Gambling Business Group cites ‘impossible challenge’ for regulator INDUSTRY GROUPS

eter Hannibal, CEO of the Gambling Business Group, has described the Premise Licence sections of the 2005 Act as obsolete, a statement which he claims is epitomised by what he describes as the "proverbial coach and horses" that internet based gambling drives through them, and which enables players to play what they want, at any stake of their choosing , anywhere in the UK whether there is a premise license in place or not. Hannibal, writing in the Politics Column of this week's Coinslot, argues that the industry has unfair expectations of the regulator to "…make this outdated situation work" adding "however best their intentions may be, they have an impossible challenge on their hands." Weaknesses persist in underage gambling controls - Commission TEST PURCHASING

The Commission has criticised the coin-op industry for an apparent lack of underage gambling controls. BACTA, however, believes that the sample size is too small to be accurate and that according to its own figures the ‘problem’ is nowhere near as bad as it seems. he latest round of underage gambling test purchasing conducted by local authorities in partnership with the Gambling Commission demonstrates that many operators have inadequate controls for preventing underage gambling, according to the Gambling Commission itself. In 20 out of 40 tests ofAGCs and betting shops,a supervised test purchaser under the age of 18 was allowed to play on a gaming machine and leave the premises without being challenged to prove their age.A number of tests were also conducted at licensed FECs and at bingo premises that had been converted from arcades, with similar weaknesses found. Licensees that did not challenge a test purchaser before they played a gaming machine have been warned by local authorities that failure to improve could lead to formal regulatory action being taken, and many licensees have been required to submit action plans to their LA detailing how the weaknesses in their underage gambling controls will be remedied. Some licensees have introduced a range of measures in response, for example improved training schemes for their employees; the employment of third-parties to conduct quarterly test purchases of their premises;have re-sited CCTV to provide employees with better sight of customers entering the premises;or are introducing physical barriers to age-restricted areas at times where they cannot be monitored. However, LAs are reminding the operators that if they fail to voluntarily deliver improvements, or if their gambling premises fail a further test purchase,then they may be subject to a review of their premises licence which could culminate in the impo-

sition of stricter licence conditions or the suspension or revocation of their premises licence. Some staff members appeared to be unaware of the presence of the young person, either being engaged in other duties at the time or not paying attention. In one test, there were no staff present.On other occasions, staff appeared to be unwilling to challenge the tester. Conversely, early challenges were made in tests where the layout of the premises allowed staff to supervise customers entering the premises, or where staff members were positioned close to the entrance. These latest test purchase results provide further evidence that controls need to be strengthened, in the key areas covered in the consultation; such as line of sight, premises layout and staff training. The Commission is currently consulting on strengthening its Licence

Conditions and Codes of Practice.The consultation will close on 31 October. The Commission will continue to work with LAs to test gambling operators as part of a rolling programme of testing. Individual operators may be putting their livelihoods at risk if they fail to prevent access to gambling by children and young people and regulatory action is taken by a local authority or the Commission. BACTA CEO John White commented: “BACTA is committed to ensuring that under 18s do not play machines illegally.It has in place age verification training and a robust test purchasing scheme for its members. This has shown, on a sample size of over 250, a pass rate of 82 per cent with 100 per cent on a retest of those that failed. We look forward to exploring further with the Gambling Commission and local authorities how we can achieve even better levels of performance.”

Tourette’s syndrome sufferer banned from bingo hall for swearing BINGO BAN

ouis Bunn (pictured) was ejected from EastLbourne’s Leo Leisure Bingo hall last week when staff judged his involuntary tics as a deliberate attempt to disrupt players. Bunn, however, claimed the bingo caller made fun of his accidental outbursts while the bingo hall owner defended the decision and said he was ‘sworn at and spat at’. Bunn, from Eastbourne in East Sussex was removed from the town’s Leo Leisure Bingo hall in

the middle of a game. He has now doubled his dose of medication since the incident. He told a national newspaper: “A member of staff was very disrespectful to

me and this made my tics worse. When I confronted the person I told him I couldn’t help it and that I was being discriminated against.” He added: “As the night went on, the staff working the bingo made a few remarks on the microphone regarding my Tourette’s and I felt like I was being singled out.” Bingo hall owner, Peter Brown, who knows Mr Bunn as a regular, defended his actions by stating: “I am aware of his condition and have never had a problem with it in

any way. I’ve spoken to other people to make them aware of his condition and told them that he was a nice person. But we’d had a complaint in that week that he had jumped out of his seat and got very aggressive towards an old lady. I told him he was welcome to continue playing but we would not accept him being aggressive to customers. Brown concluded: “He was aggressive to me, my female members of staff and I was sworn and spat at. I’ve never been spoken to like that.”

A Commission fine and a slap on the back of the legs is a reminder that when it comes to gambling issues, it’s not always about the machines.

he Gambling Commission has found Camelot UK Lotteries Ltd in breach of its licence to operate the National Lottery and has imposed a financial penalty of £100,000, following the initial miscalculation and subsequent communication and publication of an incorrect National Lottery Lotto jackpot prize amount in October 2013. After a full investigation, and t a k i n g account of representations f r o m Camelot, the Commission

found that Camelot had failed to ensure that its bespoke processes and procedures put in place in respect of this key area for the re-launch of Lotto were fit for purpose and had thereby acted in contravention of Condition 5.10A (b) of the licence granted pursuant to section 5 of the National Lottery etc. Act 1993 (as amended). As a result of this breach a financial penalty of £100,000 has been imposed together with a direction for Camelot to commission an independent review, subject to consultation on scope, of its related control environment performance. The incident led to three Lotto jackpot winning ticket holders initially being informed by Camelot that they had won more than in fact they had.The original jackpot broadcast was £ 6 . 2 m ,

which was revised down to £4.8m once Camelot had discovered the error. The winners were subsequently told the correct prize amount before any prize money had been transferred/paid out and the Commission is confident that the winners did receive the correct prize amount under the rules of the game. The Commission’s Chair, Philip Graf, said: “While this is an isolated incident, this is a serious matter, as confidence in the accurate calculation of prize monies is a critical part of maintaining public trust in the integrity of the National Lottery. “Camelot has put measures in place to ensure it doesn’t happen again. We will continue to monitor Camelot to ensure it meets the requirements of the licence and that the interests of players are protected.”

Bank lending to SMEs still falling short BUSINESS

ccording to the Bank of England’s latest A update on the government’s Funding for Lending scheme, net lending to SMEs fell by £435m in the second quarter. The fall was less dramatic than in the first quarter, when SME lending plummeted by £723m, and the Bank said some of the weakness in bank lending to smaller businesses could reflect ‘weaker demand’. However, business advocates said it was ‘disappointing’ that SME lending has continued to fall despite the introduction of the FLS, which reduces bank funding costs in a bid to encourage lending to smaller businesses. Phil Orford MBE, chief executive of the Forum of Private Business (pictured), said: “The Funding for Lending Scheme shows another net reduction of funds reaching small businesses. These figures would surely be worse still if Funding for Lending was not in place, and it is true there is a weakness in demand, but it remains disappointing to see less money being lent in this crucial part of the economy.” Orford argued that ‘better and wider’ bank lending to the small business sector should be a crucial component of any prospective government’s manifesto.

John Langworth, director general of the British Chambers of Commerce, also called for government action, stating: “Despite the welcome refocus towards SME lending, the real test for the scheme has always been whether it is able to get credit flowing to young and fast-growing businesses. Unfortunately many of these firms remain frozen out when it comes to accessing the finance they need to fulfil their potential.” According to recent research from Boost Capital, the lack of bank funding for SMEs is hitting the hospitality sector particularly hard. The research revealed that the hospitality’s sector’s contribution to Britain’s GDP dropped 0.2 per cent between 2007 and 2013, mirroring a 6 per cent drop in lending from banks between 2008 and 2012. Nicola Horlick, CEO of crowdfunding service Money & Co, concluded: “Alternative finance, such as person-to-business lending, not only supports UK businesses, but also gives UK savers a new way to make their money grow. However, awareness of this sector remains low. Unlike the banks, which seem to be stifling growth, alternative finance has real potential to boost the UK economy.”

The Gambling Commission has issued a note offering advice on what circumstances a company can operate using another’s licence.

new note has been published by the Gambling Commission which offers advice on under what circumstances a company can operate using another’s licence, a summary of which is detailed below. Where a person provides facilities for gambling as defined in section 5 of the Gambling Act 2005 in the course of a business carried on by another person who holds an operating licence authorising the provision of such facilities, they can, in the case of betting or gaming, take advantage of the exception in section 33 (3) (a) of the Act from committing an offence under section 33 (1) and operate under the auspices of that other person’s operating licence without themselves holding a licence.

As a general rule, the Commission will accept that a company can come within the scope of this exception and not be required to hold its own licence providing that the company is truly acting in the course of a business carried on by the licence holder. The following are some of the general principles which the Commission takes into consideration when deciding when a company is acting in the course of another’s business: • The company must be doing the licence holder’s (‘the principal’) work • The company is likely to be a wholly owned subsidiary of the principal • Responsibility for compliance lies squarely with the principal • Responsibility for adher-

ence to technical standards lies with the principal and the principal has controls in place to ensure the company complies. The list is not exhaustive and the Commission also has regard for other points which it details in its despatch online, but it stresses that operators should always seek their own legal advice and should, if in any doubt, discuss their circumstances with the Commission in detail. With regard to gaming machines and gambling software, the exemption in section 33 (3) (a) is not available to gaming machine and gambling software manufacturers/suppliers as section 33 does not apply to their activities; they are governed by separate provisions, namely sections 41 and 243. However, where the operational decisions for these companies are made by the owning parent company it can be appropriate for that owning parent company to be accountable to the Commission for the group, as opposed to the individual companies being directly accountable, and for it to be the parent that holds the licence. Finally, the Commission takes the view, in respect of machine and software manufacturers/ suppliers, that naming the subsidiary companies as agents on the licence makes it absolutely clear that the licensee is responsible for all compliance issues.

The country’s poorest families are struggling to afford the cost of a trip to the coast, before they can even consider visiting an amusement arcade, a leading charity has warned. hildren’s charity Barnardo’s has warned that a day trip to the seaside is now out of reach for one in five families due to income poverty. It calculated that a nofrills day trip could cost a family with two children up to £172 in the South East, £127 in the Midlands, and £96 in London. The research looked at the cheapest train fare for a family of four from cities and county towns to their nearest seaside resort. The figures also include the family price of suncream, fish and chips and ice-cream, but not any addi-

tional costs such as money spent in amusement attractions or family entertainment centres. The most expensive trip identified by Barnardo’s was Aylesbury to Bournemouth, at £172.20, while the cheapest was Bristol to Weston-superMare, at £40.80. The UK’s poorest families have too little money to cover basic weekly living costs, let alone a trip to the beach, the research found. Their incomes have declined in recent years, due to what the charity condemned as a“toxic mix” of rising living costs and cuts to working and non-

working benefits, as welfare changes have broken the link between benefits and inflation. With government statistics showing one in five families currently brings in less than £423 a week, Barnardo’s calculations reveal that - after covering basic living costs - a family of four on this income could not afford a seaside trip in any location surveyed. Minimum disposable weekly income for the poorest one in five families is £39, less than the figure required for a trip from Bristol to Weston-super-Mare Javed Khan, Barnardo’s

The survey of over 2,000 children was carried out for the #BlackpoolsBack awareness campaign, a marketing initiative led by Merlin Entertainments and VisitBlackpool. The four most important elements for a successful family holiday, according to the nation’s children, are a

real, sandy beach, a seaside location, a theme park and a water park. However, only one in 20 said sunny weather is important for a great family holiday. More than six out of 10 believe it is crucial they visit a resort where they can speak English when they go on a family holiday. Travelling time is also key. The majority of children (55 per cent) said it should take no longer than four hours, door-to-door, to get from their UK home to their holiday resort. Most want to avoid the fuss and waiting at airports, with 73 per cent saying they would rather go on a holiday that didn’t involving flying to their resort.

Almost seven out of 10 kids don’t want long walks or, worse still, car journeys to the nearest beach on their perfect getaway. Some 67 per cent said getting to the beach should be no more than a brief 10minute walk from their holiday accommodation. Marsden told local press:“Improved services should be seen as the essential driver for economic growth and other funding models for investment, as have been used in London,should be looked at. “The animosity felt towards the socalled ‘pacer’ trains - especially at peak times of the travelling year in Blackpool, late summer and into the illuminations period - when they are crammed with

both residents and visitors, often without additional capacity being added, cannot be exaggerated.” He repeated calls made by the South Fylde Community Rail Partnership for a more frequent service to be offered on the line between Kirkham and Wesham and Blackpool South - which he said would help to improve the economy of areas served by stations on the route. Marsden added:“The beneficial outcome will be greater connectivity between the seaside and rural tourism offer to visitors to the Blackpool and Fylde area as well as increased residential and commuter traffic, which would not only bring in more revenue but also help revive the local economies of St Annes and Blackpool’s South Shore area.”

The official application is for a ‘part change of use of amusement centre to form public house’ and was handed over to North Ayrshire Council earlier this month.

If given the green light, Wetherspoons said the conversion would bring “much needed” jobs in to the

area, and would see the removal of the FEC’s eight-lane 10-pin bowling alley in order to accommodate the new 3,000 square foot venue. Architects Harrison Inch stated: “The property is not listed or in a conservation area. However, the client understands there is an obligation on the owners for the upkeep. The proposed intention of the works is to ensure the future of the building and its attractiveness. “In its current state the building

is deteriorating. If the proposal is granted this will help to revitalise the building bringing it into use for customers to enjoy.” The original building opened in 1967 as the Manhattan Amusements, before going on to become the Cumbraen Amusements in the 1980s. Around the turn of the millennium, a bowling alley was built at the new Lanes Amusements, which was owned by the Taylor brothers.

alex lee comment had a very illuminating conversation with BACTA’s new chief executive officer John White earlier. Despite much of what we talked about being strictly off the record (exclusive: more than one John works in the BACTA London office), White did hint at the industry’s trade body taking a bit of a new direction, with particular reference to how it engages with politicians and, indeed,the Gambling Commission. All business sectors, White believes, have to be honest with themselves and industry stakeholders must engage with politicians rather than simply shout at them! His aims and goals for BACTA, its members and the wider coin-op sector are refreshingly straightforward. He wants the businesses working within the amusement and soft gambling sectors that BACTA represents to be profitable, successful and sustainable. It will of course be interesting to see how White’s new approach affects the direction in which coin-op heads, but judging by the amount of work he has got through in the first few weeks of his tenure and the sheer number of meetings he has attended we can all expect nothing less than a thoroughly hands-on approach. Furthermore, I’m hoping that his work will throw up plenty of news-

worthy stories! I often use this column to request more input from coin-op stakeholders and while I enjoy a lot of dialogue with a few, there are many more out there who rarely get in touch. While things are generally pretty quiet in the world of coin-op at this time of year, especially in terms of manufacturing-related news, there must be plenty of other stories bubbling under which are worth publishing.While in days of yore I steadfastly went through the BACTA directory starting with ‘A’ it got a little disheartening when I reached ‘F’ and still no-one wanted to share anything. In other news, I did a mini-tour of the three family entertainment centres positioned on Sunderland’s coastline of Seaburn and Roker recently.Two of them were in excellent repair, bright and cheerful with a decent mix of new and not so new games and machines, but the other, which was poorly lit, unwelcoming and featured the same products I used to play as a child left a lot to be desired. I’m hoping the latter will somehow find the means to improve itself and reach the high standards the nearby premises have managed to achieve.

Well here we are again, having the exact same debates and dialogue that we were having in the 90s. Gambling Legislation is outdated, can’t keep up with technology, mostly obsolete and in desperate need of modernisation. It is absolutely right that regulations should enforce the three principles of the 2005 Act in protecting the vulnerable, keeping gambling free of crime and ensuring that gambling is offered in a fair and open manner. Furthermore, those businesses and organisations that operate to these principles with a culture of genuine responsibility towards the customer must be applauded accordingly. So surely in an ever increasing consumer led society, using regulations to determine which responsible adults can use which products in which venues restricts customer choice and is unfairly restrictive on those businesses that are operating in a fit, proper and responsible manner. The obsolescence of the Premise Licence sections of the 2005 Act is no more epitomised by the proverbial ‘coach and horses’ that internet based gambling drives through them, enabling players to play what they want, at any stake of their choosing, anywhere in the UK whether there is a premise license in place or not! We then unfairly expect the regulator, the Gambling Commission, to make this outdated situation work and however best their intentions may be, they have an impossible challenge on their hands. So where should the Gambling Com-

mission and the DCMS position themselves with regard to licensed adult gaming premises which are by their nature intended to provide for over 18 year olds? Taking all of the above obsolescence into consideration, it is perfectly reasonable for the consumer to expect a ‘fit and proper’ provider of gambling facilities who operates in a responsible and trustworthy way to offer what are regarded as ‘adult’ gambling products in all ‘adult’ venues.And where the DCMS and/or the Gambling Commission have the wherewithal to enable this within the current Act, they should. If there is a sound and logical argument for not giving this choice to the consumer then I am sure we would all want to understand what it is. This logic is also relevant to the operators of adult gaming businesses call for ‘parity’ on adult gaming machines. It makes no sense (particularly to the consumer) for one adult gambling venue to offer one range of machine products when another, with a similar set of controls and service, in similar locations, is only allowed to offer a restricted range.The call for clarity and transparency from the regulators on this matter is a perfectly understandable and reasonable one. The DCMS and the Gambling Commission have an opportunity to remove some of the obsolescence from the current regulations which would improve the situation for the consumer, for the operators of these businesses and also for themselves in their pursuit of effective regulation. If we are not going to see a new Gambling Act in the medium term then we have to put pressure on the DCMS and the Gambling Commission to use what resources they have at their disposal to move current regulations,consumer choice and the industry forwards.
