JACKPILE MINE | FROM COVER United States for nuclear weapons in the Cold War came from New Mexico thanks to the Grants Mineral Belt, a rich deposit of uranium ore that runs through the northwest corner of New Mexico. The mining started before regulations were in place to protect the surrounding air, water, and public health.

The Pueblo has fought for decades to undo that damage.

These days, only clean-up crews work there, like those Lorenzo sees drilling groundwater monitoring wells, as she drives to her job as a judge with the Pueblo of Zia. “ People grew up not even t h i n k i ng about t he m i ne because it wasn’t in their lifetime,” Lorenzo said. “They don’t even realize it’s a concern.”

But Lorenzo does. She’s noticed the effects on the tribe’s traditional practices, and water sources and the lingering health problems, like cancer, respiratory illnesses, and kidney diseases, though decades later, the Pueblo still waits for a thorough health analysis.

The U.S. Bureau of Indian Affairs and Bureau of Land Management had approved a clean-up plan for Jackpile in 1986 and declared work complete in 1995. But now, it’s a Superfund site, joining the list of the nation’s most heavily polluted places and a priority for remediation work to protect public health and the environment.

The U.S. Environmental Protection Agency is just now drilling groundwater monitoring wells, 40 years after the mine closed, as the agency assesses the extent of the contamination and how best to address it. Meanwhile, community members live with polluted land, water, and air they worry is slowly killing them.

LOCAL NEWS hundreds of former mines and mill sites. Many fall under the oversight of the federal Office of Legacy Management, which monitors for mer ura nium mines and mills tied to nuclear weapons and energy programs when clean-up work is declared completed.

The agency faces the prospect of some of those sites needing additional work to protect public health. The task ahead means planning for waste that will remain hazardous for hundreds, if not thousands of years, through a sea of unknowns, while fi nancial limitations mean prioritizing which risks merit the fastest response.

“When you look at the hills, you can see they’re crumbling, and you can see the water that’s re-emerged in the pit,” Paul Robinson, who has watchdogged the Jackpile mine for decades as part of his work with the Southwest Research and Information Center, said.

“That’s damage left from something the company made a good profit on and the country built its nuclear weapon stockpile on. It made the country great, but it left the community with damaged lands that may or may not be cleaned up.”

upended a matrilineal culture in which duties split evenly between husbands and wives, Lorenzo’s research has also

found, and triggered persistent problems with alcoholism, drug abuse, and family breakdowns. Families sold off livestock, left fields untended, and missed traditional events and ceremonies to accommodate mine work schedules.

None of that has been set right since the mine closed, she said. Neither has the ground itself.

The A naconda Copper Mining Company (which later merged with Atlantic Richfield, or ARCO) leased 7,868 acres beginning in 1953, and dug three open pits, moving 400 million tons of rock to produce 25 million tons of ore. When

Located in central Arizona’s Tonto National Forest (near the town of Superior), Oak Flat is also an important part of America’s public-land heritage.

The site is world-reknowned for rock climbing, thanks to its beautiful and impressive rock formations. The endangered Arizona hedgehog cactus lives there, and an endangered ocelot, sadly, was killed on the highway, just a few miles from the popular Oak Flat campground. The cool, perennial

New Mexico courts work to prevent evictions, improve housing stability Staff Reports

S

ANTA FE – A new courtbased program will assist New Mexicans facing the possible loss of housing during the pandemic and provide landlords with an alternative to evicting tenants unable to pay their rent.

The Eviction Prevention and Diversion Program will be piloted in the Ninth Judicial District of Curry and Roosevelt counties starting Feb. 1, and will be expanded statewide in March.

“Courts will provide trained facilitators in eviction cases to help landlords and tenants resolve disputes over rental pay ments,” Ch ief Justice Michael Vigil said Jan. 4 when he announced the program. “The goal is to negotiate a settlement acceptable to property owners and renters, allowing people to remain in their homes, while fairly compensating the property owners through emergency rental assistance.”

“This initiative to help financially vulnerable New Mexicans was developed collaboratively with input from courts, state agencies, local governments, property owners, housing advocates, and providers of legal services,” Justice C. Shannon Bacon said.

UNDER THE PROGRAM • When tenants receive a legal notice that an eviction petition has been filed in court, they will also get information to help them access legal services, financial assistance for rent and utilities, as well as re-housing for people who may lose their home or have already lost it.

• At the start of a hearing or trial in an eviction case, judges will advise the tenant and landlord about the Eviction Prevention and Diversion Program and the availability of federally-funded emergency rental assistance administered by the state.

• If the parties agree to participate in the program, the case will be put on hold for a minimum of 60 days while negotiations are underway with NEWS

Justice C. Shannon Bacon a court-appointed settlement facilitator. If needed, a court can grant up to 30 additional days for negotiations. The court will dismiss the case if a settlement is reached. The case will proceed if there is no settlement and a judge can issue an eviction order, known as a writ of restitution.

If evicted, tenants may access re-housing assistance through the Eviction Prevention and Division Program.

Early in the pandemic in March 2020, the Supreme Court paused evictions for tenants who provided a judge with sufficient evidence of their inability to pay rent during the pandemic.

Under a court order issued Jan. 4, the stay on evictions for non-payment of rent will be lifted in Curry and Roosevelt counties when the Eviction Prevention and Diversion Program begins there. Once the program takes effect statewide, the eviction moratorium will be lifted in all other counties.

Family’s search for missing father continues a month later

A

family living near Yatahey is hoping for any help from a watchful public after making it through the holiday season without one of their own.

Jimmy “Shawn” Peterson, 57, of Yatahey, has not been seen since Nov. 19. His family, including sons, Lamar, Kendall, Steven, and Jeremy have repeatedly shared flyers across Gallup and with local law enforcement to help fi nd Jimmy Peterson and bring him home.

However, despite the ongoing efforts, Lamar Peterson sa id t here have been no

updates from anyone as of Jan. 5.

THE DISAPPEARANCE Jimmy Peterson was last seen walking from Yatahey toward Gallup on Nov. 19. The last person to see him was Lamar Peterson’s nali, as he told the Sun. “The last time I saw him in person was Halloween day [Oct. 31],” Lamar Peterson said. “It was at his residence in Yatahey where I spoke with him briefly.”

The conversation had not been a pleasant one due to some personal circumstances, Lamar Peterson said. He added his father lived in Yatahey with his stepsister and his nali,

Jimmy Peterson Sr. “The last I heard from him, he was taking care of [my nali],” Lamar Peterson added.

The rest of the family stated Jimmy Peterson mostly stayed at his home in Yatahey and was also taking care of the stepsister, who also had children of her own to whom he was attached.

Jimmy Peterson told the others at the residence he was going to walk to T&R Market and then to Gallup on Nov. 19, the last time he was seen by any of them.

THE REPORT FILING Despite being missing since November, the family was not informed of Jimmy Peterson’s

disappearance until Dec. 12.

A missing persons report was then fi led on Dec. 13.

“We have spoken to the McKinley County Sheriff’s Office, Navajo Nation Police, Gallup Police Department, Gallup FBI, and the BIA law enforcement,” Lamar Peterson said. “We have posted flyers all across Gallup and we also post about it on Facebook.”

He added each member of the family carries posters with them when they travel to Gallup and have passed out more than 500 to date.

Lamar Peterson requested the names of his brothers be shared, stating that each of them along with their children want to see Jimmy Peterson returned home safely.

The suspect was wearing a black jacket, beige pants, and blue shoes, and was seen running from the store in a westward direction.

Deputy Paul Davis arrived and was told the suspect was seen running toward Windsong Avenue. He went to a vacant burned down structure on Windsong a nd found two people.

Davis met Andy Garcia, 31, no address listed, who matched the description of the suspect.

Largo examined the broken window and found traces of blood on the window blinds, and on the f loor. Another employee arrived and told Largo she had left the business at 4:50 pm the day before and the window was not broken at that time.

The estimated da mage came to about $150. There was no security footage available.

Bowannie found him standing behind one of the nearby trees and instructed him to follow him to his unit, which Hosteen did.

A pat down showed Hosteen had a bottle that appeared to be glass in his pocket. When Bowannie moved to remove it, Hosteen became disorderly and tried to break away.

Bowannie was able to get Hosteen under control by grabbing his right arm, which appeared to be injured, since it was bandaged. Hosteen moved to the ground before he agreed to get inside the police unit, where Bowannie removed the bottle from his pocket before transporting him to Gallup Indian Medical Center.

Hosteen was still disorderly on the way to the hospital, but did calm down and agree to be evaluated once they arrived. The report showed he remained at the hospital for

Oak Flat would be utterly destroyed and unsafe for human visitation in perpetuity.

Rio Tinto has made headlines for destroying a sacred site in Australia, the Juukan Gorge. In response to shareholder pressu re the CEO resigned, and the company issued a statement saying,

CARWASH STREET RACER Gallup, Aug. 8 An orange Corvette was doing a burnout in the parking lot of Premier Carwash, 1115 W. Hwy. 66, about 8:20 pm.

Gallup Police Officers Warren Bowannie and Dominic Molina were at the scene when one of the persons at the lot, later identified as Antonio Ponce, 31, of Gallup, walked up to Molina’s window and began yelling at him.

The owner of the business arrived and told the group to leave if they were not using the carwash services. Ponce did not leave and Bowannie informed the owner they could write up a trespass notice for him.

When the owner arrived to talk to police about issuing a trespass notice against Ponce, Ponce drove away. The owner informed police he had issues with street racers loitering at the carwash. Additional patrols were requested by the owner.

‘The Tragedy of Macbeth’ is fi lled with haunting images, powerful roles

Of all of the plays ever written, Shakespeare’s “Macbeth” is one of the most enduring and

famous. It has been performed countless times and has been adapted to film on several occasions (perhaps most notably in a 1971 feature starring Jon Finch). So, one would think that nothing new could be done with this very familiar source material. While that assumption is true to an extent, “The Tragedy of Macbeth” still manages to exceed expectations.

For those unfamiliar with the original story, it involves a noble Scottish lord named Macbeth (Denzel Washington). After fighting bravely in battle for King Duncan (Brendan Gleeson), he is informed by a trio of witches that he will soon be King. Both the lead character and Lady Macbeth (Frances McDormand) are pleased by this prediction.

But greed and lust for immense power soon begin to influence their actions.

In order to attain the throne rapidly, Macbeth is convinced by his spouse to secretly murder the King. Their plan works, but soon it becomes clear that finalizing their accomplishment requires tying up and removing many loose ends. Macbeth becomes a panicky, distrustful, violent and murderous authoritarian, wiping out anyone with the potential to expose his criminal act. Guilt and madness begin to take hold, threatening to ruin everything.

Both Macbeth and Lady Macbeth are meaty roles and the two lead performers sink their teeth into the material. Director Joel Coen (“Miller’s Crossing,” “Fargo,” “No Country for Old Men,” “Inside Llewyn Davis”) keeps things moving at a surprisingly rapid pace. The story has been pared down and condensed in comparison with other adaptations.

The film actually benefits from being presented in an abridged manner. While the story is still clear and as it appears in the classic play, there isn’t a wasted minute onscreen.

Still, what really elevates

this particular version is the technical panache on display.

The movie looks phenomenal.

While it is clear that most of the film was shot on a soundstage, the process has allowed the production design and cinematography to really stand out. It is shot in black and white in a boxy 1.33:1 or 4:3 aspect ratio that feels claustrophobic, especially when the camera is tight on the actors’ faces.

The interiors are sparse-looking and cold, while bits taking place on exteriors are even more wonderfully moody and expressionistic. From the fog-shrouded fields to the stark, inky blackbare trees set against crumbling structures, the movie’s sets maintain a gorgeously gloomy appearance. One expects that

those involved in the look of the picture may receive some significant award nominations in the coming weeks.

So, while this is a fairly faithful and familiar telling of the famous tale, the accelerated storytelling, committed performances, and incredible camerawork ultimately result in a unique experience. If you’re curious about the work of Shakespeare or simply want to see a masterclass in set design, lighting, and photography, then “The Tragedy of Macbeth” is something you will want to check out. The haunting images on display in this tragedy will likely make as much of an impression as the tale itself.

Initial environmental reviews by federal agencies cautioned without cleanup the mine site would present a public health hazard, including increasing radiation-induced cancer deaths.

What should have happened, but didn’t, would have been to bury the leftover uranium-laden ore with clean soil deeply enough to protect nearby water sources from it and other contaminants found with the uranium, like

In January 2021 the Apache Stronghold filed an historic lien on the land, per the 1852 Treaty of Santa Fe that had granted Apaches a parcel of land including Oak Flat.

This and the lawsuits from the Stronghold, Tribe, and allies have slowed the land exchange.

Rio Tinto’s website says it works in 35 countries and its geologists explore the Earth’s

chromium, cobalt, manganese, vanadium, and zinc. That work would have also preserved a Goldilocks-level of soil moisture: If soil is too dry or too wet, it releases radon, which is linked to lung cancer.

“From the plan that was proposed at the time, it didn’t seem like there was much attention to the thickness and the material in the cover,” Chris Shuey, who co-authored comments criticizing the cleanup plan in 1985, said. “We said, ‘If you simply backfi ll the pits, eventually groundwater is going to recover through that material, and it would appear at the surface, and when it appears at the surface, it’s going to be contaminated.’ They said, ‘Well,

that’s too expensive, that’s not part of the plan.’ … So I think we thought, at the time, it was a plan for failure.”

Documents from 1985 show researchers tracking uranium and arsenic from the Grants Mineral Belt as far downstream in the Rio Grande as Elephant Butte Reser voir, affecting drinking water and irrigation sources for roughly 200 miles through New Mexico.

In 1986, Atlantic Richfield negotiated a cash settlement with Laguna Pueblo for $45 million to complete the remediation work. The tribe was eager to address an unemployment rate that had soared above 80 percent following the mine’s closure, and so created the

Laguna Construction Company to complete the remediation.

The company employed about 60 people, nearly all tribal members, many of them former mineworkers. They followed the plans and reclamation standards set by the BLM and BIA. The focus: remove risks from mine waste piles that contained traces of uranium by fi lling pits in the mine higher than the water table to prevent ponds from forming in them, contour waste piles to reduce erosion, and scatter native grass seeds.

Some remediation was better than nothing, at least for a while.

“We will look back and say, you know, environmentally, that was really not the best plan for reclaiming the land, because what happened was, it rained, and a lot of the cover came undone, and contaminated the water that runs through the Pueblo,” Lorenzo said. “The design—which, you know, they did when there were no standards in existence, right?—was the best they could have, and now, we know that environmentally, it could have been better.”

The bill follows years of uncertainty regarding the status of the land. Arguments in a lawsuit fi led in January by the nonprofit Apache Stronghold were made before the Ninth

Circuit Court of Appeals in Oct. 2021. A ruling is expected this year. The group’s website Apache-stronghold.com at says its mission is “to battle continued colonization, defend holy sites and freedom of religion.”

All property subject to valuation for property taxation purposes not valued by the Assessor in 2021 for property taxation purposes must be reported to the Assessor no later than the last day of February 2022, unless it is not subject to valuation and be on a form that is obtained from the Assessor’s office. Lifeline Service Lifeline service is a government program designed to make monthly residential telecommunication services more affordable to eligible low-income customers.

The Federal Subscriber Line Charge, of $6.50, is waived for Lifeline customers.

Customers who are eligible for the Lifeline program are also eligible for toll blocking at no additional charge. The Federal Lifeline discount is $5.25 for qualifying voice service or $9.25 for qualifying broadband service. In order to be eligible for the Federal Lifeline discount, a customer’s annual household income must be at or below 135% of the Federal Poverty Guidelines or a customer must participate in one of the following programs: Supplemental Nutrition Assistance Program (SNAP); Medicaid; Supplemental Security Income (SSI); Federal Public Housing Assistance; Veterans Pension & Survivors Pension or qualifying Tribal Programs.

WHO IS ELIGIBLE? We determine your eligibility based on income limits developed by HUD. HUD defines low income as families who have gross incomes of 30% up to 80% of county median incomes. Gallup Housing Authority can provide you with information on income limits for the Gallup-McKinley County area.

HOW IS RENT DETERMINED? Your rent is based on your family’s anticipated gross annual income less authorized deductions/allowances.

HUD allows the following deductions/allowances: $480 for each dependent; $400 for elderly or a person with a disability; and some medical deductions for families headed by an elderly person or a person with disabilities. Some deductions/allowances will have to be verified before they are allowed.

Annual income is the anticipated total income from all sources received from the family head of household, spouse, and each additional member of the family 18 years of age or older. Once Adjusted income is determined then your rent is set at: 30 percent of the monthly adjusted income; 10 percent of monthly income; or minimum rent of $50.00; whichever is the highest.

WAITING LISTS and APPLICATION INTAKE: Since the demand for housing exceeds the available housing units, applicants are placed on waiting lists by bedroom size. To get on the waiting list you must submit an application. Currently, application intake is conducted on the 1st, 2nd and 4th Fridays of every Month from 8 am to 11 am.

Applicants are selected as they move up to the top of their respective waiting list. Applicants must be ready to lease when their opportunity to get a housing unit comes up – This means you must have “funds in hand” to pay 1st month’s rent and a security deposit.

CLOSING REMARKS: Just being “poor” or low income does not automatically get the family into a rental unit. It is a process – you have to complete the paperwork – pass required background checks – show up for appointments – be ready to pay when you lease-up - You have to do your part, otherwise we can’t help you.
