Greene King’s successful bingo licence appeal is to be challenged by the Gambling Commission. So where does this leave the opportunities for business development, particularly through the amalgamation of gambling sectors? he Gambling Commission is to launch an appeal to the Upper Tribunal Court, having been forced to approve pubco Greene King’s licence to operate bingo on its premises. Despite initially rejecting the application,the Commission’s hand was forced by Greene King’s own successful appeal in the First-Tier Tribunal, at which the brewery argued that the regulator had overstepped its responsibilities in refusing the initial request. Judge NJ Warren overturned the Commission’s decision on the grounds that it did not have the authority to dictate whether or not Greene King should be awarded a licence,stating that it should simply provide guidance to the relevant local authority,as had been dictated by Parliament. In the view of the Gambling Commission, this is a position that places the body in a regulatory strait-jacket, effectively hamstringing their express purpose. “We are seeking permission to appeal the decision of the First-Tier Tribunal requiring the Gambling Commission to allow (license) a pub chain to introduce commercial gambling with potentially large numbers of gaming machines into pubs,”said a spokesperson.“This ruling appears to handicap the Commission in doing what it was set up to do - that is, react to new developments and protect the vulnerable.” The Commission has also raised concerns regarding the potential for blurring lines between a pub and a dedicated gambling venue.“We are clear, and this view is strongly sup-

ported by the government,that commercial betting, gaming and bingo and any associated high stakes and prize machines should be provided only in separate premises licensed for that specific purpose,”added the spokesperson,“premises that adults make a deliberate choice to visit in order to gamble.” The court ruling also entitles pubs to feature machines that are currently limited to bingo and AGC premises.The potential for £2/£500 B3 machines entering UK pubs, is a development that the Commission is extremely keen to prevent. “A judgment from the Upper Tribunal should hopefully clarify what we can and can’t do by way of operating licence conditions,”continued the spokesperson.“Meanwhile, we

are working closely with the Department for Culture, Media and Sport to see how we can both use our various powers to keep commercial gambling in dedicated licensed premises and stop it spreading to pubs.” The industry, on the other hand, wears the lines of concern across its face. In the view of BACTA chief executive, John White, this episode will eventually result in a law change that returns things to the status quo. “My own very personal view is that rather like the Luxury Leisure case,” said White,“if a ruling goes against the Gambling Commission, in all likelihood the law will ultimately get changed to accord with the view the Commission has.”

eading UK gambling operator Rank Group have announced the appointment of Martin Pugh, formerly managing director of Camelot UK, to the role of managing director of its Mecca Bingo brand. Alongside his work at Camelot, Pugh’s credentials within the UK leisure industry also include senior management positions within both Virgin

The announcement comes at a time of management restructure throughout Rank Group: former Mecca MD Mark Jones is rumoured to be filling the position of the company’s Grovesnor Casino Division, in wake of the departure of its own managing director Phillip Urban to pub retailer Mitchells and Butlers. Rank’s chief executive Henry Birch highlighted the suitability of Pugh’s career history: “With Martin’s wealth of experience not only in gambling, but also marketing and leisure, I am confident that he will help us to bring gaming-based entertainment to an even wider audience,” he remarked. Pugh is set to officially take the helm of Mecca’s 93 retail clubs as of January 5, 2015.

Bingo operator Gala Retail is to remain part of the larger Gala Coral whole for now, but may itself be up for sale in the near future.

“We remain pleased with the turnaround in the performance of Gala Retail and have recently embarked on a process to explore a potential sale of the division,” said chief executive Carl Leaver when announcing the bingo club sales in August. Indications are that the company remains on the lookout for a likely buyer.

Buoyed by continued profit growth and with a tentative foothold into the Irish market, UK marketleader JD Wetherspoons has set its sights on a programme of growth which will see the opening of twohundred new pubs.

eading UK pub operator JD Wetherspoon has announced that it plans to invest over £400m to open 200 pubs over the next five years, many of which will be located in the Republic of Ireland. The move is expected to create 15,000 jobs throughout both countries. The expansion plans come at the end of a bountiful sales year for the pub company. Whilst fourthquarter financial results for the pub company’s gaming machines division showed a like-for-like decrease of 3.1 per cent, total sales revenue for the company increased 10 per cent to £1.4bn. Wetherspoons currently operates over 900 pubs throughout the UK. 2014 saw the company take its first steps within the Irish market,opening its first pub in the country in Blackrock earlier in the year, and a

second in Dublin in December. The Irish pub sector is notable for its diverse ownership structure that sees brewers wield significantly more power than their UK counterparts. The company has stated that it will aim to open a further 30 pubs throughout Ireland before 2020. “We are looking forward to opening the new pubs, many of which will be in areas where Wetherspoon is not yet represented,” stated JD Wetherspoons’

chairman Tim Martin.“We have already acquired a number of sites and will continue to search for new sites throughout 2015 and beyond.” Fair fortune for the new pubs will see the company almost double its tax contribution. “Wetherspoons paid more than £600 million in taxes in our last financial year,” added Martin. “This will rise to approximately £1 billion in the course of the next five years.”

East Lindsey District Council’s licensing committee ruled the business should enforce the “Think 21” rule and undergo independent testing once a month for 12 months of business. Tony Kelly,a Sun City representative, told the East Lindsey Target: “It’s very embarrassing to be here,

this is the first time we have been to a licensing review. “We don’t want this to happen again. We are having test purchasing, we are trying our best to comply with the law. “We rely massively on our reputation, we will do everything that we can to correct this.” Licensing and environment officer Neil Brooks told the committee he instructed the underage individual to make contact

with staff and stay for at least seven minutes. On both occasions that Sun City was tested during the summer, the underage individual was not challenged on entry to an adults-only section and was allowed to stay. Kelly told the committee that no employee had taken responsibility for the first offence and that during the second the employee responsible had not been confident in

making a challenge. He also suggested that the adults-only section of the premises could be moved to make its entrance more visible to staff.The committee said it would support such an application. In response to the offences, Kelly said Sun City’s management had now adjusted its recruitment procedure to ensure all employees understood best practice regarding underage gambling and the consequences of failing to carry out their responsibilities. Brooks said:“I have never asked them to be in front of a committee before and they are some very good operators.”

It’s in these crucial weeks that Britain’s arcades, piers and amusement venues deliver an easy, cheap and fun leisure option to families of all incomes up and down the country.And it’s in this crucial time slot that the fortunes of the amusements industry can often depend. Could this all be about to change? If plans unveiled by former Secretary of State for Education Michael Gove in 2013 are put into action, these summer breaks could be slashed, with the missing weeks redistributed throughout the year.

The move of Oswestry fair is a boon for long-time showman Allan Stokes, but he remains in need of a place to live as he reflects on the changing nature of his trade.

howman Allan Stokes has expressed his satisfaction with the new location Shropshire Council has found for Oswestry’s historic March funfair. However, he is still awaiting the outcome of the council’s search for a new site for the caravans he lives in, and hopes to remain close to the town itself. The move was made necessary after the funfair’s previous site, near cattle market on Shrewsbury Road, was sold to become part of a new leisure and retail complex. Stokes said that Oswestry’s 100year-old funfair could now become even more successful, owing to the new site’s more central location at the town’s Oswald Road coach and car park. He told Coinslot:“It’s much closer to the town itself then the cattle market is,and we’ve always said that the closer you can get to a town centre, the better the atmosphere

for the funfair. “Because we have done business with Shropshire Council for many years, it has pulled all the stops out to find us somewhere to go. “The March funfair was held in the centre of town for 88 years before it was moved to make way for Sainsburys around 20 years ago,and it was always a very successful event.” Stokes said his involvement with the funfair goes back 60 years, but it was founded by his grandfather and has since passed on to his sons. He was still frustrated by the lack of progress made in finding a new location for his caravans,which have stood for on the cattle market site for the past 15 years. He commented: “It’s one thing having nowhere to take the funfair, but it’s a bigger problem having nowhere to live. “The council has been trying to find us somewhere for the last 15

years,and really they haven’t got very far at all.But now because of the new retail park and coverage in the local media it has started to pull its finger out and find me somewhere to go. “Hopefully in the New Year I will hear more about it, and hopefully it will still be in this area,as I have three grandchildren at local schools,so we don’t want to have to move very far.” Stokes also told Coinslot that the way funfairs are operated have altered a great deal over the last decade. Gone are the days when a funfair will set up in a town for two or three weeks with the showmen’s caravans in tow. He explained: “It’s all one day events all over the country now,and it’s too costly to move all the caravans to an event just for one day. “Parents used to give their children money to come down to a funfair every weekend, but with the recession we’ve had over the last

ten years they don’t have that kind of money any more. “If we take a fair into a town for a couple of weeks and charge just 50p the children don’t seem to come,but if we come for just a day and charge £2 we are busy.” At 70-years-old, Stokes’ appetite to stay in the industry remains as hungry as ever, fuelled by the demand he perceives people still have for the type of entertainment his family provides. He said:“If a time came when we opened the funfair and nobody came, then you could say it has had its day,but it isn’t like that at all - lots of people continue to enjoy our events throughout the year. “I do about 20 different events in this area without travelling out of Shropshire, and the locals are always excited to see me and the children are always glad to come to the fair, so I feel like I want to keep going for a few years yet.”

WORTHING LEAPER RECOVERING IN HOSPITAL An adult male in his 40s who jumped from Worthing Pier was pulled from icy waters off the south coast by the Shoreham coastguard. The Shoreham RLNI’s inshore lifeboat was scrambled to rescue the man, following calls from concerned witnesses. What will now be known as Wolstanton High Street Club can already boast as many female members as male and at a gathering of the venue’s 600 members, a vote was also passed last year to leave the Working Men’s Club and Institute Union. “I spoke to two or three members on the club committee and we thought we’d take that step forward to change the name,” said Skelton.“Someone suggested the Wolstanton High Street Club name because that’s where we’re located.” It is hoped that,after a lean year, the name change will help attract new members.“We’re trying to improve on what we already

This might explain why B2B exhibitors spend a median of 39.2 per cent of their marketing budgets on show attendance (the largest of any other marketing channel).

In a recent survey, 99 per cent of exhibitors agreed that trade shows offered unique marketing opportunities. 60 per cent attributed this to the ability to meet multiple current and prospective clients at the same time, whilst 51 per cent claimed shows provided unprecedented face-toface contact with customers and prospects alike.

The vast proportion of exhibitors (84 per cent) claim that the most important factor underlying their decision on whether or not to exhibit lies in the quality of the show’s attendees. Reversing the roles, the overwhelming majority of attendees (92 per cent) claim that their main objective is to see new products.

As of 2010, the sector supported nearly 150,000 jobs and attracted more than 13m visitors. Over a third of all UK expo exhibitors expect to generate between £10,000 to £50,000 in additional sales.

First, though, we need to consider the down-side. Combining exhibition prices with the logistics required in transporting high volumes of advanced, heavy or delicate products, stand design and assemblage, not to mention accommodation costs for personnel and trade-show exhibition adds up to a significant commitment, particularly for smaller businesses. In an age where social media provides an unprecedented global marketing platform free-of-charge, some might be tempted to ask of the large-scale trade expo: is it still all worth it? Well, businesses seem to think so. A recent study by the Center for Exhibition

Industry Research (CEIR) drew upon four key metrics to analyse the sector’s overall performance since the turn of the millennium: net floor-space sold, visitor attendance, exhibitor number and gross revenue.Across all sectors, the collected trade-show industry grew 1.09 per cent: but behind this figure lies a more complex and optimistic outlook.“Even though 2013 only showed incremental growth, there was positive movement across a majority of the sectors and there was growth in all metrics,” said Dr Allen Shaw, chief economist for Global Economic ConsultingAssociates. “Each metric measured saw positive growth in 2013, and the number of attendees finally exceeded the previous peak in 2007.” What’s more, amusement trade-shows continued to outperform the industry standard: growing nearly 3 per cent in 2013 across combined analysed metrics. So much for the figures. One need only spend five minutes chatting to exhibitors at October’s Autumn Coin-op Show to find

If they turn the lock back within a few minutes then nobody is any the wiser until collection, when we have found there is no money in the machine and grip marks on the locks.” VG Leisure has supplied some pictures of the gang, which he has also passed on to West Midlands police. A group calling itself Lizard Squad has claimed responsibility for the Christmas attacks. BACTA steps up its activity It’s been a busy close to the year for BACTA where the many and varied campaigns are getting underway.

john white politics by David Gershlick andAndy Deacon,we Ahadccompanied a very useful meeting with the Gambling Commission before Christmas where we were able to demonstrate how compensators worked in cranes when they were operated as games of chance as opposed to prize every time. The Gambling Commission has been trying to ascertain via questionnaires, which I know a number of members have received, the answers to questions about compensation. These conversations are ongoing but physically seeing the compensation unit really helped their understanding. As you will know the issue arose principally because of concerns about cranes in shopping centres not being properly permitted and operated. The GC issued advice to Local Authorities on the matter about which we advised members a few weeks ago. We also spoke about LAs requiring a new licence when pubs replace a Cat C machine with a Cat D. We think this is wrong and will be writing to Division 2 in the New Year with legal advice on how to go about making sure both are covered. We have also met with Graham Wason and his team from the Campaign for Reduced Tourism VAT to 5%. We support this campaign and we were able on Tuesday to work out how BACTA and its members can help make the case.I will soon be sending out material that Division 1 members in the main can use to lobby local MPs and other stakeholders. In the meantime I would encourage all members to go to their website and

sign up to support the campaign http://www.cuttourismvat.co.uk. BACTA took its place at the IGRG meeting which included the Commission to talk about self-exclusion. As you will know BACTA has created a compliance committee. This will be on the agenda for that meeting which is fixed now for 10th February. If anyone is interested in sitting on that committee then please let me know. Our Mancom held its last meeting of the year and I also had the opportunity to take our DCMS civil servants to see the types of machines you can find in pubs,arcades,and LBOs. Amongst other things, we discussed the recent Greene King case which effectively gave the green light to bingo in pubs - with associated machine entitlement. The judgment in the case was not on the desirability of bingo in pubs but rather more simply the process by which Greene King were denied a licence.Essentially the Gambling Commission was adjudged to have acted beyond its powers, powers that properly resided with the local authority. I would be interested in members' view of this case. Finally, can I say thank you to all members for their support during the past five months since I rejoined BACTA as CEO. It has been hectic and challenging but I feel we are getting traction on the strategic and policy initiatives we have developed. The Convention was a great success and I am very much looking forward to renewing our engagement with policy makers in the NewYear.
