WE ROLLED OUT THE RED CARPET FOR SOME OF THE HOUSTON APARTMENT ASSOCIATIONS BEST AND I WANT TO KEEP THE CELEBRATION GOING AS WE WEATHER THE STORMS!

On June 27, HAA hosted the 2024 Honors Awards Ceremony! We recognized outstanding nominees and announced this year’s award winners. It was a night off from our industry that never sleeps, and we made time to celebrate hard work and dedication! It was very special, filled with changes, new additions, over 1,000 familiar faces and an energy in the room that could power up this city (which we all could use after Hurricane Beryl)! As president of HAA, I had the pleasure of hosting the Honors Awards alongside an “all-star cast” that included several HAA past presidents. It was my absolute pleasure to share the stage with predecessors that have been such an inspiration! Watching all members celebrate with and for one another was a priceless memory I will always cherish from this year.

Our industry truly never stops! Countless hours on site are spent inside leasing offices, outside walking properties, dealing with maintenance issues, supporting residents and leading teams to success. A lot of the hard work is performed behind the scenes, so on nights like the Honors Awards, we want to shout success from the rooftops to let the biggest association in the whole universe know just how valuable you are to HAA! This association has the best of the best, so even if you didn’t leave the night with an award, being nominated in such competitive categories is an achievement in and of itself. To the winners, a personal note from me … “You are some of the top professionals in our industry and we enjoyed celebrating you. Continue to go above and beyond and we will continue to watch you soar!”

RENT CONTROL

President Biden proposes a federal cap on rents.

LAST MONTH, President Joe Biden announced a series of proposals to address increasing housing costs, most notably a cap on rents.

The plan would require housing providers with 50 units or more to cap annual rent increases at 5% or risk losing an important federal tax deduction for depreciation.

The proposal states that beginning this year and for the next two years, corporate landlords would only be able to take advantage of faster depreciation write-offs available to owners of rental housing if they keep annual rent increases to no more than 5% each year.

Under the current tax code, residential rental property owners can depreciate a building’s value over 27.5 years, rather than 39 as for other types of commercial real estate.

This would apply to more than 20 million units across the country, which is nearly half of the available stock. It would include an exception for new construction and substantial renovation or rehabilitation.

A Wall Street Journal Op-Ed opposing the President’s plan states, “It would reduce and could even eliminate the return on rental housing investments, especially since inflation has driven up insurance, construction and maintenance costs. Investors will have to pay higher taxes or accept a lower return. The Administration wants to increase subsidies for affordable housing even as it promotes policies to make

such projects less financially attractive.”

The President’s plan is NOT in effect now and would require Congressional approval, which is unlikely prior to the election and with a divided Congress. This is, however, an indication of future policies that he would push forward if he wins reelection.

In addition, the President has called for the repurposing of public lands by the Federal Government and state and local governments to build more affordable housing.

In an effort to sway Nevada voters, he announced that the Bureau of Land Management is considering the sale of 562.5 acres of public lands in the Las Vegas Valley that could support the building of up to 15,000 or more additional affordable rental and homeownership units.

The Federal Government is the largest landholder in the country, and state and local governments, as well as entities like transit agencies, school districts, public utilities and faith-based institutions, own considerable amounts of land that are underutilized and may be used in ways that better reflect local priorities and housing needs.

Recent analysis from the Center for Geospatial Solutions at the Lincoln Institute of Land Policy estimates the development potential of underutilized state and local government land located near transit at approximately 1.9 million units nationwide.

FHFA Announces Multifamily Tenant Protections

Also last month, the Federal Housing Finance Agency (FHFA) announced a set of required tenant protections for multifamily properties financed by Fannie Mae and Freddie Mac. Covered housing providers will be required to provide tenants with the following:

• 30-day written notice of a rent increase

• 30-day written notice of a lease expiration

• 5-day grace period for rent payments

Fannie Mae and Freddie Mac will monitor and enforce the tenant protections and failure to comply could result in penalties under the loan agreement. These protections will be required for new loans signed on or after the policy effective date, February 28, 2025.

A detailed description of the tenant protection policies is expected to be published later this month.

Fannie Mae and Freddie Mac have financed an average of 1.2 million multifamily rental units over the past three years.

HURRICANE SEASON IS DEFINITELY HERE

Hopefully, this checklist can help.

AT PRESS TIME, we are still dealing with the damage and power issues from Beryl, along with an emergency order issued by the Texas Supreme Court. With more storms projected for the hurricane season, will you be ready for this again?

Although a number of things must be done before, during and after a storm hits, it’s a good idea to take note of what must be done after a hurricane hits in order to determine what should be done before a hurricane. In short, what can we do now that will help us prepare for later?

Unfortunately, Beryl has offered some pointers. Hopefully this checklist helps, too.

Who is in charge?

• Is there a contact number for all employees to check in and announce their availability?

• What employees of the owner or management company will make decisions?

• Is there a hierarchy of persons to make decisions so that if one person isn’t available, the next person will take charge?

Evaluate damage to the property and units.

• What has to be done?

• What vendors will need to be used to evaluate damage?

• Does the property have power?

• What materials, supplies and labor will be required to repair the property?

• How quickly can vendors get to the property?

• How much will vendors charge when they come to the property?

Determine the habitability of units.

• What is the damage at the property?

• Are units habitable?

• How long will it take to repair the damage?

• Can residents continue to occupy units during the time that repairs are made?

Determine status of leases.

• Pursuant to section 92.054(b) of the Texas Property Code, if after a casualty loss the rental premises are as a practical matter totally unusable for residential purposes, either the landlord or the tenant may terminate the lease by giving a written notice to the other any time before the repairs are completed.

• Section 16 of the TAA lease provides that if, in the owner’s sole judgment, damages to the unit or building are significant or performance of needed repairs poses a danger to the resident, the owner may terminate the lease and the resident’s right to possession by giving the resident at least 7 days written notice.

Determine the status of rent obligations.

• Pursuant to Section 92.054(c) of the Texas Property Code, if after a casualty loss, the rental premises are partially unusable for residential purposes, the resident is entitled to a reduction in the rent in an amount proportionate to the extent the premises are unusable because of the casualty, but only on judgment of a county or district court. However, an owner and resident may agree otherwise in the lease.

• Section 16 of the TAA lease provides that if the lease is terminated due to damage to the building or repairs needed pose a danger to the resident, the owner is required to refund prorated rent and all deposits, minus lawful deductions, through the termination date.

• Pursuant to section 3 of the lease, the resident cannot withhold or offset rent unless authorized by law.

Determine the status of the resident’s ability to remove items from the unit.

• The resident is going to want to know

whether, and to what extent, the resident can enter the unit after the storm passes by to remove personal property.

• Are the residents able to safely enter the unit to remove personal property?

• Do the residents need an escort to safely enter and remove personal property from the unit?

• What arrangements need to be made for residents to safely retrieve salvageable property?

• Pursuant to section 16 of the lease, the owner may remove the resident’s personal property if, in the owner’s sole judgment, the property causes a health or safety hazard or impedes the owner’s ability to make repairs.

• If the lease is terminated, the resident will be required to remove the property as of the termination date, unless other arrangements are made.

Determine how you will communicate with residents.

• Picture a world in which residents are not in their units or at the property. They have left. Knocking on doors and posting notices on doors may not be the best way to communicate with residents.

• Pursuant to section 21.1 of the lease, notice may be given electronically by the owner to the resident if allowed by law. The resident represents that the resident has provided the owner with the resident’s current email address and that the resident is responsible for notifying the owner if the email address changes.

• Be prepared to communicate by email. Residents may disperse when the storm comes through and the best way to get ahold of residents may be by email.

• You might want to have the cellphones of residents handy. You may want to communicate with residents by cell phone or text.

Determine how much time you will have to make repairs.

• Section 92.056(b)(4) provides that a landlord has a reasonable time to repair or remedy conditions after the landlord receives the tenant’s notice of the condition. However, Section 92.056(d) provides that, in determining whether a period of time is a reasonable time to repair or remedy a condition, there is a rebuttable presumption that 7 days is a reasonable time. However, to rebut that presumption, the date on which the landlord receives the tenant’s notice, the severity and nature of the condition, and the reasonable availability of materials and labor and of utilities from a utility company must be considered.

• Pursuant to Section 92.054(a), if a condition results from an insured casualty loss, the period for repair does not begin until the owner receives the insurance proceeds.

• Pursuant to Section 15.4 of the Lease, the owner agrees to act with customary diligence to make repairs and reconnections within a reasonable time, taking into consideration when casualty- insurance proceeds are received. A “reasonable time” accounts for the severity and nature of the problem and the reasonable availability of materials, labor and utilities.

Determine the status of pending evictions and court proceedings. Be prepared for changes and delays.

• Already this year we have seen operations in justice courts disrupted by a derecho and a hurricane. We have even seen the Supreme Court of Texas issue an Emergency Order which authorized extending deadlines and timelines related to justice court proceedings, including evictions.

• Do you have any pending eviction cases? Do you plan to file any new cases?

• Do you know how to obtain up-to-date information regarding possible court closures or other practical impacts on courtroom operations? This could include knowing the contact information for the court clerk and knowing how to check websites or social media accounts for the justice court, county court, and other official county agencies.

• Do you know how to access court records online so that you can monitor the status of your case and be prepared to adjust to any changes?

• Do you know how to contact your local constable’s office to check on the status of a pending Writ of Possession?

Other issues to consider.

• Do you have a list of vendors that you can call to estimate damages and make repairs?

• Do you have insurance to cover damages?

• Do you have funds set aside to pay any deductible (deductibles for named storms can be pretty hefty)?

• Do you have someone to call if you have issues dealing with media requests?

Although you can’t prevent storms from occurring, you can be as prepared as possible with respect to the issues that may affect your communities and residents. The goal is to make any recovery process go as smoothly as possible to minimize the time in which you and your residents can get back to a sense of normalcy. Good luck!

LOST IN TRANSLATION

An evicted resident claimed she did not receive a notice to vacate.

A RESIDENT FILED a complaint with the Houston Apartment Association to dispute charges, receive an apology and to have an eviction removed from her credit report. Enclosed were copies of the resident ledger, lease and final account statement. The resident claimed that management did not accept her month to month rent deposits and evicted her from her apartment. After eviction, the resident received a final account statement showing that she owed the property $3,860.98.

HAA reached out to the apartment property and passed along the information and that response was forwarded to the resident. Enclosed in the management’s response were copies of the application, lease, resident ledger and final

account statement. Management stated that the resident received several letters and notices to vacate regarding her overdue account statement before she was evicted from her unit. Management also provided copies of the past due and notice to vacate letters that were sent to the resident.

The case was heard during a Resident Relations Committee meeting where the committee decided in favor of management. The committee decided that the charges were justified and that the resident owed the property $3,860.98.

The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the

resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

The HAA Honors Awards recognizes members for their commitment to their communities and the apartment industry. Here is the first group of 2024 Houston Apartment Association Honors Award recipients.

Owner/Management Executive of the Year

Stephanie Graves, CAM, CAPS, IROP Q10 Property Advisors

Stephanie Graves is CEO of Q10 Property Advisors and was HAA’s 2023 President. Stephanie served as a vice president-atlarge for HAA from 2019 to 2020. She has served on the HAA Board of Directors for more than 10 years and is a graduate from the HAA and Texas Apartment Association Leadership Lyceum programs. She also served as a National Apartment Association delegate, and the HAA Strategic Outreach Committee.

In 2015, Stephanie started her own company, Q10 Property Advisors, with partner Ginger Bernstein, who has since retired. In July of 2015, they acquired a 276-unit community and today, Q10 manages 7,853 units. At the ceremony, Stephanie had this to say, “You know, we work hard for other people (in this industry). I love seeing everybody nominated. It's such a huge honor and you know it's icing on the cake for everything that HAA is and I just appreciate it, to see my peers and to know that they appreciate it.”

Portfolio Supervisor of the Year

“I’d like to thank my Q10 team … my team's amazing. We've grown a great deal. This has been the hardest five years … we've ever been through and they have worked so hard. So I just very much appreciate it.”

Stephanie is a sought-after speaker for the apartment industry nationwide. She has spoken for the TAA and NAA conferences on multiple occasions, and she is recognized as an NAA Education Faculty member. She is an active volunteer instructor for the Houston Apartment Foundation and Education Committee leader.

Stephanie was recognized in 2009 and 2011 as Marketing Director of the Year and in 2019 for Executive of the Year. TAA selected her as MVP Volunteer of 2022 for her leadership as the TAA Lyceum chair.

She is an entrepreneur, a business owner, started a non-profit, built a Montessori preschool, is an avid poker player and is a mother to an amazing daughter, ‘Smilin’ Rilynn.

Jennifer Ramos, CAPS, CAM, CAS Vidalta Life

Jennifer Ramos is regional supervisor for the Houston region for Vidalta Life. Jennifer has been in the multifamily industry for 16 years and with Vidalta for one year.

Vidalta’s Andrea Castro stated, “Jennifer was enlisted to assist in the restructuring of a struggling and destabilized portfolio. She assumed responsibility for three properties, all grappling with issues such as low occupancy rates, outstanding debts, maintenance issues, high employee turnover and low resident satisfaction. …”

“Under Jennifer’s guidance, Grand Palms underwent a remarkable transformation. They successfully eliminated stagnant units, diligently managed make-ready processes, controlled work orders effectively and boosted their occupancy from 83.7% to an impressive 94.2%. … Similarly, Champions Centre faced comparable challenges but

managed to weather the storm. Their occupancy surged from 69.3% to a commendable 90.6%, reflecting a significant 21.3% improvement.”

“Renewal rates across the portfolio soared from and average of 15-20% to an impressive 45-76%. Within a span of eight months, the properties witnessed a remarkable decrease in employee turnover and significant improvements in occupancy rates, debt management, maintenance efficiency and resident satisfaction. Jennifer’s strategic acumen and unwavering commitment to delivering results have been instrumental in this success story.”

Jennifer is also an active industry volunteer, a credential facilitator for HAA, an NAAEI Faculty member and a Leadership Lyceum graduate.

Corporate Support Professional of the Year

Emily Frost, SYNC Residential

Emily Frost is the talent acquisition specialist for SYNC Residential, “I am the recruiter for our entire company, not just in Houston, but all of it,” with a portfolio of more than 7,074 units.

Emily has been in the industry for six years and with SYNC Residential for four years.

“I fell into the apartment industry. I feel like that's what a lot of people do. I knew someone who referred me to the industry, worked my way through a vendor referral and have been here ever since.”

SYNC’s Danasha Richard stated that, “Emily has had a strategic approach to recruitment and effective candidate sourcing. She has a strong focus on candidate experience and commitment to diversity and inclusion. She has made significant contributions to talent acquisition within the organization.”

“Emily doesn’t just stop at recruitment, we can always count on her to assist in all other areas of our company. If it is helping plan company events, schedule training or even helping onsite when we are short staffed. Emily truly embodies all of our core values at SYNC. We are very blessed to have her as a part of our team and glad that she is the first person our new team members get to meet.”

Emily’s awards with SYNC include being the Spotlight Employee of the Month March 2021 and Corporate Employee of the Year 2021, and received the SYNC Excellence 2022.

Emily is an active volunteer. She is a HAA NEXT and Expo Committee member and was selected for the HAA Forty Under 40 Class of 2022. She is currently a HAA Leadership Lyceum candidate. Outside of HAA, Emily is a member of the Junior League of Houston.

Manager of the Year, 1 to 199 units

Judy Molina, Mosaic Residential

Judy Molina is a property manager for Mosaic Residential’s Del Sol Apartments, a 152 unit property built in 1979. She has been in the apartment industry eight years and with Mosaic for two years.

Judy accepted the challenge to manage and lead the team for a vintage 1979 asset as a first time property manager when Mosaic acquired the property. She lead the team to overcome high turnover, high delinquencies, inherited serious city required repairs and much more.

Mosaic’s Velissa Parmer said, “She led her team to achieve an average occupancy of 95.1%, average bad debt of 0% (ZERO y’all) after she inherited over 5%. She increased revenue 8.8% largely due to a $35.6K or 26.4% decrease in Total Rental Losses and a $32.6K decrease in Total Bad Debt. The closest reporting month with 0.4% delinquency on average and Controllable Net Operating income increased $348K or 34.3% year over year as of December 31, 2023.”

Velissa continues, “Judy’s leadership ability, professionalism and performance management ability makes her quite a power-house, results driven leader. While Judy leads with heart, she is downright masterful at training others, providing clear direction and motivating them to achieve or exceed the desired results. This and she is always willing to help sister properties.”

“She also had two of the three team members that reported to her get promoted. She is an amazing first time property manager and leader.”

Prior to her promotion to property manager, Judy was recognized by her company as Assistant Manager of the Year for an asset over 500 units.

Judy stated after winning her award, “Thank you to all of Mosaic Residential who believed in me and who gave me the chance.”

Assistant Manager of the Year Chelsie Simpson, CAM, Q10 Property Advisors

Chelsie Simpson is now a property manager for a tax-credit property, but was nominated and received her award for her previous position as assistant manager for Q10 Property Advisors’ Montebello Gardens and Bella Capri, properties with a total of 155 units.

Chelsie was recruited into the multifamily industry while looking for an apartment, “The manager at the time liked my personality. So, she asked if I was interested in leasing. I said yes. It came with a free apartment, so I couldn't pass it up. Six months later I was an assistant manager and I've never looked back. I've been in the industry for eight years.”

How did she get where she is in her career? “Amazing leadership, asking questions, always wanting to learn more, never stopping,” Chelsie responded.

Q10’s Emily Gaal stated, “Chelsie makes an immediate positive impact on each property she has helped and always rises to the challenge! At her previous community, she was able to assist with turning struggling assets around by helping to increase total income form $400K to $540K through her collections efforts and leasing expertise. She has also become our expert on evictions after assisting with over 200 in her communities and we cannot wait to see her excel more!”

Chelsie has earned her Certified Apartment Manager credential and has attended numerous HAA educational offerings.

She has taken part in the HAA Food Drive and looks forward to continuing her participation.

Marketing/Training Director of the Year
Emily Jones, CAPS, CAM, Advenir Living

Emily Jones is the regional marketing manager for Advenir Living and oversees their portfolio marketing spending and assists with different aspects of marketing and systems. The Advenir Living portfolio includes 7,833 units.

She has been in the industry for eight years and with Advenir Living for one year and holds an MBA.

When asked, how did you get your first job in the apartment industry? Emily said, “I was going to Texas State and I was looking for a job where I could do my homework and it just fell into my lap.”

“I got engulfed and just fell in love with the industry.”

Emily was a member of the 2022 Class of the HAA Forty Under 40, served on the HAA Expo Committee and is a member of the HAA NEXT young professionals group. Emily stated, “… my love for the industry has always run deep and there have been times where I put my job before my personal life. … I’d like to thank my spouse and my baby girl and just everyone who's been along my journey.”

Emily mentors on-site team members on best marketing practices and takes teaching leasing skills to a new level that incorporates the leasing professional personality type to ensure a successful closing ratio.

Manager of the Year,

200 to 299 units Amber Tristan, CAM, Francis Property Management

Amber Tristan is the property manager at the 243 unit Midtown Arbor Place for Francis Property Management. She has been in the apartment industry for 11 years and at her current property for two years.

When asked how she became involved in the multifamily industry, Amber said, “My mom, she started me off when I was 11 years old, filing papers. Then at 16, allowed me to answer phones and start showing apartments.”

When asked how she arrived at where she is now, Amber stated, with “great mentors at Francis. I love them so much I couldn’t do it without them.”

Francis’ Jennifer Whiteman says that “Amber is always available to help. As a new manager, she volunteered to manage two of FPM’s sister sites as well as her own during staff shortages.”

“She was instrumental in organizing the 2022 and 2023 employee HAA events, including organizing our HAA Volleyball team, comanaging the HAA Maintenance Appreciation attendees, All Stars Sports Challenge team and planning the FPM company Christmas Party for more than 100 employees. She attends and maintains a Blue Star status for her communities as well.”

Amber has been a member of the HAA NEXT young professionals group for eight years and currently serves as a committee member.

When asked who she would like to thank, she said, “all my mentors, from Jennifer Whiteman to Debbie Sulzer to Chris Palacios and Wallace Reed. I am so happy and love them for teaching me and encouraging me to grow and love what I do.”

Manager of the Year, 300 to 399 units Jessica Wheeler, CAM, CAPS Greystar

Jessica Wheeler was promoted to regional manager, but was nominated and received the award as onsite manager for Greystar’s The Westcott, a 315 unit property built two years ago.

Jessica has been in the multifamily industry for 15 years and with The Westcott for less than a year.

She began her career in leasing, “How did I get my first job? I was a young 20 year old who was looking for a discount on rent and I decided to be a leasing agent and the rest is history.”

“I got where I am now by being supported by amazing people and falling in love with the industry as a whole …”

Her property has an occupancy of 93% with a delinquency of less than 1% of the monthly billing amount of $1,088,684.

Jessica has assisted in the successful sale of three communities, finalized lease ups at

three communities and has managed various product types. Jessica transitioned one community to the PFC program and has successfully assisted several other communities onboard and train for the program. Nine employees report to Jessica and there have been multiple promotions of employees that have worked under her, as leadership and motor skills are a priority.

Jessica received the 2011 Manager of the Year award, the 2016 Profitability Award and the 2021 Professionalism Award.

Jessica is currently the chair of the HAA Resident Relations Committee. Her advice to her peers, “Be involved in HAA as much as possible, whether that’s networking at events or volunteering on a committee. Taking part and making those connections is instrumental to your career.”

Patti Melendy, CAM, Asset Living

Patti Melendy is property manager for Asset Living’s 2828 Royal Oaks, a 510 unit property built in 1995.

Patti has been a member of the apartment industry for 34 years and with her current property three years.

Asset Living’s Karen Hefner had this to say about Melendy, “Patti is a rockstar in our company, winning numerous awards for performance, Internal Manager of the Year several times, and in addition, her community won HAA’s Property of the Year award last year for 2022 performance. Leasing Professional of the Year

Helen Barnes is a leasing professional for Venterra Realty.

Helen joined Venterra in late 2022 and quickly proved to be a leasing superstar by achieving Tier 1 in less than two months.

With a positive, charismatic personality, she is always willing to learn. She not only earned her Certified Apartment Leasing Professional credential, she also became a Better Living Consultant mentor this past year, welcoming Venterra’s new consultants and providing training and support in their role.

Venterra’s Christina Montalvo stated in her nomination of Barnes that Helen exemplifies a “Team First” spirit and is always willing to stay late or come in early to help and get the job done. Ranked four out of 112, Helen completed 327 tours and had a 34% closing ratio in 2023.

Ramon M. Nunez is a native Houstonian and the CEO and managing director of Bravo Capital Management LLC and has been a part of the multifamily industry since 2015.

This is the third time Ramon has won this award, he also won in 2020 and 2022. He was also the recipient of the Texas Apartment Association Bob Ross Independent Owner of the Year award in 2023 and was the National Apartment Association Independent Rental Owner of the Year winner in 2022.

Ramon received his Independent Rental Owner Program credential in 2019 and his Certified Apartment Manager credential in 2017. His properties are Houston Police Department Blue Star Certified. Ramon also was a volunteer for the HAA delegation for the TAA Day at the Capitol in 2017, 2019 and 2023.

Ramon is a graduate of Milby High School and received a Bachelor of Science in IT from the University of Houston. From 2009 to 2012 he was a contractor for Kellogg Brown and Root in Mosul, Iraq, supporting the U.S. Department of Defense.

When asked how he became involved in the apartment industry in an interview with ABODE in 2023, Ramon said, “In 2015, my wife and I discovered a real estate group in Houston called Lifestyles Unlimited. In this organization, we learned how to purchase single-family and multifamily properties. We started our journey to build a real estate business and leave a legacy for our future family.”

“Entrepreneurship was always in our blood. I always wanted to be a business owner, entrepreneur and executive leading the charge in my own company. Our family instilled in us an entrepreneurial mindset and skills throughout our lives. When those skills were combined with our past work history, we found an industry that complemented our mission, talents, and abilities to be successful.”

The top 10 techniques and how to deflect them.

Par t 2: 10 Negotiating Techniques

In our first article, we looked at building the skills necessary to improve your ability to negotiate well with your client. There were six tips that will help you be even more successful. Now we want to learn how to recognize and respond to the techniques our clients often use to either not negotiate at all or fail to collaborate on a mutually beneficial solution. These come very naturally to all of us and sometimes our clients don’t even realize they are losing the chance to engage in the conversation.

Stay focused on growing a long-term partnership and adding value. Always! So, let’s look at these techniques and how to respond to our owner manager partner.

Tactic 1: The Wince

The wince is an overt negative reaction to an offer. It might be a facial expression of pain, or hand to the forehead. Wincing is not bad – it could save the client money.|

Your Response: Go on to the next technique – in other words, pause and move on. Be gracious, smile.

Tactic 2: Silence

The other party says nothing, no other indication of response.

Your Response: Restate your offer, don’t expand on it and fall silent too. Be gracious even smiling, but not smug. Remember, almost without fail, the first person who speaks whittles away at their own deal.

Good Guy-Bad Guy

This is where you are met with two negotiators and they play the team approach to get you to better the offer (in the movies it’s meant to trigger a confession) or listen in on their sidebar conversation about the deal.

Your Response: Unlike the movies, your best move is to ignore it. Don’t let the good guy (your deal advocate) influence your offer. Stay focused on adding the value you already presented.

Tactic 4: Limited Authority

This is like the good guy, bad guy, but you’re dealing with only one person. The “other guy” who apparently has the authority isn’t there.

Your Response: This limited authority may in fact be true. But don’t assume the decision is out of his or her hands. Either ask to speak with this other person or explore the limits of the client in front of you – you may get what you want.

Tactic 5: The Red Herring

This tactic goes back to fox hunting days where one team tosses a red herring to distract the foxes from the real prey. In bargaining, it’s a minor point that the party brings up to distract or delay from the main point or deal.

Your Response: Be careful. This is a sly tactic, but could really be true. If the client won’t budge until this minor point is resolved or addressed, use extreme caution about trying to move forward. If you can, suggest that you set it aside and talk about the rest of the product or service, if possible.

Tactic 6: The Trial Balloon

This is a way to give you an inkling of a possible deal without committing to a deal. For example, “would you consider deploying your product on a temporary basis or at one of our locations.” Another example might be “We’re looking at other alternatives as wel.l” Your Response: In most cases, this is a good sign of willingness to beta test. But, be sure to nail down parameters: Where? How long is “temporary?” What criteria will be used for decision-making? In other words, be appreciative and welcoming but focus on the logistics. Don’t be so overjoyed at the potential business that you skip details.

Never forget your role as an industry partner. Stay focused on shared values and mutual success –it is there for both supplier and owner manager.

Tactic 7: Low-Balling

This is the opposite of a trial balloon. Here the client is ready to do the deal – at least try the deal – you say yes and then all the “extras” to make the deal work for the client come back at you.

Your Response: After the client offers to do the deal or test the deal, thank them and get a handle on what exactly needs to be addressed to make your deal shine and the client feel well served. Pitch this as a roll-out checklist to ensure all of the client’s boxes are checked. Remember, it’s for them!

Tactic 8: Bait and Switch

Similar to low-balling, the test run or other offer is made, looks good, but in ironing out details and costs, the client decides to sub out another deal or a lesser footprint. You got yourself ready for one opportunity and the client changes the offer later.

Your Response: This may be an honest reaction as you get into the deal itself. It could be the client really wanted to offer the switch deal in the first place and didn’t know how to go about it. Continue to ask even more questions about the second location or substitute deployment. If possible, refine the trial period to be shorter or more intense and then get a commitment to next steps.

Tactic 9: Outrageous Behavior

This sounds pretty bad and it is. This might be some sort of inappropriate, or loud or disruptive behavior (like a “Wince” on steroids) that makes you uncomfortable or concerned enough that you are willing to revise, accommodate, reduce and/or alter your original planned deal.

Your Response: This is a strange tactic, but not unheard of. If this plays out, the best response is none at all. Let it play and without you being condescending. If you react or respond with adjusting terms of the original offer, you lose your negotiating power.

Tactic 10: The Written Word

When terms are written out, they frequently seem non-negotiable. This can work for you or against you.

Your Response: The best tactic is to question everything. If you read something and it seems disagreeable, ask about it or note it. It never hurts to ask.

So, there it is – some helpful tips and techniques to use when negotiating. Maybe you’ve noticed – these will also work with family members, friends and other acquaintances.

Never forget your role as an industry partner. Stay focused on shared values and mutual success – it is there for both supplier and owner manager.
