Debbie Gibson can continue operating her kennel at Paws Inn, after Circuit Judge Timothy K. Sanner granted Goochland County’s motion for a non-suit Tuesday, March 15. That was the original trial date for an injunction requested by the county to force Gibson to stop operating her business until she obtained a conditional use permit, said Goochland County Attorney Norman Sales last week. “It’s a zoning enforcement case,” said Sales. “All we wanted to do was to get her to apply for a conditional use permit.” Sales said the county filed its non-suit motion, in essence withdrawing its request for an injunction, because “We came upon some evidentiary problems that caught us by surprise.” Those problems may have been that Deputy Zoning Administrator Anita Barnes gave a deposition in February, according to the case file, in which she said she believed the defendant was lawfully operating kennel. This testimony was at odds with the county’s complaint. Gibson has operated Paws Inn at the same location on

Plaza Drive in Manakin-Sabot since 1996. She said she was steered to the location by former Goochland Planning Director Robert Hammond. Hammond said in a 2009 interview that he recommended the location with the understanding that Gibson would be operating a kennel, not an animal boarding place, which is what Judge Sanner ruled her business was in January 2009. In 2007, the county’s zoning ordinance was changed and kennels were no longer allowed in B-1, unless a conditional use permit is granted. The county maintains that Gibson must have a conditional use permit to operate.

An exchange of letters between the chairs of the board of supervisors and the school board last week left supervisors and county administration unsatisfied. But one supervisor was still ready to up the county contribution to the schools budget to last year’s level. Discussion of the letters came at the end of the supervisors’ Monday work session, in which they heard budget presentations from 10 departments along with a budget update by Goochland County Administrator Rebecca Dickson In his March 15 letter to Goochland School Board Chairman Ivan O. Mattox, Goochland Board of Supervisors Chairman

William E. Quarles Jr. requested supervisors be furnished with a list of the job title and salary for each position in Administrative, Attendance and Health Categories included in the FY2012 schools budget with an indication of whether the positions are mandated by the state or federal government. Quarles also asked for information on anticipated unexpended funds in FY2011 and verification that the schools were budgeting 100 percent of the state’s sales tax revenue due to schools and asked that schools provide the supervisors with quarterly spending projections on a quarterly basis. School Board Chairman Mattox’s letter in reply listed 18 positions in the three categories specified and stated that no significant unexpended funds for FY2011 were anticipated. “I do think it addresses the question,” said county administrator Rebecca Dickson of the job listing

provided by Mattox in his response letter. Dickson indicated less satisfaction in the schools response to the request for projections of FY2011 expenditures. “Projections are not convenient for anyone to do but I do think they are an important part of the monitoring,” said Dickson. Dickson said “We believe schools should budget 100 percent of sales tax rather than 95,” which would add $132,000 to the FY2012 budget. Dickson told supervisors that the county could expect some adjustments that would result in a net $200,000 increase in funds for the FY2012 county budget and that potential changes to the schools budget showed an increase in revenue of about $370,000. At this point District 1 supervisor Andrew Pryor said he was in favor of at least a flat budget for the schools. “The quicker we tell them

the better off we’re going to be simply because there’s no use letting some of these good teachers walk out,” said Pryor. “I’m all for telling them today that we’re going to give them a flat budget.” Pryor asked that the county administrator bring back suggestions on how that could be done but Dickson said she was reluctant to do so until getting better projections on current spending by the school board. The supervisors also discussed a proposal for Quarles and Mattox to meet but that idea was ultimately dropped as was Pryor’s request for flat funding for the schools budget. It was instead decided that the Mattox would be invited to the next board meeting to hear a discussion of how the two boards might better cooperate. The supervisors next meet on March 29 at 7 p.m. for the public hearing on the budget. Budget adoption is anticipated at the April 5 regular board of supervisors meeting.

Virginia Farm Bureau President Wayne F. Pryor kicked off Agriculture Literacy Week last week by reading to a group of third graders at Byrd Elementary School. Virginia’s Agriculture in the Classroom program celebrated Agriculture Literacy Week in conjunction with National Agriculture Week, which is March 13-19. Volunteers from the state’s agriculture community, including 70 county Farm Bureaus, read books about agriculture in 1,700 classrooms statewide. Pryor and other volunteers read the book Ready, Set, GROW! published last year by AITC, and donating copies to school libraries.

Ready, Set, GROW! is a rhyming tour of Virginia farms, led by the character Farmer Ben, who is modeled after 21st-century Virginia agricultural producers. The story takes readers to an apple orchard, a dairy farm, a horse farm, poultry houses, a peanut field and other locations that show the diversity of Virginia agriculture. “Agriculture Literacy Week is an opportunity for farmers to get out to schools and spread the word about agriculture,” Pryor said. “Many children are far removed from agriculture these days and this is a great opportunity for working farmers to educate children about farming.” The third graders at Byrd Elementary had plenty of questions. One student wanted to know what happens when you plant something and it doesn’t grow.

The unanimous decision was met with a hearty round of applause from the packed meeting room in the Administration Building. Bellview Gardens residents mounted a well-organized and focused opposition effort, including the use of several lawyers. Their concerns did not fall on deaf ears, as most commissioners voiced a lack of support for the project. Prior to the final vote, Commissioner Courtney Hyers voiced her strong opposition to the approval and said “Goochland County has an obligation to protect our neighborhoods. This is planning run amuck.” The regular meeting of the Planning Commission began with a request by Goodwill to defer the application consideration, but a number of citizens

Jordan Hedgepeth, also a Bellview Gardens resident, said his family moved there for the rural peace, quiet and safety of the neighborhood, having no idea that commercial development was a possibility. “It is a ridiculous idea,” he said. One resident, an engineer, said the asphalt on Mills Road would not support the heavy tractor-trailer traffic anticipated. Theobald said there would only be one truck delivery a day. Other neighbors cited safety, traffic and concern for the safety of their neighborhoods. Some feared illegal dumping could become a problem, while others suggested sexual predators could infiltrate the small neighborhood. Property values were also cited as a concern with the application. Most speakers voiced support for Goodwill’s mission and expressed no opposition to them locating in Goochland County, just in a more appropriate and compatible location. Lisa Pumphrey, a Bellview Gardens resident who has been

instrumental in the fight to stop the construction, said she understood the decision by Goodwill. “It’s a good business decision,” she said. “Why buy commercial real estate when you don’t have to?” she questioned, citing the difference in the cost of residential lots as opposed to commercial sties. “It’s an assault on the sanctity of residential neighborhoods,” she added. “Do not uproot our families.” Commissioner Lowe Lunsford said the issues between the neighbors and Goodwill could not be resolved. “What we have is someone trying to shoe horn a 17,000 sq. foot facility in there. I think their (the neighbors) concerns are justified,” he said. Commissioner Ty Querry said while voicing his opposition to this project that “this county cries out for commercial development,” and said he would consider future applications for the site. The board unanimously denied recommendation of the application, and the matter now moves on for Board of Supervisors consideration.

spoke against that action. Many stated their lives had been in a state of limbo since the filing and wanted the process to move forward. The commissioners agreed and voted not to defer, with Bob Rich representing the only dissenting vote. Commissioner Bill Neal questioned if a B-2 designation was appropriate for a retail business with 75 parking spaces. Goodwill attorney and representative James Theobald said the application was based solely on the recommendation of planning staff, and the zoning issue never arose. “No one thought there was a conflict?” Neal questioned. Theobald responded, “No”. As the public comment period progressed, one neighbor after another spoke against the application. John Wright expressed concern over Goodwill’s policy that allows convicted criminals to work in their stores. “That is of great concern,” he said. Theobald said the agency does hire people with criminal pasts in an effort to provide second chances for people.

As members of the Army’s field artillery team, the course is designed to train soldiers as specialists to operate the advanced field artillery tactical data systems for both cannon and multiple launch rocket systems. The specialists play a critical role in the safe, accurate, and lethal

delivery of the field artillery’s various fire support systems used to support infantry and tank units in combat. Skills training included methods of computing target locations using computers or manual calculations, ammunition handling techniques, and operating and performing maintenance on related equipment, vehicles, generators, and artillery tactical and data systems. Daniels is the son of Rebbeca J. Daniels of Chapel Hill Road, Goochland, Va. The private is a 1998 graduate of Goochland High School.

County gives up on Paws Inn Last week the Goochland Circuit Court Judge Timothy K. Sanner granted Goochland County’s request for a nonsuit allowing them to withdraw their request for an injunction against Paws Inn, a kennel operated by Debbie Gibson on Plaza Drive in Centerville. Although county attorney Norman Sales said that technically the county could come back to court and ask for another injunction to require Gibson to obtain a conditional use permit, one is left with the impression that such a move is unlikely. Gibson has been doing business there since 1996 when the area was much less developed than it is now. She evidently has a faithful clientele and serves a perceived need for such a service. She has given up boarding other animals, a fact that caused the court to rule that she was operating as an animal boarding place in 2009. Both kennels and animal boarding places are allowed in B-1 since the ordinance was revised in 2007 but only with a conditional use permit. Gibson maintains she was grandfathered in, the county says not. Withdrawal of the county’s request for an injunction came when it became obvious that not all county zoning folks were on the same page as to what should be done regarding Paws Inn. And some folks have observed that the troubled history of the county’s relationship with Paws Inn might well have a negative effect on small businesses pondering locating to Goochland and that is worth considering too. Considering the amount of time and money expended by both sides in the case (on the defendant’s side in the neighbor-

hood of $50,000, on the county side unknown at this time) and the possible negative impact on the county’s ability to attract small businesses to locate here, perhaps it would be best to call this case closed and use the county’s resources on more pressing problems. Goodwill recommendation denied Speaking of locating to Goochland, Goodwill Industries got a stinging rebuke from the planning commission last Thursday. Bellview Gardens’ residents turned out and in numbers and convinced commissioners that the thrift store was not right for the location on Mills Road, although at least one commissioner commented that they might look favorably on an application from a different business. A quick drive through the area bears out some of the residents’ concerns. Locating any store at the entrance to the subdivision would change the character of the neighborhood, particularly if Mills Road serves as the main entrance and one of the exits from the business. Just moving the location a few feet further west with a separate entrance and exit onto Broad Street might have made all the difference. Provided the board of supervisors does not disregard the planning commission and approve rezoning for Goodwill, which they have the power to do, any future applicant for the area should consider not using Mills Road in their development plan.

Keep Goochland clean I recently commented on the trash along the roads through our pastoral county. Following that letter I noticed a great increase in such detritus on Tabscott Road (though many other roads look like a trash dump as well). Yesterday I picked up three 50 gallon plastic bags of beer bottles (mostly Bud Light) on a 1,000 foot section of the road. I may have underestimated the reading abilities and the great loss of self respect for such scoundrels. In today’s economically troubled times , where politicians speak to no new taxes, even in the face of already dire budget cuts, why can’t we encourage the people who make and sell such products to bear a degree of respon-

sibility for their proper disposal. A possible deposit charge on the sold product , which if not returned reverts to the county’s coffers. I would think that Budweiser and other members of BIG Beer would admonish this

form of product advertising as well? It is unlikely that we can appeal to the better side of such individuals who despoil where they live but maybe we see Letters > page 8

Bringing clarity I wish to bring clarity to some comments made recently concerning the effects of converting Goochland County Government to a county manager form, rather than retain-

ing our current form of government. This question should be put to the voters during the next election cycle of the board of supervisors so that the citizens will understand clearly the advantages of making this change. I am not speaking for the board of supervisors and I am not speaking of personalities in these comments. It has been said that the current system offers “checks and balances’. This is pure fiction. There is no such thing as “checks and balances” between constitutional officers. Constitutional officers

know they answer only to the voters and to no one else. Certainly not to the board of supervisors. We know that from personal experience. You will never hear of one constitutional officer criticizing another constitutional officers job performance writing them a letter of complaint is no guarantee of success. We know that for a fact. The only way to remove a constitutional officer is to seek permission from the Attorney Generals office to charge them with misfeasance or malfeasance, or for citizens

to initiate a removal proceeding with the local circuit court. This is hardly the structure for operating a good county government. The traditional form of government we have now was devised a long time ago when accounting procedures were far simpler. There was no such thing as “wire transfers” in 1870. Brookman chases off Collegiate comeback BY DAVE LAWRENCE Special Correspondent

Chase Brookman started Goochland’s baseball season with a bang. The shortstop took the first pitch of the Bulldogs season and drove it over Collegiate’s left field fence, added another hit and a run, then survived a tense seventh inning in relief on the mound to preserve a 6-4 victory over the Cougars at Collegiate’s Sam Newell field. “You can’t really script it any better than that,” said Goochland coach Wes Farkas. “I told Chase before he got up to the plate, ‘You know, just go ahead and start it off right. Just give me some runners, I want to see you come across that plate.’ I didn’t realize he was going to get that quickly around the bases, but I’ll take it.” For Brookman, it was a case of getting what he was looking for. “I came up to the plate thinking fast ball, that’s usually the first pitch,” Brookman said. “He threw it belt high, and I put a good swing on it. … It was too good to take, way too

good to take.” Brookman was one of four Goochland players with two hits apiece – the others were center fielder Ben Swecker and left fielder Cody Johnson. But the Bulldogs (1-0) got plenty of offense all around with 12 hits overall. Those hits helped them build a 6-0 lead going into the bottom of the seventh inning, but it took a bit longer for Goochland’s complete offense to get on track. Brookman’s homer was followed by singles from Swecker and catcher Scott Ragland, who took off on a hit-and-run with first baseman Alex McDowell at the plate – but McDowell hit a line drive to Collegiate second-baseman Miller Golliday, and Golliday turned the fly into a triple play to end the inning. Goochland’s leadoff hitters reached base in each of the first five innings, and the Bulldogs took advantage of that to score runs in each of the third, fourth and fifth innings. They scored two runs in the sixth inning – the first inning their leadoff hitter did not reach base.

Those two runs proved pivotal, however. In the bottom of the seventh, Brookman moved to the mound to close the game. With two outs and a man – center fielder-pitcher Hank Evans on second after a double, Collegiate coach Andrew Slater decided to give his bench some playing time, and the pinchhitters, David Gorsling and Tyler Wrenn, rewarded him with two straight singles. Evans scored on Gorsling’s single. Cougar shortstop Brook Slotterback walked to load the bases. Third baseman Brian Davia cleared the bases with a bouncer that went over the head of a Goochland infielder for a double. Designated hitter Jack Sutton struck out and end the game. “I was getting really worried,” Brookman said of the scare. “I was keeping the ball up, just wasn’t getting it down. Good hitters hit that.” Goochland’s starting pitcher, Wes McGuire, had been throwing well – he had given up only one hit and one walk – when he was replaced after four innings by Austin Goyne. up one hit, walked one and hit one in the two innings he was one the mound. Farkas was trying to give McGuire, Goyne and Brookman some time on the mound. “[McGuire] was great. His pitch count was low,” Farkas said. “Our plans for our first couple of non-district games

was to give our top three guys innings – game time and situations.” Slater felt the Cougars (0-21) were simply outgunned. “To be quite honest, I thought we were outmatched at the plate for most of the game,” Slater said. “Our kids kept on fighting and scrapping,

The Randolph-Macon baseball team faced a big mid-season test this past week only to come away with failing grades. It was not any easy stretch by any means as R-MC took on the three top ODAC teams, Lynchburg, Va. Wesleyan and Bridgewater, in consecutive matchups. But the Yellow Jackets were hoping to come away with more than a 2-3 mark in the end. Coming into the stretch with a 6-0 ODAC record, RMC Coach Ray Hedrick took an optimistic approach to the

schedule. “A week ago I’d have told you that I would have taken three out of five between Bridgewater, Virginia Wesleyan and Lynchburg,” he said. But that cautious approach changed after an early R-MC sweep. “We sweep Lynchburg on the road and now you get greedy, you’d like to take four out of five,” he said. Instead the Jackets lost their next three games. However, it does not take an in depth investigation as to why R-MC lost. “We made 11 errors in five games this week,” Hedrick said. “We won 14-3 in a game where we didn’t make any errors. The point is, we’re

beating ourselves and that’s easy. If we can fix that we’re going to be fine.” In 19 games this season, R-MC is averaging 4.42 errors per game and those miscues were most costly on Saturday against defending ODAC champion Bridgewater. There’s no question that the near capacity crowd got their fill of excitement as each game came down to the final pitch. Picking up the pair of ODAC wins over R-MC puts Bridgewater firmly in first place, a game and half up on Lynchburg and W & L and two games up on the Jackets. “To go away with two is a

plus because you kind of help yourself conference-wise,” said Eagles’ Coach Curt Kendall. “You’ve got room for making some mistakes. Hopefully we don’t make too many of them the rest of the way but you put yourself in good position sweeping these guys.” For Hedrick it was no surprise that the Jackets had a chance to win each game in the final at-bat. “I tell the guys all the time, 98 percent of the time we’re going to have chances to win games late,” he said. “I just tell our guys, good teams are in it, great teams make their own breaks... When you’re not play-

ing well, when you’re not doing the little things well, breaks generally don’t go your way.” Likewise the path back to success is clear for the Jackets. “It’s not like we’re pulling our hair out,” Hedrick said. “We’re hitting so well. We’re playing mistake free baseball. We’re pitching it. We’re keeping teams under five runs. Why aren’t we winning. It’s obvious why we’re not winning. We’re making too many mistakes whether it be base running mistakes, not executing on offense, defensive mistakes, which were the big ones today.” For complete game story and slideshow go to www.

Deep Run High students dance the night away Fifth annual marathon raises $160,684 By Ken Odor Media General Staff Writer Almost 700 students signed up to dance and they started last Friday night They didn’t stop until 27 hours later at the Fifth Annual Deep Run Dance

Marathon, raising $160,684 for 12 local charities, besting last year’s total by more than $20,000. Organized by a student committee, daylong and overnight events took place including a limbo competition, air band competitions and a dance-off.

Over the course of the last five years, the students of Deep Run have raised approximately $612,000 for local charities. Last year’s event raised $137,000. Kathleen Kern, Marathon Dance codirector and health and physical education teacher said she grew up in South Glen Falls, N.Y., home of the oldest high school dance marathon in the country, continued on page 2

so it was only natural for her to help start the Deep Run High School Dance Marathon, now in its fifth year. In fact she met her husband David, Exceptional Education teacher at Deep Run, through their work on the project.

Kern said a whole crew of her friends and alumni from South Glen Falls High School come down each year to help out with the Deep Run Dance Marathon. Starting Friday evening, the marathon presented a spectacle of hundreds of young people in motion, with lights flashing and music pumping.

About 9 p.m. the lights came up for the first costume contest with a theme of “Under the Sea.� Brian Rieckman, clad as King Triton, was accompanied by his two sea horses, Mitchell Dintaman and Ben Gallagher. To participate in the dance, each student was required to collect $100 in pledge money.

Robert Bolling thanked the dancers Friday night during a break. Bolling, Executive Director of the William Byrd Community House on Cherry Street in Richmond, praised the Deep Run students. He said he heard about the event several years and was glad to be one of the 12 recipients of funds raised. “We asked them to support our school programming,� said Bolling, after he addressed the dancers. “It’s beautiful,� said Bolling. “It’s a great situation when an affluent community like this is helping a community that is struggling.�

Henrico and Chesterfield CASA to hold ‘Superhero Run’ April 9 Contributed Report The Henrico County and Chesterfield County Court Appointed Special Advocates programs (CASA) will host the second annual Superhero Run on Saturday, April 9, at St. Joseph’s Villa, 8000 Brook Road. The Superhero Run, which works to raise awareness and support for local victims of child abuse, will feature a 5K race, kids’ mile and post-race fair. The Martin Agency is the lead sponsor of the event. Participants of all ages are encouraged to dress and run in the costumes of their favorite superhero characters, said Barbara Herzog, executive director of Henrico CASA. “Henrico and Chesterfield

CASA are excited again to hold the Superhero Run and help increase awareness of the special needs of abused and neglected children in our community,” Herzog said. “We are grateful for The Martin Agency’s support of this special event.” Inspired by The Superhero Foundation, an Austin, Texasbased organization working to prevent child abuse, the CASA event is one of several Superhero runs nationwide. The race is being held in conjunction with national Child Abuse Prevention Month. Activities begin at 8:30 a.m. with the kids’ mile; the 5K race will follow at 9 a.m. Cost before April 9 is $25 for adults and $15 for children ages 5 and older; fees increase $10 on race day.
