HOTELS: There are many hotels within the area, ranging from four star to excellent Bed and Breakfast accommodation, a list of which may be found on page 4 of the catalogue CONDITIONS OF SALE: This Sale is held subject to the British Blue Cattle Society’s Conditions of Sale, including the Terms and Conditions of Sale, incorporating Bull & Female Breeding Warranties. In order to deray the cost of implementing the warranty conditions, a levy shall be charge to the vendor for every pedigree animal cost - £5 + VAT INSURANCE: A representative of H & H Insurance Brokers, will be present at the sale and will be pleased to quote Purchasers for transit and other risks. METHOD OF SALE: All cattle will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers. COMMISSIONS: The Auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions. PEDIGREE TRANSFERS: Official Pedigree Transfer will be effected by the Auctioneers and the British Blue Cattle Society as soon as possible after after the Sale. Full Pedigrees will be transferred at a fee of £13.90 (+ VAT) payable by the vendor. SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of Sale. No animal may leave the Sale Premises without an official ‘Pass Slip’, obtainable only from the Auctioneers upon settlement. ANIMAL WELFARE: Vendors and Purchasers should note the CODE OF PRACTICE published by the Livestock Auctioneers’ Market Committee for England and Wales IS OPERATIVE IN BORDERWAY MART and that weakly, unhealthy or injured stock will be refused entry by the Auctioneers. Enquiries should be directed through the market office to the Auctioneers’ ANIMAL HEALTH and WELFARE OFFICER (Mr Andrew Templeton).

Important Notice to Vendors ARRIVAL OF STOCK: As per timetable of events (page 7). PRE-SALE INSPECTION: All animals entered for the sale must be available for inspection in the sale premises by a panel of inspectors, including a qualified Veterinary Officer. The Inspectors will have regard to general health and genetic defects, particularly mouth, teeth, eyes, testicles, locomotion and general conformation. Any animal discovered with a genetic fault, disease, disorder or is considered by the panel to be not in a proper and healthy condition to be presented as representing a good specimen of the breed will be REJECTED and the Entry Fee forfeit. Animals will be placed in a crush for this inspection - as required by the inspectors. No pedigree or grade registered stock, entered for the sale, shall have horns. Two Society Members will form an appeal committee, one of whom will be a society council member. The appeal committee will be elected prior to the sale. If any exhibitor feels the need to formally lodge an appeal against the result of an inspection, they must from the beginning speak ONLY to the Chief Inspector. He will then ask for a deposit of £20 from the exhibitor. The appeal committee will then carry out their own inspection of the animal and their decision will be final. The deposit will only be returned if the appeal is successful. RECORD WEIGHTS & HEIGHTS: All bulls will be weighed and measured by an official as an integral part of the pre-sale inspection procedure and the data will be displayed above the animals pen. EVERY ANIMAL entered for the SHOW and SALE must be halter trained and shall have no horns. Bulls must be led with a nose rope. Every animal entered for the sale must be provided with a serviceable halter, which shall become the property of the Purchaser. UK TAGS/TATTOO MARKS - All cattle entered for the Sale will have their UK Tags/Tattoo marks examined as an integral part of the pre sale inspection procedure. Any marks found to have faulty, incorrect or illegible marks will be REJECTED from the Sale. Vendors are therefore urged, in their own best interests, to examine the UK Tags/Tattoo marks of Sale cattle before the animal(s) leave their farm, so that faulty marks can be recitified in accordance with the required Society procedures. CONDITIONS OF SALE The sale will be held subject to the Auction Rules and Conditions of Sale drawn up by the British Blue Cattle Society: “No member shall withdraw from sale any animal catalogued for sale. Any member who, having entered an animal for sale under these rules, fails to bring that animal to that sale, must produce, either at the sale or by post to reach the Registered office of the Society within 7 days of the sale, a veterinary surgeon’s certificate accounting for such absence on grounds of health. Failure to produce such a certificate within the time stipulated will automatically render the member liable to a summary fine of £50 (imposed by the Council and subject to variation from time to time) in respect of each animal not brought forward. In addition, all entry fees will be forfeited, and no further pedigree registrations or entries for other sales will be accepted from that member until such fine or fines have been paid.” The proceeds of sale are guaranteed by the Auctioneers, who will account to Vendors on the day of the Sale. Such guarantee, however, does not extend to the animals sold for export, to which special conditions apply. UPSET PRICES - There will be an “upset” price of 1500gns on each bull presented for sale - i.e. if no opening bid of 1500gns is received for any particular lot that lot will be passed out of ring unsold. ALL REGISTERED CATTLE entered for the Show & Sale (Pedigree or Grade Register), also pregnant recipient cows or heifers will be sold in guineas (105 pence) and a commission 5% will be charged by the Auctioneers on all sale. RESERVE PRICES: Vendors shall have the right to refuse to accept the final bid for their animals, or to fix a Reserve Price, which must be notified to the Auctioneers in writing before or at the time their animal enters the Sale Ring. The auctioneers reserve the right to charge half commission on the amount of the final bid in the case of animals which fail to reach the Vendors reserve price. All animals will be sold in guineas (105 pence) and a commission of 5% will be charged by the Auctioneers on all sales.
9 No animal may be sold privately before being passed through the Auction Ring and FULL COMMISSION will be charged on the sale of any animal sold by private treaty after the auction. All such transactions MUST BE PASSED THROUGH THE AUCTIONEERS OFFICE. PRIZE MONEY: Will be withheld unless the winners are sold, either by auction or private treaty. STRAW: A limited amount of bedding straw will be provided by the Auctioneers free of charge. Additional Straw, if required, may be purchased from the Auctioneers. The British Blue Cattle Society’s Sale levy, amounting to 1% of sale price, will be deducted by the Auctioneers from the proceeds of sale.

Level 1:
This is directly equivalent to the previous CHeCS Accredited free status. Level 1 status is associated with the lowest risk source when buying in stock. They have had 3 or more clear consecutive clear herd tests. Health plan required.
Level 2:
Herds with level 2 status have had one or two clear consecutive herd tests. Health plan required.
Level 3:
Herds with level 3 status have reactors identified at the annual herd test, but these are no more than 3% of the animals tested. Health plan required.
Level 4:
Herds with level 3 status have reactors identified at the annual herd test, and these amount to more than 3% of the animals tested. Health plan required.
Level 5:
Any herd that is not carrying out the required testing or does not have a suitable health plan in place automatically falls into this category. Level 5 status is considered to be the greatest risk source when buying in stock.

INSPECTION CRITERIA AT SOCIETY SPONSORED SALES MINIMUM HEIGHT WEIGHT AND SCROTUM DIMENSIONS January 2013 This document is published to help members select cattle of the right type and specification, for entry into prestigious sales, held under the auspices of the Society. It also sets out criteria for the Society’s Volunteer Inspectors to work to, which in turn, facilitates uniformity across all Society sales. Apart from meeting the minimum standards stated below, pedigree cattle should also conform to the Society’s Bylaws, number 1.1 of which states: “The definition of the breed’s characteristics is as follows: A long, large bodied beef animal with fine bones, double muscle, sloping rump and hidden hips, strong legs and correct mouth. Coat colour can be black, white, blue, or any combination of these colours that is acceptable to the Council.” 1. The ear tattoo should be clearly legible and the letters and numbers agree with the pedigrees. Animals born after 1 January 1998 require no tattoo, on condition that they have been double tagged, as per Ministry regulations 2. Animals must conform to minimum heights and weights specified by the Society’s Council. See over for the detailed charts 3. Teeth and jaws should be correct in terms of position and bone structure. A degree of latitude shall be allowed where an animal is cutting teeth. The Chief Inspectors decision is final, with regard to acceptable jaw and teeth configurations. 4. The testicles and sheath shall be checked for correctness. Testicles should be of good conformation and consistency, with the epididymis showing definition. The minimum circumference of the scrotum between 10 and 24 months is shown overleaf. Animals over 24 months must have a minimum scrotal circumference of 32cm. 5. All animals must be in good, healthy condition and free from signs of infectious diseases, such as Viral Warts, Live Ring Worm etc. (A Veterinary certificate must accompany animals if previously treated, this treatment must have been carried out at least 14 days prior to the sale), Mange, New Forest Disease, Lice. 6. All animals should be able to walk correctly, on the day of inspection, with no genetic defects. The general mobility of the animal should be acceptable for practical use and not be detrimental to the breed’s reputation. Bulls with an exceptional conformation will be allowed a degree of latitude with regard to mobility The Council of the British Blue Cattle Society would urge all potential vendors to adhere strictly to these notes when entering cattle into official sales and to seek advice, prior to the sale, if they are uncertain as to whether an animal will pass. This will avoid the disappointment of any of their cattle being rejected by the Inspectors. Should any cattle be rejected, it is the vendor’s responsibility to ensure that the Lot Number is sprayed in red at the time of inspection. Such cattle may be sold privately from the pens, the sale going through the auctioneer’s books. Rejected animals may not be sold through the pedigree or commercial ring at a Society sale SAFETY A Vendor must not enter for sale, any animal with a potentially dangerous temperament. The Society’s Inspectors have the right to demand the immediate removal, from the sale and the sale premises, of any animal, which, in their opinion, demonstrates a temperament, which could be dangerous to the public x x x

All Animals Must Be Halter Trained No Animal Shall Have Horns It is a statutory requirement that any bull over the age of 12 months, sold through a public auction, shall have a ring in its nose The objective of the Official Society Inspection is primarily in place to raise the breed standard and the inspection panel’s decision is intended as a purchasers guide only. Prospective purchasers should satisfy themselves as to the suitability of an animal for their particular requirements. 14 NOTICE TO PURCHASERS The objective of the Official Society Inspection is primarily in place to raise the breed standard and the inspection panel’s decision is intended as a purchasers guide only. Prospective purchasers should satisfy themselves as to the suitability of an animal for their particular requirements. By bidding for an animal the intended purchaser accepts the Societies and Auctioneers conditions of sale, the animal being theirs at the fall of the hammer. The British Blue Cattle Society Guide to looking after your new Bull It is often, quite correctly said, that the bull is half the herd. This should mean that he is treated as being as important as all the other stock put together. What often happens, in practice, is that he is lucky if he is given half the care and attention that others receive. This is in spite of being possibly, the most expensive single animal in the herd. The first thing to do, when buying, or hiring a new bull, is to plan ahead. Do not rush out to find a bull today, because you want to use him tomorrow. First, be sure about what kind of bull you want and, how many you need and give yourself time to get the right ones. How many you need, depends, not just on the size of the herd but also on the breeding season. It is the number of cows per day, when working, which matters, not the total number of cows. Another reason for planning ahead is to allow time for the bull to settle in. Leaving home for a young bull is just as big a wrench, as it is for your children when they go to ‘big school’, or leave home. Some bulls are affected by the stress of travel, showing and the sale ring. Stress can disrupt the reproductive system. Some bulls will have poor semen quality for up to two months, following transport. By the time poor results are noticed and a vet, like myself, gets around to looking at the semen, the situation is back to normal. The wise farmer uses this period for quarantine and settling in. You should, of course, always buy bulls from a reputable source, for both quality and health. As far as reproduction goes – size does matter but it is the testicles, rather than any other anatomical feature. Scrotal circumference is a good ‘rule of thumb’ indicator of a bull’s capacity and you should be looking for 31cm+. However, remember that bulls are still maturing in this respect, up to 2 years of age, or so, so do not overtax them when young. Some bulls will be 18 months old, or more, before beginning to produce decent semen. British Blue bulls being warranted from 20 months. Give your bull a gentle introduction to the herd. Just give a small group of females at first, (preferably heifers, for a young bull). Young Blues are often unbalanced by their large backends, and, if they cannot get a good grip on the cow, will do an involuntary backward somersault, at the critical moment. Present a young ‘Blue’ with a large Holstein and you are in “It’s a business doing pleasure with you” territory! These are simply matters of common sense; a young bull will not have the capacity, skill, or psychological strength to cope with being suddenly turned out with a herd of large, bossy cows. Always keep a close check on your bull in the early days. Watch him to ensure he is not having problems with service and, that his libido is good. Check the females regularly for pregnancy. If there is a problem you need to know quickly. Finally, do not forget his psychological development. Few bulls are natural born killers. Those that turn nasty are mostly made so, by lack of attention and by only being handled for unpleasant purposes. Keeping a tractable, well-behaved bull takes time and effort. He should be handled and put through handling facilities regularly, for no reason other than to give him a reward. He should have comfortable quarters and his feet etc., should be well cared for. EXPLA ATORY OTES FOR CATALOGUES Only British Blue GROUP BREEDPLAN EBVs or INTERIM EBVs with Accuracy (Acc) can be validly compared between herds.
ESTIMATED BREEDI G VALUES (EBVS) The EBV is the best estimate of an animal's genetic merit for that trait.
ACCURACY An accuracy value is presented with every EBV and gives an indication of the amount of information that has been used in the calculation of that EBV. The higher the accuracy the lower the likelihood of change in the animal's EBV as more information is analysed for that animal or it's relatives. Accuracy below 75% should be considered low. CALVI G EASE Calving Ease EBVs are based on calving difficulty scores, birth weights and gestation length information. More positive EBVs are favourable and indicate easier calving. DIR: Direct calving ease indicates how this animal influences the birth of its progeny. DTRS: Daughterâ&#x20AC;&#x2122;s calving ease indicates how well the animal produces daughters that have easier calving.
BIRTH A D FERTILITY GL: Gestation Length EBV (days) is based on AI records. Lower (negative) GL EBVs indicate shorter gestation lengths which generally relate to easier calving and increased growth after birth. BWT: Birth Weight EBV (kg) is based on the measured birth weight of animals, adjusted for dam age. The lower the value the lighter the calf at birth and the lower the likelihood of a difficult birth. This is particularly important when selecting sires for use over heifers. SS: Scrotal Size EBV (cm) is an indicator of male fertility in regards to semen quality and quantity. Higher (positive) EBVs indicate higher fertility. There is also a small negative correlation with age of puberty in female progeny.
GROWTH MILK: 200-Day Milk EBV (kg) is an estimate of an animal's milking ability. For sires, this EBV is indicative of their daughterâ&#x20AC;&#x2122;s milking ability as it affects the 200-day weight of their calves. 200: 200-Day Growth EBV (kg) is calculated from the weight of animals taken between 80 and 300 days of age. Values are adjusted to 200 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth to early ages. 400: 400-Day Weight EBV (kg) is calculated from the weight of progeny taken between 301 and 500 days of age, adjusted to 400 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for yearling weight. 600: 600-Day Weight EBV (kg) is calculated from the weight of progeny taken between 501 and 900 days of age, adjusted to 600 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth beyond yearling age. MWT: Mature Cow Weight EBV (kg) is an estimate of the genetic difference in cow weight at 5 years of age. Smaller, or more moderate EBVs are generally more favourable.

CARCASE CWT: Carcase Weight EBV (kg) estimates the genetic difference in carcase weight at a standard age of 650 days. EMA: Eye Muscle Area EBV (cm2) estimates genetic differences in eye muscle area of a 300kg dressed carcase. More positive EBVs indicate better muscling on animals. FAT: Rib Fat EBV (mm) estimates the genetic differences in fat depth at the rib in a 300kg dressed carcase. More positive EBVs indicate more subcutaneous fat and earlier maturity. RBY%: Retail Beef Yield Percent EBV (%) represents total (boned out) meat yield as a percentage of a 300kg dressed carcase. A more positive EBV indicates higher percentage yield for the 300kg carcase size. IMF%: Intra-muscular Fat Percent EBV (%) is an estimate of the genetic difference in the percentage of intra-muscular fat at the 12/13th rib site in a 300kg carcase. Depending on market targets, larger more positive values are generally more favourable.
INDEXES An index combines the EBVs with economic information (costs and returns) for specific market and production systems to rank animals based on relative profit values. Note that the different types of animals can give similar profit values, so you should also consider both the index and the component EBVs when selecting animals for your production system.
BBB Carcase Profitability Index (£’s) - Estimates the genetic differences between animals in net profitability per cow mated for an example commercial herd targeting the EU market with no marbling requirement. All progeny are assumed to be marketed at around 550-580 kg live weight (280-320 kg carcase weight) at approximately 19 months of age. Bulls with a higher BBB Carcase Profitability Index will have a greater genetic potential to sire heavier finished progeny. As there are no maternal traits included in the calculation of the BB Carcase Profitability Index, bulls with a high Index will not necessarily be suitable for breeding heifer replacements. BBB Pedigree Breeding Index (£’s) - This index (£ per cow joined) targets herds that breed their own replacement cows and bulls and slaughter progeny from large framed cows. Steer progeny are slaughter at around 16 months of age at 620 kg live weight (360 kg carcase weight). The main EBV emphases are on weight, carcase retail beef yield and calving ease. The index estimates the genetic differences between animals in net profitability per cow mated for a herd targeting the EU market with no marbling requirement. With this in mind, the index also identifies suitable replacement breeding animals by also considering the maternal and fertility traits of the animal. Therefore, both direct and daughters calving ease are included in the index. This index is only reported for animals with at least moderate accuracy for the key traits. Animals must also be in the top 50th percentile or better for Calving Ease Direct, 400 Day Weight and Retail Beef Yield % EBVs. The British Blue GROUP BREEDPLAN Estimated Breeding Values contained in this Sale Catalogue were compiled by the Agricultural Business Research Institute (ABRI) from data supplied by the breeders. The British Blue Cattle Society draws purchasers and vendors attention, to the following Conditions of Warranty Bylaw, incorporated into its Bull & Female Breeding Warranty.
Conditions of Warranty Taking care to settle a newly purchased bull properly will assist in ensuring that you have many years of good service from him. Under the terms of the British Blue Bull and Female Breeding Warranty the purchaser is required to maintain the animal in normal breeding condition, in accordance with the rules and practice of good animal husbandry and management, as referred to in clauses 4.2 and 6.1 and 8.1.4.2. Following purchase the Society would require a purchaser to adhere to the following points to fulfil the requirement of ‘Good husbandry and management’ 1)
The bull is not used within one month of the date of purchase.
2)
Ensure that the bull is in ‘Breeding condition’ before use.
3)
When the bull is first used, try it with 1-2 smaller cows first, in a yard on a non-slip surface, so he is introduced to service gradually and safely. Observe him closely to ensure that he is inseminating the cow properly.
4)
Once you are satisfied that these cows are not returning then put the bull out with the rest of your cows. 20 to 25 cows is a maximum in the first year.
5)
British Blues are warranted fertile from 20 months of age. The Bull is not warranted if it is used prior to this age.
6)
It is a fact that ‘British Blues’ as a breed, sexually mature, 4-5 months later than some other Breeds. Please bear this in mind
Failure to observe the above could invalidate a claim under the Bull Breeding Warranty
It is a condition of sale, that where a warranty claim on a bull is upheld, that the purchaser shall agree to the Society or its agent, on behalf of the vendor, should it choose to do so, of having access to all calves that he has bred in the last 12 months, along with their dams if necessary, for the purpose of undertaking DNA parentage checks.

DEFINITIONS In these Terms: "FERTILE" in respect of a female animal means capable of conceiving by natural service and of carrying a calf for twelve weeks and the words "INFERTILE", "FERTILITY" and "INFERTILITY" shall be construed accordingly. 'INCAPABILITY' in respect of a bull means incapability of getting stock by natural service and the words "CAPABILITY", "CAPABLE" and "INCAPABLE" shall be construed accordingly. "MAIDEN HEIFER" means a heifer, which has never been served, by natural means or artificial insemination. "PURCHASER" means: a) the successful bidder for any animal in the sale, or b) the successful bidder together with such one or more persons with whom the said bidder is in partnership, or engaged in a joint venture, and whose names shall have been notified to the Auctioneers on the day of the sale "SERVICE" without qualification means both service by natural means and service by artificial insemination and the words "SERVE" and "SERVED" without qualification shall be construed accordingly. "SHIPMENT" means the sending or taking of an animal outside the United Kingdom.

“TERMS” means the standard terms and conditions of sale set out herein and (unless the context otherwise requires) include any special terms and conditions agreed in writing between the Vendor and the Purchaser in accordance with Clause 2.3 hereof. 2. 2.1

BASIS OF THE CONTRACT These Terms shall (subject to Clause 2.2 hereof) form the basis of the Contract between the Vendor and the Purchaser and from the said Contract all conditions and warranties implied under the Sale of Goods Act 1979 or any other statutory enactment or implied by law or custom are expressly excluded subject to the Unfair Contract Terms Act 1977 or any statutory re-enactment or modification thereof. These Terms may not be varied in any way except by an announcement by the Auctioneers before or at the time of the sale and, apart from such announcement, no servant or agent of the vendor has authority to make any representation, waiver or variation of or inconsistent with any of these Terms or to make any collateral contract or other arrangement to which these Terms do not apply. The British Blue Cattle Society does not accept any liability arising out of the use or application or form of these Terms. Only animals owned by a member of the British Blue Cattle Society and entered in the Herd Book of the Society or registers supplementary thereto shall be offered for Sale under these Terms. GENERAL WARRANTIES Each animal offered for sale has been bred by the Vendor unless otherwise stated in the Sale Catalogue or by the Auctioneers at the time of sale. The Vendor guarantees the identity, correctness of pedigree, history and description of each animal submitted for sale and contained in the Sale Catalogue (including all flushings for embryo transfer, caesarean operations and calvings recorded) save to the extent that any miss-description would be apparent on inspection or unless specifically amended by an announcement by the Auctioneers before or at the time of the sale. BULL BREEDING WARRANTY Subject to the provisions of Clauses 4.2, 4.3, 6, 8 and 11 hereof each bull over the age of ten months at the date of the sale is sold with a warranty by the Vendor that it is capable of getting stock by natural service from twenty months of age which shall be deemed to be fulfilled as soon as six Females or fifty per cent of the herd whichever shall be the lesser number of the animals put to the bull are in calf to the bull by natural service subsequent to the sale. TRIAL PERIOD. The Purchaser shall give the bull sufficient time and opportunity to prove itself capable of getting stock by natural service while applying the standards of good husbandry and management, including the Society’s “Conditions of Warranty” Bylaw shown below, and subject to Clause 4.3 hereof, in any event within six calendar months of the date of the sale or within six calendar months of attaining the age of twenty months (whichever is the later).

“Conditions of Warranty” Bylaw 1. The bull is not used within 14 days of the date of purchase. 2. Ensure that the bull is in ‘Breeding condition’ before use. 3. When the bull is first used, try it with 1-2 smaller cows first, in a yard on a non-slip surface, so he is introduced to service gradually and safely. Observe him closely to ensure that he is inseminating the cow properly, thus giving the opportunity to identify any possible problems at an early stage, this being very much in the purchaser’s interest. 4. Once you are satisfied that these cows are not returning then put the bull out with the rest of your cows. 20 to 25 cows is a maximum in the first year. 5. British Blues bulls are warranted fertile from 20 months of age. The Bull is not warranted if it is used prior to this age. 6. It is a fact that ‘British Blues’ as a breed, sexually mature, 4-5 months later than some other breed’s please bear this in mind. Failure to observe the above could invalidate a claim under the Bull Breeding Warranty

A claim for infertility or unsatisfactory mating performance will not normally be accepted, in the case of an inexperienced bull, until he has been allowed a minimum of three natural heat cycles with the females. DEFERMENT OF THE COMMENCEMENT OF THE TRIAL PERIOD. If upon purchase of the bull, it is found impracticable for the Purchaser to try the bull fairly, within the period stated in clause 4.1 above, due to the purchasers normal calving programme, the purchaser shall ON THE DAY OF THE SALE, or within the next seven days, give the auctioneer notice IN WRITING of the month in which it is proposed to commence using the bull. AT THE DISCRETION OF THE VENDOR (in consultation with the auctioneer, if applicable), the vendor may extend the date of commencement of the Trial Period to the first day of the month in which the Purchaser has notified the vendor as in clause 4.2. Acceptance or otherwise of the purchasers written request, shall be conveyed to the purchaser, by the auctioneer, in writing, within seven days of the request being made.

NB. The maximum time allowed for extending the trial period is three months from the date of the sale, or the bull attaining 20 months of age, whichever is the later. THE PURCHASER SHOULD NOTE THE TIME LIMIT FOR CLAIMS IN CLAUSE 8.1.2.1 BELOW.

Every cow or heifer described in the Sale Catalogue or by the Auctioneers at the time of the sale as "running with the bull" up to a date not later than twelve weeks before the sale is sold with warranties by the Vendor 5.6.1 that it is in calf, and 5.6.2 that it is in calf to the bull described in the Sale Catalogue or by the Auctioneers at the time of the sale, and 5.6.3 that it is in calf to a service date at any time between the dates stated in the Sale Catalogue or by the Auctioneers at the time of the sale and that the latest expected calving date will be within a period of 279 to 307 days of the last possible service date. FEMALES WITH VETERINARY SURGEON'S CERTIFICATE OF POSITIVE PREGNANCY DIAGNOSIS N.B. Scanning is not accepted as proof of pregnancy diagnosis less than 12 weeks. Every cow or heifer stated in the Sale Catalogue or by the Auctioneers at the time of the sale to be sold with a veterinary surgeonâ&#x20AC;&#x2122;s certificate of positive pregnancy diagnosis is sold with warranties by the Vendor. 5.7.1 that it is in calf, and 5.7.2 that it is in calf to the bull described in the Sale Catalogue or by the Auctioneers at the time of the sale and 5.7.3 that the expected calving date will be within a period of 279 to 307 days of the service date stated in such Certificate notwithstanding that the said cow or heifer would not otherwise be sold with the benefit of the above warranties. THE PURCHASER SHOULD NOTE THE TIME LIMIT FOR CLAIMS IN CLAUSE 8.1.2 BELOW

LIMITATIONS ON THE APPLICATION OF WARRANTIES None of the warranties in Clauses 4 and 5 above shall apply 6.1.1 to any cow or heifer which has been subjected after birth or is subjected after the sale to any process involving the technique of embryo transfer, unless that animal's subsequent natural breeding record (as declared in the Sale Catalogue) indicates not less than one natural calving since the said embryo transfer, unless specifically warranted by the vendor. 6.1.2 to any cow or heifer, which has undergone a caesarean operation (as declared in the Sale Catalogue) unless that animal's subsequent natural breeding record (as declared in the Sale Catalogue) indicates not less than one natural non-surgical calving since the said operation 6.1.3 to any cow or heifer which is declared by the Vendor to be a twin to a bull, unless before the sale pregnancy has been certified in

writing by a Veterinary Surgeon following rectal examination or the animal has produced a full term calf 6.1.4 to any animal, which has not been maintained by the Purchaser at all, times since purchase in a normal breeding condition, in accordance with the rules and practice of good animal husbandry and management 6.1.5 to any animal purchased for export outside the United Kingdom and the Republic of Ireland unless a claim shall have been notified within the time limits imposed by Clause 8.1.2 hereof and proved correct (after all examinations and procedures deemed necessary by the Veterinary Surgeon appointed under these Terms has been carried out) before the date on which shipment of the animal takes place. 6.1.6 to any animal, which has been rejected at the date of the sale by the British Blue Cattle Society, Society Inspector or Inspectors, appointed for the purpose of that sale 6.1.7 to any Bull that is used prior to twenty months of age. 6.1.8 to any animal which after the sale has contracted an illness or suffered an injury which may affect its fertility or capability as the case may be after the sale 6.1.9 to any animal, which does not remain the property of the Purchaser unless it was purchased by means of a hire purchase agreement and the title to, but not the right to possession of the animal has therefore been transferred to a finance or other hire purchase company 6.1.10 to any animal, which does not survive until the completion of all examinations and procedures, deemed necessary by the Veterinary Surgeons appointed under Clauses 8, 9 and 10 hereof. No warranty is given or to be implied that a cow or heifer will carry full term or deliver a live or viable calf. UDDER AND CLEANSING WARRANTIES Unless otherwise stated by the Auctioneers at the time of the sale. every cow in calf or in milk, and every heifer in milk at the time of the sale, is sold with a Warranty that it is sound in the udder and teats at the time of the Sale PROVIDED ALWAYS that any claim under this warranty shall be made to the Auctioneers not later than one hour from the close of the sale and if the Auctioneers in their absolute discretion (having taken such veterinary advice as may be appropriate) decide that the udder is not sound in all respects, the sale of such animal shall be cancelled, and every freshly calved cow or heifer is sold with a warranty by the Vendor that it has satisfactorily cleansed before the sale PROVIDED ALWAYS that: 7.2.1 any claim under this warranty shall be made, accompanied by a Veterinary Surgeon's Certificate, to the Auctioneers not later than three days from the date of the sale, and 7.2.2 without prejudice to the rights of the Purchaser set out in Clause 11 hereof, the Purchaser shall have the right to arrange such veterinary treatment to the animal (the cost of which shall be borne by the Vendor) as may rectify the animal's condition.

CLAIMS AND TIME LIMITS A claim by a Purchaser under any of the above warranties shall not be valid unless: 8.1.1 the animal remains the property of the Purchaser except where it was purchased by means of a hire purchase agreement and the title to but not the right to possession of the animal has therefore been transferred to a finance or other hire purchase company 8.1.2 the Purchaser shall have given notice in writing to the Auctioneers of the intended claim as soon as evidence supporting the claim comes to the Purchaser's notice and in any event within the following time limits: 8.1.2.1 Under Clause 4 in the case of a bull: within six calendar months: (a) from the date of the sale; or (b) from the date when the bull attains the age of twenty months; or (c) from the date of the commencement of the trial period stated in Clause 4.3 above whichever is the later date 8.1.2.2 Under Clause 5.1.1 and 5.2.1 in the case of a maiden heifer or a heifer recently served: (a) within three calendar months from the date of the sale; or (b) within one calendar month from the date when the heifer attains the age of twenty eight months whichever is the later date 8.1.2.3 Under Clause 5.1.2 and 5.3.2 In the case of a maiden heifer or a cow, which was sold as unserved, and which subsequently proves to be in calf: within twenty-six weeks from the date of the sale. 8.1.2.4 Under Clause 5.3.1 In the case of a cow sold as unserved since last calving and which proves infertile: within twenty-six weeks from the date of the sale. 8.1.2.5 Under Clause 5.4.1 In the case of a cow sold as recently served and which proves infertile: within twenty-six weeks from the date of the sale. 8.1.2.6 Under Clauses 5.2.2 and 5.4.2 In the case of a cow or heifer which, although not warranted to be in calf, produces a calf to a bull other than that stated to be the service sire: within fourteen days from the calving date. 8.1.2.7 Under Clauses 5.5.1. 5.6.1 and 5.7.1 In the case of a cow or heifer sold as being in calf or sold as running with the bull, and which proves not to be in calf: within twenty-eight days from the date of the sale. 8.1.2.8 Under Clauses 5.5.2. 5.6.2 and 5.7.2 In the case of a cow or heifer which, having been warranted to be in calf, produces a calf to a bull other than that stated as the service sire in the sale Catalogue or by the Auctioneers at the time of the sale as the case may be: within fourteen days from the calving date. 8.1.2.9 Under Clauses 5.5.3. 5.6.3 and 5.7.3 In the case of a cow or heifer which, although in calf, does not

calve to the stated service date: within fourteen days from the expected calving date. 8.1.2.10 Under Clause 7.1 In the case of a cow or heifer whose udder is not sound: within one hour from the close of the sale. 8.1.2.11 Under Clause 7.2 In the case of a cow or heifer which has not satisfactorily cleansed before the sale: within three days from the date of the sale. Claims Procedure 8.1.3 in the case of a claim under Clauses 4, 5.1.1,5.2.1, 5.3.1 or 5.4.1 the Purchaser shall within thirty days of the receipt of a Bull Fertility Report Form or a Female Fertility Report Form as the case may be, return it to the Auctioneers, completed by a Veterinary Surgeon appointed by the Purchaser 8.1.4 the Veterinary Surgeon appointed in accordance with sub-clause 8.1.3 hereof certifies in writing that: 8.1.4.1 the animal is in a normal breeding condition, and 8.1.4.2 the animal's infertility or incapability as the case may be is not due to illness contracted or an injury suffered, or poor husbandry, after the ‘fall of the hammer;’ and 8.1.4.3 in the case of a bull he has examined the cows and heifers on which the bull has been tried and has found them to be in normal breeding condition and that they are not responsible for the bull's incapability, or 8.1.4.4 In the case of a cow or heifer, he has examined any bull with which 0the cow or heifer has been running after the sale and has found the said bull to be capable of getting stock by natural service 8.1.5 In the case of a claim under Clause 5.1.2, 5.3.2, 5.5.1, 5.6.1, or 5.7.1 the Purchaser shall when notifying such claim, forward to the Auctioneers a Certificate from the Purchaser’s Veterinary Surgeon certifying the animal is or not in calf as the case may be 8.1.6 In the case of a claim under Clause 5.2.2, 5.4.2, 5.5.2, 5.6.2, or 5.7.2 the Purchaser shall when notifying such claim forward to the Auctioneers a Report from the Purchaser’s Veterinary Surgeon giving his opinion that the animal has produced a calf to a bull other than that stated to be the service sire 8.1.7 In the case of a claim under Clause 5.5.3, 5.6.3, or 5.7.3 the Purchaser shall, when notifying such claim, forward to the Auctioneers a Certificate from the Purchaser’s Veterinary Surgeon certifying that the animal has not calved to the stated service date 8.1.8 Where any claim concerns an animal purchased for export outside the United Kingdom it shall have been notified and proved correct (after all examinations and procedures deemed necessary by the Veterinary Surgeons appointed under these Terms have been carried out) before the date on which shipment takes place or before the relevant period in sub-clause 8.1.2 (whichever shall be the earlier date) 8.1.9 The animal shall survive at least until the completion of all examinations and procedures deemed necessary by the Veterinary

Where notice of an intended claim is given to the Auctioneers in accordance with sub-clause 8.1.2 the Auctioneers shall immediately inform the Vendor and the British Blue Cattle Society and forward to the Vendor a copy of the relevant Report Form if applicable.
9. 9.1
EXAMINATION OF ANIMALS Upon receipt by the Auctioneers in accordance with sub-clause 8.1.2 of any notice of claim under any of the above warranties the Purchaser shall permit a Veterinary Surgeon appointed by the Vendor to examine the animal should the Vendor desire such examination
10. 10.1
DISPUTES Any dispute as to the condition, fertility or capability of an animal under the warranties contained in these Terms shall be determined by a Veterinary Surgeon appointed by agreement between the Purchaser and the Vendor or in default of such agreement by the Auctioneers. The Veterinary Surgeon shall have the power to make such directions including (but without prejudice to the generality of such directions)directions under sub-clause 10.3 below and to make such investigations as he thinks fit and the Purchaser and the Vendor shall comply with such directions and shall co-operate in such investigations and shall provide such records and information to the Veterinary Surgeon as he may require If the Veterinary Surgeon so appointed decides that further opportunities are required to prove whether or not a bull is capable of getting stock by natural service or, as the case may be, whether or not a cow or heifer is fertile, he shall direct under what conditions and within what timescale such opportunities shall be afforded, and the Purchaser shall, if so directed by the Veterinary Surgeon, allow the Vendor to remove the animal from the Purchaser's premises and the Vendor shall, if so required by the Veterinary Surgeon, afford such opportunities as the Veterinary Surgeon may direct and shall, before removal of the animal, lodge with the Auctioneers the whole amount of the purchase money (or such part of it as the Purchaser has paid) of the animal, interest thereon to accrue for the benefit of the Vendor pending the outcome of the dispute. The Veterinary Surgeonâ&#x20AC;&#x2122;s decision as to the condition, fertility or capability as the case may be of the animal shall be final and binding upon the Vendor and the Purchaser, PROVIDED ALWAYS that the Veterinary Surgeon may decide in favour of the Vendor if in his opinion the cow or heifer would have proved fertile or the bull would have proved capable of getting stock by natural service within the terms and period allowed by the relevant warranty if within that period the appropriate opportunity or veterinary treatment had been given or proper management or principles of good husbandry had been applied. If the Veterinary Surgeon decides in favour of the Vendor, then the Purchaser, or if he decides in favour of the Purchaser, the Vendor shall pay or reimburse all veterinary and laboratory fees and any reasonable transport costs incurred by both parties in the course of the dispute.

LIMITATION OF RIGHTS ON BREACH OF WARRANTY Upon breach of any warranty contained in these Terms the Purchaser shall have the right to return the animal, together with any calf sold at foot or born subsequent to the sale, and recover from the Vendor: 11.1.1 the purchase money or such part of it as the Purchaser has paid; 11.1.2 interest thereon calculated on a daily basis at two percent above the Base Lending Rate from time to time in force at Lloyds Bank Plc from the date upon which notice of the claim was received by the Auctioneers to the date of return or the date of disposal of the animal as the case may be; 11.1.3 the expense of transporting any such animal to and from the Purchaser's premises: 11.1.4 the reasonable cost of any such animal's keep from the date on which notice of the claim was received by the Auctioneers to the date of return to the Vendor's premises or the date of disposal of the animal as the case may be, not exceeding the slaughter carcass value of the animal at the date of return, which sum shall be assessed by the Auctioneers, whose assessment shall be final and binding upon the Vendor and the Purchaser; 11.1.5 the reasonable expenses (including laboratory fees) of any Veterinary Surgeon employed for the purposes of investigating the animal's condition, fertility or capability as the case may be and for making a claim under these Terms BUT THE PURCHASER SHALL HAVE NO RIGHT TO CLAIM DAMAGES FROM THE VENDOR IN RESPECT OF: (i) ANY INDIRECT OR CONSEQUENTIAL LOSS SUCH AS (BUT NOT LIMITED TO) LOSS OF PROFITS, OR (ii) ANY OTHER LOSS WHATSOEVER.

TIME LIMITS Time shall be of the essence of all Terms in which time limits are prescribed and a claim made under any warranty herein will not be admitted unless made within the prescribed time limit provided that where time limited for any person to do anything expires on a Sunday, Bank Holiday or Public Holiday or on a day following next after any such days then such Sunday, Bank Holiday or Public Holiday shall be excluded from the computation of the time. In the computation of any period of time before or after the sale or any other event, the day of the sale or other event, as the case may be, shall be excluded. All periods expressed, as a number of days shall be taken to refer to that number of clear days, and similarly for any period of time.

ARBITRATION Any disputes, other than those determined by the Veterinary Surgeon in accordance with Clause 10 hereof, between Vendor and Purchaser shall be referred in accordance with the provisions of the Arbitration Act 1996 and all statutory modifications thereof for the time being in force to a single arbitrator to be appointed by agreement between Vendor and Purchaser or in default of agreement by the President or a Vice President (or the President's delegate) for the time being of the Royal Institution of Chartered Surveyors. The party calling for Arbitration shall lodge with the Society the estimated fee to cover the total cost of Arbitration, as determined by the Society, before the Arbitration commences; the losing party bearing the full cost on completion of the process. NOTICES Any notice required to be served on any person shall be deemed to have been duly served if left at or sent by prepaid first-class post to that person at his last known abode or principal place of business and shall if sent by post to that person at his last known abode or principal place of business be deemed to have been received on the fourth day after the date on which it was sent. GENERAL If any provision of these Terms is held by any competent Authority or Court to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and the remainder of the provision in question shall not be affected thereby. The headings in these Terms are for convenience only and shall not affect their interpretation. The validity, construction and performance of these Terms shall be governed by the Laws of England.

AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions ) 1.
The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.
5.
All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.
8.
No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.
9.
Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.
Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.
10.
If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.
The auction ring man escapes and refuges must be kept clear at all times.

All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc. All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington. Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations. Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling. When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals. Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.
All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
