No Brasil, o descarte de alimentos é de uma grandeza que ultrapassa os 50% do total de resíduos gerados. Ou seja, o impacto é enorme e preocupante, mas, segundo uma visão mais otimista, isso significa que, resolvido esse problema, teremos avançado metade do caminho em busca do atendimento às demandas da PNRS – ainda que tal realidade continue muito distante. A matéria de capa traz diversas visões sobre o tema, apresentando soluções em escala doméstica ou industrial para o tratamento de resíduos orgânicos.

Discard of food in Brazil surpasses 50 percent of the total waste produced. That means a worryingly huge impact, but a more optimistic view suggests that solving this problem will make us advance halfway in the path towards compliance with the demands of the PNRS – even being such reality still far, far away. The cover story brings several views on this subject and presents solutions in home or industrial scale for the treatment of organic waste.

Nesta quarta edição, a ARes cede espaço a diferentes opiniões sobre o Acordo Setorial de Logística Reversa de Embalagens em Geral, cuja assinatura, ocorrida em novembro de 2015, gerou debates sobre os reais avanços proporcionados pelo acordo. A discussão sobre o tema mostra-se tão fundamental quanto o acompanhamento de outros acordos setoriais ainda não assinados.

This fourth issue of ARes Magazine gives space to different opinions about the Sectorial Agreement for Reverse Logistics on General Packaging signed in November 2015, which held debates about the real advances that the agreement might have provided. Discussion on this topic is meant to be as essential as the follow up of other sectorial agreements yet to be signed.

Aproveitamos para compartilhar mais uma novidade que a ARes entrega aos seus leitores. Neste número, estreamos a seção “Mundo aberto”, em que publicamos reportagens de revistas de outros países, levando ao leitor um pouco do conhecimento sobre a gestão de resíduos em diferentes partes do mundo. A matéria “Aterro La Crosse County, Wisconsin, EUA: Mudando percepções públicas” foi gentilmente cedida pela revista Waste Advantage Magazine, que circula com quase 40 mil exemplares entre EUA e Canadá.

Com essa leitura, fica para nós a reflexão sobre como poderemos remar contra a maré e avançar, de fato, na gestão de resíduos no Brasil, passados seis anos da PNRS.

We also would like to share one more new gift with ARes’s readers. From this issue, we start publish the section “Open World”, with reports of magazines from other countries to give our reader a bit of the knowledge on waste management in different parts of the world.

The story “La Crosse County, Wisconsin, Landfill: Changing Public Perceptions” was kindly shared by Waste Advantage Magazine, with a paid circulation of almost 40,000 copies to the United States and Canada. This reading gives us some thought on how we can swim against the tide and really make progress with waste management in Brazil after six years of the PNRS.

Desde janeiro de 2016, está vigorando uma nova agenda global aprovada por unanimidade dos 193 Estados membros da Organização das Nações Unidas e direcionada a promover um futuro sustentável no planeta pelos próximos 15 anos.

O documento contempla 17 objetivos de desenvolvimento sustentável e 169 metas, reunidos sob o título “Transformando nosso mundo: a Agenda 2030 para o desenvolvimento sustentável”. Além de tratar de sustentabilidade, a declaração também cobre questões como erradicação da pobreza, desigualdade, infraestrutura, energia, consumo, biodiversidade, oceanos e industrialização.

Entre os vários pontos abordados, consta o compromisso expresso de promover a proteção do planeta “da degradação, sobretudo por meio do consumo e da produção sustentáveis, da gestão sustentável dos seus recursos naturais e tomando medidas urgentes sobre a mudança climática, para que ele possa suportar as necessidades das gerações presentes e futuras”.

A new global agenda is in effect since January 2016. Unanimously approved by the 193 member states of the United Nations, it is aimed at promoting a sustainable future for the planet for the next fifteen years.

The document comprises 17 Sustainable Development Goals and 169 targets under the title “Transforming our world: the 2030 Agenda for Sustainable Development”. Besides talking about sustainability, the Statement also covers issues such as eradication of poverty, inequality, infrastructure, energy, consumption, biodiversity, oceans, and industrialization.

Among the several topics focused, the document is explicitly committed to “protect the planet from degradation, including through sustainable consumption and production, sustainably managing its natural resources and taking urgent action on climate change, so that it can support the needs of the present and future generations.”

Nesse quesito a gestão adequada de resíduos sólidos assume papel de grande importância, tendo sido incluída como uma das metas do Objetivo 12, que cuida de assegurar padrões de produção e de consumo sustentáveis e, no item 12.5, traz o compromisso de, até 2030, reduzir substancialmente a geração de resíduos por meio da prevenção, da redução, da reciclagem e do reúso.

Além de figurar entre as metas da Agenda para o Desenvolvimento Sustentável, a gestão de resíduos também exerce um papel central na adoção do modelo de economia circular, cuja implementação vem sendo amplamente discutida ao redor do mundo, principalmente depois de um novo plano de ações para estimular essa transição ter sido apresentado pela União Europeia, no fim de 2015.

Em ambos os casos, o fundamento para o sucesso reside na aplicação do princípio da hierarquia na gestão dos resíduos, que determina uma ordem de prioridade de ações e parte da prevenção, seguindo para a redução, reutilização, reciclagem, recuperação, e termina com a disposição final adequada (aterro sanitário).

Under this topic, proper management of solid waste plays a very important role. It was included as one of the targets to be achieved within Goal 12, Responsible Consumption and Production, and within Item 12.5, “by 2030, substantially reduce waste generation through prevention, reduction, recycling, and reuse.”

Besides being one of the targets of the Agenda for Sustainable Development, waste management also plays a central role in the adoption of the model known as circular economy, whose implementation has been widely debated around the world, especially after the European Union introduced a new action plan to stimulate this transition.

In both cases, the pillar for success is the establishment of the hierarchy principle in waste management, setting up a priority order for actions with focus on prevention, followed by reduction, reuse, recycling, recovery and, lastly, proper final disposal (sanitary landfill).

Não é possível avançar sem esforço, dedicação e, principalmente, sem recursos.

One cannot advance without effort, dedication and – above all – resources.

O modelo de gestão de resíduos aplicado pode resultar em índices elevados de reciclagem e de recuperação de materiais, que passam a ser considerados como recursos, ou levar a um sistema ineficaz, com impactos ambientais negativos e consideráveis perdas econômicas.

The waste management model applied might result in high levels of recycled materials, which in turn would be considered as resources, or create an ineffective system with negative environmental impacts and significant economic losses.

O Brasil está bastante atrasado no atendimento das determinações da PNRS, que datam de 2010 e incluem a hierarquia na gestão de resíduos como um de seus pilares e, no ritmo atual, certamente não dará conta de cumprir com o compromisso assumido perante a ONU para adoção da ordem de prioridade de ações até 2030.

Brazil is lagging behind when it comes to fulfill the goals of its 2010 National Waste Management Plan (PNRS), which includes waste management hierarchy as one of its fundamentals. At the current pace, Brazil certainly will fail to comply with the commitment made to the UN to implement the action priority order by 2030.

Esse atraso verificado na gestão de resíduos (mais de 3 mil municípios ainda usam lixões; pouca abrangência na coleta seletiva; baixos índices de reciclagem; e carência de planejamento, dentre outros fatores) retira do país qualquer possibilidade de rumar para a adoção das bases de uma economia circular, que além de criar empregos e desenvolver novos negócios, promove um crescimento sustentável, tendo grande potencial de reverter as perspectivas econômicas negativas que nos atingem atualmente.

With such a delay in waste management (over 3,000 municipalities still use dumpsites; little coverage of selective collection; low recycling levels; lack of planning, among others), Brazil is totally unable to adopt the pillars of a circular economy that creates jobs, develops new businesses and promotes sustainable growth, with a great potential to revert the negative economic outcomes we have been dealing with today.

Não é possível avançar sem esforço, dedicação e, principalmente, sem recursos. Para ter uma ideia, ao adotar o novo pacote para a economia circular, a União Europeia anunciou a disponibilização de mais de 6 bilhões de euros para viabilizar as ações propostas, além de vários estímulos para o setor.

One cannot advance without effort, dedication and – above all – resources. For example, when the European Union adopted the new actions towards circular economy, it provided more than 6 billion Euros to turn the proposed actions into reality, among several other benefits to the sector.

Enquanto isso, por aqui, nem os serviços básicos de limpeza urbana têm sido adequadamente remunerados pelos órgãos contratantes. Ou seja, enquanto vários outros avançam, corremos um sério risco de retroceder na gestão de resíduos.

Meanwhile here, even the basic urban sanitation services are lacking proper remuneration from contracting authorities. That is, while many others make progress on waste management, we are seriously in danger of falling back.

GLOBONEWS WINS GRAND PRIX OF 20TH ABRELPE PRESS AWARD On December 1st, 2015, The Brazilian Association of Public Sanitation and Special Waste Companies – ABRELPE – with the sponsorship of Planalto Indústria Mecânica, held the awards’ ceremony of the 20th ABRELPE Press Award. This year, the subject was Innovation and Developments in Waste Management.

The winner in categories Grand Prix and Television was journalist André Trigueiro from Globonews, with the report SP na era da reciclagem (São Paulo’s Recycling Era), broadcasted in November 2014 in his program Cidades e Soluções (Cities and Solutions). His story shows that the megacity – Brazil’s biggest waste producer – has invested in cutting-edge technology to speed up the separation of recyclable items. The program followed the work in one of the sorting centers that use state-of-the-art technology for its processing activities, and highlighted the scavengers’ employability and the destination of the money earned with the selling of recyclables.

Winners in category Press Media were journalists Alfredo Mergulhão and Elisa Clavery from newspaper Extra, with a four-part series called Jogo Sujo (Dirty Game). Published just after the State of Rio de Janeiro’s government announced the postponement of the cleaning up of Guanabara Bay, the story showed symbolic podiums for the “dirt champions” in categories Domestic Sewage, Floating Garbage, and Industrial Pollution, along with possible solutions to cleanse the bay.

In the Radio category, the winner was the report Os caminhos do lixo (The Waste Paths) by journalist Eduardo Matos for Rádio Gaúcha, in October 2014. The series showed the path that waste follows from discard to the transfer station, reported about the Viamão city dump, the biggest in the State of Rio Grande do Sul, and interviewed authorities about actions to be taken to solve the final disposal issues. The last story shows all stages of selective collection and the activities of a plastics recycling plant in the city of Gravataí.

ABRELPE’s CEO Carlos Silva Filho highlights the amazing quality of the contents that came up in this edition of the award. “The press is increasingly aware of the subjects related to solid waste management and the solutions that could be implemented and taken up by municipalities to minimize the impact of improper disposal and comply with the legislation in force”.

NEW ITEMS, TECHNOLOGIES AND TRENDS ON ENVIRONMENT: BW EXPO From 20-22 October 2015, the first edition of the Technology Fair for the Environment – BW Expo – at the Pro Magno Event Center in São Paulo gathered more than 100 companies that showed the latest in new products and services for the sustainability market. About 3,000 visitors attended to the event.

One of the highlights was the BW Conference, with a solid agenda of meetings, technical courses and seminaries on environment, water, sanitary landfills, draining, among other subjects. The conference was held alongside

the fair and received more than 500 delegates. Another milestone was the introduction of The Plastic’s Sustainability Guide, developed by a partnership between Think Plastic Brazil, Instituto Nacional do Plástico (INP) and Apex Brasil (Brazilian Agency for Export and Investment Promotion). Aimed at being a reference for every company, the project was finished in March last year and comprises an integral understanding of the Brazilian and international scenarios, with a diagnostic of the best sustainability practices in the sector.

According to the Fair’s Director Guilherme Ramos, BW Expo overcame expectations, particularly in a year of economic crisis, and stimulated debates and up-to-date contents about the areas related to sustainability and the environment. “An evidence of BW Expo’s success is that we have 53 percent of the spaces already renewed for the next edition in 2017. During this first event, we showed technologies and services that make difference in the market and prove that, just like Nature, the sectors depend on one another, and so cannot be seen as isolated entities. Brazil, for example, has needs in all areas of the environment and has much to do in the various sectors of the society until we become a sustainable country.”

During the Fair, companies such as Construrban, H2Life and SuperBac brought their newest products. Construrban exhibited the biggest compactor truck in Latin America, with capacity to carry up to 25 tons without overflowing.

H2Life showed a Treatment Station that is able to transform improper fresh water into drinking water. And SuperBac showed applications and cases for sanitation in commercial facilities, with a biotechnological product that can pre-treat an average of 10,000 liters of water.

SOLVÍ AND MAN TEST 100% NATURAL GAS-POWERED TRUCK A technology partnership between Solví – a group of companies from the waste, sanitation, energy recovery, and engineering – and MAN Latin America will start testing a 100% natural gas-powered waste collection truck in the streets of São Paulo.

The VW Constellation 17.280 6x2 could reduce particulate emissions, nitrogen oxide (NOx) and carbon dioxide (CO2) by 95%, 70%, and 20%, respectively. The expectations on emission reductions were made after evaluations on a dynamometer bench in Germany. In order to confirm these results under real application, Solví will carry out the tests, which are expected to take at least one year.

The truck will run about 130 kilometers per day in the city center, in a way with high concentration of transported load on flat streets.

Each three months, the route will be revised in order to gradually increase the severity of topography.

NEW TECHNOLOGY RAISES IN WEEE MARKET After many years of research and work with specialized teams, TOMRA Sorting Recycling developed a technology based in optical sensors, called X-TRACT. The promise is to use the technology to help managing Waste Electrical

and Electronic Equipment (WEEE) by speeding up automation processes at the plants and reducing waste of materials.

The X-TRACT technology allows to identify materials that, otherwise, are invisible at the sorting process, regardless of color and level of dirtiness. The technology also makes easier to process old TV and monitor tubes for reuse, and uses a separation system that collects heavy metals from fractions of non-ferrous metals, especially aluminum.

WEEE: SECTORIAL AGREEMENT The management chain for Waste Electrical and Electronic Equipment (WEEE) belongs to the Reverse Logistics System set forth by the National Solid Waste Policy – PNRS. This is a sectorial agreement on “Electric and Electronic Products and their Components”, still under negotiation and waiting for public consultation. The unified proposal was received in January 2014. Three sectorial agreements were implemented for other chains: “Plastic Packages for Lubricant Oil”, “Sodium Vapor, and Mercury and Mixed Light Fluorescent Lamps” and “Packages in General” (find out more on page 32).

CONFERENCE ETHOS 360º DEBATES BRAZIL’S CURRENT SCENARIO UNDER THE COMPANIES’ POINT OF VIEW The 2015 edition of Conference Ethos 360º was filled with high-level content, discussion and ideas about perspectives and sustainable business. From 22-23 September, CEOs, managers, specialists and entrepreneurs from the most diverse economic segments talked about the future without forgetting the present, of course. Through 72 activities and over 150 lecturers spread along seven multimedia stages, the public had a solid experience and could extract the most of new insights on the environment.

One of the most discussed topics during the activities was the fight on corruption. Still at the opening, Brazilian magistrate Fausto De Sanctis and German legal expert Andreas Pohlmann talked about the role of the companies in a much more straightforward business environment. De Sanctis is well-known for having acted in several anticorruption cases, such as Operation Satiagraha. Pohlmann was the person responsible for Siemens’ global compliance, and today is a member of the Special Committee created by Petrobras to follow up on the investigations on corruption in the company.

Other topics discussed during the two-day event were: Transparency in Sports, New Accountability Towards Social Well-being, Diversity in Companies, Innovation, Entrepreneurship, and Sustainability. Juan Duque, Directing Partner of Deloitte in the USA, showed recent data from a research on criteria that investors have been adopting to assess risks and prevent crises., Disney Group’s Sustainability VP Beth Stevens emphasized the company’s concern with children and family when it comes to provide fun, as Disney is one of the first companies in the entertainment sector to set forth ambitious targets to reduce carbon, solid waste and environmental impacts in their offices and

“Estamos discutindo o futuro do planeta desde o relatório de 1970, do Clube de Paris, e, apesar de todo o pessimismo daquilo tudo, nós ainda estamos aqui hoje.”

Since the Club of Paris report of 1970 we have been discussing the future of the planet and we are still here today despite the gloom of that report.

Estudos científicos apontam que os efeitos das mudanças climáticas têm desencadeado uma série de desastres ambientais. A última Conferência das Partes (COP21), em Paris, definiu como uma das principais metas, o estabelecimento de um acordo para limitar as emissões de gases do efeito estufa. De uma forma geral, qual foi a sua impressão sobre a COP21 e os resultados obtidos?

O acordo é fraco, é frágil e poderá ser sabotado por eventuais governos hostis no futuro, por exemplo, o Partido Republicano na presidência dos Estados Unidos e a forma como a Suprema Corte americana tem se mostrado ao barrar a política do governo de redução das emissões em usinas energéticas. O monitoramento é tênue. O sucesso depende de enormes transferências de fundos dos países ricos para os pobres, e isso sempre implica riscos quando a economia sofre retração. As metas são muito baixas e as mudanças climáticas estão aumentando na intensidade e na velocidade. É claro que nós devemos aplaudir o acordo obtido em Paris. É um triunfo da diplomacia sobre aqueles que se opunham a qualquer tipo de acordo. Quase todos os países o assinaram, ele estabelece metas, ele dá um impulso e envolve mecanismos complexos nunca antes tentados em acordos internacionais.

Vai acabar com a mudança climática? Claro que não. Vai ajudar a alcançar uma meta de aquecimento de 1,5 °C? Talvez. É suficiente para fazer os níveis dos oceanos pararem de subir e evitar distúrbios graves nas condições climáticas regionais?

Não. Mas qual é a alternativa? Nenhuma. Nesse sentido, Paris foi um sucesso, estamos todos conversando uns com os outros, todo mundo trabalhando com as mesmas metas, todos cientes da urgência e da enormidade do desafio. Isso é positivo.

Em vários fóruns, atualmente, existe um debate sobre o futuro do planeta, e é essencial que as grandes corporações e a sociedade como um todo sejam envolvidas nessas discussões. Em sua opinião, qual é o principal desafio para obter o compromisso de todos com a sustentabilidade?

Estamos discutindo o futuro do planeta desde o relatório de 1970, do Clube de Paris, e, apesar de todo o pessimismo daquilo tudo, nós ainda estamos aqui hoje.

Fato é que o planeta Terra tem feito um belo trabalho em prover alimento, roupa, habitação, bens de consumo, transporte, saúde e educação para uma população que não para de crescer, além de ter tirado centenas de milhões de pessoas da pobreza nas últimas décadas. A história da humanidade é de um sucesso notável. Talvez, os relatórios pessimistas desde 1970 tenham servido para nos acordar e fazer-nos

The fact is the Earth has done a great job in feeding, clothing, housing, bringing consumer goods, transporting and providing health care and education to an ever increasing population- and has brought hundreds of millions of people out of poverty in recent decades. Humanity is a remarkable success story. Maybe the gloomy reports of 1970 and since then have been wake-up calls for us to improve our performance and make the changes needed to survive as a Race.

But there is an enormous amount yet to do, waste is just one of the questions. And let’s forget now that we will ever find global consensus and commitment on these questions- it is naive to believe everyone will get behind a sustainaibility agenda. The best we can hope for, and work for, is for the democratic process to work its way towards gradual improvements in sustainability policies. For this we need the voices for change to be heard more clearly, to be more focused and to challenge the inertia of vested interests. Take one example: globally, the fossil fuel industry receives around $550 billion in government subsidies; the renewable energy sector receives around $120 billion. So what would you do if you were in charge of the Planet ? Eliminate the fossil fuel subsidies and increase the renewable fuel subsidies. But to do this you need to overcome powerful vested interests who will fight against you every second of the day, and they will fight dirty too. Nothing is gained without a fight and our biggest challenge is to rise together to face the battle and make our governments take actions against interests that damage our communities, health and in the long term, our economies. It is hard but if you don’t get into a fight, it probably means that the battle is not worth winning anyway. And it is hardest where the democratic process is weakest. Our first challenge is to fight for a real, enforcebale democratic decision-making process, this is the real revolution !

Scientific studies show that the effects of climate change have triggered a series of environmental disasters. The latest UNFCCC Conference of Parties - COP21 in Paris had among the main targets the definition of an agreement to limit the emissions of greenhouse gases. In general, what are your impressions about COP21 and the results achieved?

The Agreement is weak and fragile. It can be sabotaged by future hostile governments like a Republican Presidency in the USA and as the US Supreme Court has shown in blocking the government’s policy on power station emission reductions. Monitoring is tenuous. Success depends upon huge transfers of funds from richer to poorer countries, and these are always at risk when the economy turns down. The targets are too low and climate change is increasing in intensity and speed.

Yet we should applaud the agreement reached in Paris. It is a triumph of diplomacy over those who opposed any deal. Nearly every country in the World signed it. It lays down targets. It gives momentum. It involves complex mechanisms untried in international agreements to date.

Will it make climate change go away ? Of course not. Will it help reach a warming target of 1.5°c ? It may help. Is this enough to stop rising ocean levels and severe disruptions in regional climatic conditions ? No. But what is the alternative ? No deal at all. In this sense Paris was a success, we are all talking to each other, all working towards the same goals, all aware of the urgency and enormity of the challenge. This is positive.

Nowadays there is a debate about the future of our planet in various forums, and it is essential to involve large corporations and the society as a whole on these discussions. In your opinion, what is the main challenge to get everyone’s commitment for sustainability?

Since the Club of Paris report of 1970 we have been discussing the future of the planet and we are still here today despite the gloom of that report.

The population is growing rapidly, which leads to increased consumption and waste generation, especially in developed countries. Economic growth, increased purchasing power and waste generation are still inseparable? And in developing countries, the situation is similar?

Developed countries are actually decoupling waste production from economic growth, as populations get older and consume less and as new materials, lighter packaging and waste reduction programmes begin to succeed. Of course, this is not everywhere nor is this a consolidated trend, but we are seeing signs in the more developed economies, and in countries that have really worked on their policies, of positive development towards lower waste production. (Austria, Netherlands, Belgium, Germany, Scandinavia, Japan, Korea) Developing countries are another story. The rise in consumption and waste production is linear and complementary. It is going to continue. It is also hard to combat because for the first time in many countries history people have the opportunity of spending on consumer goods and moving themselves out of poverty. An Indian peasant farmer produces less than 100 kilos of waste per year; a New Yorker produces more than 700 kilos. Do you think the New Yorker wants to achieve Indian levels of consumption or that the Indian wants to become like the New Yorker ? Well, I can guess. So you are facing an incredible emergency in developing countries of rising waste volumes that is now submerging many areas of these cities under their waste- the latest report is on the east of Delhi city in India, a real nightmare. The answer ? The ISWA-UNEP Global Waste Management Outlook report publilshed last September shows what the situation is and lays down a pathway to facing the challenges. Again, this is hard, it requires time, investment and above all policy- which comes back to my earlier point about making government work for the general interests of people, rather than for small sectorial interests.

A Política Nacional de Resíduos Sólidos (PNRS) prevê a implantação de cinco categorias de acordos setoriais que seguem a ideia de responsabilidade compartilhada pelo ciclo de vida dos produtos. O terceiro acordo em âmbito federal a ser firmado foi o Acordo Setorial de Logística Reversa de Embalagens em Geral, assinado em novembro de 2015 com a presença de Izabella Teixeira, ministra do Meio Ambiente.

O acordo, firmado entre o governo federal e a Coalizão (grupo de associações nacionais do setor empresarial que representa centenas de empresas ligadas às indústrias), tem por objetivo garantir a destinação final ambientalmente correta das embalagens que compõem a fração seca dos resíduos sólidos urbanos. A seguir, trazemos a opinião de duas visões distintas a respeito dos reais avanços que poderão ser conquistados com o acordo.

The National Solid Waste Policy (PNRS) sets forth the implementation of five categories of Sectorial Agreements that follow the concept of shared responsibility, based on the products’ lifecycle. In November 2015, the third federal-level agreement to be signed was the Sectorial Agreement for Reverse Logistics in General Packaging, with the presence of Environment Minister Izabella Teixeira.

The agreement signed between the Brazilian Government and the Coalition (a group of national business associations that represents hundreds of industry-related companies) aims to ensure an environment-friendly destination for packages that constitute the dry fraction of urban solid waste. Next, we bring the opinion of two different views about the real developments that the Agreement could achieve.

O QUE É ACORDO SETORIAL? / WHAT IS THE SECTORIAL AGREEMENT? De acordo com o Decreto 7.404/2010, significa o ato de natureza contratual, firmado "entre o Poder Público e os fabricantes, importadores, distribuidores ou comerciantes, visando à implantação da responsabilidade compartilhada pelo ciclo de vida do produto". / Federal Decree # 7.404/2010 says that a Sectorial Agreement is the contractual act “signed between the Public Power and manufacturers, importers, distributors or traders, aimed at implementing shared responsibility for the product lifecycle “.

EM QUAIS CIDADES? / WHICH CITIES WILL BE AFFECTED? Todas as que compõem a fração seca dos resíduos sólidos urbanos ou equiparáveis, exceto aquelas classificadas como perigosas pela legislação brasileira, as quais podem ser compostas de: (a) papel e papelão; (b) plástico; (c) alumínio; (d) aço; (e) vidro; e (f) embalagem cartonada longa vida. / The Agreement comprises all packages that constitute the dry fraction of urban solid waste or equivalent, excluding the packages classified as hazardous by the Brazilian legislation, such as those made of: (a) paper and cardboard, (b) plastic, (c) aluminum, (d) steel, (e) glass, and (f) long-life carton packs.

PRAZO E METAS / TERM AND GOALS O prazo do acordo é indeterminado. A primeira fase de implementação do sistema de logística reversa terá duração de 24 meses. Até o fim desse período, o sistema deverá garantir a destinação final ambientalmente adequada de, pelo menos, 3.815,081 toneladas de embalagens por dia. / The Agreement’s term is indefinite. The first implementation stage for the reverse logistics system will last 24 months. Up to the end of this term, the system should ensure an environmentally-proper final disposal of at least 3,815.081 tons of packages/day.

Situado numa área de 350 acres (141 hectares) diante de uma falésia dentro dos limites urbanos do condado de La Crosse, no estado americano de Wisconsin, o aterro “vê” o vale do rio La Crosse entrar no vale do rio Missisipi. Quando iniciou suas operações em 1978, o aterro era típico, sem membranas de revestimento e com os consequentes vazamentos. Em meados da década de 1990 foi construído um novo local com uma membrana de revestimento, conforme o Subtítulo D da Lei de Conservação e Recuperação de Recursos dos EUA. Em 1988,

quando o condado assinou um contrato de longo prazo com a Northern States Power (hoje Xcel Energy), o sistema do aterro de La Crosse recebeu uma instalação Waste-to-Energy (WTE). Atuando como uma instalação que produz combustível e energia elétrica a partir do lixo, e com um contrato em vigor até 2023, o aterro recebe 75 mil toneladas anuais de resíduos, principalmente resíduos sólidos urbanos, coletados das áreas residenciais por caminhões locais e levados até a planta de WTE para serem incinderados e transformados em energia.

Through turning every kind of waste into a resource, partnering with environmental organizations and developing the land into a natural resource, the La Crosse County Landfill has made it their mission to transition the facility into an asset for the community.

Nestled on 350 acres against a bluff within the city limits of La Crosse, Wisconsin, lies the county landfill looking down into the La Crosse River Valley as it enters the Mississippi River Valley. When the landfill originally opened in 1978, it was a typical landfill that didn’t have a liner and it leaked. So in the mid-1990s, a new site with a Subtitle D liner was built at the complex. In 1988, waste-to-energy (WTE) was added as part of the La Crosse system, when the county entered into a long-term contract with Northern

Outras 100 mil toneladas de resíduos que não podem ser processados na unidade de WTE, como materiais de demolição ou areia de fundição, são depositados normalmente no aterro.

O aterro La Crosse County é o ponto central de um sistema regional de resíduos sólidos que atende principalmente aos condados de Buffalo, Trempealeu e La Crosse, no estado de Wisconsin, além dos condados vizinhos de Houston e Wabasha, no estado de Minnesota. O aterro também recebe lixo de partes dos condados de Jackson e Winona e outros nos limites da área de atendimento. Os participantes regionais no sistema são representados pelo Conselho Gestor de

Políticas de Resíduos Sólidos do Condado de La Crosse, responsável pela supervisão do aterro.

REPARANDO UM PROBLEMA ORIGINAL Até o início dos anos 1990, o velho aterro do condado não possuía membrana de revestimento. Vazamentos atingiam os lençóis freáticos, criando um dilema para as autoridades do condado de La Crosse, porque não havia espaço adicional suficiente na propriedade para realizar uma terceira expansão do aterro. “Nossas autoridades tiveram uma discussão bastante franca a respeito do aterro antigo e do fato de que ele estava vazando.

Todos unanimemente concordaram que era preciso ‘dar um jeito nisso sem precisar de uma solução imposta por [órgãos] reguladores’. Tínhamos verba suficiente

States Power, now known as Xcel Energy. As a refuse-derived fuel, waste-to-energy facility and with a contract in place that runs through 2023, 75,000 tons per year of primarily municipal solid waste that local haulers collect from residential areas go to the WTE plant where it is burned for energy. An additional 100,000 tons of waste that cannot be processed at the WTE facility, such as demolition materials or foundry sand, are typically disposed of in the landfill.

The La Crosse County Landfill is the hub of a regional solid waste system that primarily serves the Wisconsin counties of Buffalo, Trempealeau and La Crosse as well as the bordering counties of Houston and Wabasha in Minnesota. The landfill also accepts waste from parts of Jackson County and Winona County and others on the edge of the service area. Regional participants in the system are represented on the La Crosse County Solid Waste Policy Board, which oversees the landfill.

FIXING AN ORIGINAL PROBLEM Until the early 1990s, the old county landfill had no liner. Leaks affected nearby groundwater, so La Crosse County leaders were faced with a dilemma—there was not sufficient additional space on the property to develop a third

RESUMO: A gestão associada do serviço público de resíduos sólidos pode ser viabilizada por meio de consórcios públicos e convênios de cooperação. O presente estudo visa demonstrar que os consórcios públicos intermunicipais, em razão de seu regime jurídico, é o instrumento que apresenta maior segurança para a gestão associada de resíduos sólidos.

ABSTRACT: The associated management of solid waste public services can be executed through public consortiums and cooperation agreements. This paper aims to demonstrate that the inter-municipal public consortium, because of their legal regime, is the instrument that provides greater security for the joint management of solid waste.

1. A COMPETÊNCIA DOS MUNICÍPIOS A repartição de competências federativas definida pela Constituição da república envolve um sistema que combina competências exclusivas e privativas com competências comuns e concorrentes (SILVA, 2010, p. 477).

O princípio geral que norteia a repartição de competências entre os entes políticos componentes do Estado é o princípio da predominância do interesse, pelo qual à União cabem as matérias de preponderante interesse geral, ao passo que aos estados tocarão as matérias e os assuntos de predominante interesse regional e aos Municípios concernem os assuntos de interesse local.

Assim é que o serviço público de saneamento, bem como a gestão de resíduos sólidos, é uma atividade cuja competência foi constitucionalmente atribuída aos três entes políticos da federação: à União cabe estabelecer suas diretrizes1; aos municípios compete prestá-los, pois se trata de serviço de “interesse local”2; e, por fim, aos estados, aos quais, em regiões metropolitanas, aglomerados urbanos e microrregiões, compete integrar a sua organização, o seu planejamento e a sua execução3.

Saliente-se, aqui, que, neste caso, a atuação dos estados em áreas conurbadas não afasta – e sequer mitiga – a autonomia conferida ao município pela Constituição da república no tema.

Nessa linha de raciocínio, portanto, discordamos do entendimento segundo o qual os estados, no âmbito das regiões metropolitanas, por conta da conurbação e da necessidade da prestação de serviços comuns, podem, por meio da instituição de regiões metropolitanas, afastar ou mitigar as competências inerentes à autonomia municipal.

2. OS ESTÍMULOS À GESTÃO CONSORCIADA INTERMUNICIPAL A Lei 12.305/2015, ao instituir a Política Nacional de Resíduos Sólidos, previu que, dentre outros, constitui como seus objetivos a gestão integrada de resíduos sólidos4 e a articulação entre as diferentes esferas do poder público para a gestão desses serviços5.

Para tanto, a mesma lei previu a elaboração, em cada esfera de poder, de planos de resíduos sólidos6: (a) Plano Nacional; (b) planos estaduais; (c) planos microrregionais e planos de regiões metropolitanas ou aglomerações urbanas; (d) planos intermunicipais; (e) planos municipais de gestão integrada; e, por fim, (f) planos de

1. THE JURISDICTION OF MUNICIPALITIES The division of federative jurisdictions as set by the Brazilian Constitution involves a system that combines exclusive and privative competencies with common and competitive ones (SILVA, 2010, p. 477).

The general principle to guide the division of jurisdictions among the political entities that comprise the Federative State is the Prevalence of Interest: the Federal Government is responsible for matters of prevailing general interest, the States manage the matters of prevailing regional interest, and Municipalities are in charge of matters of local interest.

By considering this, the Constitution has assigned public sanitation services and solid waste management as activities under the jurisdiction of the three political entities of the Brazilian Federation: the Federal Government shall establish directives for these activities1; Municipalities are in charge of providing the services, as these are considered of “local interest”2; and finally, the States, which, at metropolitan areas, urban agglomerates and micro-regions, shall integrate the organization, planning and execution of the activities3. Let us emphasize that, in this case, the role of States in conurbation zones neither exempts – nor mitigates – the autonomy given by the Constitution to Municipalities on the matter.

Under this reasoning, therefore, we disagree with the understanding that States, under the context of metropolitan regions and, because of conurbation and the need to provide common services, may establish metropolitan regions and so remove or mitigate the jurisdictions inherent to autonomy of Municipalities.

2. INCENTIVES FOR INTER-MUNICIPAL CONSORTIUM MANAGEMENT Act 12,305/2015 – that established the National Solid Waste Policy – set forth as some of its goals the integrated management of solid waste4 and the coordination between the different public power entities towards management of these services5.
