BACTA drafts letter to M COMMUNICATION

BACTA has prepared its communication for members to ask MPs for their support in addressing the HMRC call for reclaimed VAT to be handed back over. In the circulated correspondence, industry businesses are being advised to state that: In 2005/6 many taxpayers submitted claims to recover VAT that was considered to be erroneously declared on income from certain gaming machines. In 2010, HMRC issued Revenue & Customs Brief 11/10, in which it was announced that taxpayers with valid claims would have them repaid, subject to “protective” assessments being issued allowing HMRC to claw back the repayments, should they be successful in the leading case known as the Rank litigation. In October 2013, the Court of Appeal in the Rank litigation found in favour of HMRC. Following the decision, HMRC issued a bulletin confirming that the protective assessments would be enforced and HMRC would commence to claw back repayments. This action is

being taken notwithstanding that Rank has applied to the Supreme Court for leave to appeal, which may result in a further hearing which may result in these repayments being returned to the taxpayer. These repayments, if enforced now, may have the result of forcing closure of thousands of businesses and organisations, together with enormous administrative burden being placed upon HMRC as these taxpayers will undoubtedly make hardship applications. We urge you to write to the Minister, David Gauke, with copy to the Chancellor of the

It is estimated that HMRC could receive hardship applications from as many as 3,000 to 4,000 affected businesses.This would result in a significant administrative burden on HMRC in dealing with these applications. Rejection of the hardship application would likely result in all businesses appealing that decision, requiring a raft of hearings before the First Tier Tribunal. “The outcome of the above action is that it is unlikely that the hardship applications and any subsequent action would be dealt with until such time as the Supreme Court decision in Rank is handed down. This action would require significant HMRC resource to be expended with minimal return.”

Industry trade body BACTA has sent out a message to its members with regard to VAT paybacks. It has implored members of all sizes to contact their MP using a draft letter with a view to seeking a stay of HMRC action. eslie MacLeod-Miller, chief executive of BACTA, has contacted all the association’s members in relation to the HMRC’s announcement that it intends to claw back repayments made in relation to VAT on gaming machines. BACTA, together with 11 other trade associations and clubs, has written to HMRC requesting that they stay the action to enforce assessments issued to taxpayers in connection with repayments of VAT on gaming machine income, until such time as the litigation in the lead case involving Rank Plc reaches conclusion. Burlin speaks out regarding EAG timing SHOWS

aving read recent issues of Coinslot where two industry stakeholders have quesH tioned the timing of the annual London coinop show, EAG International chairman Martin Burlin has responded with his reasoning for retaining EAG’s January slot. He told Coinslot: “If we moved the show in line with ICE we’d lose all the plush suppliers, which is approximately 30 per cent of all our exhibitors. The week that ICE is on coincides with the Spring Fair International at Birmingham NEC, so if EAG was on at the same time, we’d lose 30 per cent of our sales. If I could move the show I would - it’s utter nonsense to

say it’s all ‘political’!” Burlin believes that only a small percentage of companies want to move EAG’s schedule. He added: “If anyone would like to tell me how to resolve the situation with the plush suppliers I’d like to hear their thoughts, but no-one has come up with an answer. If industry stakeholders have any ideas regarding the above, please come to me with your solution. The timing of EAG is not political, it’s purely commercial.” EAG’s chairman revealed that he is already talking to all kinds of new potential exhibitors, including ride manufacturers, ahead of next year’s show. He continued: “Furthermore, a lot of our current exhibitors believe that February

would be too late for them in terms of their seasonal requirements. I’ve just spoken to a company that exhibited at EAG for the first time this year. They also exhibited at ICE. They told me that they won’t be exhibiting at ICE again and that they wished they’d signed up for EAG years ago.” The bottom line for Burlin is that if EAG was moved to February to coincide with ICE then the organisers would lose 30 per cent of their sales straight away. The show has to be at least 75 per cent full before the organisers start making any money. He concluded: “I firmly believe that there is no other exhibition company that listens to its customers as much as we do.”

Talarius and Gamestec agree extension on AGREEMENT

amestec has secured an extension to its existing logistics G contract with national AGC chain Talarius for a third consecutive year. Under the auspices of the agreement, Gamestec will continue to supply its network and

infrastructure capacity to over 180 Quicksilver AGCs on the high street and motorway service areas throughout the UK. Services covered by the partnership include provision of storage facilities, preparation of new machines and distribution across the Talarius machine estate.

Consumer group CAMRA and trade body BBPA have implored the government to take quick, decisive action after new figures have revealed UK pub closures to be at a level of 28 per week, a decline that will impact on the pub sector’s £22bn contribution to the economy. he most recent CGA-CAMRA Pub Tracker, covering the period of April-December 2013, has shown that the number of pub closures in the country has risen from 26 to 28 per week - a worrying statistic for all single site operators and machine suppliers. In order to help struggling pubs, the consumer group is calling on the government to press ahead with plans for a Pubs Watchdog scheme to protect licensees from high rents and beer prices charged by large pub companies. The tied pub model, where landlords are managed by large pubcos, has come under increased criticism with survey figures suggesting 57 per cent of licensees tied to the big pub companies earn less than £10,000 a year, while leased and tenanted pubs accounting for 16 of the 28 pub closures each week. Mike Benner, CEO, CAMRA, said: “Pubs are unnecessarily closing as tied licensees struggle to make their businesses succeed thanks to increased rents and inflated beer prices. It is vital that the government step in to redress the balance with the implementation of an independent Pubs Watchdog and an option for licensees of large pub companies to

opt for market rent only agreements allowing them to buy beer on the open market at cheaper prices.” The group is also calling on the government to freeze the rate of beer duty in the up-coming Budget and closing planning loopholes to ensure pubs cannot be lost without planning permission. Benner concluded:“It is currently possible to convert a pub into a betting shop, pay-day loan store or supermarket without the need for planning permission, making it far too easy for valued community pubs to be lost. We are pressing the government to act to close this planning loophole.” Calls for a freeze in beer tax in the Budget now have more support than any other tax measure among early day motions signed by MPs, with the number supporting now 100. The milestone follows another new report showing that 900,000 jobs depend on beer and pubs - and 44 per cent are workers aged 16-24. The report,by Oxford Economics for the BBPA also shows that the industry pays out £11bn in wages, and adds £22bn to the economy. Brewing itself sustains 80,000 UK jobs, while pubs employ 820,000 people. The industry also spends over £1bn

in capital investment, and pays £12bn in taxes. Andrew Griffiths MP, the Burton MP and chairman of the all party Parliamentary Beer Group, commented: “The Chancellor’s cut in beer duty last year was a historic, confidencebuilding measure for this vital sector. But with beer tax having risen by 42 per cent over the previous five years, more action is needed. It will take many years to undo the damage and at the very least, a freeze is needed. At very little cost, the Chancellor can protect 2,400 jobs in a great British industry.” Brigid Simmonds, BBPA chief executive, added:“For all those campaigning in our industry, there is still time to ask your own MP to help the campaign, or highlight the importance of beer and pubs in your own area, using our Oxford Economics Impact Report.” With further pub closures being the last thing that the single site operating sector needs, the two groups’ suggested course of action - which relies on immediate government intervention - looks to be founded on solid business sense. If its proposals are acted upon in the Budget later this month, operators just might be able to breathe slightly easier.

The Association of British Bookmakers has launched a new code of conduct on March 1 as part of its ongoing efforts to tackle problem gambling.

Described by harm minimisation experts as ‘worldleading’ measures, the new Code introduces enforced breaks for customers on gambling machines, automatic alerts about the money and time spent and improved training for betting shop staff. Dr Mark Griffiths, Professor of Gambling Studies at Nottingham Trent University’s International Gaming Research Unit, explained: “The player protection and harm minimisation measures proposed go further than anything else emanating from the UK gambling sector in the past. Some of the measures proposed are innovative and potentially world-leading and I am delighted that the ABB has taken such a proactive stance in their efforts to promote responsible gam-

Club officials attributed the impressive financial turnaround to lowering overheads and maintaining profit margins on beer at above 50 per cent. Broughton Workingmen’s Club treasurer Terry Finch told local press: “We would like to thank our 430 members for their loyalty and seven-strong staff and the committee for their hard work.” Finch said a decision last year to open until 12.30am on Saturdays and to host wedding receptions had also paid dividends. We believe the measures strike the right balance between protecting customers without stopping the enjoyment of the eight million people who play on gaming machines without any problems.”

A reception will be held at the Belfry Hotel, Mellors Way, Nottingham, NG8 6PY. Flowers may be sent but donations are preferred for the Nottingham Adult Speech and Language Therapy Department at The Queen’s Medical Centre, Nottingham. VAT cut crucial for resorts claims MP TOURISM

Although the government continues to resist cutting VAT for attractions and tourism business, Cleethorpes MP Martin Vickers has joined the growing number of campaigners calling for a change of heart.

leethorpes MP Martin Vickers has spoken out in favour of the campaign calling on the government to implement a drastic cut onVAT for tourism businesses. The Conservative MP’s words come despite the proposal having been rejected by the Treasury, which said it did not believe a cut would boost tourism. Vickers, a supporter of the Cut Tourism VAT campaign, argued it would help support local seaside economies such as his own. He told local press:“We have got to do all we can to promote our British resorts above those on the continent and this is one way we can make our coastal resorts as attractive

The Jobcentre Plus Work Trial employment scheme, an initiative set up by the Department for Work and Pensions, gives businesses the chance to try out potential employees before offering them a job. The Grand Pier will take on 10 jobseekers over the period of a fortnight, in which time they will gain experience in a number of

different roles, including operation of the pier’s amusement rides. Grand Pier director Michelle Michael said: “We are very excited to be leading the way in Weston by signing up to this scheme. “We believe a lot of these jobseekers will have something unique to offer and we are delighted to be the first business locally to be able to provide these placements.” Jobcentre Plus will ensure the candidates for the trial - who will work in a voluntary capacity and continue to receive benefits throughout its duration - meet the required eligibility conditions.

Before the 10 jobseekers begin working on the pier, they will attend Weston College for three weeks, attending classes on the foundation skills that are essential for fitting back into the workplace At the end of the two week placement, they will be interviewed by the Grand Pier’s management and considered as candidates for employment. Anne Nock, of Jobcentre Plus, said: “We are very pleased the Grand Pier has come on board. “A scheme of this type allows an employer to tap into the potential of this keen, loyal and hardworking pool of talented people to build a diverse and multi-skilled workforce, enhancing their local reputation and strengthening the business.” All amusements business can offer a work trial through the scheme, as long as the job the trial is for requires 16 hours or more a week and lasts for at least 13 weeks.

However, Gauke said the department had “yet to find any evidence”it would help the attractions and tourism sectors and said funding it with additional borrowing would undermine efforts to reduce the national deficit. Vickers, who has discussed the reduction with several tourism businesses in Cleethorpes, said he would not be deterred by the government’s rejection. He commented: “I will continue to support the campaign to reduce VAT for our tourism businesses in the coming months.

“It is an issue that I have raised with local tourist operators who will support any bid to make their hotels and resorts more attractive to customers.” Independent research carried out by an advisor to the Treasury using the government’s own economic model concluded that lowering the rate of tourism VAT was “one of the most efficient, if not the most efficient, means of generating GDP gains at low cost to the Exchequer that we have seen”. Additional research by Deloitte/Tourism Respect found that a reduction would contribute an extra £2.6bn to HM Treasury over ten years and create 80,000 jobs.

Seafront traders have welcomed the scheme, which they hope will boost regeneration. Inner London Group director George Fentiman said: “It may be this size of development will push forward the rest of the seafront. It’s a fantastic development and a fantastic scheme.” The developer has been

holding talks with council planners for two years. It has now formally asked the council what information it should include in a report on the environmental impact of the development, required with the planning application due to the size of the 2.7 acre site. As well as a block of flats, the developer wants to build shops, restaurants, cafes, bars, a takeaway, offices and an amusement arcade on the corner of Marine Parade and Southchurch Avenue. The Inner London Group paid

£2.25m for the site in 2010. According to local press, the firm is still negotiating with an elderly lady over buying the last of a row of four terraced houses at the northeastern corner of the plot, but it is confident a deal will be reached. Fentiman concluded:“We are ready to build. If we had planning permission a year ago, we would be building now.We hope to put the application in this year and work could start within six months. It will be in 2015.”

Praesepe admits ‘administrative error’ ADULT GAMING CENTRES

Following an unannounced visit by the Gambling Commission in October 2013 to licensed bingo premises operated by Cashino Gaming, the Commission identified that the premises were operating in breach of Section 37 (1) of the Gambling Act 2005.

he Gambling Commission has identified that a licensed bingo premises operated by Cashino Gaming Ltd, part of the Praesepe group of companies, was operating in breach of part of the Gambling Act. Historically, the building in question had been split and benefited from two adult gaming centre premises licences. Cashino applied to amend the layout of the building by converting the existing two AGC premises to one bingo premises and a new bingo premises licence was subsequently granted. Through an administrative error those responsible for machine allocations at Cashino believed that the premises still benefited from one AGC licence in addition to the bingo premises licence. They believed that the two premises could operate a combined total of 12 Category B3 machines, instead of eight, based upon the prevailing machine entitlements.

The error was identified in October 2013 whereupon a number of B3 machines were withdrawn from service until such time as the number of Category C and D machines on site could be increased in order to accommodate 12 B3 machines under the 20 per cent provision. Praesepe accepts, as a result of the administrative error, that for a period of time they operated a limited number of B3 machines at one site in breach of Section 37 (1) of the Gambling Act 2005. However, it was not a deliberate act to gain financially by exceeding the B3 entitlement, but a regrettable administrative error. Whilst individual customers were not disadvantaged, Praesepe acknowledges its complete culpability for this regrettable breach. Praesepe also acknowledges that this incident revealed weaknesses in certain internal administrative processes. These processes

have since been thoroughly reviewed and improved. The incident also prompted a thorough review of machine allocations in all 169 premises operated by Praesepe, which were all found to be correctly operated. Praesepe has cooperated fully with the Commission during the investigation and continue to ensure that their compliance with the licensing objectives is central to their operating practises and procedures. Praesepe has made every effort to monitor all their management processes in order to identify and remedy any weaknesses in their administrative and operational procedures going forward. Praesepe also accepts that the administrative oversight did lead to an unintended financial gain, and are happy to donate £25,000 to the Responsible Gambling Trust. This sum will be in addition to the donation that Praesepe had already committed to the RGT in 2014.

We’re faced with so many warning signs on a daily basis that eventually we’ll just ignore them all.In terms of coin-op context, despite the ABB putting together a code of conduct for LBOs to keep a watchful, caring eye on all their FOBT players, Culture Secretary Maria Miller told The Sunday Times the other day that a voluntary code simply isn’t enough. While playing all types of coin-op machines, not just FOBTs, can be a very private activity, the polar opposite community gaming - is becoming a cunning spin on the principal of multiplayer gaming. While bingo players have already bought into community gaming, new evidence from Talarius suggests that AGCs are rapidly catching up and that the emergence of the genre in pubs could gain momentum if the government has the nous to freeze the beer duty escalator in the Budget for the second consecutive year. Community gaming, for those of you returning from Mars, comes into its own when one person triggers a

feature on a community game and the feature is shared by one or more (or all) the other players present. Operationally, therefore, it allows operators who can’t commit to taking the maximum six units in one go, but can choose to add to their community gaming stock when conditions allow. We’ve seen in a few short years that community gaming has somehow managed to cater for both Cat B3 and Cat C player demands, despite the obvious risk that yet another reel-based product could have, in such a mature market, flopped spectacularly. This proves to me a few things. Not only are manufacturers doing their utmost to serve the sector, but also that major operators are prepared to embrace them in the knowledge that keeping their customers stimulated and on-site as long as possible is of vital consideration. The point is, there’s a lot more to machine gaming than FOBTs - with community games just one example - and there’s many more types of player than those who think that shovelling £200 in a note acceptor will somehow make them instant millionaires. This project will feature the relocation of a ballistics hall from the last Olympic Games to deliver facilities for archery and Paignton Rifle Club. Torbay Leisure Centre will also be redeveloped and there will be a new gymnastics hall and beach sports centre. In addition, Moirai plans to turn the Splashdown Waterpark into a facility that can run all year round. The £45m price tag of the scheme will be funded entirely by the developer and its investment partners. Moreover, the development will be run commercially, removing the need for the local

authority to continue paying subsidies and ongoing maintenance costs. To cover the expense, commercial developers plan to construct more profitable elements across the site such as a multi-screen cinema, a bowling alley, shops and restaurants. Torbay mayor Gordon Oliver said: “Moirai recognises the potential for tourism and leisure development that Torbay has to offer, against a unique backdrop of landscape and coastal scenery. I am particularly impressed with the way that they have presented a viable commercial solution that enhances and preserves the public open space at Clennon Valley, and safeguards Youngs Park for open access and public use for future generations.” Martin Barber, speaking on behalf of Moirai Capital Investments (Torbay), added: “Our plans, which include major developments, will greatly enhance the scope for attracting visitors and

ensuring that Torbay consolidates its position in the premier league for both holidaymakers and casual visitors. Our planned investment of some £45m will not only create greatly enhanced opportunities for visitors, it will provide in the region of 650 jobs and make an important contribution to the commercial success of Torbay and the region.” Elsewhere, a bowling alley that the local community in Bedhampton fought to save has closed down. AMF Bowling opened its doors for the final time last week, according to the Portsmouth News, with people of all ages who have enjoyed using the alley over the years gathering for one last game. During the autumn, more than 1,400 people signed a petition to save the alley, but councillors at Havant Borough Council voted to demolish the building to make way for an 86-home development. The council was initially planning to block the plans as it was the loss of a community facility, but AMF Bowling then wrote to the authority

In October 2013, the Court of Appeal found in favour of HMRC on the matter of whether there had been a breach of fiscal neutrality in the taxation of gaming machines. Following the decision, HMRC issued RCB 01/14, in which it confirmed that the protective assessments would be enforced. This action is being taken notwithstanding that Rank has applied to the Supreme Court for leave to appeal, which may result in a further hearing; and that the strand of the Rank litigation referred to as ‘Slots 2’ remains before the First Tier Tax Tribunal awaiting hearing. As alluded to above, whilst the outcome of the litigation remains uncertain, we are of the view that enforcement action is premature. Many businesses have experienced severe financial difficulties since the economic downturn struck and have been forced to take some very difficult decisions, such as being forced to make staff redundant, as a result. For many, having to make the repayment at this stage could have severe implications and could spell the end for many small businesses around the country. In other cases it could see businesses

being forced to sell assets to fund the repayment. The Undersigned request that HMRC take an alternative approach to enforcing the assessments in advance of the conclusion of the litigation in Rank.As a minimum, a stay of the enforcement action at least until such time as the Supreme Court has announced whether leave to appeal will be granted. Should leave to appeal be granted, it is further requested that the stay on the enforcement action is extended until the Supreme Court hands down its decision. Should leave to appeal be refused, further discussions on how best to serve both HMRC and affected businesses are requested. As stated above, the Undersigned wish to work together with HMRC to find an acceptable solution and welcome the opportunity to discuss this further with you. It is considered that the approach proposed above will serve the interests of both HMRC and affected businesses and will remove the potential for HMRC to be inundated with applications for hardship and the associated administrative burden this would cause. Assuming that the Supreme Court grants leave to appeal, it is likely to be a maximum of 12-15 months until it delivers its decision. Given the financial hardship that enforcing the assessments would cause to UK businesses, in addition to the potential administrative burden that could be created by those businesses applying for hardship, it is considered that a stay on that enforcement action would be appropriate.

Camra urges swift action to support pubs K pub group Camra is pressing the government to act now to help save pubs,as closures rise to 28 a week. The latest CGA-Camra Pub Tracker, which covers the period of April-December 2013, shows that the number of net pub closures in the UK has risen from 26 to 28 per week – showing that much more needs to be done to protect pubs. This disappointing increase in pub closures comes as the Campaign for Real Ale (Camra) is calling on the government to press ahead with plans for a Pubs Watchdog to ensure a fair power balance between the large pub companies and their
