UNPACKING THE

Sectional Title Legislation

M

any cash-strapped South Africans are already buckling under the pressure of spiralling consumer inflation and shrinking budgets, but scores of sectional title property owners are now also faced with hefty levy hikes if their body corporates haven’t made provision for the requirements of new legislation gazetted in October. One of the new stipulations of the Sectional Titles Schemes Management Act is that schemes are now required to have a reserve fund, implied by the regulations to be maintained equal to 25% of the scheme’s total annual levy budget. Although the amendment to the Sectional Titles Schemes Management Act was signed into law this month, it was approved way back in 2011 and efficient, well-established body corporates will have taken advantage of the five-year gap to get ahead and begin accumulating the necessary surplus. The aim of this portion of the legislation amendment is to ensure schemes create “rainy day” funds and shield home owners from the 10

special levies that body corporates demand from time to time when major repairs or refurbishments take place. Once-off special levies are usually hefty and aren’t in most cash-strapped home owners’ budgets, often plunging households into debt to service them. While numerous developments have already created their required level of reserves or are well on the way to doing so, there are also many schemes that have not used the grace period to add small top-up increases to annual levies and home owners in those schemes now face the prospect of substantial levy hikes next year while Trustees play administrative catch-up.

IN REAL TERMS, WHAT DOES THIS MEAN FOR EXISTING OWNERS AND PROSPECTIVE BUYERS OF SECTIONAL TITLE PROPERTIES?

owners could see their levies increase by up to 25% initially until adequate reserves have been accumulated. This is in addition to the standard fixed annual increases required to cover the rising costs of maintaining the development. Once the reserve fund has been adequately established, provision has been made for lower contributions but owners can expect reserve fund levies to be charged unless the value of the reserve fund is equal to 100% of the scheme’s total levy budget. “Regulation 2 of the act also stipulates that, if the reserve fund is less than 25% of the previous year’s maintenance contributions, at the start of a new financial year, the owners in the scheme must add 15% to their total levy budget for the coming year as a contribution to bolster the reserve fund.” Van Rooyen adds that if, at the end of the financial year, the remaining reserve funds are less than 100% but more than 25% of the value of the past year’s administration fund contributions, then the contribution to this fund must be at least equal to the

repair and maintenance budget which has been formulated for the coming financial year. Lew Geffen, Chairman of Lew Geffen Sotheby’s International Realty, says that while the intent of the new regulations are laudable, their implementation and management require a whole new level of administration and accountability, and trustees will have to raise their game considerably to achieve and maintain compliance. “Not only are separate records, budgets and bank accounts mandatory for the general levy and the reserve fund; they must be independently audited every year by an impartial person or company not involved in the scheme’s financial administration. Trustees must also prepare a detailed written 10-year plan for the use of the reserve fund, and report back to owners annually on its progress and implementation and more often than not, this document will have to be prepared by an outside consultant with the necessary expertise at an additional cost to owners.” Geffen adds that the complexities of implementing the new 2016 / 2017 • HAZELDEAN TIMES • www.hazeldeannode.co.za

requirements are compounded by a very short window of 90 days in which to meet seven of the key requirements. “These include registering the scheme and lodging all governance documentation with the Community Schemes Ombud Service (CSOS), establishing a reserve fund and opening a separate bank account as well as compiling and submitting the new fund’s budget and financial statements. Many of these steps are time-consuming and involve reams of documentation as well as a level of expertise that smaller schemes with more simply structured body corporates will struggle to complete in time.” Arnold Maritz, Cape Town Southern Suburbs Co-Principal for Lew Geffen Sotheby’s International Realty, stresses that it is now essential for prospective buyers to add scheme management to their list of priorities when choosing property, especially investors with budget restrictions. “Sectional title levies cover various expenses such as insurance, administrative fees and the maintenance costs of the common property and on-site facilities, and it must be remembered that the more amenities there are and the larger the grounds, the higher the levy.” “First-time buyers on a tight budget should therefore look for low maintenance schemes that are well run and maintained, and whose financial statements are in good order. Request a copy of the financial statements, and look for the presence of a reserve fund as well as any adverse figures for non-payment by other owners in the complex. “Sectional title properties will remain the more affordable option and they will continue to attract first-time buyers. However, it is essential that prospective buyers don’t just look at the property and the purchase price.” “They have to take the new Act and its financial implications into consideration when calculating their budgets and decide what they can afford in the long run, including any substantial levy increases. There is a very apt Afrikaans phrase that applies here, which is that sometimes goedkoop is duurkoop – or directly translated, buying cheap initially doesn’t always cost less long term.”

Maritz adds that it’s also a good idea to compare the levy for the subject property with those in similar complexes nearby on a “per square metre” basis as this will help to establish a balance between the lowest levy payable versus the expected capital return on the investment. Matthew Raubach, Sectional Title and Area Specialist for Lew Geffen Sotheby’s International Realty between Wynberg and Lakeside says: “We have been lucky enough to predominantly sell property in blocks that have been well-managed and that already have established reserve funds with a healthy balance. What this has highlighted for us is how beneficial effective management is to sectional title schemes, not only in the short term but also to the value of owners’ investments. It is now even more critical and smaller schemes without the necessary resources or expertise would benefit by appointing an experienced managing agent.” Shaun Groves, Gauteng Rental Manager for Lew Geffen Sotheby’s International Realty, believes that many Johannesburg sectional title owners are in for a nasty surprise. “From what I have seen, it appears that the majority of schemes have not planned accordingly and I have no doubt that many owners are going to feel the pain of increased levies which will compound the struggle to realise yields in a notably subdued rental market. This year has been particularly tough as yields have come under severe pressure and any increase in the operating cost of a property will have a direct impact on net profits. Landlords may look to offset this by increasing rentals, therefore pushing prices up and putting even more pressure on consumers.” The rental market in Cape Town is much stronger and in the more soughtafter areas, demand in the lower to middle markets now exceeds supply. However, rental prices have dropped this year in response to the continued economic downturn, with tenants also becoming increasingly educated about the market and aware of current pricing. This is according to Lorraine-Marie Dellbridge, Rental Manager for Lew Geffen Sotheby’s International Realty in Cape

Town’s Southern Suburbs who adds: “I have seen a number of leases including clauses that if levies or rates increase the landlord may adjust the rental accordingly but I would advise against it as a blanket practice, especially if they risk losing stable and reliable tenants. Not only will the landlord have to go through the onerous process of finding a suitable new tenant, it could be costly if the house stands empty which is a real possibility if the increase prices the property out of its current market.” Van Rooyen concludes: “While it may be daunting, especially for schemes that have only just begun the process, it must be borne in mind that the home owners are members of the body corporate and in terms of their governing rules as prescribed by the new regulations, they have to approve the annual administration and reserve fund budgets. So whilst increases may be unavoidable for many schemes, the trustees cannot just increase the levies arbitrarily. Home owners are not entirely powerless here; they do have a voice.”

The evening included wine and canapés for the ladies to re-fuel before gym members and dance students took the stage to showcase what they have learnt in class over the last 3 months. Abland’s commercial development attracts top restaurants, steak houses, coffee shops and other select retail outlets.

C

onstruction is progressing well on Abland’s R1, 45 billion project in collaboration with the Blue Bulls, adjacent to the legendary Loftus Versfeld Stadium. After completion of the earth works (8 months and 33 800 truckloads of soil later), the entire first level, and 60% of the second level of a massive scale super basement has been completed. This accounts for around 500 of the 2000+ parking bays that will be provided when Loftus Park opens its doors. The ground floor level will accommodate seven restaurants, steakhouses, and coffee shops surrounding an open air Piazza. Big names such as Motherland, Turn ‘n Tender, RocoMamas, Salsa and Spur have been signed up while an Italian restaurant, as well as a coffee shop are on the cards. Checkers will be opening a premium store with an exciting new approach and a

renowned pharmacy and several famous sports brands are also underway. Abland’s project manager, Hannes Kleynhans explains that 15000 m³ of concrete (no less than 2145 truckloads) has been poured to date with more than 1300 tons of steel reinforcement. “The works proceeded according to plan and the opening date in March 2018 is achievable. Early next year we will commence with the Virgin Active gym, the retail outlets and the hotel. Midway into 2017 the office towers will start going up” says Kleynhans. Phase two will feature a Sport Rehabilitation Centre of Excellence with a hospital where top specialists will treat sports injuries, An attractive feature of the development will be the Piazza itself. Apart from a few prize works of art presently being specified and procured, Abland is creating an actual park landscape atmosphere. Thus

numerous fully grown trees will be planted in huge concrete cavities under the floor slab. This lovely shaded park will provide a safe play space for children in full view of their parents seated at the restaurants. Open air gatherings will also be hosted and negotiations are underway with top ensembles for lunch hour concerts and music recitals, while artists and art students will be invited to paint and exhibit their work on the Piazza. State of the art security goes without saying and internationally renowned advisors were contracted to assist with the planning and implementation thereof. With a large covered outside dining area, moms can make the most of the sunny December weather while being close enough to watch over the kids as they enjoy themselves in the huge playground. EXPLORE THE HAZELDEAN VALLEY TRAILS The Hazeldean Valley Mountain Biking and Trail Running Trails are ideally situated within riding distance from Silver Lakes and surrounds. The trails are well designed so that everyone can enjoy them, from beginner to advanced rider level. Following the recent expansion, there is now 36km of well-designed single track to be enjoyed and different route distances to choose from. Further extensions and additions to the trails are in progress. Parking and ticketing is at the Cowhouse from where you can follow the coloured arrows to the trails. The National Zoological Gardens, more commonly known as the Pretoria Zoo, is the largest zoo in South Africa and the only one which has a national status. It is also rated as one of the top zoos in the world. The zoo was established in 1899 but only officially became the National Zoo in 1916, and now hosts in excess of 600 000 visitors every year. There is so much more to the zoo than just a collection of caged animals – it actually plays a vital part in the conservation of threatened species. There is a lot of importance placed on providing the animals with a natural environment to live in, and for this reason, a large number of enclosures have been revamped or modernised in recent years. Some special enclosures include a large walk-through aviary and a specially air-conditioned Australia section. The zoo also has the largest inland aquarium in the country with a large reptile park. There are many ways to get around the zoo. For those who don't feel like walking the 6km of walkways that meander through the zoo, there are golf carts and children's pushcars for hire. A 7 minute cable car ride is also available which takes visitors up to the top of the mountain and provides a beautiful view over both the zoo and the city. There are also many children's rides on offer, including a zoo train. Restaurants and kiosks are scattered around the zoo to provide refreshments, braai and picnic facilities are also available. The Zoo is open 7 days a week, 365 days a year!

STROLL THROUGH THE PRETORIA BOTANICAL GARDENS Embark on a floral journey of discovery at the Pretoria National Botanical Garden, a treasure chest of South African flowering plant species and trees and definitely among the more beautiful of the tourist attractions in Pretoria. We created a short garland fit for a fireplace. You can use these same steps with long strips to create a ribbon backdrop for a larger space

Loosely tie the fabric and ribbon to the thick twine. Leave a few inches of length at the top. By tying the fabric loosely, you will be able to adjust the strips as needed.

DIY WREATH ITEMS YOU WILL NEED: 1. Wreath frame 2. Ribbon 3. Scissors 4. Wire and wire cutters 5. Pine cones, accent greenery, and evergreen branches

Bunch Greenery Clip your evergreen branches with your wire cutters into short lengths as seen above. Layer about five branches on top of each other and tie your wire around the centre of the bunch. Twist the wire in the back of the bunch to hold the branches together. Attach the branches to the wire frame by twisting the wire around the frame.

Add Accents Add accent greenery and decorative items such as ribbon, box wood, and pine cones as you attach the pine branches to the frame. If you wait until the end to add these items, the accent pieces lay on top of the pine branches instead of within them. It creates a more layered look to add the decorative items as you go. Attach your accent items in the same way you attached the pine branches with wire. Try to use an odd number of accent items. We used five pine cones and three ribbons for our wreath.

Trim the Pine Needles Continue this process until you have completed your wreath. Lastly, take scissors and trim the extra pine needles to create a clean edge around the wreath.

It’s holiday time again! The December holidays are upon us and for most of us this month long break over the festive season is the perfect excuse to get away for a while – which means leaving your house empty. It’s important to take safety measures to make sure that you return to your home the way you left it.

don’t have an alarm system, fake it. Have fake armed response signs made and put them up outside your house. You can also put ‘Beware of the Dog’ signs on your gate, whether you have a dog or not. Leave a few large dog bowls visible outside and thieves won’t dare go inside. Put away any visible ladders or garden equipment that can be used as tools to break in.

BEFORE YOU LEAVE

Call your insurance company and make sure what is and isn’t covered in your policy and that your account is up to date. If anything should happen, you need to know what you can claim and what you can’t. If you are leaving any vehicles at home,

he most ideal scenario would be to have a family member or close friend that you trust stay in your house while you are away. A person best suited for this would be someone who has little responsibility at their own home, such as pets etc., so that they are not leaving their own house vulnerable. If you don’t know anyone who can help you, don’t worry. There are a few things you can do to ensure the safety of your house. These can be divided into three categories: before you go away, right before you leave and while you are away.

It is important to contact your security company, if you have one. Inform them that your house will be empty and they should respond to any alarm signals. Ask to have your system tested as well. Don’t wait until the last minute for this; leave enough time to have any repairs done if needed. If you

Ask a friend or neighbour you can trust to keep an eye on your house. Ask them to water your lawn and plants while you are away, nothing says “The owners aren’t here” like a brown dried out lawn when the neighbours all have perfectly green grass. Ask them to pick up any mail and flyers outside, as a full mailbox is also a signal to burglars. If your car is normally parked outside and will be while you are away, ask your friend to drive it around a few times so that it doesn’t gather dust and cobwebs, which is another sign that nobody’s home. Show your friend how all the doors and windows are locked and fastened and ask them to check every day for signs of tampering. Take your friend around your house and show them what things normally look like so that they can notice if something is different or if anything looks strange. Take note of things like where any pot plants stay so they will notice if any have been moved; plants around your fence or wall so that they can see if any have been trampled or cut out for any reason and what will and won’t be outside and around the house so that they will know if anything has been left there by strangers. Right before you leave, make sure you have locked and fastened all windows and doors. Don’t rush in your haste to leave, it is worth taking an extra few minutes to make sure it is done right. Arrange a time to give your friend or neighbour your keys, don’t leave them under a mat or somewhere obvious, thieves know where to look. Make sure your alarm system is set properly and that no pets can set it off unnecessarily.

WHILE YOU ARE AWAY

Contact your security company every few days to make sure no signals have been received from your house, especially if you will be away for a long time. Keep in touch with the friend or neighbour you asked to keep an eye on your house so that you know that everything is fine. Remind them of any details they may have forgotten. There are a lot of things to remember but if you make sure to leave your house as secure as possible, the only thing left for you to do is enjoy your holiday. 34

Many people are in unhealthy relationships without realizing it. Some might have a toxic relationship at home with a partner, child, parent or sibling – some might have a bad relationship with colleagues or their boss. It is important to understand what an unhealthy relationship entails, why we are in unhealthy relationships and how we can change this. By: Andrea Kellerman

O

ften unhealthy relationships are connected to a low emotional maturity of one or both of the people in the relationship, boundary setting issues and conflict management problems. Such relationships can make you feel unhappy, destroy your self-esteem and increase physical and psychological problems as they start to get more and more under your skin. If you are married to or work with someone who is emotionally immature you probably face great challenges in dealing with this person’s moods and behaviours. I am sure you came across a boss, colleague or friend who tends to try to control the world around them rather than to accept it for what it is and work toward positive change. This belief is a strong indicator of self-centeredness or narcissism. Selfcenteredness and self-importance are normally traits of children. Children demand special treatment, make little real contributions themselves, and complain that life isn’t meeting their needs. Overcoming this mind-set is a normal and a vital part of growing-up. When those characteristics manifest in an adult, they are indications that that person is not in fact a mature, responsive adult, but rather still reacting out of their selfcentred child view. The person may look mature, and have many adult responsibilities, but emotionally, they are still a child. Instead of taking responsibility for how they feel, they expect others in their life to see their points of view. They try to control others, which

is something you cannot control! A mature individual does not lose control and succumb to irrational thoughts simply because they haven’t gotten their way. Insecure and emotionally immature people are often bullies and employ many techniques to get their way. Bullies and harassers have the emotional age of a young child and will exhibit temper tantrums, deceit, lying and manipulation, not speaking to you, making you feel that you are not worthy or not including you when you should be part of something to avoid exposure of their true nature and to evade accountability.

BELOW ARE SOME SIGNS OF PEOPLE WHO ARE EMOTIONALLY IMMATURE: • When things go wrong, they always feel that it is someone else’s fault. • They are highly sensitive to things done to them, but are blind to the things they do to others. • Feeling that they are the victims – bad things happen to them but in their view, their poor choices play no part. • Their relationships are often short lived. These are only a few signs that someone is emotionally immature. While you may have compassion for such people, it’s important that you recognize that you are dealing with someone with emotional issues. It is not always

you who is at fault or who should take the blame. You may feel that you can fix this person or the situation. But in reality, the issues are often deeply seeded, and you may find it highly challenging to have a fair and balanced relationship, work relationship or friendship with someone who is emotionally immature. You need to be able to see this for what it is and set boundaries. This means that you need to be able to stand up for yourself, say “no” if you feel bullied, be assertive and don’t shy away from conflict. I see many people in my practice who dislike conflicts greatly and try to avoid them at all cost. The problem is when avoiding conflicts, we can develop anxiety, sleeping problems and depression because we are not solving those issues and other people who bully us might always get their way.

THE TYPES OF DIFFERENT BEHAVIOURS PEOPLE USE WHEN BEING CONFRONTED WITH A CONFLICT INCLUDE:

Conflict situations are an important aspect of our everyday life. Often, a conflict presents opportunities for improvement and personal growth. In a conflicting situation we need to make sure that we stay calm and assertive. Assertiveness means that we respect ourselves and the other person we are talking to. If the other person is very upset, allow him to vent first. This will take the steam out of the situation. As a second step, show the other person that you understood the point that 40

was made. This does not mean that you agree with him/her, but you signal to them that you understood the frustration and irritation they are going through. This will help them to feel that you understand them and will calm them down. As a last step you can either agree that there has been a mistake made and it will not happen again or, if no mistake was made, you can try to find a solution to the problem to avoid any further unhappiness. Those steps work very well in most situations. You need to be aware of how you feel about the conflicting topic. If you feel strongly about it, use the above mentioned techniques to get to a solution. If you do not feel strongly about the conflicting situation it is sometimes wise to walk away and leave the situation behind. Being aware of having a toxic relationship at home or at work is the first step to change and feeling happier within yourself. Once you have identified the problem, whether it is emotional immaturity, a problem setting boundaries or not being able to handle conflict well, you can start to work on those issues and implement the above mentioned points. It is important that you feel content, can be your true self and feel in control over your emotions and reactions in life. This is your life and you deserve to be happy!

Summer Berry Pavlova INGREDIENTS

6 egg whites 350 g castor sugar 1 tablespoon vinegar 1 tablespoon cornflour (or corn starch), sifted ⅓ cup (50 g) icing sugar, sifted 600ml thickened cream 500 g mixed berries

SALTED CARAMEL

2½ cups (550 g) castor sugar 300ml thickened cream (at room temperature) 1 teaspoon sea salt flakes, to taste

INSTRUCTIONS

No idea of what to serve for Christmas lunch this year? There's no need to agonise over this or spend hours in front of the stove. These delicious dishes are sure crowd pleaser's and easy to prepare too!

1. Preheat the oven to 150°C. Line a large baking tray with baking paper. 2. Place the egg whites in the clean, dry bowl of an electric mixer and whisk on high speed for 3-4 minutes until soft peaks form. 3. Add castor sugar, 1 tablespoon at a time, allowing each spoon to be incorporated before adding the next. Keep whisking until all the sugar has been added and the mixture is glossy. 4. Reduce the speed to low, then add in vinegar, cornflour and icing sugar, until combined. 5. Spread the mixture over the baking paper in a round, rectangle or wreath shape, making a slight indent in the centre to allow for the toppings. 6. Reduce oven to 130°C and bake meringue for around 1 hour. 7. Meanwhile, for the salted caramel, combine sugar with ½ cup (125ml) water in a saucepan over low heat, stirring until the sugar dissolves. 8. Increase heat to medium and cook, without stirring, occasionally brushing down the sides of the pan with a damp pastry brush, for 8-10 minutes until a golden caramel forms. 9. Remove the caramel from heat and pour in the cream. Be careful here, as the mixture will bubble and then seize. Return the pan to low heat, add salt to taste and cook, stirring the caramel, for 1-2 minutes until smooth. 10. When the meringue is cooked, turn off the oven and leave the meringue inside, with the door ajar, for 1-2 hours until cooled completely. 11. To serve, remove the meringue from the oven and place on a platter or serving board. Whisk cream to soft peaks then spread over meringue. Scatter over berries and drizzle with salted caramel. 12. Glazed Roast Gammon INGREDIENTS

1 deboned uncooked gammon of about 2.5kg 1 onion halved Cloves 2 sticks celery Water

50g butter 75g dark brown sugar 1 tablespoon mustard

INSTRUCTIONS

1. Clean out the pot, place the gammon back into the pot and fill with water. 2. Stud the onion halves with 2 cloves and add to the pot. Bring to the boil, reduce the heat and simmer on low for 2 1/2 hours. 3. Take the pot off the heat and set aside allowing the gammon to cool in the liquid. 4. When cool remove from the water, the skin will be easy to remove. Remove the skin and score the fat diagonally into diamond shapes. 5. Melt the butter in a pot over a low heat, add the sugar and mustard and mix until well combined. 6. Brush the gammon with glaze and stud with cloves then place it in a 200°C preheated oven for about 40 minutes until nicely brown. Remove and brush with the rest of the glaze.

So how often is it that we can easily decide to take our year-end bonus money and invest it, only to reap the rewards five years from now? Or is it easier to use the money now and actually see where it’s going and just be content that it came and left?

any people get intimidated when you mention the word invest because they have always believed that the only people who invested were those with money. This is not true, as over the years many companies have developed a variety of options and portfolios which allow anyone – even low income earners – to invest. People have different reasons for investing and as a result will invest differently. Once a person establishes why they want to invest, it is then easier to sit down and look at the best plan to invest in and for advisers this means advising on what will be suitable for your needs. Besides investments, there are few smart ways to put your end year bonus to good use.

what to expect when it’s time to reap your reward at the end of the term. This depends entirely on your needs and affordability. This will also determine whether you invest for the short term, medium term or long term. One option is a lump sum investment. These vary in terms of the investment period which ranges from three to five years or even 10 years depending on your needs. There are portfolios which have a minimum lump sum of R1000, R12 500, R25 000 or even up to R250 000 – once again depending on your needs. Within these lump sum investments, you do get those that have the flexibility of having a certain percentage of the initial consideration accessible in the event of an emergency, whereas the other remaining percentage would remain inaccessible until the minimum term of the investment is complete. Another option to look at is a debit order investment. This is where there is a debit order arrangement of say a minimum amount of R500 per month for the duration of the investment. Then at the end of the term there is an option to withdraw the funds, withdraw only some of the funds or even continue to keep the money in there until such time you feel you’d like to access the funds.

CLEARING YOUR DEBTS A RAINY DAY FUND

Every budget should have a ‘rainy day’ fund for unexpected expenses like a geyser bursting, car problems or unexpected medical expenses. This would be a perfect place for your bonus or part of your bonus to go as you never know when you might need some extra cash. Most financial experts recommend putting at least 50% of your bonus into a savings account. Also keep in mind that the ideal position to be in is to have three to six month’s salary stashed away in case of emergencies.
