BACTA chief Leslie MacLeod-Miller believes that the Gambling Commission’s recent assessment of the Newham licensed betting office ruling is flawed. he Gambling Commission’s legal analysis of the recent ‘Newham case’ has come under fire by BACTA, prompting its chief Leslie Macleod-Miller to question the Commission’s interpretation of key elements of the GamblingAct. When the Judge in the Newham LBO case allowed another bookmaker (in this instance,Paddy Power) to set up shop on its high street, the Gambling Commission disagreed with his assertion that primary gambling activity was an area solely for the Gambling Commission to look at,not licensing authorities.In the Commission’s opinion, its own stance was clear under the terms of section 153(1) of the Gambling Act 2005 which determined the regulator’s duties in this complicated scenario. The Commission reminded local authorities of their powers,stressing that when issuing premises licences or ensuring that licensing objectives are being met,they must have regard to guidance issued by the Commission and to the codes of practice they publish, including for example those on primary gambling activity. BACTA CEO MacLeod-Miller has an alternate view on the matter.He told Coinslot:“Once again the Gambling Commission’s legal analysis has been found to be flawed, yet the Commission persists in attempting to reinforce its opinion.Worse still, the Commission will attempt to encourage local authorities to make decisions based upon the Commission’s misguided interpretation of the law which would require local authorities to spend vast amounts of money which the Commission is not willing to commit.” MacLeod-Miller continued: “It remains a matter of common informed view that the Commission’s interpretation, which imports the concept of primary gambling activity,was neither intended by Parliament nor supported

Set at the centre of one of Torbay’s best beaches, Paignton Pier is nowadays a busy landmark attraction among seaside tourists and families. The pier comprises an entrance building at the shoreward end along with a series of individual pavilion buildings along the neck, which form a single large amusement arcade, featuring rides, crazy golf, jackpot bingo, ten pin bowling, trampolines and amusement machines.

Early Day Motion critical of BBPA beer tie conduct BEER TIE

British Beer and Pub has come under TfireheAssociation after an Early Day Motion was launched in Parliament criticising its actions surrounding beer tie reforms. Greg Mullholland, chairman of the Save The Pub Group, claimed in the EDM that the BBPA and large pub companies had made “repeated misleading statements” over the impact of ties between pubcos and licensees. The EDM described what it called a “desperate bid to stop the government fulfilling its promise to enshrine in law the

principle that a tied licensee should not be worse-off than a free of tie licensee”. It said: “This is a cynical attempt to persuade the government not to fulfil its commitment to reform the failing pubco busi-

ness model through a statutory code of practice for companies with 500 or more pubs. “These organisations have sent reports and other documents to the Department for Business, Innovation and Skills presenting them as evidence of the negative effects of reform when there is no reliable evidence to back up these claims.” It singled out BBPA chief executive Brigid Simmonds for criticism, accusing her of giving “incorrect and misleading statements” before a Business, Innovation and Skills Committee in June and claiming she had admitted providing two incorrect statements.

The EDM also referenced a parliamentary report in which pub company bosses were said to have given “partial and in one case positively false information to the Committee”. A BBPA spokesman told The Publican’s Morning Advertiser that Simmonds had already clarified these issues with the select committee and with Mullholland. They said: “This is very much a distraction from the key issue now facing government, which is the potential for a hugely damaging intervention on Britain’s brewers and pubs, and what instead they can do to help create a climate for investment, growth and jobs in our industry.”

alex lee comment ome reliable industry sources have told me that the Triennial Review will finally be with us later this year, hence some of the reaction in this week’s magazine. While no official announcement has yet been made from the DCMS, it shouldn’t be too long before the long-awaited lift in stakes and prizes gives us all a bit of a boost from the factory floor upwards. Although trading has been tough in recent years, the recent spate of good weather has handed the industry a lift and the above announcement represents further positive momentum for the beleaguered coin-op sector. The up-coming Triennial won’t be a panacea for all the coin-op industry’s ills, but by the same token it should prove to be more than just a band aid to patch it up. If a glut of new games, better features and inventive gameplay styles don’t arrive, then it will be incredibly disappointing for all, not least the end user who has more things competing for his leisure time and spend - than ever before. The above paragraph may sound wildly optimistic, but let’s be honest

we’ve been crying out for a Triennial for so long now that our voices are hoarse. Now it seems to be coming it’s time to look beyond the recent cashbox boost that the warm weather has helped stimulate and plan for EAG 2014 and beyond with some spectacular new products. While I was naturally impressed by their plans mentioned elsewhere in Coinslot, I’m sure Praesepe aren’t alone in their advance preparation for the Triennial. Once again, despite the nay-sayers accusing the coin-op sector of being at best an old-fashioned remnant of a bygone era or at worst dead and buried, there are several positives to be taken about our sector’s gradual reinvention against pretty poor odds. As I write this, a roar of thunder has erupted. In years gone by this would have reflected murmurs of discontent and the closure of arcades. I’d like to think that the noise is now indicative of the start of a new era for coinop, where the emphasis is less on survival of the fittest, but more on building on the bedrock of technological nous and gameplay know-how that the industry should be famous for.

Today’s gaming machines are complex chunks of engineering, with a mixture of moving parts and digital electronics, and frequently with components produced by multiple manufacturers. Their reliability is high, but still things do go wrong, and a single fault can make a machine unusable - whether that’s because it literally prevents it from functioning at all, as when a cashaccepting mechanism fails, or because it so seriously affects the playing experience that no customer will waste their money on the unit. So repairs - and regular preventative maintenance, if needed are essentials, not luxuries, for gaming operators. In many pubs, for example,

gaming machines can account for between 20 and 50 percent of trading revenues, according to Gamestec, which manages some 35,000 units across the country. They are also important sources of revenue in other sites such as adult gaming centres, licensed betting offices, clubs and casinos. To ensure that they are kept up and running, Gamestec has developed an infrastructure based on a central services team, which provides repair of electronics, parts distribution and centralised ordering. “We know how important it is for our customers that machine faults are resolved as quickly as possible. In response to this we developed a robust infrastructure for repairs and also invested in training for our engineers so they are the best in the business,” says Peter Collinge, Gamestec’s operations director. “We also aim to minimise instances of faults occurring in the first place, by making sure all machines in our estate are serviced regularly and that we choose the most reliable models to offer to our

customers. As part of our commitment to fast response times we recently expanded our team of rapid-response motorcycle engineers so they now cover the whole area within the M25. The introduction of motorcycle engineers in London has slashed response times by around 50 percent and we are currently looking at introducing motorcycle engineers to other metropolitan areas where traffic congestion is a problem.” But what about the smaller operator who’s not tied into a contract with a big supplier like Gamestec? Failures are relatively rare and the skills required to repair gaming and amusement machines command relatively high pay, so it’s not costeffective to keep a technician on staff against the eventuality of problems. The answer, says Suzo Happ, is to outsource maintenance. “Complexity is an issue that faces gaming operators more and more. Advancing technologies are providing more entertaining solutions to players with multi-game video gaming. Yet

The Scheme has been published and will form the basis of a Bill. Drafting of the actual Bill is to begin right away and it is likely that it will be published in 2014. If the Gambling Control Bill becomes law, Ireland’s existing and outdated legislation for gaming and betting will be replaced with legislation that takes into account the numerous and significant developments in the industry since the current laws were enacted in 1931 and 1956. The government plans a unified national regulatory system for gambling and gaming in Ireland. A new licensing system will be introduced covering land-based betting and gaming, as before, but it will also extend to casinos and remote gambling. A new body called the Office for Gambling Control, Ireland (OGCI) will be established. It will issue all new licences and carry out compliance and enforcement activities.The Minister’s executive regulatory functions will be discharged by the OGCI, whilst the Minister will retain responsibility for general policy. The OGCI will be situated within the Department of Justice and Equality.Applications will be able to be made for a number of different types of licences including betting and gaming licences, remote and land-based licences. The OGCI will be financed, at least in part, by fees from licence applicants and holders. There will be a Social Gambling Fund; created by a levy on operators based on a percentage of their turnover. Fixed Odds Betting Terminals are explicitly prohibited. The Scheme indicates an intention to remove the prohibition on the enforceability of bets in court: in the future gambling contracts will be enforceable. All operators will welcome this proposal, as

there are difficulties in dealing with legal disputes involving these contracts. Operators will pay close attention when details of the proposed financial viability tests emerge, as the Scheme anticipates licence holders complying with financial viability tests aimed at ensuring that they have adequate reserves to meet players’ winnings. It also flags that certain licence holders may have to lodge a sum in an Irish bank as security;this security may be used for any fines or financial penalties are imposed on the licence holder. The Scheme includes plans for measures to protect vulnerable persons such as age restrictions,staff training,self exclusion, and controls on advertising, promotions and sponsorship. It proposes major changes in relation to bingo and, in particular, separates bingo from lotteries. Under the existing law, bingo is a lottery. The Scheme provides that no more than 40 casino licences may be in operation at any one time in Ireland. It is reported that there are currently 34 private members clubs registered under the present antimoney laundering legislation. Regulation of gambling is a complex area and it is expected that it will take some months to draft a bill from the contents of the Scheme.While there is no official consultation process, parties are welcome to submit comments on the Scheme to the Department of Justice and Equality. It is unlikely that any change in law in Ireland will take place during 2013 or early 2014. In conclusion, most interested parties in Ireland have long been in agreement that the current principal gambling laws (from 1931 and 1956) do not adequately address the challenges or opportunities presented by modern gambling, particularly in terms of technology.We welcome the Gambling Control Bill as it will introduce significant reform through the establishment of a regulatory and licensing regime, but will continue to review and monitor the detail of the proposals as they evolve.
