Under the new regime, businesses wishing to advertise or provide remote gambling services to consumers in Great Britain will be required to obtain a licence from the Gambling Commission to do so. In connection with the new ‘point of consumption regime’, the Gambling Commission has already implemented a raft of changes to licensing conditions that remote gambling operators will have to adhere to. Further changes

to the gambling software licensing regime do not take effect until March 31, 2015. After the verdict was announced, a spokesperson for the GBGA said that they were disappointed with Justice Green’s ruling. He said that the UK had an opportunity to introduce a cross-border regulatory regime which would benefit consumers and the industry alike. The GBGA maintains that the new legislation is not in the best interests of UK gamblers, but it will not appeal the verdict.

Gibraltar challenge to UK Gambling Act rejected LEGISLATION

A legal challenge to the UK (Licensing and Advertising) Gambling Act 2014 by the Gibraltar Betting and Gaming Association has been rejected by the Royal Courts of Justice in London. r Justice Green has rejected the GBGA’s legal challenge to the UK (Licensing and Advertising) Gambling Act 2014. The Act requires remote gambling operators not physically located in the UK to obtain licences to provide an online gambling service to UK gamblers and to pay a point of consumption tax of 15 per cent on the profitsmade from their UK operations. Legislation was due to take effect on October 1 but, after the legal challenge to theAct by the GBGA,a hearing took place at the Royal Courts of Justice in London and implementation of the legislation was delayed until November 1. The GBGA represents a number of remote operators based in Gibraltar, including 888, Bet365, Betfair, Bwin, Ladbrokes, Victor Chandler and William Hill. On behalf of these firms, the GBGA took legal action on the grounds that the implementation of a 15 per cent tax would create an unfair advantage to UK-based operators and that the UK GamblingAct was illegitimate,disproportionate and discriminatory interference with the right to free movement of services guaranteed by Article 56 of the Treaty of the Functioning of the European Union. The GBGA suggested an alternative“passport solution”for regulating online gambling in the UK that would create a consistency of regulation between what was already in place in Gibraltar and what was being proposed in the new Act.The GBGA also claimed that this solution would impose a more proportionate burden on its members. After the two-day hearing at the end of September, Mr Justice Nicholas Green announced that he would not be able to make a decision on the case until after October 1. The Act was delayed by one

month pending his verdict,and on October 10 Justice Green released a 96 page decision rejecting the GBGA arguments. In the paper,Justice Green found that the GBGA had failed to show that the new legislation was unlawful under UK or EU law - pointing out that Gibraltar was not a full member of the EU anyway. The judge wrote that the UK Gambling Act served a series of legitimate objectives and was neither disproportionate nor discriminatory.

In respect of the GBGA’s proposed passport solution, Green wrote that it would fail to meet the objectives of theAct or prove effective or achievable without significant bureaucracy or extra cost.He concluded by dismissing the GBGA’s concerns that the UK regulator will find it difficult to hold companies to account in jurisdictions outside the EU. ormer Conservative MP and Economy Minister Sir Richard Needham has said that those blocking the proposed fivestar casino and leisure complex in Belfast are preventing people from enjoying themselves responsibly. New Social Development Minister Mervyn Storey, however, told the BelfastTelegraph that he will not scrap current legislation banning casinos operating in Northern Ireland. Needham,who sits as a nonexecutive member on the board at Rank, the gambling company behind the plans, said that opponents of the move are denying Northern Ireland a world-class attraction ‘blindly’ without taking time to examine the facts. Needham urged Belfast City Council to fight for the power to grant the casino a gambling licence. Currently, such a move can only be made by the Department for Social Development. Rank Group claims the £25m facility would include a bowling alley, cinema and restaurants as well as a casino.

The development would also include a hotel. Rank said the initiative would create 200 jobs for people from sociallydeprived areas of the city. Former Under-Secretary of State for Northern Ireland Needham said he believed a change in the law would bring a boost to the economy and that the casino was just one part of the sprawling complex outlined. New Social Development Minister Storey signalled that he will take a tough stance over the licensing of casinos, however. He stated:“Casino gaming is generally regarded as the hardest form of gambling and is highly susceptible to abuse by criminal elements.I have a duty to protect vulnerable people and their families. Legalising casinos would bring with it the potential for people here to lose large amounts of money just on the single throw of a dice.A gambling prevalence survey commissioned by my department in 2010 has shown that the level of problem gambling here is over three times higher than in the

rest of the UK; this equates to over 2 per cent of the population. In simple terms this means that one in every 50 people here has a gambling problem. “In bringing forward proposals for gambling regulation, my priority is to minimise its effects. I intend to include measures to protect the vulnerable and ensure fairness for consumers. However, on the issue of casinos there is no strong demand for casinos here.” Needham countered: “There are still too many voices heckling from the past, disrupting progress for the sake of maintaining their historic grievances. Some of these voices are part of the opposition to the creation of an international entertainments complex which would create 200 jobs.These same voices would deny Belfast City Council of benefiting from up to £2m annually in rates. “They argue that such a five-star entertainments attraction with bowling alleys, art house cinema, restaurants, casino and bingo

Cumbria police warn arcade operators after machines emptied CRIME

olice in Cumbria have warned operators in the county to Pbeware after a man and woman used a key device to empty machine cashboxes at a holiday park amusement arcade. The raid took place on the afternoon of September 30 at the Solway Holiday Village in Silloth, operated by Hagan Leisure.

Officers have not said how many of the arcade’s coin-op machines were targeted or how much money the couple got away with, but they did confirm that those machines were emptied. Police have issued detailed descriptions of the suspects, who they say were armed with a key that allowed them to open the machines. The man was white, tall, thin,

with light-coloured hair, cleanshaven and under 25-years-old. He wore a distinctive longsleeved top that bore a Mickey Mouse logo. The woman was also white and under 25-years-old, and wore a dark-coloured thigh-length coat that had a white-lined hood. She had long dark hair and was wearing white plimsols. A spokesman for Cumbria said:

“They knew to target the caravan park when it was not busy.” He asked amusement arcade owners in the county to protect themselves from travelling criminals by using additional locking devices on slot machines, warning that many can be opened with a generic key. Witnesses should call police on 101 or Crimestoppers on 0800 555111.

English Tourism Week kick starts the tourism season and provides hundreds of tourism businesses with the opportunity to take part in a national campaign to encourage more visitors through their doors and inspire people to become tourism ambassadors for their local area. England’s pubs are often identified by tourists as a major attraction for an English holiday. This desirability is highlighted by 13m foreign visitors every year. Next year, ETW will run from 14-22 March. Previous events taking place during English Tourism Week ranged from afternoon teas and English-themed baking competitions to art exhibitions, special guided walks and ‘behind the scenes’ tours. There are lots of ways for pubs to get involved from creating all-English menus with locally sourced produce to running themed quiz nights and music events. VisitEngland’s chief executive James Berresford said: “English Tourism Week is a great way to get Britons thinking of England as their next holiday destination by reminding them what’s on their own doorstep. I am delighted that the BBPA is on board and I look forward to its members toasting the tourism industry in 2015.” BBPA chief executive Brigid Simmonds said: “With great hospitality, accommodation and entertainment, pubs are right at the heart of English Tourism. Council officers have been working with the sports centre committee, which is made up of members of the public from the local community, to develop a business plan which is now complete, but the next task is to identify a suitable location for the centre. Councillors agreed to look more at the potential for Agnew Park to host the facility, but agreed it could be problematic with planning issues and could impact on the park’s ability to hold larger events.

after it answered a request made by local police to help out a youth club in the County Durham seaside town.The firm responded to a call for a pool table to replace the club’s existing model which was incredibly popular, but no longer fit for play. Gamestec RDC regional manager Gavin Robson explained: “I was approached by two police community support officers (PCSOs) -Aimee Guest and Martin Nicholson who asked if Gamestec could help the centre by donating a second hand pool table. I thought it was

a great idea so we took a perfectly sound used table, gave it a thorough refurbishment and prepared it for the site. It looks like a brand new table and is a great addition to the club.” Alison Pattison, a One Point youth worker at the club, welcomed the gift, saying: “The kids are absolutely overwhelmed by it.They’ve wanted a pool table for such a long time. It’s fantastic. It’s bringing more in to the club, and we want to say a big thank you to Gamestec.” PCSO Guest added: “This will be of great benefit to the youth centre and the police.The youth centre numbers could increase and, in turn, lead to fewer youths on the street.”

Ahead of its proposed opening next year, detailed of plans of what Margate’s newly redeveloped amusement park will look like have been debuted by The Dreamland Trust. he Dreamland Trust has unveiled its plans for the first phase of the redevelopment of Margate’s iconic amusement park. The new ‘heritage’ amusement park is due to open next year and has received a total of £18m from Thanet District Council, the Heritage Lottery Fund and the government’s Sea Change programme. Around 150 people will be employed by Dreamland during peak season according to the Trust, alongside another 50 employed indirectly on concession stands, bringing the number of new jobs created at the resort to around 200. The centrepiece of the

new attraction will be the reconstructed Grade IIlisted Scenic Railway rollercoaster. Speaking at the launch of the plans last week, project director Eddie Kemsley said: “The Scenic Railway took half a million visitors in its first few weeks of opening, it was so iconic and important on a national level that people visited from all over the country to ride it. “It’s beautiful,it’s visually brilliant and makes a great noise as the cars go along the track because it’s old. “We’ve got wonderful vintage rides all over the country in workshops being restored. Some of them are nearly finished, some of them are in various

stages of repair.” Although entry costs have yet to be announced, membership schemes are planned for the local community to offer it as much use as possible from the site. Dreamland is due to open in spring or summer of 2015, with the prospective date expected to be announced at the end of this year Kemsley revealed that the design and branding of its redevelopment is being led by renowned designer Wayne Hemingway, adding that there wouldn’t be a single area of the new park that hadn’t been touched by an artist or designer. She explained:“Visitors won’t sit on a bench, they’ll

sit on a reclaimed dodgem car that’s been upcycled and turned into a bench. “There won’t be ordinary queues with posts and ropes to go on a ride, it’ll be bits of letters from an old illumination from Blackpool which will create the queue line. “Wayne Hemingway wants every single view to be an Instagram moment which can be posted online and look really interesting.” Although the Trust is aiming for a vintage style for the new park, Kemsley said it would incorporate plenty of modern elements. She commented:“From the front the site will look like a really cool modern leisure complex, with all

the cool architecture to remind us of the past, but then visitors will walk past modern bits that have been interpreted in a different way. “The entrance will have the yellow and black colour scheme which will run throughout the whole project. “The cafes will have a cool mix of modern and vintage and the former dancehall can cater for weddings, corporate events and Christmas parties. “And no seaside amusement park would be complete without a vintage pinball parlour - and ours will be the biggest and rarest collection in Europe, and maybe the world.”

Thousands of attendees descended on the Sands Expo and Convention Centre for G2E’s largest show floor to date, with more than 500 exhibitors showcasing high-tech innovations, unveiling popular entertainment-title games and even hosting celebrity appearances. From Europe, Novomatic Group, owners of UK coin-op subsidiary Astra Games, the show represented an opportunity to showcase its own latest cabinet offering: the Novostar VIP. Whilst still retaining the unique

Meanwhile, long-time global manufacturer of slots and casino games International Game Technology (IGT) announced in July their impending $6.4bn take-over by Italian firm GTech S.p.A, with early indications suggesting a complete cessation of trading under the IGT banner. And then there was Future Logic, longtime established providers of gaming printing products, proudly displaying their acquisition by transaction technologists JCM Global. The upheaval, or consolidation as the suits describe it, provoked mixed responses from industry stakeholders: “There’s concern and there’s excitement,” said Paul Magno, executive vice president of Gaming Laboratories International, one of the leading global providers of gaming testing services. “On the one hand the face of the industry is clearly changing, and there’ll be new prospects that go along with that. On the other, we really don’t know

what that brings in the future.” The show, though, must go on and G2E did that both on and off the expo floor. The Las Vegas Convention Center also provided the platform for a programme of keynote industry speakers, including billionaire casino entrepreneurs Steve Wynn and Sheldon Adelson, owners of Wynn Resorts and the Las Vegas Sands Corporation respectively. Peter Yesawich, vice chairman of travel marketing agency MMGY Global, also took the stand, profiling current vacation trends of the American public. Whilst Las Vegas gaming revenues remain depressed in the post-recession climate, there may well be respite close to hand: MMGY’s latest findings suggest that the ‘millenial’ generation (those aged 18-35) have the highest level interest of any age demographic when it comes to the prospect of a future gambling holiday. The inextricably powerful and prosperous link between tourism and gaming - now where have we heard that before?

A new beginning for coin-op

With the hustle and bustle of a busy trade show enough to sweep anyone off their feet, we’ve asked some industry veterans give us their top tips for making the most out of the first ever Autumn Coin-op Show.

For an industry that still faces difficult times, the addition of a new show could provide a galvanising influence, explains Astra’s Alan Rogers. he first ever Autumn Coin-op Show (ACOS) hits west London at a time when money is once again, slowly, beginning to flow around the industry.And despite persisting difficulties,Astra’s director of sales,Alan Rogers, believes that there are reasons for hope.“There has been an improved appetite across the board for investing in the business and there’s a willingness on the part of stakeholders to explore new ideas and open up to fresh concepts,” he said. Nevertheless, we remain a sizeable distance from the heydays of old and there’s plenty of ground to still be gained.“I think that the industry finds itself in a challenging position at the moment,”said Rogers.“There is a stability of sorts in so far as we’ve had things a lot worse in the past, but then again we can all recall times when we’ve had things much better.” ACOS could well be a catalyst in that rejuvenation project, but Rogers warns that it will require a communal effort to make the show, and its positive effects, a lasting success.“According to the theory,” he said,“an autumn exhibition should provide the perfect setting for industry stakeholders to gather and prepare for any opportunities that might emerge when the show season proper kicks off in January.The hard part, of course, is encouraging everyone to subscribe to that theory and to get into the spirit of the event.” On an individual level,Astra will ultimately judge the show on sales.“All shows are judged to some extent by what’s in the order book after the doors have closed,” noted Rogers. However, there are other valuable rewards to be taken from each and every show, and with ACOS slotting in ahead of the major show season, simply allowing customers to get eyes on product may prove equally as valuable. “Sales form a vital element of the exhibition process,” said Rogers,“and we’ll be looking to sell as much product as we can over the two days at ACOS, to lay down the foundations for further orders at EAG and ICE. But as any exhibitor will testify, a healthy order book on its own does not always signify a successful show.There are other factors such as the number and quality of visitors who attend.” In depth discussions, both with customers and competitors, also form a major component of any good show and Rogers believes that coin-op folk have a natural aptitude for productive conversation.“Networking has always been one of the coinop industry’s strongest points,” he noted.“In good times and bad, stakeholders and competitors have come together to talk over the challenges, threats and opportunities faced by the business.” This fosters a spirit of lively debate, without causing bitter divisions between rival businesses.“We might not always agree on everything,” he said,“but as an industry we are very good at working together to find solutions.” For this reason, Rogers will ensure that he and his colleagues retain focus on networking throughout the two-day event. “From an Astra perspective,we always take time out to talk with our customers at shows,” he said,“and ACOS will be no exception. It helps to forge new relationships and strengthen existing ones, and the feedback we get is invaluable.”

Ahead of the Autumn Coin-Op Show, BACTA honorary treasurer John Powell notes the significance of the trade-event as a marketing and networking opportunity within a challenging marketplace. ohn Powell’s credentials are impressive.A fellow of the Institute of Chartered and Certified Accountants, he has over 35 years’ experience of working in the gaming and amusement machine industry. Currently serving as BACTA’s honorary treasurer, Powell is also chairman of the Independent Operators Association (IOA Group), a specialist marketing and purchasing organisation comprised of 15 independent gaming machine suppliers. Amongst his busy schedule, he also finds time to serve as managing director of S E Leisure Ltd, who supply over 5,000 amusement machines to the pub and club sector. Armed with a wealth of industry knowhow, we asked Powell how important he judged the upcoming Autumn Coin Op Show to be. “It’s very important,” he replied.“Previously, there was a substantial gap in the trade-show calendar since the previous autumn show ceased some years ago. There’s too long a period to go from one EAG to another, so ACOS fills the void that was created quite nicely.” Whilst anticipation for ACOS amongst suppliers and operators alike remains high, Powell was conscious of the wider sector environment that forms the backdrop to the event.“It’s still very difficult,” he said, “especially as far as single-site venue operation is going.”He outlined a particular area of flux underlying the industry obstacles his business is facing:“The marketplace is changing, and the key thing is the fact that there are now less pubs operating machines.” How did he explain this slowdown in the pub sector? Powell was definitive: “What it comes down to is a wider change in peoples’ social habits.” In spite of the challenges, Powell values ACOS as one of the industry’s premier opportunities for forging closer business links:“The networking potential at ACOS is

Autumn Coin-op Show: Shaping up for success With half a century’s experience beneath his belt, Bill Simmonds of F Simmonds & Sons anticipates success for the Autumn Coin-op Show amid high-quality exhibitor attendance ill Simmonds comes to the Autumn Coinop Show with a discerning eye born out B of decades of experience:“We’ve been in business fifty years, and I’ve been here for the duration,”said Simmonds,who was something of an early-starter.“I’ve been going to amusement trade-shows since I was twelve years old.” He’ll be well-placed to survey the show’s latest offerings:his business has experienced something of an upturn in recent months. “Business is good at the moment, we’re slowly picking it up,” he noted,“in general, the sector seems to be up and down, a bit

unpredictable, but in the long term I’m still optimistic.” To his mind, the success of a show hinges upon the quality of its exhibitors:“Looking at the brochure, I’m particularly optimistic about this year.”He commented.“It looks like it’ll shape up to be a real success.” Simmonds echoes a familiar sentiment as to the timely occurrence of ACOS in regards to the industry calendar:“We needed something around this time in the year,”he stated there’s been a gap around this time of the year for quite some time,and so ACOS seems the logical way forward.”

The benefits of attending are twofold, he argued:“It’s a networking opportunity for us mainly,but it’s also useful to see if there’s anything really new and different on the market.” With his business specialising in the supply and operation of machines to the pub sector, the prospect of new product acquisition may be tempered against that specific sector’s challenges: “A major obstacle that we’re facing at the moment is trying to get enough rent for our machines,”he explained.“The brewers want the best products with the latest features but aren’t willing to match the cost of leasing

these newer machines.We’re constantly battling the uphill struggle of reaching a fair price on the rent of our units.” Whilst ACOS represents one of the best opportunities to take in the industry’s latest innovations, for Simmonds, the event would benefit from additional SWP games:“It’s not the fault of the show - it’s the government legislation which has essentially taken a whole ream of SWP games out the running,” he said.“The industry requires support from the government,not the passing of measures which detract from its earnings.”

Comment Time to reflect on the summer season

Hopefully, the Stamford Bridge event will prove to be a worthwhile and relevant business exercise above and beyond a meet and greet-fest. I’m pretty sure it will. Elsewhere, the Gambling (Licensing and Advertising) Act 2014 will go ahead on November 1 after Mr Justice Green found no errors or flaws in that logic or in the procedures which led to the adoption of the final policy conclusion, despite the Gibraltar Betting and Gaming Association’s high profile protestations otherwise. Now that the weather seems to be finally taking a turn for the worse as we reach the halfway point of October, it would be interesting to hear how well the coastal arcades fared in the warmest and driest September for over 100 years. You may remember a news article that appeared in Coinslot in recent weeks which offered substantive

If nothing else, investment into several well-known seaside resorts continues apace and with any luck this will be reflected in increased footfall and bigger cashbox takings in 2015. With depressing predictability, McIlveen stated:“In establishing a casino in Belfast it will have the potential to subject some of the poorest of our population to a life of misery with all its attendant problems. Northern Ireland has long cherished its puritanical past which is under pressure from a policy of liberalism coupled with an unrestrained view of freedom of expression.” When such a figure (McIlveen is a retired Free Presbyterian minister) comes out with these kinds of words one wonders what planet they live on.

Gowers said that a ‘broadbased economic recovery’ which delivers social mobility and raises living standards for all - would be dependent on growth in all sectors, not just those requiring a high level of academic skill. He underlined the importance of tourism to job creation, with the sector creating a third of all new jobs since 2010 and Travelodge alone helping 3,000 unemployed people back into work through its partnership

with the Job Centre since 2007. “One in ten people in the UK work in travel and tourism, and a lot of people in this room today look surprised by this. This is a £127bn sector that provides fantastic career opportunities and what we need is a government who celebrate the role tourism can play and stands up for the industry,” he said. Gowers also argued that tourism offers excellent career progression, and called on the government to do more to encourage lifelong learning in sectors currently below the ‘national radar’. In response, Nick Boles MP, minister of State for Skills and Equalities, acknowledged the role that tourism plays in the economy, and said it was a ‘huge priority’ for the government. He argued that the industry should play a role in highlighting opportunities, because it was ‘more in touch than politicians about what employees need’, but agreed that more needed to be done to improve access to lifelong learning.

The debate then turned to international competitiveness, with BHA chief executive Ufi Ibrahim warning the objectives put forward by Prime Minister David Cameron were at risk of being missed without further government action. Dr Gerard Lyons, chief economic advisor to the Mayor of London also took to the stage to argue the importance of tackling business taxes, regulation and transport to help tourism businesses succeed, while Baroness Neville-Rolfe DBE CMG, Parliamentary Under Secretary of State for Business, Innovation and Skills, called for the government to adopt a ‘long-term vision’ on infrastructure. Elsewhere, an Asian betting group submits plans to transform vacant office building into new betting shop, bar and restaurant venue, according to the Birmingham Post. Hagan digests Mr Justice Green’s Gambling Act judgement Specialist gaming law firm Harris Hagan has issued a bulletin detailing the outcome of the GBGA’s Judicial Review challenge to the point of consumption licensing regime. Here John Hagan digests some of the judgement.

Chaplin Court is owned by Black Country-based London and Cambridge Properties which intends to lease the building to Xela Estates. 138.com would operate the ground and first floors itself and lease out other available units although not all of the building forms part of this application which covers 16,412sq.ft. GVA’s report added: “The applicant considers that Birmingham offers an excellent opportunity for investment, and, as such, the city is one of the first of several locations around the UK where it intends to deliver new mixed-use leisure and entertainment venues.” And finally, we are continuing to see a decline in street operations with growth in FECs, particularly large format locations, according to Intergameonline.com. Larger outlets, from 20,000 to

60,000sq.ft, are also dominating the markets in the US, Middle East and Asia. Surprisingly, the UK and European markets have been slow to develop in this area. Companies like Timezone, Dave and Busters, Main Event, Chuck E Cheese, MAF, Fun City, Al Hokair, Al Otaim and Wanda are each generating hundreds of millions of dollars in sales and growing in their individual markets. Consumers are looking for immersive experiences, which suggests that the future of the industry may not be limited to games which come in a box with a coin mechanism/swiper, which has been the standard for more than 100 years.

In a 96 page judgement, Mr Justice Green rejected the GBGA’s claim that the Gambling (Licensing and Advertising) Act 2014 infringed EU or domestic law.In what he stated was in his judgment“a clear cut case” he ruled that the new regime was: “…neither disproportionate, nor discriminatory, nor is it irrational. The new regime serves a series of legitimate objectives. There is no reason to doubt Parliament’s judgement that it will achieve a reasonable degree of effectiveness and there is no proper basis for concluding that it is or will be discriminatory in its effects.Further,I reject the submission that the new regime will create perverse incentives and lead to the creation of an illicit market of unscrupulous service providers.” In his judgement, the documentary evidence from 2010 onwards (when the UK government began to consult over changes to the licensing regime) recorded “a strong and consistent justification based upon consumer protection and the protection of public order” and that “these were objectives the Government and Parliament were entitled to pursue”. He concluded that:“Consumers want to avoid being cheated.They want winnings to be paid.They want their personal data to be kept confidential. They want to have confidence that the operators with whom they deal are properly regulated in these respects and that in the event of a problem they can contact the regulator easily. The State wants consumers to be protected from addiction and wants those who

profit from gambling to assume some level of responsibility for the social ills that gambling can lead to. In my view a regime that does no more than bring service providers within the confines of a consumer and public order oriented regime in the State that they target serves entirely legitimate objectives.” For those within the industry who believe the new regime is really about tax revenues,Mr Justice Green noted the explanation of the UK government that the exposure of offshore operators to the domestic tax regime “was a by-product of the regime not its principal justification”. For his purposes, he excluded any economic considerations in determining that there was sufficient justification for the new regime based only upon legitimate consumer and/or public order grounds. For those within the industry who believe the new regime will prove to be unenforceable, Mr Justice Green said that:“First, there is no evidence or reason to believe that there will be a major enforcement problem. Secondly, even if there are limitations in the enforcement regime, the Government and Parliament were entitled to take the view that the suite of enforcement powers available to the GC would be sufficient, at least in large measure, to meet the licensing objectives. Thirdly, the Government has acknowledged that if and insofar as this proves not to be the case that it would review the law and take steps to strengthen enforcement powers.” No application was made in court for leave to appeal,as we would ordinarily have expected if there had been any intention on the part of the GBGA to appeal. In terms of what this means for operators, the new regime will go ahead, as planned, on 1 November 2014.
