‘TIS THE SEASON! JUST WHEN WE THOUGHT THIS YEAR WAS GOING BY SLOW, WE LOOK UP AND IT’S NOVEMBER! WE ARE ENTERING A VERY BUSY SEASON OF LIFE AND IT IS SO EASY TO GET TANGLED UP IN THE HOLIDAY STORM. BUT BEFORE WE STUFF THE TURKEY AND DECK THE HALLS, WE NEED TO TAKE A MOMENT TO TAKE A STEP BACK AND PLAN TO END THIS YEAR ON A POSITIVE NOTE. In this industry you are guaranteed to come face to face with some bad elves, and sometimes those kinds of people can blind you from seeing all the good elves you meet! Isn’t it crazy how one bad comment can turn your day into a bad one? You can have 100 people tell you something great and you could be getting 100 five-star reviews, but the one bad one sets you off. It is a challenge to focus on all of your achievements when the negativity and envy are so loud and somehow seem stronger than any positives coming your way! But life is about making choices, and it is our choice to be positive. We can CHOOSE to be affected by the good comments and strive to achieve more! Or we can CHOOSE to let that one negative customer or resident take over our day. I want to challenge you this month, through all the chaos, to wake up and CHOOSE to spend your 24 hours wisely! Speaking of achieving, coming up this month is the Industry Achievement and Annual Business meeting Luncheon. This year HAA has chosen to induct long time member Vic Vasek Jr. into HAA’s Hall of Fame. Now this is a choice that was done wisely! Vic has poured his heart and time into this industry, and it is time we pour our heart into him. Come out and show your love for Vic on November 9. You can find more information about the luncheon on Page 17. I wanted to take my own advice and end on a positive note. Thank you to everyone who came out for this year’s 2023 Maintenance Appreciation Night and showed their love for their onsite heroes. It was a jam-packed night that ended with a Dynamo win! Wahoo! You can find pictures from Maintenance Appreciation Night starting on Page 50.

Legislative Update By GINA ERWIN, HAA Legislative Chair, with BRADLEY PEPPER, Vice President of Government Affairs

THIRD TIME’S THE CHARM? The Texas Legislature is back in session.

ON MONDAY, OCTOBER 9, the Texas Legislature gaveled in for the third special session of the year. This follows a regular legislative session that ended on May 29 after 140 days and two special sessions over the summer (30 days each) that ultimately delivered the largest property tax cut in Texas history. This most recent special session has been anticipated for months as Governor Greg Abbott has made passing school choice legislation one of his top priorities of the legislative year. He has pushed for a bill that would allow parents to use taxpayer funds to help pay for private school tuition, home schooling expenses or private tutoring. He has specifically called for “education savings accounts for all Texas schoolchildren,” or taxpayer-funded accounts that parents could use to subsidize alternative education costs. Historically, Democrats and rural Republicans have joined together to oppose the adoption of any type of school voucher program, especially in the Texas House of Representatives. Their belief has been that using taxpayer money for private schools will take away much needed money from their local public-school districts. For some rural Republicans that cover larger geographic areas, they may have only a small number of private schools, if any, or the school districts could be the largest employers in

these counties. Naturally, most of those Republicans have become the staunchest supporters and defenders of their public schools. For Democrats, especially those in urban areas that represent a higher percentage of economically disadvantaged students, they have been ideologically opposed to the consideration of a private school voucher program because it is perceived to only exacerbate their already underfunded schools. Democratic leadership in both the Texas House and Senate have indicated that they are united in voting against any school choice legislation during this special session. Despite the seemingly uphill road to passing any form of a voucher program, Governor Abbott has remained resolute in his commitment to seeing school choice come to fruition. He has toured the state, visiting rural areas to promote the policy, and even hinted at helping support primary challengers to Republicans that do not ultimately back his initiatives. This will be a very contentious fight and the Governor has said he will continue to call the legislators back until they send him a bill to sign. In addition to school choice, the Governor included a few other items on the agenda for the third called special session. As we know, only the Governor has the authority to both call a special session and determine the topics that will be taken up during that session.

He has added items intended to increase border security and public safety, as well as ending COVID-19 restrictions by prohibiting vaccine mandates by private employers. He has called for the creation of a criminal offense for illegal entry into Texas from a foreign nation, as well as authorizing all licensed peace officers to remove illegal immigrants from Texas. “For the first time ever, Texas will subject people to arrest for illegal entry into our state from a foreign nation. All licensed law enforcement officers in Texas will be authorized to arrest or remove any person who illegally enters the state, with penalties up to 20 years in prison for refusing to comply with removal. To crack down on repeated attempts to enter Texas illegally, reentry will be penalized with up to 20 years in prison,” Governor Abbott said. With the acrimony between the House and the Senate, especially after the outcome of the impeachment trial for Attorney General Ken Paxton, this and subsequent special sessions are expected to be combative and it is not clear at this point how compromise can be reached. THE HOLIDAY SEASON IS HERE But are the fees you are charging legit?

THE APARTMENT INDUSTRY is under scrutiny. Nothing new, you say? Both the White House and HUD have recently taken positions that a number of fees in our industry are … well … “Junk.” The Background • January 25, 2023: Biden-Harris Administration announces new actions to protect renters and promote rental affordability. • January 2023: The White House Blueprint for a Renters Bill of Rights is published intended to support the development of policies and practices that promote fairness for Americans living in rental housing. Among a number of other issues, the Blueprint stated that leases should not include hidden or illegal fees. (Reported in the March issue of Abode) • March 7, 2023: Secretary of HUD sends an open letter to housing providers calling for action on “Junk Fees” that renters face. (Reported in the April issue of Abode) • July 19, 2023: White House publishes a Fact Sheet taking on “Junk Fees” in rental housing to lower costs to renters. • July 2023: HUD publishes “Transparency in Rental Fees” stating that application fees can limit options for renters and strain household budgets, particularly for renters with low and modest incomes who already face high rental cost burdens. In addition, the monthly rent included in a listing may not reflect the full cost if an owner later requires the resident to pay undisclosed or hidden fees. The publication provides an overview of the research on rental fees and highlights strategies to encourage transparency and fairness in the rental market.

So what’s the problem? The White House and HUD claim application fees are excessive and duplicative and rental fees are excessive, undisclosed or hidden. Although I previously addressed issues raised by the Blueprint for a Renters Bill of Rights and HUD’s open letter, the continuing publications warrant further discussion. The publications suggest: • Application fees should be capped or eliminated altogether. • Applicants should be allowed to provide their own screening reports. • A single application fee should be allowed to cover multiple applications. • Excessive duplicative application fees could be deemed discriminatory because higher upfront costs add to the challenges faced by renters of color, and Black and Hispanic renters report submitting more application fees than White or Asian American Pacific Islander renters. • Limiting allowable fees and deposits at the time of move-in or lease signing. • Clearly identifying bottom-line amounts that residents will pay for move-in costs and monthly rent. What other states do? It may be beneficial to see what other states have done regarding their landlord/tenant laws to determine what might be coming our way. We often see laws in other states blossoming into ideas for new legislation in Texas. While it is important to note that these are not representative of current laws in Texas, we need to be on the lookout for what might be coming.

• Colorado: - Allows applicants to reuse a rental application for up to 30 days without paying additional application fees. - Limits fees to residents when owners fail to provide a nonrenewal notice that disguise fees as “rent.” - Limits the amount an owner can mark up to charge a resident for third-party services. • Rhode Island: - Limits application fees beyond the actual cost of obtaining a background check or credit report (if the applicant does not provide their own report). • Minnesota: - Requires owners to clearly display the total monthly payment in all nonoptional fees on the first page of the lease and in all advertisements. • Connecticut: - Prohibits owners from requiring a fee for processing, reviewing or accepting an application. - Sets a cap of $50 on the amount that can be charged for a screening report. - Prohibits move-in and move-out fees, and certain fee-related lease provisions, including certain late fees relating to utility payments. • Maine: - Prohibits owners from charging a fee to submit an application that exceeds the actual costs of a background check, a credit check or another screening process. - Prohibits an owner from charging more than one screening fee in any 12-month period.

• Montana: - Requires owners to refund application fees to unsuccessful applicants except any portion of the fee used to cover the costs relating to reviewing the application, including conducting a background check. - Owners can only charge applicants for the actual cost of obtaining a background check or credit report. • California: - Requires mandatory disclosure of monthly rent rates, including disclosure of a range of payments, fees, deposits or charges. - Prohibits certain fees from being charged. What can we do? The theme of the publications suggests that the fees are excessive or hidden. To combat these claims, you may want to consider the following with respect to application fees and rental fees. • Application fees: - Disclose application fees up front before an applicant is expected to pay them. - Be able to justify the amount of the fees (HUD suggests that the fee not exceed the

cost associated with the application process, including screening the applicant). • Rental fees: - Fully disclose all fees. - Be transparent in advertisements regarding fees (you want to avoid an argument that prospects are surprised when they find out what they are “really” paying to rent a unit). - Be sure that all fees are agreed to in advance in writing by the resident. - Be sure that you are not charging fees that are prohibited by law. - Be sure that the amount of the fee is reasonable considering what the fee is supposed to cover (consider charging fees to cover expenses, not build profit).

TAA Rental Application and Lease • Rental Application: - Paragraph 1 of the “Disclosures” section of the TAA application provides that the applicant agrees to pay a non-refundable application fee in the amount identified in the application and that the application fee offsets the cost of screening an applicant. • Lease: - Subsection L in the “LEASE DETAILS” of the lease allows you to identify all monthly recurring fixed charges. - It is interesting to note that the TAA lease was used as an example in the HUD publication from July 2023 as a lease that provides a Summary of Key Information that succinctly highlights the total monthly costs and any additional fees to which renters may be subjected. Fees in the apartment industry are under attack! It would be beneficial for you to review all fees you charge to be sure that they would pass muster under White House and HUD scrutiny.

NORMAL WEAR AND TEAR A resident wants a refund after being charged for carpet cleaning at move out.

A RESIDENT FILED a complaint with the Houston Apartment Association requesting to be refunded $102.86. The resident claimed that during her walkthrough with management she was told that her unit looked up to standards and she would not owe anything after moving out. The resident did end up having fees taken out of her deposit for a carpet shampoo that totaled $102.86. The resident was confused after having the walkthrough with management and then being charged for wear and tear. HAA reached out to the apartment property and passed along the information and that response was forwarded to the resident. Enclosed in the management’s response were copies of the application, move-in condition form, resident ledger, final account statement and pic-

tures. They also included the charges showing a carpet shampooing performed after the resident moved out. The case was heard during a Resident Relations Committee meeting where the committee decided in favor of the resident. The committee removed the charges for the carpet shampooing after reviewing the photos and deciding that the carpet had normal wear and tear and the resident should not have to pay. Management is to refund the resident $102.86. The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, HAA appreciates a

direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the management owner, the decision is final. SCOTUS DECLINES TO HEAR NEW YORK RENT CONTROL CASE With this decision, the prior Court of Appeals ruling stands.

The National Apartment Association (NAA) will continue to track the outcome of 74 Pinehurst LLC. Initial Article (10/02/2023): On October 2, 2023, the Supreme Court of the United States (SCOTUS) denied certiorari (denied review) in Community Housing Improvement Program v. City of New York, New York (CHIP v. NYC). 74 Pinehurst LLC v. State of New York was redistributed for conference and will be reviewed again on October 6, 2023. The National Apartment Association (NAA) will continue to track the outcome of 74 Pinehurst LLC.

The Court’s decision not to hear CHIP v. NYC is devastating to an industry plagued by years of ineffective rent control policies that only exacerbate housing affordability challenges. SCOTUS’ decision also means that the ruling of the Court of Appeals for the Second Circuit stands. Earlier this year, in CHIP v. NYC, the Second Circuit affirmed the district court’s ruling that the owners (Plaintiffs-Appellants) failed to state claims for violations of the Takings Clause. The Second Circuit reasoned that “no provision of the New York City Rent Stabilization Law (RSL) effected, facially, a physical occupation of landlords’ properties in violation of the Takings Clause because the landlords voluntarily invited third parties to use their properties.” The Second Circuit also reasoned that the “RSL did not effect a regulatory taking because the landlords did not plausibly allege that every

owner of a rent-stabilized property suffered an adverse economic impact.” However, rent control distorts the housing market by acting as a deterrent and disincentive to developing rental housing, often expediting the deterioration of existing housing stock. While done under the guise of preserving affordable housing, rent control policies hurt the very community they purport to help by limiting accessibility and affordability. NAA will continue to advocate on behalf of its members and encourage policymakers to implement effective policy solutions to help resolve the nation’s housing affordability issues. ictor “Vic” Vacek Jr. is the 2023 Houston Apartment Association Hall of Fame inductee. Many would describe him as a strong business man with exceptional loyalty, superior commitment and an extreme dedication to this industry. Vic got his start in the industry as a maintenance man and has climbed up the ladder in a professional and honorable manner to be where he is today. Vic Vacek was raised on a dairy farm in a small town in Texas. He went to the University of Houston where he earned his B.B.A. degree in Business Administration. Once Mr. Vacek got his diploma in hand, he hit the ground running. He now is a Certified Property Manager, holds a Texas Real Estate Brokers License and an Oklahoma State Brokers License. He has a real estate background dating from 1969 when he was a member of the Vantage organization, where he was responsible for commercial property management. He managed over 1,600,000 square feet of retail/service area and over 2,000,000 square feet of industrial space. In 1977 he became President and General Manager of the Houston division of McKinney and Company, a Pittsburgh based real estate firm. Then, Vic founded Central Management Inc in 1978 where he still works to this day. CMI is a boutique firm specializing in commercial real estate property management and brokerage services. Management services include property, facility and construction management. Brokerage services include landlord representation, tenant representation, sales, asset valuation, real estate recovery and consulting advisory services. Mr. Vacek has been a Certified Property Manager for over 40 years and CMI has been an Accredited Management Organization “AMO®” since 1984. He is very involved in the commercial real estate community, where in 1982 he was selected “Manager of the Year” by the Houston IREM chapter; served as President of Institute of Real Estate Management “IREM,” Chairman of AMO® November 2023

You can find him on the weekends spending time with his family and working on that same dairy farm that he grew up on. Some things never change. Vic Vacek Jr. is not only deserving of the HAA Hall of Fame Award but his hard work and commitment to this industry speaks louder than any award could. When asked who his role model was he quickly, and strongly answered, “my wife”, but what he doesn’t know is that anyone he has crossed paths with in this industry when asked that question would just as quickly answer “Vic Vacek.” Where are you from and where did you grow up? My parents lived on a farm in Colorado County, near Weimar, TX. I was born in Weimar at the family farm at 5 a.m., in time for my Dad to milk cows for our dairy business. I spent my first 18 years in Weimar, then attended Wharton Junior College, then transferred to the University of Houston where I completed my Bachelor of Business Administration with a major in Finance. What was your first job in the apartment industry and how did you get your start? While in college, I started in the apartment industry as a maintenance man to earn extra money. After graduating and completing my military service, the same gentleman hired me as a property manager, which I couldn’t understand how a Finance degree could be used in property management, but I was totally wrong. Did you always want to work in the apartment industry? If so – why? My career led me to multifamily after my

military service. I was working in the industry and connected with numerous people working in the commercial field. One of these contacts was a commercial developer, and we formed a strong working relationship. What do you think is the secret to your success? I hope it’s not a secret and I attribute my success first to God, then family and Godgiven talents. I know believing in and honoring the Lord has directed me to successful projects. Having the support of my wife, Diane, and my family has definitely propelled my success. One of my gifts is being personable. I like people and enjoy working with people at all levels. A strong work ethic and enjoying hard work contributes to successful projects. It’s a bonus to have long-term devoted employees, several of whom have been with me for over 30 years. Who have been your role models throughout your time in the industry and who do you have to thank for reaching it to this level in your career? Fred Welling, my first employer, guided me into multifamily, along with my brother-in-law

Ron Scharck, Timberline Properties, both of whom got me involved with HAA in 1969, as they were apartment owners. Wyndham Smith, with Vantage, who hired me as a Commercial Property Manager from 1975 through 1977, and Tim Meyers with Allied Orion, who got me involved with HAA and networking with Board Members in 1994. I am grateful for each of these mentors for proper guidance and encouraging me to take initiative and follow roles in organizations that helped advance my career. How long have you been a HAA member and how did you get involved with the association? I joined, attended meetings and various HAA functions when I worked with Fred Welling starting in 1974. Fred interacted with HAA founder Harry Reed, Bill Dinerstein, Ted Dinerstein and Lester Prokop, and dragged me along. I have been associated with HAA for 45 plus years! You have chaired many committees during your time as a member – what has been your favorite? Which holds the most importance? Yes, I have chaired many committees during

my time with HAA! The Finance Committee (formerly the Investment Committee), Go-Getters, the HAA Expo, HAA/HAF Office Building Task Force (2004 to 2007), to name a few. My favorite and most unforgettable event was in the Fall of 1999 at the HAA Chili Cookoff. I had the opportunity to push Ronnie Finger around the event in a wheelchair and he could only speak using a trach speech device. He died shortly thereafter as a result of ALS. The reason this is important to me, it made me understand, regardless of how successful you are, only the good Lord knows when your number will be called - you never know your own destiny. What has been your favorite thing about HAA throughout the years? Best memory? The comradery with the past presidents and members, and working through the challenges of members not paying their dues are memorable. Most apartment associations always looked up to Houston as a leader in the industry, and still do today. What are some of your greatest accomplishments in the industry and in your personal life? Attaining CPM and AMO certifications and

“When I first became involved in the HAA, Vic was one of the first members I met. He was very welcoming and we always had a nice visit. being a Real Estate Broker since 1970 stand out. The development of The Franklin Apartments on Gessner Road from the ground up was a major accomplishment, as well as being on the team with Mr. Tom Miller that oversaw the Hollyview Apartments conversion from rags to riches story. Not only was the property transformed, we also led a transformation of the neighborhood. We continue to get rave reviews from the owner today! During 1988 to 1995, Central Management Inc. had 6,000+ units. I’ve been involved in more than 200 buildings, all garden style units. In Houston’s River Oaks Community, in the Upper Kirby District, CMI completed three major renovations at The Hermitage, an 11-story residential high-rise, over a 24-year period. CMI rehabilitated numerous other properties throughout the past 45 years. On a personal note, I got a commercial driver’s license at the age of 14 and drove the school bus for Bishop Forest High School. My major life accomplishment is being committed to my wife, Diane, for 53 years, and we’re still going strong! I love being a dad to our two sons, and granddad to six wonderful grandchildren. I’ve completed multiple marathons across the USA, and a 200-mile relay from Mt. Ranier to the Pacific Coast. I was a paratrooper in the military, making many jumps. Do you have any tips for those just starting out that want to end up in your shoes one day? You need drive and commitment. Gain knowledge by working with others. Continuously learn more than the required CE hours and get involved in HAA and other professional real estate organizations in your community. Were you surprised when you heard you were going to be in the HAA Hall of Fame, or did you see it coming? Oh my, was I ever taken aback! I had never given any thought to being in the Hall of Fame, so I was shocked when Gary Blumberg, Ken Bohan and Jerry Winograd appeared in our lobby area with balloons and wine! Then reality sank in, and the moment brought tears to my eyes! You are now a Hall of Fame inductee – what’s your next step? I will pass the baton to my son, Trent, and spend more time with my wife. I plan to stay active and keep promoting HAA for the foreseeable future! Award-winning HAA IROP member talks shop Ramon M. Nunez didn’t always know where his journey would lead him, but he did know he was going to work hard to get there. Ramon has lived in Houston his entire life, so it was no surprise that this local was a proud Cougar at the University of Houston in 1997. It was in college that Ramon started on his journey into this industry. From moving to Iraq to perform FOB project management and regional operations that supported the U.S. Department of Defense, State Department and Special Forces, to meeting his wife in 2009 and getting married in Europe, to 2014 where he and his wife took a leap of faith to become entrepreneurs. Ramon then got his start in this industry in 2015 when he joined the Houston Apartment Association and has been an Independent Rental Owner since 2019. Since 2019 Ramon and his team has been named HAA Independent Owner of the Year, Property of the Year, Maintenance Technician of the Year, NAA Independent Owner of the Year and TAA Independent Owner of the Year. He holds several certifications within HAA and continues to be involved on a local, state, and national level. With his work experience and education he has gained over the years and an amazing team behind him, he has turned the American dream into his reality.

Since 2015 How many years have you been an Independent Rental Owner (IROP)? Since 2019 What made you want to get involved in this industry? In 2015, my wife and I discovered a real estate group in Houston called Lifestyles Unlimited. In this organization, we learned how to purchase single-family and multifamily properties. We started our journey to build a real estate business and leave a legacy for our future family. There are so many appealing traits to real estate. Whether you were getting started with singlefamily homes or apartment communities, real estate has less barriers of entry to start by using leverage to purchase properties, plus we could control our financial outcomes with increasing the NOI over time in correlation with market appreciation. Furthermore, many successful members in our real estate group were active members of the Houston Apartment Association for many reasons. How and when did you find HAA and what did HAA do for you and your company? Since many successful members in our real estate group were active members of HAA, this was a perfect partnership for us to build our business. HAA helps close the learning curve for new and seasoned IROPs with updated laws, local guidelines, national initiatives and many

news updates. HAA had additional in-depth education regarding fair housing guidelines, Leasing 101 process, political advocacy, credential programs, IROC programs, supplier’s connections, professional development and endless industry knowledge at the tip of our fingers. HAA had leadership conferences and expos to attend as well as opportunities to get involved with the Texas and National Associations. If you are eager to learn the rental business, HAA has numerous resources to help anyone progress as a business leader. HAA taught me that we all need to work together as a unified group for the success of our industry. That includes local, state and national associations working side by side to address issues that can negatively impact our business and industry. I attended the TAA Day at the Capitol in Austin in 2015, 2017 and 2023. Being involved with our Political Action Committee opened my eyes to the great work our associations accomplish for us daily. The HAA PAC also participates in local and state political campaigns, helping candidates who support the apartment industry and its supplier businesses. HAA gave our company added confidence to perform our daily operations successfully. The training, networking, and leadership development help our team excel to the next level of professionalism. As a result, we earned local, state, and national recognition for our team’s hard work. What came before becoming an IROP, tell me about your work before? I graduated from the University of Houston with an Information Technology major and minor in Business Management from C.T. Bauer College of Business in 2004. I worked for one of the

From 2009 to 2012, I was a United States Government Contractor for Kellogg Brown & Root - KBR (sister company of Halliburton) in Mosul, Iraq (During “Operation Iraqi Freedom”) performing project management and regional operations supporting the Department of Defense, State Department, and Special Forces. We basically oversaw operating Military Bases. Working alongside our US military in a war zone and traveling the world has certainly expanded my mind in so many ways. My amazing wife and I met on project in Iraq and got married years later in Europe. Currently, we are happily married with an amazing 6-year-old son Leo and Benjamin which is now 3 years old. Entrepreneurship was always in our blood. I always wanted to be a business owner, entrepreneur and executive leading the charge in my own company. Our family instilled in us an entrepreneurial mindset and skills throughout our lives. When those skills were combined with our past work history, we found an industry that complemented our mission, talents, and abilities to be successful. How did you feel when you heard that you won IROP of the year? I felt excited and grateful for this team’s win. We live in the best country on earth that stands for freedom, entrepreneurship, family values, love of country, and a hard work ethic. I strongly believe, if anyone has the will power and fortitude to be successful in life, America is the land of opportunity for success.

In April, at the Texas Apartment Association Awards Dinner in Fort Worth, I sat with Anzer Gul Afghan. Anzer was a translator for the US Military from Afghanistan. He brought his family to America in 2016 and is now embracing our industry education, leadership skills and opportunities for the betterment of his family. He was awarded the TAA Maintenance Professional of the Year for his hard work and dedication to his profession. This is a prime example that the American Dream is still alive if you do the hard work, stay focused, earn your stripes and persevere to your goals.

Success is all about having a good team surrounding you. Our behind-the-scenes bookkeeper and accounting department is one of the brightest and most talented in the industry. She learned everything from day one on how to operate ResMan and had a tenacious work ethic to make sure her job was done correctly. We made sure to encourage additional training and we were patient with every team member to close the learning gap to make them better at what they do.

Tell me about the team behind you? With our Bravo Capital Management brigade, our onsite team members are the backbone to our success. My maintenance technician has been with us for seven years and is one of the best in the industry. We have encouraged additional training every year to help him achieve his personal goal of becoming the best at what he does. He takes personal pride in his job, and it shows every day. He is from an impoverished country with no advancement opportunities. When he joined our team in 2016, we made sure to help him with industry training to suc-

A few years ago, we welcomed our new community director to manage our portfolio in Spring Branch. We greeted her with open arms and encouraged additional education from HAA. We realized she was a superstar that needed a good work environment to flourish and to be even more successful than her previous post. Today she is one of the best in the industry and has been recognized on a local and state level for her accomplishments.

Then we have our asset management group that includes bankers, insurance agents, property tax consultants, utility vendors, brokers and mentors to seek advice and guidance. This is another crucial strategic process that is important to master since it helps with planning and forecasting your business financial projections. Our trade associations and partnerships include the Spring Branch Management District, Seal Security, District A City Council Member Amy Pecks Team, City of Houston, Houston Police Department, Houston Fire Department and our amazing Houston Apartment Association team. What sets you apart from the rest in this category or in general? I’ve worked alongside many people from all over the world in numerous industries and countries. I’ve been in the business world for many years. I have networked with various successful people and have been involved with many associations and organizations. In my opinion, what “sets people apart,” is the self-motivational, purpose driven reason why they do what they do. The fire in their belly that makes them get up every morning to be the best at what they do is in their DNA. When I was single, my motivation was to be a good example to my future family. When I got married and had kids, my motivation was to be a good husband provider, caring father figure and good example to my family. We are on this earth for a short period of time. We measure our success by how many people we have helped along the way and the good example we set for our family. Setting purpose driven goals for the right reasons gets you on the fast-track to accomplishing your mission. Don’t compare yourself to others and keep your goals in front of you with razor sharp focus.

What is your end goal? Our end goal would be to build our family business and teach our sons the options of having your own business. I also had a dream to build a fifty-story skyscraper and a master development community. I think those plans are in reach with the right planning and foresight.

What is your 5-year plan? Our plan is to keep building the property portfolio with quality acquisitions in strong submarkets, quality properties and continue good operations. In addition, every property we have and acquire will need to be HPD Blue Star Certified

Who do you have to thank? This business is a team sport. My wife and I would like to thank our family for the encouragement, support and motivation. were being adjudicated. Paxton had been only the third Texas elected official in history to be impeached by the state, with the two others being removed from office. Having been removed from his duties since the Texas House of Representatives voted 121-23 to impeach him in May, Paxton was reinstated and able to resume his duties as AG following the acquittal. This episode, in Paxton’s history of scandals as an elected official, stemmed from a request he made to the Texas House in February asking for the state to pay for a $3.3 million settlement his office negotiated with four of the whistleblowers who alleged they were improperly fired for reporting him to the FBI. The agreement was rejected by the Legislature. It did initiate an investigation by the House in March to determine whether the original whistleblower claims against Paxton of bribery and corruption had merit. The findings of the House investigative committee, which were released in May, were that Paxton had likely broken numerous state laws, misspent office funds and misused his power to benefit Austin Developer Nate Paul, his friend and political donor. The Texas House voted overwhelmingly in favor of 20 articles of impeachment related to these findings, as well as four associated with a securities fraud case that Paxton was previously indicted for and awaiting trial. This action set up the trial to be held in the Texas Senate, with the Senators serving as the jurors and the Lt. Governor as the judge. The trial was scheduled for September and rules were determined by the Senate. Both sides hired teams of high-profile attorneys to try the case. The prosecution published nearly 4,000 pages of evidence supporting the claims that Paxton had misused his office by helping Nate Paul investigate and harass his enemies, delay foreclosure sales of his properties and obtain confidential

records on the police investigating him. Ultimately, after two weeks of trial, the Senate voted to acquit Paxton. None of the 16 articles received more than 14 of the required 21 votes to convict, with only two Republicans voting in favor of any the articles. The trial and impeachment proceedings have increased the rift between the House and the Senate, with both sides alleging bias and impropriety in how it was conducted. We will have to wait and see how this will impact the

ability of our lawmakers to pass meaningful legislation in Austin.
