Newham Council versus th BACKGROUND

• Newham currently has 86 betting shop premises licences and there has been an increase of almost 30 per cent since 2007. • Licensing regulations restrict betting shops to having only four FOBTs, Newham Council believes that this restriction is what has contributed to the rise of almost 30 per cent of stores in the borough during the last seven years. • Newham Council’s licensing committee refused a licensing application to Paddy Power in February 2013 on the grounds that the company could not prove their primary use would be traditional overthe-counter betting, not fixed odds betting terminals. Although the decision was overturned at magistrates’ court, a judicial review confirmed that for a council to be effective in carrying out its licensing authority functions primary gambling activity must be taken into

consideration. • Earlier this year Newham Council supported Hackney Council’s SCA submission calling for the introduction a separate planning class for betting shops, which the government consulted on over the summer. • On October 14, 2014 London Councils’ leaders committee also passed a formal motion backing Newham Council’s SCA proposal. Councillor Claire Kober, London Councils’ executive member for regeneration (pictured), said: “Londoners have told us they are fed up with the number of betting shops on their high streets, and they want councils to have more powers to act. While we welcome the recent changes that the government has proposed to the planning regulations around betting shops, councils currently have no power to regulate how fixed odd betting terminals operate.”

ajor single site operator Bob Rudd has given digital content the nod as one of the sector’s most important features for 2015 and beyond. The firm’s managing director Bob Rudd welcomed the £100 triennial review for Cat C machines at the start of 2014, stating that it has given machine income a boost. His company’s digital estate has handed the operation a lift and Rudd has noticed increased player uptake over the past 12 months. He explained: “Our digital estate of machines has seen a new level of consistency this year, which is pleasing. We know

digital is the future and can begin to see players thinking that way also.” He does, however, believe that there is still a significant place for analogue in the single site product mix. n response to Newham Council’s initiative,the Association of British Bookmakers defended their corner by stating: “There is no evidence in that a reduction of the stake to £2 will have any impact on issue gambling. Betting shops are located in major commercial centres and 84 per cent of betting shops are located in commercial centres where the demand is highest.” It added that the licensed betting office industry had introduced a voluntary code for FOBTs where there would be more breaks in play. The statement concluded: “The majority of customers stop playing after reaching their voluntary limits and self-exclusions have gone up by 35 per cent in the last six many months as a result of customer interactions with staff in shops.”

Newham Council’s sustained attempt to drive betting shops off Britain’s high streets - for better or worse for the local business community - is gathering momentum. With cross-party local authority support growing, is Britain actually turning into the Russia of Western Europe? ewham Council’s Sustainable Communities Act proposal, which demands that the government reduces the maximum stakes on betting shop B2 gaming machines (FOBTs), from £100 a spin to £2, has been backed by 92 other councils from across the political spectrum up and down the country. The East London-based council, and its supporting authorities, argue that a rise in the number of bookies, mainly big name chains, are clustering on high streets, and taking advantage of lax planning laws. Their proposition is that in the 55 most deprived areas of England, there is double the number of betting shops, compared to the 115 most affluent localities. The Mayor of Newham Sir Robin Wales is demanding that action is taken to reverse the decline of the country’s high streets into the hands of bookmakers. He said: “We are fighting hard to ensure that high streets up and down the country are not dominated by betting shops who are solely concerned with making a quick buck on a computer roulette wheel. In Newham we have tried to curb the rise in the number of betting shops, especially those chain stores who try to maximise their profits through fixed odds betting terminals, but our battle with the betting shops has been thwarted by the lack of tough regulations and the toothless court system. “We are now taking the next step. Some 92 councils,of all political parties, have signed up to our Sustainable Communities Act, the largest number ever,to urge government to bring an end to casino-style gambling on the high street, and prevent betting shops from clustering and destroying our shopping districts, especially in deprived areas.” Notwithstanding Newham’s own

poor track record of making a quick buck out of its residents through its landlord’s licence and hyper aggressive council tax battles in court,it has managed to drive a highly successful PR campaign against FOBTs pushing the numbers game to their very limits with claims that one machine alone could see £18,000 gambled in an hour,and with up to four machines in a store, £72,000 could be spent during peak hours. The latest wave in the public debate, which has been serviced by poor riposte from the bookies themselves, continues to play heavy on the emotive argument, with chairman of the Newham chamber of commerce Lloyd Johnson adding:

“Betting shops are strangling our high streets. It is not a pleasant sight for shoppers to be greeted by rows of bookies instead of independent and high street retailers in our town centres.” The fact that no other businesses have come forward to take these high street premises is somewhat overlooked,as is a discernable lack of willingness of general businesses to operate in an area where it is seemingly difficult to trust a council which sees fit to undermine the planning laws because it doesn’t like them. Whether that argument resonates remains to be seen,the battle,though, will continue with a fairly definitive timetable. The Sustainable CommunitiesAct established a process where councils can urge central government to assist in “promoting the sustainability of local communities”.The government must now reach a decision on Newham Council’s submission within a year.

Nick Arron, of gaming law experts Poppleston Allen, stated: “The First-tier Tribunal has handed down its judgment in respect of Greene King’s appeal against the Gambling Commission’s refusal to grant it bingo operating licences.The Judge, NJ Warren, allowed the appeal and remitted the applications back to the Gambling Commission with a direction that the applications be allowed. “Greene King had applied for operating licences to allow it to provide commercial bingo and gaming machines within its pubs. Gambling revenues grew by 6 per cent last year, a sure sign that the UK was on the up from the economic doldrums. Remote betting took the winners medal for the biggest growth, which is somewhat ironic given all the media attention focused on landbased bookies and that one much maligned machine.

he Gambling Commission has published industry statistics for the five-year period 1 April 2009 to 31 March 2014.The figures provided for April 2013 to March 2014 are provisional at this stage. The Gambling Commission has also published an Excel version of the statistics to provide more transparency and an element of interactivity with the figures. Findings include: • The British gambling industry, as regulated by the Commission, generated a gross gambling yield (GGY) of over £6.8bn betweenApril 2013 and March 2014, a rise of almost £0.4bn (6 per cent) compared to the periodApril 2012 to March 2013. • The non-remote betting sector represents the largest market with a 47 per cent share of GGY. • Growth is biggest for remote betting, bingo and casino (22 per cent) and

casinos (15 per cent) compared to last year. • Other sectors showing growth are arcades, betting, and large society lotteries. Only the bingo sector experienced a decrease in GGY between the two most recent reporting periods. • GGY for B2 machines in betting shops was over £1.56bn, an increase of just under £17.6m (1 per cent) on the figure for the previous reporting period, set against a 4 per cent

increase in the number of B2 machines. • 102,715 people were employed across the industry, a drop of 5,357 from the previous reporting period. This is the first edition of Industry Statistics to include sales figures for the National Lottery, for which sales were £6.7bn during the period April 2013 to March 2014. Commission licence needed by software suppliers REGULATIONS

only source gambling software from Commission licensed software businesses. Software providers are being advised to apply for the relevant licence at the earliest opportunity to avoid potential disruption to business. A Commission spokesperson said:

“Licence applications normally take six weeks to process but can take longer if the application is incomplete or the Commission needs to investigate further. We are therefore advising software providers who need a licence to make their applications as soon as possible

and preferably before 31 December 2014.” Further information on who needs a gambling software licence can be found on the Commission website. Gambling software is defined in the Gambling Act 2005 as computer software that is used in con-

nection with remote gambling but does not include anything for use solely in connection with a gaming machine. An operator requires a gambling software licence if it manufactures, supplies, installs or adapts gambling software that is used in connection with remote gambling.

He told Coinslot:“The general consensus from most operators is that 2014 has been a great year. The weather across most of the UK was dry and good which prompted a lot of day trippers. The economy is still showing signs of improvement and there seems to be a far better mood amongst consumers than the year before.”

will vote with their feet. Arcades face stiff competition for consumers’ time and money and if the offer is attractive enough then the rewards will flow through.” Setter revealed his highlight of 2014 was being awarded the Universal Studios ‘Best Product’ category for his firm’s Minion collection. “There are thousands of different licensees worldwide involved in Minions. To be presented with this award was a fantastic recognition to all the staff both in the UK and China who were involved in the development process and ensured

that this licence was such a resounding success.” Setter admitted that 2014 will be a difficult year to beat but he does believe there are still gains to be made and that his firm’s collection for 2015 really does look impressive.He added:“If the weather is kind to us I believe 2015 will be another great year for the industry.” He concluded: “I think that the buzz around

It is important that BACTA pulls together the data for those sectors of our industry that are struggling so that we can prove that we require assistance through stakes and prizes and technical standards to give those areas a boost. This should be a constantly evolving process for our sector in order to maintain the interest of the players, while still adhering to the tenets of the 2005 Gambling Act. The increase in prizes in January was the most important single event this year.As an industry we are dependent on refreshing not only the game content but also the nuances in how we deliver it to the

players.This is something we have also learned with the latest technical standards, which have really pushed things forward. The new jackpot separated the new games from those that came before - it also threw the balls up into the air and stirred up competition between games design houses. We can expect to see a little more consolidation of the key players when it comes to providing product in volume to the Cat C retail business. We have gone through a period of fragmentation and seen some new entrants - which is great - the industry welcomes the competition. However, this is likely to develop into a situation where we see a degree of polarisation between the stronger and the weaker players and some will struggle to sustain their position. We will continue to see reelbased products dominate in volume in 2015 but it is going to be interesting to see how digital performs and how it is delivered commercially.It is the commercial model rather than the games themselves that will see digital really stick.”

Operator close to reaching terms for Barry Island Pleasure Park AMUSEMENT PARK

A deal that would see amusements and rides return to Barry Island Pleasure Park in time for the 2015 season could soon be agreed. ne of the country’s leading fairground operators is reported to be close to an agreement to take on the running of Barry Island Pleasure Park. The family-run operator, who did not wish to be identified, is thought to be in talks with the Vale of Glamorgan Council over the site, which is currently derelict. If its plans are approved, it could see the return of amusements and major

rides to the iconic South Wales attraction. A representative of the operator, who is planning to visit the resort later this month, told local press: “I cannot go into details at the moment but this could be the one of the biggest and best developments Barry Island has seen. “The Barry Island Pleasure Park is well known and it is sad to see the state it is currently in. We want to bring it back to life.” The firm is renowned for

operating traditional fairground rides - many of which have featured in films, music videos and on television - which it would bring to Barry Island. Plans are already in place to demolish the existing log flume ride, the last major ride on the amusement park, which closed in September. It stands on a prime site in the park and would be replaced by an attraction of similar style and importance under the new pro-

posals. It is hoped that the deal can be agreed in time to allow the new operator and rides to move onto the site in time for the 2015 season, avoiding any loss of reputation for the attraction and for Barry Island itself. Local councillor Richard Bertin, who is hoping to use the amusement park as a venue for a music festival next summer, commented: “I really hope that something can be delivered on

BALPPA to keep campaigning for tourism VAT cut TOURISM

ALPPA has vowed to keep up its efforts as part of the group campaigning for a B reduction in VAT on attractions, accommodation and restaurants. As one of the leaders of the Cut Tourism VAT group, it had hoped to see George Osborne cut the rate to five per cent in his Autumn Statement last week. When nothing appeared forthcoming from the chancellor, Janice Dunphy, chair of BALPPA’s family entertainment centre subgroup, aired her disappointment in an interview on BBC Radio 5Live. When asked for reaction to no cut being offered, she commented: “It is something that we have been campaigning for and we will continue to. “We are asking for a cut to five per cent, and we have evidence that will increase

the Pleasure Park site as soon as possible.We need a good operator to come in and deliver on the decaying site. “I am sure everyone would agree that progress has been slow at this site and people are becoming more and more frustrated at the way the site has been left in its current condition. “I therefore now call on the developers, a leisure operator, the Vale council and the Welsh government

to work together and deliver this jewel in the crown for our town.” The operator’s plans are separate to those already submitted to the council by the Barry Island Property Company to turn the Dolphin pub, at the beachfacing entrance to the Pleasure Park, into a flats and retail development. That scheme has caused concern amongst council planners that want to see a unified approach to the regeneration of whole site.

In parts of Somerset, almost one in five jobs depends on the industry. “Cutting VAT on tourism would be a bold move and could create a further 5,000 jobs, boost our economy to the tune of £150m and encourage employers to invest in our towns and villages, making them even more attractive to visitors.

He said the strong performance - from what is Britain’s fifth largest export industry - throughout the recent recession will see the sector gain recognition. Recent figures produced by the Office for National Statistics show that total employment across the UK increased by 820,000 over 2013 - of which 120,000 jobs (15 per cent) were attributable to the UK tourism industry.With 39 per cent of these new tourism jobs going to people under the age of 30,the growth of the UK tourism industry is also one of the leading factors in the 20 per cent reduction in youth unemployment that is highlighted by the statistics. Political parties already seem to be alive to the importance of the sector to the nation’s prospects, with shadow culture secretary Harriet Harman recently stating that tourism would play a ‘key role’ in Labour’s plans for growth and jobs if it

returns to power. This followed a seminar featuring highprofile panellists at the recent Conservative Party Conference, which explored ways to unleash the growth potential of the industry. Janson told leisure industry press: “Tourism looks likely to feature in next year’s election due to increased recognition by all parties that the industry has been at the forefront of the UK’s economic recovery, having generated almost a third of all additional new jobs in the UK over the past three years. “This is especially important because the key areas in which these jobs have been created - seaside and rural destinations - are the location of the marginal constituencies that will decide the election outcome. So look out for policies that will support rural businesses (e.g. rural broadband) and the regeneration of seaside towns when manifestos are published.”

East Kent tourism trade boosts the area’s regeneration REGENERATION

he tourism and hospitality sector continues Tto play a key role in the regeneration of East Kent, according to the Kent Property Market Report 2014. The report, launched this month, is compiled by Kent County Council, Locate in Kent and Caxtons Chartered Surveyors and reviews activity in the county’s property and economic development and regeneration sectors. It states that Thanet attracts more than 3m visitors a year, bringing £230m into the local economy. Visitors to the world’s first heritage amusement

park on the Dreamland site in Margate, which is due to open next year, and the East Kent area’s other many and varied amusement outlets in Broadstairs, Ramsgate and Herne Bay will have a big choice of nearby accommodation in 2015. Many other developments have also started in earnest, including the opening in April of the

Botany Bay Hotel, creating 15 new jobs; a new 14bedroom boutique hotel, The Crescent Victoria, Margate; the new 14-bedroom Albion House Hotel, Ramsgate; an additional seven rooms at the Royal Harbour Hotel, Ramsgate and plans for a 30-bedroom hotel and hospitality training centre at East Kent College’s Yarrow Building in Broadstairs.

From the viewpoint of 93 local councils it’s the fact that FOBTs are causing the UK public to lose large sums of money in seconds and in some cases ruining people’s lives, while from a BACTA perspective, it’s the disparity in what is permitted in equally well-regulated and lawabiding premises that’s causing the kerfuffle. As the Gambling Commission’s Matthew Hill stated at last month’s BACTA Convention, however:“Be careful what you wish for.” While the coin-op sector has had to suffer some extraordinarily tough times in recent years, with appalling levels of job losses and shrinkage, the high street LBO sector has, by and large, thrived with its FOBT allowance.The more times the phrase ‘The crack cocaine of gambling’is bandied about, the more the public at large will start to actively avoid - or be suspicious of - all types of machine-based play. I have no independently-compiled research to back up my next assertion, but it is my guess that the average man on the street who doesn’t play machines at all - wouldn’t have a clue about how to differentiate between FOBTs and other types of coinop gambling. The above, of course, is all being played out to a backdrop of BACTA admitting that they need to convert non-players into players tout suite.These are testing times for all concerned, but I’m inclined to agree with some of the RGT’s independent findings which state that:

“Machine gambling behaviour is clearly dynamic and changes over time, with people starting, stopping and switching machine gambling.” In other words, the presence of FOBTs in bookmakers just might not be the reason why coin-op has suffered so much in recent times and, let’s be honest, the past 12 months have seen many companies involved in the various links of our industry’s chain report something of an upsurge.In the same way that any profits and success can’t be credited solely to the weather, any downturns aren’t necessarily down to the FOBT disparity. The other challenge that the industry must face very soon is the onset of the new £1 coin. BACTA will be writing to the Chancellor to see how the industry can be somehow compensated for a move that could potentially cost coin-op ‘tens of millions’ and push for an appropriate reduction in MGD to help soften the blow. It’s just as tough to predict the sector’s future as it is to make a living out of it, but to finish on an upbeat note BACTA’s most recent shake-up at the top has already re-positioned the trade body as a business which faces, broadly, the same issues as any other - and that requires its fair share of government empathy and support. If the buzz words of ‘ethical, sustainable, modern, professional, partnering, open and transparent’ are put into practise quickly, they can help coin-op move forwards with confidence.

The Powers of Entry draft code stipulates that authorities should give at least 48 hours’ notice before visiting a licensed venue, and clearly state the reason for their visit. A Home Office Spokeswoman revealed that the code, which was drawn up in January 2013 and subject to consultation, will be introduced in Parliament ‘shortly’. It is hoped the code will minimise disruption to licensees, who have complained of groups of police officers and other authorities turning up unannounced at busy times for routine inspections. The proposed code is separate from the Home Office review of powers of entry last week, which concluded that the powers set out under the Licensing Act should remain as they are. Meanwhile, many organisations are struggling to overcome cultural, technical and data-

related barriers to a truly joinedup customer experience and single customer view, according to Econsultancy. The gambling sector is no different in this respect, according to new research by Econsultancy and IGT. The Multichannel Convergence in the Gambling Sector Best Practice Guide examines how companies can significantly improve their business performance by taking a cross-channel approach to the customer experience and marketing activities. It includes findings from an industry survey and in-depth interviews with senior executives. Some key findings from the report are as follows: Multichannel customers spend more. Across different industries it’s true that customers that engage with brands across numerous touch points tend to be more valuable. This should be no big surprise, as it makes sense that if a person is a fan of a certain brand then they will be more likely to engage regardless of the chan-

nel or device. The gambling sector is no different. Companies surveyed as part of the report are seeing a much improved revenue uplift per player when customers engage with them across multiple channels (an average of 38 per cent uplift). So the real challenge for gambling brands is to ensure they are delivering a consistent customer experience across all channels. A majority of respondents (88 per cent) said it was crucial to offer a consistent brand experience, while 67 per cent strongly agree that convergence is creating significant opportunities for their businesses. Though the gambling industry is aware of the critical importance of convergence there are still major challenges to overcome. In its survey the most commonly cited barriers to having a truly multichannel approach are: incompatible technologies (58 per cent), too much focus on short term goals (58 per cent) and difficulty joining up different data sets (50 per cent).

The complexity of the supplier ecosystem in the gambling sector is not conducive to a joined-up customer experience, nor is the issue of differing legislation across geographical boundaries. It’s clear from the research that there are a number of key elements to be considered in the path to success. These range from convergence in games, to the critical area of account convergence and the potential of using account information and other data to inform marketing and content activity, increase revenues and drive competitive advantage. And finally, the RGT has been criticised over its machinerelated problem gambling study,

according to iGaming Business. Research by the RGT into machine-related problem gambling has attracted criticism over claims from a number of parties that the reports favour the industry and ignore wider issues in the UK market. The RGT said the research was undertaken to build the knowledge base available to identify harmful machine play and to better understand what measures might help limit harmful play without impacting those that do not exhibit harmful behaviour. The independent findings will be passed on to the DCMS and the Gambling Commission to inform policy decisions they may decide to make in regards to these machines. RGT chief executive Marc Etches said: “Our understanding of these (gaming) machines (in LBOs) and the way people use them is now greatly enhanced. We hope that everyone will consider carefully how the findings of this ground-breaking research can be used to help all gamblers

to make better informed decisions and, in particular, to protect those that are vulnerable to gambling-related harm.” However, the report has attracted criticism from some parties that have highlighted the risks such machines pose to problem gamblers. “This (RGT) report serves only to block any move that would hit the bookies where it hurts, on their bottom line. It does little to help problem gamblers, the communities they belong to or the nation’s high streets,” according to Sir Robin Wales, Mayor of Newham (pictured). Newham Council is currently leading a group of 92 other local councils in England that have petitioned the UK government to cut the maximum stakes on FOBTs from £100 to £2.

The necessity to understand more about how the industry can minimise harm caused by gambling activity is well understood by most, if not all industry stakeholders and this research represents a marked progression along that journey.Similarly, the more we understand about problem gamblers and their behaviours the more effective we can be at prevention. But as readers of the documents will appreciate, answers to the questions posed for the research are not as straightforward as some had perhaps hoped, and the results of the research therefore need to be considered very carefully. What is also important is that the gambling entertainment experience enjoyed by the majority, whether in betting shops or other venues and platforms, should not be unnecessarily impaired by the imposition of unqualified harm minimisation measures that whilst best intended,may carry with them unforeseen side effects.This further highlights the need for more of this type of research to inform quality decision-making. The future of the gambling industry in the UK is to a large extent dependent upon the government using evidence provided by this type of research to inform gambling policy and future changes, and on

that basis the Gambling Business Group supports the work of The Responsible Gambling Trust and the Responsible Gambling Strategy Board in their methodical approach to change. Contextually, it is also important to recognise that this research relates to a particular type of machine in a specific environment. It should not be automatically assumed that the information gleaned in this research will be relative to all machines in all venues. To acquire a similar level of intelligence about other machines or products in different gambling environments will require a similar undertaking with a focus on those products and their players. There is more work to be done in the evaluation of the results from this research and also in identifying the next steps for our members in order to leverage the maximum value that this and any further research presents. Key objectives set out by the Gambling Business Group when it was established and formally launched in the summer was to provide a strategic voice for gaming, to engage with government thinking, to help shape the political agenda and in the process to protect the long-term future of the companies active in the industry and the livelihoods of the people employed.To help fulfil these objectives we look forward to taking an active role in the next stages of this important research. Undoubtedly, there is more work to be done in the evaluation of the results from this research and also in identifying the next steps for our members in order to leverage the maximum value that this and any further.
