* * * Plaintiffs, * * v. * CIVIL ACTION NO. * 1:14-CV-01180-WSD DEBORAH ADERHOLD, et al, * * Defendants. * __________________________________________________________________ DEFENDANT DEBORAH ADERHOLD’S MOTION TO EXCEED PAGE LIMIT __________________________________________________________________ COMES NOW, Defendant Deborah Aderhold, State Registrar and Director of Vital Records for the Georgia Department of Public Health (“Registrar Aderhold”), by and through counsel, the Attorney General of the State of Georgia, and respectfully requests leave to file a brief in support of her motion to dismiss which exceeds the limit of twenty five (25) pages allowed under Local Rule 7.1.D. Registrar Aderhold moves this Court for leave to file a brief no longer than forty five (45) pages in support of her motion to dismiss. In support for this motion, Registrar Aderhold notes that the complaint (Doc. 1) in this action is one-hundred and nineteen (119) paragraphs in length and includes claims for relief under 42 U.S.C. § 1983 alleging violations of the United

States Constitution’s guarantees of equal protection and due process in an area with rapidly evolving legal developments. Registrar Aderhold has prepared a motion under FED. R. CIV. P. 12(b)(1) and FED. R. CIV. P. 12(b)(6) that addresses various defenses to Plaintiffs’ asserted claims, including that this Court is without jurisdiction over Plaintiffs’ attempted claims as there is no substantial federal question at issue, and that Georgia’s marriage laws, which must be scrutinized under rational basis review, do not violate the guarantees of due process or equal protection under the Fourteenth Amendment. Registrar Aderhold requests an additional twenty (20) pages, such that she is permitted to file a brief in support of her motion of not more than forty-five (45) pages in length, in order to adequately address all of the claims asserted against her.
