ogic dictates the construction industry boom regionwide will eventually subside, if not slip and slide to a halt. After all, this is Florida: un-patented inventor of the boom-and-bust cycle. But a singular focus on one metric — revenue growth in 2018 — shows the sector remains an economic force. For starters, combined revenue for all companies in this special section, the Top 50 contractors in the region, totaled $5.6 billion in 2018. That’s up 15.4% from the 2017 total, $4.85 billion. (To make the list, companies must be based in the Business Observer’s coverage area, from Polk County south to Collier County. Companies must be in some type of contracting field: electrical, general construction, roofing and more. Data is self-submitted.) Of the 50 companies, 43 posted a sales gain, while five dropped and two stayed flat. Two companies, Naples-based Connor & Gaskins Unlimited and Fort Myers-based Advanced Roofing and Sheet Metal, doubled sales year over year, rising 115.7% and 110%, respectively. Another revenue-based sign of the market’s prowess: Seven companies with at least $12.5 million in sales didn’t make the Top 50. That’s an almost-there list with several established names, including Bradentonbased Key Glass, with $17.93 million; Fort Myers-based Lee Drywall, with $16.27 million; and Merit Electric, a Largo-based firm with $13.4 million in 2018 sales. The strong market is visible in multiple sectors, says Mary Dougherty, executive director of the Gulf Coast Builders Exchange, one of the largest advocacy groups for the industry in

the region. “I’m hearing good things from lots of members. They are doing well.” Yet, going back to the boom-bustboom cyclical nature of Florida, a yeah-but lingers. Dougherty, for example, reports one GCBX member told her his business has slowed so much, he probably can’t afford to renew his membership. That member says some subcontractors are struggling, too. The other lurking issue for construction, of course, is the labor shortage. The Top 50 in 2018, combined, have some 11,700 employees — about 1,000 more than 2017. But the labor shortage is a significant obstacle. For instance, 79% of Florida respondents to the Associated General Contractors of America 2019 Construction Outlook survey report having a “hard time” filling some or all salaried and hourly craft positions. Nearly the same, 78% of Florida respondents say it will continue to be hard or become harder to hire construction personnel in the next 12 months, states the survey. The lack of labor, in turn, has a far reaching impact: at least 25% of AGC survey respondents say projects are costing more and taking longer to complete. That, combined with the potential for local governments to overreact if there’s a downturn, leaves Dougherty a bit worried, despite the overall market strength. “I’m a little worried about what could be coming down the pike,” says Dougherty, adding she’s “cautiously optimistic,” that, if anything, a drop in business is a blip, not a trend. So do lots of contractors. — Mark Gordon

How to successfully navigate the 50% FEMA Rule process After the past couple of hurricanes municipalities are enforcing the 50% FEMA rule even more than in the past years. If cities and counties do not comply with the Community Rating System (CRS), they could lose their favorable rating and with that the entire community can lose flood insurance discounts. It is vital to understand that enforcing the 50% FEMA rule benefits all property owners within a community and the building departments and flood plain managers play an important role in this interaction. Contractors dealing with rehab, remodeling, or reconstruction of buildings in flood zones A and V, should know how to navigate the 50% FEMA rule process. The formula to determine if the project is a substantial improvement, is shown below:

Cost of Improvement Project Depreciated Value of the Structure

= > 50%

The outcome of the calculation should be below 50% to go ahead with the improvement project. If the cost of the project exceeds 50% of the building’s depreciated value, it is a substantial improvement, which must meet floodplain regulations. If the property owner cannot afford to bring the building up to flood standards the contractor can adjust the project to meet the 50% rule.

Added layers of difficulty are the different interpretations and adoptions of FEMA rules and guidelines by the different municipalities. Contractors working on an island with several different municipalities will face different rules in each city.

We see a variety of rules and here are some examples: • The 50% FEMA rule can be applied once in the lifetime of a property. • The 50% FEMA rule can be applied once a year, always based on a 50% FEMA Rule appraisal. • The 50% calculation starts over every 5 years. Several projects can be accomplished during the 5-year term, but they cannot surpass the accumulated value of 50%. • The 50% calculation starts over every 10 years, with the percentage used in year 1 falling out of the calculation in year 11, etc. These are just a few examples and the contractor should inquire about local rules to be informed, not only for the contractor’s sake but also to share the knowledge with potential future clients.

By: Patricia Staebler, SRA, RS State-Certified Appraiser

The correct steps in applying for a building permit in coastal areas are as follows: • Determine if the subject property is located in an A or V flood zone • If yes, hire an appraiser to prepare a 50% FEMA rule appraisal to evaluate the depreciated value of the property • Estimate the project cost • Apply the formula as shown before • Determine if the property meets the 50% FEMA rule • If yes, go ahead and apply for your permit together with the 50% FEMA Rule appraisal report • If no, adjust the project cost, or the property will have to be brought up to FEMA standards Our firm offers consulting and valuation work. Let us help and guide you through the process. We also offer seminars for builder’s associations and municipalities who want to be better informed about FEMA rules and guidelines, the CRS, and the correct valuation approach for a 50% FEMA Rule Appraisal.

FEMA has many publications which can help understand the process: • Substantial Improvement/Substantial Damage Desk Reference FEMA P-758 • Coastal Construction Manual FEMA P-55 • Home Builder’s Guide to Coastal Construction FEMA P-499
