Five gaming arcade operators have become the first in the East Riding to gain accreditation as part of a unique pilot scheme aimed at promoting and rewarding good practice and responsible gaming. ive arcade operators have gained accreditation as part of a new scheme which once illustrates that the coin-op sector is at the vanguard of transparency, customer protection and safety. The gaming accreditation awards,which are a joint initiative between East Riding of Yorkshire Council and BACTA,are the first of its kind anywhere in the country. The scheme provides a system of support and advice to local businesses to promote public health initiatives and safeguarding adults and children from harm. The council is working with the gaming trade and BACTA to jointly raise standards and reduce the level of inspection required by the council. Since October last year, 21 gaming premises were jointly assessed by officers from the council and trade assoiation. They were assessed on seven standards including the likes of crime prevention,public health initiative and safeguarding systems. Taylor Made Fun, based in Bridlington, was the overall winner of the scheme,with Smiles for Miles, who are based in Withernsea, runners up. Leisureland and J Noble and Sons, both based in Bridlington and W&J Shaw, based in Withernsea were also accredited. Councillor Jackie Cracknell, portfolio holder for community involvement and performance at East Riding of Yorkshire Council, congratulated those owners who now had accreditation. She said: “This is a fantastic scheme and the arcade operators must be congratulated on their accreditation. This pioneering joint initiative is a different way to deliver regulation side-by-side with the trade, using recognition of good practice, promoting safeguarding and ensuring that stan-

dards remain at the high level we currently have across the East Riding.” Cracknell added: “This is the future for the licensing trade in the East Riding and we want to show the rest of the country a very good example of best practice. The council is keen to find new ways to support local businesses and are pleased we have also been able to keep licensing fees low for the operators.” John White, chief executive of BACTA, said:“I really do applaud

The saga surrounding Margate’s signature amusements offering has been long and arduous. Hard work, dedication and incredible resolve has brought the Dreamland dream closer than ever to a reality. Now, talks to bring in an operator for the amusement park are within touching distance according to soundings from the local council. Could it be that Dreamland will actually be riding high in the seaside town by next year? n operator for Margate’s new Dreamland heritage amusement park appears to have been found after Thanet District Council agreed a deal with Sands Heritage. The award of the contract to Sands, which is also based in the Kent seaside resort, is subject to agreement of the lease terms, which the two parties will discuss over the coming months. The board of Sands Heritage is thought to include industry and financial professionals that have experience with visitor attractions such as London Zoo, Kidzania and the new London Paramount Entertainment resort currently being planned in Kent. Belfast arcades under pressure from organised crime POLITICS

recent debate at the Northern Ireland Assembly saw politicians discuss the A effect that fronts for paramilitaries still have on businesses in Belfast, including family-run amusement arcades. Edwin Poots, of the Democratic Unionist Party, stated: “For a considerable period of time, the SDLP have positioned themselves as the stooges of Sinn Féin. They will never separate themselves from Sinn Féin on any of the big issues. They are like rabbits caught in the headlights.” Joe Byrne, Social Democratic and Labour Party (pictured), countered: “I thank Mr Poots for giving way. Would he accept that it is virtually impossible to run a family-owned private business in parts of Belfast in the pub trade, the fuel business or in amusement arcades? We have the abuse of an official mechanism known as the national charities registry. Fronts for paramilitaries on both sides have become legitimised and a blind eye is being turned to that. We want the National Crime Agency to be effective in that regard as well as on the other issues and to have real accountability.” Poots concurred, stating: “Of course I agree. The Member has stated very clearly that the current arrangements are ineffective. Meanwhile, the SDLP are wringing their hands and saying that they cannot change it because we do not have as much accountability for the National Crime Agency as we have for the Police Service of Northern Ireland. It is not that we do not have accountability. It is that we do not have as much accountability as we have with the PSNI. We really need to move ahead with this, and the SDLP needs to look at themselves and who they are is lining up with on this. They are lining up with Sinn Féin and all of the other people that I named at the start. The SDLP needs to reconsider their position. If they have genuine concerns, get them dealt with and let us move on. This business of carrying on and on and on, and delaying, delaying and delaying is brilliant news for all those criminals and gangsters out there.” While the struggle which some Belfastbased operators must face to do their daytoday business looks to be a tough one, the issue has now been openly discussed at the Northern Ireland Assembly and is something that cross-party politicians appear to want to do something about.

Controversy stirs as Godden trust plans sale of Banksy art to fund cancer care charity FEC

The cancer charity set up to honour one of the biggest figures in Kent’s amusements history, Jimmy Godden, is set to get a boost from the sale of a piece of street art by one of the world’s most famous artists. But not everyone is happy with this.

painting by Banksy has been removed from the A side of a Folkestone amusement arcade and will be sold to raise money for a cancer charity. The piece, dubbed ‘Art Buff’, appeared on the exterior wall of Palace Amusements just over a month ago, with the world-famous artist later revealing it was his contribution to the Folkestone Triennial art festival. Estimated to be worth over £300,000,the painting will now be auctioned and the proceeds raised given to the Jim Godden Memorial Cancer Trust. The charity was set up by Rochelle Godden after the death of her husband, Kent amusement industry giant Jimmy Godden, who lost

his life to cancer in 2012. The sale will be coordinated by art dealer Robin Barton, who previously handled the £345,000 sale of Banksy’s Kissing Coppers mural, which first appeared on a pub wall in Brighton. Barton told the Folkestone Herald that the artwork will be cleaned and restored at a secret location in Britain, before being shipped to the US, where it will be sold. He added: “The unsolicited work that first appeared on the wall of an amusement arcade in Folkestone was the subject of a number of attacks, including one where a cartoon phallus was applied to the plinth,now thought to have

been the work of the artist on a second clandestine visit to this sleepy seaside town. “The artwork will carry a price tag in the region of 750,000 US dollars and all proceeds of any sale will go to the Jim Godden Memorial Cancer Trust, created in the memory of local businessman Jim Godden, whose widow owns the wall where the artwork was applied and is herself an active fundraiser. “Its removal has been met with considerable local hostility from the local artistic community culminating in a tirade of obscenity being sprayed on to the wall where the work was first sited.” As well as the resort’s

artist community, the removal of the Banksy piece has also caused consternation with Folkestone and Hythe MP Damian Collins. The Conservative Party MP has written to the Godden Family, who own Palace Amusements, asking for them to consider an alternative solution to the issue that would allow the artwork to remain on public display. Collins wrote on social network Twitter: “The Folkestone Banksy artwork was a gift to the town, not for the profit of one person. We must do what we can to try and get it back.” It seems that when it comes to Banksy, not even charity can stop the writing on the wall.

£150m Birmingham NEC complex add-on takes shape ‘stunning new entertainment hub’ is coming to Birmingham’s NEC complex and is poised to welcome thousands of visitors each year. Its shimmering glass appearance and modern curves could make it the envy of glamorous resorts in cities around the world,according to local press. The in-progress Resorts World will ultimately include a four-star hotel, dozens of designer shops, restaurants and bars, a casino, an 11-screen cinema and a spa as part of the £150m development. Bosses say works are on track for the site to be completed by next spring and hope the glass venue will prove a fitting addition to the well-known destination. Huge glass panels will envelop the front of the building as it comes into sight for visitors. Officials say the resort will be the first of its kind in the UK and is set to be the largest leisure and entertainment complex in the whole of Western Europe. They hope the design will

With typical manufacturer lead times of four weeks to build new product, we have fast approached the last week to place orders on manufacturers for product to be available week commencing December 8. For most single site operators,

Walter Cohla, of Heywood, travelled to Oldham three times and caused over £6,000 worth of damage to the smoking area of the Oldham town centre hall between January and May. Mecca bosses set up CCTV cameras to watch the area after previous damage to its industrial bins. They caught Cohla setting fire to fencing and bins and pleasuring himself on his second visit. He was finally identified after a third visit, when the cameras caught a better view of his face. Rebecca Romih, defending, described the situation as an unusual case. Cohla was first seen in the smoking area looking for cigarette ends and was ordered to leave by a member of staff. After brooding on the encounter he returned, intending to ‘cause the person some distress’, according to local press. Cohla was revealed to have suffered depression for 10 years. He remains on conditional bail - and can’t go within 50 metres of any Mecca premises before his crown court appearance.

The board expects that the acquisition will be earnings enhancing in the first year, even before the benefit from applying Tenpin’s operating model. The bowling centre operator added that the new contract to provide its amusement machines estate has resulted in this key category being materially improved. The migration has now been completed on schedule and the new machine estate is operating ‘satisfactorily’. Selected by a panel of leading UK toy retailers,the DreamToys list is the most accurate predictive list available,and provides consumers with expert insight into what will be the most popular toys this Christmas. Early indications suggest that 2014 is set to be the biggest year for toy sales since 2010. “The 2014 DreamToys list is the perfect illustration of how the toy indus-

Minister praises Mumbles Tivoli plans REGENERATION

Work has begun to clear the famous building,known locally as the ‘Tiv’, ahead of the multimillion pound Oyster Wharf

regeneration scheme. Crabb, Conservative MP for Preseli Pembrokeshire, said: “Tourism is becoming an ever more competitive sector but developments like this will put Mumbles on the map and represent a legacy for future generations.” The £4m Oyster Wharf development on Mumbles seafront has been granted planning permission and will comprise restaurants, shops and a gym and spa. Crabb described the development, which will see work begin on it after Christmas, as “stunning”.

Skegness seafront road safety to be improved RESORT REPORT

The coach companies will want to go elsewhere and that is not a good thing.” A meeting took place at the Embassy Theatre recently between councillors, highway officers from Lincolnshire County Council and local campaigners Hunter-Clarke concluded: “The proposal we are taking forward is to stop disabled parking across the road from the Embassy.This is not trying to prevent disabled parking on the seafront.It would be moved to a designated area on South Parade.”

are searching for two men after an attempted robPberyolice took place at an amusement arcade on Morecambe promenade last week. During the attack an armed raider entered Slater’s Amusements and threatened a staff member with a crowbar, while an accomplice stood at the entrance. The staff member managed to flee to the safety of a nearby pub and asked guests, who were taking part in a quiz, for assistance. Glen Cooper, former editor of local newspaper The Visitor, was taking part in the Monday night pub quiz when the arcade worker came in. He told the publication: “He went straight up to the barman and said: ‘Can you ring the police, please, we’ve just been raided’. “He looked really shaken and distressed. The barman rang the police immediately. The man calmed down. He was leaning against the wall and getting his breath back. “The police turned up straight away but the men had already gone.” A spokesman for Lancashire Police said it received a call at 9.40pm on Monday last week, initially describing both raiders as having their faces covered, and one as wielding a baseball bat. The quick actions of the arcade worker appear to have paid off, as nothing was stolen during the attempted robbery.

Wetherspoon enjoys strong August and September trade PUBCOS

Independent pubco and long-time supporter of AWPs and SWPS, JD Wetherspoon’s interim management statement for the 13 weeks to 26 October highlighted strong trading through August and September, despite the impact of VAT on its coin-op machines. or the 13 weeks to 26 October 2014, pubco JD Wetherspoon’s like-for-like sales increased by 6.3 per cent, and total sales increased by 11.3 per cent. Sales were good through August and September, but like-forlike growth decreased in October. The operating margin in the period was 7.7 per cent, compared with 8.3 per cent in the same period last year. In October, the company

increased pay for hourly paid staff by 5 per cent, while utility costs increased by about 4 per cent. In addition, during the period, there have been cost increases from suppliers. The company has opened two new pubs since the start of the financial year. It has 15 pubs under development and,in line with its last update, intends to open around 3040 pubs in the current financial year.

The statement read:“In recent budgets, the chancellor has announced heavily publicised and welcome cuts in beer duty. In contrast, in an initiative which achieved little recognition, changes were announced in 2012 to the VAT treatment of pub slot or ‘gaming’ machines.As a result,pubs were no longer to be allowed to set off all VAT charged by suppliers against VAT charged to customers. “This legislation has

been interpreted by the tax authorities so that a proportion of VAT inputs for pub businesses is disallowed. For example, if gaming machine income is 4 per cent of a pub’s sales, 4 per cent of the pub’s input VAT, in respect of certain categories of supplies (even if unrelated to gaming machines), is disallowed. This new ‘tax’ cost Wetherspoon an additional £3.6m during February 2013-July 2014. “These sorts of tax

increase penalise pubs, which are closing in great numbers, yet not supermarkets, which already benefit from a zero VAT rate on food, whereas pubs pay 20 per cent. Supermarkets also pay far lower business rates per pint or meal than do pubs. Indeed, this government has presided over thousands of pub closures - perhaps more than any government in history. The pub industry recognises that governments need to balance the books,

yet it is imperative for the future of pubs that political parties commit themselves to a sensible rebalancing of the tax system, so that there is fairness and equality between pubs and supermarkets - a rebalancing will produce more revenue for the government and more jobs in the economy. Stealth taxes, including the new treatment for gaming machines, are confusing and unfair for publicans and are very harmful to the industry.”

Comment Looking forward to the annual convention

alex lee comment espite having to get up at‘milkman’time to catch the train from Manchester Piccadilly to London Euston, I’m quite looking forward to the BACTA Annual Convention at the QEII Conference Centre on November 27. The winds of change seem to be blowing through the industry at present and I’m sure this will be reflected in the speeches and prevailing attitude at the event. Having glanced at the list of speakers, not only does it read like a who’s who of the sector’s movers and shakers,but also the likes of Philip Graf, from the Gambling Commission,who I’m sure will be given a thorough examination of his credentials and views on regulation during the informal panel session, which will also include representatives from the Department of Culture, Media and Sport and the Responsible Gambling Trust. The expression ‘sledgehammer to crack a nut’ when it comes to some of the legislation that has dogged the soft gaming industry immediately springs to mind. In fact, I’m sure I’m not alone with my standpoint that the average Police display dog will leap through less flaming hoops in its lifetime than today’s trimmed-down legion of arcade, FEC,

single site and bingo operators. Like the recent Autumn Coin-op show and the forthcoming EAG International 2015,the annual conference will give everyone concerned an opportunity to discuss issues with likeminded individuals and while the convention is far from an exercise in sales like the above mentioned two events it is equally unmissable for all sector stakeholders. In other news, I was delighted to see that five arcade and FEC operators in the East Riding of Yorkshire had been given accreditation for their hard work in compliance and generally making sure customers had a safe and enjoyable experience at their premises.This type of news further underlines the fact that the coin-op sector is up there with the best when it comes to good business practice. And finally, a week doesn’t seem to pass without news of another fruit machine theft. While I’m not going to start advocating capital punishment for AWP thieves I’m sure a little stint in the stocks where rotten cherries, lemons, strawberries and so on could be thrown at the miscreants before they started their stretch at Her Majesty’s Pleasure - wouldn’t do them any harm!

alex lee media watch ookmaker John Boyle says that the fact that B Boylesports was debt free in 2007 made a huge difference in terms of coming through the crash, according to the Irish Independent. In the teeth of a downturn it allowed the business to double in size, from 98 shops in 2007 to 198 today. With size comes a growing profile, boosted last month by a seven-figure deal with RTE that sees Boylesports sponsor horse racing across the national broadcaster's services. Boyle now presides over a betting empire of 198 stores, 1,500 staff and a growing digital business. Boylesports didn't escape unscathed from the crash. The typical bet halved after 2007, Boyle says, and has not yet recovered but more people are betting, and betting on more things. In Market Hill, Co Armagh, Boyle set up his first shop in 1982. In 1989 Boyle began

what snowballed into a rapid expansion. He crossed the border to buy a shop in Drogheda. Within a year he had a third shop, and the pattern has continued ever since renting rather than buying established betting shops and rolling out his successful formula. “I was picking up the shops for very small money. I remember buying a shop for IR£2,500 and for me that was a big investment, but it was successful instantly,” he recalled. Growth was being funded from within the business and success fed ambition, he says. After seven years behind the counter in Markethill, Boyle was happy to embrace change. Sourcing shops and closing deals provided the change he was after. Growing a small business into a big one, especially one with a geographic spread, means relying on managers, but it’s something

Boyle says came easy enough to him. “It worked very easily. I was amazed. I remember that second shop; there was a young fellow, Frank Cruise. He’s still with me in a senior role. But he was sitting there that morning in 1989 thinking he had no job, maybe. People grow along with you. It was never difficult to get good people.” Boylesports had borrowed during its expansion - as much as €20m at one stage. But by 2007 that money had been repaid, giving Boylesports the flexibility to ride out, and even benefit from the storm. Rapid technological advances and changing customer expectations demanded investment in digital. The Boylesports mobile App means every customer has a full bookie's shop in their pocket, all the time and anywhere, he explains, and they demand no less. Horses are still the big

Down at Bingo Palace, in the inner depths of Elephant and Castle shopping centre in London, Gary Dighton is there with his mum and for him, it's all about the win: “I'd prefer to make money, than just go out and drink.” The most he has won is £80, but this is a big club with national games - players regularly win up to £1,000. He’s close to his mum, and takes her twice a week for a night out. But just by virtue of being a hoodie-wearing 20year-old, he says he rubs people up the wrong way. “People around where I live aren't very polite to me. It’s their influences, they just think I'll be involved in crime or something,” he said.

He’s not the only one more likely to be down the bingo hall than down the pub. The Bingo Palace manager Patrick Kelly, who’s also vice-chair of the Bingo Association, says the average age of players is getting younger. He said: “Young people are always attracted to clubs that are bigger, busier, and offer good money. It's like everything - it's about the atmosphere that goes with it. They come in the evening. People often meet up, and you'll see them moving from table to table. It's a very safe environment, especially for women.”

The Gambling Commission: Regulator or Legislator? The Gambling Commission, whose existence and duties derive from Part 2 of the Gambling Act 2005 must fulfil its statutory functions by reference to the law as it stands, not as it would like it to be, believes solicitor David Biesterfield.

The salient provision (although the issue in question is not restricted to non-remote betting operating licenses) states:“Gaming machines may be made available for use in licensed betting premises only at times when there are sufficient facilities for non-remote betting provided….” The issue was whether the test of“sufficient facilities” turned on their existence or the dominance of their use.As Judge Warren concluded, the requirement that betting facilities be“provided” was to be determined by reference to their existence, not to the variable and questionable concept of the level of their use. As the Judge noted, the GC’s interpretation “…insert[ed] into the condition, without justification, words which are simply not there”.The GC was attempting to impose a condition which the Judge suggested would have been invalid had it been interpreted as the GC argued. In essence, the GC was attempting to legislate rather than to regulate. It is now repeating that error in its review of the social responsibility provisions of the LCCP. In its consultation, the GC asserts:“The LCCP is based on the principle that the primary responsibility for delivering the licensing objectives – keeping crime out of gambling, ensuring it is fair and open and protecting children and vulnerable people – rests with gambling operators”. While the Act empowers the GC to impose on operators conditions which the GC properly concludes are necessary to enable the GC to fulfil its duty to “pursue and wherever appropriate to have regard to the licensing objectives”, it imposes no such duty, let alone a “primary” responsibility to “deliver” the licensing objectives, on operators. To impose the suggested “primary responsibility” on operators would be extreme, going far beyond the matters

that any operator, even in the largest category, could be expected to manage. For instance, the “local risk assessments” suggested by the GC in the consultation document would require operators to evaluate matters beyond their own premises, experience or expertise while the GC’s suggestions in relation to “customer interaction” assume operators to be expert psychologists. The GC seems not to accept that a licensee’s only legal obligation is to operate in compliance with the law as it stands. Conversely, the GC seems to relegate its duty “to permit gambling [so far as] reasonably consistent with the licensing objectives”, a duty enforced by its obligations under the Regulator’s Code . In his forward to that Code, the Minister of State confirmed the Government’s commitment “…to reducing regulatory burdens and supporting compliant business growth through the development of an open and constructive relationship between regulators and those they regulate.” By apparently pursuing a political rather than a regulatory agenda, the GC fails compliant businesses and, in its usual refusal to exchange with operators detailed legal opinion on points of dispute,it fails in its obligation to develop an open and constructive relationship with the industry it regulates. As the Minister confirms:“This Code does not detract from [the protection of the vulnerable, the environment, social or other objectives] but seeks to promote proportionate, consistent and targeted regulatory activity through the development of transparent and effective dialogue and understanding between regulators and those they regulate.” To retain the confidence of the industry that it regulates,the GC should surely regulate rather than seek to legislate and be seen to test each and every new regulatory burden against the criteria of proportionality and necessity.
