Goochland’s Board of Supervisors will decide whether or not to grant a Conditional Use Permit to Benedictine College Preparatory School at their Dec.6 meeting next week,
their last of the year. The school, which hopes to relocate to its property on River Road in time to open for the 2012 school year, was granted a 90 day delay at the supervisors’ September meeting. Although action was deferred for three months, almost 40 speakers rose that night to tell the Board what they thought of the school relocating, with supporters see Benedictine > page 2

Family Chiropractic Center of Richmond held their annual Thanksgiving Food Drive to help raise food donations for the Goochland Free Clinic and Family Services. The patients and staff have been busy raising food donations for our community just in time for the Thanksgiving holiday. “This is the fifth year that we’ve held our Thanksgiving Food Drive in our office and it is always a great success. We honestly couldn’t have done it without the generous donations and support from our wonderful patients,” said

Benedictine’s attorney Darvin Satterwhite said last week that, despite the three month delay, the school still hoped to open in the fall of 2012 on River Road. “Everything would have to go fairly flawlessly,” said Satterwhite. “It’s more difficult but not impossible.” Opposition to the move has centered around traffic concerns on River Road and claims that the site’s water supply and waste water treatment capacity is not adequate for the planned expansion. Some critics have implied that the county could wind up bailing out the school if systems should fail. But this is not so, said Goochland Principal Planner Tom Coleman last week. “ApprovaloftheConditional Use Permit does not obligate the County to fund any road or infrastructure improvements,” wrote Coleman in response to questions from the Gazette. Nor does possible approval of Benedictine’s CUP request

set any sort of precedent that might apply to future requests from private schools, said Coleman. “Each Conditional Use Permit application is reviewed case-by-case by the Planning Commission and Board of Supervisors. In their deliberations, the Board can decide how much consideration, if any, is given to other applications previously approved or denied,” wrote Coleman. Goochland Planning Staff has added a number of conditions to the proposed CUP. For instance, Benedictine would be required to pay Goochland County $230,000 for its pro rata share of the cost of a west bound left turn lane at Patterson Ave. and River Road. Other requirements include limits on the number of students, monks, teachers and employees at the facility for each of the first four years of operation. After four years, the maximum number of students would be limited to 550 (Benedictine’s current enrollment is about 275). Water supply to the site would be limited to 10,000 gallons a day. Sewer capacity would
be governed by the Department of Environmental Quality (DEQ) permit and a 500,000 gallon capacity reservoir would have to be maintained for fire fighting purposes. But River Road resident David Pendergrast, who lives near the Abbey Road location, worries that the proposed left turn lane on Patterson Ave. will be years in the building, since VDOT, the source of the rest of the money for the project, may not be able to come up with the money. And Pendergrast poses the hypothetical question of what might happen if the Abbey’s waste water plant failed and the school was without funds to repair it. But such concerns are immaterial, said Benedictine Headmaster Jesse Grapes Monday. “All folks in Goochland need to understand is that the Virginia Constitution forbids giving government money to religious schools for education,” said Grapes. “Even if Goochland County wanted to make some great gift to Benedictine it would be unconstitutional.” Grapes reminded that when
the school burned a few years back, the City of Richmond did not help pay to rebuild it. Grapes said the 90-day delay period granted in September was necessary. “We were concerned the misinformation would impact the vote,” said Grapes. “We were afraid we would not get Board of Supervisors approval.” Satterwhite said the 90-day period was well spent with Benedictine getting positive feedback after working in the community. Asked if a possible delay of the vote until the newly elected supervisors are sworn in next year would be a problem, both Satterwhite and Grapes said yes. “That would make it an impossibility to get things done,” said Satterwhite, referring to the fall 2012 opening date goal. “It would be a setback for us,” said Grapes. Next week’s public hearing on Benedictine’s CUP will be held at 7 p.m. on Tuesday, Dec. 6 in the old high school gymnasium behind the Goochland Administration Building to accommodate the anticipated crowd.

The Goochland School Board approved a grueling budget calendar at its workshop meeting last week that commits the incoming board to five meetings in January, with the goal of sending a budget to the County Administrator on Feb. 2. At the beginning of the workshop session, outgoing School Board Chairman Ivan Mattox congratulated the five members-elect who will replace the current members and pledged to help them in the transition process. “We support you,� said Mattox to the members-elect. But during the public comment period, before the vote on the budget calendar, Jane Christie urged the board not to adopt the proposed calendar. Christie worried that the compressed schedule doesn’t give the public enough time to give feedback. “You want to have the maximum amount of time,� she said. Other speakers included Sherry Rosen, who said she wanted restitution for being paid less as the girls gymnastic coach over the last seven years than the coaches for golf and swimming. “I can’t figure out what I didn’t do to get equal pay,� said Rosen. Sekou Shebaka spoke on disciplinary actions that he said disproportionately affected African- American students. Michael Mc Dermott questioned the budget calendar and asked why the outgoing board members needed to attend the recent Virginia School Board Convention. During the discussion on the budget calendar board member Maxwell Cisne asked if the new board members would
have a say in the budget schedule once sworn in and Goochland School Superintendent Linda Underwood indicated they would. Besides approving the budget calendar unanimously, the board also approved a Goochland High School Band Trip to the New York City Music Festival from March 29April 1 next year, also on a 5-0 vote and the appointment of Mercedes Castillo to the Gifted Advisory Committee, likewise unanimously. In other business, the board heard a report on an audit of the Activities Account for all five schools. “We’re feeling good about this,� said Underwood. “We got a clean report.� Schools Director of Finance Ernie McLeod gave a short briefing on challenges posed by expected increases in the Virginia Retirement System for schools, which could total up to an additional $1.5 million for Goochland

While most farmers’ markets have closed for the winter, Lulus, a growing online farmers’ market, is thriving and just got a $93,000 grant from the U.S. Department of Agriculture as part of a program to boost access to healthy, fresh and local food. Lulus’ founder, Goochland County resident Molly Harris, said the company would use the grant to create four new hubs in Virginia for distributing produce, meat and prepared products. Lulus has two hubs in Virginia, the first of which was started in Richmond under the name Fall Line Farms. Customers order products from local farms on the company’s website and pick up their order at one of 12 depot locations. Harris was first inspired to support the local food movement in 1999 when spending the summer in Vermont with her three children. She remembered the fresh food she enjoyed growing up. It was this that motivated her to open her own restaurant in 2004 showcasing locally sourced ingredients and educating customers on the importance of supporting their local agricultural community. In late 2008, Harris began a local food co-op with the farmers serving the restaurant, Edible Garden in the eastern part of the County, and customers seeking fresh local produce and meats for their own consumption. The next spring, with support from Virginia Fairs, Fall Line Farms,
opened a second season of business with on-line capabilities, growing from 25 farmers selling to one pick up location to over 50 farmers selling to five pick up locations. Today, the hub supports over 100 local farmers and serves customers picking up orders from over a dozen pick up locations throughout the metropolitan Richmond region. After being open five years, Harris closed the restaurant in 2009 due to the economy and focused on expanding Lulus, launching Coastal Farms in April 2010 to serve Virginia Beach and Hampton Roads. About 100 farmers sell their goods through that program. Lulus makes money by taking a small percentage of the producers’ sales and from customer registration fees. Lulus Local Food, the full service on-line program, has provided a means for starting six hubs with multiple pick up locations and supporting more than 200 local farmers and small businesses with weekly sales year round. Lulus is currently processing approximately 200 orders a week and they range from three or four dollars to over $400. It’s hard to say what an average order might be,” Harris said by phone Nov. 7. “It’s probably somewhere between $20 and a $150.” There are advantages for both consumers and farmers in working with the co-op. “Members of the co-op do not have to buy every week,” she noted. “If they are on vaca-

tion, out of town or just don’t need anything, fine. On the other hand, farmers don’t have to have product available all the time. Maybe they’ve had a bad season, run out of product to bring to market or only have products available certain months of the year, they aren’t obligated to have something to sell. It works to everyone’s advantage.” As the founder of this ever
expanding project, Harris has involved herself in many aspects of the local food industry, serving on the executive committee for the Virginia Food System Council. She is a member of the Virginia Farm to School Working Group, a board member of the Virginia Farmers Direct Marketing Association and leader of the Richmond Area Buy Fresh Buy Local Chapter.

Since the margin of victory was less than one half of one percent of the total votes cast, the costs of the recount will be borne by Goochland County. The last recount in Goochland in a Board of Supervisors election occurred in 1999, when Pryor defeated Herb R. Griffith by 618 to 613 votes, Griffith picking up one vote in the recount.

Lame ducks to decide? That’s the observation that a number of folks have been making recently, seeing as how four of the five members of the current board will depart county government after their Dec. 6 meeting. So the argument goes that they should not deal with a weighty matter, such as whether or not the highly regarded private Catholic Benedictine College Preparatory School should be granted a Conditional Use Permit to relocate to the Benedictine Abbey location on River Road. Opponents of the move worry about traffic impact, the site’s water supply and capacity to handle waste water. They also have implied that the county will be assuming some liability for future problems with such, a claim disputed by Goochland Principal Planner Tom Coleman, who told the Gazette last week that the Conditional Use Permit that will be considered at the Dec. 6 meeting does not obligate the county to fund any road or infrastructure improvements related to the school’s relocation. Benedictine originally was in a big hurry for county approval, telling the Gazette that it needed the Planning Commission and the Board of Supervisors to move quickly for the school to be able to open in Goochland in the fall of 2012. And the Planning Commission came through, approving the CUP at its July meeting. But at the September BOS meeting, the school’s attorney Darvin Satterwhite surprised everyone, asking for a three month delay, in order to counteract a “misinformation” campaign waged against the school’s move. That angered outgoing District 5 Supervisor Jim Eads, who said the issue should be dealt with then. A deferral was eventually granted on a 3-2 vote. Then some folks began to speculate in public that the delay was just a stratagem to move the controversial matter to after the election, so supervisors running in contested races would not have their votes on record. So here we are. The election is over and three incumbents have been defeated (barring a turnaround in an anticipated recount in District 4, where challenger Bob Minnick defeated incumbent Rudy Butler by a handful of votes). So no supervisor’s vote on Benedictine Dec. 6 will be a campaign issue, at least not until 2015 and that would only apply to Mr. Creasey should he run again. Leaving the question exactly as it always has been. Will a Benedictine relocation to Goochland be a net plus for the county or a potential liability? The question of whether outgoing supervisors should decide an important issue is more a question of political philosophy. One could argue that, freed from political and campaign considerations, they may just be able to consider the matter in a more rational and dispassionate manner, considering what’s best for the county and not what’s best for their re-election chances. If that ever was a factor, which we’ll likely never know. - Ken Odor

Reader urges Board to deny Benedictine CUP Precedent: In common law legal systems, a precedent or authority is a principle or rule established in a legal case that a court or other judicial body may apply when deciding subsequent cases with similar issues or facts. In other words precedent can be defined as “an already decided decision which furnishes the basis for later cases involving similar facts and issues.” In March 2007, the late Don Charles, Director of Community Development, sent a letter to Abbot
Moore of Mary Mother of the Church (with copies to Collegiate, St. Catherine’s and the University of Richmond) in which he cited numerous, substantial reasons of concern with Benedictine’s request to move to Goochland. One of the many reasons for concern is the fact that it would set a precedent and Goochland County would be hard pressed to prohibit Collegiate, St. Catherine’s and UR to move some or all of their operations to Goochland should Benedictine be granted permission move here.

Benedictine takes the position that it currently has little to no impact on the area and will have even less of an impact once they move the entire school there. Who are they trying to fool? I live less than half a mile from the Abbey and have seen a tremendous increase in traffic since the playing fields were moved there. What happens when St. Catherine’s wants to move here? Or Collegiate moves all or part of their campus? Or, the University of Richmond decides that Goochland is the place to be? River and Blair Roads cannot handle that traffic. I urge the Board of Supervisors to do the right thing and deny Benedictine’s request for a Conditional Use Permit. After all, it was the current board that approved the existing comprehensive plan. Do the right thing and stick with it.
Benedictine, what are the issues? When Benedictine High School is mentioned, 100 years of history and heritage immediately come to mind. Graduates like John Kuester, who, after his Benedictine High School career played under Dean Smith at the University of North Carolina and went on to become an NBA player, and later an NBA coach; Goochland resident Gary Piacentini, CapCenter Founder; Richmonders Mark Smith and Michael Muldowney, principals of Direct Impressions, a regionally well known direct mail and commercial products printer; Paul Ambrogi, son of Franco’s Fine Clothiers founder Franco Ambrogi, who died serving our country as an A6 Intruder pilot; and recently elected Goochland County District 3 School Board Representative, John
L. Lumpkins Jr., a former Police Officer and now Attorney. Yes, the above narrative is factual, but what does it evoke, emotions or objective rationale to support Benedictine’s proposed Goochland move? I argue, using the legal definition, the true issues needing consideration supporting either side of this issue are the facts – traffic, sewage, water, finance, noise, and property values. In reviewing the facts, we must also examine the credibility of those presenting the facts. That said, can we believe the Monks behind the move, and their motives? The Benedictines have stated numerous reasons over the past few years for moving, not moving, moving, not moving, moving‌do we not remember the “Boy Who Cried Wolfâ€? Tale? Does Religious Order membership, couched in “prayerful
discernmentâ€? equal God-like credibility? We recently witnessed Benedictine’s current headmaster, a retired Marine officer, visiting downtown Goochland with a monk spreading their “gospelâ€? “We already have three votes, and now we’re working on Creasey for insurance‌â€? I thought the Benedictines took a vow of poverty, not arrogance! The Benedictines are doing a wonderful job of equating their proposed move with God, patriotism, heritage and tradition‌all wonderful. They are also excelling at positioning those who oppose the move as being anti-God, unpatriotic, and anti-Benedictine High School heritage and tradition. If informed citizens oppose the move because of the facts traffic, sewage, water, finance, noise, and property values, it makes no difference whether Benedictine, or the University

Byrd Elementary School students learn about life in the fast lane By Jim Fields jfields@mechlocal.com
It was a busy day Nov. 17 at Byrd Elementary School. In the library, books and education were talked about, but the main focus was a one-half size drag racer. In the cafeteria, students were getting Xs taped to their chest. The program in the library was for the school’s Type I guest speaker program. “We have speakers come in monthly to speak to all of our students and talk to them
about their professions,” said Glenda Hawk, Enrichment Resource Teacher at Byrd. “We want to motivate them and stress the importance of a good education.” The program on drag racing featured Sheryl Hlavacek and her daughter Bria. The students were really interested because Bria is in the fourth grade at Byrd. “I’ve been racing for 20 years,” Sheryl said. Without saying how old she is, Sheryl did say she was “really young when I started.”
Bria has been racing two years, and by the end of the day, the mother and daughter had made their presentation five times, reaching every student in school that day. They used videos and Bria’s car to talk about various aspects of racing. “I had to go to driving school to get a license to be a drag racer, and so did Bria,” Sheryl told a group of kindergarten students. “You have to learn the proper way to drive these cars.” The word responsibility was stressed.
“There are three things in life you need to take responsibility for,” Sheryl told the students. “The first one is your education. I’m a college graduate and then had to go driver’s school to get a license to race. “We have a rule for Bria, and it is that if she wants to go racing, she has to make the honor roll at Byrd Elementary School. A while back, she didn’t make it and didn’t get to race. Now she is back on the honor roll and has earned the right to race.” Sheryl then talked about setting goals.
“You can do anything you want in life. I’m a college graduate, a mother and a race car driver. You need to set goals for yourself and make sure you accomplish them. Don’t let anything keep you from reaching your goals.” The third thing she stressed was to work hard. “You have to be willing to
work hard at whatever you want to do to reach your goal. There was a time Bria didn’t work hard, and she didn’t get to race. Now she has worked hard and made the honor roll, and she can go racing. Achieving your goal is worth the effort you have to put see Byrd > page 11

Henrico County Court Appointed Special Advocates (CASA) is seeking applicants for an upcoming training program that will prepare volunteers to serve as advocates for abused and neglected children in Henrico’s court system. The six-week training program will be held from 6-9 p.m. each Tuesday and Thursday beginning Tuesday, January 10, 2012, at the Henrico CASA office in the Hungary Spring Office Park located at 3001 Hungary Spring Road (Suite A), Henrico. Individuals will undergo an interview as well as background checks and FBI fingerprinting as part of the application process. Henrico CASA will provide training free of charge to those selected! Beverly Brown of Echo Lake Elementary School and Mary Bruner of Godwin High School have been honored with the R.E.B. Foundation’s 2011 Award for Teaching Excellence for their demonstrated passion for teaching and their commitment to inspiring students. Brown is known not only for teaching her students core subjects in school, but teaching them the core subjects of life. Brown wants her students to be aware of the community around them and learn that they can truly make a difference in the world. One of Brown’s greatest personal passions is providing positive experiences for veterans. Each year, her students interview veterans and their families and honor them by reading their essays in a classroom ceremony. With her $8,800 R.E.B. award, Brown will honor veterans and visit the sites where they served to protect freedom in the U.S. and abroad. Bruner’s love for American literature is apparent to every student in her classroom. She quotes Twain and Thoreau in her everyday speech and pushes students to succeed while still allowing them to have fun. Bruner will use her $6000 award to embark on a personal survey of American literature with visits to the homes of famous American authors and will also attend Literary Week at the Chautauqua Institution in New York and South Carolina’s Piccolo Spoleto Literary and

Marine Corps Pvt. David A. McKenna, son of Steven R. McKenna, of Sandy Hook, Va., recently completed 12 weeks of basic training at Marine Corps Recruit Depot, Parris Island, S.C. designed to challenge new Marine recruits both physically and mentally. McKenna and fellow recruits began their training at 5 a. m., by running three miles and performing calisthenics. In addition to the physical conditioning program, McKenna spent numerous hours in classroom and field assignments which included learning first aid, uniform regulations, combat water survival, marksmanship, hand-to-hand combat and assorted weapons training. Long after the band has packed its instruments away, the dissonant sounds of the vuvuzelas and air horns have ceased, and the stadium lights have been extinguished, the red-and-gold clad, foot-stomping Goochland partisans who cheered themselves hoarse Friday night will still be talking about Jordan Jefferson’s shining moment that saved the Bulldogs’ season. With coach Joe Fowler’s contingent clinging tenuously to a 16-12 lead over King William in
the Group A, Division 2 quarterfinals, quarterback Freeman McPhearson, who usually operates from the shotgun, was under center. D.J. Johnson, usually a wide receiver, took a spot in the backfield just outside the right tackle. Two tight ends bolstered the line. From the film study, Goochland defenders packing the box recognized the alignment, anticipated sweep and slanted slightly to their left. A split-second after taking the snap, McPhearson pitched to Johnson, who lit out to his right. Stationed just inside the wide receiver and two steps deep in the end zone, Jefferson read the play perfectly, kept his eye on the prize and along with Jess McLaughlin dropped Johnson three inches shy of the
goal line. “He cut it in, and I went fullspeed up in there and hit him about belt-level,” said Jefferson, a 5-foot-9, 140-pound freshman who was promoted to the varsity five games ago. “He had to go through me to score. I had to step up.” “I knew that was the play,” McLaughlin said. “ I just ran to the ball and Jordan and I had it stopped with the help of a great effort by the defensive line.” McPhearson, who rushed 13 times for 71 yards and completed 11 of 24 passes for 178 yards, gave the Bulldogs fits all night. He threw a 35-yard pass to Keith Montgomery for the Cavaliers’ first touchdown at 9:06 of the first quarter. Goochland (13-0) answered with a 14-play, 65-yard drive that ended with a 1-yard run by

In many ways, it’s a new beginning for Goochland basketball. This year the Bulldogs bring back a limited number of starters from last season as they return to the James River District after a two year hiatus. The team also features a new leader on the bench in the form of former Louisa coach Preston Gordon. After four seasons with the Lions, Gordon followed his heart to Goochland, where the

With King William (12-1) trailing 7-6 midway through the third period, McPhearson connected with Brandon Fuller for a 66-yard gain that set up Shawn Chandler’s 1-yard run at 6:25 that gave the visitors a 12-6 lead. The Bulldogs then drove 53 yards in eight plays, the last a 1-yard sweep of left end by Jake Martin for a 13-12 lead. After Mason Engel intercepted a pass, Cooke drilled a 31-yard field goal with eight minutes remaining in the game. And on KW’s final series, McPhearson — an athletic 6-2, 200-pound junior — took the Cavaliers 61 yards on 14 plays before Jefferson’s dramatic goalline stop. “The clock is ticking, many things are going through my mind, and we’ve got to make a play right here,” said Dan Summitt, Goochland’s defensive coordinator. “We put our best players in the best position, tell them what we think will happen, and they perform for us.” Goochland will host Wilson Memorial Dec. 3 at 2 p.m. in the Division II semifinals. It will be a slow start for the Bulldog basketball team at least when it comes to number of players. With football season running long and into basketball’s preseason, Gordon will be forced to wait for some of his key players to arrive. For now, senior James Brooks and Sammie Smith, sophomores Ceejay Johnson and Josh Hayden will join junior Harry Talmage in the lineup. After two years in the Jefferson District, the Lady Bulldogs return to the James River District with a renewed confidence and athletic toughness coach Sarah Voyack feels will serve them well as the 2011 season begins. Goochland also has some clear-cut goals established for their return to the JRD. “We have our eyes set on the district title,” Voyack said. “We feel we have the tools to reach that goal. We saw a lot of improvement last season in the Jefferson District and feel our two years there have made us stronger, smarter players.” Even though this year’s Bulldog lineup is young, the team returns four starters including juniors Chakiryn Jackson, Dana Rodriguez and Tammara Taylor along with sophomore Jessica Liddle who spent most of last season sidelined with a torn ACL. Briana Jackson is the only returning senior. “Tammara Taylor was our leading scorer and rebounder last year,” Voyack said. “We are expecting big things from her this season - she should dominate in the James River District as I believe she is probably the best post player in the district.” The coach is also expect-
ing other starters to step up and assume more dominant roles on the court. “We’re looking for more scoring and leadership on the floor from Chakiryn and Dana this season,” Voyack said. Liddle proved she could play in her first season on the court and Voyack is anxious to see her continue that trend this year. “Jessica Liddle started out strong as a freshman (before her injury) so we are hoping she picks up where she left off and continues to help us both offensively and defensively,” Voyack said. Newcomers Khayla Leabough and Kelsey Simmons should add extra spark for the Bulldogs. They’ll need it entering district play in a James River District that is highly competitive, with Central and Amelia expected to be at or near the top. “Central won the district championship last season but Amelia, Central and Randolph Henry were all at the top,” Voyack said. The team tunes up with non-district foes Fluvanna and Powhatan, both tough contests, and is playing in the upcoming Dale E. Travis Invitational Tournament at Trinity Episcopal this weekend. Working with a group of such talented athletes, Voyack

The applicant is requesting approval for Benedictine High School to operate a school facility. The property is currently used as an Abby for Benedictine monks and by Benedictine High School for athletic activities. The Conditional Use Permit is required by Article 3, Section 3.19 of the County Zoning Ordinance.
