Spring Membership Drive Turns Up Stiff Competition
T
his year’s spring membership drive was the most intense, heated drive I’ve ever been involved with. Applications were coming in right up until the wire and competition was stiff. It all started with a friendly wager to beat Joe Halpin’s (The Drees Company) longstanding recruitment record of 7 new members. Joe’s kind of a legend amongst the membership committee and Spike participants. He’s easily our biggest recruiter, last year receiving “The Big Spike” award an honor he’s had four times.
I’m not sure if the incentive was gaining bragging rights over beating Joe or not, but the competition indisputably brought everyone into the game. After 2 days of battling it out, Jason Yeager of Ashley Construction closed out the drive with a new record 8 new members, followed by an awesome 7 new member from Patrick Townsend owner of Patrick’s Hardwood Flooring.

Workers Compensation in Today’s World By David Thornton, Greater Lexington Insurance

he past two months have proven very trying for my office relative to workers compensation. Two accounts failed initial safety inspection and then failed a follow up inspection a week later. Two employers had employees fall from fork lifts, and not out of the driver’s seat. Audit disputes are up; losses in masonry and framing indicate a need for substantial rate increases. In plain English, employers are not reporting all of their payroll exposure to the comp carrier. Think this doesn’t impact you, think again. These employers are on job sites with you every day. They are exposing you and your employees to injury or death. Still not convinced? They may be working for you and therefore exposing you to OSHA fines or worse. Every employer must formalize a set of written safety rules that document procedures to be utilized by your employees while performing job functions. Your company should include with the list a Zero Tolerance policy for violation of safety rules. Very simply this means that any employee that is seen violating safety rules will be immediately removed from the job site and their employment will be terminated. You need to hold a companywide meeting to distribute the rules. All employees should sign a statement that they have read and understand the rules. A new hire needs to do the same before they begin to work. Your local association’s educational programs, Kentucky OSH, and NAHB library are all good sources of information if you need help establishing these guidelines. Not an employer? Make sure 100% of your subs are working under a written contract. Require evidence of workers compensation before you let them on the site. Reference your policy on safety in the contract and be willing to terminate any sub in violation of the policy. Yes there are other things you need in the contract, but this is a workers compensation discussion. We all have a duty to make sure our business’ are financially successful, but we also have an obligation to our employees and our industry. Embrace safety within your organization. Refuse to work with business’ that don’t. Get help if you need it, but do it now.
IRS Program Sub or Employee Classification?
T
he IRS has announced a new program to allow employers to voluntarily reclassify workers as employees rather than independent contractors. The IRS bulletin is here, http://www.irs.gov/businesses/small/article/0,,id=246013,00.html. Clearly the construction industry is impacted as they are the predominant user of the sub contract relationship. In determining employee vs. independent contractor status, what matters is that the employer has the legal right to control the details of how the services are performed. See here for a good legal discussion of the issue, again directly from the IRS http://www.irs.gov/ businesses/small/article/0,,id=99921,00.html Previously labor and revenue worked independently of each other, so an IRS reclassification rarely amounted to other penalties. Not so anymore. Just before announcing the VCSP the IRS and the DOL signed an agreement agreeing to improve coordination of efforts on employee misclassification. So if you have any questions about employees, now is the time to review how you treat them for their employment status.

ousing Opportunities of Northern Kentucky (HONK) once again offers it’s thanks to the HBANKY and all HBANKY members and volunteers who helped frame 205 Oak Street in Ludlow. On June 28th, HONK was proud to showcase the HBANKY’s generous contributions with a successful open house.

1099 Employees and No Workers Comp… Just don’t Do It
A
golf course decides to put in an irrigation system and the landscape company says yes, we do that. The majority of the job goes well until a trench caves in and crushes an employee. The employee is entitled to work comp benefits, we all agree, but the benefits get paid by the golf course. Read on to find out why. Why? The landscape company was a partnership with no direct payroll, so they thought they didn’t need work comp. The company that was hired to trench to the water main was a sole proprietorship with no direct employees, so he said he didn’t need work comp. (does any of this sound familiar?) In fact he tried to convince the Division of Workers Claims that the laborer in the trench was a sub. But the “sub” was working by the hour, he was unskilled labor, and he will never be considered a sub just because you choose to pay with a 1099. Now the employee is entitled to benefits from the excavation company, but they were uninsured. The Department of Workers Claims looks up the line until they find coverage and in Kentucky the statute is very clear, the general contractor is liable for the injury to an un-insured subs employee. So the golf course policy responds. And in the interim, the injured employee is being ignored. This is a bad situation for all parties. Are you paying someone with a 1099 because it’s too much trouble to set up a withholding account and do it correctly? Are you using 1099’s for your employees because “that’s just what every one else is doing”? Are you paying a sub who professes to be exempt, and you know he has helpers on your site? Or maybe you heard that work comp was expensive and you just wanted to avoid buying it. Well, just don’t do it! We are a professional association, let’s all step up and act like it. If you have employees, pay them and report the earnings on a W2. You are eligible for very attractive workers compensation rates as members. And when you have a legal group, you are eligible for very attractive group health insurance rates. And more importantly, the situation above will not happen to you.

Making a Difference: How Ed Collins’ Concerns Turned into a Solution by Just One Member Speaking Out By Brian A. Miller, Executive Vice President HBA
Every year the members of NAHB gather in Washington, DC to head to Capital Hill and lobby on your behalf. This year was no exception as NAHB members from across the country poured into our nation’s capital to make sure your voices were heard. This year was a little different. We usually follow NAHB’s priority list to draw our thoughts and concerns from but a local focus on a national issue took center stage. Earlier this year, Ed Collins with Kentucky Federal Savings and Loan brought his concern to our attention. For years Ed has worked with homebuyers using the USDA Rural Development Section 502 Guaranteed Loan program to help homebuyers to become homeowners in Northern Kentucky.

his program is budget neutral in that it costs the taxpayers nothing. Ed brought it to our attention that, according to the legislation, the eligibility lines would be redrawn following the 2010 census. This would have a huge impact upon our community, especially those who are newcomers calling Northern Kentucky their new hometown. Many Americans have lost so much equity in their current home that they are not able to use that equity as a down payment on their next home For those who are local in the market that often causes families to stay put once they decide that they simply can’t come up with the next down payment. For those relocating to our community that means that these would be homeowners would have to be renters, no matter their past history of responsible homeownership. The USDA 502 program provides 100% financing with very strict underwriting criteria and ensures responsible homeownership for those in these exact types of situations. After Ed brought the issue to our attention we immediately contacted NAHB. The potential USDA 502 program changes were unknown by practically all in our federation. On your behalf, and with the help of Ed and our senior officers and advocacy committees, we began a campaign to communicate the situation to the other HBA’s across the country. At the same time we undertook a campaign to work with NAHB to make this a priority item as we were readying to head to DC for the legislative conference on June 6th. With the help of other HBA’s in our federation we were successful in drawing NAHB’s focus to this issue. Once the issue became a major concern for the federation talking points were drawn up, research was conducted. Your local HBA was instrumental in making this all become a reality. As a result there is an amendment to the farm bill that saves the current eligibility lines and ensures that many more responsible homeowners can call Northern Kentucky and the remainder of the nation the place where they can achieve the American Dream. At present time thebill was awaiting passage in the House of Representatives 10

The USDA 502 program was not the only issue that we addressed. We were successful in getting a bipartisan bill introduced which would reassert the opt out provision in the EPA’s RRP Lead Paint rule. The original regulation allowed for those who owned homes that were built prior to 1978 and had children over the age of six to opt out of the RRP rules. These rules have added considerable cost to the remodeling process of the aging housing stock and in many cases remodelers are avoiding working on these projects altogether due to the expense of the process and the worry of what the EPA may do if they make the most minor mistake. In many cases the EPA has levied fines for those that are not in compliance with the rule. These fines are always thousands of dollars. The HBA also lobbied Congress to create a funding mechanism whereby builders and developers could access easier credit for AD&C financing. There are bills currently addressing the need for financing of this perennial issue. The HBA was successful in moving the ball further forward in helping to solve this issue. The USDA 502 loan program is just one example of how the HBA hears your concerns and works to help your voice to be heard across the nation. Together we make a huge difference and work to get things done for you. If you are ever concerned about an issue or see a wrong that needs to be righted for our industry don’t hesitate to call us. Temporary Furnished Housing Made Easy
I
t’s that age old problem, where does a family stay (comfortably) for an extended period of time, when they need to vacate their house during remodeling, disaster or between homes. Of course options like family, friends, extended stay hotels and the like could be a consideration, but problems such as wearing out your welcome or too little space are just a couple concerns that can make these less than desirable choices. It’s also difficult to find a quality apartment to rent for a short period of time and the hassle and expense of setting up utilities and moving furniture are often deterrents. Enter HBANKY member Schilling Properties and their Valley View Temporary Housing solution. In 2006 when Schilling Properties purchased 8 buildings and 96 apartment/condo units in Crestview Hills (near St. Elizabeth Medical Center), part of the master plan was to offer a number of furnished units to companies and individuals who needed high quality temporary furnished apartments. Schilling Properties saw a need for large, furnished and equipped apartments; partly due to a partners experience in the extended stay hotel business. And, while the 300 and 400 Square Foot rooms with kitchenettes offered by most extended stay hotels work well for many individuals and couples, they saw a demand for large furnished apartments to serve the needs of families and people who needed more space for longer periods of time. With their experience and patience, they have been able to slowly grow the number of furnished units and now offer 25 high quality, fully furnished and equipped apartments. Units all exceed 1,000 Square Feet and they offer 2 and 3 bedroom units; each with 2 baths, walk-in closets, fully equipped kitchens, washer & dryer in each unit and more. Their pricing includes all this space, along with cable TV, high-speed internet, phone and all utilities. Just like a hotel, guests need only bring the clothes
and personal belongings they need; everything else if furnished. The minimum stay is 30 days and pricing is based on the size of the unit and the length of stay. The longer a guest stays, the lower the price. In discussing this service with Linda Schilling – General Manager, she pointed out a few important factors that many guests fail to consider when trying to find temporary housing. First is the hassle factor; she said that many people are looking to save a few dollars but they fail to consider things like utility costs, wear and tear from moving furniture and the comfort and psychological effect living away from home has on a family. She related a story about a man who came in last fall and said he was building a house and needed a place for “just couple months,” since the builder estimated they would be in their house by Christmas. He balked at the cost and in a follow-up phone call, she learned that he was able to find an apartment to rent on a short lease. He did admit it was much further away and not as nice, but since it was only for a couple months, he was just going to bring a card table and chairs and his family would all sleep on air mattresses. Linda said, “I remember thinking that his wife and kids were not going to be very happy and that based on the fact that they hadn’t even broken ground, I could not see any way he would be in that house by Christmas”. She said “the building site was on the way to a relative’s house and each time I passed it, I thought about his wife and family. I think they finally got into that house around Easter, I just hope they were still speaking to each other when they finally moved.” Linda let us know that their company owns and manages the units at Valley View; they also own all the furniture, electronics, appliance and linens used to furnish each unit. This allows them to maintain a very high standard. They also have a loyal following of companies both in Northern Kentucky and nationally, who relocate employees or bring them to town for long term assignments, where temporary housing is required. This is in addition to many local families who rent furnished units during renovations and relocations. KENTUCKY FEDERAL S&L OFFERS TIPS DURING LOW-INTEREST-RATE PERIODS ith interest rates at record lows, consumers face a number of choices for managing their money. Whether they want to save, spend or invest, consumers are encouraged to consider their options and choose the strategies that best suit their particular financial circumstances. Kentucky Federal S&L offers the following tips for low-interest-rate periods: 1. Make large purchases now. If you’ve been thinking of making a major purchase like a house or a car, today’s low interest rates make it a good time to finance big-ticket items. However, make sure you have a good credit record and can pay off the loan before applying. 2. Fantastic financing choices available. Two options to consider for qualified applicants are, USDA no down payment loans or Lender

Paid PMI loans which is a low down payment loan option. Of course, borrowers who have a 20% down payment have a more flexible array of financing options. 3. Consolidate debt. With interest rates at historic lows, it makes sense to consolidate debt into one low-interest loan. For example, if you have outstanding balances on several credit cards, consider transferring those balances to one credit card with the lowest interest rate. If you qualify, it may be a good time to apply for a home equity loan to consolidate debt or make a home improvement. Banks have been easing lending standards, so it may be easier to qualify today than it was a couple years ago. 4. Shop around for credit cards with the best interest rates. You may be able to get one with better terms than the one you are currently using. Or, ask your credit card issuer to lower your interest rate to make it more competitive. 5. Know your credit score. Before you apply for any loan or credit card, check your credit report and learn your credit score. The higher your credit score, the better interest rate you will qualify for. To improve your credit score, pay down your balances, remove errors from your credit report, and pay bills on time. 6. Keep saving. Just because standard savings accounts aren’t paying a lot of interest now doesn’t mean you should stop saving for your future. Your savings will still accrue, you’ll be less likely to spend it, and you know it will be safe. If you can afford to lock up your money for a while, longer-term Certificates of Deposit (CDs) pay the highest interest rates. “Low-interest-rate periods offer a variety of opportunities and challenges for customers deciding how to manage their money,” said Glenn Meyers, EVP. “Customers should never take on more debt than they can afford to repay, but this could be a good time to consolidate debt to make payments easier, or make a home improvement you’ve been thinking about for a long time,” he added. Customers who are unsure of how to take advantage of the current low-interest-rate environment are encouraged to speak with their local bank representative.

REMODELER’S COUNCIL WHAT’S HAPPENING??
Code Issues: The new International Energy Code will go into effect on October 1, 2012. The N.K.A.P.C. started energy inspections on July 1 to help remodelers get used to what they are looking for in the inspections. The new Kentucky Building Code will go into effect on January 1, 2013. The Building & Housing Codes Committee will continue to meet with inspectors the remainder of this year to discuss the new changes. If you are experiencing any code enforcement issues or have questions about these new Codes, please contact Brian Miller at the HBA office.

The early bird deadline has passed and the final deadline for entries is August 3. We hope to have several projects in Cincinnati again this year.
