Dear Members,

The Malaysian interior industry has faced unprecedented challenges over the last two years amidst the volatile business landscape. However, 2022 has been encouraging as the engines of business and economy have begun to pick up momentum. This augurs well for us in the interior industry as we get the opportunity to once again increase our participation in Malaysia’s economic activities.

Over the last several months, MIIP has been actively engaging our members through various webinars, charity events and social gatherings. We have had the opportunity to listen and learn from many industry experts and professionals who have advised us and provided us tips that are relevant to our business.

Just to name a few – to help our members achieve the necessary accreditation required for the industry, we organised a webinar on the Certified Construction Management Accreditation Programme (CCM) Level 5. In our Educational Series, we also engaged with interior industry businessowners on the topic of employee lay-off so that all parties involved are fairly treated in such a process. The live webinar on SME grants under the BAP 3.0, was an eye-opener for many businessowners, especially the RM400,000 allocation per company, which is very helpful in reviving businesses that have been adversely impacted by the pandemic.

We also had the pleasure of welcoming En Nazruddin bin Mat Ali from the Department of Occupational Safety and Health (DOSH) to share with us on OSHWA and OSHCIM safety and health requirements in the workplace as well as the necessary steps to take to comply with government regulations for our interior and construction projects. On this topic, we also hosted another webinar on Environmental, Health and Safety (EHS) to provide our members with the basic understanding and how to implement EHS.

Recognising the importance of understanding the roles and responsibility of interior industry players in relation to the CIDB Act 520, MIIP held a webinar to explain the dynamics of this Act and clarify the necessary parameters. We also co-ordinated a learning session with PERKESO who expounded on the introduction of Budget 2022 and PERKESO’s support scheme for employees.

In April this year, we hosted the MIIP Bowling Tournament 2022, which saw an encouraging participation. On that note, our hearty congratulations to the winners and we hope that every MIIP bowler had a great time. We hope to organise more of such events and activities so that our members can benefit from the interactions and networking opportunities. This year, we had the opportunity to host a factory visit to Space Products Sdn Bhd’s premises. It was an enlightening experience and we are grateful to our member company for welcoming us.

members and I visited Rumah Juara to deliver our contributions of cash and kind to the home. We made a cash donation of RM1,200 as well as new power sockets, changed padlocks and window locks, changed wooden doors and patched the cement floors.

In September this year, MIIP and TAC Malaysia are jointly organising a business collaboration event, connecting and driving collaboration between Malaysia’s most forward thinking architects, interior designers and building industry stakeholders. This 1-to-1 business meeting will take place from 13 – 14 September 2022 at Manhattan Ballroom, Berjaya Times Square. Come and join us there.

The much-awaited MIIP 12th Anniversary Gala Dinner and 2022 Interior Industry Awards is here, and I express my sincere gratitude to all our award participants, members and industry partners who have made this event possible. VISION, MISSION AND CORE VALUES ARE KEY SUCCESS FACTORS

Tony Leong attributes Sunray’s success to its vision – he said, “Our vision is to be an integral part of iconic structures across every city in the world. We aim to undertake every project, especially iconic projects, that are within our capability both regionally and globally.”

“Sunray’s mission is to be the industry’s shining beacon in how we build our people, execute our projects, and grow with our partners. We are not undertaking projects, instead it is a full cycle whereby we help our clients to expand and upgrade their businesses as well as create a revenue stream for them by constructing the assets and facilities to drive their businesses,” explains Tony.

Another contributing factor to Sunray’s success and one of the key building blocks for every Sunrayian is the company’s core values – Teamwork, Innovation, Pride, Perseverance, Safety and Care.

Founded in 1987 by Mr. Tan Teng Huat, as a family-run carpentry business, Sunray has grown in leaps and bounds to capture international markets across Asia.

As Chairman of the company, Tan grew the business from just less than 20 employees undertaking carpentry works, to become one of the largest full-fledged interior fit-out as well as addition and alteration (A&A) specialist today.

Elaborating on Sunray’s progress over the years, Tony says, “Along the years, with the leadership of our Chairman Mr. Tan and continuous guidance from Group CEO Ms. Connie Wu, the group has grown and expanded until today, into a fullfledged main contractor in the region covering building works, structural, architectural, and interior fit-out works, as well as major alteration and addition (A&A) works.”

Sunray’s unique selling proposition is its high brand recognition in the market, attributed to successfully completing more than 1,400 projects over a span of 35 years across several countries, making it a sterling brand in the market.

“One of our advantages is that we started as an experienced 40-year-old carpentry manufacturer, We also have our steel manufacturing factory. For every project, we are committed to deliver different designs. With our expertise and our vast knowledge and experience, we delivered every project successfully – and that creates a strong portfolio,” he elaborates.

“As quality of life improves with technological advancement, the quality of the construction services also has to follow suit. With that, our brand and expertise as well as our strong capacity has given us the opportunity to fulfil our clients’ demands and needs across the region,” he adds.

EXPANSION

Over the last 35 years, Sunray has expanded its footprint from its headquarters in Singapore into Malaysia, Shanghai, Myanmar & Indonesia, offering integrated services including commercial interior design fit-out, property rejuvenation, design and build services, addition and alteration, value and cost engineering, customised manufacturing, feasibility studies and mechanical, electrical, and plumbing services.

The company is credited for delivering spectacular fit-out works for hotels, restaurants, banks, offices, retail stores and museums. Sunray’s iconic clients include Resorts World Sentosa and Marina Bay Sands in Singapore, as well as Alila Hotel, Renaissance Hotel and Parkroyal Hotel in Malaysia, among others.

Having been in Malaysia for the last 10 years, Sunray has three offices located in Kuala Lumpur, Johor and Penang.

MALAYSIAN MARKET

Talking about the Malaysian market, Tony reflects, “Malaysia is a wide country,

we have east and west Malaysia, the east coast, central, southern and northern regions, so geographically as a contractor we have to localise our business offerings to cover every region in Malaysia. The country is still a very hot and emerging market where the interior design and construction industry is concerned, with really high needs.”

Looking at the bright prospects presented by the Malaysian market, he adds, “After the pandemic and as business recovers, the market is going to be really busy.”

SUNRAY’S UNIQUE SELLING PROPOSITION

Sharing about Sunray’s unique proposition, Tony explains that one of the company’s offerings include adding and enhancing the value of existing un-utilized buildings.

“We propose to our clients on how to enhance the building to regain back the value to the asset. So far, this is a very niche market and not many provide this one-stop redevelopment service,” he highlights.

Sunray has carried out several redevelopment projects for hotels such as

Hilton Garden Inn in Kuala Lumpur, which was an abandoned and incomplete building.

“We put up a planning proposal, rebranded and reconstructed it, and obtained the necessary approvals from the authorities to complete the building. Currently, we are also working on the redevelopment from an existing office building to a five-star luxury hotel at Jalan Sultan Ismail.” Tony reveals.

Tony highlights that the Malaysian market holds excellent prospects where

asset enhancement is concerned. With Sunray’s expertise in asset redevelopment, the company is ready to help asset owners and investors add and enhance the value of existing assets.

“We have been in Malaysia for 10 years and we are building our clientele. We have many recurring customers who believe in us after we have delivered their projects in the past. By having our customers’ trust to continue, we are committed to provide the best quality and best value in products to them,” says Tony.

“As for potential customers, we have delivered several iconic projects that gives us good brand recognition. Therefore, there are more enquiries from potential clients, and our doors are always open to explore prospects with potential clients. We want to understand every need that our clients have and their expectations,” he adds.

“Our track record is proven and the awards we have won are testament to our

achievements. We aim to maintain the win-win situation with our clients whereby our goal is to complete the project and maximise their investments,” Tony continues.

To-date, the group records a revenue of RM1.2billion or SGD350 million. According to Tony, Sunray’s ability to employ 800 employees is one of its biggest achievements as it is able to provide an income and livelihood to 800 families and individuals.

SUNRAY’S FUTURE DIRECTION

Talking about the future, Tony shares that Sunray aims to leverage on tech and big data to improve construction efficiency and to create greater value for its clients. The company hopes to reduce labour-intensive factors and drive higher efficiency in its projects. Sunray has invested significantly into augmented reality and virtual reality.

THE BENEFITS OF SME GRANTS FOR BUSINESSES

In his welcome message, Herbert Koh, Vice President of MIIP said that there is an allocation of RM400,000 available to SMEs to ramp up their business and drive productivity, and that SMEs should capitalise on this opportunity. He also introduced the speaker for the day, Czarif Chai Abdullah, Senior Director, Business Advisory & Support Division, SME Corporation Malaysia.

Czarif, holds a Master of Business Administration (MBA) from UPM Malaysia specialising in corporate governance. He also has a Graduateship with the Malaysian Institute of Chartered Secretaries & Administrators (MAICSA). Czarif is a qualified Mechanical Engineer from UPM and has been with SME Corp since 2006 where he is involved in diverse financial and technological support development programmes for Malaysian SMEs. He is also the winner of Chairman’s Award

which has led to his admission at the prestigious Stanford Business School to complete the Leading Change and Organisational Renewal Program (LCOR). He was also awarded the Best Business Counsellor and Best Business Counsellor Trainer by Japan International Cooperation Agency (JICA), and was appointed as Head Business Counsellor providing advisory to help nurture competitive, innovative and resilient SMEs in Malaysia.

BAP 3.0

In elaborating about BAP 3.0, Czarif explains that BAP 3.0 is a 5-year plan that is in line with the 12th Malaysia Plan 2021 –2025. BAP 1.0 commenced in 2011 until 2015, followed by BAP 2.0 from 2016 – 2020. Formerly known SMIDEC, SME Corp is wellknown as a government engine that provides financial grants to SMEs.

Czarif explains that SME Corp is the Central Coordinating Agency that manages the implementation of SME development programmes across 17 ministries and more than 70 agencies. SME Corp reports to the National SME Development Council (NSDC) chaired by the Prime Minister.

SME CORP’S MANDATE

SME Corp is driven by its vision to be the premier organisation for the development of progressive SMEs to enhance wealth creation and social well-being of the nation. Meanwhile, the agency’s mission is to promote the development of competitive, innovative and resilient SMEs through effective coordination and provision of business support.

“SMEs are very important as they employ 7.3 million people in the country, thus putting food on the table for millions of families,” stresses Czarif.

Headquartered in Kuala Lumpur, SME Corp has 12 state offices across Malaysia to provide advisory and outreach, support implementation of SME programmes and to monitor and coordinate SME development.

“Representing 98.5% of business establishments in Malaysia, SMEs are the backbone of the economy,” said Czarif.

He adds that there are 907,065 registered SMEs in Malaysia, of which 76.5% are microenterprises, with 21.2% smallsized enterprises and 2.3% medium-sized enterprises, while 20.6% are women-owned businesses. Close to 35% of SMEs are based in the Klang Valley.

allocation of RM17.21 billion. BAP is one of the 228 programmes,” highlights Czarif.

SCORE

“For all of SME Corp’s programmes, we use the SME Competitiveness Rating for Enhancement (SCORE) with customised parameters that vary across sectors, to measure the current condition of the company before providing assistance. SCORE will once again be conducted after assistance is provided to measure whether or not the assistance provided is beneficial,” he shares.

SCORE is a diagnostic tool to rate and enhance competitiveness of SMEs based on their performance and capabilities. The 7 parameters assessed include business performance, financial capability, management capability, production capability, technical capability, quality systems and innovation.

The SCORE ratings are kept confidential and not shared with any other parties except to the particular company that is being assessed.

ASSISTANCE OFFERED UNDER BAP 3.0

Under this programme, financial assistance is available in two forms, namely matching grants of up to a maximum of RM400,000, and soft loans of up to RM1million.

Under the matching grant, 50% of total approved cost (amount of financing) will be determined by SME Corp. The matching is grant is available on a reimbursement basis whereby the SME would need to fork out RM800,000, after which, if the SME is eligible, SME Corp will match that amount with an RM400,000 matching grant. The eligibility of financing for a single business entity is up to a maximum of RM400,000, with a tenure of up

to 6 months only. This grant is open to projects implemented 180 days or 6 months before the date of online submission. Fifty percent of the total approved cost is allowable to be disbursed to suppliers. Processing fees for this grant is RM500 for SMEs and RM300 for micro-SMEs.

As for soft loans, the financing limit is from RM50,000 to a maximum of RM1million with a profit rate of 4.0%. Under this scheme, the margin of financing for fixed assets and working capital is 90%. The financing tenure is up to 10 years inclusive of a grace period of up to 24 months for fixed assets; while the tenure for working capital is 7 years inclusive of a grace period of up to 12 months.

QUALIFYING CONDITIONS

SMEs are required to undergo an SME status certification, and fulfil the SME definition. Annual sales turnover has to exceed RM300,000 per year. The SME has to have a minimum of 60% local equity with a valid business premises license from local authorities. Also, the SME has to be willing to undertake the SCORE/MCORE assessment.

Priority will be given to SMEs that are paying taxes, have a minimum paid up capital of RM30,000, and cash at bank of at least 20% of the project value. Also, the SME has to have a ratio of local workers against foreign workers of at least 70:30. Projects with high value added / contribution to increased productivity are also prioritised.

The scope of the matching grant includes renovation for certification and quality management systems such as HACCP, HALAL and GMP; packaging and product packaging; branding development and promotion; productivity and automation; and, online applications, mobile eCommerce, ePayment and ICT applications.

The application for BAP 3.0 is open from 1 – 30 September 2022. Applicants must have the approved SME status before application and undertake SCORE. Project planning can start immediately and preparation of relevant documents is encouraged to be done well ahead of submission.

Responding to a question on whether or not grants will be provided for ISO implementation, Czarif said ISO certification that require renovation is applicable. To another question on whether the matching grant will be provided for businesses dealing with supplier from overseas, Czarif responded that it is permitted because the grants are on a reimbursement basis, which means the business has to purchase and operate the machine and later submit for reimbursement to SME Corp.

MIIP EDUCATIONAL SERIES: LEGAL ASPECTS OF EMPLOYEE LAY-OFF

Sean Lee, Consulting Director, inTalent Consulting Sdn Bhd, shared about the various aspects of retrenchment.

Tong, MIIP President welcomed the attendees to the session and introduced Sean. In introducing the topic, Sean highlighted that there is a difference between “contract of service” and “contract for service”, which are commonly used in organisations today.

“Contract of service” bears a “masterservant” relationship which involves an employer-employee structure where there is an appointment letter or letter of employment to hire an individual. The completion of contract is the consideration which comes in the form of payment for service or product. In the case of the employer-employee consideration,

the employer commits to pay wages while the employee commits time and effort to the organisation.

Meanwhile, “contract for service” involves vendors that offer services or products to the organisation in exchange for payment.

According to Employment Retrenchment Notification 2004, all employers are required

to report to the nearest Department of Labour before taking actions such as retrenchment, voluntary separation scheme (VSS), temporary lay-offs, and salary reduction. The employer must submit FORM PK to the nearest Department of Labour at least 30 days before the said actions are taken. Employers who fail to undertake this process are committing an offence according to Section 63 of the Employment Act 1955 and shall be liable to a fine not exceeding RM10,000 for each offence.

Sean explains that lay-off exercises involve 8 key steps that include holding a townhall session for employees to inform them of the intention to lay-off; making an application to the Labour office; 1-to-1 sessions with the affected employees; submission of the second time to the Labour Office; obtaining the affected employees’ profiles to be sent to competitors; preparing pay-out based on retrenchment benefits; send them to PERKESO-certified trainers for reskilling; and, making a final submission to execute the retrenchment. He also highlighted that PERKESO has a compensation programme called EIS which compensates employees according to a pre-set quantum.

To a question from the floor on Voluntary Separation Scheme (VSS) and Mutual Separation Scheme (MSS), Sean explains the first employees to go during a retrenchment exercise is the foreigner or the last person that came in. He elaborates that after the retrenchment exercise the employer is not allowed to hire any new employees for the next six months. In the event that hiring is needed, the employer has to rehire the retrenched employees first. Sean says that VSS is an exercise whereby the company calls for volunteers to offer themselves up for retrenchment, and the company is not allowed to make selections, thus whoever wants to be retrenched has to be released. Meanwhile, MSS involves approaching certain employees and seeking for them to agree to a mutual separation with a specific compensation.

Sean also shared measures that employers can take to avoid retrenchment. This includes freezing recruitment of new workers except for critical areas, limiting overtime work as well as work on weekly rest days and public holidays, reducing the number of shifts or daily working hours, providing workers with retraining, identifying alternative jobs,

and carrying out temporary lay-offs. Other measures include implementing pay-cuts fairly at all levels, and identifying vacancies in other companies to be offered to workers who will be retrenched.

Sean explained that the guidelines that employers should follow when retrenching employees include taking into consideration the employee’s abilities, experience, skill and occupation qualifications, age, family situation, length of service, status (noncitizens, casual, temporary or permanent). A few common industry practices to retrench employees include the FWFO principle (Foreign worker – first out), and the LIFO principle (Last In, First Out).

In sharing a case study, Sean advises employers to never discriminate women who are pregnant. The case involved an organisation who removed an employee who went on early maternity leave, while in the midst of her contract. The employee won RM346,000 for the breach of constitutional rights. He ended the session by cautioning employers to be just and carry out periodic performance reviews in order to be fair to employees.

CERTIFIED CONSTRUCTION MANAGEMENT ACCREDITATION PROGRAM (CCM) – LEVEL 5

Nadzhatul Syamiru Usmaiza Othman, Pengurus, Unit Dasar & Strategik, Bahagian Dasar Personel Binaan, Lembaga Pembangunan Industri Pembinaan Malaysia (CIDB), presented on the certification programme which is in line with the Malaysian Construction Industry Development Board Act 1994 (Act 520).

The CCM session was aimed at motivating and encouraging MIIP members to undertake accreditation and certification programmes organised by CIDB, in order to drive a robust and dynamic construction industry in Malaysia. The webinar provided attendees with information, awareness and insights on CCM accreditation as well as the various areas and job scopes that have the potential to achieve accreditation.

Speaking about the programmes offered by CIDB, Nadzhatul said that the accreditation programme is aimed at creating competent standards within the industry; to ensure compliance with the Act Part 7 Section 33 (1); to assist CIDB to record and store certified construction manager data in a single database; and, to render CIDB’s support towards the elevation of Malaysian construction managers’ competency to a global level. The Act clearly

stipulates that skilled construction managers or site supervisors are to be certified by CIDB. Breaching the requirements of the Act is considered which an offence is liable to be fined not exceeding RM5,000.

Nadzhatul was accompanied by Hilme Hj Md Isa, General Manager, Unit Dasar & Strategik, Bahagian Dasar Personel Binaan, CIDB. In her presentation, Nadzhatul explained that CIDB is a government body that regulates the construction industry, under the purview of the Ministry of Works. CIDB was established under the Construction Industry Development Board Act 1994 (Act 520) (Amendment 2011) to regulate, develop and facilitate the construction industry towards achieving global competitiveness. She encouraged the attendees to get a copy of the Act which is available for the reference of industry players.

“CIDB governs the registration, certification and accreditation of personnel

involving contractors, construction personnel and even construction materials,” said Nadzhatul.

ACT 520

Nadzhatul shared about the various facets of Act 520, which also covers the interior design industry. She explained that building, improvements, dredging, maintenance and extensions as well as demolition is considered construction work.

On the aspect of categorisation of construction personnel, Nadzhatul clarified that this was relevant for personnel involved in general construction work, partial construction, construction specialists, site supervisors, construction project managers and various other personnel involved in construction work.

She highlighted key sections within the Act that are relevant to MIIP members. According to Nadzhatul, Part 1 Section 2(1) stipulates that

site supervisors must be well equipped with knowledge, skill and attitude that will provide them unlimited choices when seeking solutions to project supervision problems. In doing so, they must become one of the most resourceful persons – the critical element for project success. She pointed out that under the Act, no site supervisors were permitted to be engaged or employed unless they are accredited and recognised by CIDB.

Those found to contravene Part 7 of Section 33A (5) are committing an offence and are liable to be fined not exceeding RM5,000. Site supervisors or skilled construction workers that are not certified by CIDB and found to be working on a construction site are also in contravention to the Act and are liable to be fined not exceeding RM5,000. She stresses that both employers and employees will have to bear the fines respectively.

CONSTRUCTION SKILLS AND MANPOWER DEVELOPMENT

Nadzhatul explained about the process that has to be undertaken in order to receive CIDB’s accreditation.

COMPETENCY PROGRAMMES UNDER CIDB

The programmes encompass competency levels from 1 to 6, whereby Levels 1 and 2 cover general workers and skilled trades; level 3 covers trade supervisors; level 4 covers the supervisory level; level 5 is managerial such as construction managers; and, level 6 involves project managers.

Programmes from Levels 4 onwards are considered outcome-based programmes that encompasses expected attributes, learning outcomes mapping and rubrics.

Methods of accreditation include training and assessment, examinations, as well as recognised prior learning and experience.

The knowledge assessment and expectations for accreditation include understanding, applying, analysing, evaluating and creating. Nadzhatul also shared about the assessment grading and the criteria that were taken into account, as well as the minimum requirement to pass. The minimum passing score is 70%.

She pointed out that the certification was critical and mandatory for construction

projects above RM50million, while project managers handling construction projects below RM50million were encouraged to obtain certification. CIDB’s anticipated numbers for certified construction managers is 3,500 personnel with CCM accreditation.

Nadzhatul highlights that there are module differentiation for the various levels of expertise within the construction environment. This goes to show that the level of the content within the modules vary according to the demands of the job roles.

Sharing about the benefits of being competent, Nadzhatul explains that the priority is to ensure compliance to the Act, obtain industry recognition, and employment recognition through certification for career progression. She elaborated that competence also cultivates best practices within the industry while also recognising professional status through certification, contributing back towards the industry as well as inculcating professional practices.

MIIP Member Factory Visit at Space Products Sdn Bhd

More than 20 MIIP members, headed by MIIP President President Tong SL attended a factory visit at Space Products Sdn Bhd on Saturday, 23 April 2022. In his opening speech, Tong thanked Bella Chong, Managing Director of Space Products for the members of the association the opportunity to visit the factory to learn more about the products manufactured.

Bella Chong welcomed and thanked MIIP’s President and members for visiting the factory and for their interest in the company’s operations and products.

Karen Chong PF, Manager at Space Products, gave a presentation on the company’s wide range of products and took the entourage on a tour of the factory premises. The members had a great learning experience and posed questions on the manufacture of the company’s products.

As a token of appreciation for the warm hospitality and insightful factory visit, Tong presented Bella with a memento.

MIIP Charity Visit @ Rumah Juara

In reaching out to the needy and lending a helping hand to underprivileged members of communities, MIIP extended aid to Rumah Juara in Petaling Jaya. Tong S L, MIIP President and committee members visited Rumah Juara and presented a cash donation of RM1,200. The team also provided other items to the home such as new power sockets, as well as changing of padlocks, window locks and wooden doors. Additionally, damaged cement floors were also patched. The residents and staff of the home were delighted to receive the team and gave them a warm welcome. Rumah Juara is a charitable home for orphans, as well as abused and underprivileged children.

The team also distributed food and drinks to the children and management of the home. MIIP also took the opportunity to spend some time with the children at the home, interacting and getting to know them better over a delicious meal. This time, visitors to the home were only limited to 6 people per visit, and as the pandemic eases, MIIP hopes to get more members involved in its charity efforts and visitations.

MIIP Bowling Tournament 2022

MIIP held its annual bowling tournament recently, bringing members, partners and friends together for an exciting time of fun and camaraderie. The tournament saw an encouraging turn-out of enthusiastic bowlers who came out to give their best shot. The team from CAN.I Interior Fit-Out Sdn Bhd comprising Leong Chian Meng and Cheong Kong Fatt, emerged as the champion. Meanwhile, the first runner-up was the team from Sunray Malaysia represented by Steven Koh and Edward Lee. Sunray Malaysia was also named second runner-up, represented by Alex Leong and Azun Jaafar. Congratulations to all the winners! The day ended on a happy note and opportunities to interact and network.
