SMC Awards Funds to Free Feet Footwear A tremendous “Thank You� to all who contributed to the 2011 SMC Charity, Free Feet Footwear. Free Feet Footwear provides shoes, boots and other footwear to be distributed to the needs and underprivileged children in the Northern Kentucky area. Through your generous donations, $875.00 was raised for this worthwhile charity. Mary Gosney, Director of Free Feet Footwear, informed us that they had already distributed 90 pairs of shoes to the tornado victims in Southern Kenton County. The SMC contribution will replenish those shoes for future needs in the Northern Kentucky area. Donations were collected at the 2011 HBA Golf Outing and 2011 Holiday Party. YOUR ACTION IS NEEDED NOW BEFORE THE END OF THE 2012 GENERAL ASSEMBLY SESSION!

T

he General Assembly is reaching its last few weeks for the 2012 session. Several bills have worked their way through the House and are now in the Senate and need your action. Seller Finance – SAFE Act Correction: HB 409 (Rep. Jenkins) The HBA strongly supports this legislation. HB 409 introduced by Rep. Joni Jenkins and co-sponsored by many real estate licensees accomplishes two important objectives: First, this legislation amends existing law in relation to property  forfeitures in the case of unlawful deaths, and would remove the requirement    that real estate professionals advise their clients on the statute’s provisions.  Secondly, and of utmost importance to HBA members, this legislation makes     provisions to the KY S.A.F.E. Act, allowing home builders to make up to 4   owner financed loans each calendar year. (This practice was inadvertently made    illegal by the SAFE Act.) This language has been agreed to and supported by   the Department of Financial Institutions. The bill passed the Senate Judiciary   Committee, and now must pass the FULL SENATE. Please call your Senators  and tell them to fully support House Bill 409.  Property Valuation Methods Codification: HB 398 (Rep. Tommy  Thompson) The HBA strongly supports this legislation. Straightforward   legislation, this bill codifies the property valuation methods utilized by PVAs in   the Commonwealth. HBAK worked with the PVA Association on this legislation. The measure passed the Senate Committee on Appropriations & Revenue, and now goes to the full Senate for passage. Please contact your Senator and urge them to support House Bill 398. Unemployment Insurance Fix: HB 495 (Rep. Clark) The HBA strongly supports this legislation. Under federal law, Kentucky employers will owe an annual interest payment due on September 30th for the life of the loan which Kentucky received from the federal government to stabilize the Unemployment Insurance Trust Fund. The 2012 anticipated interest payment will be approximately $34 Million. If KY defaults on interest, employers will lose all of their FUTA offset. The current FUTA Rate is $63.00 per employee. This will increase to the Penalty Rate of $420.00 per employee unless this is addressed. This bill authorizes the Education and Workforce Cabinet to temporarily finance the interest due and requires the Governor to seek a cap on the federal FUTA tax before implementing an assessment in 2014 in the same amount of the anticipated FUTA increase. HBAK and other business groups have worked for months to find a solution that would not impose an additional unemployment tax this year or next. This solution is far superior to other proposals considered. The measure has passed the full House with no dissenting votes and is now in the Senate.



Residential Construction and Remodeling Market Continue to Improve in 2012

W

hen the Home Builders Association of Northern Kentucky (HBA) released its 2011 Residential Economic Report it proclaimed that the bottom was in for the housing market. The report stated that in 2011 the foundation for the housing recovery took place in 2011. Indicators for that call included a surge in multifamily and condominium construction activity, investment in publicly traded homebuilder stock on Wall Street, and a strong resurgence in the remodeling market. In the latest release of permit data that story remains true. “We are very happy to see an increase in single family construction,” said Brian

Miller, executive vice president of the HBA. “Overall, single family permit activity has increased 31% for the first two months of 2012 over the first two months of 2011. Residential remodeling activity continues to surge increasing 47% in that same timeframe over last year. When we talk to our members face to face we hear unanimous anecdotal stories of improvement. Developers that have had homesites sit ignored for four or five years now have willing buyers and in some cases multiple offers are beginning to be experienced on newly built homes and contracts to build on particular homesites. This is very encouraging,” he concluded.

Designer of the Year - Rachel Seibert

A

s a child, Rachel Seibert dreamed of working in the construction industry with her father, Bob. The eldest of nine in the Seibert home, Rachel graduated from the University of Kentucky with a BA in Interior Design. n our continuing effort to help educate a skilled workforce, HBA Northern Kentucky has again partnered with Youthbuild USA ® to present their “Mental Toughness” Training. This bi-annual event bring together at-risk students or those who have dropped out of High School to achieve a GED and to learn the basics of skilled trades. But this is event is not just a simple training session. Students are brought together and challenged to unlearn bad habits and to confront what has impeded their success so far. Many of the students are ill prepared for adult life and many more are unsure of their adult identity and how to begin their life. Students must meet physical challenges as well as seemly simple requirements like being on time and presenting themselves as a professional young adult. Some students fail out quickly but many more accept the challenge and move on to both graduate and find gainful employment. We at Home Builders are happy to host this event that allows those who truly want to change their lives for the better to be afforded a chance that they many not have otherwise received. NLRB poster rule is upheld, but sanctions are disallowed

T

he U.S. District Court for the District of Columbia, in a case brought by the National Association of Manufacturers (NAM), has upheld the National Labor Relations Board (NLRB) collective bargaining rights poster rule, but has also held that an employer’s failure to display the poster will not be considered to be an unfair labor practice, nor will it toll the statute of limitations for filing an unfair labor practice complaint. If the rule lacks these sanctions, it may be unenforceable as a practical matter. However, because there is uncertainty as to whether the NLRB or private parties may assert other enforcement options, NAM has announced its intention to appeal the portion of the court’s decision that upholds the NLRB rule. The court’s opinion may be found at this link: ecf.dcd.uscourts.gov/cgi-bin/show_ public_doc?2011cv1629-59. There remains pending in the U.S. District Court for the District of South Carolina a separate challenge to the NLRB collective bargaining rights poster rule brought by the U.S. Chamber of Commerce. Enzweiler Trade Program at HBA Northern KY wraps up another successful year!

O

nce again the close of a school year is upon us. It is always very bittersweet to see a group of students graduate the program and go into the world. Over this, my first year as Director, I have gotten to know these graduates and appreciate their efforts to better their lives and become educated and skilled. This year has seen many changes to the program and a great deal of growth. Students say that have felt a positive atmosphere and a sense of support from their peers and from the staff. To the teaching staff, I must commend you on a job well done! I saw every teacher on staff strive to reach every student and to present the material in relevant and understandable ways. To my students, thank you for your feedback and for being so positive about the year‌not to mention having the trust in me to give all these changes a try and to work through the bumps. To all of my graduates, Godspeed toward your future endeavors and be proud of what you have accomplished here at the Enzweiler Trade Program. To my returning students for next year‌.Have a productive summer and return to us ready to further your skills and abilities!

Code Issues: The new International Energy Code will go into effect on October 1, 2012. The N.K.A.P.C. will start energy inspections on July 1, 2012 to help remodelers get used to what they are looking for in the inspections.

The new Kentucky Building Code will go into effect on January 1, 2013. The Building & Housing Codes Committee will be meeting with inspectors during this coming year to discuss the new changes.

Tour of Remodeled Homes: The 2012 Tour is scheduled for October 6 & 7. The TORH is a great way to showcase your work, so start planning your entries for this year’s TORH.
