Letter from the President

HAA MEMBERS, IT IS A PRIVILEGE TO BE SERVING YOU DURING THIS HISTORY-MAKING TIME WE ARE IN RIGHT NOW. The lessons and experiences we are going through right now will be passed onto our future generations. And, if there’s anything we have learned over the last couple of years, it’s that we have to keep going, growing and adapting. We have to embrace that COVID-19 and all the variants are here to stay. There is no going back to normal, there’s only moving forward. We have to remain open to the fact that things are going to continue to change. We have to continue to adapt, overcome challenges and modify the way we do everything. We have to lead through the changes. The challenges brought on by the pandemic forced a lot of growth opportunities in many leaders and organizations. And a lot of really great leaders and processes have emerged because of it. Leading through change isn’t just about finding new processes. It’s about supporting employees through the emotional ups and downs. While we can expect change to continue to be the constant in 2022, there are a few things we can expect to remain the same: supply chain issues and inflation will continue to impact every area of the industry. We can also expect it to be an interesting year for local politics, too. Already, there has been significant turnover with justices of the peace and among our state legislators. We are losing a lot of institutional knowledge in the region and it will be imperative for HAA to fill in the gaps on industry needs. This underscores the importance of being involved with the HAAPAC this year. Political advocacy is one of the most important services we offer to members. We are stronger when we mobilize together, and I encourage you to become more politically engaged in 2022. In 2022, let’s remember that we are surrounded by the best people who have the best intentions. Let’s trust our teams and lead our teams through the changes. If we can do that, it will be a great year.

THE END OF RENTAL ASSISTANCE? State and local programs pause for lack of funding.

HAPPY NEW YEAR! As the Houston Apartment Association’s secretary/treasurer, I get to work with the HAA staff on the ABODE magazine’s Legislative Update in 2022. I have a passion for education, and in recent years, I’ve learned how important legislation is to our industry, our personal careers and livelihood. So, I’m really excited to use this platform to educate our members on industry legislation. With that, this column may be a little different this year. First, I want this column to serve as an educational arena for you to understand how you can help protect our industry against bad legislation. Second, I will work on offering opportunities for each of you to get involved in the legislative and lobbying process. Finally, I will work to make this sometimes-complicated information easy to understand to empower you to get involved and get educated on how you can protect this industry, our jobs and, truly, our way of life. I will touch on this more in the February column, but for now, read on for important updates that impact our industry and association. State and Local Rental Assistance In all honesty, toward the end of 2021, it was becoming harder and harder to pretend that COVID-19 rent relief programs really had anything to do with COVID-19. The economy was strong – especially in the Houston area – with unemployment near all-time lows and employers begging for workers. Even as worries continued about the omicron variant, hospitalizations for COVID-19 continued to fall. Somehow, though, the demand for rental

assistance never seemed to let up. WHAT’S NEW IN ’22? Learn everything you need to know going into 2022.

WHO CAN PREDICT the future? Who would’ve thought that at the end of 2021, we would still be dealing with COVID19? Who would’ve thought that rental assistance would affect our eviction process? Who would’ve thought that rental assistance was necessary when every business needs employees? Who would’ve thought that the Texans would have a bad season? (Well, some things may actually be predictable!) It’s always helpful to prepare for the future. As we embark on 2022, let’s take a look at some legal issues that may affect your operations this year. Remote Judicial Proceedings In the 45th emergency order issued by the Supreme Court of Texas, the court continues the pattern and practice of authorizing courts to allow or require anyone involved in any hearing, deposition or any other proceeding of any kind to participate remotely, such as teleconferencing, video conferencing or other means. Although the court’s order expires February 1, 2022, the remote hearing option has been fairly well received by lawyers, their clients and, to a lesser extent, judges. Chances are remote proceedings will live past the pandemic. How can we plan for this? Before you go to an eviction proceeding, you’ll need to be prepared to know: (i) whether or not the proceeding is in person or remote; (ii) if it’s remote, that you are able to access the appropriate technology; (iii) how to present evidence and witnesses to the court; (iv) and that your witnesses are able to access the applicable technology. The Eviction Delays The Texas Rules of Civil Procedure provide that the trial in an eviction case must not be less than 10 days nor more than 21 days after the petition is filed. pending application for rental assistance or whether both the owner and resident are interested in participating in a rental assistance program. If either is the case, the court is required to immediately abate the eviction for 60 days and will reinstate the eviction only if a motion for reinstatement is made indicating that the application for rental assistance has been denied, cancelled or withdrawn. If the case is not reinstated within the 60day abatement period, the court is required to dismiss the case with prejudice. This means that the eviction action (based on the same defaults) can’t be brought again. The 44th emergency order expires January 1, 2022. In light of the evaporation of rental assistance funds, it would appear that the court would not extend this portion of its order. If the order is not extended, the justice courts may no longer be involved in rental assistance programs. Legal Aid The 45th emergency order provides that at the trial, the Justice of the Peace must allow, if available, representatives from legal aid organizations or volunteer legal services, to be present, in person or remotely, to provide in-

formation, advice, intake, or other assistance for eligible litigants. Although this emergency order expires January 1, 2022, this or something like it may extend beyond the pandemic. Flood Disclosure As you should be aware, a new law was passed in the last regular legislative session which requires owners to make certain disclosures regarding floods that have affected their property. The new law requires owners to disclose whether the property is located in a 100-year flood plain and whether they are aware that the dwelling the resident is renting has flooded at least once within the last 5 years. The law applies to a lease entered into or renewed on or after January 1, 2022. Consequently, if you sign the lease on or after January 1, 2022, the flood disclosure notice should be given at or before the execution of the lease. If you have a lease that is renewing on a month-to-month basis, the flood disclosure notice should be given at or before the 1st renewal that occurs on or after January 1, 2022. Be prepared to give the flood disclosure to any residents who sign or renew leases on or after the beginning of the year.

New TAA Lease As you may be aware, the TAA is coming out with a new lease. The new lease is scheduled to available in the middle of February 2022, and it will look a little different than the old lease. The lease is a little shorter (six pages instead of eight pages) and contains most of the lease details (with the blanks that have to be filled in) on the first page.In the new lease, much of the content is the same. It still has many of our favorite paragraphs as the old lease, although they will be in different places in the new lease. You will need to be familiar with where your favorite paragraphs are located so you can answer questions from residents, point out provisions to judges and be able to identify the parties’ rights and responsibilities to resolve a particular issue or circumstance. For example, the rent paragraph is no longer paragraph 6. The rent provisions are paragraph 3. The conduct provisions are no longer in paragraph 20. They are in paragraph 11. The default paragraph is no longer paragraph 32. The default provisions are in paragraph 23. One of the changes is that the early termination option which was previously / See Law, Page 59

the Houston Apartment Association to receive a refund on her security deposit. In her complaint, the resident questioned management replacing the carpet when she only lived in the unit for two years. In addition, the resident claimed she left the unit clean and felt she shouldn’t have been charged for cleaning charges. Upon signing her lease, the resident paid a $300 security deposit. To cover the carpet replacement and cleaning, management used the resident’s full security depost. Management’s reponse to HAA was forwarded to the resident. Ultimately, management felt the resident was charged accordingly.

Learning to listen and respond specifically to the customer, handling objections and meaningful ways to close the sale are the essential duties learned. The course closes with a personal assessment of sales readiness. A Deep Heart for HAA

a versatile multifamily real estate executive with a firm commitment to excellence. She is the director of real estate for Judwin Properties, a leading family-owned apartment management company based here in Houston that has been in operation for 58 years. She pours her heart into what she believes in and has the power to influence positive change in companies, projects and people. And she uses that power often. As many of her own mentors have said, it’s her versatility that makes her a great teammate and leader. “Christy is incredibly dedicated to the industry and association. She is a tenacious professional, always striving to be the best and outperform previous records,” HAA CEO Casey Morgan said. Over the last couple of years, Rodriguez has been largely influential in helping HAA navigate the disruptive changes brought on by the pandemic for the organization to best serve its members. “I enjoy working with Christy because she understands the big picture. She’s not easily distracted with minor challenges as long as we remain focused on our mission – what really matter to members. She is able to prioritize and create goaloriented tasks so that we achieve real results for the membership,” Morgan said. As a versatile leader, Rodriguez can be counted on in any critical situation to succeed and she can manage competing priorities. As a Harvard Business Review article titled “The Best Leaders Are Versatile Ones” reads, the last couple of years have amplified the need for versatile leaders, because versatility allows leaders to read and respond to change. This couldn’t be truer for HAA’s 2022 president. “To me, her value is that she can do anything. If you put her in front of anything, you can have the confidence that she’s going to lead it and succeed,” 2020 HAA Past President Clay Hicks, and president of The Dinerstein Companies, said. During a financially distressing time for most organizations, Rodriguez was instrumental in navigating HAA’s financial health as the organization’s secretary/treasurer in 2020. In the words of HAA Immediate Past President John Boriack, it was a monumental task. “I was fortunate to have her as treasurer during my presidency because HAA’s finances were, of course, a huge challenge during COVID-19. All I had to do was ask her to dig into the financials to help me figure out what was going on. She went above and beyond in determining HAA’s financial health and in figuring out what we had so that we could make big decisions off information that we understood,” Hicks said. January 2022

Rodriguez assisted HAA through a technical challenge created by the pandemic, but she was also a much-needed encouraging voice to the HAA staff during her time serving on the HAA Executive Committee in 2020 as secretary/ treasurer and in 2021 as president-elect. Although Rodriguez is truly a force characterized by curiosity and discipline, she is also extremely extroverted, kind, thoughtful, positive and fun. It’s the culmination of these traits that make her sparkle when she speaks or even when she enters a room. It’s what has made her a standout in her

career and in her association involvement. “On a personal level, Christy is one of the most approachable people I’ve met in a professional environment. She never meets a stranger and is very inclusive. Christy can light up any room – even if it’s a room full of members working on not-so-riveting material, like the budget or our financials,” Morgan said. Everyone who meets Rodriguez sees that sparkle almost immediately. Many joke, such as Hicks, that her being really good at her job is a bonus.

“Christy is vibrant, full of life and she has this positive energy unlike hardly anyone else I know. She's very loving. She's kind. She's very thoughtful. She thinks things through. She's so intelligent – like in every way. She's really amazing. She knows how to make people feel good, and that feeling stays with you. It’s definitely a gift of hers. She knew there was a huge need and assumed that role as secretary/treasurer and took a deep dive working with Nancy (Lo, former HAA vice president of finance) and Susan (Hinkley, HAA vice president and general manager) and the HAA financials. She really challenged that status quo.” – John Boriack, Immediate HAA Past President and President of Veritas Equity Management “Christy’s contributions were plenty. As an example, I could point specifically to her time spent on an ‘Innovations’ national committee that literally altered the direction of Greystar from a technological and creative standpoint. Instead, I will say her greatest accomplishment was spreading a positive vibe across our Houston office and across the company in general. “Her positivity is what causes her to standout, like she immediately did at Greystar. She carved her own path within our company and made a name for herself,” Mack Armstrong, a senior managing director for Greystar and HAA’s 2013 president, said. Over the course of her career, she has cultivated a wide repertoire of skills, which is what has propelled her career growth in an industry that demands it. “Christy’s talent that has created such career growth is her versatility,” Jenifer Paneral, 2012 HAA president and senior vice president of operations for DayRise Residential, said. As author of Grit: The Power of Passion and Perseverance Angela Duckworth says, talent, though, never happens overnight. Talent is developed over time, through hard work, practice and unwavering commitment. It’s no surprise that Rodriguez began developing the artistry of being well-rounded long before her career in multifamily real estate. In school, she was an overachiever in every way. She excelled in both academics and various extra curriculars. She was a member of the National Honors Society, the Spanish Honors Society and Mu Alpha Theta (the honor society for mathematics) in high school. On top of her academic achievements, Rodriguez was a talented clarinet player. As if that wasn’t enough, she was also the drum major in the La Porte High School marching band and performed for the annual musical production in the pit orchestra. Her clarinet mastery brought her to study music performance at San Jacinto Community College, where she placed First Chair Symphonic Clarinet in the Texas Music Education Association All-State Band. At San Jacinto, Rodriguez met her husband, David, who was a bass player. While in school, Rodriguez picked up a part-time job at an apartment community where she would quickly become the property manager. Even though she had plans to pursue a career in music performance, she was thinking about the future when she made the decision to go after a career in the apartment industry. “Here I am in the apartment industry, making the salary of a teacher, and there’s a ton of opportunity in this business to grow. I would get the ABODE magazine and see women like Eileen Subinsky (HAA’s 1998 president), Kathy Clem (HAA’s 2003 president) and Darlene Guidry (HAA’s 2004 president) on the cover. I thought, these are women who are leading. I could do this,” Rodriguez said. While there was scarcity in jobs at the top for female leaders in business then, seeing women in leadership positions within the apartment business inspired Rodriguez. www.haaonline.org

Rodriguez never sacrificed her family life for success. She has overcome the stereotype about women having to choose between their families or careers. When asked what she admires most about Rodriguez, Paneral said it’s her commitment to her family. In fact, her commitment to her family helped shape her career path. With a toddler at home and a baby on the way, David went back to school to pursue a career change for the betterment of their amily’s future. So, Rodriguez did what any wife and mother working in multifamily property management would do to support her family. She negotiated a free apartment to work onsite for Alliance Residential Management during a time when free apartments for property managers were hard to find. David went to school at night for engineering and design graphics so that he could be at home with their young children during the day while Christy worked and vice versa. It was hard work, but it paid off. Today, David works for a global oil and gas organization using the skills he learned and developed when he went back to school. At Alliance Residential, Rodriguez’s career really started to flourish working under Paneral. Through Rodriguez’s story, you will see how she aligned herself with the best in their crafts to be the successful, dynamic leader she is today without ever sacrificing family. First, I want to start by asking you how you were able to develop the artistry of being so well rounded? I’m deeply curious about people and problems. I’m also really competitive with myself. I learned along the way that every person possesses strengths on any team. There is always going to be someone wiser and more experienced than

you on any team. Those are the people I always try to lean into. I also like to work with leaders and owners who are different than me to create a balanced team in order to accomplish the goal. Alliance Residential Management wasn’t your first job in the industry, but it was the first time you were exposed to people who would later become HAA leaders, such as Paneral and Suan Tinsley (a partner of Houston’s DayRise Residential). Jerry believes you learned a lot from Paneral about operations, when in fact, Paneral said she learned a lot from you. There, you started as an onsite property manager. You were promoted to a dual-site property manager, then to a regional director of marketing and then again to a regional director of operations. What did you learn working with Paneral at Alliance Residential? Jenifer and I are opposite, but we worked together as yin and yang. Her approach to operations is analytical and data driven. I tend to be quicker with my decision making, often referencing my past experiences to help me come to a decision. Jenifer would encourage me to slow down and utilize the data to help guide my decisions. I’ve always been a numbers nerd, but once I started understanding – and she helped influence this – the relationship between the operation and the numbers, it took my craft to a whole new level. We respected each other for our strengths so much because we saw in each other the abilities that we didn’t possess within ourselves. Paneral said you took a massive and challenging 1,000-unit property and completely turned it around. At the time, you were a regional director of marketing, but you went onsite and

did an excellent job, she said. “That was the first project I worked with her on where I was able to really see how talented she was at identifying what it took to lease, market and reposition a property” Paneral said. Were you surprised to go back onsite? Honestly, no. I'm a team player. I'm going to do what I need to do, right? If my leader says this is what I need to do, I'm going to do it. It was a great opportunity to understand where the core of our business lied. Tell me about your transition to Apartments.com and then back to the operations side. At the time, there was a lot of change happening at Alliance. I started thinking about what I wanted out of my career, what I wanted in a job and what I wanted in a company. I had young kids in elementary school. They were starting to get active in soccer, they needed help with their homework and the weekends were getting busier. I wanted the flexibility to work remotely to be more available for them. When the opportunity to work for Apartments.com came up, I wasn’t sure if I could take the financial risk at the time, but I loved leasing and marketing. I ended up loving working for Apartments.com. It was innovative, it was fun, it was fresh, and I ended up doing really well in sales for the company. It was a blast, and I was able to have the flexibility I wanted for my children. I was able to cook breakfast for my kids every morning. We lived in a culde-sac – kids in the neighborhood would come over for breakfast, too. Then the 2008 recession started happening, everybody was cutting marketing and my pay was being impacted. That’s when I reconnected with Jenifer Paneral and discovered there was an

open position at Concierge. I knew I could really elevate the customer experience after experiencing it from the lens of the supplier and I knew I could be a standout in the submarket for these operations. Following Concierge, you went to work for Greystar. Tell me about going from a company that did a lot of value add to a third-party management company – the largest in the United States. The decision to go work for Greystar was a move towards growth. I had a deep love for my team at Concierge, for Jenifer, for the company itself and I believed in what we were doing, but ultimately, I wanted to grow and experience what it was like to work for a global organization. I knew I was in the prime of my career and that if I wanted to give my career my all, I had to make that leap. It goes back to what my parents taught me growing up – if you don't try, you're never going to succeed. I am thankful for my experience at Greystar, and I am privileged to have learned from so many industry leaders during my tenure there. Shifting to your HAA involvement, once you graduated from the HAA Leadership Lyceum program, your association ascension really

started, but your biggest and most influential contribution to HAA was your role as secretary/treasurer. You were integral in Morgan’s transition as CEO of HAA with your extensive knowledge of the budget and financials. Tell me about that role. When Michelle Pawelek (a managing director for Greystar and the 2018 HAA President) called me to tell me I was going to be secretary/treasurer, I was so excited. Fast forward a few months later and COVID-19 happens. The first board meeting of the year, Jackie Rhone (an executive director for Greystar) says, “Madam secretary, have you considered revising the budget?” I worked with her closely on the owned assets at Greystar – all she did was ask the question and I knew I needed to dig in. From that point, I just immersed myself into HAA’s financials. When Clay asked me to chair the HAA COVID-19 Taskforce, I knew it would be a great opportunity to marry the two. I have a deep heart for this association. I accredit this association to my success. The relationships I have built here have really catapulted me in my career. I knew I had the skillset and the aptitude to take on these roles, and, by the way, I work for the Winograd family. Dr. (Eugene) Winograd is a past president (served in 1975) and Jerry (Winograd) is a past president (served in 2006).

I felt like I owed it to them to give it my all – to do my best. I owed it to the HAA staff, too, to do what I could. Simultaneously, at Judwin, we were going through the same thing. Many of our processes were not digitized when the pandemic happened. That’s right. Once you started with Judwin, just six months later Texas went on lockdown to reduce the spread of COVID-19. Shortly after, the HAA COVID-19 Taskforce was formed. As chair, that was a huge responsibility, but your current owner, Jerry Winograd, was supportive of that commitment. He said you were laying the groundwork for the industry. Tell me about your new role with Judwin and how it shifted during COVID-19. When you’re in the trenches, you just take it one day at a time. I’m reading a book called Leading Change by John Kotter. He says there’s survival mode and then there’s thrive mode. For me, thriving was bringing joy. Where can we find the wins? Where can we make progress? We can’t control what we can’t control, but we can support people in this crazy time – and that’s what I did. My journey at Judwin was serendipitous, I always say, because I didn’t want to make any changes within my first couple of months at Judwin but the pandemic demanded we do www.haaonline.org

exactly the opposite. When I joined the Judwin team, I was just trying to learn how they did things. I was, however, setting the framework with the Winograds to automate and digitize our operations in those first few months. We would talk about online leasing, transitioning to paperless, what tools we already had, what we would need. I’m big on project teams – getting everyone together and talking through things. I wanted to understand it all. When the pandemic happened, we had to be able to operate with the doors closed. People needed to be able to lease, pay and tour online. There was a huge push to get Judwin online simultaneously with everything that was going on at HAA. I’m fascinated by your ability to navigate so many challenges at once. How were you able to juggle all of that at once? I’m always looking for people’s strengths. I am keenly aware of what my strengths are and aren’t. When it comes to an initiative or a problem, I look at it as, what skillsets do we need to accomplish the goal? First, you establish what that the goal or problem is, and then you establish who possesses those skillsets. How can I pair people and put them in project teams to make it happen, do it quickly and make people feel good about it? I use my energy to motivate others, to inspire others, to help them see things they don't see within themselves that I can see and identify. When it comes to weaknesses, I try to apply the “Whale Done Approach” – it’s a book by Ken Blanchard. They studied the whales at SeaWorld to identify how they got them to perform. Basically, both whales and people perform better when you reinforce the positive. When people are operating within their strengths, they're happy, they care, they're productive and they feel fulfilled. How did your involvement in extra curriculars in school prepare you to be so well-rounded in your career and in HAA? I learned a lot of skills in band, as drum major, and in every club. Band is a lot like being on a sports team – talk about teamwork and discipline. You learn teamwork and how to be a team player, you learn discipline, you learn how to listen, you learn how to work with different personalities. Growing up, your parents really shaped you into who you are today, but there was always some-

thing missing, right? Tell me about finding your biological dad. Did you find where you got your sparkle from? My parents divorced when I was really young. I was raised by my stepdad, who's the person I call dad to this day. He made sure that my sister and I did our school studies, that we were respectful and put education at the top of our list of priorities. My mom was giving, caring, soft spoken and introverted. My dad was not super introverted, but he wasn’t necessarily an extrovert, either. Meanwhile, I was literally born with this super extroverted personality. Fast forward to today. About three years ago, I found my biological father through Ancestry.com. When I met him, it was like looking in a mirror. It has answered a lot of questions internally that I didn’t realize I was asking. It’s been so fulfilling to learn where I got some of my innate personality traits from. It’s been a really fun, crazy experience getting to know him and my sister, my brother and my five nieces and nephews. My dad will always be my dad, but it’s been such a gift and a bonus to meet my biological dad and all of these family members I didn’t know I had. Tell me about your children! It sounds like your son David may follow in your real estate footsteps and your daughter Marissa sounds like a mini you. Yes, David is 21, and he’s studying business administration and real estate finance development at the University of Texas – San Antonio. He’s a numbers person, like I am. He is the most caring, thoughtful and artistic person. He’s a musician, too. He’s just an amazing kid all around. He has a bright future ahead. My daughter Marissa is also just amazing. She’s the better version of me. She’s 18 years old, and she’s in CAP (Coordinated Admission Program) at the University of Texas – Tyler to get into the University of Texas – Austin. She’s pursuing health and society, but she already has an associate degree from her work in high school. She recently pledged Zeta Tau Alpha, too. She’s very genuine and kind. My children are the best of friends. It’s really the sweetest thing ever. I’m always fascinated by women who do it all – who have a career and a family. You’ve often made career decisions based on what is best for your family. For the women who want to do both, how did you do it? How can women better support each other in the workplace?

It’s having a support system. My husband, my in laws and my mother have been a tremendous support system. My husband is my rock, my biggest cheerleader and he grounds me. He has been critical to my success. You have to give yourself grace, too. When you become a mother, your purpose becomes bigger than yourself. You have to make sacrifices. Family is first – family is everything. I’ve had really awesome mentors and managers who were in the business 20-30 years before me who told me if they could redo their time with their children, they would, because you’re not going to remember that report, but you’re going to remember missing their band concert. I decided I was going to be there for the things that matter most to them, always, and I won’t waver from that. That was a big reason why I joined Judwin, to be with my family more. As women, we have to support each other and not feel guilty when we have to miss a meeting to be there for our family. I think women often feel like we have to prove ourselves for that "one seat" at the executive table. I believe all that does is pin women against one other. I firmly believe that we have to start recognizing the strengths in one another in a way where we can feel confident about saying to each other “You are so smart. You bring so much to the table. I'm proud of you.” We don’t have to compete with one another for that one spot at the table, right? Make two spots, make three spots. In looking at 2022, would you agree HAA is still in a transition period as the organization continues to rebound from the pandemic? Yes, for sure. With the new leadership combined with a pandemic, we’re still in this adaptation phase. We have a fresh new leader after 30 years who sees things completely different. So, we’re still adapting. We’re still growing and learning. For example, with meetings and events, we still don’t know what attendance is going to be like in 2022. We are all keenly aware that we aren’t through this yet. We are forever changed by the pandemic. It’s important we be open and honest with each other about what has changed. We have to constantly be open to the fact that this is the way things are now and be okay with that. We have to be okay with not really knowing what to expect, but we know that we have the best people with the best hearts who have great intentions and a great vision. We can lean on another to get through anything.

Legislative, continued from Page 9 A long-term solution will probably have to contain some form of all these options, but even those won’t be enough. Ultimately, the true value of blue-collar labor continues to decrease as technology continues to reduce demand. Each time you book a hotel room online, check out your own groceries or use a QR code to order in a restaurant, you can see the demand for unskilled labor decrease just a little more. It’s difficult to imagine that self-driving vehicles and drone deliveries not accelerating this trend over the coming decade. There will always be a demand for manual labor. Lawns don’t mow themselves. Restaurant dishes need to be washed, hotel rooms and office buildings need to be cleaned and call centers need to be staffed. Finding a way to bridge the gap between wages for these jobs and the real cost of housing when there is no pandemic, hurricane or other acute crisis will be a challenge for our industry and for every level of government. At the same time, providing better access to higher education – including workforce training and trade apprenticeship programs will be a key factor in helping individuals find lucrative careers to support themselves and their families as housing costs continue to rise. Staff Change My co-author for this column, Andy Teas, has accepted a position teaching government at Houston Community College, and he will be leaving HAA at the end of this month. Andy started with HAA in 1989 and has managed government and public affairs for the association for more than 32 years. We wish Andy well in his new career and we are excited to welcome Bradley Pepper as HAA’s new Vice President of Government Affairs. Bradley has served as director of government affairs for the Greater Houston Builders’ Association since 2015 after three sessions as a legislative aide in the Texas House of Representatives. Be sure to welcome Bradley at the next HAA Political Action Committee meeting. To my second point earlier in the column, I want to create new opportunities for everyone to get involved, but if you’re not already a member of the HAAPAC, 2022 is the year to sign up. This year’s elections will be critical for the apartment industry as voters choose new members of congress, legislators, judges and executive branch officials.

2022 HAA Leadership Christy Rodriguez, CAPS President Christy Rodriguez is the director of multifamily properties for Judwin Properties. Christy has 20 years of multifamily real estate experience in acquisitions, dispositions, due diligence, senior housing, affordable housing, value add renovations, third party management and new construction lease-ups. Christy served as an HAA vice president at large from 2018 to 2019. In 2020, she served as HAA secretary/treasurer, as chair of the HAA COVID-19 Taskforce and she served on the HAA Executive Director Search Committee. 2022 PRODUCT SERVICE COUNCIL OFFICERS Derek DeVries, CAS President Derek DeVries is the regional director of sales for the central region for Camp Construction Services. He was promoted in 2018 after being one of Camp’s most productive salesmen in Houston for eight years. He joined Camp after a 14-year career in education, teaching high school history and coaching athletics. Derek has been very active in HAA since joining the industry in 2010. He has served HAA through his involvement and through leadership roles on various committees, including leadership positions as the co-chair for the Ambassador One Society and heading up the chili judging for the HAA Chili Cookoff. Clay Hicks, president of The Dinerstein Companies How did you get to where you are within your career? I followed leaders I trusted with high integrity and morals, dropped my ego and hired up. I learned how to hire a team and empower them, I began giving and mentoring and, lastly, I just worked hard. I never quit when things got hard, I put myself in positions to succeed and then got lucky every once in a while.

It was about banding together as brothers and sisters who want the best for our industry. It’s what we are about and why you always hear people refer to this industry as a family. What are you working on right now? When I was first put on the ladder to become TAA president, I knew 2022 was going to be a big year for me. For these last four years, I’ve worked to build, grow, and surround myself with a team of leaders at TDC who could support me and lead our organization this year. I can now honestly say this is the best team I’ve ever been a part of. We are all aligned together to succeed for both TDC and TAA. What makes teams successful? I’m going to take the opposite approach to answer this question because it had a huge impact on our leadership team. We read The Five Dysfunctions of a Team by Patrick Lencioni together. He takes you through a fable to help you understand why effective teams are so rare and to eliminate barriers that lead to dysfunctional teams. He summarizes the five dysfunctions in a pyramid in order of importance: 1) Absence of Trust 2) Fear of Conflict 3) Lack of Commitment 4) Avoidance of Accountability 5) Inattention to Results At the foundation of the pyramid, and what I think is the most important, is an absence of trust. While so important at any time, I think ensuring trust among your team is more important than ever in today’s work environment. After experiencing 2020, what can you say about change that is positive? I think 2020, and then our recovery during 2021, tested us all. It tested our trust, our relationships, our leadership, our resilience and many times our sanity. Looking back at the last two years, our industry really came together. We came together as both friends and peers. The company names didn’t matter anymore. It was about banding together as brothers and sisters who want the best for our industry. It’s what we are about and why you always hear people refer to this industry as a family. I’m so proud of our HAA family.

Steve Tennison, CAM, owner of Verve Assets What do you do? Big management companies have CEOs, CFOs, operating officers, investor relations, accountants, legal, HR, marketing, IT and supervisors. My management company has one employee, me, so I do all of that stuff. But the most important thing I do is lead and tell stories. I tell stories to my investors to convey the vision, the goal, the plan to achieve that goal and the progress made. I tell stories to my employees so that my dull, written business plan comes alive and makes sense in a way that motivates them to act with conviction. Leadership then boils down to creating the goal, telling stories to make the goal real to others and putting people and resources in place to achieve the goal. That’s what I do, plus all of that other stuff. How did you get to where you are within your career? I sometimes joke that the only thing I did right as a property owner was to not give up, but that’s too simple. Yes, when things get tough, fortitude will be your friend, especially if it overcomes your ego, which will make you willing to reach out for help. I’m here today thanks to people who are willing to share their wisdom and experience and my willingness to seek and accept their help. When I first took an interest in owning rental property, I joined Lifestyles Unlimited and the Houston Apartment Association to get an education, because a wise man only invests in what he understands. I got way more than an education. Those organizations lead me to friends, owners and mentors who have all guided me to where I am today. With fortitude, education and mentorship, your success will seem guaranteed compared to the person who tries to go it alone. Once I had my education and support, it was just a matter of working every day and trying to do the right thing. I’m always looking for things to improve. I feel fortunate when I try something and it works, but that’s not always the case. Over time, little improvements add up and can completely transform a property. Improvement is important. If your property is not improving, it’s becoming someone else’s valueadd acquisition.

How do you make an impact? Listen to your customers and strive to meet their needs. That resident who comes to the office with a complaint or a concern is providing valuable marketing data – for free. They’re telling you how to improve your product in ways that matter to your specific clientele. They’re telling you how to increase occupancy and reduce turnover. Be grateful to your customers and listen to them. They’re telling you how to have an impact. Believe that your community does not end at the fence line. Your property is part of a larger community. Be a part of it. If there’s a neighborhood association, join it. If there’s a church or school, volunteer at it. Patronize your local businesses. Attend your local police meetings. Invite your neighbors to your resident events. Too often, neighborhoods have negative impressions of their apartment communities. Do what you can to turn that around. When you are a positive influence in the larger community, the community will naturally direct business your way. What advice do you have for people who want to own and manage multifamily properties like you? Love your customers. There are many in this industry who fall into the trap of having contempt for their customers. They have a bad experience with a resident or even a lot of residents and come to believe that this is an us vs them game. They forget that, ultimately, the people who rent our apartments, even the ones who challenge us, are the very people who pay the light bill, the property taxes, our employees, our investors and make us financially successful. They forget that the vast majority of our customers are wonderful people who are as important and fundamental as the bricks and mortar that hold our buildings together. You’re in the customer service business. Take care of your customers. Hire employees who take care of your customers. Deliver products and services that meet your customers’ needs. Do this because: If you take care of your customers, your customers will take care of you.

Sometimes, you just have to put your ear in gear and listen to change happen right before your very eyes!” – Joe Melton

Joe Melton, vice president of marketing and management support services for The Morgan Group What do you do? Easily answered by starting with Morgan’s first key value: “commitment to people.” It is my job to lead and work with a team that provides each employee with opportunity and resources for personal and professional growth. I always tell people I work from dirt to dollars. I’m involved in the creative branding and collaboration for Morgan development, acquisitions and management assignments. In my department, we handle marketing, social media, reputation management, software and systems, due diligence and much more. We are adding to our team this year with our incredible growth. How did you get to where you are within your career? I have always been interested in marketing and selling, and I thrive in an environment where I can be creative and influence company culture. I try to learn something every day, and I know the importance of making sure I always have a professional mentor. I have been super lucky to be mentored, trusted and ultimately empowered with big decisions. Finding the next great leasing agent who will one day be a marketing director, trainer, mentor, influencer, etc. is no easy task. Giving back to capable individuals by providing growth opportunity and support is important to me. It is really how I got here. What are you working on right now? Morgan’s growth this year and the last 18 or more months have me and my team digging deep. We are focused on technology that works for us and creating efficiencies for all of our customers that help to streamline data and that puts information in the hands of the right people. We are happy for our growth, but we are also reminded of another one of our values: “commitment to quality and service.” We must continue to hold the highest standards. Allison Culver, regional marketing director for Asset Living What do you do? Well, this is a tough one. I have a title of regional marketing director. I do the marketing for 24 properties, but I do much more. I handle operational items like Grace Hill, Bluemoon and I manage the walk inspections for due diligences wherever and whenever they may be. That is really my favorite part because I get to see my coworkers and colleagues who I miss on a daily basis. Whatever my title or job description is, my main goal for Asset is to be a smiling face with a warm welcome to everyone every day, and I try to bring a smile to their faces and a laugh along the way. I love being a cheerleader for our team! How did you get to where you are within your career? I’ve been with my company for over 31 years. So, I suppose loyalty got me where I am today. Loyalty to the owners and founders of Greystone and to the Asset family we became. I also believe flexibility was key to my shifts within the company and my growth. One of my favorite mottos is “Trust the process.” How have you been able to develop yourself as a dynamic contributor to your organization? I would say it’s my dedication to the people. Beyond the work is the people. Without those people and relationships, what are you contributing to and what for?

However, keep in mind that the early termination option is not an option available to a resident who is in default of a lease. Residents who are in default of a lease would be subject to paying the reletting charge, accelerated rent and other damages associated with the default. A resident who exercises the early termination option would be required to pay the early termination fee and repay all rent concessions, credits or discounts received during the lease term. Liability Protection When Serving Writs A new Texas law provides that an owner is not liable for damages to the resident resulting from the execution of a writ of possession by a constable. This law applies to the execution of a writ issued in an eviction suit filed on or after September 1, 2021. This new law could be valuable if there’s any claim by a resident after the constable has authorized you to remove the resident’s property from the unit. This also emphasizes the need to have a writ served if you have a judgment for possession and there is a question whether the resident has moved out of the unit. If there is a question if the resident has moved out, the writ should be requested (by you) and served (by the constable). This law protects you from damages that may occur from the execution of the writ. Anticipate the Unknown! One thing we can be sure to predict in 2022 is that we won’t be able to predict everything that happens in 2022. If we have learned anything over the past two years, we’ve learned that our policies, procedures and operations can be forced to change quickly. As we come out of the pandemic (hopefully) we need to be aware of any new issues that come up and be flexible enough to adapt to the new environment and surroundings. Hopefully this gives you some food for thought to be able to plan at least the beginning of 2022. Happy New Year and good luck!

Joseph Rodriguez, CAS Secretary Joey Rodriguez is a sales manager for The Urban Foresters. He manages a small team of multifamily and commercial arborists across Texas, prioritizing training and one-on-one coaching weekly. Joey joined the multifamily industry after attending The University of Houston and beginning a career in retail sales and management. Seven years ago, Joey joined The Urban Foresters and HAA, a journey that has helped him grow and develop professionally and personally. Joey obtained his Certified Apartment Supplier credential through NAA. In 2019, Joey began serving on the HAA Product Service Council, the same year he graduated from the HAA Leadership Lyceum program. Joey is a member of HAAPAC Steering Committee and he served as the 2021 HAAPAC Century Club Chair. He has served on a number of other committees such as the Ambassador ONE Society, the Chili Cook-Off Committee and the HAA NEXT Committee. Joey and his wife, Adrianna Rodriguez, are parishioners at St. Ann's Catholic Church. They share the dream of owning a hub house, where their friends and family can come together and be loved.

David Lindley, CAS Immediate Past President David Lindley is a vice president for FSI Construction. He started working for FSI Construction in 2015, working in busines development. He began his multifamily career working for Asset Plus in 2012. As an active HAA volunteer, David graduated from the HAA Leadership Lyceum program in

2016. David has served HAA by volunteering for various HAA committees, groups and projects including the HAA Food Drive, the HAAPAC, the Ambassador ONE Society, Go-Getters, the Community Outreach Committee, the HAA NEXT Committee and the Chili Cook-off Committee. From 2017 to 2018, David served as chair for the HAA NEXT Committee and as the chair for the 2020 Expo Exhibitor Committee. In 2017, David won the HAA Honors Awards Go-Getter of the Year award. In 2021, David also won the HAA Supplier of the Year award. He has served on the HAA Board of Directors since 2018. Deborah DeRouen, CAS Treasurer Deb DeRouen is a director of sales for OneApp Gurarantee. She is an accomplished sales executive with over 20 years of diverse experience in multifamily real estate sales and marketing. In her current role, Deb builds and oversees sales teams across the United Sates. In the first 10 years of her career, Deb worked in multifamily operations as a leasing agent, an assistant manager and as a community director, before she found her passion working in sales as a supplier partner. Deb has extensive experience in various multifamily products. As a passionate networker, Deb loves connecting with people and mentoring others. These statistics are derived from a continuous survey of all apartment communities in the Houston region. The effective rental rates are the calculated net of concessions and utility adjustments. The second table lists the five hottest submarkets in the Greater Houston area. There are a total of 42 submarkets, and the ranking is based on the best combination of rental rate growth and absorption over the past three months. The third table distributes and analyzes concessions (specials) by classification. Concessions generally are represented by three types of specials: move-in, months free or floor plans. The effect of these specials is captured and prorated over a lease term to arrive at a percentage reduction in market or street rents.
