Board reviews noise and pet ordinances County gives updates on Three Chopt Water Line, HCA projects By Amy Condra acondra@goochlandgazette.com
At last week’s Board of Supervisors meeting county staff presented several ordinance amendments, including two drafts of a noise ordinance amendment and an amendment to a companion animal and public nuisance ordinance. The primary difference between the two noise ordinances is whether noise violations are measured by decibel or “plainly audible” standards. Examples of noise disturbances included social gatherings and parties, sound producing devices such as radios or MP3 players, noisy animals, trash and recycling collection, street cleaning and construction, peddlers and hawkers, amplified sound from vehicles, lawn care activities, on- or off-road motor vehicles, and the sounding of horns or other warning devices. “This is probably the third time this has come up in the last 10 or 15 years,” said Steve Oakley of Manakin-Sabot. Oakley said that he felt that the cost of monitoring decibel levels would be cost-prohibitive for the county. He also noted that agricultural operations were listed as an exemption to the noise ordinance. “It would be nice if we had some stipulations

It’s only October, but the Goochland County Christmas Mother is already gearing up to help provide a Merry Christmas to all county residents, including the less fortunate. This year’s Christmas Mother is Jane Allen-Bowles. Active in the community for more than 50 years, Allen-Bowles is married to Dr. James H. Bowles. Allen-Bowles is currently the Friendship Café Manager for Senior Connections at site 004 at the Goochland Recreational Center. She is a lifelong member of Fauquier Baptist Church, where she currently holds a number of offices, including President of the Senior Missionary Ministry and President of the Ladies Auxiliary. In addition to charitable activities too numerous to mention, Allen-Bowles has been Director and Recording Secretary for the Goochland Recreational Center. “Our primary thing this year is we want to emphasize not leaving out our senior citizens,” said AllenBowles in an interview at her home last week. “We want to emphasize that to the churches.” The Goochland Christmas Mother program has grown since its beginnings in 1957, when the Family Services Society (now the Goochland Fellowship and Family Services organization) first began distributing food baskets to Goochland’s needy residents. In 1963, Ms. Rodie Roberts was chosen as the first Goochland Christmas Mother. Last year the program served more than 300 county families. A big change this year is the program’s move from the Fairgrounds building to the old Middle School on Dogtown Road.

Training for application takers will be held Wednesday, October 27 at Grace Parish House from 9 to 10 a.m. and 5 to 6 p.m. Applications for assistance will be taken Saturday, October 30 at County Line Baptist Church, Goochland Parks and Recreation offices and the Goochland Recreation Center from 9 a.m. to 12 noon. A second application day will be held November 6 from 9 a.m. to 12 noon at County Line Church, Goochland Parks and Recreation offices and Manakin Fire and Rescue. Shopping Day is set for November 30 at the Short Pump Wal-Mart and Wrapping Day will be at the old Middle School on December 4 starting at 9 a.m.
Pickup Day is December 11 at the Old Middle School. Allen-Bowles said the program hopes to increase its effort this year. “Our goal is to raise $55,000 this year,” she said. The program anticipates increased demand due to the current economic difficulties, she said. “So many families have lost incomes,” she said. “My main concern is children and the seniors.”

John Denver’s Banjo Man will play fundraiser for GHS By Ken Odor jodor@goochlandgazette.com
Jim Connor and Don Park, playing together as “John Denver’s Banjo Man,� are hoping to raise a goodly sum of money for the Goochland High School Chorus when they perform October 23 at the high school auditorium. Connor on banjo and vocals with guitarist and lead vocalist Park, along with Jeff Yago, organist for Gum Springs Methodist Church on keyboards and bass, have played each of the last two years to raise money for the chorus, but this year is different. That’s because the chorus is on its own this year, after having its funding eliminated from the school budget. “We went from $2,000 to zero,� said Choral Director Susan Duty last week. “We’re trying to do self-funding.� “Right now I need money just to buy sheet music,� said Duty (it runs about $1.80 a copy, she said). Last year the show drew an audience of about 200, said Duty. This year they are hoping for a bigger turnout. Park said the audience could look forward to hearing some Denver favorites like “Rocky Mountain High,� “Country Roads� and “Grandma’s Feather Bed,� which Connor wrote for Denver. “It was one of Denver’s favorites,� said Park. Although Park gets to sing lead vocals, he defers to Connor. “He’s the draw,� said Park about Connor, who played with Denver for 20 years, as well as performing with the New Kingston Trio. “I’m definitely second fiddle,� he joked. But just singing Denver’s
songs is a high for Park. “It’s a lifetime fantasy to play with a member of John Denver’s band,� said Park. “My rush is that he picked me to sing Denver’s songs.� Both Park and Connor are Goochland residents and both have had daughters who were members of the GHS chorus. Park, who is also a Kingston Trio fan, said they would also likely perform some of that group’s favorites, like “Tom Dooley� and “The MTA.� All proceeds from the performance will go the GHS Chorus, said Park. Duty said that in addi-
tion to the normal supplies needed for the chorus, they need to raise money for fees so they can compete in the district competition and also help fund a trip for the jazz choir to go to New York. The John Denver’s Banjo Man performance is scheduled for 7 p.m. Saturday night October 23 at the Goochland High School auditorium.

Three Chopt Water Line Dickson presented an update on the Three Chopt Water Line project, saying that the water line is about 95 percent complete. The project, which has been underway since September 2009, is being constructed through Henrico County Public Utilities at an initial projected cost of $2.7 million. At a meeting of the Goochland Board of Supervisors in October 2009 county staff recommended that due to unforeseen circumstances, such as the discovery of rock at the site, that $3 million be set aside for the project.

The revised total was approved and $3 million was appropriated for the water line, as was a general fund loan to the Tuckahoe Creek Service District. More rock has been encountered at the site, however, resulting in three change orders that add up to $266,000. And, Dickson told the board, additional rock was found last week, which could impact the project’s timeline and budget. Henrico has been billing Goochland for exact costs throughout the project and the county will reconcile all final costs with Henrico when the project is finished. The Court Appointed Special Advocate program is designed to pair trained volunteers with children in the judicial system who have been alleged to have suffered abuse and neglect. The volunteers stay with the child assigned to them until the case is resolved and the child is placed in a safe, permanent home. The Goochland CASA program has served more than 130 children since it was established. The Goochland program’s leadership, originally set up to operate under one paid part-time a d m i n i s t r a to r / p ro g r a m supervisor, will not have

two paid staffers, who will split the duties and salary of the former Executive Director. “I think we make a terrific one-two punch,” joked Casey, who said she is comfortable with the legal side, having served as a CASA for five years. Now she is learning the administrative side as well. Both Case y and Bumgardner also have cases, as do the nine other Goochland CASAs. But that’s not enough, say the pair. They want to recruit more volunteers for the program, with an eye to holding their next training class in January. “When we have a new CASA we buddy them up with a seasoned volunteer,” said Casey, who has a background in teaching handicapped children. She ran her own school in the Philadelphia area for 25 years.

After selling the school, Casey said CASA gave her an opportunity to continue working with children. Bumgardner also has a background with helping children. A retired insurance agent, she and her husband raised five foster children along with their own three children, she said. “You might say I majored in children,” said Bumgardner. In addition to recruiting new CASA volunteers, fundraising will also be a priority, since the agency’s budget has been reduced. Casey said the state contribution from the Department of Criminal Justice Services declined by 27 percent this year. The program also receives funding from the Board of Supervisors and is provided an office in the Goochland County Administration Building

(Re)educating the public? The midterm elections will be held on November 2, and pundits from all sides of the spectrum are gearing up for the big day. The Gazette receives press releases from a variety of political parties, and these are often written in ways that bash one side of an issue and bolster the other. That is expected during the election season, and if you read all the news you receive, the messages eventually achieve a kind of balance. It is at that point, whether you are receiving your news from press releases, newspapers, blogs, neighbors, and/or any other sources you seek out, that prospective voters begin to decide who will get their vote. That is the point, right? The point in this country is to have an educated public that learns about candidates, then votes for the person who seems best suited for the job of running our county, our state, our nation. Some people do not agree with this process. “The bottom line is: Tell everyone not to listen or believe anything incumbents have to say,” said one correspondent who sends various members of the media frequent emails, under various names, from one centralized address. I have received other emails and faxes with the same message, and I wonder, How is this helpful advice? Well, it isn’t. It is the kind of advice that is given to help only one interest: The interest of the person giving it. And that is always dangerous to the cause of democracy. Why would anyone feel that he or she
has a right to tell anyone not to listen to a candidate? We are all certainly entitled to an opinion about issues and candidates, and our First Amendment Right means that we are allowed to share those opinions. Ideally we would do so respectfully, and with an aim at discussing, rather than dictating, points of view. There was a lot of talk over the weekend about candidates who are considered unsavory—posing in Nazi uniforms, and giving speeches of grave intolerance, are two reasons that two political hopefuls were covered extensively on the Sunday talk shows—and these examples should prompt prospective voters to ask a few questions. Whether your answers end up being “yes” or “no,” deciding whether a candidate’s actions or words are acceptable to you, and indicative of a solid character and strong statesmanship, is part of being an educated voter. I have said this before in this column, and I see no reason not to reiterate it as we get closer to casting our votes—you may not agree with my political choices, and I may not agree with yours. But I do agree with democracy, and with making informed, individual decisions. I disagree with anyone who tells you to throw away that right, who tells you not to listen to a candidate he or she doesn’t like. That is the kind of advice that is meant to reeducate, rather than educate, a voter. And that is the kind of advice best ignored in any country that prefers freedom and equality to tyranny.

A rush to judgment? It appears to me now that (Pet Rescue Foundation Operator) Annette Thompson was convicted of the charges against her. Last time I thought that justice delayed was justice denied. I now believe that instead we have a rush to ‘ legal’ judgment. My conclusion is based on the following...neither the State Veterinarian nor the Goochland County Animal Control Officer, in all their visits, following claims of animal abuse by the plaintiff’s, supported those abuse claims.
The two veterinarians for the plaintiffs, who examined the dogs in the complaints, under questioning by the plaintiffs, did not report to authorities, as they are legally required to, abuse of the animals. The judge had previously ruled that the plaintiffs could not use a private prosecutor, yet he allowed their lawyer in the court and to participate for the plaintiffs by passing notes to the plaintiffs during the questioning.

At a previous meeting, an agenda item regarding our high school baseball team’s proposed Disney World Spring Trip was tabled to a future meeting for more “discussion� and a vote. Interestingly enough, the SB member requesting the tabling did not attend, there was little discussion, none being really meaningful, and the vote was, you guessed it, unanimous. Why does the SB even go through these pretend parliamentary pretzels? Table for future discussion, don’t
attend, don’t discuss, but yet a unanimous vote‌smells like, “Lockstep unanimous voting is the trademark of decisions made in secret.â€? I am personally not against this trip, but in my opinion, how this decision was made is yet another example of our SB’s unbridled arrogance towards the public which continued to rear its multi-pronged head as the meeting continued. When questioned later in the meeting about transferring funds between accounts, Superintendent Underwood stated, with regard to certain transfers, that “no formal
agreement� existed. Despite our recent less than glowing county and GCPS audit results, we now have public admission of funds being transferred informally. It gets better – during the “Other Business� portion at the meeting’s close, SB member Mattox suggested moving the workshop meetings back to their previous dungeon-like surroundings in the SB building. His feeble and rambling attempted justification for this step-backwards move make a teenager’s curfew extension argument read like a Supreme Court brief!

Questioning the process It has been said that, “Lockstep unanimous voting is the trademark of decisions made in secret.â€? I have been attending Goochland County Public Schools (GCPS) School Board (SB) meetings regularly since the beginning of this year, and I must say, truer words were never spoken or penned. The SB’s September 28 workshop was no exception, as all votes were unanimous. These expected “lockstepâ€? decisions add more brush strokes to the portrait of arrogance already painted by a board and administration caring more for their bureaucratic survival than the cost effective education of GCPS students. There was a small, albeit erroneous, glimmer of hope for greater GCPS SB transparency as our middle and high school principals each presented their annual School Improvement Plans. Hopeful, in that they used the overhead projector and attendees could follow their well prepared presentations. Erroneous in that they used a master slide entitled “20010 – 11.â€? Bulldogs suffer from heartbreak 2.0 For second week in a row, Goochland nipped on last second two-point conversion BY JIM RIDOLPHI Special Correspondent
For the second week in a row it was heartbreak for the Goochland football team as they suffered their second last minute loss to a two-point conversion in as many weeks. On Friday night the Bulldogs dropped a one-point decision to visiting Jefferson District opponent Monticello. The Mustangs scored with 26 seconds remaining in the game to cap a dramatic second half comeback that netted Monticello a 29-28 win over the host Bulldogs. Monticello running back Jesse Ayres put the one-yard finishing touch on a final drive that drew the Mustangs within one at 28-27. Though a tie was virtually assured, Monticello head coach Brud Bicknell didn’t hesitate and opted to go for the win on a two-point conversion. “We believe in that cliché that you go for the win on the road,” Bicknell said. “We saw them play a triple overtime last week and they were efficient, so we figured our best shot was to go for two.” Monticello sophomore quarterback Jhalil Mosley stretched the Bulldog defense as he swept around the right end for the conversion and a Mustang lead. “It certainly wasn’t the way the play was drawn up but Jhalil made a great play to find the end zone and get the win,” Bicknell said. Most heartbreaking for Goochland was the loss came after the Bulldogs dominated the first half, taking a 21-0 lead to the locker room. They were also set to receive the second

half kickoff. “It was pretty somber at halftime,” Bicknell said of the Mustangs. Goochland running backs David McKenna and Dustin Plummer provided the apparently comfortable lead with each producing 100-yard plus performances for the Bulldogs. But, Goochland’s powerful ground game wasn’t enough to counter Ayres’ three-touchdown, 254-yards rushing performance, much of which came in the second half. “I think he finally realized just how good they were and they were going to hit him,” Bicknell said. “He came out the second half and just slammed it up in there. I think he just wore them down after he saw what they were trying to do.” In the second half, things started going wrong for Goochland right from the start
when the Mustangs set the tone by executing a successful onside kick on the opening play. The gamble paid off when Ayres took it in from seven yards out to make the score 217 with a little over nine minutes remaining in the third quarter. The Bulldogs responded with what looked like a backbreaker when Plummer broke loose for a 58-yard touchdown run to answer the Mustang score with an exclamation point. Goochland then stopped the Mustangs on the ensuing drive and took over on their own eight-yard line. A steady dose of McKenna runs took the Bulldogs to the Mustang 25, but Monticello defensive back Denzel Terry ended the threat when he intercepted a Ryan Crouch pass and killed the drive. “That was a big play for us,” Bicknell said. “It was the
first time we’d stopped them all night.” Ayres capped the ensuing drive with an 11-yard run, and the Mustangs were within 14 heading into the final period. Mosley found wide receiver Tyler Moneymaker with a 28yard touchdown pass to cut the lead to seven, setting up the dramatic finish. With three minutes and change left in the game, the Mustangs stopped the Bulldogs on a fourth-and-four on the Goochland 25-yard line, and took over for their final push. Ayres again took charge with key runs and wide receiver Deno Robinson grabbed a critical third down catch that set the Mustangs up on the Bulldog 14-yard line. At that point, it was a matter of when, not if for Ayres. “My only thought was to score,” the senior running back said.
“I knew I was getting in there, regardless.” He plunged across the goal line with seconds remaining, setting the stage for the two-point winner by Mosley. Bicknell said it was the biggest win in recent memory for the Mustangs, and places them in the middle of the Jefferson District hunt at 4-2. “It’s exciting and I feel great for our kids,” Bicknell said. “We’ve haven’t had many games where we came back from such a long way back to get a victory. This one ranks right up there.” Goochland coach Joe Fowler was clearly frustrated with the repeat last-second loss. “We’re not able to close the deal right now,” he said. “We’re doing everything we can as players, as coaches and things aren’t going our way. All that we
can hope for is that in five weeks we get to see Monticello again in the playoffs.” Plummer finished with three touchdowns and 163 yards on 17 carries, while McKenna had 18 attempts for 134 yards and a touchdown. Zakell Johnson also had an interception for the Bulldogs. Goochland returns to action this Friday, hosting Fluvanna at 7:30 and looking for a chance at redemption. This year’s boys’ soccer version of the battle of River Road produced some fierce competition and moments of greatness… but no winner. Playing at the Abby in Eastern Goochland County, Benedictine and Collegiate fought each other to a 1-1 standoff in a defensive struggle that had its share of close calls. The Cougars almost came away with the victory with seconds remaining in penalty time, but couldn’t close the deal as several late shots on goal went awry. “We had our chances against a very good team today,” said Cougar coach Charlie Blair. “I was pleased with our effort and intensity. I thought we used the field well in the second half and knocked the ball around well. This was a well played match today and we got to see some good soccer.” Likewise, the Cadets also had their shots at victory, but a stubborn Cougar defense controlled the ball and kept play mostly at their end of

Burke Modisett also did not play due to injury. “We’ve still have a couple of kids to get back to full strength,” Blair said. But according to Blair, the depleted numbers do have a silver lining. “It’s given us a chance to play some of our less experienced players,” he said. “That was a big relief today to see some guys who we needed to step up do such a good job.” Both teams have their sights set on the state playoffs. “We definitely think we can make a run in the states if we get healthy,” Blair said.
Prather is hoping for a good finish in the regular season for the 9-1-2 Cadets, and maybe even a home field advantage. “Hopefully, we’ll be in a good position to compete when the state tournament begins in November,” Prather said. “Maybe, we’ll even have a home game here in the first or second round.” The Cadets face St. Christopher’s and Christchurch this week while Collegiate preps for Christchurch and Trinity. The proposed definitions are as follows: 65.2 Net metering service: Measuring the difference, over the net metering period between electricity supplied to a net metering customer from the electric grid and the electricity generated and fed back to the electric grid by the customer. 89.1 Small wind turbine: Any device, such as a windmill, wind turbine or wind charger that converts wind energy into electricity, including rotors, generators, towers and associated control or conversion electronics.

The proposed supplementary regulations on the use of small wind turbines are as follows: Section 21. Small wind turbines. 1. Purpose. To promote the use of renewable energy sources by allowing small wind turbines in appropriate locations while minimizing visual, safety, and environmental impacts. 2. Applicability The regulations set forth in this section shall govern the installation and siting of freestanding small wind turbines used to generate electricity primarily for onsite consumption, however such provisions shall not impact roof-mounted systems that meet the underlying height requirements of the respective zoning district. Both freestanding and roof-mounted systems shall comply with the appropriate regulations set forth in Virginia Administrative Code Sections 20VAC5-315-10 through 20VAC5-315-80. 3. Application for approval. In conjunction with the submittal of a building permit application for a freestanding small wind turbine system, the applicant should submit the following for review and approval by the Planning Director: a. Plat of the parcel showing lot lines, location of the small wind turbine, and setbacks. b. Plans that show the total height of the structure including rotor blades. c. Certifications required by the state for net metering service, such as approval of the electric distribution company and proof of liability insurance. 4. General guidelines and requirements. Freestanding small wind turbines shall be: a. Limited to 100 feet in height. The height shall be measured as the distance from ground level to the highest point on the structure. b. Limited to one per lot. c. Constructed as monopoles, guy wires may be used but not lattice structures. d. Setback at least 150 feet from all property boundaries, overhead utility lines and public rights-of-way. If guy wires are used, setback is measured from guy wires. e. Energy generated shall be used primarily for onsite consumption. 5. Noise. Small wind turbines shall not emit sound that is plainly audible as measured at the closest property line. The level may be exceeded during short-term events such as utility outages and/or severe windstorms. 6. Signage and lighting. No signage, other than safety and warning signs shall be installed. Lighting is prohibited unless required by the Federal Aviation Administration. 7. Removal. Any system that is found to be unsafe by the building official must be repaired or removed within two (2) months. Any system that is not operated for a period of one (1) year shall be considered abandoned and shall be removed by the property owner within ninety (90) days of receipt of such notice from the county. Hallway of Hope unveiled at Henrico Doctors Hospital By Ken Odor Media General Staff Writer When breast cancer survivor Tracy Lynch would walk the hall from the parking deck to her radiation appointments, she had an idea. “The walls were so blank,” she said, in an interview after the Thursday night unveiling of the Hallway of
Hope, which will feature artwork on a rotating basis from Henrico County Schools. She thought the blank walls affecting her’s and other patients’ mindsets as they arrived for therapy, probably in a negative way. “I thought –what can we do to brighten the hallway?” she said.
Her idea was to use students’ artwork to brighten up the trek to treatment and create a more positive mindset in patients coming in for treatment. So she approached Meg Helsley, Oncology Nurse Specialist with her idea of decorating the hallway with children’s artwork. continued on page 3

Henrico rabies clinic set for Oct. 16 Contributed Report The Henrico County Division of Police will hold a rabies clinic on Saturday, Oct. 16, from 9 a.m. to 2 p.m., at gate four of Richmond International Raceway. Shots cost $8, cash only, and include a rabies tag and certificate of inoculation. Cats must be held in pet carriers. Dog owners may purchase a 2011 license for $10 with proof of rabies inoculation. Lt. Shawn Sears, supervisor of Henrico Police’s Animal Protection unit, encourages residents to vaccinate their pets. “Vaccination will ensure the safety of our residents’ pets and will help protect the community as well,” Sears said. “I said I loved it,” said Helsley. Lynch then approached Henrico Schools (she had two children at Twin Hickory School) and got them involved. “Everyone said yes, nobody said no,” she recalled. “I said to the Heroes Club, ‘make someone happy,’ and they did.” Lynch said she has seen surgeons, janitors, patients and people from all walks of life looking at the art work in the hall. “I think it’s going to be better than we thought!” she said. “It took my breath away,” said Mike Gettings, Art Specialist with Henrico Schools of the idea. Gettings, who has family members who have battled cancer, was visibly moved after the outpouring of enthusiasm at the ribbon cutting. “The kids learn art in class,” he said, “But this combination of art, empathy and compassion will benefit hundreds of people.” The ribbon cutting ceremony coincided with Breast Cancer Awareness Month, with the initial display a selection of 20 pieces of art from the Twin Hickory Heroes Club, a school community service organization. As the crowd swelled before the opening remarks, chairs had to be added to accommodate all who attended. At the last minute, a surprise appearance by cheerleaders from Brookland Middle School added
