The Right to Development offers a new idea, model, methodology and path for the implementation and protection of the right to development from the new perspective of the 2030 Agenda for Sustainable Development.

ISSN 2352-2593 brill.com/cphr

The series is a venue for books on European immigration and asylum law and policies where academics, policy makers, law practitioners and others look to find detailed analysis of this dynamic field. Works in the series will start from a European perspective. The increased cooperation within the European Union and the Council of Europe on matters related to immigration and asylum requires the publication of theoretical and empirical research. The series will contribute to well-informed policy debates by analyzing and interpreting the evolving European legislation and its effects on national law and policies.

The book assesses the EU Returns Directive against international human rights norms and standards. Izabella Majcher explores protection gaps in the EU return policy and highlights how the provisions of the Directive should be implemented in line with member states’ human rights obligations. Informed by this assessment, the book discusses draft amendments to the Directive, proposed by the European Commission in September 2018.

In 2012, the UK introduced the ‘Preventing Sexual Violence Initiative’. This work examines whether it is actually possible to prevent sexual violence being employed as a weapon of war against women, men and children. It assesses existing prevention strategies, uses Daesh as a case study – to illustrate the limitations of the current approaches – and considers additional measures. The author concludes that it is possible to prevent sexual violence in war, provided that all appropriate measures are harnessed and adapted to the specific circumstances of each conflict. It will, though, require improvements to existing strategies, the use of additional prevention measures, more resources and long-term engagement of all actors. This volume was awarded the 2017 first prize in EuroISME’s annual best thesis contest.

Theory and Practice of Public International Law Series Editor: Vincent Chetail

This rich and remarkable volume offers an overview of the most important schools, movements and trends which make up the theoretical landscape of contemporary international law, as well as the works of over 500 authors. It moves beyond generalization and examines how the relevant literature deals with the basic issues of the international legal system, such as international obligations, legitimacy, compliance, unity and universality, the rule of law, human rights, use of force and economics. It offers insights into the addressees (the state, international organizations, individuals and other private persons), and the construction of international law, including law-making, the relationship between norms, and interpretation. Moreover, it widens the discourse by addressing old, yet enduring, as well as new concerns about the functioning of the international legal system, and presents views of non-international lawyers and political scientists regarding that system. It is a valuable analysis for researchers, students, and practitioners.

Brill Research Perspectives in Family Law in a Global Society

Editor-in-Chief: Sanford N. Katz, Boston College Taking a national, comparative, or international perspective, Brill Research Perspectives in Family Law in a Global Society publishes long review articles addressing specific issues found in case law and statutory law that have an impact on the formation, maintenance, and termination of family relationships. At a time when family law has undergone a major transformation in most of the countries in the world, this publication fulfills the function of providing academics, practitioners, and policy-makers worldwide with information regarding the changes that have occurred and the approaches being taken in specific countries toward particular family law doctrines. As more and more individuals move from one country to the next either by choice or by necessity and form new family relationships with persons from other countries and cultures, there is a need for an understanding of the possible conflicts in family law that will govern their new relationships. This publication meets that need.

The Asia-Pacific Journal on Human Rights and the Law is the world’s only law journal offering scholars a forum in which to present comparative, international and national research dealing specifically with issues of law and human rights in the Asia-Pacific region. Neither a lobby group nor tied to any particular ideology, the Asia-Pacific Journal on Human Rights and the Law is a scientific journal dedicated to responding to the need for a periodical publication dealing with the legal challenges of human rights issues in one of the world’s most diverse and dynamic regions. The journal will be a prime source of information and reference not only to legal scholars and students but also to all those who are in any way involved in human rights issues across the whole of the Asia-Pacific region.

Brill Research Perspectives in Transnational Crime

European Journal of Health Law

Editor in Chief: Prof. Dr. Jannemieke Ouwerkerk, Institute of Criminal Law and Criminology, Leiden Law School, The Netherlands Crime, criminal law and criminal justice are no longer purely national issues in today’s Europe. Criminal conduct is becoming increasingly denationalised because offenders can easily cross borders and through the emergence of the Internet and cyberspace. It is also increasingly common for individuals either to face criminal proceedings or to become victims of crime in countries other than their own. Nevertheless, efforts to combat crime, and to safeguard the rights of victims, are still organised on a, by and large, national basis. These factors are driving the need for a better understanding of crime in Europe, as well as many important debates to which it gives rise. They include: how best to respond to crimes that affect more than one state; how to strike an appropriate balance between respect for national criminal justice traditions and the tendency to harmonise legislation and practice; and how to ensure that it is possible for suspects, offenders and victims to rely upon an adequate level of protection of their fundamental rights. European Journal of Migration and Law

Managing Editors: Paul Minderhoud and Sandra Mantu

Selection of Indexing and Abstracting: ArticleFirst, Current Contents, ERIH PLUS, Legal Collection, Scopus, Social Sciences Citation Index, Web of Science

The practice at the different international criminal tribunals has shown that there is no real international criminal (customary) law, but only extrapolations from international public law, general principles of law and humanitarian law. The divide between the so-called common law and civil law systems and their differences in approach to solving legal problems make it necessary to establish an international forum for discussion and development of a common ground on which the work of the international courts can build. This is especially true with regard to the so-called “General Part” of the substantive criminal law, like forms of participation, actus reus and mens rea categories, defences and excuses, offence types, sentencing, enforcement etc. But also the procedural law still lacks sharp features in many aspects; the ICC’s Rules of Procedure and Evidence are still in need of interpretation.

International Criminal Law Review

The European Journal of Migration and Law is a quarterly journal on migration law and policy with specific emphasis on the European Union, the Council of Europe and migration activities within the Organisation for Security and Cooperation in Europe. This journal differs from other migration journals by focusing on both the law and policy within the field of migration, as opposed to examining immigration and migration policies from a wholly sociological perspective. The Journal is the initiative of the Centre for Migration Law of the University of Nijmegen, in co-operation with the Brussels-based Migration Policy Group. It provides an invaluable source of information and a platform for discussion for government and public officials, academics, lawyers and NGOs interested in migration issues in the European context. Devoted exclusively to migration law and policy, the original research and analysis the Journal presents will emphasize the development of migration policies across 2017Europe.Impact Factor: 1.121 5 Year Impact Factor: 1.250

Global Responsibility to Protect

Focusing both on critical leadership and practical policy development, the articles in the preeminent International Journal of Children’s Rights reflect the perspectives of a broad range of disciplines and contribute to a greater understanding of children’s rights and their impact on the concept and development of childhood. The journal deploys the insights and methodologies of all relevant disciplines, including law, legal and political theory, psychology, psychiatry, educational theory, sociology, social administration and social work, health, social anthropology, economics, theology, and history to further children’s rights in all parts of the world.

The International Journal on Minority and Group Rights is devoted to interdisciplinary studies of the legal, political, economic and social problems which minorities and indigenous peoples face in all countries of the world. For the purposes of the Journal, groups are seen as clearly recognizable segments of society, defined by such relatively constant factors, as national or ethnic origin, religion, culture or language. Current developments, not least the spread of violent ethnic and religious conflicts, underline the need for a periodical publication dealing with the rights of persons belonging to minorities and indigenous peoples and of the groups themselves. The Journal pays special attention to the contribution which human rights standards and good governance guidelines can make to a better world for all. The Journal aims to become the primary forum for the discussion of the vitally important field of studies which it covers.

The International Human Rights Law Review is a bi-annual peer-reviewed journal. It aims to stimulate research and thinking on contemporary human rights issues, problems, challenges and policies. It is particularly interested in soliciting papers, whether in the legal domain or other social sciences, that are unique in their approach and which seek to address poignant concerns of our times. One of the principal aims of the journal is to provide an outlet to human rights scholars, practitioners and activists in the developing world who have something tangible to say about their experiences on the ground, or in order to discuss cases and practices that are generally inaccessible to European and North-American audiences. The Editorial Board and the publisher are keen to work hands-on with such contributors and to help find solutions where necessary to facilitate translation or language editing in respect of accepted articles. The journal is aimed at academics, students, government officials, human rights practitioners, and lawyers working in the area, as well as individuals and organisations interested in the areas of human rights law.

The Journal of International Peacekeeping is devoted to reporting upon and analyzing international peacekeeping with an emphasis upon legal and policy issues, but is not limited to these issues. Topics include inter alia peacekeeping, peace, war, conflict resolution, diplomacy, international law, international security, humanitarian relief, humanitarian law, and terrorism. The journal is of scholarly quality but is not narrowly theoretical. It provides the interested publicdiplomats, civil servants, politicians, the military, academics, journalists, and NGO employees - with an up-to-date source of information on peacekeeping, enabling them to keep abreast of the most important developments in the field. Peacekeeping is treated in a pragmatic light, seen as a form of international military cooperation for the preservation or restoration of international peace and security. Attention is focused not only on UN peacekeeping operations, but other missions as well.

Security and Human Rights Editor-in-Chief: Christophe Paulussen Executive Editor: Jennifer Pampolina Security and Human Rights (formerly Helsinki Monitor) is a quarterly, full Open Access journal devoted to issues inspired by the work and principles of the Organization for Security and Cooperation in Europe (OSCE). It looks at the challenge of building security through cooperation across the northern hemisphere, from Vancouver to Vladivostok, as well as how this experience can be applied to other parts of the world. It aims to stimulate thinking on the question of protecting and promoting human rights in a world faced with serious threats to security. The journal, founded in 1990 under the title Helsinki Monitor, is a legacy of the Helsinki process that was designed during the Cold War, to bridge Eastern and Western Europe on the basis of common principles and co-operative security. With its thorough analysis and thought-provoking articles, Security and Human Rights is a must-read for all those interested and involved in the OSCE and the process of guaranteeing security and protecting human rights. Readers will find a regular column, both short and long articles, a chronicle of OSCE events, as well as occasional book reviews and interviews.

The Journal tackles these issues fearlessly, and draws its materials from all relevant disciplines - theology, anthropology, history, international relations, human rights, religious studies, and many others - but with special emphasis on legal frameworks. It is an indispensable source for all those concerned with monitoring, studying, teaching, analysing or developing policies on the relationship between religion and human rights today.
