Everybody has a story about where they were and what they were doing last week when a 5.8 magnitude earthquake, with its epicenter near Mineral, shook hard enough to be felt in 22 states and Canada. Ricki Lanyi owns Patterson Sports Park and had experienced earthquakes before. “We used to live in San Francisco and went through a few out there,” she said Thursday as she drank her morning coffee. “When this one hit, I was inside the little building we have on the property. I felt things start to shake and the windows were rocking and rolling, so I ran outside. I could see the ground shaking and my dog was running around. I guess it lasted about 20 seconds. We didn’t have any damage, so I guess we were pretty lucky.”

Senator Mark Warner gives GHS students a pep talk By Jim Fields jfields@mechlocal.com

Sen. Mark Warner spoke at Goochland High School Wednesday and encouraged his younger constituents to not be afraid to fail in life while stressing the value of an education. “I was the first member of my family to attend college,� the first-term Democrat told the student body. “I used a lot of student loans and graduated from Harvard Law. After graduation, I couldn’t get a job, so I took $5,000 and opened a small energy company. Six weeks after opening, it went bankrupt. I then opened a real estate company and that lasted six months. “I was living out of my car and had failed at my first two jobs,� Warner added. “The important thing is I learned from my failures. In the 80s, I had a chance to get involved in a cell phone company. I was getting calls from all of my friends telling me not to do it that no one wanted cell phones. I didn’t listen

to them and co-founded the cell phone company that today is Nextel.� Warner stressed that it was no disgrace to fail, as long as you were willing to pick yourself up and learn from the experience. “It used to be that if school wasn’t for you, you could leave when you were 16 and get a job at the local mill or factory. Those days are gone. The factories and mills are gone and so are the jobs. “Let me give you an example of how an education can affect your lifetime earning potential. If you don’t have a degree, you can expect to earn $800,000 over the next 50 years. A high school degree gives you a $400,000 raise to $1.2 million in your lifetime, and with a college degree, you will earn another million dollars for a total of $2.2 million.� Warner took questions from the students and one was did he have aspirations to run for President? “I have so much on my plate right now,� he said. “I spent about a year and a half traveling around the country talking

to people about a possible run after my term as governor ended. Then President Obama entered the race and I decided not to run. “As for the future, I don’t know. It takes a strong person to take on that type of challenge. For example, every day when he gets up, President Obama has briefings from six department heads, and that’s before breakfast. I think he’s done a good job, although there are times I’d like to see him step up more.� As for the recent debacle over passing a budget amendment, he had some definite opinions. “Right now, this country needs for you to elect officials who are willing to check their party hats at the door. It’s time your elected officials started putting our country first and party someplace down the line. Before we finally passed an amendment, I was a member of a group called the Gang of Six. We had three Democrats and three Republicans ready to work together for the good of the country.�

there had been an earthquake. When I went inside my house, there were broken dishes, cups, saucers and vases everywhere. A lot of things had fallen off of shelves and a lot of things were broken. My house looked like it had been robbed.” Wally Thurston was at home sending e-mails when he was suddenly transported to another time. “I used to live near Quantico, and I heard this loud noise that reminded me of one of their bombs going off,” he said. “Then I thought it couldn’t be one of their shells or artillery fire because I don’t live there anymore. I realized it was an earthquake, got my dogs and we all went outside. I stood there watching my house and my neighbor’s house shake. Fortunately, my house didn’t have any damage.”

Everything stayed where it was supposed to.” Down the road at Parker Properties in Crozier, Rob Parker was at his desk. “I was looking up some listings on my computer when everything started shaking,” he said. “I was here, in exactly the same place, when the last one hit. I stepped outside to see if I could hear or see it better, but it was over by the time I got out of the building. We had some pictures turned crooked on the wall, but otherwise, we didn’t suffer any damage.” At the Goochland Family YMCA, members inside working out and people on the pool deck felt the shaking, but swimmers in the water felt nothing. “I had been outside and just entered the building when it hit,” said Jay Shively, Executive Director. “At first, I thought there was a freight train going by, but then I realized there aren’t any train tracks in the vicinity. I could feel the floor start to vibrate under my feet and then the building started shaking. I could see the lights swaying and a few pictures fell off the walls and broke. “Members inside the building began coming to the front desk, and about that time, it was over,” he added. “We evacuated the building and did a thorough check of the structure, inside and out, before letting members back in. We also checked the pool and pump area to make sure everything was structurally sound and alright to use.” Rachel Neill was working out at the YMCA and said she was driving home from Richmond when the earth shook. “I was driving home and didn’t feel a thing,” she said. “When I got home about 10 minutes after it happened, a neighbor told me

Garrett looks past GOP primary campaign to November election By Ken Odor jodor@goochlandgazette.com

“You can’t get to 21 without the 22nd,” is GOP primary winner Tom Garrett’s refrain, after his narrow victory in last week’s five-person Republican primary for the nomination in the new district. He’s referring to the GOP’s hope to win a majority in the state Senate, where Democrats now hold a 22-18 edge. “It’s a big task returning the Virginia Senate to Republican control,” said Garrett. The GOP already enjoys a comfortable majority in the House of Delegates. But before taking on that task, Garrett had to win the primary, against what he called a strong field of Republican candidates. He singled out Goochland’s Bryan Rhode for praise. “He must have worn out two or three pairs of shoes knocking on doors in the district,” said Garrett. Four of the five candidates polled more than 20 percent, with Garrett holding an unof-

ficial 171 vote margin over second place finisher Bryan Bates. Rhode placed fourth, winning Goochland with 66 percent of his home county’s votes. Mark Peake was strong on his home turf in Lynchburg. But Garrett picked up votes in all jurisdictions, as well as winning Louisa, where he is the Commonwealth’s Attorney, with 81 percent of the vote. Early on election night Peake led but that was before Fluvanna results came in. Turnout there was good, and Garrett said that was key. Garrett got 48 percent in Fluvanna, putting him in the lead. In the fall contest, Garrett faces Democrat Bert Dodson, whom he called “a formidable

opponent.” Dodson faced no opposition for the Democrat nomination and has been able to amass a considerable sum for the fall campaign. “He’s well funded,” said Garrett, “and he has an institutional advantage,” said Garrett of Dodson’s tenure as vice mayor of Lynchburg, one of the most vote-rich areas in the 22nd District, “but he’s got a record he can’t run from.” Garrett said the voters will have a clear choice in November. “Do we need bigger government or do we want to free the hands of those who produce?” Dodson said Monday his campaign would focus on job creation.

“It’s not just a concept to us, it’s a day to day battle,” said Dodson, CEO of Dodson Pest Control. He also touted his 12 years experience on the Lynchburg City Council, six as vice mayor. If it comes down to who works the hardest, Garrett is no slouch, said Goochland Republican Committee Chair Ben Slone, who also praised Rhode’s effort. “He is such a relentless worker,” said Slone of Garrett’s campaign style. “He is non-stop when it comes to working,” said Slone. Slone was optimistic about the GOP’s chances Nov. 8. “Tom Garrett will take it but it will be a challenge,” he predicted

A visit from Irene We were sitting at the lunch counter at the corner drugstore near where we live in the city, munching on BLTs and chips and watching the weather forecast for the Richmond area on the Weather Channel. It’s Saturday afternoon, mind you, and the power has already gone out at the house (no surprise there, it seems to go out every time we have a mild thunderstorm) but the forecast seemed pretty tame. Irene would bring rain with winds in the 25 to 35 mph range. No sweat, right? Wrong. As the day wore on the winds got worse and the big old oak in the front yard, just yards from the house, was whipping its branches around as if possessed. This just had to be the time it finally gave in and crushed the roof, I thought, since it had survived so many other hurricanes. Good luck can’t hold forever, I feared. But, in the end, all it did was drop a few small branches and a bunch of foliage in the yard. Others in the area were not so lucky and by the time it was all over and we stepped out Sunday morning to, ahem, assess, as they call it, it was clear that the Richmond area had been hit by a major storm. Before Irene arrived, some folks had begun to belabor the media for over covering the approaching hurricane and in the end, the storm did seem to cause less damage up north than was feared. But in our neck of the woods,

preparation was essential. No batteries, no light. No prepared foods, nothing to eat when the power goes out. All up and down Patterson Avenue the sound of the chain saw could be heard as tree service companies and homeowners dealt with scores of trees down, on top of cars and houses and blocking roads completely. In Goochland people seem to have fared somewhat better, thank goodness, although a significant number of households in the eastern end lost power and a number of trees blocked roads. And while many area schools closed Monday, Goochland’s were open on time. Seems Irene spared the county the severe blow it administered to the city. So I guess there’s no point in taking forecasters to task for not having a perfectly accurate crystal ball. Too much hollering about all the danger and they are accused of over coverage. Underestimate the potential damage and we get irritated. They can’t win. What it all boils down to is that Irene has served as yet another reminder, as did the recent earth quake, that we live at the mercy of forces larger and more powerful than ourselves. As much as we would like to think we can be in control of our lives, it’s just not so. In the end, Nature always prevails, providing us periodically with lessons in humility, reminding us of the limits of our power.

Letters continued from > page 6 returned and were able to cast their ballots. At Hadensville Precinct’s County Line Baptist Church, the quake damaged the Sanctuary, and the Fellowship Hall. First-time Chief Bill Singleton evacuated the polling place in a rapid and orderly fashion, immediately establishing an outdoor poll with an electronic pollbook and a touchscreen voting machine set up in a tent outside. Voting resumed inside the Fellowship Hall two hours later after clearance from the county building inspector. At the County Administration Building, where county employees were ordered to evacuate, General Registrar Frances Ragland stayed at her post and maintained contact with the State Board of

Elections, directing county building officials to assist at the Hadensville precinct. In other poll locations precinct chiefs and their officers were prepared to evacuate but did not have to leave their stations. The election continued throughout the day even as aftershocks rumbled beneath us. No voter was turned away. No vote was lost. Although voter participation had been anticipated to be as low as 6%, 12.7% of the county’s voters turned out and the brand new polling place on Blair Road topped the list at 18.7%! She practiced radiology in Louisiana for 11 years at St. Tamminy Parish Hospital before moving to Richmond, Virginia to practice in 2006. She suffered a neck fracture in 2008, and retired from practice in 2009 due to health problems. Lynn was an avid runner and competed at an elite level for many years, running in countless 10K races, winning many. She ran her first marathon in 1991, winning the Pittsburgh Marathon. She qualified for and ran in the women’s U.S. Olympic Marathon Trials in Houston in 1992. She continued to run daily with her beloved dogs until her injury. Lynn also enjoyed the outdoors, including fishing and bird and waterfall hunting in both Louisiana and South Dakota. Lynn attended Unity Christ Church in Richmond. She is survived by her mother; a sister, Cheryl (fiancé‚ Ron Knode) in Youngstown; brother, Dr. James (fiancé Amy Blackstone) in South Dakota; special friend, Blane Braud and his daughter, Michelle; and niece, Meredith. She also leaves her beloved dogs, Jenny and Layla. She is preceded in death by her father and her grandparents, H. Leighton and Jeanette Jones and Raymond and Mildred MacDougall. Replacing 10 starters on offense key for Bulldogs 2011 Goochland football preview BY JIM RIDOLPHI Special Correspondent

The dog days of summer are upon us, and that can only mean one thing in Goochland — the Bulldogs are busy hitting the sleds preparing for another successful season under head coach Joe Fowler. Although the early practices seem fairly routine, the team is prepping for a new challenge this year as they exit the Group AA Jefferson District and anticipate a return to their old stomping grounds, the Group A James River District. While Goochland was busy capturing two consecutive playoff spots during their brief stay at the upgraded rating, the James River District was upping its game also. Usually dominant Goochland faces legitimate challenges from Amelia and Buckingham. Fowler thinks the Jefferson experience will benefit looking to overcome the challenge of losing starters at 13 positions, mostly on offense. Even with the losses, the team features 30 seniors, providing leadership that could be the X factor on this year’s squad. “The two years we spent in Group AA will pay off big time this year. We think we have the potential to be very, very good,” Fowler said. Chances are, he’s right, especially if the Bulldogs can negotiate one of the toughest Group A schedules in the state. “We play as tough a schedule as anyone in Group A with non-district games with Monticello, Fork Union, and Fluvanna,” Fowler said. “If we can get through that stretch healthy, we will be tough to

The last two regular season games against Buckingham and Amelia will be very important.” The coach’s biggest challenge will be re-igniting an offense that lost 10 starters, and that seems plausible considering the influx of JV players from a squad that won the Jefferson District last year. Cody Johnson will assume full time quarterback duties after playing defense last year. He’s not a stranger to the position. “As usual, it will be running back by committee and we have a stable full of capable guys,” Fowler said. “Mitchell Brice, Jake Martin, Zakell Johnson and Mason Engel will man the halfback spots. Senior Patrick Clore and junior Nathan Maddox will compete for the fullback job in our three back system.” Brent Alvis returns at wide receiver and the offensive line will likely be anchored by a group of talented juniors

including Josh Kitt and Rye Neidhammer. The team participated in summer league ball, and Fowler is hoping to add another dimension to his ground attack. “Every year, we try to emphasize the passing game more in an effort to find more balance,” Fowler said. But inevitably we still end up being a very ground based offense. That likely will not change that

much, but we will make a concerted effort to put the ball in the air more.” On the defensive side of the ball, the Bulldogs are solid. “We return nine starters and some of them are very good,” Fowler said. Jess McLauglin and Nathan Adams provide a rock steady base at linebacker where Andrew Gee and Dasheem Norris join them.

Colby Cooke have already committed to NCAA Division I programs, Purdue and Vanderbilt respectively. “We are going to be better on special teams than almost any Group AAA team in the state,” Fowler said. It’s early, but most factors point to a special season for the Bulldogs, maybe even a home match up with rival Gretna in the playoffs. Of course, Fowler isn’t looking that far ahead. “How fast our offense gets in rhythm will be key for us.”

There is no argument that Latrell Scott made a terrible decision late last Monday night when he chose to operate a vehicle under conditions that eventually led to his arrest for driving while intoxicated. Scott made a major mistake in judgment that was magnified by his position within the community as the head football coach at the

University of Richmond and a local product who played at Lee-Davis High School. Perhaps sadder still, Scott’s situation was not out of the ordinary. Benedictine returnees looking to toughen up BY JIM RIDOLPHI Special Correspondent

Benedictine’s Greg Lilly is a no nonsense football coach who enters each new season with a singular focus; to make his squad the toughest and best prepared team in the region. With a brutal schedule that often finds the Cadets playing larger schools, some with national recognition, Lilly’s job isn’t easy, but he’s up to the task. The coach is looking forward to the beginning of this year’s campaign with his usual expectations. Boasting 20 seniors on the squad, this year’s Cadets have a good chance of meeting his goals. This year Benedictine will rely on an experienced and battle tested defense, anchored by all state defensive tackle Nigel Williams, who returns for his senior year. “We are strong up front on defense but need to replace two-year starters Kendall Squire and Ben McSweeney, who we lost to graduation, in the secondary,” Lilly said. Deshawn Wells will get the nod in the secondary for the

NASCAR driver Brad Keselowski made a visit to RIR last week as part of a special cookout for select ticket holders. With two wins in the past month and several top finishes, Keselowski is currently the hottest driver in NASCAR.

Last week NASCAR’s Brad Keselowski gave a treat to a select group of ticket holders by inviting them to an exclusive cookout at Richmond International Raceway. For the driver of the #2 Miller Lite Dodge, it was an opportunity to get up close and personal with the people who support NASCAR.

“We do a lot of different events throughout the year but the ones we do with the fans and the guys that come out here and buy tickets and support our sport are very rewarding,” he said. “It’s nice to kind of give back and add value to their ticket and their experience.” Though Keselowski limped into RIR as the result of a broken ankle suffered during testing at Atlanta on August 3, he certainly will not limp into the Chase. The first half of Keselowski’s season was highlighted by a June 5 win at Kansas but since the

beginning of July he has been the hottest driver in NASCAR. A 10th place finish at Sonoma was followed by a 15th place finish at Daytona and 7th in Kentucky. Keselowski suffered a momentary setback with a 35th place finish at Loudon but bounced back to take 9th at Indianapolis, then picked up his second win at Pocono. Not slowing down in the weeks since, Keselowski was second at Watkins Glen and third at Michigan, then found victory lane for the third time this season with a win at Bristol this past weekend. Though the results have

been significantly better over the past two months, Keselowski feels his Penske race team has really made no changes. “I don’t feel like I’m doing anything different, we’re just winning as a team,” he said. “It sounds pretty obvious but we’ve had good runs before this but we haven’t gotten the finishes.” Going into Atlanta this weekend he had risen to 11th in points and with this year’s addition of two wild card slots he has virtually locked up a see Wild >page 19

He never accepted it from his players and always set the standard himself. Coming into this season, Scott and the Spiders had adopted the slogan ‘No Excuses’. The Richmond team knew what they did wrong last season, made no excuses and

looked to correct the situation. Likewise for Scott, simply making an excuse would destroy everything he stood for. With the season due to get underway in 11 days and the weight of intense scrutiny soon to fall upon him, Scott knew what was in the best interest of his university, his players and his conscience. Instead of dragging the situation through a media quagmire, Scott acted without hesitation. Early Tuesday morning Scott made his final call as the Spiders’ head coach. He walked into the office of Richmond Athletic Director Jim Miller, explained his mistake and without a request from the university, offered his resigna-

tion. “It was sad for him talking today,” Miller said. “He was very, very, very sorry that this happened.” For Miller, it was one of the darkest days of his career at Richmond.“It’s certainly among the worst,” he said. “There’s some sad things happen that’s just a part of the business. You lose games, people take other jobs, but this is a situation I think that involved a sad turn of events that was hurtful to a person and his family.” Though obviously painful, Scott knew there was only one recourse for his action and responded in the only way his character would allow. At Lee-Davis, where Scott played high school football, head coach Zac Hayden felt the

Keselowski and former Chesterfield resident Denny Hamlin are currently ranked as the last two drivers to make the Chase. “I think the wild card is a huge move for our sport and I think it’s really the finishing touches on the Chase, what the Chase needed,” Keselowski said. He feels that the previous format devalued many races in the middle of the season. “It seemed like by the time you got to race 10 there was really only three or four people fighting to get into the Chase. It never really changed from there. “With the wild card picture, heck, you can go to tracks like Pocono, that kind of used to be snoozers and didn’t really make a difference; if you win Pocono like I did, now you all of a sudden have a shot of getting into the Chase.” Keselowski believes the

actions on Tuesday morning were a true defining moment for Latrell Scott. “I think that speaks for who he is,” Hayden said. “Some people would try to prolong it and get a way around it, get a lawyer. But for him to kind of man up and say, ‘Hey I made a mistake. I’m going to resign and go ahead and take care of my business,’ I think that speaks a lot about his character.” As of Wednesday morning, University of Richmond senior offensive lineman Richard Muldrow had yet to talk to Scott, but Muldrow felt his former coach reacted to the situation exactly as the players would have expected. “He’s a high class guy,” Muldrow said. “He pushes being a gentleman and being

I’m too close to the fire.” However, one thing Keselowski does know, with his recent performances on the track he has become very popular among race fans. “It’s a huge honor,” he said. “The fans are kind of the ultimate judge, jury and executioner of whatever moves you make for good or bad.”

But no one would question that Scott’s final call as a head coach, was the right one to make.

of the Noteholder and the Substitute Trustees), plus any amount by which the ultimate sale price for the Property is less than the defaulting purchaser’s bid and interest at the rate of six percent (6%) per year of the sales price, prorated on a daily basis from the date of the auction until the date of the replacement sale. After any such default and forfeiture, the Property may, at the discretion of the Substitute Trustees, be conveyed to the next highest bidder on the Property whose bid was acceptable to the Substitute Trustees. In the event the Substitute Trustees do not execute a deed of conveyance, the purchaser’s sole remedy shall be the refund of the deposit with interest accruing thereon at the legal rate, it being the intention of the parties for such remedy to be sufficient to survive a challenge for lack of mutuality. The Substitute Trustees reserve the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the Property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Substitute Trustees may determine in their discretion. Purchase of the Property and settlement will be conditioned upon the waiver of any cause of action against the Substitute Trustees, the Noteholder, and their successors and assigns, respecting the condition of the Property, including without limitation its environmental condition as provided by federal, state, or local laws, ordinances, regulations, or otherwise. The purchaser releases the Substitute Trustees, the Noteholder, and their respective agents, successors and assigns from any and all claims the purchaser or his personal representatives, successors and assigns may have now or in the future relating to the environmental condition of the Property. The parties specifically acknowledge and agree that this clause bars all claims by the purchaser arising from the condition of the Property pursuant to the Comprehensive Environmental Response Compensation and Liability Act of 1980, as amended, and all other actions pursuant to state or local laws, ordinances, or regulations for any environmental condition of the Property. Notwithstanding the parties’ intent that this clause bar all such claims, should a Court of competent jurisdiction deem otherwise, the purchaser agrees that the presence of this clause should serve as the overwhelming primary factor in any equitable apportionment of response costs under federal, state, or local laws, ordinances, or regulations. Nothing in this Notice of Sale shall release, waive, or preclude any claims by the purchaser against the owners or any party in possession or control of the Property. The purchaser shall be required to sign an agreement at the foreclosure sale waiving any cause of action he, she, it or they may have against the Substitute Trustees and the Noteholder for any condition with respect to the Property that may not be in compliance with any federal, state or local law, regulation, or ruling, including without limitation any laws, regulations, and rulings relating to environmental contamination or hazardous wastes. The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or other parties in possession and their agents and not within the control of the Substitute Trustees, the Noteholder, or their successors and assigns. Settlement shall occur in the offices of the Substitute Trustees or such other place as mutually agreed upon, no later than thirty (30) days after the sale, time being of the essence. The Substitute Trustees reserve the right to extend the date of settlement as may be necessary to complete arrangements for settlement. Risk of loss or damage to the Property shall be borne by the purchaser from the time of the Trustees’ strikedown at the foreclosure sale. Real estate taxes and other public charges shall be prorated as of the date the public auction is held, and the purchaser shall be responsible for the payment of such taxes and charges beginning as of the date of the public auction. The purchaser shall pay all settlement fees, title examination charges and title insurance premiums, and all recording costs (including the State Grantor’s tax). The Substitute Trustees will not deliver possession of all or any part of the property being sold. If any successful bidder fails to complete settlement, their deposit shall be forfeited and applied to the costs of the sale and to the secured indebtedness. There shall be no refunds. The forfeiture shall not limit any liability of the defaulting purchaser, or any rights or remedies of the Substitute Trustees or the Noteholder, with respect to any such default and the defaulting purchaser shall be liable for all costs of re-sale of the Property (including attorney fees of the Noteholder and the Substitute Trustees), plus any amount by which the ultimate sale price for the Property is less than the defaulting purchaser’s bid and interest at the rate of six percent (6%) per year of the sales price, prorated on a daily basis from the date of the auction until the date of the replacement sale. After any such default and forfeiture, the Property may, at the discretion of the Substitute Trustees, be conveyed to the next highest bidder on the Property whose bid was acceptable to the Substitute Trustees. In the event the Substitute Trustees do not execute a deed of conveyance, the purchaser’s sole remedy shall be the refund of the deposit with interest accruing thereon at the legal rate, it being the intention of the parties for such remedy to be sufficient to survive a challenge for lack of mutuality. The Substitute Trustees reserve the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the Property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Substitute Trustees may determine in their discretion. Purchase of the Property and settlement will be conditioned upon the waiver of any cause of action against the Substitute Trustees, the Noteholder, and their successors and assigns, respecting the condition of the Property, including without limitation its environmental condition as provided by federal, state, or local laws, ordinances, regulations, or otherwise. The purchaser releases the Substitute Trustees, the Noteholder, and their respective agents, successors and assigns from any and all claims the purchaser or his personal representative, successors and assigns may have now or in the future relating to the environmental condition of the Property. The parties specifically acknowledge and agree that this clause bars all claims by the purchaser arising from the condition of the Property pursuant to the Comprehensive Environmental Response Compensation and Liability Act of 1980, as amended, and all other actions pursuant to state or local laws, ordinances, or regulations for any environmental condition of the Property. Notwithstanding the parties’ intent that this clause bar all such claims, should a Court of competent jurisdiction deem otherwise, the purchaser agrees that the presence of this clause should serve as the overwhelming primary factor in any equitable apportionment of response costs under federal, state, or local laws, ordinances, or regulations. Nothing in this Notice of Sale shall release, waive, or preclude any claims by the purchaser against the owners or any party in possession or control of the Property. The purchaser shall be required to sign an agreement at the foreclosure sale waiving any cause of action he, she, it or they may have against the Substitute Trustees and the Noteholder for any condition with respect to the Property that may not be in compliance with any federal, state or local law, regulation, or ruling, including without limitation any laws, regulations, and rulings relating to environmental contamination or hazardous wastes. The subject property was rezoned to RPUD (Residential Planned Unit Development) in March 2007 and included proffers addressing such items as buffers, density, sidewalks, a conceptual plan, etc. The property is in Centerville Village and is recommended for residential use with a maximum density of 2.5 units/acre in the Comprehensive Plan. The property is in the Tuckahoe Creek Service District. b.
