Majestic Bingo acquires ACQUISITION

Mark Jepp has confirmed that his firm Majestic Bingo has completed the acquisition of eight Apollo Bingo clubs from Top Ten. The deal brings Majestic’s portfolio of bingo halls in the UK up to 15, making it the UK’s largest independent bingo operator. Jepp, who has been active in the bingo sector for many years, having worked for both Gala Bingo, as head of machine operations, and for the Rank Group, explained: “Top Ten basically re-branded their clubs as Apollo Bingo with a view to selling them and we saw their eight venues as an ideal way to grow our company, thus adding to the seven we acquired from Seldis Cooper earlier this year.” “The message we’re putting out to the industry is that the growth doesn’t stop here. We’ve already invested

approximately £1m on the seven clubs we bought from Seldis Cooper and we’ll spend even more than that on upgrading and updating the other eight.”

project to develop Brighton i360, the UK’s Ttallesthethe£46m observation tower outside of London, has taken a leap forward now that loans of more than £40m have been agreed to fund the scheme. Brighton and Hove City Council has agreed to lend £36.2m to Brighton i360 Ltd to fund the construction of the 530ft tower.The development is expected to create more than 440 permanent jobs and help regenerate Brighton’s seafront. The council loan comes from the government’s Public Works Loan Board (PWLB), while £4m is being provided by the Coast to Capital Local Enterprise Partnership (LEP). Architects David Marks and Julia Barfield are investing £6m in the project. Council leader Jason Kitcat said in a statement: “We are delighted to confirm our funding

agreement with the Brighton i360. It will be a spectacular observation attraction and is the cornerstone to funding the regeneration of Brighton’s seafront, expected to draw over 700,000 additional tourists and up to £25m revenue into the local economy annually as well as over £1m to the council during the next two years of construction. Longer term, the i360 will benefit the city through annual interest payments of over £1m, as well as 1 per cent of ticket sales in perpetuity, as well as creating jobs and investment.” David Marks, creator of the Brighton i360 and the London Eye, added:“We have the opportunity to create something truly unique and of international renown here on Brighton’s beautiful seafront and we look forward to opening the attraction in summer 2016.”

Gala Coral looks to sell off bingo clubs BINGO

Bingo is enjoying something of a mini revival following the government’s tax boost for the sector in the last Budget. So, what better time for Gala Coral to trade its entire bingo estate in the market, as group focus now switches to betting.

aming chain Gala Coral is set to sell its 135 bingo clubs, formally setting in motion an auction of the gambling division that it hopes will generate bids of up to £300m,according to the Financial Times. The paper believes that private equity-owned gambling group has recruited Lazards to conduct the sale, banking on George Osborne’s Budget boost to bingo making the clubs a more attractive proposition. Gala has been informally seeking buyers for several months at a price tag of about £250m, with potential suitors including Henry Jackson’s OpCapita investment group, financier Hugh Osmond and Luke Johnson’s Risk Capital Partners. Given the 20 per cent tax rate which was in place at the time, no bids were forthcoming, but people with knowledge of Gala Coral’s plans say chief executive Carl Leaver has dusted down its sale strategy after the Chancellor halved bingo duty, and now believes he can get a better price through an auction involving trade and private equity buyers. Lazards’ sales pitch will talk up a business that captures a 38 per cent share of the market, generating 300,000 visits a week and 1.1m active customers over the past 12 months.The clubs have generated £16m in earnings before interest, tax,depreciation and amortisation in the first half. But the group will attempt to convince buyers that full-year EBITDA will be in the region of £50m if other factors such as the growth in the business, bingo

duty reduction and downward movement in rents are taken into account. It will also sweeten the offer by tempting buyers into a partnership deal with the online bingo business, which Gala Coral is retaining. One analyst said a valuation at six times EBITDA was a “bit high” for the bingo business and that“the duty cut will benefit the bottom line, but any buyer will have to invest in the estate”.

Gala Coral sold its 19 casinos to rival Rank Group for £179m last year. A flotation has long been mooted,though an insider said any decision on that was at least 12 months away. The group is now focusing on the Coral betting business, whose division is run by former HBOS chief executive Andy Hornby. In the quarter to April 12, the group’s betting business increased turnover by 8 per cent to £302.2m, reporting EBITDA of £62.7m.

Seaton in Devon and Barry Island in South Glamorgan have both joined more high profile seaside regeneration projects elsewhere on the UK coastline recently, with millions of pounds being poured into both resorts.

new £1m advertising campaign to show off Blackpool’s seafront regeneration has begun in A earnest. The seaside resort and arguably the UK’s olidaymakers at one of South Wales’ most popular coin-op strongholds will soon benefit from a £3m cash injection. The finishing touches are being put to a row of beach huts on the Eastern Promenade, at Barry Island,and they should be available to rent from next month. The huts are part of a £3m regeneration which will feature new walkways, toilets and a water feature designed to boost Barry Island’s reputation as a traditional family seaside resort, and is aimed at attracting the same huge numbers of visitors Barry Island enjoyed in its 1960s heyday. The council has decided against selling the huts. Commanding views across Whitmore Bay,the beach huts are part of a major regeneration of the historic Eastern Shelter and promenade.The Western Shelter, with its amusement arcades, takeaways,cafes and shops has for years been the focus for visi-

tors to the resort. Councillor Lis Burnett, the Vale council’s cabinet member for regeneration, innovation, planning and transportation said: “The beach huts have been built in an effort to increase the attractiveness of the Eastern Promenade. Rental income from the beach huts will be put into the future regeneration of the Island, increasing its vitality.The huts will also provide an opportunity for some people to hire them for commercial use.” The project fits in with the Come To The Barry Riviera campaign by the Pride in Barry group which promotes the resort as a “place offering sun, sand, sea, surfing and sailing”. Rob Thomas, the council’s director of development services, said:“Barry Island has a distinctive sense of place which contributes to the broader character and identity of the town.This legacy deserves to be preserved and enhanced through conserva-

tion and adaptation of period buildings, surviving structures and improvements to public spaces. The aim is to reconnect the promenade with the land above and extend the seafront character of the resort along the full length of the beach.” Beach huts have had something of a renaissance in recent years, becoming popular colourful attractions on many beaches around the country, swept up on a tide of nostalgia and are fast becoming an essential part of the British seaside holiday. Elsewhere, in 12 months’ time, the coastal resort of Seaton is set to benefit from a huge new visitor centre. Seaton Jurassic will be a £4m indoor attraction that sets out to tell the story of the geology and ecology of the Jurassic Coast. The centre will be built on The Underfleet in Seaton, a two-minute walk from the seafront, and local authorities believe it will contribute to the regeneration of the town

The authority, along with Devon County and Seaton Town councils, is the key funder of the £4m project which has also received grants from both the Coastal Communities Fund and the Heritage Lottery Fund. The outcome of a second application to the HLF is expected to be known before the July event. Bernard Dunford, chair of the Seaton Visitor Centre Trust, told local press: “We have been campaigning for many years for a visitor centre in Seaton because of its unique location on the Jurassic Coast. We are delighted that this dream is about to become a reality and look forward to sharing the detail with local people who will be key to the success of the project going forward.” The inevitable additional footfall to both resorts will come as music to the ears of local arcade and FEC operators.

The ninth edition of the annual Global Gambling Report white paper published by Global Betting and Gaming Consultants suggests that technology, tourism and taxes make up the triumvirate of trends that is driving the growth in global gambling revenues. he latest Global Gambling Report by Global Betting and Gaming ConTsultants suggests that technology, tourism and taxes are driving the growth in gambling revenues across the world. Entitled ‘Change is on the cards: technology, tourism and taxes drive global gambling’,the report states that the global gambling market had total revenues (gross gambling yield) of $451bn in 2013, an increase of 4.4 per cent over the previous year.The three trends of technology, tourism and taxes will help the global figure rise to more than $500bn by 2016 and reach $533bn by 2017. Technology is enabling those operators with both internet and retail businesses to offer more integrated services for their customers, in particular making deposits and withdrawals in betting shops/casinos for use in gambling online. Governments’ desire for new tax revenues is a double-edged sword for gambling operators.The good aspect is that it can mean governments permit gambling for the first time where it had previously been prohibited or new forms of gambling are regulated. Expansion is generally good for the gambling sector. But the other edge of the sword is that governments will increase taxes on existing gambling operations. Raising the tax rates is a particularly easy thing to do with casinos and betting shops because it is hard to relocate these businesses and they are easy

tax targets. Several of the casino projects listed are in jurisdictions where no legal casinos currently exist, so this expansion will bring in new tax revenue (both direct gambling tax and employment taxes). Similarly, in Europe, several markets have begun regulating internet gambling and offering domestic licences to private companies e.g. Denmark, France, Italy, Spain, UK. In some cases this has been a way of preventing tax revenues from leaking offshore or of protecting state revenues from gambling monopolies. Higher gambling taxes might actually boost gross gaming yield. The reason for this is that operators have to increase their margins or rake percentages to cover the higher taxes.The only real beneficiary from this situation is the Ministry of Finance which collects the taxes.The customer loses out because his payout is decreased and the operator increases their revenues because of the higher margins but simply pays most of it out in tax again. So the profit line does not show much benefit of the higher margins. The overall trend for gambling taxes around the world is upwards. The UK betting sector experienced this trend in full force in the recent Budget.The UK Treasury announced that it would be increasing machine games duty (MGD) on fixed odds betting terminals (FOBTs) to 25 per cent of gross profit. The Chancellor argued: “These

He was found not guilty of nine false accounting offences. Jailing Burton, Judge David Fletcher said:“You had access to company computer systems and you utilised that to systematically drain the company of £19,000 in cash.You say that what you spent the money on wasn’t anything dramatic, but you were able to purchase luxury items during this period.”

Travelodge’s latest holiday report has brought plenty to cheer for amusement operators, with the British seaside now the public’s top destination of choice.

new survey has revealed that a getaway to the British seaside is the most popular choice of destination for Brits holidaying at home this year. With 40 per cent of the population planning to take a coastal break this year according to Travelodge’s 2014 staycation report, the traditional seaside holiday has overtaken the city break as the nation’s favourite. The hotel chain said the top coastal destinations Brits would be flocking to this summer include Cornwall, Devon, Blackpool, Brighton, Scarborough, Bournemouth,Whitby, Skegness, Isle of Wight and Great Yarmouth. The report found that the staycation break had grown to record levels over five consecutive years,with three quarters of the public now choosing to holiday at home. The growing trend would benefit the UK economy to the tune of £15bn, it said, as holi-

The annual report surveyed 3,000 adults about their holiday plans for 2014 found that the number of Britons holidaying at home has more than doubled since 2011. It also revealed that 51 per cent of Britons are taking lots of short breaks throughout the year so that they have a constant stream of holidays to look forward to,rather than just one big break. Just over a third of these people will take two short breaks, 37 per cent will enjoy three getaways and 12 per cent will take four short holidays throughout the year. Over half of respondents said that holidaying at home offered much better value than going abroad, with the average overseas break costing £1,113.91. Peter Gowers,Travelodge chief executive, said:“2014 looks like being the year of the Staycation. More of us than ever before are being inspired to get up and go and explore what Britain has to offer. “At Travelodge, we are seeing particularly strong demand from families and couples having multiple short breaks rather than the traditional fortnight.It all points to the fact that the nations desire for a great holiday is still with us, but more than ever, were all looking for great value and finding it here in the UK. “The importance of value to Britons is evident, being more important than location, images and feedback when booking a holiday. Further flooding fears for Southend arcade FLOODS

outhend operator Martin Richardson has Sexpressed fears that his seafront amusement arcade could be hit by further flooding, a year after it suffered £200,000 damage. He believes misfortune could strike once again because the resort’s £7.6m City Beach revamp only allowed for one drain to protect the arcade. Richardson’s Happidrome FEC was forced to shut for eight months after heavy rain caused drains to overflow, flooding it with sewage. He told local press: “The drain is the only drain in the

side street and the natural downhill force means the side street’s water all goes into this drain. “Last August, this drain got blocked by a large, black plastic bin liner. The water flowed right over it and flooded the seafront. “Before City Beach, the kerbs channelled water away

from the paved areas, along the side of the road and down a main storm drain. “This man-made channel has been removed and no adequate provision has been put in its place”. After seeing the drain become blocked again last month, Richardson now checks for flooding every

time it rains, watching the security camera feeds from home when not on the premises. With a significant rise in his insurance premium, he is now investigating the possibility of legal action to recoup some of the cost. Richardson commented: “The massive increase in my insurance premium and little or no help, thanks to the lack of commitment to provide a duty of care from Southend Council. “I’m engaging specialist engineers and solicitors to investigate the building design of this front in and around my business.”

A masked man burst into Benfleet Amusements on Tuesday last week at around 7pm and threatened staff with a knife he was carrying. Terrified, they gave the attacker a small threefigure sum in cash and he fled from the premises. Detective sergeant Phil Smith of Essex Police said:“Whilst he managed to get away with only a relatively small amount of cash he caused fear and trauma with staff at the arcade. “We are appealing for witnesses or anyone who knows the suspect to come forward to identify this person.” The suspect was wearing a balaclava, blue jeans and a t-shirt. He is believed to be white, aged in his mid-30s and about 5ft 6ins tall and of stocky build.

Weekly social event saves WMC from closure WORKING MEN’S CLUBS

Steve Riley and a few like-minded friends were worried that Gilroyd Club was under threat of closure, and were also concerned that elderly and disabled people were feeling lonely and isolated due to a lack of things to do. So they formed Young At Heart, which meets every Wednesday afternoon and includes bingo, games, cabaret and singa-long, and light refreshments - for young and old. Between 45 and 60 regularly turn out, which has given the club’s coffers a

healthy injection. Club entertainer Riley said: “It’s proved so popular, it’s just snowballed really. We all just felt the club was on a bit of a knifeedge. The community needs it. We’re getting support from local councillors and we’re in the process of applying for some funding.” Ian Williamson, secretary of Gilroyd WMC, said before Young at Hearts started the future looked very bleak for the club. “The way things were going last year it was going to close. It was imminent. We’re a new committee and gradually we’re trying to turn things around. This has been a massive help.”

In other words, the main proponents of second hand sales have been in the business - and in the know - for many years and can therefore be trusted to not only offer a competitive deal on a second hand

Total service from Aztec Coin Founder and owner of Aztec Coin, Richard Monk, places pride in his company’s ability to refurbish machines to a high standard and offer impartial advice on the viability of second hand purchases. oinslot: What kind of renovation processes does a machine typically undergo before being re-sold? Richard Monk: This can be quite a lengthy process. It all depends on the condition of the incoming machine and, of course, the quality and standard it needs to meet.An average service can take an hour to an hour and a half and the machine is extensively checked over in a very thorough and logical order. The BACTA standard test routines are run through step by step with particular care being given to re-bulbing and sticky buttons - two very common and frustrating service calls. We also check software versions, security updates to hardware and machine internals. Machines can be exposed to manipulation tactics by players so this part of the servicing is a vital part of the process. Locks and note acceptors are fitted if required, then price of play and percentages are adjusted according to the customer’s order. Frameworks are repainted or repaired where needed. The machine is cleaned and sanitised and then polished inside and out. Aztec ensure that the machine has a manual and power lead and is PAT tested.The machine is also given a ‘live’ 15 minute play test, which normally exposes any gremlins left in the hardware or software. After the play test the machine remains on a two hour soak test, so that reliability of components once warm is satisfactory. The machine is then bagged and labelled for shipping. We always ensure machines are refurbished to a high standard to eliminate any potential problems in its future use.This high standard has served us well as repeat orders are essential to our survival

CS: In what circumstances would you advice buying a refurbished machine versus a completely new model? RM: Depending on pub co contracts, an operator may have to inject a number of new machines and slightly older models - compared to perhaps a smaller operator that has the freedom of choice as he is dealing only with free houses and independently owned sites. There is no doubt with managed business that new machines attract a higher rental and provide much higher income to retailers, however, in our opinion, there are some fantastic used models on the market that provide exceptional performance for smaller operators with profit share arrangements. In fact it not uncommon for many of our customers to see a machine’s cost covered on the first collection. Choosing the right model Coinslot JUNE 27 - JULY 3, 2014

set on the right percentage and percentage uplift is key to this. Not everyone wants or needs new kit and in fact some models that use a dongle are a cost that some operators will not swallow. It’s risk versus reward: New machines have more chance of increased cash in box whilst players learn the new features and patterns of play, but do the additional costs justify this on smaller estates? We think there is an awful lot of choice in the used market and when machines are prepared to high standards, they can look and perform as good as a host of latest releases.As ever we aim to provide honest, accurate and reliable advice when buying used machine. CS: Do you source machines on request? RM:Yes, of course.We always take a wish list off our customers and do our very best to meet their needs. If we cannot get the exact model they want we offer close alternatives.We have a huge network of suppliers that we can use, as a result of being in the distribution business for over 15 years. If you are prepared to make the effort by phone, fax, email and even good old fashioned footwork, these hard to find machines can be sourced. It’s a great feeling to get back to a customer with that special piece they need and they are always extremely grateful for the time and effort we spend.

Used machines provide a safe pair of hands Operators looking for a reliable earners are increasingly demanding second hand machines, even in the face of recent updates to stakes and prizes. lthough it might seem counter intuitive to suggest that buying second hand is a less risky investment, the reliability of a refurA bished machine from companies such as Leeds Leisure, coupled with the lower price, makes them a sensible investment. “There is more often than not better value and a safer purchase for the operator when buying used products,” said Leeds Leisure managing director, Tim Stanhope. “Especially when they have figures to back up the performance that show its earning potential over a year or so, as opposed to a few weeks of test figures.” New machines have often not been truly tested in the field and operators purchasing a brand new product may well find that players simply do not take to it. “We constantly come up against pushy and cold-calling distributors trying to convince operators that the next new model is a world beater based on a few short weeks flimsy figures,” said Stanhope. “With refurbished machines, the operator is able to update much more of the operation to £100 [Cat C] Jackpot by injecting a good number of used products, without leaving the business overstretched financially.” Particularly when operators are under pressure from pub estate owners to provide good results, second hand products can be the best choice. “If an operator is buying to satisfy pubco needs then there is usually certain models that fare a little better on the rentbands in relation to their cost than others,” said Stanhope, “and we can help out customers to identify those models and blend them into their operation. That said the pubcos work extremely hard to make sure they are the only ones profiting from the arrangement!” In recent times there has been a strong demand for a cheaper way for operators to invest in the new £100 Cat C jackpot. “The last few months have been all about the machines that will convert to the new £100 Jackpot,” said Stanhope, “and being able to offer our customers, whether managed or freetrade business, a top performing machine that either meets their rent band or budget requirements.” In the past that has largely meant staying on the look out for instances of the popular Deal or No Deal line of machines from Bell Fruit. However, Stanhope believes that times are changing. “We are generally interested in the better performing used product and try to acquire it at an age and price that fits with our customers needs,” he said. “The Bell Fruit/Deal or No Deal brand has been the dominant force of the last few years, but the introduction of the unpopular timed dongle and the sense that even great themes like DOND can’t go on forever have seen Reflex Gaming and Blueprint amongst others wrestle some of that dominance away.”

Coinslot: How can buying secondhand products help operators to bolster their existing range of machines? Tony Glanville: Not all refurbished product is purchased based on price. Purchases are often made if we have a particularly strong game become available on the used market and a customer did not buy that model at the time of release, or they have expressed a desire to acquire larger numbers of that model for their estate.The Coinslot charts assist in driving this market sector, as operators follow the charts to see what products they may have missed out when they were new.

There is no point recommending a new machine for a venue that is not capable of delivering the income to warrant the purchase cost of a new machine.This is where a lower value refurbished machine is ideal.We also have customers that have requested ‘fillers’ and do not want to invest large amounts of capital on equipment that is in a venue to basically make up the numbers. The sales team also work hard to know their customers’ product mix. If a model becomes available in the used market that they know would complement the customers existing product range,that is when the sales team would be in contact with the customer to recommend that they strongly consider that model for their business. CS: What kind of renovation processes does a machine typically undergo before being re-sold? Jo Harper: The operations team at RLMS Sales work extremely hard at delivering a high standard of product. It is a constant challenge maintaining high standards dealing with used product, as we could be refurbishing equipment that is as little as six months old through to equipment that has been in everyday operation for over ten years. The high standards we set ourselves are achieved through a comprehensive refurbishment programme.They key is a combination of people and process. We have a great workshop team at RLMS Sales that not only take care and great pride in their work, but are also highly experienced. The team work to set processes for each product type, whether it be a high-tec reel based machine for a pub location, a multiplayer reel based for an arcade or the most up to date PC-based B3.The processes are broken down into technical and cosmetic. The technical process ensures that the product works and passes all the recommended manufacturer test routines and if we have a specific customer requirement in terms of hardware, such as note accep-

tors or note recyclers these are fitted.Any specifics in terms of price of play, jackpot and percentage pay out are also catered for. In terms of the cosmetics, depending on the product, it can follow different processes. If it is a product such as the Bell Fruit Games Eclipse cabinet, prior to workshopping these have their frames rubbed down and pass through our spray booth give them that ‘just from the factory’ look. All products at the end of the technical process are thoroughly cleaned and polished. The team work on the premise that ‘the next person to check this product is the customer’. It is great feeling of satisfaction when you see the same customers’names coming up every month on the order book, knowing that they have the confidence to keep returning to RLMS Sales because of the high standards of equipment we produce. CS: What refurbished machines have been particularly popular in recent

months? JH: Without doubt in recent months the highest demand has been for converted £100 machines for the single site pub market. Bell Fruit Games supported the industry by making the largest number of back catalogue models available to convert, going back as far as models first released in 2011. Dealing with conversion kits adds another dimension to the refurbishment process, as in addition to the normal process, £100 kits have to be ordered in from manufacturers and the new software downloaded to be installed.The operations team work extremely hard during the £100 conversion programme, dealing with hundreds of kits during the course of the month, not only to convert products for sale but to also fulfil customers’ orders for their own conversion programmes. It is a huge logistical challenge ensuring all the kits are in the right place at the right time so we can complete customer orders within required timescales.

The same workshops and experienced technicians service and repair both new and refurbished

games. All new equipment goes through the company’s workshops to be subjected to a testing regime, before being sent on to customers. Paul Moriarty, UDC technical director, and Bonel Chua, UDC workshop manager, offer their perspective: “Our refurbishment process is not just as comprehensive as our new equipment checklist - it’s much more thorough and rigourous. All games are fully tested with all components double checked. They are then stripped down with all parts carefully cleaned and tested before being reassembled. All faulty parts are replaced with new components. UDC often undertakes to manufacture replacement parts to their own exacting standards when originals are no longer available. It is not unusual for games to be upgraded beyond their original specifications with better guns, stronger and more durable cables, larger high resolution displays, better speakers and improved LED lighting replacing old fashioned bulbs. It’s no good for a game to work when it leaves us only to develop a fault once it is with the customer. Our years of experience allow us to anticipate which parts of a game are most prone to faults and pay extra attention to these, reinforcing and adding protection where necessary. For example, we frequently make use of expensive metal shielded gun cables rather than cheaper plastic or rubber versions.” UDC are satisfied that they’re doing the right thing by our customers, which is demonstrated by the fact that the vast majority of their sales are repeat business. alex lee comment noticed Sonic The Hedgehog celebrated his 23rd birthday this week, having first emerged on the Mega Drive (or Genesis if you’re American) back in 1991. This brought back a number of fond memories, not least employing someone due to their prowess on the game in my days as editor on consumer console magazines. He was that good he could beat one of my colleagues who’d already won the Golden Joystick for his efforts on Gamesmaster. I digress. If we take into consideration, however, that video gaming (specifically of the ‘not in arcades’ sense) wasn’t anywhere near the mainstream entertainment activity it is these days back in the early 90s, the spiky hedgehog character has done pretty well to become an instantly-recognised brand.Obviously,he’s not the only one and he’s certainly not the oldest (read Pac-Man, Donkey Kong, the extended Mario ‘family’, Lara Croft et al) but when you consider a character based on a hedgehog can last the course the way Sonic has is it any wonder we’re all looking to invent - or at least quickly identify - the next big brand, particularly with reference to coin-op? Effectively expressing its identity,a strong brand has the power to change the competitive landscape and reposition competitors.And this applies

There are some internal benefits, with some vertical integration; Astra finding an outlet for its equipment and it could provide a home for some of the high-tech ex-pub machines. Novomatic has most of the manufacturing business (in the street market) with its collection of the main names such as Bell-Fruit and Astra, with

Gauselmann holding Blueprint. In the street operating industry Gauselmann has its sizeable minority stake in Sceptre, but that was pre-dated by Novomatic’s seizure of Gamestec with its 35,000 machines. So where does it all go from here? Is that it, in terms of the Teutonic invasion? Is there anything else worth buying? The bingo groups? The one big remaining AGC company, Talarius? We can all speculate all day, but the only real conclusion is that the Germans and Austrians seem to have considerable faith in the long-term future of the UK non-casino market. And that is something which no-one else is prepared to go out on a limb and emulate, so more strength to their elbow. Further afield, The Belgian Gaming Commission has issued an open letter to the next Belgian government asking for stricter regulations

During the pre-legislative scrutiny, the GBGA cited a multitude of reasons as to why they believed the legislation to be “misconceived and unwarranted” and the fact that up to 10 per cent of the workforce of Gibraltar’s workforce is employed by the gambling industry cannot be underestimated. The key foundations of the claim are as follows: • A breach of Article 56 of the Treaty on the Functioning of the European Union on the basis that the new regime“constitutes a disproportionate and unjustified interference with the right to free movement of services”; • The new regime is “discriminatory” on the basis that it places an equal burden on all operators irrespective of the local legal and regulatory regime within which they operate;

• The failure of the Gambling Commission to adopt other measures available to them to achieve an equivalent outcome is “irrational and unreasonable”. The language might appear emotive but there are only four grounds for judicial review as follows: illegality, irrationality, procedural unfairness or legitimate expectation. The failure to adopt other measures refers to the “passporting proposal” proposed by the GBGA in formal correspondence on 31 December 2013 that would enable the Gambling Commission to be assisted by local regulators to ensure that overseas operators meet the standards required by the Gambling Commission. The GBGA contended that this proposal would allow more effective regulation, better consumer protection and would impose a more proportionate burden on operators. The letter concludes with an extensive list of requested information and clarifications and, from a procedural perspective, the Gambling Commission now has 14 days to respond. As the matter proceeds we will continue to update on further developments, and in particular whether the challenge will have any impact on the timing of the introduction of the new licensing regime, presently scheduled for no earlier than September 1. Meanwhile, our strong recommendation to clients is that they not be distracted and instead continue to prepare for the launch of the new regime in the autumn.
