Gambling Commission and National Lottery Commission merge MERGER

Following Parliamentary approval, the Gambling Commission and the National Lottery Commission merged on 1 October 2013. No change has been made to the legislation which governs how commercial gambling and the National Lottery are regulated, but life for the regulator will be slightly different going forward. he two leviathans of UK gaming regulation - the Gambling Commission and the National Lottery Commission - have officially joined forces.

The Gambling Commission and the National Lottery Commission have been located in the same offices in Birmingham since January 2012, allowing them to share common services such as IT and Human Resources. From 1 October 2013 the merged body, the Gambling Commission, will license and regulate all commercial gambling and the National Lottery in Great Britain (except spread betting, which is the responsibility of the Financial Conduct Authority).

Philip Graf, chair of the Gambling Commission, said: “As we bring National Lottery regulation under the umbrella of the Gambling Commission we will be better placed to carry out our role by combining the expertise of both organisations, as well as building on the National Lottery Commission’s successful record in maximising returns to good causes.”

Dr Anne Wright, chair of the National Lottery Commission until the October 1 merger, said:“I have very much valued the opportunity to Chair the National Lottery Commission over the last eight years, which have seen steadily increasing returns to good causes.”

Wright admitted that there were challenging times ahead,but believes the merger will prove to

be beneficial to all in the long run.

She added:“No doubt the coming years will present just as many challenges in regulating the National Lottery, but, I am confident the Gambling Commission will continue to protect both the interests of Lottery players and the integrity of the National Lottery, as well as maximising the billions of pounds raised for good causes across the UK.” Aware of the public and political attention that the merger will no doubt attract, the DCMS’ Hugh Robertson stated:“I am certain we can expect a high degree of public and commercial scrutiny around decision-making whilst procedures for the newly-merged

The late August bank holiday weekend already seems a distant memory, but the Gambling Commission used it to announce its latest round of under-age test purchasing, according to law firm Joelson Wilson. he Gambling Commission has revealed that tests of smaller adult gaming centre and independent betting shop premises earlier in the summer had revealed some weaknesses in operators’ systems for identifying and challenging youngsters who enter the premises hoping to play gaming machines.Those tests were conducted in collaboration with local authorities and the police, and focussed upon access to gaming machines by young people who did not seek interaction with staff first, in order to assess operators’ ability to identify and prevent underage gambling.

In the past, the Commission has carried out test purchasing where the youngsters interacted with staff by,for example,visiting the cash desk for change.

This gave staff the chance to identify and challenge them.

In the tests earlier this summer, the Commission found that, in over half the cases, young people were able to access premises and play the machines, reflecting, it said, its concerns that certain sections of the industry do not have sufficient safeguards in place.

The Commission further said that it was expecting to see an improvement in results as the programme, which was due to last “for the next few months”, continued. No doubt it will make known its findings in due course.

Exempt from the programme have been those operators who have persuaded the Commission that they are effectively monitoring their policies, either by using third party testing companies and sharing the results with the Commission, or who are members of trade associations that make test pur-

He concluded: “The most important outcome of the ASA ruling is that it clearly shows that we have been able to substantiate that FOBT roulette is not as fair to the gambler as the traditional casino table game roulette.

This is because the FOBT plays up to several times faster, meaning FOBT gamblers lose several times faster than casino roulette gamblers at the same stakes.”

In a report published last week, the DCMS has warned that the success of the UK’s creative industries may be put at risk by failure to protect intellectual property rights.

The Committee says that such illegal piracy, combined with proposals arising from the Hargreaves review to introduce copyright excep-

tions, and a failure to strengthen copyright enforcement along the lines envisaged by the Digital Economy Act 2010, together threaten the livelihoods of the individuals and industries that together contribute over £36bn annually to the UK economy.

Included in the recommendations from the committee is a specific dispensation for the video games industry. The committee believes the government should redouble its efforts to ensure that the video games tax credit is approved by the European Commission and introduced as soon as possi-

ble: and that current delays are harmful to the industry.

Among other requests, the Committee is calling for a central champion of Intellectual Property (IP) in government to promote and protect the interests of UK IP; the maximum penalty for serious online IP theft to be increased to 10 years imprisonment, to bring it into line with the punishment for such offences in the physical world; and reforms to the income tax and tax reliefs systems to adequately recognise the freelance nature of much creative work.

The delays in implementing measures to prevent piracy in the Digital Economy Act are costing the creative industries millions of pounds with serious consequences for the wider economy.”

She was returning to her vehicle in the pub car park when she was attacked from behind by two hooded men and struck repeatedly around her head and shoulders. Her attackers snatched her car keys and she was pushed to the ground before her work case was taken, along with all the takings and her company car.

Staff from the pub heard her screams and tried to intervene. One witness narrowly escaped being run down by the offenders and was dragged along while holding on to one of them through the car door.The vehicle was found abandoned a few miles away and officers found Wayne Dial with the car.

He had returned to the vehicle to help dispose of evidence left behind by Hooker and Dodgin. Officers from the dog section and traffic followed him along a nearby railway line and arrested him on his way back towards his home address.

When police went to his home, they found Hooker hiding in the kitchen together with the victim's case, some of the stolen cash and the cosh which had been used in the attack. The former owner of Margate’s Dreamland amusement park wants to quash the compulsory purchase order that gave control to Thanet County Council, saying its plans for the site are the most financially viable. he latest round in the fight for ownership of Margate’s historic seaside Dreamland amusement park has taken place in the Court of Appeal.

The previous owner of the site, DreamlandLive, wants to reverse the compulsory purchase order that passed control of Dreamland to Thanet County Council after it was backed by the ruling of a High Court judge in May. The council, in partnership with the Dreamland Trust, want to create a heritage theme park with historical rides, classic sideshows, vintage cafes, restaurants and gardens.

Glover also accused the High Court Judge that backed the order of failing to grapple with any of the issues raised about the commercial viability of the council and the Dreamland Trust’s plans for the site.

Glover said:“Taken collectively, it is plain that the conclusions on commercial viability and durability are not safe.”

DreamlandLive’s alternative proposals involve an amusement park on part of the land and the building of up to 500 homes on the rest, arguing that is was the most

financially viable option.

Both the Communities Secretary and the council defended the legality of the order at a one-day hearing before Lord Justice Goldring, Lord Justice Elias and Sir David Keene.

On hearing that the appeal was to be brought, Thanet County Council leader Clive Hart said:“The continued legal challenge is nothing short of frustrating.

“With support from the Secretary of State, and the High Court, we are hopeful that the right outcome will be determined at the appeal, and will continue to do all we can to unlock

the regeneration of this part of Margate.”

Dreamland fell into disrepair after closing its gates in 2003, and the council said it had been forced to carry out repairs to important heritage assets on the site, which had been left neglected It has already secured £10m of funding for phase one of the redevelopment, which includes restoration of the Grade II-listed scenic railway ride that was damaged in an arson attack in 2008.

The judges have reserved their decision until a later date.

New arcade set for Portobello REGENERATION

Although smaller than its predecessor, the new arcade will be accompanied by a café, alongside 73 flats with underground parking, at a new development on the site of the old Fun City funfair.

Margaret Munro, chairman of the Portobello Heritage Trust, said she was sad to see the old amusement arcade go.

She told the Edinburgh Evening News: “It is the end of an era – there has been a funfair and amusements on the site for a long

time. It’s part of the heritage. There was a huge funfair once but over time it has gone.

“It is a building of its time but I was still sad to see it being demolished.

It’s something that you can’t bring back again now it’s gone. Tastes have changed and I suppose we have got to accept that.”

The development project was approved by the city council nearly four years ago, despite

more than 80 letters of objection.

Alastair Hackland, director of Hackland and Dore Architects, said the demolition had gone well.

He commented: “We are hoping to start building work next month. It will be built in phases with the first phase at the western end. All being well, we hope to have the site completed in the next two to three years.”

Resident Bob Jefferson

said the old arcade would be fondly remembered but agreed that the resort needed projects like this one to boost its regeneration.

He explained: “I’m sure people will be sad to see it go but I don’t think there’s the market here for it anymore.

“It will always be part of Portobello’s heritage and I’m sure people will look back at it with nostalgia and fondness.”

The OFT believes that the app sector should stop pressurising minors to pay for add-on game content. Eight principles from the body state that consumers should be told upfront about any possible in-game costs or advertising, and any important information such as whether their personal data is to be shared with third parties.

The OFT also make clear that in-game payments are not authorised, and should not be taken, unless the payment account holder, such as a parent, has given their informed consent. The proposed principles follow the OFT’s investigation into whether children are being unfairly pressured or encouraged to pay for additional content in web and app-based games.

Planning permission was granted in January 2010 for the £100m HD One leisure and retail development on land around the John Smith’s Stadium, but had been held up because of uncertainties over the shares deal.

The stadium shares have now been split 40/40/20 between Huddersfield Town, Kirklees Council and the Huddersfield Giants, the Huddersfield Daily Examiner reports.

Because, to those of us outside the industry, and believe me there are many, that’s all it is.A very good, big, impressive one nonetheless,but despite its size, stature and undoubted time, money and effort spent on its manufacture and securing what could be a lucrative licensing deal it is ‘a bandit’.

The point I’m making here in time-honoured roundabout fashion is we all sometimes just have to cut through the complications and get to the crux of the matter - yes, rather like this comment piece. Will (insert new product name here) attract more than one go once its initial impact has subsided? Will it yield a satisfactory ROI and, most importantly, will players understand it and want to put their hard earned into it over and over? Ultimately, if the player doesn’t like it,everything that’s gone on before has been a complete waste of time.

The new site offers over 30 different search fields ranging from dog-friendly pubs to those that offer newspapers or live music, making the results customizable to each person’s individual preferences.

Another key feature is that of the 35,800 real ale pubs featured, around 22,000 have details of the real ales being served - taking the guess work out of a visit for real ale lovers. CAMRA director Andy Shaw said: “CAMRA has developed WhatPub to be the ultimate online pub guide for all pub-goers. It may even help encourage people who have stopped using pubs regularly, since WhatPub will help them find the ideal pub to

suit their needs.”

The site differs from many pub websites which are based on details provided by the person who owns the pub.

The pub entries are written by local CAMRA members and then approved by dedicated branch volunteers. A full entry offers a description and pictures of the pub, the address, opening hours, who owns it, lists the regular real ales they stock, states whether the pub offers Guest Beers, highlights the pub’s main features e.g. availability of food, gives a map of where the pub can be located, satnav reference, OS reference and highlights the local transport available. As is often discussed in Coinslot, anything encouraging higher footfall levels in pubs has to be actively encouraged.

Elsewhere, one of Portobello’s amusement arcades has been reduced to rubble as builders move in to start

work on new flats, according to the Coin-op Community website.

The demolition of the arcade - which stands next to the derelict site of a once popular fun fair - has been described as the “end of an era”.

A smaller replacement arcade and cafe will be included in the new development alongside 73 flats with underground parking. Two neighbouring B-listed pottery kilns, dating back to 1906 and said to be the last visual remnants of the pottery industry in Scotland, will be retained.

The project was approved by the city council nearly four years ago, despite more than 80 letters of objection.

In its heyday, in the 40s and 50s, Portobello could attract up to 18,000 visitors a day with its diving tower and adjacent funfair. The railway, which was opened in 1846, was a key to Portobello’s success as a

DEAR SIR, I write to clarify some comments in a recent issue of Coinslot re: “Webb provides funding boost for Lib Dem conference” article.

Firstly, the campaign is against FOBTs, not bookmakers. Secondly, the campaign could not serve to protect any interests in casinos and I do not own any casinos. Thirdly, the alleged £40,000 is not a donation. As any of your readers who have exhibited at trade shows will know too well, exhibiting is a costly business.

Fourthly the £40,000 is not an accurate amount for our costs at the Lib Dems.

Fifthly we are exhibiting at Labour and Conservative conferences also.

The most interesting aspect of the article was that Labour MP for Bradford North, Gerry Sutcliffe, the exgambling minister, was quick to comment that “eyebrows would be raised” because the Lib Dems accepted cash from someone who has made a fortune from gambling. I wonder where Mr Sutcliffe’s eyebrows

went when Stewart Wheeler, the founder of a spread betting firm, donated £5 million to the Conservatives in 2001.

But I suspect that Mr Sutcliffe’s eyebrows were stationary when his own Labour Party accepted donations from Neil Goulden; the chair of the Association of British Bookmakers (ABB), the chair of the Responsible Gambling Trust and the Emeritus Chair of Gala Coral. In the last few months, Goulden has given Labour £43,000 and donated £20,000 to Chuka Ummuna’s constituency office.

Mr Sutcliffe is one of the guilty people responsible for enabling the continued FOBT harm to young and vulnerable people, in breach of the 2005 Gambling Act. We have crafted some questions that coin-operatives trade might like to ask Mr Sutcliffe. These can be viewed in a link from this letter on our site www.stopthefobts.org.

In the Playing Safe booklet, among a raft of measures, the industry leaders pledge to look at new methods of product risk assessment, testing the effectiveness of voluntary self exclusion schemes, developing national player protection standards, gathering data on machine play and to sharing information between companies to aid policy development.

At the core of the Playing Safe agenda is an open forum that will draw data from the industry that will drive the responsible gambling agenda. Playing Safe is an NCF initiative and we are very proud of it and the commitment our members are making, but membership of NCF is not a precondition of participation. The Playing Safe Forum (PSF) will be open to NCF members and to a wide range of other stakeholders, including the Gambling Commission and care service providers, as well as academics

and researchers. Uniquely, the PSF will also welcome representatives from the other trade associations.An important consideration for us is that responsible gambling should not be a lever for commercial advantage.

The NCF represents over 90 per cent of the industry but the non-NCF members are welcome to representation on the PSF without needing to join NCF. NCF is recruiting a dedicated project coordinator to lead the work of the Playing Safe Forum and an announcement will soon follow on the appointment of the chair.

The PSF will not be just another talking shop:that would be a disaster.We have had a very clear remit from the CEOs of our major member companies.We intend to lead the gambling industry in its commitment to responsible gambling and to be an engine for change.We have a number of projects which are already under way, like testing the effectiveness of data sharing on facial recognition and an industry wide mystery shopper programme to test our ability to keep young people out of our premises. And there’s much more to come.

The trade body has also amended its name from NCiF to NCF. Dropping the word industry is intended to be a clear signal that casino operators want to encourage participation in the PSF from a group that extends well beyond the industry.
