La sfumatura o sfumature nelle piastrelle variano da pezzo a pezzo e da produzione a produzione. Quando possibile è consigliabile controllare che pezzi provenienti da una singola produzione abbiano variazioni di sfumatura accettabili. Qualsiasi domanda o dubbio sulla scelta delle mattonelle dovrebbe essere chiarita prima della posa.

The anti-slip factors illustrated refer to the results of a previous anti-slip pased on standards prescribed by the German rule DIN 51130. The slip values are expressed by an R followed by a number from 9 to 13, where 9 indicates the lowest anti-slip level and 13 the maximum one. General sales and property conditions

1. Gli ordini di materiale debbono essere formulati per iscritto e anche se raccolti da nostri agenti od intermediari, s’intendono accettati soltanto a seguito di conferma della nostra Direzione. 2. I prezzi indicati sui nostri listini non sono impegnativi; di conseguenza ci riserviamo il diritto di modifi carli prima dell’accettazione dell’ordine. Anche dopo la conferma d’ordine e fino al momento della consegna del materiale sarà nostra facoltà disporre variazioni del prezzo per sopravvenuti aumenti dei costi di materie prime, mano d’opera, combustibili, spese di produzione. I pallets, gli imballaggi effettuati a discrezione della venditrice sono fatturati al costo e non vengono accettati in restituzione. 3. Tutti i pagamenti devono essere fatti nei termini pattuiti presso la nostra Sede di Fiorano Modenese. In caso di ritardo il compratore inadempiente sarà tenuto a corrispondere gli interessi di mora della scadenza del termine contrattuale nella misura del tasso medio praticato dagli Istituti Bancari sulla piazza di Modena, salva in ogni caso la risarcibilità dei maggiori danni del mancato rispetto dei termini. Ci darà la facoltà di sospendere la consegna di tutti i materiali comunque ordinati senza necessità di comunicazione alcuna. 4. I termini di consegna hanno carattere indicativo; eventuali ritardi nelle consegne, interruzioni, sospensioni parziali o totali delle forniture non daranno diritto ad indennizzi o risarcimenti danni. 5. La consegna del materiale s’intende effettuata franco stabilimento. Ogni nostra responsabilità cessa con la consegna al vettore; il materiale viaggia a rischio e pericolo del destinatario per cui non si accettano contestazioni per eventuali rotture o manomissioni. Eventuali accordi con spedizionieri, ivi compreso il pagamento del prezzo del trasporto s’intendono sempre conclusi in nome e per conto dell’acquirente che fin d’ora ratifica ed accetta il nostro operato. 6. Il materiale s’intende venduto con patto di riservato dominio; per cui resterà di nostra proprietà fino ad avvenuto pagamento. 7. La garanzia per eventuali difetti o vizi è limitata al materiale di prima scelta, salva in ogni caso, una tolleranza del 5%. Per il materiale di scelta diversa non sarà dovuta garanzia alcuna tanto per la sua qualità che per idoneità all’uso. L’obbligo di garanzia ci impegna alla sola sostituzione del materiale con esclusione di qualsiasi responsabilità per danni diretti o indiretti dal compratore. 8. Eventuali reclami in merito alla qualità, tipo del materiale dovranno pervenirci entro otto giorni dalla consegna. Il compratore si impegna a tenere a disposizione le partite contestate così da consentire il controllo dei difetti denunciati. In ogni caso la posa in opera del materiale ci esonera da qualsiasi responsabilità, in quanto è fatto tassativo l’obbligo al compratore di controllare prima della utilizzazione che il prodotto sia di suo gradimento. 9. Nessuna perizia potrà essere promossa su tutti i ns. materiali se non perverrà direttamente e preventivamente alla ns. sede il decreto di nomina del perito ed in tempo utile per intervenire alle operazioni peritali. Nessuna domanda di difesa o di merito potrà essere promossa dal compratore se prima non saranno integralmente pagati tutti gli importi delle fatture per materiali ritirati. 10. Per nessuna ragione l’acquirente potrà restituire materiale senza espressa autorizzazione scritta. In caso di scioperi o serrate, mancato o ridotto approvvigionamento di materie prime, difficoltà di trasporti, guerre, insurrezioni, interruzioni di comunicazioni comunque provocate, cassa integrazione, guasti ai forni ed ogni altro avvenimento imprevedibile, ci riserviamo la facoltà di sospendere le spedizioni ed anche di annullare ordini senza che ciò possa dar diritto all’acquirente di richiedere indennizzi o risarcimenti di danni. 11. Per qualsiasi controversia o contestazione sarà esclusivamente competente il Foro di Modena.

Price of our Price list are not binding: we could make changes before accepting orders. Even after an order confirmation, until the delivery, it is within our authority to make price changes, due to higher costs of raw materials, labour, fuel or production costs. 3. All payments must be made within the agreed term directly to our Headquarters in Fiorano Modenese. Any costs due to delayed payments or extended terms are at the buyer’s expense. For failure to respect terms of payment we reserve the right to suspend all further consignments of goods on order without any communication. 4. Delivery dates are purely indicative; any eventual delay in delivery, interruption, total or partial suspen sion of supplies, are not reason for indemnity or compensation for damages. 5. Good are delivered ex-factory. Our responsability ends upon consignment of goods to driver, goods travel at the risk of the receiver and for this reason we do not accept claims for damaged or tampered goods. Eventual agreements with shipping agents, even if transports costs are included, are understood always to be concluded on behalf of the buyer and in his name thus ratifying and accepting our actions. 6. All goods remain our property until payment has been fully effected. 7. Guarantee against defects is limited to first choice goods and to quantities above the accepted allowance of 5% . For goods of inferior choice we are not obliged to guarantee either quality or suitability. The obligation of guarantee commits us to the sole replacement of goods with the exclusion of any responsability for damages – direct or indirect – suffered by the buyer. 8. Any eventual claim regarding quality, quantity or type of material must reach us within 8 days of delivery date. Buyers commit themselves to hold any claimed goods at our disposal, thus allowing us to control denounced defects. In all cases the laying of tiles exempts us from any responsability as it is compulsory that products are controlled by the buyer before being put into use. 9. No survey will be promoted on our materials if the decree of appointment of the expert does not came directly and beforehand to our offices giving enough time for us to be present during the expert’s control. No deference of merit application will be promoted by the purchaser unless all the invoice costs for materials already collected have been entirely paid. 10. For no reason may a buyer return goods without our written authorisation. In case of strikes, closure, reduction or lack of raw materials, transport-problems, war, revolt, interruption of communications – whatever the reason – kilns out of order or any another unforeseen event, we reserve the right to suspend deliveries and even cancel orders without the buyers having any right to claim damages. 11. The law-courts of Modena are exclusively responsible in handing any controversy or claim whatsoever.

Les prix indiqués sur nos tarifs, ne sont pas formels : en conséquence nous nous réservons le droit de les modifier avant l’acceptation de la commande. Même après la confirmation de la commande et jusqu’au moment de la livraison de la marchandise, nous serons dans la facuité de varier les prix dans le cas ou des augmentations des coûts de matières premières, main d’oeuvre, combustible, frais de production, soient survenus. Les pallets et les emballages effectués a discretion du vendeur, sont facturés au coût et ne sont pas acceptés de retour. 3. Tous les paiements doivent être effectués selon les délais fixés après de notre siége de Fiorano Modenese. En cas de retard l’acheteur sera obligé a verser les interéts de retard de l’échéance du terme contractuel dans la mesure du taux moyen pratiqué par les instituts bancaires sur la place de Modena sauf de toute maniere le remboursement des dégàts plus importants. La manque de respect des délais de paiements nous donnera la faculté de suspendre la livraison de tous les articles par vous commandés sans pour autant etre obligé de vous communiquer quoi que ce soit. 4. Pour la marchandise de choix different aucune garantie ne sera due soit pour sa qualité soit pour l’aptitude à son usage. L’obligation de garantie nous engage seulement la sostitution du materiel en excluant toute responsabilité pour dégats directs ou indirects subis par l’acheteur. 8. Les réclamations éventuelles concernant la qualité, quantité, type de marchandise doivent nous parvenir entre les huit jours de la date de livraison. L’acheteur s’engage à garder à disposition les parties contestées de maniére à consentir le contrôle des défauts dénoncés. De toute façon la pose de l’article nous exempte de toute responsabilité, car l’acheteur a le devoir de controler, avant l’utilisation, que le produit soit de sa convenance. 9. Aucune expertise ne pourra être operée sur tous nos produits si directement et à l’avance ne nous parviendra pas à notre siége le décret de désignation de l’expert et en temps utile pour intervenir aux opérations d’expertise. Aucune demande de défense ou de mérite ne pourra être formulée par l’acheteur si auparavant ne seront pas entiérement payées toutes les factures pour le materiel livré. 10. En aucun cas l’acheteur pourrà rendre la marchandise sans avoir reçu notre autorisation par écrit. En cas de gréves ou barrages, réduction ou manque d’appovvisionnement de matiéres premiéres, difficulté de transports, guerres, interruptions de communications de toute facon provoquées, caisse d’integration, arret des fours et tout autre événement imprévu nous nous réservons la faculté de suspendre les livraisons et meme d’annuler les commandes sans pour autant que ceci puisse donner le droit à l’acheteur de demander les indemnisations ou le remboursement de dégats. 11. Pour toute discussion ou contestation sera exclusivement compétent le tribunal de Modena.

Die in unsere Preisliste angegebenen Preise sind unverbindlich, infolgedessen behaelt sich der Verkaeufer das Recht vor dieselben, vor der Auftragsanahme zu aendern. Nach der Auftragsbestaetigung und bis zur Auslieferung der Ware steht es dem Verkaeufer den Preis, falls Rohstoffen – Herstellungs – oder Belegschaftskostenerhoehungen da zwischen gekommen sind, zu aendern. 3. Die Berechnung der Preise erfolgt in der angegebene Waehrung. Falls keine besondere Zahlungspflicht vereinbart ist, sind alle Rechnungen innerhalb von 30 Tagen rein netto ab Zugang der Ware faellig. Im Falle der Zahlung nach Faelligken schuldet der Kaeufer Zinsen in Hoehe von mindestens 3% ueber dem jeweilingen, in der Bundesrepublik geltenden Wechseldiskontsatz, und zwar fuer die Zeit vom Verfalltag bis zum Zahlungstag. Die Zurueckbehaltung von Zahlungen oder Waren wegen ungeklaerter Ansprueche des bestellers und die Aufrechnung gegenueber den Anspruechen des Verkaeufers sind ausgeschlossen. Ist der Kaeufer mit einer Zahlung im Verzug oder hat er seine Zahlungen eingestellt, so ist der Verkaeufer vorbehaltich seiner sonstigen Rechte befugt, Vorauszahlung oder Sicherheitsleistung zu verlangen. Auch kann er in diesem Fall jederzeit von allen, mit dem Kaeufer laufenden Vertraegen ganz oder teilweise zuruecktreten. 4. Bestaetigte Liefertermine werden nach Moglichkeit eingehalten, sind jedoch nicht verbindlich. Alle Umstaende, weiche die Herstellung oder Lieferung der verkauften Ware unmoeglich machen oder uebermessig erschweren, sowie alle Faelle hoeherer Gewalt insbesondere Fabrikationsstoerungen, Rohstoffmangel, Verkehrsstoerungen, Streiks, behoerdlichen Massnahmen und dergleichen auch soweit sie in der Person des Lieferanten des Verkaeufers eintreten entbinden fuer die Dauer der Behinderung oder deren Nachwirkung von der Lieferungspflicht. 5. Die Auslieferung der Ware versteht sich “ Frei ab Fiorano Modenese “ Der Verkaeufer lehnt jede Verantwortung ab, nachdem die Ware dem Frachtfuehrer uebergeben worden ist. Der Versand erfolgt stets auf Rechnung und Gefahr des Empfaengers. Transportversicherungskosten gehen zu Lasten des Kaeufers. Fuer Bruch und abhandgekommene Ware haftet der Verkaeufer nicht, er sorgt jedoch fuer Sachgemaesse Verpackung. Transportschaeden sind sofort beim Transportunternehmer zur Pruefung anzumelden. 6. Bis zur vollstaendingen Bezahlung des Kaufpreises fuer alle Warenlieferungen innerhalb der Geschaeftsverbindung, einschliesslich alle Nebenforderungen(bei Zahlung durch Scheck oder Wechsel bis zur Scheck – oder Wechseleinloesung) bleiben die Gelieferten Waren Eingentum des Verkaeufers. Der Kaeufer ist bis dahin nicht berechtigt, die Ware an Dritte zu verpfanden oder zur Sicherung zu uebereignen. Soweit der Kauefer die Ware verarbeitet oder umbildet, gilt der Verkaeufer I.S. des § 950 BGB und erwibt das Eigentum an den Zwischen- oder Enderzeugnissen. Der Kaeufer ist nur Verwahrer. Er ist berechtigt, die Ware oder das hieraus hergestellte Fabrikat im ordnungsmaessigen Geschaeftsgang zu veraeussern. Das Eigentumsrecht hat auch Gueltigkeit gegenueber dem Spediteur, dem die Ware auf Auftrag des Kaeufers oder auf veranlassung des Verkaeufers uebergeben werden. 7. Die Gewaehrleistung fuer Maengel beschraengt sich auf Ware in erste Sortierung ein Spielraum von 5% ist jedoch zulaessig. Fuer andere Sortierungen ist der Verkaeufer zu keiner Gewaehrleistung verpflichet, weder fuer die Qualitaet noch fuer die Verwendung der Ware. Die Gewaehrleistungspflicht verpflichtet den Verkaeufer nur zum Ersatz der Ware. Jede Verantwortung fuer direkte und indirekte Schaeden, welche der Kaeufer erleiden sollte, ist ausgeschlossen. 8. Alle Maengel, Schaeden und sonstige Beanstandungen koennen nur innerhalb 8 Tagen nach Zugang der Ware Schriftlich geruegt werden. Der Kaeufer verpflichtet sich die beanstandeten Ware zur Verfuegung des Verkaeufers zu halten damit dann eine Kontrolle ermoeglicht wird. Der Verkaeufer haftet nicht fuer Farbarweichungen sofern sie bei Materialien festgestellt werden, welche nicht aus der gleichen Lieferung stammen, ferner haftet der Verkaeufer nicht dafuer, das die gelieferte Ware fuer die vom Kaeufer in Aussicht genommene Zwecke geeignet ist, und es wird jeder Ersatz des Schadens abgelehnt, der im Zusammenhang mit der Verarbeitung der Ware entstehen sollte. 9. Für keinen unserer Artikel kann ein Gutachten angefordert werden, wenn der Ernennungsbescheid des Gutachters nicht direkt und nicht im voraus und rechtzeitig bei uns eintrifft. Um bei der gutachtlichen Tätigkeit zu intervenieren, ein Antrag auf Verteidigung oder Sachverhalt kann seitens des Kaeufers nicht erwirkt werden, wenn nicht vorher alle Rechnungsbeträge für übernommene Materialien ganz bezahlt sind. 10. Der Kaeufer darf auf keinen Fall die Ware ohne schriftliche Genehmigung des Verkaeufers zurueckschicken. 11. Gerichtsstandt fuer saemtliche Beanstandungen Modena. Die rechtliche Unwirksamkeit eines Teils der vorstehenden Bedingungen beruehrt nicht die Gueltigkeit ihres uebrigen inhalts.
