scenarios are the reason for your misfortune then it’s just the start of things to come you think you were scared, or nervous or froze up before . HOLY SHIT you’re going to be three times worse. But if it was something that you couldn’t avoid like a deer or someone pulling in front of you or bikes going down in front of you and many other different things I think you get the idea. Then it’s up to you to make the decision everyone is going to look at these things differently so take some time and sort it out, but don’t rush, look you just had a close call it’s a lot to take in so take your time and you will make the right decision for YOURSELF. You see that’s the important thing here, you can factor in everyone and everything but ultimately it is YOURSELF, that you need to satisfy. So all that BULLSHIT SAID! My answer is, F&^% I forgot the question, no my answer is you and only you will know and you will live with it because you made the choice no one made it for you. So everyone ride safe, watch out for each other and the animals and all the road hazards we face every time we saddle up. And hopefully you never have to wonder about this question. Well that’s it see you next month. OH YEA! HAPPY THANKSGIVING! IF YOU SEE A VETERAN THANK HIM ALSO FOR SERVING!!!!!
NEW RIDER TIP: Check your tire pressures especially throughout the cold months. REMEMBER KEEP THE SHINEY SIDE UP AND THE RUBBER SIDE DOWN

Before there were Sportsters
there were K Models
ISSUE
38
By Jim Wagner Launched in 1952, the K Model was a product of Harley’s post-war development. It was a power plant that was destined to evolve into the mainstay of Harley’s Class C AMA Racers as well as the grandfather of the modern day Sportster. The K Model was the Motor Company’s first attempt at a unit-construction (transmission mounted in the engine case) V-twin, rather than a V-twin engine case mated to a separate independent transmission and case. The unit construction provided a more compact power plant and more reliable cassette transmission. Unlike other Harley transmissions of the day, the K Model transmission input power on the left and output was on the right side. This benefitted gearing changes since the clutch and primary drive no longer had to be removed to change the front final drive sprocket. The cassette feature of the transmission allowed it to be removed for service without dismantling the whole motor. The compact unit-construction K Model engine and transmission allowed a shorter wheelbase and provided a more rigid component to stiffen the chassis, both benefitted the K Model’s handling. They called them K Models because the general profile of the motor with its integrated transmission looks like a “K” laying flat side down. The 45 cubic inch (750cc) motor was laid out with 4 speed transmission (some transmission parts as well as clutch plates are still used in XR-750s), 4 gear-drive cams (like a modern day XR-750 or Sportster), magneto, side valve heads and cylinders, the carburetor was mounted on the left. This was a design flaw for flat track racing since all the turns are to the left. The safest way to crash on a flat track is to “low side”. A “low side” means the rider lays the bike down in the direction he (or she) is turning. If the bike “high sides” it will launch the rider over the handlebars presenting a lot more opportunity for injury. Since flat track turns are all to the left, a left side mounted carb, in a “low side” on a dirt track, can break the carb off or scoop dirt into the carb and motor potentially ruining it, (when the Sportster came out in 1957 the carb was moved to the right side.) In 1952 the K Model was Harley’s hotrod. The unit-construction power plant, short wheelbase and swingarm frame made it the lightest, best handling V-twin powered motorcycle from Harley. The K Model’s success was almost immediate, finishing first and second at the Peoria TT in September 1952 fathering a racing heritage that continues on today in the XR-750. The K Model in the photos, on display here at DOC’S Harley-Davidson Kirkwood, Mo. is a 1954 KH. By 1954 engine size was up from 45 to 55 cubic inches. People see it on display and most identify it as a Sportster, not too far off as the original 1957 Sportster

was the same chassis and bodywork with the overhead valve XL motor replacing the flathead K Model. Over the years K Models were produced, there was the KH, KHK, KR, KRTT, and KHRTT. The K Models with “R” in the nomenclature were factory race editions, they received the modifications and more, from the factory, that were done to the K Models that finished one, two at Peoria in 1952. These were formidable racers that remained dominant into the 1960s in the hands of guys like Joe Leonard and “Black Bart” Markel. Probably the most famous K Model was owned by Elvis Presley. More dressed up than the KH at DOC’S, was the 1955 KHK, which came with buddy seat, saddlebags and front end as on a FL model. Shortly after his time in the army was over, Elvis acquired the KHK. Harley made a big deal about it and featured Elvis with his KHK in the Motor Company’s magazine in 1955. You can’t visit Elvis or his KHK but you can see a great example of a KH right here at DOC’S Harley-Davidson.

STEVE’S ROADKILL CAFE
Deep Fried Turkey Dinner ................................$6.66
Before you prepare your turkey, make sure you read your manual that came with your turkey fryer. Make sure your follow the following turkey frying rules: Allow your turkey to thaw completely! THIS IS VERY IMPORTANT! This is what causes all those horrible grease fires you see on TV. Never insert a frozen turkey or partially frozen turkey into hot oil. Always test your turkey fryer thermometer before you attempt to fry your turkey. We suggest testing your turkey fryer thermometer several weeks before you plan on frying a deep fried turkey. Many times you find that water has gotten into the thermometer, someone stepped on it or you had to use it as a door opener. Ingredients: 4 to 5 gallons vegetable oil 1 whole turkey (12 to 15 pounds), at room temperature Cayenne pepper (optional) You will need an outdoor cooker (suggested size is 140,000 Btu) and a 10-gallon pot, preferably one with a basket insert. Begin heating the oil in a 10-gallon pot over a very hot propane flame outdoors to 390 degrees F. It will take about 20 minutes for the oil to heat. Rinse the turkey well, pat it dry inside and out, and set it on end in a sink to drain. When the oil reaches 375 degrees F., pat the turkey dry again, and sprinkle it with cayenne, if desired. If your cooker has a basket insert, place the turkey in the basket and set it over a baking sheet; if not, set an oven rack over a large baking sheet, place the turkey on it, and take them outside to the cooker. Check the temperature of the oil. When the oil reaches 390 degrees F., carefully and slowly lower the basket with the turkey into the oil; or lower it holding it by its legs or by a long heavy tool such as a clean fireplace poker inserted into its cavity. Immediately check the oil temperature and adjust the flame so that the temperature does not dip below 340 degrees F. You want to maintain the temperature at 365 degrees F. Whole turkeys take only 3 to 4 minutes per pound to fry to perfection. When it is done, the turkey will float to the surface with a perfectly crispy, brown skin. If you are unsure, you can test the meat for doneness at the hip joint or insert a meat thermometer into the breast; it should register 180 degrees F. Allow it to rest for 20 minutes before carving

3rd Annual Rip’s B.A.D. Ride Courtesy of Ann DeWoskin
On September 27, the weather was beautiful while over 340 bikers came together at Route 66 State Park for the 3rd Annual Rip’s B.A.D. (Biker’s Against Diabetes) Ride. Seeing so many bikes coming across the bridge at Route 66 was amazing, a truly beautiful sight. What a great feeling to see so many people there to support the American Diabetes Association fight against diabetes! Once the bikers arrived from one of our five different start sites or their own starting point, they convened at the festival to celebrate the ride. The atmosphere was filled with live music, delicious food, and many vendors. The Bike Show and Bike Games added to the fun filled day! So many people are affected by this horrible disease; almost everyone can say they know someone with diabetes. B.A.D. Ride raised over $37,000 this year. These funds go towards supporting our mission, which is to prevent and cure diabetes and to improve the lives of all people affected by diabetes. The American Diabetes Association is also the largest provider of Diabetes Camps as well as weekend retreats that benefit more than 10,000 children of all ages every year. On behalf of the American Diabetes Association, I want to say “Thank You” for all your support for B.A.D. Ride 2009!

Sierra Mist was originally found along side a country road and her brother and sister were lying dead next to her. Lucky for this wonderful girl, Mutts-N-Stuff found her and was able to find her a great new home...that was until her family became of victim of the economy and lost their home. Now Sierra Mist is back with us looking for a new home to call her own. She is very sociable, potty trained, crate trained and knows how to sit and give you her paw. She knows basic commands but does need a little work on her leash walking. She is great with young children as well, however, she finds small furry things to be appetizers and will not do well them, this includes cats :). Sierra is an energetic girl whose antics will make you laugh. She’s a clown who loves playing in the river, fetching her ball and acting silly. Sierra Mist is a fun loving, beautiful girl who just wants a family of her own. If you would like to meet this wonderful soul, please complete an application and her foster mom will be in touch

Bombs Away Bash '09
I really appreciate everyone who put on shows this year to help the hot rod seen grow! This is the kind of shit we need to see. The more people promote the scene, and respect everyone's time and effort the better the scene will get. The East Peoria Bomber's C.C. really understood this and this was definitely apparent in the way they thru the bash. Although I wasn't able to drive my '53 ford up there, I still had a blast traveling with some good friends up there. We made some fun memories along the way, even got the classic flat tire. Then I was stuck talking to a couple of county cops about the fact that I was driving a hearse. Once we got there it was nothing but good times. As in years prior the Bombers were extremely generous, hospitable and really hosted a fantastic show. There was great music on the P/A during the show. They had a great variety of some really nice hotrods, customs, and rats. All the attendees were having a blast, talkin’ to each other about their cars or catching up with people they hadn't seen in a while. The night just ended up being killer! Kevin and Jeremy from Outkast C.C. did a bad ass nose to nose burnout of their rods. There was a bad ass pin up contest, which I would like to mention the winner was Foxy La Feelion from here in St. Louis. Then, came the Music which fuckin’ rocked. The Boneyard Brawlers started it off, and killed it with a bad ass set. Then The Afterdarks got the whole joint jumpin’ with their amazing rock and roll, and crazy antics. Anyone who didn't make it to this year’s bash, be sure not to miss next year’s 4th annual bash. It is sure to be a blast. Special thanks to Bombers C.C. and Kevin Wallis for the photography

BROWN BAG PROPAGANDA presents
Rock n Roll REGIONAL
DEVLIN’S KIDS
Formed over cocktails nearly three years ago, this hard-working band…well, hard working is a bit ST.LOUIS, MO exaggerated, has entertained, well again you see…performed, yes, performed for the fine citizens of Saint Louis from basements to clubs, sober or not, never forgetting that original ideal of musicianship that brought them together in the first place: no frills, no pretension, beer-fueled, party punk rock! Zombies, BMX, Kickball, Titty Bars! Nothing is too hard-hitting a topic for the anchor of Do What? Rekerrrrds, Devlin’s Kids. With 8Bit’s Eddie Van Halen-esque riffs on the axe, the Nighthawk beating the hell out of his beat up kit, J-Man’s Danzig-like growl, and Spider’s thunderous four-string, the four dudes of Devlin’s Kids continue to crank out tunes and are always up for a raucous good time at live venues throughout Saint Louis. Recently the band recorded four newer cuts and plans on releasing them as an EP later this fall to accompany the “Titty City” recording released in 2008. For the hundreds, alright, alright, dozens of fans clamoring for more Devlin, the guys will have two tracks released on two separate comps this fall as well. Both compilations feature local bands, one on Brown Bag Recordings, the other on I Hate Punk Rock Records. Currently the Kids are back at it writing new tracks, but will pause the musical genius for a few nights in November to drink, oh…and play music too around town. If you’re lucky they won’t get too loaded to finish their songs…if you’re lucky. CONTACT INFO: WWW.MYSPACE.COM/DEVLINSKIDS
THROTTLE
NATIONAL
We’re influenced by the stuff we cut our teeth on...The Replacements, Ramones, The Who, Stiff Little Fingers, Motorhead....And lots of stuff since LOS ANGELES, CA ...The Meices, The Consumers, Pixies, Toadies,...Spinkle in a dash of The Scabs, The Rocks, The Saints, Hard-ons or any other classic Oz punk from the late 70’s, early 80’s and you have ‘ Throttle’, combining all this and more into a unique blend of old school punk and messy guitar amazzzzingness. Coming together from Minneapolis, Sydney-Australia and wherever it is the “Cubs” come from, we somehow found a way to meld all our influences into little 3 minute smouldering melodic punk-garage rock slices of life. It’s great driving music....And on days when you aren’t driving, it’s great drinking music...Throttle (that’s us),kicks straight into high gear and stays there. THE WARRIORS
INTERNATIONAL
The Warriors were formed in late 1981 out of the ashes of the classic oi band, THE LAST RESORT KENT, ENGLAND who Saxby was the original singer for, they did a couple of gigs in London and recorded a few tracks for compilation albums before quitting. Then in 1996 after a one off LAST RESORT show in Belgium, they changed their name back to THE WARRIORS. They have recorded 4 studio albums including the current album UNITE THE SCENE, a mini album, Bad Guys, and a best of album plus numerous tracks on compilation albums. THE WARRIORS have played all over Europe, Japan and in Atlanta USA. The current line - up includes a second guitarist who has added a different dimension to the live sound making it a lot fuller. Their new album UNITE THE SCENE is their best work to date and is receiving rave reviews and winning a new generation of fans. THE WARRIORS are currently rehearsing songs for the next album and will be playing two end of tour shows on the 19th & 20th of December in the UK, one with the COCKNEY REJECTS and the other as support to the current line up of THE LAST RESORT. Randale Records in Germany are to be releasing a limited edition vinyl copy of UNITE THE SCENE and this will be followed up by a couple of dates in Germany and various European dates before heading to the USA in 2010 for a short tour starting at the East coast OI! festival at The Starlight Ballroom in Philadelphia, PA in May. Lady Biker Sue Daniels
Have you ever heard of the town they call Licking, MO & wondered “where is that?” Some of you are saying,” Oh, I know where that is!” While the others are probably saying,” Licking, I’ve never heard of it!” This is my home town, a quaint little town nestled in the Ozark hills near Montauk State Park. I’ve heard the town got its name from a buffalo lick, which makes since, seeing as our farm has a portion of “The Trail of Tears running through it. Hi, I’m Sue Daniels & this is my hometown. I am also the newest member of the F.T.M. Army. I’ve been asked to write an article each month & shed some insight from a lady rider’s point of view. Yes, I said “lady rider”. I’ve had a passion for riding most of my life. I also share this interest in riding with not only my husband Jack, but my daughter Dana, her husband Lew, my son Jack Allen, his wife Dacia & even my late brother Gary & his son Michael. We are a biking family. In fact, when I met my husband, he was riding a chopper. He has been riding bikes since he was 2. His father rode his H-D dresser to church each week, & hauled Jack & his brother. Shortly after meeting Jack I owned my own bike. As a young girl my 1st adventure on a motorcycle was on a Honda 50 & an old Cushman scooter that belonged to my brothers. I was the only girl in our family, so whatever the guys were doing, I was there. I liked playing baseball, riding horses, riding go-carts, fishing & I even helped putting up hay. Anytime my Dad was working on his car I helped by handing him the tools, I got to be real good at knowing what was what. This is real handy now around our shop. Jack however is glad I learned to sew & they say I’m a real good cook! Now I spend most of my spare time either on my 600 VTX Shadow or my ’08 H-D Custom Trike, that my son built for me. I have the best of both worlds. Two wheels or three, I love riding both. The trike my son built for me was featured in FTM October issue; it is a dream to ride. It was only natural my son would go to mechanist school & start building bikes, after all my father was a mechanist & my husband along with his father & brother rode Harley’s & built several choppers in their days. My son had built several custom choppers before he built my trike, if some of you are interested in seeing these, let me know I might do an article later down the road about them. I think you probably have heard enough about me & I’m sure a few things will pop up from time to time in my articles. I look forward to meeting some of you at different events. Don’t be shy, come on up & say Hi! I would like to say thanks to Steve & Brandie for asking me to join them & I feel honored for this opportunity to be a part of the FTM army. Thanks, guys!

Motorcyclists in the “Show Me” state just might have to show a judge reasonable cause why they ran a red light under the new law which allows two wheeled drivers to legally proceed through a red light controlled intersection after waiting an “unreasonable” amount of time for the light to change. The new red light provision does not specify how long a motorcyclist or bicyclist must wait for the light to change and is open to interpretation, according to a report in the St. Joseph News-Press.

Well, if we learned anything in October, we learned how bad people want this Magazine!! We didn’t realize that this magazine could be made any better, but Steve proved us wrong in big ways! Tracy and I are prouder than ever to be part of the Full Throttle Army. Speaking of that, we have a new member of our Illinois Sales staff. Her name is Joni Sweet and she is rocking the south. Tracy and I will still be out and about with sales and events, but the demand for this magazine is growing fast and we can’t do it all alone anymore. So, as sales managers, we are building a sales staff and are heading north as well. Don’t worry Missouri, we are heading there too.

Last month Tracy and I announced our photo sharing site: www. jerryandtracy.shutterfly.com. Since then the hits have gone through the roof, so we are guessing ya like it! It takes us a lot of time to maintain, but we figure it’s the least we can do for all the great support you all have given us through the summer. As a heads up, in the December issue we will be featuring our buyers guide again. It’s a great way for our advertisers to promote holiday deals and sales. Contact Tracy, myself or Joni for some very special advertising deals before time runs out. We have limited space so don’t wait! These pages will fill up fast! I know we have said this over and over but 2010 is gonna be a big year for FTM. The quality of the mag you’re holding right now is just a small example of what’s yet to come and we can’t wait!!

Gary Tyler, owner/operator of Chopper Chairs has been working on upholstery since 1975 when he was refurbishing aircraft interiors at Parks Airport in Cahokia. He's worked with auto upholstery as well, but has found his greatest satisfaction building and re-covering motorcycle seats and accessories. "I really enjoy working in the biker community. Bikers are hard working people that enjoy the freedom of the road, and the most generous and caring folks I've ever seen". Gary, a Vietnam and Desert Storm Veteran, started Chopper Chairs about seven years ago at a warehouse in Sauget, Illinois. He has since moved and set up operations at his residence on Triple Lakes Rd, just outside of Cahokia Illinois. Gary can build any style seat you can dream up from stock seats to custom and exotic styles. Seat foam modification is a big part of his business. He can make your seat wider, slimmer, higher or lower and can even install top quality polymer gel pads to most any seat. These mods can sure make a difference in comfort over long trips. If you're building a custom bike and have no seat, Gary can hook you up there as well. He can build a fiberglass seat off the bike that fits like a glove. There are several shops out there that use this Chopper Chairs service for their custom builds. Tool bags as well as saddle bags are another area Gary can hook you up in. 38 FEATURE STORY
YEAR OF
NINE
In 2006 Scott Hutchens Came to Brian Elliott of Black Sunshine Customs to have a one off custom bike made. Brian did just that, building Scott a one of a kind super slick chopper with a hot rod evo power plant built by Brian,(std cases, Axtell jugs, u get the picture). Other trick shit included: aluminum gas tank, air ride seat, and many custom accessories machined and fabricated by Brian himself. Needless to say when Scott received this bike he was stoked. Scott rode this rad machine for a few years, traveling to shows, taverns, and just riding around town having a blast. After a few years Brian and Scott became good friends riding together going to shows together, etc. So when Scott decided to have a second chopper built, (because the only thing better than having one bad ass bike, is having two) he went back to Brian. Scott came to Brian in November of 2008 to have his second chopper, this one a little more old school. Brian started this project with one of his kick ass hand built frames. Each one of these frames are built in house by Brian, they are all tig welded and sport a kick ass heim joint axle block set-up. This bike instead of sporting an evo, sports a 1975 shovel also highly modified by Brian. In fact EVERYTHING on this bike besides the wheels and primary were made in house at Black Sunshine Customs, including machining and fabbing his own Springer front end. Besides fabbing and machining all parts for Goldy Locs in house, Brian also spent an amazing amount of attention to detail with this bike. Going as far as splitting the rocker boxes, making a custom rear brake caliper mount to make up for the lack of front brake. Other details include safety wired pipes, and pin striping everywhere including the oil filter canister. This is one thing that really sets Brian apart from your typical builder. This bike has already received attention everywhere. It gets ridden around everywhere, and was even on stage at the broken spoke saloon in Sturgis. Scott also loves the bikes riding it every chance he gets. I would like to personally thank Scott for allowing us the time and opportunity to cover this bike, you truly have one bad ass machine bro.

Press Release: BUELL OFFICIALS THANK CUSTOMERS, DEALERS AND EMPLOYEES FOR UNFORGETTABLE RIDE EAST TROY, Wis. (Oct. 15, 2009) – Buell Motorcycle Company officials thanked the company's customers, employees and dealers for an unforgettable ride, following today's announcement by Harley-Davidson, Inc. that it will discontinue the Buell(r) product line as part of Harley-Davidson's goforward business strategy. The new long-term strategy aims to drive Company growth through a focus of efforts and resources on the Harley-Davidson(r) brand. "I want to personally thank all our past and present Buell employees, dealers and suppliers for their efforts. I also want to thank Buell motorcycle owners for their support and passion for the brand," said Buell Motorcycle Company President Jon Flickinger. Flickinger said a limited number of new Buell motorcycles remain available for sale through authorized dealerships and production will wind down by October 30. He also stressed that Harley-Davidson will provide replacement parts and service through dealerships and that warranty coverage will continue as normal for Buell motorcycles. "I will always be proud of what we have accomplished. It is a testimony to what a small group of passionate and inspired people can do, and with brilliant innovations, we've produced some of the best-handling bikes of all time," said Buell Chairman and Chief Technical Officer Erik Buell. "I personally look forward to exploring how I can continue to work with Harley-Davidson to bring advanced product technology to riders." "I have also had the great fortune to meet and get to know many Buell riders over the years, and they are an amazing and interesting group of free thinkers," Buell said. "May you ride with pride into the future. And may your roads ahead be as adventuresome and rewarding as mine have been for the last 26 years." A wholly owned subsidiary of Harley-Davidson, Inc. since 1998, Buell Motorcycle Company was founded in 1983 by Erik Buell and produced more than 135,000 motorcycles. Over the past 26 years, Buell motorcycles won numerous design accolades and awards, and countless races and championships around the world, including the AMA Pro Daytona SportBike championship in 2009. For Immediate Release October 15th 2009 HARLEY-DAVIDSON UNVEILS NEW SINGLE-BRAND STRATEGY, PLANS TO DIVEST MV AGUSTA Varese, Italy, 15 October 2009 - Harley-Davidson, Inc. (NYSE: HOG) today announced its third quarter financial results and unveiled key elements of its go-forward business strategy to drive growth through a single-minded focus on the unique strengths of the Harley-Davidson® brand. As part of this strategy, the Company will divest its MV Agusta unit and also discontinue the Buell® product line. “Our objective in acquiring MV Agusta last year was primarily to expand our presence in Europe, and was a recognition of MV Agusta’s proud legacy. While growth in Europe and other global markets remains highly important to us, we believe that focusing our efforts on the Harley-Davidson brand is the optimal path to sustainable growth,” said Matt Levatich, President and Chief Operating Officer of Harley-Davidson Motor Company. “This decision was not made lightly. MV Agusta is a great company with a proud heritage and brand, high-quality exciting products, and a passionate team with whom we have achieved a great deal over the past 14 months” Mr Levatich added. Harley-Davidson acquired the privately held Italian motorcycle maker MV Agusta in August 2008 and key achievements since then have included the reinstating of production at the Company’s Varese factory and the re-starting of product development – leading to the recent unveiling of the re-engineered Brutale to great accolades from dealers and customers alike. “With a streamlined business and such an exciting product pipeline we sincerely believe that MV Agusta is well positioned for the future,” said Mr Levatich. Harley-Davidson will now begin actively looking for a buyer for MV Agusta to continue along the development of the brand as an outstanding manufacturer of premium, Italian performance motorcycles. MV AGUSTA-BRUTALE 1090RR
www.mvagustausa.com LE 1090RR: Identity transformed. MADE IN MV. Almost a decade has passed since the appearance of the first Brutale, a prestigious, naked motorcycle with fascinating design, power, and speed. Its characteristics, unique and unmistakable, have made it famous the world over, enabling it to win coveted prizes as the most beautiful motorcycle of the year. The Brutale pushes the limits of research and technology in its 2010 models - the 990R and the 1090RR. With its state-of-the-art components, the 2010 Brutale delivers acclaimed performance and ease of riding, in keeping with the “Made in MV” formula: a commitment to excellence in componentry, in the design of which MV Agusta is at the forefront. The “easy” handling enable the Brutale to compete with the Japanese nakeds: it is agile and instinctive in the hands of the rider. It excels on the racetrack, and its eclectic elegance and charm thrill even the casual admirer. To achieve these results, it was necessary to replace 85% of the components, but the new Brutale has preserved the significant style features of previous versions. The work carried out on the 990R and 1090RR cannot be defined as mere restyling; rather, it is a silent MV Agusta revolution. BRUTALE NEW ERA: 85% of the components are new and were DESIGNED BY MV AGUSTA There is little left of the old Brutale model, as 85% of the parts have been completely redesigned. From the aesthetics, to the engine, to the rolling chassis, no component can be interchanged with those of the previous versions. Among the new parts: Front wheel rim, either gravity die-cast, or forged Front brake disk Suspensions Internals (oil dynamics and components of the front fork) Instrument cluster (design, logic definition and information handling) Brake pump with integrated tank Headlight Mirrors with directional indicators Handlebar Handgrips Steering damper Fuel pump Fuel filler cap Inner damper (oil dynamics and inside components) Rear swingarm Rear turn signals Taillight Pressure die-cast rear taillight support Rear wheel hub, either gravity die-cast, or forged Many of these parts have been designed and crafted by MV Agusta, rather than sourced from market suppliers, thereby affording technical and aesthetic perfection.
