All vehicles transporting livestock will be subject to a documentation check before entry to market site.

All visitors and traders must ensure they wear clean clothing and footwear before entering market site.

All visitors and traders using car park areas please use main entrance.

Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.

Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.

No livestock will be allowed to remain on the premises after a sale.

Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.

Wash hands thoroughly when leaving pennage areas.

Please observe our staff’s instructions at all times. Our on site Biosecurity Officer, Stan Abbot, will only be too pleased to give you assistance.

General Information & Sale Notes LOCATION: The Sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6. HOTELS: There are many hotels within the area, ranging from four star to excellent Bed and Breakfast accommodation, a list of which may be found on page 4 of the catalogue. CONDITIONS OF SALE: The Sale is held under the General Conditions of Sale & Special Conditions, approved by the Council of the Belted Galloway Cattle Society. Any disputes arising shall be solely the responsibility of the vendor and purchaser. The Belted Galloway Society shall not be responsible in any form. INSURANCE: A representative of H&H Insurance Brokers, will be present at the sale and will be pleased to quote Purchasers for transit and other risks. METHOD OF SALE: All cattle will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers. COMMISSIONS: The Auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions. SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of Sale. No animal may leave the Sale Premises without an official ‘Pass Slip’, obtainable only from the Auctioneers upon settlement. ANIMAL WELFARE: Vendors and Purchasers should note the CODE OF PRACTICE published by the Livestock Auctioneers’ Market Committee for England and Wales IS OPERATIVE IN BORDERWAY MART and that weakly, unhealthy or injured stock will be refused entry by the Auctioneers. Saturday 18th May Arrival of Stock 7am – 10am Judging of all classes 10.30am Sale 12.30pm ALL SHOW CATTLE MUST BE HALTER LED, ALL BULLS MUST BE HALTER LED AND HAVE NOSE RINGS WITH NOSE ROPES. All animals will be sold in guineas (105 pence) and a commission of 5% will be charged by the Auctioneers on all sales. A further levy of 1.5% will be charged and paid to the Belted Galloway Cattle Society. The proceeds of sale are guaranteed by the Auctioneers, who will account to Vendors on the day of the Sale. Such guarantee, however, does not extend to the animals sold for export, to which special conditions apply. RESERVE PRICES: Vendors shall have the right to refuse to accept the final bid for their animals. The auctioneers reserve the right to charge half commission on the amount of the final bid in the case of animals which fail to reach the Vendors reserve price. No animals may be sold privately before being passed through the Auction Ring and FULL COMMISSION will be charged on the sale of any animal sold by private treaty after the auction. All such transactions MUST BE PASSED THROUGH THE AUCTIONEERS’ OFFICE. STRAW: A limited amount of bedding straw will be provided by the Auctioneers free of charge. Additional straw, if required, may be purchased from the Auctioneers.

22 CONDITIONS OF SALE The sale is conducted under the GENERAL CONDITIONS OF SALE which are exhibited in the market, with the following Special Conditions, approved by the Council of The Belted Galloway Cattle Society, only for cattle registered by The Belted Galloway Society. Any disputes arising shall be solely the responsibility of vendor and purchaser. The Belted Galloway Society shall not be responsible in any form. 1. All animals entered for the Sale must be must be pedigreed and registered or accepted for registration by the Belted Galloway Cattle Society. The pedigree certificate to be used as entry form for the sale, Photostat copies will not be accepted. Entries “pedigreed – particulars at sale” will not be accepted. Only members of the Belted Galloway Cattle Society may sell cattle at sales held under the auspices of the Society. Animals registered in Appendix A will not be eligible for sale. 2. All animals entered for the sale should be bone fide property of the vendor and must be bona fide exposed for sale at the sale. Animals not bred by the exhibitor must be registered in their name with the Society. No substitutions of animals entered in the catalogue will be permitted. All animals winning prizes at any show held before the sale must be sold at the sale, or any prize money will be forfeited. 3. Immediately after the purchase is declared the risk of the animal shall be exclusively with the purchaser. 4. a. All Bulls offered for sale are sold with an implied Warranty that they are capable of getting stock by natural service. b. This Warranty shall not apply i. To bulls purchased for export unless fertility is proved as hereinafter provided before embarkation. ii. In the event of infertility being the direct result of injury, accident or illness happening after the date of Sale. iii. To bulls under the age of 9 months. 5. This warranty is subject to the following conditions. i. The bull shall be tried within two calendar months of the date of the sale or within two calendar months attaining the age of twelve months. ii. The Purchaser shall give notice in writing to the Auctioneers and to the Vendor of infertility or suspected infertility within three calendar months of the date of Sale or of the bull attaining the age of twelve months. And the Purchaser shall obtain a certificate from a Veterinary Surgeon declaring that the bull is ineffective at service and stating the reasons for such declaration. The Veterinary surgeon shall also certify that the infertility is not the result of injury, accident or illness after the date of the Sale, that he has examined the cows and heifers of the Purchaser and has found them in normal breeding condition, and that they are not responsible for the bulls infertility. iii. The Purchaser shall give the bull every opportunity of proving itself a stock getter throughout the guarantee period, and shall, if required, allow a Veterinary Surgeon to examine the bull on the Vendors behalf, and in addition shall if required, allow the Vendor to remove the bull in order to prove the bull a stock getter, such proof to be the decision (which shall be binding on the parties) of a Veterinary Surgeon to be mutual agreed upon by both Vendor and Purchaser or in default of agreement to be appointed by the Auctioneers. iv. In the event of it being proved that the bull is incapable of getting stock by natural service the Vendor shall be bound at the expiry of the guarantee period to:-­‐

a. Be bound to accept the return of the Bull. b. Pay to the Purchaser i. The purchase money or such part of it as he had paid. ii. The expense of transport of the Bull to and from the Purchaser’s premises. iii. Keep as recommended in Condition 11. iv. The expenses of the Purchaser’s Veterinary Surgeon. But the purchaser shall have no right to claim damages from the vendor in respect of any indirect or consequential loss such as (but not limited to) loss of profit or any other loss whatsoever.

Unless otherwise stated at time of sale any cow or heifer described in the catalogue as being in calf, due to calve, calving or accompanied by the bull, fail to be in calf, the vendor shall be bound to accept intimation has been made in writing to the auctioneers within four calendar months from the date of purchase. The vendor shall be liable to the purchaser for keep (see conditions 11) and transport. a. Any pedigree female sold at this sale as a maiden heifer is warranted by the vendor that it shall be fertile up to the age of twenty eight months, which warranty shall be deemed to be fulfilled as soon as such animal is certified by a Veterinary Surgeon to be not less than twelve weeks pregnant provided always that no claim under this warranty shall be admitted before the animal reaches the age of twenty four months. If such animal fails to get in-­‐calf then the purchaser must obtain a Veterinary Surgeons Certificate stating that the animal is suffering from an abnormality or malfunction of the reproductive system which will permanently prevent fertility. In any case such as this the animal will be sold by the purchaser with the vendor making up the difference between the purchase price and the sale price.

7. Heifers described in the catalogue as bulling and /or under the age of 18 months at the date of sale are warranted free of the bull, and any such heifer proving in calf, and providing that intimation of the complaint has been made in writing to the auctioneers within 6 calendar months of the date of sale, the purchaser may return the heifer to the vendor and the vendor shall be required to accept the return of such animal and to refund to the purchaser and the purchase price paid and shall be liable for keep (see condition 15) and transport. 8. Tests: All animals sold for export will be sold subject to having passed all the tests required for entry into the country to which they are being exported. The vendor intimates to the Auctioneers in writing, as soon as test results are known or no later than one and a half hours prior to the sale that he is not willing to comply with this condition. Should any animals be purchased for export the purchaser must, on the day of the sale notify the Auctioneers. The Auctioneers shall deduct the Export Cerificate Fee for all cattle sold for export. 9. The declaration of the Vendors Veterinary Surgeon that the animal has been tested and the result of such test shall be final and binding on both Vendor and Purchaser. a. If the animal be so declared to have failed any of the tests, the vendor shall be bound to accept the return of the animal and to refund the purchaser the price paid, the risk of the animal shall be transferred to the vendor from the date of the declaration of the chosen Veterinary Surgeon that the animal has failed any of the tests. Details of regulations currently applicable for exporting cattle to individual countries may be obtained from the Ministry of Agriculture and Fisheries. b. The expense of such test shall be borne by the purchaser (see condition 15) and transport. 10. Keep: Will be under General Condition of Sale of Harrison & Hetherington Ltd. 11. Where animals are sold for export and are kept by the vendor until shipping space is available in the absence of written agreement to the contrary, the vendor shall keep the animal free for six weeks from the date of the sale and thereafter shall be entitled to the cost of keep in accordance with the Conditions of Sale.

12. The particulars shown in the catalogue are furnished by the Vendor and are believed to be correct, but the Auctioneers accepts no responsibility for any mistake or error therein. Vendors must intimate before or at any time of the sale any mistake or misprint in their entry. 13. No undertaking of the Auctioneers or their servants to take charge of any animal after the sale, or to forward to its destination, shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions. 14. The Auctioneer is appointed judge of the sale, with the powers to the said Auctioneer to appoint an Arbiter, to whom are hereby submitted all disputes and differences of any kind which may arise from the Auction either between Exposers and Offerers, or among Offerers themselves. And his decision is final and binding in all parties, and all actions at law in relation thereto are excluded. 15. The auctioneers shall deduct the Export Certificate Fee for all cattle sold for export. At sales held under the auspices of the Belted Galloway Cattle Society, no animals shall be entered as sold through the ring unless it is forward on the day of the sale and sold on that day. All other transactions shall be treated as private sales. Clauses 7 and 8 will not apply to females purchased for export THESE AFOREMENTIONED CONDITIONS OF SALE ARE ONLY FOR CATTLE REGISTERED BY THE BELTED GALLOWAY CATTLE SOCIETY HARRISON & HETHERINGTON LTD EXPORT REQUIRMENTS NOTE TO ALL VENDORS It is pleasing to note that at recent sales buyers from Ireland and Germany have been purchasing animals to export. We now highlight the main criteria currently required to export animals. Whilst Irish buyers are required to make their own arrangements for keeping animals prior to export, animals purchased for Germany require to be taken back home by the vendors and tested by them, German purchasers will be charged £160+ VAT to assist with the vendors expenses. This will be passed to the vendor once the vendor has passed the relevant tests. The rules are as follows: -­‐ All animals (if>42 days) must be TB tested within 30 days of exporting. -­‐ Cattle destined for Germany must, in addition, be isolated for at least 30 days and tested clear of IBR. -­‐ Animals will require veterinary inspection 24 hours before travelling. -­‐ Animals may need to be treated with ‘Spot-­‐on’ before travelling; some Lorries may need to be treated prior to loading.


HEALTH AND SAFETY RULES HARRISON & HETHERINGTON LIMITED NOTICE TO ALL VISITORS AND TRADERS PLEASE READ AND OBSERVE THE FOLLOWING All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc.

AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions as recommended by the NBA) 1.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

2.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

4.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

5.

All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

7.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

8.

No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

9.

Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington. Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations. Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling. When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals. Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/ sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity. Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES. The auction ring man escapes and refuges must be kept clear at all times. All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.

10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter. 11.
